Elroy man receives probation for domestic violence charges BY EVA MARIE WOYWOD

CRAZY WEATHER MIX Early Tuesday morning the commute was met with dense

fog after an overnight thunderstorm. All area schools also faced their second day of a two hour delay. Late Tuesday evening the temperatures began to drop and as of press time, the area was expecting six inches of snow. The weather service, as well as law enforcement, urged drivers to take extra caution and allow plenty of time if you must travel at all.

Missing child results in charges BY EVA MARIE WOYWOD In last week's issue we reported on a child custody case that has turned into a missing child report. On the very day the Messenger article ran, Juneau County District Attorney Michael Solovey filed a felony charge interference with custody beyond visitation and a warrant was issued for the arrest of 35 year old Kevin J. Tadder. Tadder is a mixed martial arts cage fighter and his whereabouts are unknown. The child that is missing is Loggenn (pronounced

Logan) Tadder, an almost three year old blonde haired and blued eyed little boy. His date of birth is April 23, 2010. As we reported last week the mother has stated that the last time she saw Loggenn was in August of last year. She has further stated to the Messenger that she contacted authorities and was told the matter was a custody issue. In September of last year a hearing was held and Tadder was ordered to turn over the child to the mother on September 27. According to the mother that exchange never happened. She has stated to the Messenger that she was again told by authorities the matter would need to be handled in family court as it was a custody issue. Court records show that she motioned the court in October that Tadder be found in contempt. Since that time the mother has claimed she has attempted

on numerous occasions to report her child as missing. Those attempts she has said were made via phone calls to the Mauston Police Department, in person, and when she made contact with officers while out in the community. The mother claims that on January 2 of this year the Mauston Police had her sign a written statement on her missing child. It was on January 19 when she approached the Messenger stating she was frustrated and felt no one was taking her seriously in her reports of her missing child. The Messenger contacted the Mauston Police Department on the morning of Monday, January 21, 2013 to inquire on the status of the missing child report. At that time we were told the officer handling the case would not be back on duty until Wednesday the 23rd and would be working second shift. We were also told

that Chief Messer was not in. At 12:01 on Monday, January 21, Chief Messer left a message responding to our inquiry and stated that the child was entered as "missing" and recommendation for charges would be forwarded to the Juneau County District Attorney. The mother of the child has since informed us that she too had received a phone call on Monday, January 21. She stated the officer handling the case phoned her at approximately 11:45 a.m. to inform her the child was entered as missing and charges were being recommended. The system in which the child was entered into as missing is known as the National Crime Information Center (NCIC) and the Wisconsin Department of Justice Crime Information Bureau (CIB). Both are data bases available to law enforcement agencies. See CHILD, page 5

In court on Tuesday morning 53 year old Keith Herritz of Elroy was sentenced to one year probation on a misdemeanor battery charge for a domestic abuse incident that occurred in June of 2012. He is also ordered to attend anger management classes. Three other charges were dismissed but read in. Those charges were felony strangulation and suffocation, felony false imprisonment and misdemeanor disorderly conduct. All of which were charged originally with a domestic abuse modifier. The joint recommendation plea agreement came during what was originally scheduled to be a preliminary hearing. Herritz was represented by defense attorney Daniel Berkos. Assistant District Attorney Clifford Burdon and Judge Paul Curran presided over the hearing. According to the criminal complaint the charges stem from a June 2, 2012 incident where when Juneau County deputies arrived on the scene, they were met by a female who claimed Herritz had hit her on the hip with a large frying pan, struck her open handed in the face, and proceed to choking her. Deputies noted in the criminal complaint that they saw a red circular mark on her hip and marks on her neck. Herritz does have a past criminal history which includes multiple past convictions of battery, an operating with PAC .02 or more 4th offense, and a 1992 misdemeanor 4th degree sexual assault in Dane County.
