Privy Council dismisses Akita Holdings’ appeal against TCIG civil recovery claim

BY DELANA ISLES HER MAJESTY’s Privy Council has dismissed an appeal by Akita Holdings Ltd against the Turks and Caicos Islands Government in a civil recovery case.

The ruling, which was handed down in London on Monday (March 27), affirms the 2014 decisions of the Supreme Court and Court of Appeal.

Akita Holdings Ltd. holds the majority of the land where its fuel storage and related facilities in South Dock, Providenciales resides, on trust for the Government.

In September 2014, the then Chief Justice Edwin Goldsbrough ruled that Akita Holdings had obtained the land in breach of fiduciary duties owed to the Government by its owner and former Minister of Natural Resources, McAllister Hanchell.

The Government was found to own almost 70 per cent of the land and to be entitled to the profits earned through the use of the land.

The Court ordered that a further hearing should take place to assess the value of the damages due to the Government to account for the ownership interest and profits owed to the Government.

In the Privy Council’s ruling, in addition to dismissing Akita’s appeal, they ordered Akita Holdings to pay the Government’s costs of the appeal.

The case has now been returned to the Supreme Court in order for the Chief Justice to carry out an assessment of damages, which was originally ordered.

In response to the judgement,

Attorney General, Rhondalee Braithwaite-Knowles stated: “After Akita Holdings’ unsuccessful appeals have delayed matters by two and a half years, the Government is now looking forward to valuing and recovering the damages due to it on behalf of the people of the Turks and Caicos Islands.”

The government’s claim against Akita had formed part of the civil recovery program, which was carried out and completed two years ago.

The appointment of a civil recovery team was a key recommendation of the Report of the 2009 Commission of Inquiry.

THE FACTS The property in question is made up of four parcels of land on Providenciales, Turks and Caicos Islands registered at the Land Registry with title numbers 60605/13, 92, 96 and Hanchell is a Belonger.

In August 2003, he was appointed Minister for Works, Utilities and Communication of the TCI, as such, he was a member of the TCI’s Executive Council and remained a Government minister until 2008.

At that time the Crown Land Policy entitled a belonger to apply for and be granted a Conditional Purchase Lease (“CPL”) over Crown Land subject to certain conditions, including the obligation to pay rent and develop it in accordance with the terms of the CPL. If those conditions were satisfied, the belonger became entitled to purchase the freehold title at a

discounted rate, in this case 50 per cent of the open market value.

In 2004 Hanchell applied for and was granted a CPL over the land.

In setting the sale price under the CPL, the Government relied on a 1998 valuation which gave its open market value as $150,400, resulting in a discounted price of $75,200.

Unknown to the Government, Hanchell had recently obtained a private valuation of the property in its unimproved state at $500,000.

A further private valuation in February 2006, after commencement of development, valued it at $1,200,000, apportioning $600,000 to the value of the bare land and $600,000 to the development so far carried out.

The development was substantially completed in accordance with the CPL. Before exercising his right to buy, Hanchell transferred the right to the appellant (“Akita”), a TCI company jointly owned by himself and his brother.

In December 2006, Akita acquired the freehold title, having paid the discounted price of $75,200.

After the sale, development of the property continued, in part funded by bank loans, amounting eventually to some US$3.9m, charged on the property.

In November 2008, a private valuation report for Hanchell following further development valued the property with

improvements at $4,250,000.

THE PROCEEDINGS The Attorney-General (acting on behalf of the Government) issued proceedings against Akita.

The basis of the claim was expressed in the alternative as for unjust enrichment or unconscionable receipt.

Unjust enrichment was put as a claim for US$174,800, being the difference between the price paid ($75,200) and the price which would have been paid on the undisclosed valuation ($250,000).

The claim of unconscionable receipt relied on the assertion that the price paid represented only 30.08 per cent of the price which should have been paid, with the result that Akita holds 69.92 per cent of the land on trust for the government, which was accordingly entitled to that proportion of the value of the land, including a proportionate share of any benefits made by the (Akita) that are attributable to its use of the land.

Reference was also made to the fact that the improvements had been financed by bank loans secured on the land.

The relief claimed by the government was a declaration that the property was held on constructive trust for the payment of sums due, an account of the benefits received by the Akita by reason of the 69.92 per cent of the land that it holds on trust for the Government; and restitution

of $174,800 with interest.

The matter came before the Chief Justice Goldsborough who on September 5, 2014 gave judgment for the government.

Having found the facts as summarized above, he turned to the appropriate remedy (paras 40ff), which he described as being “to trace the value of the benefit obtained by (Akita)”, the starting point being to determine “the nature of the asset” held by it. H e identified the asset as the land itself, which he regarded as “a mixed asset as described in Foskett v McKeown [2001] 1 AC 102”. This was on the basis that the value put into its purchase by Akita represented “but a proportion of its value”; the balance having come “from the property of the (Government)”, the proportions being 30.02% to 69.92%. Having cited extracts from Lord Millett’s speech relating to such mixed assets, He ruled that the Government is entitled to recover the value of that proportion of the land for which it has not received value (69.92 per cent) that being the value of the unimproved land and the same percentage of the current value of the improved land insofar as the improvements are attributable to Akita’s use of the land.

Akita was ordered to account to the Government for the benefit of its use of the land for which it has not received value.

LOBSTER season 2016-17 is scheduled to close on March 31, 2017, according to a statement issued by the Department of Environment and Coastal Resources (DECR) on Tuesday.

After midnight on that day, no lobster may be caught, landed, or sold and those who fail to comply with the closed season will be prosecuted in court under Section 3, Part 1 (12) of the Fisheries Protection Regulations.

The DECR added that during the closed season it is illegal for fishermen to land or trade in lobsters and for restaurants and hotels to serve lobsters.

Dr John Claydon, director with the Department of Environment and Coastal Resources told this publication on Thursday that the DECR did not apprehend any individuals this season for the poaching of undersized lobster, and that general compliance appeared to be high.

“Compliance with the regulations are generally very good and we are thankful to the fishermen for their cooperation and adherence to the

closed season, after March 31,” he said. The 2016-17 kicked off on August 15, 2016 with what officials considered to be a bountiful start to the season.

The opening catch landed at processing plants in South Caicos and Providenciales totaled 43,206 pounds (lb.), approximately 80% of the landings recorded for the first day

of the open season in 2015.

Dr Claydon said that although the preliminary data shows that they did not capture as much lobster this season in comparison to the 201516 season, the catch did however exceed the 2014-15 landings.

PNP will fail trying to score political points with service charge bill – Parnell

BY OLIVIA ROSE PDM Chairman Douglas Parnell says the recent attempt by the PNP`s Chairman Royal Robinson to score political points on the service charge issue for hotel workers will fail.

Last week the Progressive National Party`s (PNP) Chairman and Appointed member Royal Robinson labeled Premier, Sharlene Cartwright-Robinson a hypocrite for not bringing the Service Charge Amendment Bill 2017 for its first reading in the House of Assembly on (March 23).

Royal Robinson urged the Premier to step up to the plate and to deliver on her ardent position.

He cited the Hon Sharlene Robinson`s position and her enthusiastic behavior on the service charge issue when she was Leader of the Opposition in the House of Assembly , he recalled her eagerness to see her private members motion be reinstated as TCI law.

motion on service charge when it was first brought to the House in 2016 by the PDM. This week in a strongly worded statement the People`s Democratic Movement (PDM) Chairman, Douglas Parnell, in response to Royal Robinson`s accusations said he was not appalled by the name-calling emanating from the Opposition party, since it was evident that that party had descended to gutter politics.

Parnell said his Government is

committed to getting the service charge in the pockets of workers across the Turks and Caicos Islands.

A change in the law would give hotel workers 100% of the service charge collected, and not just the 40% they are reportedly now receiving, which means a larger take-home pay.

He said: “This is precisely why the Ministry of Finance has been conducting surveys of hotel workers to ensure that the Government gets the law right.

“Members of the hotel industry and general public can access the survey online at www.gov.tc. This is far more than the PNP ever did.”

Parnell divulged that in a recent meeting with the TCI hotel and tourism association, the Minister of Tourism put the industry`s main trade group on notice that it was the PDM Government’s intention to pass a service charge bill to provide 100 percent of the revenue into the pockets of workers.

He added that : “ The PDM government’s aggressive approach and movements to get the bill right before bringing it to Parliament caused the PNP chairman to quickly dust off an old bill that was on the agenda of the last House of Assembly meeting before the general elections.”

Parnell, in defending his party`s long held position on this service charge issue, said: “This is not his bill.

“Our party is committed to the workers of this country and will fulfill our campaign promise of delivering 100 percent of the service charge to them, but we must get it right and

– Public condemns Government`s new boards and committee appointments

BY OLIVIA ROSE THREE months as a new Government the PDM Administration has come in for heavy criticisms, following the unveiling of new boards and committee members.

The public has displayed mixed reactions on the appointment of new Boards and committee members with some critics labeling the appointments as “cronyism” and “nepotism.”

Cabinet last week advised Governor John Freeman to appoint members to the Board for the Ministry of Border Control, Ministry of Home Affairs, Fisheries Advisory Committee, the Tourist Board and the Public Health and Environment Board for a period of one to two

years.

Approximately 80 people were appointed to serve in various capacities on several Government boards and committees.

Popular radio announcer and commentator Jackie Lightbourne bashed the PDM Government for selecting individuals who in her opinion have made little to no contribution to the country`s development.

Lightbourne candidly voiced her disapproval with the selection.

She said: “The majority of the selection of the persons they have on the Boards they appointed them for two years and three years, persons who made no contributions to this country, persons who should have towed the line, who are newcomers

-- you done put them on Boards.”

Lightbourne pointed out that the list has too many spouses and close relatives.

She added: “You can’t put husband and wife on Boards, the husband of the Minister, the wife of the Minister; those people don’t need to be on the Boards, let those people stay home and be there for you when you come home stressed out.”

During this Week`s Talk Back segment, several other critics weighed in on the appointments, with one person questioning the need for so many boards and committees.

“Firstly, one must ask why this country needs such a proliferation of Boards and Committees in the first place.

“It seems that these will only

backlog the operation of the affected Government Departments, without really bringing any real benefit to the underlying processes.

“One need only look at the delays and frustrations occasioned by the Immigration Board failing to meet on a sufficiently regular basis to know how true this assumption is.

“Then, even if we must reluctantly acknowledge that these Board and Committee appointments are accepted ways of rewarding the “party faithful”, one must question whether the appointees have any knowledge of, or experience in, the areas they are now expected to influence.

“What guidance is given to those who are to sit on the Work Permit

that is why we are calling on all in the tourism industry to participate in the survey being conducted.

“The name calling by PNP higher ups is regrettable and unbecoming of Parliamentarians, but this now seems to be par for the course.

“Royal and his gang of empty canisters should focus on supporting the initiatives of the Government to get the survey complete so that TCIG can properly enact a law that captures the fair share of service charge and put it in the pockets of workers and stop fronting and stunting.”

The PDM Chairman called the propaganda being churned out by the PNP “pure lies” and a desperate attempt to find its way after a scorching defeat at the polls.

The PDM Government has been focused on outing a number of fires that were left burning by the previous administration, including addressing the needs of the poor and needy who had not been delivered sustenance payments for 2 months while surpluses were accumulating, and issuing directives to ensure that the prison populations were well guarded and secure, Parnell said.

Board, for example? Are they given any details on exactly what skills the country seeks to import, or is the work permit process going to continue to be just another means of raising revenue for the Government, without any thought being given to the social problems that arise from the importation of minimally-paid laborers?

“Perhaps what we need is a properly-constituted “Illegal Immigration Board”, to advise and assist Government in dealing with what is known to be a huge problem, and suspected to be a source of much of the crime prevailing in our community these days.”

Another contributor said: “Cronyism, nepotism, calls it what you will, always rule the waves.

“Talking of Britannia, the U.K. side of things doesn’t fair better; full of political correctness and hubristic being the adjective that springs to mind.

“In fairness, there are some really good people; especially in the CONTINUED 

Court cites lavish parties, re-election campaign – in refusal to release Michael Misick’s money

BY DELANA ISLES IN ITS latest denial to release funds for Michael Misick’s living expenses, the Supreme Court cited his lavish 50th birthday party, his massive re-election campaign, and number of other expensive habits he has maintained since being returned to the TCI. The March 23 judgement followed an application by Misick’s lawyer Queen’s Counsel Jerome Lynch and a subsequent hearing held on February 17.

The matter was heard before Chief Justice Margaret RamsayHale with Special Prosecutor for the SIPT cases Andrew Mitchell Q.C. representing the Crown.

Misick’s application sought a variation of the 2011 Restraint Order granted by former Chief Justice Gordon Ward, in order for him to have money to live on, pay outstanding debts and to take care of his children.

The Order was granted pursuant to the Proceeds of Crime Ordinance 2007 and prohibits the disposal of Misick’s assets wherever they are in the world and in whosoever’s name those assets may be held.

Last week, the former premier took to social media to bemoan the Court’s ruling, posting that he has been unable to maintain his living arrangements at the Alexandria Resort or take care of his minor children.

Misick also suggested that the court’s refusal to release his money is a denial of his human rights and flies in the face of the presumption of innocence to which he is entitled.

This is not the first time the former premier has applied for the release of his funds to cover reasonable living expenses since he was extradited to the Turks and Caicos Islands from Brazil.

In that first instance in 2014, his application to vary the order was denied until he could provide the court with an affidavit of his assets, that he tell the court how he supported himself while he lived in the Dominican Republic when he first left the TCI IN 2009 as well as in Brazil in 2014, how he paid his legal fees in fighting the extradition proceedings and for the court to be satisfied that he did not have access to any other source of funds.

Special Prosecutor Helen Garlick, who had represented the Crown in that instance, had told the court that the prosecution was not satisfied that Misick did not have an undisclosed source of funds.

Misick’s lawyer had claimed that the former premier was being supported by friends and family, to which the court requested affidavits from those persons.

At the 2014 hearing, presided over by former Chief Justice Edwin Goldsbrough Misick was granted a release of some $199,000 held in escrow by Misick & Stanbrook for legal fees, however the requested affidavits were never provided as such the Order was varied.

A second variation of the Order was filed on February 2, 2016, when Misick attained the age of 50 and became entitled to a lumpsum payment and monthly pension payments. This sum is estimated at $500,000 currently with a sum of $8,000 falling due every month.

The former premier sought a variation of the Order so that he could pay his strata fees at the Alexandria Resort, including arrears, to avoid his utilities being disconnected.

It was accepted by the court at the that the monthly strata fee was an integral expense for the maintenance of the unit which was caught by the terms of the 2011 Order but that utilities such as water and electricity should be regarded as living expenses.

In response to the application, Garlick reminded Misick & Stanbrook (who represented the former premier) that Misick had not yet complied with the 2011 disclosure order.

In June 2016 Garlick sought Misick’s consent to the variation of the 2011 Order, to which his lawyers indicated that they had no objection in principle to substituting the Restraint Order and would be seeking to agree a variation of the Order to provide a monthly sum for living expenses.

However, while the lawyers provided (October 2016) the Crown with an affidavit of Living Expenses and asked that the restraint order be varied to allow Misick access to the pension payable to him by the TCIG, the Crown eventually refused to consider it on the grounds that Misick had still had not complied with the order made by Goldsbrough.

MISICK’S EVIDENCE According to Court documents, in order to advance his renewed application to the Court for a variation to the Order, Misick filed an (undated) Affidavit of living expenses on February 1, 2017 wherein he sought to account for how he supported himself in the Dominican Republic and Brazil.

In his affidavit, he states that he had access to about $350,000 from April 2009 to October 2011 when he lived between the TCI and the Dominican Republic.

The money came from the following sources: his monthly salary of about $12,000 from the TCI Government from April to August 2009; monthly rental income of about $5,000 from Grace Bay Plaza up until June 23, 2011; a $202,000 loan from Lofton Misick which was secured by a charge over his unit at the Alexandria Resort; $2,000 per month from Arlington Musgrove; $2,000 per month from Don Gardiner; and $2,000 from his friend and former member of his Cabinet, McAllister Hanchell.

Court documents further revealed that in the period between April 2009 and January 2011, his expenses amounted to about $243,600 which he itemised as follows: US$3000 per month on house rental in DR; US $300 per month on electricity in DR; US $300 per month on a housekeeper in DR; US $1000 per month on a driver in DR; (e) US $2000 per month child support; US $2000 per month for a housekeeper in TCI; US $1,500 per month for the maintenance of the former Premier’s residence; and miscellaneous US$2500 per month.

Between January 2011 and October 2011, court documents showed that Misick’s stated expenses appeared significantly reduced: US$ 2500 per month on house rental in DR; US$30 per month on electricity; US$300 per month on a housekeeper in DR; US$1000 per month on a driver in DR; $2000 per month in child support; and miscellaneous US$1000 per month.

During the period October 2011

to January 2012, when he moved to Brazil, he asserts that he survived on the money which remained, which was some $30,000 and continued to pay child support of $2000.

From January 2012 to December 2012 he stated that he survived on the generosity of Roy Devereux who he had befriended in Brazil while staying at a hotel.

He further asserted, according to court documents, that he lived with Devereux rent free from January to December 2012 who also provided him with “pocket money” over the relevant period of about $40,000. He asserts that he continued to pay child support out of this sum.

He stated that when he was arrested and jailed in Brazil, his mother and his brothers, Ariel and Phillip, gave him $50,000 to cover his legal fees.

After he was released from jail in March 2013, he received $6,000 from Messrs. Gardiner, Musgrove and Hanchell and lived at his attorney’s apartment at no additional cost.

He was re-arrested in April 2013 and remained in prison in Brazil until he was extradited to the TCI in January 2014.

Since his release on January 13, 2014 with a condition of residence at the Alexandria Resort, Misick asserted that he has been in receipt of a monthly allowance of $700, paid first by his mother from until October 2015 until her demise and after by his brother Washington.

He asserted that he also receives financial support from various friends, to wit Arlington Musgrove, Don Gardiner, McAllister Hanchell, Jahmal Misick and Garnett Jolly, in the sum of approximately $2,700 per month.

Affidavits were provided by Washington, Lofton and Ariel Misick

(the former premier’s brothers); Garnett Jolly, Arlington Musgrove and Don Gardiner (Misick’s cousins); Jahmal Misick (Misick’s nephew) and Roy Devereux which were filed to provide evidence of the third parties in support of Misick’s assertions in intended compliance with the 2014 Order made by CJ Goldsbrough.

In light of this compliance, in February the former premier again asked the Court to vary the restraint order to make the following financial provisions for himself and his children in the following terms: US$ 1425.07 for strata fees; US$ 50 for strata telephone connection; (c) US$108 for strata TV connection; US$ 175.66 for strata insurance fees; (e) US$305 for strata electricity; US$121.24 for strata water connection and fees; US$2000 for child support of four younger children; US$ 2775 for son in college; US$1000 for food and general living; US $150 for phone; US$500 for gas; and US$800 for housekeeper and upkeep of his residence.

With respect to his outgoings Misick told the court that he is in arrears in the amount of US$90,177.74 with respect to the strata fees including utilities and that he is only able to take care of some of the aforementioned expenses.

THE LAWYERS’ SUBMISSIONS Jerome Lynch QC, who appears for Misick in the February application, pressed all of the points contained in Misick’s third Affidavit including his request that reasonable sums for child support be allowed.

Lynch at once accepted that Mildred Rivas’s (one of Misick’s children’s mother) request to be allowed the sum of $10,000 was not a proper claim.

The lawyer submitted to the court that Misick has been relying on people helping him up until now and that there are no hidden assets and that given the circumstances, the court should permit him access to reasonable sums for his living expenses and cease his dependency on his family and friends.

The lawyer also submitted to the court that Misick is currently living at the Alexandria Resort with no water and no electricity, that he will have nowhere to live if he has to leave and that he should be permitted to use the pension funds to settle the arrears of strata fees inclusive of power, water and telephone, money to pay his strata fees going forward, sufficient funds to meet his living expenses and assist with his son’s education in the United States.

should be astute to preserve the asset which the Strata Corp may seek to sell in order to recover its arrears.

In his response, Queen’s Counsel Andrew Mitchell, for the Crown, reminded the court that it is for Misick to persuade the Court that there are no funds other than the pension monies on which he can rely to meet his financial needs.

Pointing to one example to demonstrate the inherent implausibility of Misick’s assertion that he does not have access to any undisclosed funds, Mitchell pointed to the former premier’s proposed wedding in 2013 to his then fiancee Tatjana van de Merwe, which on the evidence in the possession of the Crown would have cost at least US$12,800.

The prosecutor also pointed to Misick’s apparent expenditure in 2016 as evidence of undisclosed assets.

He noted that during 2016, Misick celebrated his 50th birthday with a lavish party held at a public venue at which international music stars performed.

He also flew to the Dominican Republic in May to receive private medical care, ran for election in December and, on the face of it, mounted a comprehensive election campaign and got engaged again at which time he presented his new fiancée with a valuable engagement ring.

In reference to the engagement ring, the prosecutor told the court that he does not have any evidence that Misick purchased the ring.

With respect to the third party affidavits, Mitchell submitted to the court that none of them make sufficient disclosure to discharge Misick’s burden of satisfying the Court that he does not have undisclosed assets.

Lynch, in responding to Mitchell’s submissions with respect to the particular issues not covered in Misick’s affidavit told the court that Misick received medical treatment in the DR free of cost, that his friends paid for his 50th birthday party, that the bar was in all of the events a cash bar, that the musicians who performed did so for free and that his campaign was funded by friends and supporters and that the details of their contributions were provided to the Integrity Commission.

The Crown, he submitted, could have found out how Misick’s campaign had been funded by asking the Commission.

JUDGE’S DECISION In her decision, the Chief Justice found that Misick bears the burden of persuasion in satisfying the Court that it would be just to vary the Order.

She added that more particularly, he must persuade the court that he has no other funds to which he can have recourse and to do this he

would have to show the source of the funds which have allowed him to live without any visible means of income outside of the Islands between 2009 and 2014, celebrate his 50th birthday in lavish style and campaign for reelection in 2016.

“It appears to me that, to discharge his burden, he would have had to go further in these proceedings than he has in seeking to rely on the unsupported affidavits of his family and friends.”

She noted that to rebut the inference arising from the unexplained transfers of wealth to Musgrove, Lofton Misick and Rivas, which is that persons in and outside of TCI hold funds for Misick which have not been disclosed, cogent evidence of the source of the funds ostensibly provided by them would have had to be exhibited - bank transfers, cheque payments or bank statements that would demonstrate from any verifiable source that the payments that have allegedly been made to Misick have actually been made by the affiants and that they were made out of their own resources.

She added: “Even if I were to accept that any or all of the affiants provided him with funds, in the absence of any supporting exhibits, there is nothing to dispel the inference that these were disbursements from funds held in their names which he transferred to them while he held the strings of TCIG’s financial purse and which they hold on his behalf and over which, in practice, he has control.”

The Chief Justice pointed out that Misick would also have to provide evidence with respect to the costs of his party, his election campaign, his medical expenses, who paid for them and from what sources to persuade the Court that he had not in fact been able to call on undisclosed assets to pay for them.

Absent cogent evidence to show how his birthday party and his campaign were financed, the inference to be drawn from his activity is that he has access to undisclosed assets, the judge noted.

She said that she does not find it inconsistent with such an inference that Misick has steadfastly refused to pay the strata fees and related expenses at the Alexandria.

Adding: “On his own case, notwithstanding the generosity of his friends, he made a choice to pay a housekeeper instead of his utilities and to celebrate his birthday and pursue re-election rather than pay what he owes, heedless of the consequences. I, therefore, refuse the application to vary the order to allow for Mr Misick’s personal living expenses.”

She also refused to vary the order to settle any of his outstanding debt as well to pay child support fees.

She said that there is no independent evidence that Misick has been paying maintenance for any of his other children.

Dominican poachers on board the vessel they were captured on

Local authorities capture over 40 Dominican poachers

BY DAISY HANDFIELD FORTY-THREE Dominican poachers were arrested on March 16 and charged on March 27 in the Magistrates Court in Providenciales, after they were found with a large quantity of fish on a fishing vessel.

The suspects all plead not guilty and were remanded until April 3, 2017.

The white vessel, bearing the name ‘Captain Blaze’, about 80 ft long, contained a number of dinghies and over 39,000 pounds of mainly fish.

The men are facing charges for the use of breathing apparatus to take marine products, possession of undersized Nassau Grouper,

possession of parrot fish, using unlicensed commercial fishing vessel, possession of spear gun, taking marine products by use of spear gun, using any vessel to conduct fishing, engaged in commercial fishing in the Mouchoir Banks without a license and taking marine products without a licence.

According to a Police statement issued during the time of the incident, as Marine Police approached the vessel, the men attempted to evade capture and as a result, officers took action to bring the vessel to a stop.

Coastal Resource (DECR) and Marine Officers jointly initiated an investigation and removed the marine products and other items, which were handed over to DECR. The men were arrested on suspicion of illegal fishing and taken into custody.

Mr Kevin Clarke, Police PR, in an interview with this publication praised the Marine Division for successfully carrying out the operation. He said: “Hats off to the officers of the Royal Turks and Caicos Islands Marine Police who were able to capture these poachers.

“Although it was challenging and dangerous, no one was injured during the process,” he said.

Government dispels rumors of Haitians being forced to eat from garbage dumps

BY OLIVIA ROSE MINISTER of Health, Agriculture and Human Services, Honorable Edwin Astwood on Thursday dispelled rumors that Haitians are being forced to eat from garbage dumps in the Turks and Caicos Islands.

The Minister`s comments follow the circulation of a video purportedly originating from an investigative story by the international news network Aljazeera.

The almost two minute news story, produced in 2015 was resurrected recently and made its way on social media where it went semi-viral.

The video details the hardship and plight many Haitian migrants face after their treacherous sea journey to the Turks and Caicos shores in search of a better life.

In the video several Haitian migrants were seen scavenging through garbage at a dumpsite on Providenciales in search of food and other useful discarded household items.

Aljazeera journalist, Nick Spicer who interviewed several migrants in Providenciales said: “They came here because they wanted to work in the many luxury hotels on the Turks and Caicos Islands.

“Now they live in a dump, they eat the meals the wealthy visitors are too full to finish, and wear the clothes the people throw away, some cover their faces to keep off the flies, but one man says he also feels shame.”

However, the Environmental Health Department within the Ministry of Health advised residents, visitors and the international community that the story “Haitians forced to eat from garbage dumps in the Turks and Caicos Islands” is not true.

The release stated: “There are no

Haitian nationals in the Turks and Caicos Islands who are forced or were forced to eat from any dump sites in the TCI.” The Department further noted that over the last several years it has made significant improvements to the solid waste management facilities throughout the country, especially the sites in Grand Turk and Providenciales.

“The dump sites on Providenciales and Grand Turk are both fully enclosed to prevent unauthorized entry as well as to provide improved containment and security.

“You will note from the publication that the dumpsite is not representative of the current dumpsites on either Grand Turk or Providenciales.

“The Turks and Caicos Islands does not support or encourage persons whether legal or illegal residents or visitors, to eat from the dump.”

It further stated that all communication regarding such should be disregarded and treated as falsified information.

The final phase of modernizing the processing work permit processing will involve the ability to pay permit fees online.

In announcing the improved service, Sean Astwood, the Deputy Premier and Minister for Border Control and Employment, commented: “It is my government’s intention to demonstrate our full commitment to improving service delivery in all areas of my Ministry.

“This new system will address some of the longstanding complaints that the business community express on a regular basis, more notably, the lack of feedback, lengthy delays in the process, and the absence of identification for family members who are permitted to reside in the Islands with permit holders.

“For staff, it will resolve the issue of tracking documents and it will serve as an important compliance tool for enforcement officers”.

He further noted that all staff, employers and their agents have a responsibility to ensure that the system yields the intended benefits and ask for the support of all persons, especially during the implementation

period.

Permanent Secretary, Clara Gardiner also commented on the advancement of the new system, stating that the Ministry is finally at a stage where it is able to communicate publicly, and that the hard work and efforts of key project team members over the years is about to produce results.

She noted that the launch of the work permit database is the first of a multi-faceted IT modernization that is taking place across all departments with the Ministry of Border Control and Employment.

She further echoed assurance that in light of the implications the impending changes will have for staff, as well as the business community, a series of engagements that will take place over the next few weeks with key stakeholders.

There will also be postings online, leading up to and beyond the go live date which will be announced in due course.

Supplementary Labour officers arrested on Bill is passed suspicion of forged work permits THE fifth and last supplementary bill for financial year 2016-2017 was on Monday (March 27) passed in the House of Assembly with majority support.

The majority of the monies, some $356,629 from the recurrent expenditure and $2.26M from capital expenditure, will go towards acquiring properties that the Turks and Caicos Islands Government has been renting for several years.

Two of those buildings are the Carlos Simmons building that was has been rented by TCIG for more than 15 years, and the other is the Sammy Been Plaza.

Premier Sharlene Cartwright Robinson, who presented the Bill to the House, noted that the Government will be completing to purchase of the Sammy Been Plaza - the entire sum of which is $2.3M. She stated: “We are looking to recover this investment in no more than seven years but to also save a minimum of 384,000 in rent.”

She also thanked those Opposition members who supported the Bill, noting that there is wisdom in a government acquiring assets.

“I know that a lot of the time governments before us would have felt a bit cold feet about acquiring properties and reducing rent for those persons who would have invested. It is our business and our job to create the economic activity that there would be a private sector that would be willing to rent from these buildings once the Government vacates them.”

While all of the Opposition members supported the Bill, George Lightbourne – PNP elected member

for Grand Turk North - was very critical of the monies being taken from allocations for major projects, particularly for Grand Turk.

He pointed to the Mega One Triton boat, which has been an eyesore for years, and the allocation of $700,000 in the 2016-2017 budget for its removal as being a failure of the new government in its first one hundred days.

“After almost 100 days in office, we have seen no real effort was made to move that boat and so I am very saddened that no attention is apparently being paid to Grand Turk by this government… the boat that so much work and attention was put into by the previous administration, is going to be left on the beach.

“A prudent government would have included in the supplementary additional funding to go to $700,000 to move that boat (Mega One Triton).

As she explained on March 22, when the estimates for the supplementary appropriations was first tabled in the House, the money is being taken from several projects that did not have successful bidders or where there was no response to tenders as well as savings in other areas of the budget which would have been lost when the 2016-2017 financial year comes to an end on March 31.

Meanwhile, another portion of the supplementary allocation is going towards the housing and repatriation of the 40 plus Dominican poachers who were caught in TCI waters recently, while another portion of the money will be to be used to settle a number of litigations against the Government.

“The TCI has a small population that is getting smaller. It is hard to find qualified people other than your friends and some relatives.

“We need real legal immigration to swell the population. Hopefully the new

minister of immigration will take that department apart and open the legal doors.

“In the meantime who could complain about the new government when the people ignored what the former government did.

“NIB Board members ErvIn Quelch and Trevor Cooke transferred over 20 million of the pension funds to political friend Washington Misick’s high risk private bank.

For 4 years Washington served with his niece Akierra and his nephew DonHue.” However, Premier Sharlene Cartwright-Robinson has since said that the members assigned to serve are irrefutably qualified for the positions.

Cartwright-Robinson also revealed that several Boards are yet to be appointed.

BY OLIVIA ROSE TWO FEMALE employees of the Ministry of Border Control and Labour were arrested on suspicion of forged work permit documents on Monday March 27.

The investigation is part of a joint crackdown launched by detectives of the Royal Turks and Caicos Islands Police Force Financial Crime Unit and the Integrity Commission.

The Crime Unit launched an investigation into a number of allegations of forged Turks and Caicos Islands work permits that have been issued to a number of persons within the Haitian and Dominican Communities.

According to the Police, detectives along with members of the Integrity Commission, on Monday March 27, conducted a number of searches at various locations.

They discovered that after valid work permits expired, payments would be made through an agency for renewal and instead of receiving renewed valid work permits these nationals were issued with forged work permits.

The Two females, ages 28 and

47 were arrested on suspicion of Uttering Forged Document.

Director of the Integrity Commission, Eugene Otuonye has since said: “This is primarily a Police operation and the Integrity Commission is an interested partner that is working in the background of the investigation.

Also weighing in on the arrests Minister of Border Control and Employment, Hon Sean R. Astwood, issued a statement echoing similar sentiments.

He pointed out that since it is a police matter he did not want to comment prematurely, in an effort to avoid influencing the outcome of the investigation.

The Border Control and Employment Minister said: “I can confirm that persons were arrested and released on bail.”

Astwood emphasized that his Government supports a corruption free public service and any activity that would lead to the accomplishment of this state of being.

He further urged other workers to work together with police.

“I want to encourage the many honest and hard working men and women under my Ministry to continue to uphold the principles of integrity without fail and will cooperate fully with the RTCPF and Integrity Commission.

“We are working tirelessly to address all customer service issues in the Department of Border Control and Employment Services.”

The Minister pointed out that his ministry is currently undergoing a vigorous restructuring exercise to improve the delivery of quality of services to enhance the customer service experience.

“We have a customer service department that will receive some additional manpower and we are computerizing and streamlining processes to reduce the wait time for birth certificates, death certificates, work permits, Labour clearances, and other essential documents.

“This is an ongoing process and the public should see improvement in these services in the very near future.”

According to Police more arrests are expected to be made as the probe continues.

‘Change Government’ mum on legislative agenda – Royal Robinson

BY OLIVIA ROSE PNP`s Chairman, Royal Robinson is accusing the three-month old PDM Government of reneging on several critical promises made to the people on its touted 100 days plan.

Robinson in two separate releases this week bashed the Government for not delivering on its promises.

One such promise cited by the Progressive National Party`s Chairman, is the crafting of a legislative agenda which would update and introduce new laws essential for a growing country.

He noted that the Government has yet to produce its Legislative Agenda showing the laws that it intends under its mandate to introduce whether as amendments to existing laws or entirely new Bills.

Robinson said: “Before assuming office, Hon. Premier Sharlene Cartwright-Robinson spoke profusely about a legislative agenda and the importance of one.

“Well to date, like most things, this “Change government” is completely mum about such an important tool.

“This would clearly show the people of the Turks and Caicos Islands how they fit into the scheme of things.”

The PNP Chairman pointed out that to date, the only bills enacted were those dealing with financial matters to ensure that the government keeps running or to purchase properties, in the main.

Noting that several other bills

Robinson said :“We have heard about the vaulted 12 Point Plan to combat crime, but nowhere, so far any real inkling of that plan has seen the light of day.

“We are aware of the spike of criminal activities within our country.

“In fact, there was a joint PNP/PDM press conference to demonstrate our solidarity and commitment to eradicating crime in the Turks and Caicos Islands.”

Robinson propounded that since that meeting the Government has not allocated any new funds or rearranged its financing priorities to allocate funds to aid in the fighting of crime.

“There has not been any Legislative effort by way of a Bill to

aid in this fight.

“The one substantive piece of legislation that was brought, was the Bribery Bill, which by the very nature of the body language of the Government’s Front Bench, they are clearly not in sync with.”

Robinson in his seethe argued that the PDM on its campaign trail prioritized employment and improvement in the education sector, but is yet to put forward legislations to bring these advancements to fruition.

He questioned: “Where is the legislation that strengthens the educational opportunities of the ordinary Turks and Caicos Islander.”

“The one major construction development project that most likely would come to fruition in the very near future, they have been spewing cold water on, to the extent that Tuscany and Venetian can thumb their proverbial noses at us by dragging the litigation to the Privy Council with nary a peep out of this government.”

“Change indeed might be here, but surely this is not the one that the people voted for.”

The production of a legislative agenda will aid the Government in presenting the best positions and encourage dialogue from a wide cross section.

The absence of an Agenda under previous administrations has seen on occasions the shortest possible Notice for Bills to be brought to the House and even less time in the public domain.

Public sector overhaul

BY OLIVIA ROSE SEVERAL Government technocrats will soon function in new capacities as the public sector gets a major shakeup.

For the first time since it was elected, the People`s Democratic Movement (PDM) government will be able to bring home many of its long-held ambitions to push structural, economic and social policy changes.

These include a desire to drastically reduce bureaucratic duplication, accelerate service delivery and make government agencies and departments work to a common purpose rather than competing against each other, as has often been the case under previous administrations.

The shakeup will see several Government employees including directors, permanent secretaries,

senior managers, deputies and other personnel functioning in new roles.

According to a release from the Office of the Deputy Governor, Anya Williams under, whose purview the Civil service falls, the overhaul is in keeping with efforts to improve service delivery and to realign skills across the government.

It was noted that the senior management structure will take effect on April 1, 2017.

According to the release, The Ministry of Border Control, headed by newly assigned Permanent Secretary Susan Malcolm and Deputy Secretaries Althea Been and Sharon Taylor, will be heavily focused on the implementation of the Business Transformation Strategy, which will see the launch of a new Border Management System, several online work permit application processes, the introduction of new work permit cards and the implementation of the

recommendations of the National Skills Audit.

Relocating to the United Kingdom to study, work and reside For the past few years, there has been a significant increase in the number of Turks and Caicos Islanders relocating to the United Kingdom (U.K.) to study and/ or live. Evidence of this can be seen in the over two hundred (200) students who are currently registered and studying in the U.K., in cities such as London, Manchester, Birmingham and Leeds.

It is important to note that Turks and Caicos Islanders are British Overseas Territories Citizens, and as such, are subject to UK immigration control with no automatic right to live or work in the UK. However, those British Overseas Territories Citizens,who are both a British Overseas Territory Citizen as well as a British Citizen, are eligible to obtain an EU/British passport with the right to reside and work in the UK. This being the case, the Ministry of Border Control and Employment and the Turks and Caicos Islands

Government London Office (TCILO) hereby advise all persons who are interested in, or are planning to relocate to the U.K., whether to study or to live, to only do so after applying for and receiving their EU/ British Passport.

It should also be noted that Turks and Caicos Islander students can only benefit from UK ‘home fees’ if they are in possession of an EU/ British passport.

If the intention is to live or work in the UK, shortly after arrival, TCI citizens are advised to first obtain a National Insurance number, a process that is significantly easier with an EU/ British passport.

On the subject of travel to the U.K. and within European Union member states, it is the experience of the Team in the Turks and Caicos Islands London Office, that the possession of an EU/British passport reduces the potential for confusion and delay, particularly if entering the country for the first time.

Depression rates on the rise in the Caribbean

BY TIARA MCTAIRE Substantial levels of loneliness, anxiety and depression have been identified as a persistent threat to the mental wellbeing of many persons across the pendulum. Unfortunately these findings are not isolated, many first world, and third world countries including those in the Caribbean are feeling the effects of this ‘common’ disease. The World Health Organization has even deemed depression as the leading cause of disability worldwide, and a major contributor to the overall global burden of disease as there has been over an 18 percent increase in diagnosed cases from youths to geriatrics since 2005.

Statistics from the Department of Mental Health & Substance Dependence’s 2016 annual report, illustrates that mood affective disorders which range from severe depression with psychosis to mild depressive disorder, was one of the top three leading diagnosis made throughout the islands, accounting for 20 percent of the population seen.

What is more so startling is data presented by the psychiatric services division which reported that the number of hospital admissions for psychiatric services, resulting from disorders linked to depression accounted for 47.6 percent of those admitted. Locally, persons assessed and receiving treatment for mood related disorders were predominantly female, this disproportion is in accordance with the World Health Organization’s 2015 Global Health Estimates, where women were 1.5 percent more likely to be diagnosed with depression than males.

Depression is known to increase the likelihood of suicide/ para-suicide and risk of other non-communicable diseases such as heart disease and diabetes. To combat this issue a three tiered plan was enacted; education and research to ensure that persons were not only aware of depression and its symptoms, but to ensure that the general public and those who were in the most vulnerable positions were assessed. Suicide was the second leading cause of deaths globally between person 15-29 years old and the cause of approximately 800,000 other deaths making it the 20th leading cause of death of 2015. Optimizing on Suicide Prevention Awareness Day, depression screenings were carried out for the general public and new mothers for two days throughout the islands, this was furthered by a walk and testimonials addressing the issue.

As with any treatment, it must be cost effective, services provided by the Department have been provided free of charge by The Turks & Caicos Islands Government, which also through the aid of the Social Development Department reduces the cost of prescription medication for some persons who require those interventions.

Lastly, the increase of reported cases has led to additional clinical staff` employment, including a Community Mental Health Nurse, Mental Health Counsellor and Clinical Psychologist. This has ultimately led to an increase in accessibility to support services.

Victoria Public Library in Grand Turk receives donation of over 100 books

BY DAISY HANDFIELD OVER 100 books were donated to the Victoria Public Library in Grand Turk, by Bark and Bliss veterinary clinic, after the establishment suffered from a recent fire which engulfed the 19th century library earlier this month.

The donation was made after the Cheshire Hall Medical Centre in Providenciales made a generous donation of over 100 books to the veterinary clinic, after hearing about the cause.

Miss Nikira John, public relations officer for Interhealth Canada handed over the books to representatives of the clinic during a press conference on Wednesday at the hospital on the Leeward Highway.

Dr Meghann Kruck, veterinarian at the Bark and Bliss clinic told media houses during the press conference that Grand Turk was quite near and dear to the hearts of staff of the clinic.

She said: “We have been visiting Grand Turk and providing veterinary care for about three years, newer as Bark and Bliss. Our veterinary clinic wanted to do something nice by supporting the library and doing a book drive. When clients bring in a book, they get five dollars off of services.

The hospital gave us a call and let us know that they had 100 books for us and we were absolutely delighted. We then called the library in Grand Turk and they are just ecstatic.”

Vet Kruck added that although any amount of books is appreciated, their target is to restore at least a quarter of the books that were lost to the fire.

“If we could get 2,500 books that would be amazing. The library had 8,500 books that burnt down so if we could get close to a quarter of that, that would be good,” she said.

John said that both staff and patients of the hospital are delighted to be a part of the drive.

She said: “We are always

looking for ways to help and we were very excited to learn of a local organization, Bark and Bliss veterinary services, here in the Turks and Caicos Islands, who had put out a call for persons to donate any of their unused or unwanted or lightly used books towards a book collection cause for the Grand Turk library service.

“Here today, we have over 100 books that we have collected over the years from various employees who left these behind, obviously to lighten their loads when they left the Turks and Caicos Islands. We have kept these in our store room with hopes of one day maybe opening a recreational library here at the hospital. It is actually good that this particular initiative came up because we see this as an even greater cause.”

Books can be dropped off at the Bark and Bliss clinic which is located off Sand Castle road, near Chopsticks, Neptune Plaza in Providenciales.

Repercussions from PNP administrations haunted TCI through the Interim Government period well into the Rufus/Washy Government. Rattles continue to haunt TCI while the new PDM Government works to repair damage done to TCI financials and inward investment during 13 years of collective mess.

Admittedly it did not seem like a mess from late 2003 to early 2007 when the country was afloat with borrowed and land flip money. The Rufus/Washy period suffered from unfulfilled expectations of more of the same.

It was eight years of TCI under

slow and careful Chief Derek “Honest Abe” Taylor that gave TCI a honest careful reputation for managing its own financial and developmental affairs.

A reputation stolen then squandered by PNP running wild under the 2006 Internal Independence Constitution. A constitution of rights squandered is itself a serious repercussion.

The repercussions of having a CFO will go away only after the payback loans caused by the rattlers are fully paid and not repeated. We believe the actions of Premier and Financial Minister Sharlene are guided by the Almighty........therefore we must remember “The mills of God grind exceeding slow but exceedingly fine.”

APPROXIMATELY 80 local and international delegates attended an Investment Symposium hosted by the National Insurance Board, as part of their 25th year anniversary.

The three-day event was conducted at the Beaches Resort in Providenciales on from Monday (March 28, 2017) to Thursday (March 30, 2017) and featured a range of delegates from the Turks and Caicos, other Caribbean countries and the United States.

The TCI Cadet Corp performed a stellar flags and national anthems parade, Youth Explosion champions from the Wesley Methodist School gave a riveting show of culture including song, dance and costumes.

The Premier said intervention is required and promised that her Administration will be looking at ways the National Insurance plan can be bolstered and built so that is always able to respond to its contributors.

Manager for the National Insurance Board told this publication that NIB was pleased to be hosting this Investment Symposium and that she hoped the participants found the information useful.

She said: “The National Insurance Board is celebrating its 25th anniversary and as part of the celebrations, we have agreed to host a regional social security investment forum. The forum is on the governance, the framework and the strategy of social security institution.

We have invited delegates from the social security boards around the Caribbean region. We have actuaries, accountants, auditing firms, and we have speakers and presenters from the United States, as well as local and regional bodies from the Caribbean and the TCI.” The Investment Manager

emphasised that social security is very important in every country and that the more education delegates receive on governance and strategy and formulating policies, regarding social security is beneficial to the entire country.

“I think it will be really beneficial because we are grasping on the knowledge of these experts and whatever they can give us, in terms of their knowledge from investing fields and we really are drawing on their expertise to help us to propel our funds forward,” she said.

National songs were brought by the NIB Choir with remarks coming from Mr Reginald Thomas, who flew in from Mexico and is the Director of the Inter-American Centre for Social Security Studies. The Vote of Thanks was delivered by CEO of the NIB, Mr Walter Gardiner.

The event was held at Beaches TCI in Providenciales and saw visiting facilitator and regional manager for Yello Media Group, Mr Rasheed Girvan who spoke on the importance of keeping businesses abreast with the latest digital advancements and how it could enhance their companies.

He said: “The importance of that is a direct result of how many of your customers are online. What we have seen is that 81 percent of the population, in the US for example, has a social media account. If your business in any way, shape or form, targets or caters to an international

customer, it is critically important for you to have a good digital presence.

“If your business focuses on local audiences, it is still important because most of the audience are still online. Whether they are using it for internet, for social media or for research, many people are online.

If people are online, it provides an ideal opportunity to be able to reach them where they are.”

The regional manager informed stakeholders in the audience of the benefits of YouTube and the power it has to grasp the attention of internet users.

Mr Girvan explained that the number of businesses that incorporate digital media platforms like YouTube and apps to promote their business has increased drastically over the years.

“There has been an exponential increase in the number of businesses, small, media and large businesses

who use digital marketing to promote their businesses because people are more and more online.

“There is a good reason for that; access to devices that use the internet, smartphones for example, tablets and laptops are much more accessible and affordable. Because of that, people who have the interest will be able to very easily and in a

Once the customers are there and the public is there, it means that businesses who are interested in communicating with that public, need to be there also. The truth is that digital is very dynamic and things change very rapidly and very frequently. What may have been relevant last year this time, may not

be as relevant right now,” he said.

The Yello Media Group started off as one of the top publishers of online print and directories throughout the Caribbean, then begun offering website development, online videos, search engine optimization, search engine marketing and social media.

Tourist Board hosts a writing competition

TCIG host PAHO/WHO advisor from human resources for health The Ministry of Health, Agriculture & Human Services is pleased to welcome Dr. Erica Wheeler, Advisor, Human Resources for Health of the PAHO/WHO, Barbados Office, to the Turks and Caicos Islands.

This visit spans from the 27th 31st March 2017, and is to conduct an assessment of the TCI’s human resources for health in accordance with our 2020 vision for health care.

During her visit, she will meet with multi-sectoral stakeholders that impact the health system and its human resources. The aim is to gather information about the current human resources for health situation including education and training needs as well as discuss Turks and Caicos Islands capacity to develop human resources for health policy and plan.

Autistic classroom in Providenciales to celebrate World Autism Day

BY DAISY HANDFIELD CHILDREN from the Hope Autism Classroom in Providenciales will be hosting a World Autism Awareness Day party at the school in the Mills Institute, in Long Bay, as means of celebrating another year dedicated to the development and care of those affected by autism.

The event will be held on April 2, which is the day that the world join hands to host initiatives to commemorate the well-known disorder.

From 5pm to 7pm, parents, teachers and the children will celebrate the day with games and light refreshments at the school.

Mrs Maxcia Rigby, founder of the Hope Foundation and the Hope Autism Classroom told this publication in an interview on Thursday that this initiative is something that she has been conducting for the past four years and that is it usually well attended.

She added that the public was also welcomed to attend the party.

She said: “Join us as we continue to make a difference in the lives of our children and families in TCI affected by ASD.” The Hope Foundation for Autism Awareness, a non-profit organisation, was founded in the Turks and Caicos Islands on April 16, 2013 to cater to autism awareness, diagnosis, and treatment.

Eventually, the Hope Foundation partnered with the Mills Institute in Providenciales for the establishment of a classroom for autistic children.

The Hope Autism Classroom is specifically designed for children with autism, with furniture and a curriculum designed in a way to accommodate these students.

The classroom currently caters to eight students and the teachers for the classroom are professionals with experience in teaching children with autism.

Every year, autism organizations around the world celebrate the day with unique fundraising and awarenessraising events.

STUDENTS of the Turks and Caicos Islands are encouraged to showcase their creative writing and poetry skills, in a writing competition hosted by the Tourist Board, in collaboration with the Caribbean Tourism Organization (CTO).

A press conference was held at the Tourist Board’s office in Providenciales on March 28, 2017 to discuss the details of the competition.

The competition will run from March 28, 2017 to May 1, 2017 under the theme ‘A Year of Adventure in the Caribbean’, for children within two age groups- eight to 10 years and 10-12 years.

The competition seeks to encourage both formal and creative writing submissions related to strengthening tourism development in the region.

The formal writing stream may only include works that count as either essays or prose, while the creative writing stream may only include works that count as poems or short stories.

A local judging panel will review all submissions and determine the four winning entries, two per age group, which will be forwarded to CTO for the regional finals.

Winners will be determined based on the following criteria: knowledge of tourism, originality of ideas, expression of self, organization of thoughts, and grammar.

The writing topics given by CTO focus on sustainable tourism or adventure within the participants’

home country.

The CTO and its member countries and hotels will highlight the Caribbean as the leading choice for a vacation filled with adventure.

The campaign will celebrate everything from adrenalinepumping active pursuits, to local culture, and casually sampling experiences unique to a specific CTO destination.

Blythe Clare, training manager with the Tourist Board told media houses that she is officially the local competition coordinator and will be responsible for getting the information and coordinating the screening of the entries from the TCI. Oehleo Higgs, public relations officer with the Tourist Board explained that many times visitors were not familiar with all of the activities that the TCI had to offer, so this was an opportunity for students of the TCI to highlight some of the major attractions available.

“The question that we get asked the most by visitors is what to do when we visit your destination.

CTO uses that message from all of the communication professionals and decided that 2017 would be the year of adventure. Now, a lot of people think of Turks and Caicos and only think of going to the beach, but the Turks and Caicos is full of adventure.

We have once in a lifetime adventure opportunities which include whale-watching in Salt Cay, zip lining in Grand Turk or historic adventures by visiting the

Lighthouse in all of the historic districts,” he said.

Present for the competition launching were representatives from the various public and private primary schools on Providenciales, along with education officer, Mr Mark Garland.

Mr Garland expressed that he was excited about the competition, as it is another way for the youth to develop their more artistic and creative skills.

He said: “Creative writing and formal writing go beyond what we can express as it relates to the opportunity that it offers a child.

When I was a teacher, my most effective method of assessment was the compilation of portfolios.

Every week I would give my students a piece of writing and at the end of that week I would have an idea of the progress made. It is really remarkable to see the progress made at the end of a school term. Especially in the area of vocabulary, penmanship and in expressing their ideas.”

Lyn Smith, principal of the Richmond Hill Preparatory School mentioned that she was pleased that the private schools were not left out of the competition because many times they were overlooked when it came to initiatives such as this one.

“We are a part of what happens in this country. We train the children in this country, so we are really happy you remembered us. The children love to be a part of competitions like this,” she said.

Turks and Caicos Islands to observe world health day THE TURKS and Caicos Islands will join in the annual celebration of World Health Day. Introduced during the First World Health Assembly in 1948, and implemented in 1950, April 7th, has been set aside for this observance and addressing issues stemming from the annual Global Burden of Disease Report.

The Department of Mental Health and Substance Dependence in the Ministry of Health, Agriculture and Human Services will spearhead this year’s activities as the theme chosen is “Depression: Let’s talk!”

Statistics released from the World Health Organization (WHO) in 2015 indicates that depression has been recorded as a major contributor to the global burden of disease and has seen over an 18 percent increase in reported and diagnosed cases since 2005.

The latest Report from WHO

reveals the startling statistic that approximately 300 million persons are living with depression; this represents more than 4 percent of the global population. Furthermore, depression has been known to increase susceptibility to noncommunicable diseases and can also be a result of diseases already contracted. Unfortunately, serious depression can lead to suicide and it is reported that close to 800,000 die by suicide every year. While statistics in the Turks and Caicos Islands are of no comparison to the global figures, it should be noted that 20 percent of persons assessed and receiving treatment by the Department, as well as 47.6 percent of those admitted to the hospital by the Department are linked to Depression.

In an effort to ensure that the majority of these cases do not result

in lack of treatment, self-injury or death, the Department is asking for the community to support the activities that will be taking place, as stigma and discrimination is still a concern for many requiring mental health care.

On World Health Day and the days leading up to it, the Department of Mental Health and Substance Dependence will engage in a number of activities to increase awareness about the disorder and treatment opportunities. Baby your back Statistics show that over 80 percent of people will experience back pain at some time in their lives. Back pain hurts, of course, but it can also curtail routine activities, such as picking up a child or getting in and out of your car. The good news is that while some causes of back pain such as – i.e., medical factors and pregnancy – are unavoidable, in most cases you can prevent problems by taking care of your back with simple lifestyle habits. Here are five tips that will help.

1. PERFECT YOUR POSTURE It’s important to keep your spine properly aligned, whether you are walking or sitting. One way to improve your posture is to imagine that a string is attached to the top of your head, pulling you gently upwards towards the ceiling. Just thinking about it will help you lengthen your spine. When sitting, especially in front of a computer, be sure the chair supports your lower back – in a slightly arched position – and that both feet are flat on the floor. Don’t slump, and use an armrest to help reduce stress in

the upper body. For good sleeping posture, use a supportive pillow and mattress, and sleep on your back or side.

2. BE MORE ACTIVE - EVERY DAY Poor fitness is associated with back pain. All types of activity contribute to back health, especially strength exercises for the back and abdominal muscles, and flexibility stretching for the entire body. Always warm up before physical activity, and stretch -out when you’re finished. Try to make physical activity a habit.

Team from Ministry of Home Affairs returns from status of women conference THOUSANDS of women from countries around the world gathered at the United Nations Headquarters in New York during March 12th – 18th 2017, for the 61st Session of the Commission on the Status of Women under the theme, “Women’s Economic Empowerment in the changing world of work.”

A team of three persons namely Deputy Secretary, Mrs. Bridgette Newman, Gender Affairs Coordinator Mrs. Carolyn Dickenson and Acting Executive Administrator to the Minister, Ms. Kamala Roberts joined colleagues from other Overseas Territories under the United Kingdom’s delegation.

The conference was seen as an important opportunity to evaluate the progress made in the implementation of agreed conclusions from the fifty-eighth session (2014), on ‘Challenges and achievements in the implementation of the Millennium Development Goals for women and girls.’ It also allowed persons to take stock of the progress made in achieving goals

outlined in (CEDAW) Convention on the Elimination of all forms of Discrimination against Women as well as provide critical reflection on the direction to be taken in gender equality programming.

The TCI delegation participated in several meetings at the UK Mission to the United Nations, chief among which was a Ministerial session held on Tuesday, March 13th with other Overseas Territories counterparts and was chaired by GEO Director, Hilary Spencer. The session also allowed for the reaffirmation of our commitment to gender equality and equity goals in the sub region.

The main session focused on (CEDAW) Convention on the Elimination of all forms of Discrimination against women and what member states were doing to end violence against women and girls, promote gender equality and the rights and protection of women and girls as well as strengthening the family initiative.

Interesting (and bizarre) dental facts In aid of World Oral Health Day last week, the Oral Health Foundation, the UK’s leading dental charity, have looked at just how long we spend brushing our teeth during our lives with some amazing findings.

The charity has discovered that, with the average life expectancy currently standing at 81.5 years, if a person brushes their teeth for two minutes twice a day over the course of their life it would equate to 118,990 minutes - the equivalent of 1,983.16 hours or slightly more than 82 days. How do you think you match up against this??

To look at this another way, the charity and calculated that this equals more than 1,322 soccer games, 1,487 rugby matches, or even 16 five-day cricket test matches!

They also found that you could watch all of the current 60 episodes of Game of Thrones a whopping 33

times each, or the whole run of 236 episodes of Friends 22.9 times or even the whole Lord of the Rings trilogy a huge 192.8 times!

By releasing these statistics, the charity is hoping to draw attention to just how important our oral health is and make people realize how much time they should be dedicating to looking after their mouths. Dr Nigel Carter said: “From experience, in reality we know that a lot of people do not always spend two minutes twice a day, every day, brushing their teeth. But our message is simple, you should be!

Eastern Caribbean branded a transit point for drug traffickers by US THE Eastern Caribbean has been branded a “transit point for drug traffickers going to the United States and Europe” by the US State Department.

The department’s International Narcotics Control Strategy Report (INCSR), released this month, claims that the Eastern Caribbean hosts abundant transhipment points for illicit narcotics, primarily from Venezuela destined for North American, European and domestic Caribbean markets.

According to the report, marijuana remains the most commonly used illicit drug within the region and many of the homicides in the seven countries occur as a result of turf wars between factions fighting for control of drug distribution.

The report named St Vincent as a primary source for cannabis in the Eastern Caribbean.

Data provided to the US Drug Enforcement Administration (DEA) indicates that, during the first nine months of last year, drug seizures in the Eastern Caribbean totalled 196.65 metric tons of marijuana and 1,103.8 kg of cocaine, along with 159 drug trafficking-related arrests.

The INSCR nevertheless pointed out that: “As a matter of policy, the region’s governments do not encourage or facilitate the illicit production or distribution of

narcotic or psychotropic drugs or other controlled substances, or the laundering of proceeds from illegal drug transactions.

“No senior government officials in the Eastern Caribbean were prosecuted for engaging in or facilitating the illicit production or distribution of controlled drugs or laundering of proceeds from illegal drug transactions.

“Nonetheless, many observers believe that drug trafficking organizations sometimes elude law enforcement through bribery, influence, or coercion.”

Eleuthera man held in probe of voter fraud POLICE arrested a man from Eleuthera and brought him to the capital on Tuesday night to be questioned in connection with a “voter fraud” investigation, with Assistant Commissioner of Police Stephen Dean warning the public that the Royal Bahamas Police Force will take a “no tolerance” approach to such matters.

ACP Dean said the man was expected to be charged in court as early as Wednesday.

The arrest came a day after Parliamentary Commissioner Sherlyn Hall revealed that some people have registered twice at different registration sites for the same constituency, an irregularity that was picked up by the Parliamentary Registration Department’s computer database.

On Monday, Mr Hall said the department noticed cases like these from voters in New Providence, Grand Bahama and some Family Islands, adding that at least one case had been turned over to police.

Police moved swiftly in the matter, arresting an adult male yesterday.

Caribbean tax revenues rise despite low growth TAX revenues in Latin America and the Caribbean countries continued to increase in 2015.

New revenue statistics show that the average tax-to-GDP ratio in these countries reached 22.8 percent of GDP in 2015, up from 22.2 percent in 2014.

The average tax-to-GDP ratio across the 24 examined countries is currently 11.4 percentage points lower than the OECD average of 34.3 percent.

The difference between the OECD and Latin American and Caribbean countries is mainly due to lower tax collection on personal income taxes and social security contributions in the Latin America and the Caribbean (LAC) region. However, the difference between OECD and LAC tax-to-GDP ratios is gradually declining and is the smallest on record in 2015.

The report “Revenue Statistics in Latin America and the Caribbean” shows that surging revenues from value-added tax and excise taxes offset a decline of 0.2 percentage points in corporate income tax revenues and

explain the overall increase in the region’s average tax-toGDP ratio in 2015.

It was the first decrease in corporate income tax revenues across Latin American and Caribbean countries since 2011.

In contrast, personal income tax revenue has reached its highest level, during the period covered in this report, at 2.1 percent of GDP. Given the heterogeneity of countries in the region, there is a wide variation of tax-toGDP ratios. They range from 12.4 percent in Guatemala and 13.7 percent in the Dominican Republic to 32 percent in Brazil, 32.1 percent in Argentina and 38.6 percent in Cuba, which is the only country that had a taxto-GDP ratio above the OECD average.

However, a common feature in the region continues to be the reliance on indirect taxation as the main revenue source.

Indirect taxation accounted for almost half (49 percent) of total tax revenue on average in LAC countries, compared with a third (33 percent) in OECD economies.

Haiti called on urgently to advance human rights agenda FOLLOWING the adoption by the Human Rights Council of the universal periodic review outcome on Haiti, Haiti’s acceptance of recommendations to ratify the UN Convention on the Status of Stateless Persons and the Convention on the Reduction of Statelessness is significant in a situation where tens of thousands of people of Haitian descent born in the neighbouring Dominican Republic have been rendered stateless.

Amnesty International has urged the Haitian government to work closely with the Dominican government to restore Dominican nationality to those arbitrarily deprived of it in 2013. The government must also identify and register such persons who may be on Haitian territory and adopt and implement the draft Nationality Law to facilitate access to Haitian nationality to those affected by the previous ban on double nationality if they so wish.

In December 2016, human rights defender Pierre Espérance received death threats allegedly related to his human rights work. Amnesty International welcomed Haiti’s acceptance of recommendations to

protect human rights defenders and investigate thoroughly all allegations of harassment, threats and attacks against human rights defenders and bring those responsible to account.

LGBTI persons continue to suffer high levels of discrimination.

Amnesty International welcomed Haiti’s support of a recommendation to investigate and sanction violence based on sexual orientation, however, regrets its rejection of recommendations to combat stereotypes based on gender.

The cancellation in September last year of an LGBTI Film Festival following public threats, including by parliamentarians, against individuals and NGOs involved in the event, underscores the importance of these recommendations.

The enjoyment of the right to adequate housing remains precarious.

More than 50,000 people internally displaced by the 2010 earthquake continue to live in makeshift camps and scores of people deported or returning from the Dominican Republic live in similar camps on the southern border. Following Hurricane Matthew in October 2016, nearly 7,000 people continue to be displaced.

Plan hatched to release GM mosquitoes across Cayman Islands PLANS to expand the release of genetically modified mosquitoes across Grand Cayman have been submitted to the National Conservation Council.

The Mosquito Research and Control Unit has applied for a new import permit and outlined a proposal for a two-year program to fight the disease-spreading Aedes aegypti mosquito islandwide.

The proposal contemplates the construction of new mobile labs, converted from shipping containers, for hatching the larvae. It also suggests the genetically modified mosquitoes could be deployed on Cayman Brac.

Reports submitted to the council, along with the permit application, indicate the first phase of the project, in West Bay, has been a success and that the MRCU and its partner,

Barbados signs visa waiver agreement with China Citizens of Barbados and China can now enter each other’s territory with an ordinary passport and no entry visa, following the signing last week of a visa waiver agreement.

The agreement, which follows the initialing of a reciprocal agreement three years ago that removed visa requirements for holders of diplomatic, official and service passports, was officially signed by minister of foreign affairs, Senator Maxine Mclean, and China’s ambassador, Wang Ke. Describing the signing as a “significant bilateral achievement,” McClean stated: “This visa waiver agreement signed today marks a milestone in the relationship between Barbados and the People’s Republic of China, and it is fitting that it should take place as we are

making preparations to celebrate 40 years of bilateral relations in May of this year.”

She said that government anticipated that the agreement would make Barbados a “more attractive destination” for the over 70 million Chinese tourists who were travelling beyond their country and region each year.

This, she surmised, would also assist in government’s efforts to diversify the tourism market and contribute to strengthening the vital tourism sector and, by extension, the economy.

Ambassador of China to Barbados, Wang Ke, agreed that the signing of the agreement was another milestone in the countries’ relations, and said it would make a significant contribution to people-to-people exchanges and bilateral cooperation.

However, the permit request could face an independent risk analysis – similar to the environmental impact assessment process – under new guidelines drafted by the National Conservation Council.

Guidance notes, approved by the council at its meeting last week, indicate that all applications to import invasive or genetically modified species should go through a preliminary screening assessment. Lower risk imports will be dealt with internally by the Department of Environment, but more complex, higher risk applications will be reviewed by independent consultants.

The new process was developed following a recommendation from Justice Ingrid Mangatal after a court challenge to the release of the GM mosquitoes in May of last year.

Fred Burton, head of the Department of Environment’s terrestrial resources unit, said the new MRCU and Oxitec application would be the first application to go through the new process. He said the

DoE and the council would have to determine whether there was enough information available already to deal with the request or if it should be subject to a broader independent analysis, which could involve public consultation.

Mr. Petrie said the MRCU had submitted the application early in the hope of beginning the national rollout early next year.

The application submitted to the council is for the import of up to 2 kilograms of eggs per month of the genetically engineered strain of the OX513A Aedes aegypti mosquito.

The permit application states, “As a continuation to the OX513A Aedes aegypti control program under way in West Bay under existing permission from the Department of Environment, the programmatic use of OX 513 is proposed island wide on Grand Cayman and beyond in other areas of the Cayman Islands as emerging Aedes aegypti threats are identified by the MRCU. “A staged expansion of the program across Grand Cayman including the expansion of the OX 513 Aedes aegypti production capacity is foreseen.”

It indicates that new insectaries, converted from shipping containers or in a retrofitted warehouse, will be needed to produce up to 10 million GM mosquitoes a week to support the program.

Documents submitted by the MRCU along with the application indicate that the effective elimination of the Aedes aegypti mosquito could be possible over a longer period of time.

It suggests the modified mosquitoes are used alongside other suppression techniques in an “integrated vector management” plan.

The application indicates GM mosquitoes could also be used on Cayman Brac.

“The identification of Aedes aegypti in Cayman Brac is illustrative of the need for flexibility in deploying the OX513A technology within the territory of the Cayman Islands as the MRCU undertake surveillance of Aedes aegypti populations and identify where the OX513A technology is best suited.”

Mr. Petrie said the application is essentially for permission to replicate the work done in West Bay all over the Cayman Islands.

“The technique is identical. This is just scaling it up. We are confident it is working and, yes, we wish to continue to expand the program.”

The National Conservation Council guidance notes for import of invasive or GM species, approved last week, put in place a new system for assessing such imports.

Species which are deemed to be alien and are viewed as potentially invasive or harmful will go through a risk assessment, carried out either

by DOE staff or by independent consultants, depending on the complexity.

“Where the release of an alien species may pose risks to human health, infrastructure and/or economic activity, issues which are all outside the remit of the National Conservation Law, the Department, or the independent consultant if appointed, should seek views from appropriate external agencies on these matters and take those views into account in formulating the risk assessment report; and the Council will take these same views into account when making a decision.”

Former Haitian major, now school bus driver, loses US job after murder accusation A SCHOOL bus driver from Malden accused of murder, arson and crimes against humanity as a former mayor in Haiti has now lost his job in Massachusetts.

The owner of the school bus company that employed Jean Morose Viliena says he kept Viliena from taking a bus out on the road after learning of a WBUR report early Friday morning.

On Thursday, an attorney for three Haitian men filed a suit against Viliena in federal court in Boston under the Torture Victim Protection Act. WBUR also reported that there has been an open indictment in Haiti since 2010 charging Viliena with the same crimes. He never showed up at two trials there, which ended with the convictions of six co-defendants.

The bus company owner says he promptly notified the Massachusetts Department of Public Utilities, and within an hour the DPU acted.

It suspended Viliena’s school bus driver certificate last Friday, the DPU says, “after learning of the allegations of criminal activity against Mr. Viliena.”

In order to obtain a license to operate a school bus, an applicant must go through a thorough criminal background check. Viliena did that before starting to work for the bus company, and WBUR was told Viliena came up clean. Law enforcement sources have confirmed there is no record of any crimes Viliena committed in Massachusetts.

But in Haiti, witnesses and victims accuse Viliena of commanding a political machine packed with guns, machetes and thugs to persecute his opponents and human rights advocates.

While in the U.S., the 44-year-old has the status of a lawful permanent resident. He’s a green card holder, along with his wife, and he has

traveled back and forth from Malden to Haiti without drawing arrest, attention or apparent interest.

On Friday night in Haiti, a day after the lawsuit was filed and the same day Viliena lost his job in Boston, one of his three accusers died suddenly after getting violently sick to his stomach. Human rights workers and the man’s family are calling for the Haitian government to investigate and to conduct an autopsy.

Viliena, who called WBUR a few days ago but said he needed to talk to an attorney, was not available for comment Tuesday night.

In addition to driving a school bus, Viliena has also driven for Uber.

But apparently, he will not be driving for the company any longer.

In a statement sent Tuesday night, the ride-hailing service said, “this individual does not have access to Uber.” (Wbur.org)

‘No turning back’ on Brexit as Article 50 triggered BRITAIN’S departure from the EU is “an historic moment from which there can be no turning back”, Theresa May has said.

She was speaking after Britain’s EU ambassador formally triggered the two year exit process by handing a letter to EU Council President Donald Tusk.

A sombre-looking Mr Tusk said it was not a “happy day” for him or the EU. The European Parliament warned security cooperation was not on the table as it fired its opening salvo in what are expected to be tough negotiations.

In her letter to Mr Tusk triggering Article 50 of the Lisbon Treaty, Mrs May said failure to reach a trade deal within the two-year time limit could “weaken” cooperation in the fight against crime and terrorism.

But Guy Verhofstadt, the European Parliament’s chief Brexit negotiator, said he would not accept any attempt to “bargain” between trade and security, adding: “I think the security of our citizens is far too important to start a trade off from one for the other.”

Article 50 of the Lisbon Treaty gives both sides two years to reach agreement so, unless the UK and the 27 remaining EU member states agree to extend the deadline for talks, the UK will leave on 29 March 2019, a Friday.

At a press conference in Brussels, Donald Tusk held up Mrs May’s letter, saying: “We already miss you.”

In a brief statement, he said it was not “a happy day” for him or for the EU and promised to begin arrangements for the UK’s “orderly withdrawal”.

Scottish lawmakers back call for independence vote SCOTTISH lawmakers voted 6959 in favor of an independence referendum Tuesday, setting Edinburgh on a collision course with the UK government.

The vote by members of the Scottish Parliament gives the green light to First Minister Nicola Sturgeon to ask the UK Parliament for a referendum between autumn 2018 and spring 2019.

British Prime Minister Theresa May has indicated she will reject Sturgeon’s timetable. Britain is expected to leave the European Union in 2019, and May has said that “now is not the time” for a vote that

could break up the United Kingdom.

“Today’s vote must now be respected,” Sturgeon said afterward, according to Britain’s Press Association.

“The mandate for a referendum is beyond question, and it would be democratically indefensible -- and utterly unsustainable -- to attempt to stand in the way of it.”

Sturgeon said the referendum should occur “no earlier than 18 months from now, when the terms of Brexit are clear.”

“This is, first and foremost, about giving the people of Scotland a choice on this country’s future,”

she said, according to the Press Association.

In a statement after the vote, the UK government said, “We should be working together, not pulling apart,” and that it would not start negotiations now on a referendum.

“It would be unfair to the people of Scotland to ask them to make a crucial decision without the necessary information about our future relationship with Europe, or what an independent Scotland would look like,” the statement said.

Heidi McKinney pleaded guilty Friday to assault charges connected with the May 2016 incident — during which prosecutors said she grabbed the woman’s breasts and groin.

“Ms. McKinney did so with the intent to humiliate and harass the victim,” Assistant U.S. Attorney Ravi Sinha said at federal court in Portland. “(She) both made contact with victim’s body, including her inner thigh, and made a series of profane and lewd statements to the victim.”

McKinney faces up to 10 years for the crime, but her attorney and

Florida man ‘kills female roommate during hug goodbye’ A Florida man is facing a murder charge after he admitted fatally stabbing his female roommate as she was saying goodbye to him, police say.

Brooke Preston, 21, visited the West Palm Beach home on Friday night to pick up a few items after moving out.

Randy Herman, 24, allegedly gave her a T-shirt and one last hug before he began stabbing her repeatedly.

Ms Preston was planning to move back to Pennsylvania to be with her boyfriend, local media report.

Her friends said she was not romantically involved with her alleged attacker, about whom she had expressed concerns.

Ms Preston was at the property on the eve of her death, but had left because her roommate’s behaviour made her uncomfortable, reports WPTV, a Palm Beach news station.

She returned on Saturday morning to collect her belongings when the accused attacked her, say investigators.

Police say the suspect phoned authorities to report the killing after driving the victim’s car to a nearby park.

During the call he confessed to the crime, according to police.

“Someone’s been murdered,” a tearful Mr Herman told the emergency dispatcher, according to the Palm Beach Post.

“Just send the police. It was me. I’m sorry.”

Dylan finally agrees to accept Nobel Prize for Literature BOB Dylan will finally accept his Nobel Prize for Literature

in Stockholm this weekend, the academy has announced.

The American singer was awarded the prize in October

but failed to travel to pick up the award, or deliver

the lecture that is required to receive the 8m kroner ($900,000;£727,000) prize.

The academy said it would meet Dylan, 75, in private in the Swedish capital, where he is giving two concerts.

He will not lecture in person but is expected to send a taped version.

If he does not deliver a lecture by June, he will have to forfeit the prize money.

A blog entry from Prof Sara Danius, the permanent secretary of the Swedish Academy, said: “The good news is that the Swedish Academy and Bob Dylan have decided to meet this weekend.

“The Academy will then hand over Dylan’s Nobel diploma and the Nobel medal, and congratulate him on the Nobel Prize in Literature.

“The setting will be small and intimate, and no media will be present; only Bob Dylan and members of the Academy will attend, all according to Dylan’s wishes.”

Prof Darius said taped lectures had been sent by other winners in the past, including Alice Munro in 2013.

Earlier this week, Prof

Darius said the academy had had no phone conversations with Dylan and that he had until 10 June to perform the lecture in order to receive the money.

“What he decides to do is his own business,” she had said.

But in a speech read out on his behalf, he said he had thought his odds of winning were as likely as him “standing on the moon”.

Entertainment Khalifa sparks outrage for visit to Pablo Escobar’s grave AMERICAN rap artist Wiz Khalifa has kicked up quite the controversy on his visit to Colombia.

During a trip to perform at a festival in Medellin, the celebrity posted pictures to his Instagram account of him apparently paying tribute to the late Colombian drug lord Pablo Escobar. The rapper posted one photo of colorful flowers at the grave’s headstone.

Wiz Khalifa also posted several photos of him smoking what appears to be marijuana near Escobar’s grave, as well as a picture of him posing outside of a property -- site of a bombing and attempt on Escobar’s life in the ‘80s -formerly owned by the drug

lord, who died in a shootout with authorities in Medellin in 1993.

Medellin’s mayor, Federico Gutierrez, called the rapper’s Pablo Escobar-themed photo tour of Medellin disrespectful.

“That scoundrel, instead of bringing flowers to Pablo Escobar, he should have brought flowers to the victims of violence in this city,” Gutierrez said in an interview with local media. “He must offer an apology to the city,” he said, adding that the rapper was “not welcomed” back.

Big Bang Theory ‘soft kitty’ lawsuit dropped A COPYRIGHT case about a lullaby used on The Big Bang Theory has been dismissed by a judge.

Characters on the hit comedy usually sing the song with lyrics starting “soft kitty, warm kitty, little ball of fur” - when one of them is unwell.

But according to the daughters of a teacher who brought the lawsuit, the words were used without permission.

Ellen Newlin Chase and Margaret Chase Perry had said the show should have bought the rights to the lyrics.

Their mother Ellen, a nursery school teacher from New Hampshire who died in 2004, was said to have written “soft kitty” as a poem in the 1930s.

The legal case, brought against network CBS, said The Big Bang Theory had used the lyrics on at least eight episodes, since March 2008.

CBS was sued for copyright

violation in 2015 but a New York district judge has now dismissed the case.

In the show, Sheldon Cooper (played by Jim Cooper) describes how his mother used to sing him the two-line song - ending with “happy kitty, sleepy kitty, purr purr purr” - when he was ill.

The song has been been featured on Big Bang Theory merchandise, from T-shirts to fridge magnets.

According to the dropped lawsuit against Big Bang Theory, Warner Bros.

Entertainment and the show’s other producers sought permission in 2007 to use the lyrics from Willis Music Co - a Kentucky-based company that had published them in a book called Songs for the Nursery School.

But, according to the claim, Willis Music gave permission to use the lyrics without consulting Mrs Newlin’s.

Planet Earth leads field with nine Bafta Craft nominations PLANET Earth II was a hit with viewers when it aired last year - and now it seems to have wowed Bafta as well.

The BBC One nature documentary has received nine nominations ahead of its annual Craft Awards, which celebrate behind the scenes talent in television.

Netflix drama The Crown follows with seven nominations, while the BBC’s The Night Manager gets six.

The winners will be announced on 23 April, three weeks ahead of the Bafta Television Awards on 14 May. Here’s a rundown of which programmes are up for what.

The landmark natural history series receives two nominations apiece in the editing: factual and sound: factual categories and is also up for the original music prize.

Its remaining four nominations are all in the photography: factual category, which means the show is guaranteed to take home at least one award.

Netflix’s epic chronicle of the early years in The Queen’s reign sees Stephen Daldry and Peter Morgan recognised for their direction and writing respectively.

It’s also got nominations for its costume design, production design and its photography and lighting, with additional nods going to its visual effects and titles.

The BBC’s gripping adaptation of John le Carre’s novel gets a best director nod for Susanne Bier and is also recognised for its sound and editing.

Like The Crown, it has also landed nominations for its production design, visual effects and titles.

Study: Kidney injury is a shortterm risk of running marathons

Some scientists believe that an ocean had existed some three billion years ago on northern Mars.

Impact crater linked to Martian tsunamis SCIENTISTS have located an impact crater linked to powerful tsunamis that swept across part of ancient Mars.

The team believe an asteroid triggered 150m-high waves when it plunged into an ocean thought to have existed on northern Mars three billion years ago.

Lomonosov crater in the planet’s northern plains fits the bill as the source of tsunami deposits identified on the surface.

Details were outlined at the 48th Lunar and Planetary Science Conference.

Although the idea has lost some of its currency in recent years, some scientists think an ocean might once have filled the vast lowland region

that occupies the Red Planet’s northerly latitudes.

Growing evidence that tsunami waves washed over the boundary between the southern highlands and northern lowlands help strengthen the hypothesis.

François Costard, Steve Clifford and colleagues identified and mapped the distribution of sediment that apparently originated in the northern plains and flowed onto a possible ancient shoreline to the south.

“We found typical tsunami deposits along the dichotomy between the northern hemisphere and southern hemisphere of Mars,” Dr Costard, from Université ParisSud and CNRS, told BBC News.

MARATHON running can drastically change your body, and mostly in a good way.

The benefits of long-distance running include boosting your mood and longevity while reducing your risk of cancer, diabetes and obesity.

Yet, running 26.2 consecutive miles also can stress the body, leading to injury risk, a momentarily weakened immune system, and now a small study suggests acute kidney injury, too.

Marathon runners can develop short-term kidney injury during a race, but the kidneys repair themselves within about two days, according to the study, which published in the American Journal of Kidney Diseases on Tuesday.

The findings, which need to be replicated in larger follow-up research, suggest that some runners -including those with kidney disease, diabetes, hypertension; those taking anti-inflammatory medications; and those older in age -- should be mindful of the way long-distance running may impact the kidneys.

“It’s possible that marathon running could be an acute stress and may contribute to the progression of existing chronic kidney disease, and this is where runners with this condition need to talk to their physicians and talk to their trainers,”

The study suggests that marathon runners can develop short-term kidney injuries during the race.

said Dr. Chirag Parikh, a professor at the Yale University School of Medicine and lead author of the study.

He added that, with adequate training, the kidneys can adapt to such physical stress.

“I would think that the majority of marathon runners are doing OK because the 22 people who participated in the study had normal kidney function and had been running marathons for an average of 12 years,” Parikh said. “So, if running marathons caused a great deal of permanent kidney injury, these runners would have minimal

kidney function remaining.”

Marathon running in the United States has grown in popularity in recent years.

Between 1990 and 2014, the number of US marathon finishers skyrocketed from about 224,000 to a record high of 550,637, according to Running USA, a nonprofit that tracks the number of marathon runners each year in an annual report.

Last year, about 507,600 runners finished a marathon in the United States, said Scott Bush, a spokesman for Running USA, which was not involved in the new study.

AUSTRALIAN scientists have made a revolutionary breakthrough that comes close to the effects of the mythical fountain of youth.

Westbrook punches in highest-scoring tripledouble in NBA history IN the chase to pass Oscar Robertson’s triple-double legacy, Russell Westbrook left a recordbreaking footprint along the way on Wednesday night at Orlando.

Oklahoma City’s MVP candidate staked yet another claim to the league’s highest individual honor with the highest-scoring tripledouble of all time, finishing with 57 points, 13 rebounds and 11 assists in the Thunder’s 114-106 victory over the Magic.

Westbrook, who is closing in on joining Robertson as the only players in league history to average a tripledouble for an entire season, is now tied with James Harden and Hall-ofFamers Wilt Chamberlain and Elgin Baylor for most 50-point tripledoubles in a career (two apiece).

His scoring output in this particular effort sets him atop the all-

time list, surpassing James Harden and Wilt Chamberlain’s respective 53-point triple-doubles. Tottenham midfielder Lamela out for the season TOTTENHAM midfielder Erik Lamela has been ruled out for the rest of the season because of a hip injury.

The 25-year-old Argentina international has not played for Spurs since October because of the problem and will undergo surgery on Saturday.

Tottenham said Lamela had “achieved a good level of function” but was not at a stage to make a return to training, leading to the decision to operate.

“I tried everything to recover but

my hip is still not 100%,” Lamela tweeted.

“I can’t compete at the level I want to. I’ll face this challenge with a positive attitude and can’t wait to get back with the team and be stronger.”

Lamela had made 14 appearances this season for Spurs before the injury. He joined Tottenham from Roma in 2013 and enjoyed a superb season last term, scoring 13 goals.

Pavey thrilled to receive ‘bittersweet’ 2007 bronze BRITAIN’S Jo Pavey says it is a bittersweet feeling to receive her 2007 World Championships 10,000m bronze medal after Turkey’s Elvan Abeylegesse had her result chalked off.

Athletics’ governing body the IAAF said the silver medallist had been found guilty of an incompetition doping offence during the event in Japan.

Pavey, 43, was beaten to bronze

by American Kara Goucher, who will now be upgraded to silver.

“It is frustrating,” said Pavey.

“I am thrilled with the news but it is kind of bittersweet because when I think back to those championships I was running as hard as I could, I had got myself in the best shape and it was a hot

and humid day. I was in a medal position right until the line but couldn’t hold on.

“Instead of being a moment where I was thrilled at getting my first medal, I was lying on the track feeling totally despondent and frustrated, I felt that I had let everyone down.”

The saga surrounding Abeylegesse dates back to 2015 when the International Association of Athletics Federations (IAAF) announced 28 athletes who competed at the 2005

and 2007 World Championships had returned “adverse findings” from retested samples.

The Turkish Athletics Federation subsequently revealed that Abeylegesse was one of those under investigation. The Ethiopian-born runner was withdrawn from the 2015 Worlds as a consequence.

Her results from 25 August 2007 to 25 August 2009 have been removed and the 34-year-old is retrospectively banned from 29 September 2015 to 28 September 2017. Pavey says she feels angry at Abeylegesse for denying her of her podium moment, and has questioned whether she has potentially missed out on more medals. (BBC)

World No. 1 enhances status as Masters favourite with third tournament win WITH the Masters a little over a week away, world No. 1 Dustin Johnson enhanced his status as favorite for the Green Jacket with a third successive tournament victory.

The American’s peerless 2017 form continued in Texas as he beat Spaniard Jon Rahm in the World Match Play final Sunday to become the first player to win all four World Golf Championships.

Having now won six trophies in the last nine months, Johnson’s impressive run of form has established himself as the bookmakers’ clear favorite for the first major of the year in Augusta, which starts on April 6.

Johnson is just the second player in history to win back-to-back World Golf Championships, emulating 14time major winner Tiger Woods.

He and Woods are also the only men to win four or more WGC titles.

However, Johnson -- with five WGC victories -- has some way to go to match Woods’ total of 18.

In an absorbing final, the 32-yearold was five up after eight holes and

Brown, who had erased Eve’s previous record of 52.52 metres or 172-feet, 3-inches that she set in Houston, Texas in 1990, beat her new mark of 52.73m (173-0) that she set in July at the IAAF World Junior Championships by posting a toss of 53.13m (174-4) at the Roadrunner Invitational on Saturday.

The mark was good enough for second place at the Park West

Athletics Complex in San Antonio, Texas, behind Cion Hicks of Baylor, who won with a heave of 53.83m (176-7). But Brown said it was all about improving on her performances every time she competes.

“I felt the performance was good.

I felt very good about it. I’m getting more consistent,” Brown told The Tribune. “I’m expecting more, but I know I will only get better as the season progresses.”

It was just Brown’s second outdoor meet for the season, coming off her collegiate debut last week when she pulled off another second place finish with 51.10m (167-8).

Energy United lead four of five divisions Wikenson Fenelon has etched his name in Champs history.

Fenelon breaks decathlon long jump record at Champs TCI athlete Wikenson Fenelon broke Champs’ decathlon long jump record on Wednesday morning while competing at Jamaica’s top school event at the National Stadium.

After seven of the 10 events on Thursday morning, the Jamaica College student was comfortably in third position and looked likely to medal.

Fenelon won his first two events. He powered to first place in the 100M in a time of 11.07s, while in his second event, the long jump, he broke last year’s record by Marcus Brown.

Brown, from Morent Bay High School, had jumped 6.98M. Fenelon broke the record with a

leap of 7.09m.

If it were not for the shot put, the TCI national pole vault record holder would have been in the top two, but his throw of 9.48M carried him to ninth position in the event.

In the high jump Fenelon finished second with a jump of 1.84M. The CARIFTA bound athlete then finished with a string of fourth places: in the 400M, the 110M hurdles and the discus.

Along with the 17-year-old, fellow Jamaica College students: Ken Reyes and Courtney Missick were also expected to compete.

So too was fellow national athlete, Helcy-Ann Brianna Sauver who attends the Holmwood Technical High School.

Jamson Louime scored the lone goal of the game.

Strikers beat Champions in North Caicos 5-a-side football THE Physical Strikers defeated Champions in the third game of the inaugural North Caicos Five-A-Side Men’s Football competition last Sunday afternoon.

In the game, which was played at the RGHS ground, Jamson Louime scored the lone goal from the penalty

spot.

Organiser of the competition Karmeta Burke said she is looking for more community support.

“I want more people to come and watch.”

The four-team competition will be used to unearth talent that exist in the island.

ENERGY United are in the lead in Boys U11 and U13 and the Girls U9 and U11 divisions in the Fortis Youth Football League.

In both boys’ divisions, Energy United have won all three of their games (nine points). In the U9 Girls’ division Energy United are ahead of Power Munich, owning to a better goal difference. Both teams are on 15 points.

In the older age group, the female Energy United team are on 11 points from six games, just one point ahead of Lightning City.

United are second on 11 points from six games, just behind Lightning City on 12.

Last weekend Energy United won both of their Boys’ U9 games 4-1 against Fusion Milan and 2-1 against Lightning City.

Lightning City had defeated Power Munich 5-1, while Power Munich got past Fusion Milan 4-1.

In the female U9 division Energy United won both of their games 6-2 against Fusion Milan and 5-0 against Lightning City.

Power Munich lost to Lightning City 3-6, before beating Fusion

Milan 6-4.

In the U11 Boys’ Division Energy United whipped Lightning City 6-4 before Power Munich got past Fusion Milan 7-3.

The girls division of the same age group, also had a victory for Energy United. They defeated Fusion Milan 2-0 but drew 1-1 with Lightning City.

Power Munich got past Lightning City 2-1, but lost to Fusion Milan 3-0.

In the oldest boys’ division (the U13), Energy United defeated Lightning City 3-1, while Fusion Milan defeated Power Munich 8-4.

Flyers and Knights win game one of PABA Playoffs NUMBER one seed the Five Cays Flyers and defending champions the Five Cays Knights have won game one in their best-in-three first round series against the Nazarene Kings and the North Caicos Spartans respectively in the opening games of the Provo Amateur Basketball Association (PABA) Night League Playoffs.

Javin Green with 11 points and Anthony Cash with nine points led the Flyers to a 62-52 win on Wednesday evening. The Kings were led by Dwayne Hamilton who finished with a game high 18 points and four rebounds.

The Knights, who are third seeded had their backs against the wall early, but managed to rebound for an 84-67 win.

Andujar Gardiner buried five shots from beyond the arc in his score of 28 points, seven rebounds and three assists. Peterson Sylvains added 17 points and three steals while Mark Handfield finished with a double-double 10 points and 12 rebounds.

The Spartans’ Emanio Williams also had 28 points to go with five rebounds. As Gardiner he too was lethal from downtown. He scored four threes. Devon Williams added 22 points and eight rebounds.

The Grand Turk Stallions and the HAB Sonics and the Predators and Hustlers were also expected to clash.

TCI teams improve, but USVI defend title Turks and Caicos Islands teams: the Clement Howell High School (CHHS) and the Rising Stars Basketball Club (RSBC) Pelicans showed massive improvement in the second annual Caribbean Classic Basketball tournament, which was held last weekend at the Gus Lightbourne Sports Complex court.

CHHS were beaten in the final against defending champion the USVI Club Zero Tolerance Basketball Club, while the Pelicans

defeated a team from the Dominican Republic in the third place clash.

Last year CHHS had finished third and the Pelicans fourth.

“This year the local teams have improved more in their decision making and their defensive and offensive strategies,” Rising Stars Basketball Club president Mervin Forbes pointed out.

In the third place clash power forward Shadarno Clarke and shooting guard Willinson Seymour led the club to a 64-56 win over the Dominican team.

The guest player Clarke scored 18 points and grabbed nine rebounds, while Seymour, who buried five shots from beyond the arc, finished with a game high 21 points.

Sailfish, Bruins and Flyers win PHL titles THE Scotiabank Sailfish, the Coco Bistro Bruins and the Villa del Mar Flyers are champions of the 2016/2017 Provo Hockey League.

The three teams won the Novice, Bantam and Midget divisions respectively, last Saturday at the Graceway Sports Centre.

The Bruins and the Sailfish recorded comfortable wins against the Turkberry Hurricanes (6-1) and the Grace Bay Car Rental Islanders (4-2); but it was a fight for the Flyers, who withheld an onslaught by the Gansevoort Gators towards the end of their game for a 9-8 finish.

Darius Coakley, who dominated the league this season in scoring, led the Flyers’ attack with six goals, four of which were scored in the first period. Despite the dominance

of Coakley, the Gators did not give up and towards the end scored four unanswered goals—two by Bradley Ayer, who led the eventual runners up with five successful strikes.

Ayer’s first three goals had carried the Gators to a 3-1 lead midway through the first period, but the Flyers took control with seven consecutive goals, before the Gators’ final push.

Carson Greatrex supported Coakley with two goals, while Noah Reid (also an assist) added the other.

Tristan Grandsire finished with two assists.

Colin Forbes, Brooke Rivers (also an assist) and Ronin Maclaren (also an assist) added a goal each for the Gators.

The Sailfish, led by two second half goals from Brock Pollon,

defeated the Islanders 4-2.

Dylan Wells scored the opening goal in the first minute for the Islanders, but Greta Osmond and Jake Haggie ensured that the eventual winners went up 2-1 at the break. In the second period Pollon scored his goals early, before Wells pulled one back in the 10th minute of play.

In the Bantam final, Kurt Rivers exploded in the second half with four of his five goals to lead the Bruins to victory.

Rivers opened the scoring late in the first period off a Max Scholar pass, he then carried his side 2-0 up before Maddox Zaidan Jones pulled one back, but that was as far as the Hurricanes went. Scholar scored the other goal for the Bruins.

Billy Forbes led San Antonio FC to an opening win.

Forbes scores in San Antonio FC debut SENIOR national captain Billy Forbes scored on debut for new club the San Antonio FC when the United Soccer League regular season got underway in the US on Sunday night.

The 26-year-old, who returned to the City of San Antonio after a season with the Rayo OKC in the North American Soccer League, told the Weekly News that he was ecstatic with the goal.

Forbes has emotional attachment to the US city, due

mostly to the large support he got while playing for the now defunct San Antonio Scorpions.

“This Saturday will be our home opener. The crowd will be amazing. I feel really good this season.”

In the road opener against Rio Grande Valley FC in Edinburg, Texas, Forbes scored 15 minutes into the game with a low shot into the right hand corner of the goal.

San Antonio FC won 1-0.

The Villa del Mar Flyers edged out the Gansevoort Gators for the Midget title.
