Ex government minister Lillian Boyce leaves court on day two

Misick Government’s import concessions cost TCI $42m

GENEROUS import concessions granted during the tenure of former premier Michael Misick cost the country $42 million, court heard on Tuesday (January 20). Day two of the SIPT trial also revealed allegations that a five year failure of the Misick administration to tighten up corruption laws allowed ministers to “abuse” their position for their own financial gains.

Crown prosecutor Andrew Mitchell told the court that despite campaigning on an anti-corruption ticket in 2003 Michael Misick and his Government dragged their heels for five years while taking advantage of the system to line their own pockets. Between 2003 and 2008 ministers were simply required to fill out a form declaring their interest with no

independent scrutiny or inspection. The front page of the 2005 Register of Members Interests was drawn up by hand and the members entered their interests in their own handwriting. During the two years between 2007 to 2008 and 2008 to 2009, waivers given to those importing goods came to $42 million and were not published in the Gazette, contrary to Government guidelines. Mitchell told the court: “It was not until April 2008 that the integrity ordinance was finally accepted by the governing party as something which needed to be implemented. “The Crown’s case is that by then the damage had been done, the politicians had become wealthy and the blunt instrument of the members’ interests ordinance had not done its job. “There was no one to police it and it was simply filled in by the ministers whether they wished to or not as is shown by Michael Misick and McAllister Hanchell declaring nothing in the 2008 register.” The prosecution also told the court that there was rampant overspending and disregard for due process within the PNP during Misick’s tenure. This was in part due to his “aggressive” pursuit of promoting the tourism industry and expanding development. During the same time period the prosecution alleged wide ranging bribery was taking place, dressed up as donations to the PNP. Mitchell added: “The defendants who were politicians were able to

exploit dishonestly the holes in the system. “Significant sums of money were paid into the party accounts and on the overwhelming part these were bribes. “This reached a peak between 2006 and 2008 when they received a total of $11.3 million in donations. “This in a country were the electorate is no more than 6,000 or so, no person making anything more than a few thousand dollars worth of a donation can be legitimately taking part in the electoral process. “These donations were for the purposes of gaining an advantage. “The Misick Government aggressively pursued the development of condos and the sale of land with no regard to good governance and it meant that receipts for Crown land sales which were supposed to be allocated to capital expenditure became revenue expenditure. “This is because of consistent over spending by ministers, the Premier in particular was not scared to spend a few dollars more than his budget allowed. “No one could criticise a premier that wants to promote the lifeblood of the country but he spent increasingly lavishly on his own personal account and also used his wife for advertising campaigns.” Mitchell said that ministers also applied pressure to the man appointed to independently assess the value of Crown land, a Shaaban Hoza. The issue of not obtaining full

market value for land became a heated issue in meetings between Government ministers and former Governor Richard Tauwhare who raised the issue on several occasions just months after being appointed. Mitchell said: “At all material times in this case Shaaban Hoza was the chief valuation officer, he had an obligation and duty to act in the best interest of the Islands and ensure land was sold at the highest proper value. “The ministers abused their position, acted inconsistently with their duties and subverted and frustrated him. “They applied pressure to him to lower his valuations and did not give him the information he properly should have had.” Mitchell also told the court that Tauwhare “did not know” that ministers were making money from these transactions “behind his back” and therefore considered their arguments to lower the price of land to be genuine. The court also heard that the Misick administration granted “unprecedented” concessions to Beaches when they agreed to construct their resort at Grace Bay. Beaches was granted a reduced rate of import duty for materials to build and maintain the resort for a period of 25 years, something which had never before been granted. During the same period of time concessions on stamp duty for the development of Beaches totalled $1.2 million dollars. The trial continues.

Former premier Michael Misick arrives (with lady friend) to face charges he defrauded the people of TCI out of millions of dollars

Misick finally stands trial in ‘pay to play’ corruption scandal BY JOHN TONER FORMER Premier Michael Misick has finally faced the corruption charges which have dogged him and the country for years. Along with his eight codefendants, Misick is charged with a wide ranging conspiracy to defraud the people of the Turks and Caicos Islands out of millions of dollars. Floyd Hall, Lisa Hall, Clayton Greene, Lillian Boyce, McAllister Hanchell, Jeffrey Hall, Thomas Chalmers Misick and Melbourne Wilson all appeared alongside the scandal hit former leader at the specially converted SIPT courthouse in Providenciales on Monday (January 18). The 17 count indictment alleges that all nine played a part in the selling of Crown land with ‘criminal disregard’ to the Crown Land Policy and for the specific purpose of personal financial benefit. It is said that land desired by investors was sold to Belongers at the discounted rate and immediately ‘flipped’ and sold to investors at market rate with members of the group pocketing the difference. Prosecutor for the Crown Andrew Mitchell QC told the court: “The

Cabinet ministers loyal to Misick during the period between 2003 and 2009 were the beneficiaries of payments totalling millions of dollars paid to them or to the PNP. “The money was received from the potential or actual developers and or Belongers who had obtained Crown land for which they were to jointly profit. “This happened under the guise of the Crown Land Policy which was intended to freely and properly empower Belongers with access to the main resource on the islands, land. “It was not designed to give to the privileged few financial reward. “The consequence of this is that the TCI Government and citizens lost money they might otherwise have received. “The defendants undermined, ignored and usurped all of the country’s institutions designed to protect it against this sort of activity. “There is a remarkable symmetry of access to money from a base in 2003 to a peak in 2008, the defendants were enriched beyond the wildest dreams that a politician should have and which would not have been available to them simply through their ministerial roles.

“The conduct of the defendants can be summarised in this way bribery and corruption. “Prospective developers were encouraged to pay monies in order to procure development rights, protect their investments or gain advantage. “The Government ran itself almost like a protection racket, if you can’t pay, you can’t play. “The defendants encouraged an environment in which bribery was encouraged for normal development to talk place, this has been described as ‘pay to play’.” The court heard that Belongers sometimes unwittingly received cheques in their name worth thousands of dollars after their name had been used to buy land which was then ‘flipped’ to a developer. The Crown also said that during the six year time period a total of 6,000 Belonger land purchase applications went unanswered during the rampant corruption alleged. In one incident it is alleged that $73,500 of a loan paid to the PNP was used to clear Misick’s overdraft. In January 2006 it is said that $23,400 of PNP funds were debited from the PNP account to a stylist

specifically to style the former premier’s wardrobe. The same account was also allegedly used to pay for a boat charter for Misick’s then wife and nine of her friends costing $110,000 with $150,000 being debited for furnishings in the newly built Misick mansion. During the period between 2002 and 2010 the PNP received $13.5 million, eight times as much as their nearest political rival PDM, for ‘electoral purposes’. The Crown says that the former members of the PNP used this money to fund their lavish personal lifestyles rather than for the political advancement of the party.

During this time former Governor Richard Tauwhare was in office and Mitchell put it to Judge Harrison that he will have to decide whether or not he was ‘blind’ to these activities to which the judge responded: “Or shutting his eyes.” The first day of the long awaited trial went smoothly despite interruptions from smart TVs installed in the court room which began speaking randomly on two occasions. The defendants deny all charges against them and if found guilty they are facing potentially significant jail terms. The trial, expected to last six months, continues.

TURKS AND CAICOS WEEKLY NEWS

A Weekly News column that puts you on the spot for your opinions on the issues of the day

PROUD OF THE LOAN?

THE TCIG has arranged what they say is a $28 million loan. This is the reported balance after paying down the $170 million loan. They are reporting the loan is for three years and has a fantastic low interest rate of 1.2 percent. What do you think? Is this a source of pride as Premier Ewing says?

It’s a shame

If a great portion of the money is used to pay for the trial of former ministers and their friends and relatives there is no sense of pride there. We the people are still losing as we paying for those accused too many times. No sense of pride here. It’s a shame.

We have suffered

There is no cause for celebration because the

money was taken from our people. For three long years we have suffered. From missing toilet paper in the schools to massive flooding due to missing drainage in the hastily constructed roads of Downtown Provo. Where is the thanks to the people who are suffering? How can the Royal Bank of Canada offer us with a BBB+ rating a 1.2 percent loan? Their best AAA customers are currently paying 2.7 percent. Why is the loan only $28 million? We understood the sinking fund was less than

$100 million. We still have three years of high payments to pay off this new debt. Debt from the reckless spending of the PNP. We are now known as a highly taxed country. Thanks to Ewing, Washington and Mike Misick.

Yet another debt

Yet another debt. We have the Ewing hospital mortgage at a reported interest rate of 12 percent. This is costing us $12 million per year for a total of $240 million. We also have the Ewing InterHealth contract obligations for 20 plus years - $600 million at $30 million per year. We have yet to hear what loan has been taken out to build Akierra’s long overdue high school and its principal, teachers, furniture and supplies. Now we lay another $10 million obligation on us for three more years. No wonder we cannot get inward investment with our high taxes to pay down all these PNP created debts. Now we hear Washy wants to sign us up for the VAT tax. God save us.

Not progress

We were born in Lorimers many years ago and now live in Florida. We want to come home but cannot find work. More debt on top of debt all paid for by huge taxes and no inward investment as a result of years of the progressive party ripping off the people to pay themselves huge salaries and drive fancy cars to show up and drink wine with the rich tourists. We have scared off every potential investor because of solicited bribes, purchased

elections and high taxes. Now it’s more debt with no reserves. Better hope the visitors keep coming. We don’t call this progress!

Lucky to be a B

Firstly, I must say that this is nothing to be proud of. Yes it is a good interest rate. After all Premier Ewing’s party caused the country to default by stealing and monetary mismanagement. The country’s finance was badly mismanaged. In other words abuse of authority, stealing, abuse of the country’s money. Now we have to borrow to pay it off. Let us all be cognisant of the fact that if England didn’t step in we would be like halfdead roaches on our backs, kicking, trying to turn over, just like the other poor Caribbean islands. Independent, no economy, no resources and we wouldn’t have a B rating it would still be D.

We are not fools

We should not view this as a source of pride. The Government spent three and a half years doing nothing while the people of the country suffered. They continue to tell the people that their hands were tied when it came to spending money on such things as roads, Government buildings, schools and host of other things that would have benefitted the country. Now that we are in an election year they are trying to figure out how to fool you by starting some of these things instead of paying off the loan completely which would mean no more interest payments whatsoever.

Mixed reactions at new building height consultations BY OLIVIA ROSE CONSULTATION meetings to garner feedback from the populace on the proposed amendment of the existing building height and density has generated mixed reactions from stakeholders as the five day meeting concluded last Friday, January 15. The Office of the Premier in collaboration with the Ministry of Infrastructure, Housing and Planning hosted meetings for key stakeholders and the general public from January 11 to 15 at the Environmental Arts Centre, the Bight, Providenciales. Key stakeholders were grouped and notified of the date and time to which they could make representations prior to the meetings. An additional meeting was held on Thursday, January 14 for the general public to make representations on

the amendment of the building height and density at the Gustarvus Lightbourne Sports Centre in Providenciales. At this meeting a small but energetic group voiced their concerns. This meeting spawned mixed reactions as many welcomed the concept of 12 story development while others openly rejected with sound reasoning. Those in attendance were Premier Rufus Ewing, Minister of Finance Washington Misick and Minister of Tourism Porsha Stubbs who all listened attentively to the opinions of those gathered. Hotelier Emma Selver said: “Why is the plan to follow what these other countries do? “The Bahamas, the Cayman Islands, Jamaica.” Other hoteliers weighed in and

rejected the idea saying that there is a place for that type of development but not in the Grace Bay area. “Our guests tell me over and over again, they come here, they don’t go to South Beach or San Juan because we’re not like that and as soon as we become like them we’ll have to consider our long term future.” For many others who were not sure which side of the debate to choose they said that whatever comes from the proposed development, Turks and Caicos Islanders should benefit. The lack of consultations with the public on the building height has led to national criticism. Speaking to the media Assistant Director of Planning Toriano Williams, said: “A little bit of history and background as it relates to the changes in building height in Turks and Caicos is that in 1996

the building height was changed to three storeys, in 1999 it was changed to four storeys and in 2001 to five storeys and in 2004 to the seven storeys that we have now. Williams noted that there is currently a budget in place for a fiscal national development plan that will dictate where, when and how development should take place. Attempts by the Weekly News to contact the Minister of Infrastructure, Housing and Planning Amanda Misick for a comment on the way forward proved futile. The consultation meetings came after the Supreme Court’s decision in November 2015 to halt construction plans for a 12 storey high rise building after a joint complaint was filed by the proprietors of The Tuscany and The Venetian luxury condominiums in Grace Bay.

Clayton Greene is said to have acted as a private banker for corrupt ministers

Ralph Thorne QC (right) making himself heard to SIPT defendants outside court

Dodgy account set up for minister’s land profits BY JOHN TONER AN ATTORNEY created a bogus client account specifically to hide money being passed to a minister for the sale of Crown land, court heard on Wednesday (January 20). Clayton Greene allegedly cooked up an account in the fake name of John Doezer for the sole purpose of passing cash to Floyd Hall for his role in the sale of land at Water Cay. A Belonger by the name of Aulden ‘Smokey’ Smith was used as a front

to buy the five acre plot of land at a heavily discounted price of $150,000 in January 2003. The Crown said he borrowed money to buy the land from Ashley Properties, a firm Floyd Hall had an interest in, and then immediately sold it on to Aquarius Holdings for $2.5 million. The SIPT court was shown a client ledger which appeared to show Greene dishing out money from the sale to various people including, and mostly for the benefit of, Hall.

New regional president appointed to Methodist church conference REVEREND Theophilus Rolle has been elected to serve as the next bishop and president of the Bahamas, Turks and Caicos Islands Conference of the Methodist Church in the Caribbean and Americas (MCCA). The youthful Bahamian clergyman was born in James Cistern, Eleuthera, and after his acceptance as a candidate for the ministry in 1991, he studied at the United Theological College of the West Indies in Kingston, Jamaica. He has served in several circuits in the Leeward Islands District Conference and is presently Superintendent Minister of the Grand Bahama Circuit. He is expected to take up office as bishop and president from September 1, 2016. Rolle is married to the former Evona Niles and the couple have two children, Ebony and Theus, both students of St Paul’s Methodist College. The growing influence of women was in evidence in the election of officers during the

Reverend Theophilus N Rolle

annual session. Esther Joy Sargent, circuit steward of the Nassau Circuit, became vice president while the Reverend Claire Robinson became the first female minister of the Gospel to be elected secretary of the conference and will be assisted by Rev Emily Demeritte of the Nassau circuit. Wilbur Caley, of the north Turks and Caicos Islands circuit, and the Reverend Kenneth Lewis were re-elected as treasurer and assistant treasurer respectively.

A letter from Greene’s law firm, Stanfield Greene, to the Royal Turks and Caicos Islands Police Force was shown to the court admitting this, it read “we make it clear that the account was for the benefit of Floyd Hall”. Prosecutor Andrew Mitchell told the judge: “From that the Crown are able to say with a degree of confidence that the account was opened by Mr Greene for the benefit of Floyd Hall. “There is a clear inference that Floyd Hall benefited directly from the sale of the land and there after benefited from monies that otherwise would have gone to the Government. “He must have known that the

Government would be losing out and that he would gain a personal advantage. “The purpose of this account was to hide the true recipient of the monies, Greene was effectively acting as his private banker. “It is highly unusual for an attorney to allow a client to run a debit account.” The third day of the trial was delayed and interrupted repeatedly as defence counsel for numerous defendants persisted to interrupt Andrew Mitchell QC during his opening despite having months to raise objections to the document and failing to do so.

Under the tree

Proceedings had also initially been held up in the morning after several defence counsel moaned at length about the prosecution making verbatim notes of their opening available to the press at the end of day one. After lengthy submissions, from Thorne QC and Witter QC in particular, Judge Harrison dismissed their objections and told all defence counsel that if they have concerns over incorrect press coverage of the trial it should be brought to his attention and he would deal with it. All defendants deny all charges against them. The trial continues.

Seven Stars investor made huge payments to ministers BY JOHN TONER THE WEALTHY backer behind the luxury Seven Stars resort made large cash payments to Government ministers before, during and after he got special concessions for the project, court heard on Thursday (January 21). It is alleged that Varet Jak Civre paid $50,000 from his investment firm Precon to Paradigm Ltd, a company he and Floyd Hall both had an interest in, on March 27, 2003. Just a few days later $20,000 was sent to the PNP, who were not in power at the time, before the funds disappeared. The Crown’s case is that Civre was paying money to Hall, which Hall was then distributing to other members of the PNP as a form of bribery. At first this was for Civre to gain Belongership and naturalisation, and then later to get the planning concessions he wanted for the Seven Stars resort.

The court was shown letters of endorsement bearing Floyd Hall’s name in which Civre was recommended for Belonger status and later to become a naturalised British subject. Lead SIPT prosecutor Andrew Mitchell also claimed that $100,000 was paid by Civre to Paradigm Ltd and $50,000 was then credited to the PNP on July 16, 2003. That $50,000 was then carved up between Michael Misick and Floyd Hall who each received $25,000 cheques from the party account on the same day, it is said. Mitchell told Judge Harrison, who acts as both judge and jury in this case: “The Crown says Mr Civre was seeking to develop dependency with Michael Misick and Floyd Hall so that should they win the coming by elections and come to power they would be in a position to act on his behalf. “There is no legitimate reason that, on the face of it, a man would wish to give such significant amounts

Floyd Hall, deputy premier during the Misick years, is alleged to have been a major player in the corruption

of money.” The court heard that Civre made planning applications for the Seven Stars site which exceeded the regulations in place at the time. These applications were duly granted along with other concessions once the PNP came to power. Civre wanted to build the resort seven stories high but at the time the rules only allowed for five stories, however, the PNP executive committee waived his plans through following the alleged corrupt payments. Mitchell also showed the court documents which apparently show Civre paying $250,000 to Saunders

and Co, whom Michael Misick was a consultant for at the time, with the reference “commission of land sale”. The money was returned to Civre’s bank account but then the same sum was sent to an off shore bank account held by Michael Misick in Miami. Mitchell continued: “That is money being sent by Mr Civre to the chief minister some ten days or so later, after various concessions have been agreed on the Seven Stars project. “The proximity and timing of payments and the various concessions are evidence of Michael

Misick taking monies in order to offer advantage.” The fourth day of proceedings had been in danger of descending into farce as time and again Andrew Mitchell QC was interrupted by objections from defence counsel, many of which ought to have been raised during previous preliminary hearings before the trial got underway. Eventually Judge Harrison told all defence counsel to go away and read the remainder of the prosecution opening and make any further objections to the court in writing first thing on Friday morning. The trial continues.

SMEs to benefit from more loans in 2016 BY OLIVIA ROSE SMALL and medium-sized enterprises (SMEs) in the Turks and Caicos Islands will benefit from increased access to loans as TCI Payday Loans Ltd works feverishly to roll out tailored loan products in 2016. The micro lending company has been providing loans to some small and medium-sized business enterprises which has helped to stimulate business activities within the SME sector in the country. Director of TCI Payday Loans Victor Lowe during an exclusive interview with the Weekly News on Wednesday (January 20) said this year the company is looking to tailor loans to meet the needs of SMEs. “The SMEs is an emerging economy in many ways and we’ve seen whereby the tourism sector and the hospitality sector continues to grow and flourish but that requires large capitalisation.” He explained that the service sector will have to expand to support the growing tourism sector. However traditional financial institutions are not as aggressive in fostering and supporting the SME sector, Lowe said. “That’s where TCI Payday comes into play. We understand small and medium businesses, and we understand their needs and so to that end we see a viable business sector and we lend support to them both financially and from an advisory

perspective because we do have that skill set in house.” Lowe noted that TCI Payday Loans has stepped up to the challenge and has been providing much need support to these businesses. “They are also encouraged by the mandate of Invest TCI because it goes hand in hand with our objective lending support to that sector and there’s great compatibility there so we intend to increase our lending pool to that sector . “The criteria for qualification would be significantly different from the more traditional payday loans business model. “With the payday payroll deduction we had collateral protection in a payroll repayment on the loan facilities we provide. “In the case of the SME we have to evaluate the business in terms of the performance or in some cases performer to qualify them based on the strength and ability to repay the receivables or other facilities that they may have. “We will pay attention to their cash flow, and we review their bank statements or any other support systems that speaks to the cash flow strength of the business, their contracts, and suppliers. “We will also be looking at using those contracts as collateral and that will lend to protection, but it’s very critical that someone steps up to the plate in an manner that speaks to the need of SMEs.” Lowe said that he is pleased

with the adjustments made by local companies to provide payroll deduction facilities, a requirement of TCI Payday Loans, in order to help support the financial needs of their employees. He indicated that employers benefit from the reduced stress on cash flow and time consumed by payroll departments that can result from employees borrowing from the company to meet their short-term emergency financing needs. According to Lowe the company since its introduction to the TCI in 2015, has been providing a formal channel for residents to secure short term loans. He noted that compared to the traditional lending institutions, TCI Payday Loans provides several distinct advantages which have been embraced by its clients who continue to express their appreciation for the easy qualification, flexibility and convenience of the process. In addition to the general availability of such a lending facility, TCI residents have been using the enhanced features of online applications and documents submission offered by the company. He said: “We are investing in technology that will provide a seamless platform for borrowing and repayment of loans using smart phones. “The streamlined loan application process, affords borrowers from Grand Turk, South, North Caicos and the other islands, to conduct

business without visiting our office.” Another feature of the service that has been welcomed by the populace is the introduction and access to a personal international Mastercard with the disbursement of their loans. He noted: “All unlending by TCI Payday Loans is done by means of a Mastercard debit card, thereby providing the benefits of security, ready access to cash withdrawals and purchasing flexibility to the borrower.” The company’s non-cash business model allows all unlending to take

place through each borrower’s newly issued Mastercard. This provides the further benefit of a secure work environment for TCI Payday Loans staff, as there is no cash management at the business location. He reiterated the company’s commitment to strict adherence to best industry practices, regulatory guidelines and the delivery of quality service that is focused on strong client relations as a benchmark of its product offering.

The transformational role of the training officer THE TRAINING and development of managers and staff has taken on a new dimension, with increased activity in the business field, and education. Also the emphasis on aligning training with the vision of the organisation sees the role of the training officer as important in bringing this about. A recent advertisement in the TCI Weekly News for a training officer for the Royal Turks and Caicos Islands Police Force brings to the forefront the transformational nature of this function. The advertisement is easy to follow. It mentions the management role of the job holder, networking and designing of programmes, so essential to the function, and the reporting function, which stresses the accountability requirement of the post. Everything about the advertisement is precise and relevant to the job. It is well crafted and professionally done. Much credit is due to those who were responsible for putting it together. All this goes to show that the training officer is a change agent. have a creative approach to current and new influences that would enhance the competence and integrity of police officers and other staff. Furthermore, the training programmes should impact positively on the attitudes and dispositions of officers, be presented in a way that engages course members and the topics should be relevant to the findings of the needs analysis exercise. To be a transformative agent also requires that the training officer ensures results align with objectives and determines where revisions to the process are necessary. This facilitates the transformation of the organisation and its members. The training officer’s change agent role should also be to enhance the performance effectiveness of staff by producing motivated participants, and recognising individual differences. The environment of training should match the objectives of the

programme too. This encourages active participation. Also, the creation of a culture of self-belief, reward and recognition further strengthens commitment to the organisation and its mission. Another transformational role of the training officer should be assisting with the conception, formulation and implementation of a training policy. The policy is a guide and strategy for directing the strategic path the organisation wishes to follow and should be available to the staff in general, and important elements be discussed with its members. They will then be clearer about what is expected of them and feel integral to the process. Their view of it will be further informed. Seeing the training officer’s role in this light will definitely result in a more efficient organisation and a capable, supportive and satisfied staff.

An award ceremony was held at the school in Providenciales on Thursday (January 21) to acknowledge Achsah Wildish on a job more than well done. The service commenced with the singing of the national song, ‘This land of ours’ and then with the opening remarks of vice principal Anthony Wilkinson who commended the young achiever for such an extraordinary accomplishment. Wilkinson said that the award recognised talent, dedication and commitment of both learners and staff. He said: “This is an outstanding achievement for Achsah. “Not only did she score 100 percent in a particularly challenging subject, representing our small school in our small island state she has surpassed the performance of students in countries such as India, China, Korea and Singapore who have tended to dominate the field of mathematics.” Wilkinson said that Achsah was an immensely talented and well balanced young woman. “We at BWIC, and all of us in the TCI, are extremely proud of her success, and the honour and recognition she brings to these shores,” Wilkinson said. When Premier Rufus Ewing took the podium, he said that that this accomplishment was not an easy one. He said: “This is certainly something that came with hard work from the student herself and it came

from hard work from the parents. “To the teachers and the staff of the British West Indies Collegiate, I congratulate you.” Achsah said that she was overjoyed with the news and surprisingly, only found out during the actual ceremony. She said that one day she hopes to own her own business in financing. Words of recognition were brought by Wilkinson and founder member of TCI Education Foundation, Dr Euan Menzies. Closing remarks were brought by founder member of the TCI Education Foundation, Carl Simmons. Cambridge programmes and qualifications are taken by learners in more than 10,000 schools in 170 countries. They are recognised by universities and employers around the world. Formed and operated by the TCI Education Foundation, a charitable organisation incorporated in 1993, the British West Indies Collegiate is a private international secondary school whose founding ethos is the provision of education of the highest possible quality for the children of Turks and Caicos as well as those who come to reside in the Islands. Government scholarships are available for sixth form study at BWIC to enable students in the TCI access undergraduate university education in the United Kingdom, United States, Canada and elsewhere.

Long Bay High School to host first pageant BY DAISY HANDFIELD TWELVE students from Long Bay High School in Providenciales will be participating in the school’s first Mr and Ms Long Bay High pageant, under the theme, ‘A blast from the past’. On February 11 the students will compete in fashion rounds where they will be showcasing casualwear, sportswear and elegant wear. They will also participate in a talent and question and answer segment of the competition. Principal of the school Carlton Mills said that he was excited about the event and was eager to see the students succeed. He said: “The Long Bay High School is also about preparing our students for life. “We feel that events of this nature give them an opportunity to express themselves through dance and the creative arts. “This could also lead to career choices for them.” In an interview with English teacher Charvis Ferguson on Thursday (January 21), she said that she was looking forward to the pageant. She said: “I feel like it’s a great endeavour for the school that students are able to showcase their CONTINUED 

A colonised mind

THE CONSEQUENCE of colonisation throughout the world has had far reaching results that we must come to grips with here in the still colonised Turks and Caicos Islands and the wider Caribbean for that matter. The system was pretty simple and straightforward. Squeeze as much natural resources etc as possible out of the colonies for as little cost as possible and send the riches to the Motherland. These ideals still exist in the form of capitalism, as well as in many countries in the Caribbean where we traded in the Motherland for a local benefactor. These local benefactors could be political parties and their associates, ‘prominent’ families, businesses or other examples. You have many angling for the opportunity to eat from the people’s trough or more importantly control of who eats at all. How can my brothers and sisters from independent Caribbean countries say they are truly independent if their leaders continue to practice the same ideologies many of their founding fathers fought against? Have we truly emancipated ourselves from mental slavery? We are running a race that was not invented by us nor was it for the benefit of us. Think about it, many if not all

BY JAMELL ROBINSON of the so-called first world countries have or continue to benefit from the natural resources of so-called third world countries. The designation of a third world country has always made me laugh because it suggests such a separation that first world is so much better. Why? Because they have cities built off the backs of slaves or indentured servants? Has any third world country ever made it to first world country status or been recognised as such? How about moving to second world status? No, you have never heard of that either. So these false designations are just to keep the order of things. And for the politically correct amongst us, we now use developed and developing countries or states or emerging markets. So what does all of this have to do with the TCI? As I said in the article,

‘The power of one,’ we believe that only one person could specialise or be the go-to person in any given area. What I didn’t mention was that this mentality is the legacy of colonisation. How? Simply because if the persons being administered believed they had the capacity to do what their overseers did, they would likely be harder to control as they would soon realise the overseer was no longer needed. So as with many things it has to be one person at a time as we don’t believe we can have several successful persons at the same time. As a result you have persons in authority believing that they are where they are simply because they are special and are a gift to the TCI. I’m sure we all can identify several people that fit the bill. What they don’t get is that their positions are more a product of opportunity. The saying goes that ‘luck is when opportunity meets preparation’. This is true, however, no matter how prepared you are without the opportunity you are not getting anywhere. Another consequence of this type of colonised mind is that we do not believe in each other’s ability and must rely heavily on what is foreign, or as the saying goes, ‘foreign is better’. This mentality and way of thinking

is flawed and is prevalent throughout the Caribbean, such that not only do we believe foreign is better in terms of the use of North American or European ‘experts’ and I use the term expert loosely, we have an unwritten pecking order of who believe they have the most sense in the region. There is nothing more interesting than seeing a Jamaican, Bajan, Bahamian, Trinidadian or Saint Lucian flexing their aptitude in a regional forum, each trying to assert their supremacy. But then again we have been divided into the Greater and Lesser Antilles so it is a wonder the Greater actually believe they are greater? But I digress. So can we in the TCI do what many of our independent regional brethren have not done in overcoming a colonised mind? Yes. Will it be easy? No. Nevertheless the first step in any treatment plan is to identify the problem. Therein lies this article. We have work to do in believing not only in ourselves but also believing in other Turks and Caicos Islanders potential, ability and aptitude. If you haven’t heard it, I’ll be the first to say it. I believe in you. Be blessed.

COMMENTARY

To tell the truth

HONESTY is the best policy, they say. In the TCI people are confused and frustrated, seeking honesty. Why is it that this Government brags about huge surpluses and then has no money to spend? Basic needs are unaddressed. Mould in the container classrooms is ignored. Our Education Minister claims she was aware of the mould. The truth is she became aware after the Opposition leader revealed the problem. Minister Akierra Missick then tells us she can’t clean mould because the $39 million surplus was used up by something called the ‘sinking fund’. She stops short of admitting why we have a sinking fund. The truth is Mike had squandered hundreds of millions

BY DAVID TAPFER

David is a retired mobile hydraulic engineer and business executive. He has been married to Middle Caicos native Yvette Robinson Tapfer for 25 years and has lived in Conch Bar, Middle Caicos, since 2002. David formerly served as branch chairman of the PDM from 2008 to 2011

on himself. This after being advised by her, her cousin, fellow PNP minister Don Hue, and uncle PNP minister Washington. Uncle Premier Mike spent millions on the goody planes and on games and parties. Just how did the PNP party advise their Premier? The sinking fund is a hole where the people’s money is going. Not just surplus but funds allocated

for infrastructure, schools, roads, drainage unaddressed in Uncle Mikes administration. Every possible dollar taxed has been sunk into the sinking fund. Except dollars allocated for 2012 PNP ministers’ goodies. The interim British government of 2009, ruled by the British Labour party, had two choices. Declare TCIG bankrupt or borrow a credit line of $260 million which

only Britain could guarantee because the TCIG under the PNP had zero credit. The loan saved the British Labour party embarrassment for their lack of early action. The British loan had the side effect of hiding the mismanagement of the PNP. It was discovered that millions in invoices for overseas USA healthcare and scholarships were bogus PNP bills. The draw down against the $260 million credit line became the $175 million loan. That British loan comes due next month and the sinking fund will pay off part but not all of the loan. How much is left to refinance? The PNP says one thing the Governor and now media reports say something else.

It’s time to tell the truth. We will soon have to make payments of tens of millions of US dollars. Dollars yet to be taxed and collected. Refinancing huge PNP debts is not a source of pride! It does not stop here. Doctor Ewing signed us up for nearly a BILLION dollars for purchased Canadian healthcare and super expensive but small hospitals that paid honorariums to Ewing and PNP key personnel. Will an audit by a single stranger tell the honest to God healthcare truth? The unaffordable and questionable healthcare is not good for TC Islanders and residents. They are frustrated, sick, dying and leaving. What will those who survive do in the coming election?

Primary healthcare renewal to receive further input CABINET approved the draft Primary Healthcare Renewal Strategy (PHCRS) for wider stakeholder review and consultation, this week. Governor Peter Beckingham chaired the second meeting of the Cabinet on Wednesday (January 20) at the NJS Francis Building in Grand Turk. All Ministers were present except the Deputy Premier and the Minister of Tourism, Environment, Heritage and Culture. At this meeting Cabinet

agreed in principle, subject to amendments and further consideration, to a draft paper for wider consultation to establish a Sovereign Wealth Fund (SWF) for the TCI. This will create a mechanism for setting aside a proportion of future budgetary surpluses to improve fiscal resilience, assist in financing large infrastructure developments and ensure the future prosperity of TCI. Members also approved the appointment of members to the Adoption Committee, the

Children (Care and Protection) Advisory Committee and the Prison Categorisation Board. Cabinet gave approval for the Department of Agriculture to commence public consultation on the draft Agriculture Policy with a view to updating the policy in the light of feedback for further review and consideration by Cabinet. It also approved the Ministry of Health to begin public consultation on the draft National Pharmaceutical Policy (NPP).

The draft NPP has been prepared and endorsed by the Ministry of Health, Agriculture and Human Services and supported by the Pan American Health Organisation (PAHO). Members gave approval for the Ministry of Health to begin public consultation on the draft National Health Sector Strategic Plan 20162020 (NHSSP). The draft NHSSPP has been prepared and endorsed by the Ministry of Health, Agriculture and Human

Services with technical advice and support from the Belize Ministry of Health and the Pan American Health Organisation (PAHO). Church calls for youth service in fight against crime BY OLIVIA ROSE OFFICERS of the Methodist Church are calling for the establishment of a national youth service to be considered in the fight against crime in the Turks and Caicos Islands and the Bahamas. The Methodist Church in the Caribbean and Americas (MCCA) said in a statement that it is necessary for the concept to be brought into fruition. “It is essential that we, as a people, devise an approach to national youth service suitable for the discipline,

to the accounting officer confirming funds are available to finance this. Finally Cabinet approved the following appointments: the District Commissioners for Middle Caicos, North Caicos and Salt Cay as Registrars of Marriage, Justice of the Peace and Notaries Public on their respective Islands, Pastor Evan Williams as Justice of the Peace and Notary on Middle Caicos, and the Reverend Father Tellison Glover as Marriage Officer for TCI. Further information on these matters will be provided by ministers in due course.

physical, educational, moral and spiritual development of our youth.” The group pointed out that Premier of the Turks and Caicos Islands had also called for the establishment of a national youth service. “Many of the crimes committed by young people, especially our young men, are simply because they resort to violence in seeking to resolve their differences. “This is most distressing, surely the way ahead is to help them to resolve whatever conflicts they have without resorting to violence. “Here we stand with other Christian bodies in expressing our willingness to provide counselling to our young people so that they may resolve their challenges in a non-violent way. “It is abundantly clear that much more needs to be done to foster the moral and religious nurture of our youth so that they may act in a more disciplined manner.” The church pointed to the major role that family and church have played in the training of children and young people over the years. “The church, through its Sunday schools, mentorship programmes and youth organisations, including the Boys’ Brigade, Girls’ Brigade, Boy Scouts, Girl Guides, Pathfinders, have contributed significantly to the moral and spiritual growth of its young people. “The Methodist Church is strong in its commitment to continue with these endeavours and is ready and willing to co-operate with all Christians, youth organisations and government

agencies in ensuring that our young people are nurtured in the right way.” The church viewed “with grave concern” the increase in crime and violence in the Bahamas and the Turks and Caicos Islands, saying it was particularly disturbing that violent crime - including rape, attempted murder and murder, especially against women and children - continues to increase to the extent “that no one is immune from its dangerous consequences”. It said as its responsibility that it pledged to participate in seeking to bring about a drastic reduction in the high rate of crime. “We are encouraged by the initiatives being taken in the Bahamas by the Royal Bahamas Police Force to deal with this challenge,” its statement said. “Also, we note the observation by the Chief Justice that there is a need for more courts and would urge that this concern receive the urgent attention of the relevant authorities. “Meanwhile, in the Turks and Caicos Islands, the need for more police officers has been emphasised.”

talents as well as their smarts in a positive and productive manner. “Not only is it a way to show students that they are beautiful, but it also helps to promote confidence and awareness for both male and female students.” Ferguson said that she hopes that a lot of people attend the competition to show their support because the students have been

working extremely hard. “I also hope that the students take something from the pageant in terms of personal development,” Ferguson said. The show will take place at 6.30pm, on the Long Bay High School compound and it is open to the public for their enjoyment. Tickets for the event are available for purchase at the school, for the low price of $8 for students, $15 for general admission and $25 for VIP

seating. Long Bay High School is a newly established Government institution in the Turks and Caicos Islands, which aims to develop students for all facets of life, through academics as well as extra curricula activities. About $1 million was earmarked for phase one of the building which includes eight classrooms for first and second form students along with toilet and administrative facilities.

The MCCA also repeated its call for caution to be exercised in granting bail, saying that people who commit murder while on bail, should be excluded from this privilege, and urged that stiffer penalties be imposed to prevent the entry of illegal firearms into the two nations. “It is with regret that we recall the cases in which infants

were killed while handling guns in our territories. “Those persons who are licensed to use firearms are reminded that it is their grave responsibility to ensure that all such dangerous instruments are stored carefully when not in use.” The MCCA also pointed to an escalation of “white collar crime” and reminded those

in financial and commercial institutions as well as the public service must place “high priority on honesty, integrity, and diligence in carrying out their many and varied responsibilities”. The statement came as the 204th annual session of the Bahamas and Turks and Caicos Islands Conference of the MCCA took place.

HOW DOES YOUR GARDEN GROW

Spanish moss SPANISH moss (Tillandsia usneoides) is neither Spanish nor a moss, it is a fibrous, perennial, epiphytic herb. It hangs from trees in long, thick masses that may reach 20ins in length. The leaves are greyish-green, narrowly linear, and up to two inches long. It looks like filaments with many branches and is covered with silvery-grey scales. The flowers are tiny with pale greenish-blue blossoms. They form in the axils of the leaves and may give off a light fragrance at night. The flowers lead to tiny capsules which split open to release even smaller seeds. Spanish moss grows well in full sun but endures partial shade. It prefers moist environments but can survive well in dry habitats too. Spanish Moss is usually found on oaks or cypress trees it likes the chemicals that leach form the tree’s bark but can be found on other species

and usually doesn’t harm the tree. Why is it called Spanish moss? There is an explanation but it’s on linguistic quicksand. It is said the Spanish had beards and the moss looked like their beards so it was called Spanish moss. But the term Spanish moss seemed to be rather a late day innovation. As early as 300 years ago it was called old man’s beard, white beard and Spanish beard. Other names included Florida crape and wool crape. It’s found in the southern United States, the Caribbean, Hawaii and Australia, where it was introduced. Spanish moss, which isn’t a moss, was used to stuff car seats and furniture not only in the United

States but Europe as well. It was chemically stripped of its outer grey bark and use for that purpose up until about 1960. In 1939, for example, 10,000 tonnes of it was raked from trees in Florida and Louisiana. It is not a parasite but an epiphyte so it doesn’t harm the tree unless it grows so prolifically to shade the tree from sunlight. Natives used it to make bedding and emergency clothes when cloth was unavailable. The inner black core was spun and used as thread. Spanish moss is in the pineapple family a plant family known as Bromeliaceae. The family contains more than 3,000 described species in approximately 56 genera.

On the flip side, now think about all that trash that didn’t quite make it into the bins, but was left languishing in the sand, waiting for the tide to rise to take it to its watery grave. This is the sad reality that faced a good friend of mine who visits Providenciales frequently and as an avid swimmer, enjoys nothing more than to start or end her day gliding up and down the shoreline of Grace Bay, swimming past starfish, barracuda, stingray and many other marine critters. This year she noticed a

remarkable difference between pre and post New Year celebrations and was disgusted to see during her New Year’s Day swim, an overwhelming amount of trash lying at the bottom of the water, threatening not just the marine life but also other beachgoers who could easily step on some of the broken glass or other debris polluting the water. Without further ado, my friend decided on a clean-up swim, donned her mask, snorkel and fins and mesh bag and proceeded to make her way from the Mansions to the Seven Stars dock, collecting far too much trash over the course of two days. amazed by how much trash is piling up along the fence near the beach access. I was even more dismayed to witness one of a group of resident beachgoers tossing an aluminium food tray into the bush, rather than into the bin just a few steps away. After questioning his actions, one of his friends apologised on his behalf and retrieved the tray, but will this make them change their ways next time? I fear not, unless action is taken from a higher level and with education being the key. Tourism is the life blood of the Islands and we are all impacted whether we work in the industry or not. Fruit juice, smoothies and your teeth MANY parents give their children fruit juice or smoothies to drink thinking that they are the healthy option over soda and other sugared drinks like Gatorade. Many of us have juicers or blenders at home and are able to make our own. However, whilst it is true these are generally more nutritionally beneficial and contain less artificial additives than soda, fruit juices and smoothies are still very high in sugar, a fact that is unknown or overlooked by many parents. The British Dental Health Foundation issued a statement to warn parents about the harm they could be doing to their children’s teeth. Talking about fruit juices and smoothies, Nigel Carter, chief executive of the foundation said: “They are becoming increasingly

popular and the fruit content can make them seem like a good idea. “However, they contain very high levels of sugar and acid and so can do a lot of damage to the teeth.” People are also often under the impression that drinking juice is as good for you as eating a piece of fruit. However, this is untrue both on a nutritional level and from a dental perspective, with officials conceding that the sugars released by crushing make juice worse for the teeth than whole fruit. Mr Carter said that smoothies were “horrendous from a dental point of view” because they are concentrated, often sipped between meals and stick to the teeth. He also added that dried fruit such as raisins were also risky for the teeth.

It is advised that if children are going to drink juice that they should confine it to meal times when the teeth are already “under attack” from other sugars and acids. It is also advised that drinking through a straw reduces the contact of the juice on the teeth and therefore the risk of decay. He also went on to say that

vegetables were better for teeth. Mr Carter said: “The most important message to remember is that it is not the amount of sugar children eat or drink but the frequency of the sugary foods and drinks in their diets. “Children aren’t born with a sweet tooth. It is acquired over time due to their dietary habits.”

Protest turns violent in Haiti capital FOR a second straight day, opposition protesters erected burning roadblocks and shattered windows in a section of Haiti’s capital on Tuesday to press for new elections less than a week before a Jan. 24 presidential and legislative runoff. A few thousand people joined the demonstration in downtown Portau-Prince, marching through narrow streets and occasionally chanting: “The revolution has started, get your gun ready.” Young men threw rocks, smashing windshields and the windows of a bank. They also overturned vendors’ stalls to block law enforcement vehicles. Associated Press journalists saw one injured protester with what appeared to be a bullet wound. Demonstrators said a police officer shot him in the leg, but the details were unclear. At least one law enforcer was wounded by a hurled rock that hit his head. Campaigning for Haiti’s presidential runoff kicked off earlier this month, but only governmentbacked candidate Jovenel Moise is participating. Opposition presidential candidate Jude Celestin is boycotting the Jan. 24 vote, arguing he has no chance to win because the deck is stacked against him by Haiti’s electoral machinery and interference by the international community. Celestin leads an opposition alliance alleging “massive fraud” in favor of Moise, outgoing President Michel Martelly’s chosen successor. Moise won nearly 33 percent of the vote in the disputed Oct. 25 first round

Intelligence revealed that approximately 100 Islamic extremists left the Caribbean to join ISIS fighters in the Middle East last year.

that was endorsed by international monitors. Ernest Casseus, an unemployed 57-year-old from a neighborhood of concrete shacks and trash-strewn streets, insisted that the runoff had to be postponed to protect democracy in the nation that has endured coups and dictatorships for most of its history. “It’s like a football game: You need two teams to play or you have no finals. A presidential election with one candidate is crazy and will only result in chaos,” he said. The Haitian National Police dispersed the demonstrators with tear gas before they arrived at Haiti’s Parliament, where senators were discussing a resolution to potentially postpone Sunday’s vote and set up a verification commission. Lawmakers

in Haiti’s upper house expect to vote on the matter Wednesday. Haiti’s influential Chamber of Commerce issued a Tuesday statement saying it was concerned about the electoral crisis and called for a recent special commission’s recommendations to be adopted, including the redesign of Haiti’s Provisional Electoral Council. But outgoing President Michel Martelly told reporters at a conference of visiting foreign ministers that he was ready to vote Sunday and would ensure that security was in place to ensure safe balloting for citizens. Martelly, who is barred from seeking a consecutive term and is due to leave office Feb. 7, argues that the opposition has spread unsubstantiated allegations about “massive fraud” to improve their chances at gaining power.

FOUR Trinidadians fighting with Islamic State of Iraq and Levant (ISIS or ISIL) were caught by Turkish security forces last year, according to a report in a Turkish newspaper. Hürriyet Daily News this week published an article in which it reported that the Turkey government last month released a list of 913 foreign jihadists from 57 countries who had been caught in Turkey in the first 11 months of 2015, and its sources had indicated that four Trinidad and Tobago citizens were among them. No other Caribbean country was mentioned. Earlier this month, Commander of US Southern Command (SOUTHCOM) General John Kelly said that about 100 Islamic extremists left the Caribbean to join ISIS fighters in the Middle East last year and the number had risen to

about 150 this year. He expressed concern about those citizens returning to the region and carrying out terrorist attacks. Meantime, according to the Hürriyet, China tops the list with 324 citizens caught in Turkey fighting for ISIL. There were 99 foreign fighters with Russian passports, 83 Palestinians, 63 fighters from Turkmenistan, 57 from Afghanistan, 44 from Indonesia, 19 from Germany and the United Kingdom each, 18 from France, six from South Korea, five from Australia, and two from the Maldives. Two American citizens were among those caught, as well as fighters carrying Syrian passports, it added. The newspaper reported that most ISIL fighters attempting to cross into Syria through Turkey claimed they were simply trying to look for their relatives.

Jamaica health ministry tells women hold off baby making, as Zika virus gets closer THE Ministry of Health in Jamaica is following the lead of health officials in Brazil and the Dominican Republic in advising women to avoid getting pregnant for now, given the possible link between mosquitoborne Zika virus and birth defects. The ministry has advised women to delay pregnancy for the next six to 12 months, and those already pregnant to take extra precautions to prevent being bitten by mosquitoes. More than 3,500 microcephaly cases were reported in Brazil between October 2015 and January 2016, in babies born to women who were infected with the Zika virus while pregnant. Microcephaly is an abnormal growth of the brain and stunting of the growth of the head of the foetus arising from an infection in the first few months of pregnancy. Babies who develop microcephaly in the womb may not live to full term, may be born prematurely, may be still born or may survive but with lifelong disability. Minister of Health Horace Dalley

MORE than 3,500 microcephaly cases were reported in BRAZIL in babies born to women who were infected with the Zika virus while pregnant.

says although there is no absolute proof that Zika causes microcephaly, the evidence from Brazil and the information from the Pan American Health Organization/World Health Organization (PAHO/WHO) and other technical partners is strong enough for the ministry to issue the advice. “The Zika virus is inching closer and closer to Jamaica as several of our Caribbean neighbours have reported cases. Women are therefore being advised to delay pregnancy

if possible. Those already pregnant must take action to prevent being bitten by mosquitoes as the unborn baby is at high risk if the mother is infected in the first few months of pregnancy,” he said. Cases of the Zika virus have been confirmed in neighbouring Haiti, as well as Guyana and Barbados and several countries in Latin America. Dalley said the ministry is on heightened alert and is scaling up vector control activities. He also called on citizens to play their part in taking the necessary steps to rid their communities of the Aedes aegypti mosquito which transmits the Zika virus. They are advised to destroy mosquito breeding sites by disposing of or covering anything around homes, schools, churches and business places that may collect water; repair leaking pipes and outdoor faucets; cut grass short and trim shrubbery; clear roof gutters and eaves to prevent water from settling; and fill in and drain any areas where water settles when it rains.

Royal Caribbean’s Freedom of the Seas decided against docking in Labadee, a peninsula about 100 miles from Haiti’s capital Port-auPrince.

Cruise ship turns away from Haiti amid protests PASSENGERS on Royal Caribbean’s 3,782-passenger Freedom of the Seas may have been expecting a day at the beach at the cruise line’s multi-million dollar private resort in Labadee, Haiti. But on Tuesday the ship was greeted at the popular port by protestors in boats and the cruise line cancelled the visit. Haitians have been widely protesting as the country prepares for a presidential and legislative runoff election on Sunday. “When Freedom of the Seas arrived to Labadee, Haiti, the ship encountered a number of locals

in small boats staging a protest,” Royal Caribbean said in a statement. “Although this protest was peaceful in nature, it was clear that if the protest continued, there would be a significant impact on our guests’ ability to enjoy Labadee.” The ship remained at sea before heading to Wednesday’s port of call in Falmouth, Jamaica. On Thursday another Royal Caribbean ship, Navigator of the Seas (3686 passengers), was scheduled to visit Labadee, a peninsula about 100 miles from Haiti’s capital Port-auPrince.

St Lucia says ‘no’ to UK request to waive diplomat’s immunity The St. Lucia government has denied a United Kingdom request to waive the diplomatic immunity of its representative at the International Maritime Organization (IMO) so that he can answer a civil case brought by his ex-wife. The UK Foreign and Commonwealth Office (FCO) wrote to the Kenny Anthony administration last month requesting that the government waive the immunity of Dr. Walid Ahmed Juffali to allow him to answer a claim for additional financial relief in the High Court in London from Christina Estrada, whom the Saudi billionaire formally divorced in 2014. Estrada’s lawyers had sent a similar request prior to the FCO’s communication. But in a statement issued on Monday, the St. Lucia government said it intends to “uphold the principle of diplomatic immunity” by allowing Dr. Juffali to invoke his diplomatic immunity in court, and had advised the FCO accordingly last Friday. It said that a representative of the government, along with its attorney, had met with FCO officials to discuss the matter after the letter was received. “The Government of Saint Lucia has been assured by the FCO that Dr Juffali has not abused the privileges and immunities afforded to him, nor is the decision of the government of Saint

Lucia to uphold the principle of diplomatic immunity an abuse of these privileges or immunities in any way,” it said. “While the government of Saint Lucia fully respects the decision of the FCO to make such a request, it is not satisfied, based on its own examination of the facts, that a compelling case has been made out to grant a waiver of the diplomatic immunity of Dr Juffali.” The government insisted that the principle of diplomatic immunity must be safeguarded and should only be lifted in exceptional circumstances, and Dr. Juffali’s case was not one of them. It also noted that no precedent could be cited to show that such a request had been acceded to in the past.

Bahamas’ Grand Lucayan ‘may sell’ for under $180m THE Bahamian government is seeking a “better owner” for Freeport’s Grand Lucayan resort, with its international advisers suggesting Hutchison Whampoa may be prepared to sell for less than $180 million. McKinsey, in its recentlydisclosed report on the Government’s options for Freeport’s future economic growth, said Grand Bahama’s hotel product might improve if the Hong Kong conglomerate sold the property to an entity with Caribbean tourism experience. It added that the Grand Lucayan had incurred consistent operating losses of between

$10-$20 million per year since opening in 2001, while Hutchison Whampoa’s interest in the property - and effecting a turnaround - “appears limited”. Pointing out that the Grand Lucayan’s occupancies (preMemories at least) averaged around 49 per cent, compared to an industry average of 75 per cent, McKinsey said: “The owner’s interest appears limited. “Interviews suggest a lack of operational expertise and insufficient maintenance. Hutchison owns other hotels in Asia, but they are highend business properties, not resorts. It did not come to Grand Bahama for the hotel.”

‘11th hour’ tax changes creating Freeport fear THE Bahamian government has been urged by its own consultants to address “ease of doing business” concerns in Freeport, amid warnings that job-creating investment and expansion is being deterred by an increasingly unpredictable Bahamian tax policy. McKinsey, in its nowdisclosed report, indicated that the Freeport private sector’s tax, Immigration and speed of approvals concerns were all issues that could undermine plans to revive the island as a ‘free trade zone’ hub. It quoted executives interviewed for its November 2014 report to the Christie Cabinet, who expressed displeasure about the 1 per cent Customs administration processing fee, and other taxes such as the Environmental Levy, which were imposed in the 2013-2014 Budget. The Customs fee has now been removed for Freeport, but the private sector also lamented the lack of certainty and transparency in the Government’s fiscal plans, and the impact this was having on their businesses. This is especially relevant to Freeport’s current situation, with the Government yet to clarify what it plans to do about the city’s expiring real property tax, Business Licence

fee, capital gains and income tax exemptions, which expire in less than three weeks on February 5, 2016. Nor has it made public its intentions on longer-term reforms to the Hawksbill Creek Agreement. One executive was quoted by McKinsey as saying: “The [Customs administration fee] was passed at the 11th hour without consultation, without notification... It sends investors the message that you can’t trust the Government.” All executives spoken to by McKinsey were not named, but another said: “Our global headquarters is constantly asking about the tax situation for strategy and budget planning, but we just don’t know.... there’s no transparency.” Another, looking to the future, added: “We need the Government to clarify how it will handle new taxes and incentive expirations. Else we can and will shift operations to other places in just two weeks.” Investors and businesses the world over have frequently asserted that a lack of predictability, and continuity, from Governments over tax policy is a major deterrent to investment, growth and job creation. Bahamian tax policy has been subject to numerous

changes and adjustments in recent years, as well as major reforms such as Value-Added Tax (VAT), all of which have had a disruptive and unsettling effect on commerce. Taxation was also cited as a concern by Freeport’s major industrial players, although McKinsey estimated that the expiration of Freeport’s real property tax and Business Licence fee ‘breaks’ would have a relatively modest impact on the sector. The international consultancy estimated that the imposition of both taxes on PharmaChem and Polymers International would be equivalent to losing 2 per cent of their annual revenues, some $1-2 million and $3-$4 million respectively. BORCO, meanwhile, would incur tax payments equal to $15-$20 million per year, or 10 per cent of its revenues. One industrial executive even referred to the possible imposition of real property tax and Business Licence fees as “a blip” compared to the former 1 per cent Customs administration fee. Yet the sector still warned: “[Government] is opening the door to major increases. It’s reasonable to worry they’ll keep upping the ante.” McKinsey also produced

‘case studies’ for the Christie Cabinet to note, which suggested that “modest and predictable tax increases do not drive severe business flight, but large unpredictable ones do”. It pointed to India’s Special Export Zones (SEZs), where the sudden imposition of two taxes on profits and dividends - at rates of 18.5 per cent and 17 per cent, respectively in 2011-2012, resulted in a decline in export growth from 31 per cent to 7 per cent over the next two years. McKinsey suggested that the Government create “a detailed communication plan for the upcoming Hawksbill Creek Agreement negotiations and discussions”, which is something the Christie administration has conspicuously failed to do, to address the tax concerns. Meanwhile, the ability to import specialised, key workers on either a short-term or work permit basis was also cited by Freeport’s private sector as another impediment to doing business. “Key people need to be able to get here in 30 days or investors aren’t interested. The Cayman Islands should be thanking our Government for all the business we’re sending them,” one private sector executive said.

Tourism only sector of growth for Barbados in 2015, says Central Bank The Barbados economy grew by a marginal 0.5 per cent last year, according to the country’s Central Bank, and tourism was the industry to thank, as it was the only sector that recorded any growth. Central Bank Governor Dr. Delisle Worrell said yesterday that the performance of the island’s main foreign exchange earner was “stellar”, but the same could not be said for other sectors. There was a 13 per cent increase in airlift from major source markets, an expansion in room stock, and refurbishment of the aging hotel plant and “the tourism outturn was the best on record since 2007, with activity in the sector rebounding to pre-crisis levels”. “Tourism receipts grew by an estimated five per cent, with arrivals up by 14 per cent, and all major markets recorded double digit increases,” Dr.

Worrell reported during his review of the country’s 2015 economic performance. On the other hand, construction activity is estimated to have decreased by three per cent, due largely to unexpected delays in the start of major infrastructural projects; and the retail, business and other services sectors saw limited spillovers, because there was no impetus from the foreign exchange sectors, other than tourism. Additionally, Dr. Worrell said, the average unemployment rate for 2015 was 11.8 per cent, compared with 12.3 per cent in 2014. He noted that while labour costs are estimated to have risen by one per cent every year since 2008, there has been no perceptible increase in productivity. The Central Bank Governor said tourism would continue to be the economy’s saviour

Tourism proved to be a saviour for Barbados in 2015 and officials are looking for it to do the same this year.

this year, with help from a rebounding construction sector. “Tourism and construction should provide enough stimulus to the wholesale, retail and business services to produce economic growth of about 1.8 percent in 2016,” he said. “Over the next five years,

real GDP is forecast to expand by 1.7 per cent on average, peaking at about two per cent in 2017 when major tourism infrastructural projects, such as Sandals, Wyndham (the former Sam Lord’s Castle), and other tourism development projects are expected to be in process or nearing completion.”

SDP founders see prospect of another Labour breakaway TWO founding members of the SDP have speculated that there could be another breakaway from the Labour Party. Former Labour foreign secretary Lord Owen told the BBC’s Newsnight critics of Jeremy Corbyn should “fight like hell” for the next two years but that creating a new party was an option. Baroness Williams said she saw a new party of the centre-left party reviving “the concept of the SDP”. She said Mr Corbyn was “an idealist” being “manipulated” by others. Two of the so-called “Gang of Four” former Labour MPs who set up the Social Democratic Party in 1981 have been talking to Newsnight ahead of the 35th anniversary of the establishment of the party. Lord Owen, who served in Jim Callaghan’s Cabinet before leading the SDP-Liberal Alliance, told the programme that Labour MPs opposed to Jeremy Corbyn should remain where they are for the timing being and fight for their values. “For at least two years fight like hell I would say,” he said. “I wouldn’t contemplate a new party until the end of 2017.” But he said what the SDP stood for and achieved was still relevant four decades later. “Labour MPs are thinking about creating a new party. Why? Because

they see you can do it; It may not have succeeded in every aspect but that’s an option open to them. So the SDP did not die in vain, it planted many new ideas into British politics.” Baroness Williams, who later became Lib Dem Leader in the House of Lords, also told the programme she thought the exact same people who made her feel compelled to leave Labour in 1981 had returned to the party under Mr Corbyn’s leadership. “I think he [Corbyn] is like Michael Foot’s son - a kind of idealist - who is I think being manoeuvred and I think manipulated by exactly the same people as I couldn’t stand but who are not visible in the same way.” She added: “I think the one way

we get out of the mess at the moment is the SDP concept struggling back and becoming eventually there will be a new party of the centre left.” Former Labour deputy leader Roy Hattersley advised Labour centrists not to emulate the Gang of Four’s example and to stay within the party and fight, as he did in the early 1980s. But he acknowledged that Labour’s situation is “now is worse than the 1980s”. “I think our chances of getting back are still there and we will get back but it will take longer,” he said. “I think it’s more difficult for a number of reasons; I think the leader is less susceptible to reason than Michael Foot was, he was a sensible and mature politician although of the left.

Obama says he’ll be too emotional to give speech at daughter graduation US President Barack Obama normally has no problems giving speeches, but says he would be too emotional to give one for his eldest daughter’s graduation. The Commander-in-Chief told companions during a lunch in Detroit that he had been offered the chance to speak at 17-year-old Malia’s high school commencement in June, but declined. “I’m going to be wearing dark glasses ... and I’m going to cry,” he said, according to ABC News. Malia Obama is currently in

her senior year at the prestigious Sidwell Friends School in Washington. A series of college visits to institutions including her father’s alma mater Columbia University and her mother’s, Princeton, have started speculation about which school the First Daughter will attend. Britain’s environment agency boss resigns over controversial Barbados holiday THE head of Britain’s Environment Agency (EA) has resigned after being heavily criticised for not cutting his Christmas holiday in Barbados short to return home to lead the response to floods last month. Required to work a three-day week for £100,000 (US$142,992) a year, Sir Philip Dilley said he quit because of the “inappropriate” expectation for him, as a part-time chairman of the EA, “to be available at short notice throughout the year”. Sir Philip came under intense scrutiny for being on a trip to Barbados while the worst storms in decades caused flooding in Britain. The UK media accused him of being hypocritical, since he had criticised his predecessor for his tardiness in visiting the flood-hit Somerset Levels in 2013 and had said at the time that the response in a flooding crisis should be to “show great interest and turn up in your wellingtons very early on”. The Telegraph newspaper reported that, instead of taking his own advice, he was “basking in 30°C sunshine in the Caribbean at his

holiday home near the world famous Sandy Lane Resort”. But in a statement issued through the Department for Environment, Food & Rural Affairs last week, Sir Philip said the media scrutiny focused on him was diverting attention from the real issue of helping those whose homes and businesses have flooded,

as well as the important matter of delivering a long-term flood defence strategy. “This same media attention has also affected and intruded on my immediate family, which I find unacceptable,” he said. “My reason for resigning is that the expectations of the role have expanded to require the Chairman to be available at short notice throughout the year, irrespective of routine arrangements for deputy and executive cover. In my view this is inappropriate in a part-time non-executive position, and this is something I am unable to deliver. “I am well qualified to carry out this role, and had much to contribute. I fully support the Secretary of State’s reform agenda to deliver efficiency as well as a better, more joined-up service to our stakeholders and the public, and so I am disappointed that I will not now see through delivery of these reforms,” Sir Philip added. He also used the opportunity to take responsibility for a statement issued about his whereabouts over the Christmas holiday.

Muslim women must learn English or risk deportation: British PM Sarah Palin said that Donald Trump can make the USA great again.

Trump presidential bid gets Sarah Palin backing DONALD Trump’s Republican presidential bid has received the backing of Sarah Palin, the populist ex-governor of Alaska who was the Republican vice-presidential candidate in 2008. “Are you ready to stump for Trump?” Ms Palin asked cheering supporters at a campaign rally in Iowa. She was John McCain’s running mate in 2008 before they lost to Barack Obama. Despite retiring from politics in favour of a media career, she remains an influential conservative voice. Officially announcing her endorsement, Ms Palin said Mr Trump was someone ready to let US troops “kick Isis’ ass”, using another name for the self-styled Islamic State group. “We are ready for a change,” she told the rally in Ames, Iowa. “He (Trump) is beholden to no one but ‘we, the people’. He is perfectly positioned to let you make America great again.”

The New York businessman, who leads the Republican race, said in a statement that he was “proud” to receive her backing. Ms Palin was a “trusted conservative” with a “proven record of being fiscally modest, staunchly pro-life and [she] believes in small government that allows businesses to grow and freedom to prosper”, the statement added. Mrs Palin was just two years into her Alaskan governorship when she was picked by John McCain to be his running mate. The self-described “hockey mom” soon garnered huge crowds and massive media attention. After the election in 2009, she resigned as Alaska governor and has since forged a lucrative career as a writer and political commentator. Ahead of the announcement, Mrs Palin tweeted a link to an article by her daughter Bristol attacking Mr Trump’s main rival for the key Iowa caucus, Ted Cruz.

At least 22 killed in attack on Pakistan’s university MILITANTS raided a university in northwest Pakistan Wednesday, timing their attack to a ceremony at the school to ensure maximum casualties. They slaughtered at least 22 people, a provincial police authority told CNN. The scent of burning metal hung in the air a few hours after the attack as a CNN crew made its way through the building where many were shot and wounded. Blood covered stairwells, the walls were pockmarked by bullets. Some of the students’ laundry still hung in a courtyard. By Thursday, a day after the bloody attack occurred, Nasir Durrani, deputy inspector general of Khyber Pakhtunkhwa province, said that police were questioning around 50 people for connections to the attack. No arrests have yet been made. Militants had entered the

Muslim women who fail to learn English to a high enough standard could face deportation from Britain, Prime Minister David Cameron announced Monday. He also suggested that poor English skills can leave people “more susceptible” to the messages of groups like Islamic State (IS). Cameron’s comments came as his centre-right Conservatives launched a £20 million ($28.5 million, 26 million euro) language fund for women in isolated communities as part of a drive to build community integration. Immigration rules already force spouses to speak English before they come to Britain to live with their partners. But Cameron said they would also face further tests after two and a half years in the country to make sure their language skills were improving. “You can’t guarantee you will be able to stay if you are not improving your language,” he told BBC radio. “People coming to our country, they have responsibilities too.” Cameron’s government estimates that around 190,000 Muslim women in England -- about 22 percent of the total -- speak little or no English. There are estimated to be around 2.7 million Muslims in England out of a total population of some 53 million.

rime Minister David Cameron suggested that poor English skills can leave people “more susceptible” to the messages of groups like Islamic State (IS).

Cameron said that a lack of language skills could make Muslims in Britain more vulnerable to the message of extremist groups. “I am not saying there is some sort of causal connection between not speaking English and becoming an extremist, of course not,” he told BBC radio. “But if you are not able to speak English, not able to integrate, you may find therefore you have challenges understanding what your identity is and therefore you could be more susceptible to the extremist message.” His comments drew criticism from Muslim groups and opposition parties. Mohammed Shafiq, chief executive of the Ramadhan

Foundation, which campaigns for better community relations, accused Cameron of “disgraceful stereotyping”. “David Cameron and his Conservative government are once again using British Muslims as a political football to score cheap points, to appear tough,” he added. Andy Burnham, home affairs spokesman for the main opposition Labour party, accused Cameron of a “clumsy and simplistic approach” which was “unfairly stigmatising a whole community.” Ex-Conservative Party co-chair Sayeeda Warsi said her former boss’s idea was “lazy and misguided” and a “stereotyping of British Muslim communities”

Taiwan elects first female president; China not happy TSAI Ing-wen tallied up 56 percent of the vote to become Taiwan’s first female president on Saturday. Her election also marks the end of eight years in power for the Kuomintang Party, which was much more favourably aligned with China than Tsai’s Democratic Progressive Party. This led Beijing to muse ominously about the “grave challenges to crossstrait relations” resulting from Taiwan’s elections. Those musings appeared in an editorial from China’s state-run Xinhua news agency, which actually put the word “presidential” in scare quotes, lest anyone doubt the contempt Beijing holds for the legitimacy of Taiwan’s government. “As the cornerstone of crossStraits relations, the consensus insists there is only one China, of which both the mainland and Taiwan are a part, though the meaning of ‘one China’ is open to interpretation by both sides,” Xinhua lectured the new Taiwanese president. “For a Taiwan leader, whether to accept the consensus or not decides which direction he or she would lead the island in: peace and stability, or conflicts and tension. The issue bears

Tsai Ing-wen broke the male dominated ruling pattern.

no ambiguity.” The Xinhua editorial goes on to demand Tsai live up to her “reportedly expressed wishes” about Beijing and Taipei working together for peace across the Taiwan Straits. And if she gets any funny ideas about interpreting “one China” in a way Beijing does not like, Xinhua sternly warns that “under no circumstance should the differences be used as excuses to seek Taiwan independence, which means war, as the mainland’s Anti-Secession Law suggests.” “The bottom line shall never be tested,” Xinhua’s editors declared. “Any attempt to steer the island

closer to independence will be a fool’s errand.” CNN notes the Taiwan Affairs Office in China echoed the staterun paper’s editorial stance by warning Tsai’s government to avoid “any form of secessionist activities seeking ‘Taiwan independence.’” Tsai’s voters sound considerably more independence-minded than China would like, and they are not all excitable youths. “I voted for DPP, because it’s very critical time for the Taiwan people. We have our own democracy systems, we will not be influenced by China,” 55-year-old Taipei professor Tsai Cheng-an told CNN.

Will Smith confirms Oscars 2016 no-show Will Smith said the lack of representation among this year’s acting nominees would make it awkward to attend.

WILL Smith has confirmed he will be joining his wife, Jada Pinkett Smith, in not attending the Oscars next month. The Men in Black star said it would be “awkward” to attend in the light of the row about the lack of representation among this year’s acting nominees. “We’re uncomfortable to

stand there and say that this is OK,” he told Good Morning America’s Robin Roberts. Comedian Chris Rock is facing calls to withdraw from his role as host of this year’s ceremony as the row intensifies. In an interview aired on Thursday, Smith said diversity was “the American super-power” and that, “at its best, Hollywood creates the imagery for that beauty”. When he looked at this year’s all-white line-up of acting nominees, he went on, “it’s not reflecting that beauty.” “Everybody is beautiful and deserving and fantastic, but it feels like it’s going the wrong direction,” he continued. “There’s a regressive slide towards separatism, towards racial and religious disharmony and that’s not the Hollywood I want to leave behind.” Some had expected Smith, a two-time Oscar nominee, to be shortlisted again for Concussion, in which he plays a doctor investigating head injuries sustained by American football players. The Independence Day actor, however, insisted his own part in the debate was nominal. “This is so deeply not about me,” he said. “This about children who are going... to watch this show and they are not going to see themselves represented.” Smith’s comments will add further fuel to an issue that is threatening to overshadow this year’s awards, to be held in Los Angeles on 28 February. They will also heap further pressure on Rock, whose role as host of the ceremony is increasingly becoming divisive. “Please do not do the Oscars awards,” wrote rapper 50 Cent on Instagram. “You mean a lot man, don’t do it. Please.” Fast & Furious 7 star Tyrese Gibson has also called on Rock to step down. The actor said there was “no joke that [Rock] can crack” that would make up for the Academy’s failure to nominate a single non-white acting nominee. “There is no way for him to seize the moment... and say, ‘I’m going to say this and say that I’m going to address the issue but then I’m still going

to keep my gig as the host’,” Gibson told USA Today. “The statement that you make is that you step down.” Speaking at Wednesday’s National Television Awards in London, Dustin Hoffman said the all-white line-up was an example of the “subliminal racism” that exists throughout American society. In an interview with the BBC’s Will Gompertz, though, Birdman star Michael Keaton said the Academy’s voters had not been “maliciously prejudicial” in overlooking black and other minority actors for the second year in succession. “I just think they’re possibly out of touch,” he continued. Mark Ruffalo, Keaton’s co-star in journalism-based drama Spotlight, is one of the 20 all-white candidates up for this year’s acting accolades. At the London premiere of Spotlight on Wednesday night, the Avengers star said he supported those calling for a boycott “in essence” but would still be attending the ceremony. “I have a lot of sympathy for [the boycott] and I completely understand why people are protesting. They have to,” he told reporters. “Except I’m in a movie that’s representing a whole other group of disenfranchised people who have no voice in the world and this movie means so much to them. “And so... I have to demur and I have to stand up for the people I have to stand up for.” Released in the UK on 29 January, Spotlight tells of an investigation by journalists at the Boston Globe newspaper into the widespread sexual abuse of children in the Catholic Church. Talks of a boycott have been stoked by Spike Lee and Jada Pinkett Smith’s separate declarations that they would attending or watch this year’s event. In an interview on Wednesday, however, Lee said he had never used the world “boycott” in a statement he posted protesting against the “lilly [sic] white” event. The Do the Right Thing film-maker also said he would “support [Rock] either way” whether he chose to host the Oscars or not.

Bob Marley is not the father: DNA tests shatter singer’s claim

The true paternity of Fabian ‘Gong Kid’ Marley has been revealed.

DNA tests have proven that Jamaican singer Fabian ‘Gong Kid’ Marley is not the son of late reggae legend Bob Marley as he has been claiming for years. A statement issued this week by Fifty-Six Hope Road Music Ltd., a company founded by Marley’s widow and children, said the test conclusively demonstrated the identity of Fabian’s real father. “The DNA tests show with scientific certainty that Fabian Marley is not the half-brother of either Rohan Marley, Stephen Marley or Robert N. Marley. In addition, similar DNA tests show the

probability of Fabian Marley being the son of Othneil Stanford is 99.99 per cent,” said Dr. Karl A. Reich, Scientific Director of the Illinoisbased Independent Forensics DNA Testing & Technologies. The Marley clan has repeatedly maintained that Fabian was an imposter who was trying to advance his music career. The family said that, for several years, the 47-year-old declined to take a test at an accredited DNA laboratory, but his manager, Clayton Thomas, finally convinced him to do it late last year.

“The Marley family is pleased to finally have this matter behind us. We have said repeatedly that this man who calls himself Fabian is not the son of Bob Marley. The tests now prove we were correct. We hope he can finally accept the truth of his own true heritage,” a spokesperson for the Marley family stated. Fabian’s family has distanced themselves from his claims. His mother Raphie Munroe said she never told him that he was Marley’s son and his claims were “crazy talk”, according to the Marley statement.

Foxx praised for saving man from burning truck JAMIE Foxx has been praised for saving a man who was trapped in a burning truck. Brett Kyle’s pick-up went off the road and rolled over into a ditch close to Foxx’s California home. Foxx said the truck became engulfed in flames “within five seconds” after he got the driver out. “I don’t look at it as heroic”, he told reporters, “I just look at it like, you know, you just had to do something. And it all just worked out.’’ The Oscar-winning actor said he heard the crash from his house and called 911 before running to the

scene. An off-duty paramedic who was driving by also stopped to help. They used his emergency room scissors to break the window and cut the man’s seatbelt and pull him out. “I told him as we were talking, as I’m getting him out, I said ‘you’ve got to help me get you out because I don’t want to have to leave you’”, Foxx said. “And I said ‘You’ve got angels around you.’’’ The driver’s father Brad Kyle met Foxx to thank him for his actions. He said he had been shown

surveillance footage of the crash site and said several cars had passed by the scene without helping. He broke down in tears when he spoke to reporters about what Foxx had done. “I just kept watching it and going `My god, my god, he didn’t have to do a thing,’” he said. “I think we all hope that we can do something when the time is there. But the question is, do we? do we act or do we fear for our own lives? and he did not.’’ The 32-year-old driver has broken bones and a punctured lung, but he is expected to recover. (BBC)

Entertainment Cosby to claim immunity in sex assault case A KEY piece of evidence in the sex assault case against Bill Cosby has been called into question, according to reports. An email seen by CNN alleges that a prosecutor promised Mr Cosby’s deposition in a 2005 civil case would not be used to bring criminal charges. In the deposition, Mr Cosby admitted drugging women during sexual encounters but said it was by mutual consent. The deposition now forms the basis of an aggravated indecent assault charge. Mr Cosby has denied the charge and his lawyers will now use the immunity claim to get the case in dismissed. Former Montgomery County district attorney Bill Castor was in charge when Andrea Constand sued Mr

Cosby in a civil sex assault trial in 2005, after no criminal charges were brought. Mr Cosby settled the case for an undisclosed sum. Mr Castor, according to CNN, agreed that Mr Cosby’s civil deposition would not be used to bring criminal charges. However, the current district attorney, Kevin Steele, said there is no evidence of a signed immunity agreement, which would have had to go through agreed channels. On Saturday, Andrea Constand’s lawyer said she never knew of such an agreement, the Associated Press news agency reported. During the civil claim deposition, Mr Cosby admitted giving Ms Constand wine and pills but said she consented to take them. He also admitted

paying off other women to keep them quiet. Writing to his successor, Risa Vetri Ferman, three months before criminal charges were filed, Mr Castor said: “I can see no possibility that Cosby’s deposition could be used in a state criminal case, because I would have to testify as to what happened, and the deposition would be subject to suppression. “I cannot believe any state court judge would allow that deposition into evidence. ...Knowing this, unless you can make out a case without that deposition and without anything the deposition led you to, I think Cosby would have an action against the County and maybe even against you personally.” It is now believed Mr

Bill Cosby’s lawyers are attempting to get the case thrown out.

Castor will be called by Mr Cosby’s lawyers at a hearing on 2 February, where they will attempt to get the charge dismissed. But the current district attorney, Kevin Steele, said there is no evidence of a

signed immunity agreement, which would have had to go through agreed channels. It was the decision of Mr Steele to bring criminal charges in December, before the statue of limitations ran out in January.

Dozens of women have accused Mr Cosby of sexual assault, dating back to the 1970s, but only one charge has been brought because of the statute of limitations has passed on the majority of claims. (BBC)

GARDENER RESPONSIBILITIES:

Comedian Steve Harvey had mistakenly named Ms. Colombia Ariadna Gutierrez as the Miss Universe pageant winner.

Miss Colombia’s advice for Steve Harvey: ‘Learn how to read’ MISS Colombia isn’t holding a grudge against Steve Harvey, despite his mortifying flub a month ago mistakenly naming her the winner of the Miss Universe pageant. She says she isn’t even going to sue him, as some lawyers have suggested. But she does have some advice for the television host. “You need to learn how to read cards,” Ariadna Gutierrez joked with Harvey during an appearance on his talk show scheduled to air Tuesday. During the finale of the December 20 Miss Universe Pageant, Harvey misread the card listing the winner and runners-up; he announced Gutierrez as the winner.

Pageant judges had intended for Miss Philippines, Pia Wurtzbach, to win. Harvey’s gaffe resulted in an intensely awkward moment in which the crown was taken from Gutierrez and placed on Wurtzbach. “If you see the videos, I was laughing because I thought you were about to make a joke,” she said. “That would have been the worst damn joke I ever wrote in my life,” Harvey shot back. Gutierrez says the experience felt like a “nightmare” and revealed that several lawyers contacted her, suggesting that she sue. “That’s not me,” she said. “That’s not who I am.”

She says she’s moved on now. “This is our destiny,” she said. Harvey, who appeared emotional at times, said the gaffe wasn’t a publicity stunt, as some have theorised. He also revealed that he had received death threats over the mistake. Tuesday’s show is the second part of a two-part special. Monday’s episode featured Wurtzbach. “I was very happy that I won; I was excited,” she told Harvey. “But I was also thinking about (Gutierrez). I couldn’t help but think about how tough this must be for her.” (CNN)

Bills hire first fulltime female assistant coach in NFL history REX Ryan is helping to break down gender barriers in the NFL. The Bills announced Wednesday that they have hired Kathryn Smith as a special teams quality control coach, making her the first full-time female NFL assistant in the NFL. “Kathryn Smith has done an outstanding job in the seven years that she has worked with our staff,” Ryan said in a statement released by the team. “She certainly deserves this promotion based on her knowledge and strong commitment, just to name a couple of her outstanding qualities, and I just know she’s going to do a great job serving in the role of Quality ControlSpecial Teams.” Smith spent many years with the Jets, starting with the organisation in 2003 as a game day and special events intern. She became a college scouting intern in 2005, a player personnel assistant in 2007 and assistant to the head coach in 2014. She followed Ryan to Buffalo in 2015 after the Jets fired him. Last year, the Cardinals hired Jen Welter as an assistant coaching intern for training camp. Welter was believed to be the first female coach in NFL

history, but Smith is the first fulltime NFL coach. “I consulted with Bruce Arians on this since he was really the first NFL head coach to make this kind of move when he hired a female linebackers coach through the summer,” Ryan said in the statement. “You can see the success some of these young ladies are having in the coaching profession, such as the young lady that is an assistant to Coach (Gregg) Popovich at the San Antonio Spurs, and realise how exciting this is for women like Kathryn Smith as well as the Bills organisation.” (NYDailynews)

IAAF scandal worse than FIFA’s, says US great Michael Johnson THE corruption scandal plaguing athletics is worse than the one faced by football, says four-time Olympic gold medallist Michael Johnson. Three senior IAAF officials were banned for life for alleged doping breaches. And Russia is currently banned from all athletics competitions following accusations of widespread doping. Asked how the scandal facing athletics compared to that of Fifa, Johnson told the BBC: “If you think about the victims, it is absolutely worse.” FIFA, the body that governs world football, is also in crisis following a series of damaging corruption claims. Its president, Sepp Blatter, has been banned for eight years for breaching ethics rules. In an interview with Mishal Husain, Johnson said that those athletes cheated out of medals by dopers “never had the opportunity to stand on the podium - and they should have”. However, he stopped short of backing an Olympic ban for Russian athletes later this year. “Do you ban an entire country that ostensibly could include clean athletes, from participating in Rio?” asked the American, who still holds the world and Olympic records for the 400m. “That is a very difficult decision to make.”

Olympic great Michael Johnson says the IAAF needs to be “completely restructured”.

Johnson was also cool on the idea, floated by chairman of UK Athletics Ed Warner, of resetting all world records so athletics could start afresh with a level playing field. “It doesn’t make sense to me how a reset of all the world records is going to deal with the issue of people cheating,” Johnson said. “It doesn’t create a clean competition and that does not deter anyone from cheating.” But he does believe the International Association of Athletics Federations must be “completely restructured”. “It is the governing body - and the very structure of the governing body - that has allowed this type of corruption,” he said.

A report by the World AntiDoping Agency’s independent commission was scathing of former IAAF president Lamine Diack, whose 16-year reign came to an end in August 2015 when he was replaced by Lord Coe. It claimed that “corruption was embedded” in the organisation and said it could not be ignored or dismissed as attributable to “the odd renegade acting on his own”. It concluded: “The IAAF allowed the conduct to occur and must accept its responsibility.” Johnson said he hoped the crisis would be the catalyst for “a fresh look” at all the problems facing athletics and would help rebuild trust with fans. SCOTIABANK CFU CARIBBEAN CUP:

Lack of funds reason for TCI’s absence Otuonye jumps best ever season opener Ifeanyi Otuonye leaped 7.32M in his long jump opener.

A LACK of funds has restricted the national senior male team from participating in the Scotiabank CFU 2016 Caribbean Cup which is scheduled from March 21-29 with first round action, followed by second round games in May and third round matches in October. TCIFA’s president Sonia BienAime said that the association had planned to enter the competition, but “had to reconsider because we cannot afford it.”

Bien-Aime, who is also an executive member of CONCACAF and FIFA, told the Weekly News that the senior players will not go without playing time, since they will benefit from international friendlies. “Our plan is to organise friendlies with other national teams, which would be more cost effective because we have our dorm at our national facility.” The most powerful female football representative in the hemisphere

added that friendlies will give the players the needed competitive games ahead of the 2018 World Cup Qualifiers. “This would also create an opportunity whilst playing more competitive games ahead of the WC 2018 Qualifiers, and if these games are won, we can still move up the ranking table.” At the moment there are discussions with the Bahamas and a few other nations, but nothing has been confirmed as yet.

Garland hoping to stay injury free this season TCI’s 400M record holder Angelo Garland is looking to rebound from his injury plagued 2015 season; his 2016 season opener, at last Friday’s Texas A&M College Station Invitational, saw him finishing third in the 400M. Garland ran the 200M, the 400M and the 4X400M relay. He clocked 48.92s for his third place finish in the 400M, while in a 200M trot, against a lone opponent, he finished in 22.6s. He ran the opening leg of the relay in 49.4s. Angelo Garland is hoping for a good 2016 season.

NEW COACH The 21 year-old,

who

has

dominated the 400M for the A&M College, now has a new coach, and he is confident that it will help his career. “My biggest fear was always running the first part of the 400M too fast, with my new coach we’re doing and have been doing a lot of speed work, so I feel more confident whenever I get out the blocks.” The national athlete is not worried about his timings right now. “My main focus is staying injury free. Once I do that, fast times will come.”

TCI’s national long jump record holder Ifeanyi Otuonye showed strong signs of a fantastic season after leaping to his best ever indoor start. His jump of 7.32M led him to second place last weekend in a K-State scoring meet against rival schools KU and Wichita State. Otuonye, who has both the national indoor (7.50M) and outdoor long jump (7.87M) records, also competed in the triple jump and the 4X400M relay—all on the same day. “My jump went well given the circumstances….I opened up with my best ever season opener and from a shorter approach, and I didn’t even touch the board.”

HAPPY COACH The former Munro College student said that his coach was pleasantly surprised with his performance. “My coach didn’t expect me to do that well, especially being so far from the board. Also I was in the 2nd week of my heaviest lifting, so he did not expect me to have a lot of pop either.” He was actually ahead in the long jump, when his coach stopped him from jumping anymore. The senior at Kansas State University led his team to a second place finish in the 4X400M race, while he finished fourth in the triple jump.

PABA NIGHT LEAGUE

Harbour Ballers now 8-0 THE Harbour Ballers continued their dominance of the Provo Amateur Basketball Association (PABA) Night League with another impressive win. Victory last weekend propelled the South Caicos team to an 8-0 record and maintained their stand as the top team in the league. In a somewhat low scoring game, the league leaders got past the

Predators 58-46. In another clash, the Police defeated the Nazarene Kings 8575. On Saturday night, both the defending champions GT Stallions and the impressive Flyers moved to seven wins in eight games. The Stallions whipped the Kings 74-54, while the Flyers got past the Knights 85-81 after a strong last quarter.

SUNSHINE INSURANCE MARATHON BAHAMAS:

Reyes breaks 800M national record

Robinson wins age – Corvil cops bronze in high jump group for third time ONE of the Turks and Caicos most prolific long distance runners, Lynn Robinson, won the female 45-49 age group division of the Bahamas Marathon when she competed in the event last Sunday. The 47-year-old, representing the TCI, registered her third consecutive win in the division with a time of 4:02:11. “It was a little harder than the

previous two years due to the wind and the fact that I haven’t done any marathon specific training...but still a good one.” Robinson finished the race over 15 minutes faster than the second place finisher Gretchen Clark. Overall she was the sixth fastest female at the Marathon. The Provo resident is currently training for the Ironman competition slated for Texas in May.

JAMAICA based TCI athlete Ken Reyes stormed to a new national 800M record while school-mate and fellow TC Islander Woodens Corvil finished third in the high jump when they competed at the 12th staging of the Douglas Forrest Invitational Meet last Saturday at the Jamaica National Stadium. Although he did not medal, the 16-year-old Reyes broke his own national record. He clocked 1:58.00,

slightly fastest than the 1:58.97 he made last April at the CARIFTA Games. “It was a great run, was working hard for this great opening time of this season, for every track meet I think about my goals, so that I can push much harder.” The former Clement Howell High School student said that his coach is happy with his start. He will now compete in the 4X800M relay.

Sixth former Woodens, who jumped 2.0M in the high jump, finished tied with three other athletes for third place. The multievent participant cleared 2.05M, the winning height, but the wind knocked the bar down. The CARIFTA Octathlon bronze medal winner said he is confident going forward this season, although there are a number of things to fix.

Full Physic and Teachers Blain scores seven record latest PPL victories PROVO HOCKEY LEAGUE:

in Islanders win JACK Blain went on a scoring rampage to singlehandedly beat the Big Blue Thunder in the Provo Hockey League (PHL) Novice Division last Saturday at the Graceway Sports Centre. Blain scored four of his seven goals in the second period to propel the Grace Bay Car Rental Islanders to a 7-5 win. The Thunders were led by Samuel French and Tom Phillips, who scored two goals each. In the other novice game the Grace Bay Resorts Conchorers defeated the Scotiabank Sailfish 5-4, despite three goals from the league’s scoring leader Maddox Jones. Kendall Handfield led the Conchorers with two goals. In the Bantam Division Harry Schofield scored a late goal to

push the Saunders and Company Owls to a 5-4 win over the Villa del Mar Flyers. The Owls raced to a 3-1 first period lead with Tristan Grandsire scoring two of his three goals, but Carson Greatrex (who also scored three goals) had backto-back strikes in the second period to tie the game before Joe Canham assisted Schofield for the win. In the second clash of the day, against the Gansevoort Gators, the Owls lost 1-3. Canham scored in the second period, but the Gators’ Kurt Rivers, Brook Rivers and Dylan Ayer all found the back of the net. Meanwhile in the Midget Division, a highly defensive clash resulted in a 1-1 draw between the BCQS Flames and the Coco Bistro Lightning.

FULL Physic bounced back from their opening defeat to the hands of the young Academy side to whip Cheshire Hall 5-1, while Teachers got the better of Beaches last Saturday in the second week of the Provo Premier League (PPL). Cheshire Hall scored the opener after Lenford Singh volleyed the ball into the top right hand corner of the uprights in the first half, but Full Physic equalised off the boot of Kelly Louima, before Steven Derilien assisted Samuel Nacius for a Full Physic lead. Below par defense by Cheshire Hall resulted in the other three goals. The one dent to the winner’s day was the loss of Nacius with two yellow cards (suspension for the next game). In the other clash Beaches went ahead early owing to a successful penalty converted by Barrington Somers and a defensive error, but Teachers settled and were able to pull a goal back in the first half—

Full Physic recorded a 5-1 win over Cheshire Hall.

penalty by Dane Ritchie. In the second period, the Teachers looked more composed and soon a through ball from Ritchie found

Damian Palmer: 2-2. Another though ball, this time from Ian Chang to Chris O’Neil was the game winning shot.
