Becoming ADA Compliant: Businesses Face Challenges

BY DAVID LUCES DLUCES@TBRNEWSMEDIA.COM A number of Northport village businesses are facing legal action after a Garden Citybased law firm filed a lawsuit claiming they failed to meet American with Disabilities Act requirements. Gunther’s Tap Room, Penny and Cooper and the Northport Sweet Shop are among a number of businesses in Northport facing litigation.

The civil lawsuit was filed by attorney Darryn G. Solotoff of the Bell Law Group in U.S. Eastern District Court on behalf of Linda Laser, who is confined to a wheelchair due to multiple sclerosis and could not enter several businesses during a visit to downtown Main Street in August 2019.

According to court documents, the case was filed on behalf of Laser and all others similarly situated.

The plaintiff’s claim is “pervasive, ongoing and inexcusable disability discrimination by the defendants.” They also mentioned architectural barriers such as inaccessible entrances, steps, lack of ramps, designs of exits and small bathrooms.

Damon McMullen, Northport village mayor, said it could be difficult for business owners and landlords to meet compliance since some remedies, such as ramps, could block sidewalks and potentially extend to the road.

“Most buildings in the village are older and it would be difficult to add more accessible” structures, the mayor said.

McMullen said despite the village not being permitted by law to represent the business owners, he and the village attorney are looking into any way they can help them with the ADA compliances.

“We have told them to get in contact with their insurance companies and hire a lawyer,” the Northport mayor said.

respond as they could have coverage from their insurance for these type of circumstances.

“The remedy would be to get rid of any barriers that have been pointed out, or improving handicap access,” he said.

Other examples could be improved signage, additions of side entrances to buildings and ramps.

In addition, McMullen said he was able to bring in James Weisman, president of the United Spinal Association, who met with several Northport businesses to help assist them in upcoming litigation.

The village mayor said Weisman is a longtime advocate for ADA rights and thought his expertise would benefit business owners.

Laser’s attorney could not be reached for comment by press time. Nathalie Bell, a partner in the Bell Group law firm, also did not return calls for comment.

In most cases, plaintiffs will try to recoup

lawyer fees and get businesses to improve accessibility.

The Northport suit seeks $50,000 from each defendant in damages, attorney’s fees, court costs and $500 for each architectural barrier and violation at each business.

“We have seen a trend of these lawsuits not just here but in other municipalities as well,” McMullen said.

The U.S. Small Business Administration states on its website that when a business identifies a potential barrier it’s best to remove it “if readily achievable.” In addition, when a business removes barriers, it should follow the design requirements for new construction in the ADA Standards for Accessible Design.

When deciding which barriers to remove first, the administration suggests owners first provide access to the business from public sidewalks, parking and public transportation and then provide access to the areas where goods and

services are made available to the public. Once these barriers are removed, they should provide access to public restrooms and, if necessary, remove any remaining barriers, including those that limit use of public telephones and drinking fountains. The ADA became law on July 26, 1990, under President George H.W. Bush.

ADA regulations also have a safe harbor provision, stating that any of a facility’s elements built or altered before March 15, 2012, and that comply with the 1991 standards do not need to be changed to satisfy the 2010 standards. However, if an element already existed but didn’t comply with the 1991 standards prior to March 15, 2012, this element must be modified to meet the 2010 standards to the extent readily achievable.

Northport Middle School Closes: Benzene Found in Septic Systems

Grosser detected the presence of the chemical benzene in two septic systems on school grounds. Rob Banzer, superintendent of Northport-East Northport school district made the announcement 4 p.m. on Saturday, Jan. 18, in an email to parents.

Just days earlier, the board had reviewed a contingency relocation plan prepared by Banzer with input from all stakeholders, which the district ultimately needed to implement with modifications this week.

The Northport Middle School classes were canceled for Tuesday and Wednesday, and students reported Thursday, Jan. 23, for the first day of school in new locations. Northport Middle School eighth-graders were relocated to a special wing of the district’s high school.

The seventh-graders were relocated to East Northport Middle School. Sixth-graders were relocated to Norwood Elementary School.

The gifted and talented program was relocated from Norwood to Bellerose Elementary School to accommodate the Northport Middle School students.

The new arrangement, Banzer said, maintains the school’s curriculum, allows for spring sports and enables students to access science labs. It was considered the best, least disruptive option that was considered.

air testing indicated no observable detection of volatile organic compounds, or VOCs, which includes benzene, inside the building, or from soil samples, as well as at the source of the septic tanks,” Banzer said in the email.

“However, in the best interest of students and staff and in consideration of ongoing testing and remediation, the building will be closed

for the balance of the school year.”

Suffolk County Department of Health Services requires that the site be remediated to remove the benzene, which was found in septic systems on the southern and eastern side of the middle school building. It has not yet been determined where the benzene came from. The chemical is found in petroleum

products and the site has been used as the district’s refueling station and bus depot until December 2019. The district ultimately relocated its buses after the Times of Huntington reported the district’s outstanding violations for petroleum bulk storage, which were ultimately addressed with the Suffolk County Department of Health Services.

The NYS Department of Environmental Conservation states that it has no records of leaks or other spills from the three tanks onsite or fines issued for noncompliance. The DEC also reports that it has not been involved with any prior cleanup activities on the site.

Since 1987, the state DEC has delegated to Suffolk County the authority to regulate petroleum bulk storage.

The county’s health department also requires remediation for high levels of mercury and silver found in the leaching pools outside of the school’s G-wing. Remediation plans are still under development.

Many parents have been conflicted about sending their children to the school. Students and staff have historically complained about unidentified foul odors that regularly surface inside the building. Some parents, retired teachers and community members blame chemicals previously identified on school grounds as a potential cause for their illnesses.

As the environmental investigation continues, some parents are breathing a sign of relief.

“We are happy to know that the testing can be completed with the children and staff relocated to safe locations,” said parent Bethany Watts in a recent interview.

State Expands Health Study on Northport Cancer Cluster

State Department of Health is expanding its health study, initiated in March 2019, after confirming on Jan. 21, that statistically significant levels of cancer, primarily leukemia, were identified among young adults in the Northport High School Class of 2016.

“We have identified a higher incidence of some cancer beyond what would be expected for that one class,” said Brad Hutton, deputy director for Public Health. “While it’s a small elevation, it warrants us now to expand the investigation. We want to look for patterns of cancer among different ages and expanded time periods, as well as different cancers.”

The department is now expanding its cancer incidence investigation to look at cancers over a longer time period and to look at cancers among

children and adults in the entire school district.

The investigation will now include all types of cancer among all ages, with a focus on young people and young adults. It will review whether there are cancer elevations among residents of the Northport school district as a whole, certain geographic areas within the school district, in specific time frames or within specific age groups. The review will also use the NYS Cancer Registry, which includes individual level information about all cases of cancer diagnosed among residents of the study area.

The department said it has not previously received a request to review cancers among teachers and intends to focus on this expanded cancer investigation at this time.

As reported in the March 28, 2019 issue the Times of Huntington in an article entitled “Sen. Gaughran requests state health investigation,”

four cases of leukemia and lymphoma were diagnosed in the Northport High School graduating Class of 2016 (see story online at www.TBRNewsmedia.com).

The topic was raised by Samantha Marill at a town hall meeting on the LIPA tax lawsuit held March 16 at the Northport High School hosted

by State Sen. Jim Gaughran (D-Northport). On behalf of the community, Gaughran ultimately requested a state health study to determine if the Northport power plant was a factor.

Since then, the health department said it has worked to confirm the cases of people from that graduating class who were reported to have developed cancer in 2018 and 2019. Because the number of cases are less than six, the department could not say for privacy reasons how many people were diagnosed with cancers.

To confirm the diagnoses, the department said in an August 2019 interview it utilizes all

information provided by community members that might help them match the individuals believed to have developed cancer with information on cancer cases contained in the state’s Cancer Registry. The registry also provides detailed information on the cancer, such as type and subtype of cancer and date of diagnosis, which they say helps them evaluate whether the occurrence may be unusual.

As previously reported in the Times of Huntington, parents from the Northport Middle School, who have conducted their own informal, officially unconfirmed study, said that they have identified 18 cases of leukemia, lymphoma and rare blood diseases diagnosed over the last 10 years in students from the school.

“The DOH must aggressively pursue this investigation and I welcome this study and fully support the DOH’s efforts to get to the core of this issue,” Gaughran said in a recent email.

Lawmakers Call for Local Northport Power Plant Emissions Monitoring

“If the town, in its rezone of the property, or any of its agencies or boards in the 1960s imposed conditions on LILCO to protect the health and safety of Huntington residents, then it stands to reason that its successors should be bound by the same,” she said.

It is unclear what action if any will be taken. Town Supervisor Chad Lupinacci (R) did not respond to a request for comment by press time.

Danielle DeSimone is one several young adults diagnosed with leukemia from the Northport High School Class of 2016, who received a bone marrow transplant and is now in remission. She said she would absolutely support any policies that would better protect the public’s health.

“May no more families be faced with this burden unnecessarily,” she said in an email.

As the state’s health investigation continues, and as the town bears the additional burden of fighting LIPA and National Grid, spending $4.2 million to date, many people are looking at the plant with a discerning eye.

According to the DEC Permit Review Report from February 2019, the Northport power plant emissions are in severe violation of state and federal air pollution standards for nitrous oxide and volatile organic compounds, which contribute to ozone. When inhaled, ozone chemicals react with many biological molecules in the respiratory tract, the EPA reports, leading to adverse health effects.

It’s difficult to know whether or not a specific environmental toxin will cause a particular individual to develop cancer or other diseases, according to a 2003 report “Cancer and the Environment” published by the U.S. Department of Health and Human Services.

But significant sources of VOCs are chemical plants, gasoline pumps, oil-based paints, auto body shops and print shops.

Nitrogen oxides result primarily from hightemperature combustion. Significant sources are power plants, industrial furnaces and boilers and motor vehicles.

In response to inquiries, National Grid spokesperson Wendy Ladd said, “We submit our

emissions report to the EPA and the NY DEC.” The DEC states that ozone is a regional air pollutant and most human and economic activity in the NYC metro area contribute in some way to ozone exceedences.

“If the DEC finds any facility poses an imminent threat to public health or the environment, the agency works to address the situation immediately,” said DEC spokesman Kevin Frazier.

The region, he added, has been in violation of ozone standards for many years.

The prominent volatile organic compounds (VOCs) emitted from the plant, according to the DEC, are pentane, butane, and propane (roughly 90 percent of the total VOC in 2018). Benzene was emitted at 50 pounds in 2018.

The DEC said it is currently reevaluating the enforcement response to certain exceedances at major facilities in the Long Island region to ensure the continued protection of public health and the environment.

When the Town of Huntington’s Planning Board originally authorized in 1965 a site plan for the Northport power plant’s first generating unit, the impact on the greater safety, health and general welfare of the community was an overarching concern. In fact, the town’s approval stipulated that plant operators were required to submit emissions reports to the town, which were subject to regular review by town officials.

Today, the plant has expanded to four units, and while the town is still searching for records, officials do not know the last time the plant submitted an emission report from on-site monitors for a review. Town attorney Nicholas Ciappetta reported that the town has no say over the Northport power plant emissions. Instead, he said jurisdiction falls to The Environmental Protection Agency and Department of Environmental Conservation.

Some lawmakers firmly disagree, and State Sen. Jim Gaughran (D-Northport) is calling for action.

“The town has had more power than it has realized,” he said. “It should take whatever action it needs to take.”

Gaughran said he regularly drives past the plant and smells foul odors. Last year, he requested a state health investigation after learning that graduates of Northport High School Class of 2016 were diagnosed with leukemia and lymphoma. Community members said at the meeting they want to know if the plant’s emissions are a factor.

State health department investigators have now expanded their study to look at cancer rates in a broader population to look for patterns.

(See story on page A3.) With that investigation underway, Gaughran finds it prudent to take steps to better protect the community.

Every other round, students were selected for physical challenges, like Hula-Hooping, Simon Says or tug of war. Even the teachers had a chance to join in on the fun.

Throughout each round, team members cheered and encouraged their classmates as they completed the challenges. Students had an incredible time using their knowledge in an unconventional and very fun way.

Letters to the Editor Fill Empty Retail Spaces Demand All the Impeachment Facts Editorial

As journalists, we share the frustrations of many residents in our communities who see the large number of empty storefronts — many left vacant for several years — while new developments seem to erupt out of the ground just a few feet away from derelict properties.

Imagine the grief felt by Huntington residents two years ago when Great Neck-based developer Villadom Corp. proposed construction of a 486,380-square-foot mall with retail and office space on the 50-acre property known as Elwood Orchard. Many residents feared overwhelming congestion on Route 25 and water quality issues. Meanwhile, empty buildings stood just to the east and west of the site.

Imagine the relief when the developer withdrew the application.

Then think of the relief that Hauppauge residents felt last year when they saw a sign reading Relish restaurant, of Kings Park, was opening an additional location in the old Pizza Hut on Route 111. The blighted building had been vacant for decades.

Rows of vacant buildings spoil Port Jeff’s uptown vibe. The abandoned businesses along Lake Avenue in St. James and Main Street in Smithtown also point to serious problems. In Setauket, a former King Kullen still sits empty years after the chain closed those doors, and a decrepit building sits on the corner of Gnarled Hollow Road. Suffolk County was willing to buy the latter property with the Town of Brookhaven looking to maintain it as passive parkland. Some of these situations are examples of property owners holding out for more money. In which case, the only real victim is the community as a whole.

Elected officials need to ensure that these empty storefronts are filled to create vibrant shopping areas. It’s an important, even essential step to take to create stronger, cleaner and healthier communities. It also protects groundwater and can minimize roadway congestion.

Preserve that open space and fill the locations that are already set up for commerce first.

Local officials may be limited in how much they can dictate to developers but there are options. Take for example Decatur, Illinois, where the city recently hired a retail consultant to fill the vacant storefronts. Consultants or even town employees can be tasked in recruiting companies interested in entering the market.

Businesses can be sold on the benefits of reconfiguration and renovation, rather than new construction.

Business owners can take responsibility, too, to maintain the quality of life in their neighborhoods where they do business.

Recently, former Yankees star baseball player Mariano Rivera received an OK on a zoning change from the Town of Brookhaven to create a car dealership in Port Jefferson Station in an already developed space. While he plans to create one new additional building on site, he will expand on an existing one. The local civic and town board complimented him on his willingness to work with the local community.

Many big businesses may come into an area focused on their branding, concerned with how their building needs to look, and insist on building from scratch in what they feel is an ideal location. We encourage elected officials to welcome businesses into structures that already exist. Quality of life should be considered first and foremost in our communities.

My name is Peter Cartwright. I live on Eaton’s Neck, and I help edit our community newsletter, Changing Tides. I am raising three children, two of whom attend Northport public schools. I have been a registered voter for all my adult life and never in all that time have I ever seen a more divisive president who has rallied his

masses with lies and deceit. Now that he has been impeached it is vitally important to hear all the evidence that has since been mounting during just the past week. We demand to hear from everybody who has any additional information relevant to this impeachment, otherwise these proceedings will reflect only the

Republican majority’s foregone partisan conclusion.

If the American people are given all the facts it would be hard for our congressional leaders to refute what should obvious to any unbiased, intelligent voter.

Since the beginning of this year, when changes that Democratic leadership made to New York State’s bail system began providing get out of jail free cards to criminals, I have been extremely vocal about how these “reforms” are making our state and community less safe. As we have seen in an alarming number of cases, these changes have led to the release of hundreds of prisoners onto our streets, creating a policy that is dangerously shortsighted.

Thousands of residents have expressed their outrage at these reforms and made it clear that change must happen now. To help ensure

that the voice of every New Yorker is heard, my office has set up an online petition that will allow everyone to join together to tell Gov. Andrew Cuomo (D) and the Democratic leadership in the Assembly and the Senate that we want change now.

While some Democratic legislators talk about making amendments, their words ring hollow. It is clear that correcting the mistakes created by bail reform requires an urgent solution and the inaction of Cuomo and Democratic legislators is appalling. In just two weeks, we have seen a person charged with manslaughter; the driver of a fatal hit and run; a drunk driver in an

accident that killed a pedestrian; and the perpetrator of a hate crime that’s been arrested three times in the past week all set free without paying bail.

I invite everyone in our community to join me in calling for immediate action to halt this extremely dangerous policy by visiting my website at flanagan.nysenate.gov and clicking on the link on our home page. Common sense needs to prevail, and the voices and safety of honest, law-abiding New Yorkers deserve to be put before the rights of dangerous criminals.

In a letter to this newspaper [“Condemn anti-Semitism,” Jan. 16], our congressman, Lee Zeldin [R-NY1], forcefully condemned the anti-Semitic attacks that occurred recently in the New York metropolitan area. I share this condemnation. Until last year, for over 50 years the doors of my synagogue were unlocked during Shabbos services. Not anymore.

Unfortunately, instead of sticking to a categorical condemnation of all antiSemitism, whether from the left, from the right or from no particular political origin, Zeldin uses part of his letter to score political points.

He cites the attack by a mentally ill woman, who punched an Orthodox woman in the street the day following her release after being charged with another antiSemitic attack, to trash the bail reform law recently passed by New York State. This issue has nothing to do with combating anti-Semitism. It does have to do with changing the practice of making people arrested but not convicted rot in jail for months or even years, or plead guilty to a crime they did not commit, solely because

they are poor. Exploiting the fight against anti-Semitism to sow fear and division about an unrelated law he opposes in any case is not only immoral but discredits the very cause Zeldin is advocating.

I agree with Zeldin that the BDS movement, founded on the principle of eliminating the Jewish state of Israel, is often a locus of anti-Semitism. The congressional resolution he cites, H.Res.246 — condemning BDS — passed 398-17.

But his condemnation of BDS would be far more compelling if he acknowledged the dramatic increase of open anti-Semitism during the Trump administration, sparked in part by Trump’s refusal to categorically and emphatically condemn white supremacist and neo-Nazi groups and rallies, most notoriously the Unite the Right rally of August 2017 in Charlottesville, Virginia. As in so much, the president sets the tone.

Instead of making political points, it would have been far better if Zeldin had stuck to the recommendation of Jonathan Greenblatt, CEO of the Anti-Defamation League, to back passage of the Online Safety Modernization Act, which would

aid the effort to combat online anti-Semitic vitriol, and also the Domestic Terrorism Prevention Act, which would strengthen measures to prevent violent anti-Semitic attacks in the U.S. As a member of Congress, these are active steps Zeldin could take.

I agree with Zeldin that education is absolutely central to combating antiSemitism. A 2018 survey revealed that 41 percent of Americans and 66 percent of millennials do not know what Auschwitz was. Such education needs to include study of the underlying causes of the Holocaust, such as the centuries-long demonization of Jews in Europe as pernicious outsiders. Elie Wiesel famously said, “The Holocaust did not begin in the gas chambers — it began with words.”

The worst possible way to combat antiSemitism is to politicize the fight against it. Doing so weakens the effort. It’s not a political issue, it’s not a Democratic issue, it’s not a Republican issue. It’s a common decency issue.

Celebrating MLB’s First Woman Coach

T

here may be no crying in baseball, as Tom Hanks famously said in the movie “A League of Their Own,” but there is, thanks to San Francisco Giants and Alyssa Nakken, now a woman in baseball.

Last week, for the first time in the 150-year history of the game, a woman joined the ranks of the coaches at Major League level.

While it may seem past time that America’s pastime caught up with the times, members of the Long Island athletic and softball communities welcomed the news.

“I hope that it becomes more of the norm rather than the exception,” said Shawn Heilbron, athletic director at Stony Brook University.

For Megan Bryant, who has been the head softball coach at Stony Brook since 2001 and has collected more than 870 career wins, Nakken’s new job creates a path that others can follow.

“For the Giants and Major League Baseball and women in sports careers, that’s a big deal and is a step forward,” Bryant said. “It will open other doors for other women.”

Bryant said teams can and should recognize the wealth of coaching talent among men and women.

“If you’re a great coach, it shouldn’t matter the gender of the athletes you’re coaching,” Bryant said.

Lori Perez, who was an assistant softball coach at Sacramento State University when Nakken played and is now head coach, said the news gave her “goose bumps.”

The hardworking Nakken, a two-time captain at Sacramento State, once asked her coaches to stop a low-energy practice so the team could refocus and flush their negative

energy, Perez said.

Nakken’s parents had “high expectations for her but, even better, she had high expectations for herself,” which included doing well academically and helping out in summer camps, Perez said.

Patrick Smith, athletic director at Smithtown school district, believes these first few female hires in men’s sports are a part of a leading edge of a new trend.

“We will see more and more [women joining professional sports teams] as time goes on,” Smith said. In Smithtown, women constitute greater than half of all the athletes at the high school level.

Among the six senior women on Stony Brook’s softball team, three members are considering a career in sports after they graduate, Bryant said.

While the Women’s College World Series softball games have drawn considerable fan attention, attendance at women’s college and professional sporting events typically lags that of men.

The Long Island community can provide

their daughters with a chance to observe and learn from role models at the college and professional levels by attending and supporting local teams.

“It’s frustrating that the women’s games aren’t drawing close to what the men’s teams are,” said Heilbron. The Stony Brook women’s basketball team, which includes standout junior India Pagan among other talented players, is currently 18-1.

This is the best start in program history.

Typically, the third Monday of January, but it can be the second or the fourth, Blue Monday is the confluence of several downers. We Between can certainly guess you and me what they are.

For starters,

the traditionally coldest month, makes for a lot of storms, gloom and shut-ins. Even if we are fortunate, as we have been so far this year — there haven’t been so many storms — we know they are coming.

Then there are the holiday bills. This is when credit charges begin arriving, along with their urgency to be paid. We had a wonderful time, for the most part, during the celebratory days of December. Time to pay the piper.

Right around now is also when our New Year’s resolutions begin to fade. Reality sets in with an awareness of how truly hard it is to break bad habits. Easier to slip back into the old ways, especially as a treat during the awful weather.

As we look ahead into the new year, there are no big holidays to anticipate — nothing larger than St. Valentine’s Day, a Hallmark holiday after all. And then there are the coming taxes.

Property tax deadline has just passed, emptying our bank accounts but April 15 will be coming up faster than our savings might grow. Not all of us get refunds — quite the contrary.

So here are five things we can do to offset the alleged challenges of the season. They are proposed by a Buddhist monk in his book, “Love for Imperfect Things: How to Accept Yourself in a World Striving for Perfection,” and they speak to self-care. Haemin Sunim, who has taught Buddhism at Hampshire College in Amherst, Massachusetts, according to a recent article in The New York Times, goes beyond the obvious advice of exercising, eating well and getting enough sleep.

First, start by taking a deep breath. As we think about our breathing, it becomes deeper, giving us a sense of calm no matter what is happening around us.

Next comes acceptance “of ourselves, our feelings and of life’s imperfections.” When we struggle to overcome difficult emotions, the struggle intensifies. But if we start by accepting those emotions, allowing them to be there, the mind quiets.

Writing is a third suggestion from the monk.

This one, of course, speaks to me. Write down what is troubling or what we need to do, then

leave the load on paper and get a good sleep. The list will be there and help to direct our actions in the morning. I have found this therapeutic when I wake up in the middle of the night herding a multitude of thoughts. I keep a pen and pad on the bedside table and I offload the burdens. In the morning, if I can read my writing, I can usually figure out how to proceed.

Talking is also important. How do I know what I think until I have heard what I’ve said?

Somehow talking out a situation makes it clearer.

There has to be a totally nonjudgmental and trustworthy friend who will listen, of course.

Last on the top 5 is walking: “When you sit around thinking about upsetting things, it will not help you. If you start walking, our physical energy changes and rather than dwelling on that story, you can pay attention to nature — a tree trunk, a rock. You begin to see things more objectively, and oftentimes that stress within your body will be released,” the monk said.

Even if we have no issues at the moment, we certainly feel better after taking a walk.
