After her very popular and practical Conveyancing in a Nutshell session, we welcome back Deidre Tan previously of Wallace, Wilkinson & Webster (now Page Seager Lawyers) to present an introduction to conveyancing aspects of family law matters for legal support staff.

Deidre Tan graduated with a combined Bachelor of Business and Bachelor of Laws degree from the University of Tasmania in 2012. She was admitted as a Barrister and Solicitor of the Supreme Court of Tasmania in August 2013. Prior to commencing practice with Wallace Wilkinson & Webster in 2017 in the area of Conveyancing, Deidre was a team member at SAI Global Property Division for a period of 2 years.

Behind the Wheel – A Practical Demonstration of the Conveyancing Journey using PEXA $89 PEXA Team

With this session, PEXA's purpose is to introduce and enable electronic conveyancing into Tasmania by creating system solutions that are compatible, reliable and able to be used by all interested parties. PEXA aims to facilitate the transition to a positive digitised experience by introducing and adopting new streamlined systems, process, ways of working and behaviours across the various stakeholder groups. In this session, presented into the 2024 Property and Commercial Law Conference, PEXA provides a demonstration to demystify the experience of e-conveyancing and pique the viewer's interest in readying one's legal practice.

The Who, What and When of Estate Planning and Estate Administration $45

Kimberley Martin, Kate Moss and Eve Hickey, WMM Lawyers This session, conducted by a panel of local experts in the area, is a deep dive into the timeline from ‘estate planning’ to ‘estate administration’, including: WHO is in control: the attorney, the guardian, the administrator, the executor, the trustee, the appointor, the principal, the protector or … the terminator; WHAT is the purpose/effect of each document (and particular clauses in them); WHAT are the formal requirements (including witnessing requirements) for each document and WHAT happens if those formal requirements are not met: binding death benefit nominations, powers of attorney, enduring powers of attorney, instruments appointing enduring guardians, wills, trust deeds, deeds of succession, grants of probate and grants of representation; WHAT assets are governed by what document: personal assets, superannuation, life insurance, jointly owned assets and trust assets; and WHEN does each document become operative and expire (if at all): immediately, upon incapacity, upon a certain event occurring or time period passing, upon separation, upon divorce, upon death or a combination of these?

Kimberley Martin is a senior estate planning, commercial, tax and trusts lawyer. Kimberley’s range of expertise includes estate planning, tax, business succession, trusts and superannuation law, with a particular emphasis on complex needs, international, and high net worth estate planning.

Demystifying LTO Processes $45

Kate Moss is a senior probate lawyer. Kate leads a team that works on trusts and estate administration, and on legal issues that arise as a consequence of the death of a person. This includes resolving superannuation, insurance, ownership, trust, and related issues when someone has died.

Land Titles Office Team

This session delivered by the LTO team unpacks some of the mysteries of the Land Titles Office in relation to our systems and administrative processes. Some of the things covered include: Examples of common mistakes seen by the LTO and how to avoid them; Frequently Asked Questions: Let’s get these answers right!

Mathew Phipps started with the Land Titles Office as a clerk in 2003. He was held the position of Examiner (Registrations) and worked in the General Law and Powers of Attorneys areas before settling into the role of Development Officer. Mathew also assists in the Strata Dispute adjudication process and holds the position of Assistant Recorder.

Mathew has been involved with the development of the Tasmanian Online Land Dealings (TOLD) system from the beginning and conducted the initial rollout training around the state.

Joanne Lovell has worked at the Land Titles Office since 2003. She has had various roles within the Office over that time period including Clerk, Examiner (registrations) and currently as a Development Officer. Joanne was part of the development and implementation of TOLD. Nick Doyle started at the LTO in 2004 as Technical Officer in Plan Records, in 2009 moved into the Plan Examination Section and since 2019 has held the position of Principal Examiner (Registration). Nick assists with the management of the Registration section which is responsible for the examination and registration of all dealings within the LTO.

Wills and Estates 101 $49

Matthew Pawson, Consultant, Rae & Partners and Melanie Kerrison, Managing Director, Rae & Partners This session was delivered to support staff at law firms and is an equally excellent resource for new graduates and early career lawyers. In this session, Matthew Pawson, Consultant, and Melanie Kerrison, Managing Director, Rae and Partners, provide tips on ensuring efficient and accurate assistance to your firms clients by providing the best results for executors and beneficiaries whilst maintaining an understanding of, and consideration to, the emotional component of estate administration. This session explores the interplay between important legal principles and how they are dealt with in practice across a range of areas in drafting wills and administering estates.

You will gain an insights into the legal issues and understanding of the practical aspects of the: the relationship between effective Will drafting and effective estate administration addressing potential challenges to Wills at the drafting stage, including capacity, TFM and other potential issues; application of trust law to Wills and estate administration in managing testamentary trusts, including charitable trusts; trusts and estates with income tax and capital gain taxation issues; residency issues estate assets held both interstate and internationally; managing executors and beneficiaries who don’t, or won’t, get along administration of estates and trusts with missing executors and beneficiaries.
