REGULATIONS FOR AND CONDITIONS OF SALE 1. All animals entered must be put up for Auction, and sold in the order in which they appear in the Catalogue. Animals to be catalogued in order of age, the oldest animals to be placed first. Animals not presented in the Sale ring in Catalogue order will not be admitted to the Sale ring until the end of the section of the Sale for which they are entered. 2. The pedigree, history and description of each animal shall be guaranteed and warranted to be correct in all particulars by the person whose name appears as Vendor, but every animal shall be sold subject to all faults. No liability whatever is undertaken by the Auctioneers for the statements appearing in the Catalogue. The Vendors who supply such statements are alone responsible for any error or misstatement. 3. Vendors must provide competent persons to take charge of their stock up till the close of the Sale, whether sold or unsold. 4. The animals will be sold in guineas. Commission of five pence for each guinea will be charged on all Sales, either public or private. 5. Should any animal pass out of the Sale Ring unsold and be subsequently sold privately the Purchaser shall pay the Commission on such private sale. 6. Animals will be offered subject to a reserve price. 7. No money shall be paid to the Vendor of any lot sold, unless the lot be cleared by Purchaser, and the Auctioneers will not be answerable for any deficiency that may arise on the re-sale of any unclaimed property, but will give the Vendor all reasonable assistance to have the contract enforced. 8. The Purchasers to give in their names and addresses in writing, and pay the full purchase money for each lot at the fall of the hammer (if required), in default of which the lot, or lots, so purchased may be put up again immediately and re-sold. 9. No lot, or lots shall be removed from the premises till paid for, but each and every lot shall immediately at the fall of the hammer, be considered as delivered, and be, and remain in every respect at the absolute risk of the respective purchaser or purchasers thereof and shall be removed from the place of sale at the purchaser's expense. 10. No undertaking of the Auctioneers, or their servants, to take charge of the lots or animals after the sale, or to forward them to their destination, shall be held to impose upon the Auctioneers any legal obligation, or vitiate any of the forgoing Regulations for and Conditions of Sale. 11. Should any question arise, not provided for in the foregoing Rules, Regulations or Conditions, the decisions of the Auctioneers shall be final, from which there shall be no appeal. 12. UNDERSTANDING BREEDPLAN Only British Blue GROUP BREEDPLAN EBVs or INTERIM EBVs with Accuracy (Acc) can be validly compared between herds. ESTIMATED BREEDING VALUES (EBVS)

The EBV is the best estimate of an animal's genetic merit for that trait. ACCURACY

An accuracy value is presented with every EBV and gives an indication of the amount of information that has been used in the calculation of that EBV. The higher the accuracy the lower the likelihood of change in the animal's EBV as more information is analysed for that animal or it's relatives. Accuracy below 75% should be considered low. CALVING EASE Calving Ease EBVs are based on calving difficulty scores, birth weights and gestation length information. More positive EBVs are favourable and indicate easier calving. DIR: Direct calving ease indicates how this animal influences the birth of its progeny. DTRS: Daughterâ€™s calving ease indicates how well the animal produces daughters that have easier calving. BIRTH AND FERTILITY

GL: Gestation Length EBV (days) is based on AI records. Lower (negative) GL EBVs indicate shorter gestation lengths which generally relate to easier calving and increased growth after birth. BWT: Birth Weight EBV (kg) is based on the measured birth weight of animals, adjusted for dam age. The lower the value the lighter the calf at birth and the lower the likelihood of a difficult birth. This is particularly important when selecting sires for use over heifers. SS: Scrotal Size EBV (cm) is an indicator of male fertility in regards to semen quality and quantity. Higher (positive) EBVs indicate higher fertility. There is also a small negative correlation with age of puberty in female progeny. GROWTH

MILK: 200-Day Milk EBV (kg) is an estimate of an animal's milking ability. For sires, this EBV is indicative of their daughterâ€™s milking ability as it affects the 200-day weight of their calves. 200: 200-Day Growth EBV (kg) is calculated from the weight of animals taken between 80 and 300 days of age. Values are adjusted to 200 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for growth to early ages. 400: 400-Day Weight EBV (kg) is calculated from the weight of progeny taken between 301 and 500 days of age, adjusted to 400 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for yearling weight. 600: 600-Day Weight EBV (kg) is calculated from the weight of progeny taken between 501 and 900 days of age, adjusted to 600 days and for dam age. This EBV is the best single estimate of an animal's genetic merit for growth beyond yearling age. MWT: Mature Cow Weight EBV (kg) is an estimate of the genetic difference in cow weight at 5 years of age. Smaller, or more moderate EBVs are generally more favourable.

CARCASE

CWT: Carcase Weight EBV (kg) estimates the genetic difference in carcase weight at a standard age of 650 days. EMA: Eye Muscle Area EBV (cm2) estimates genetic differences in eye muscle area of a 300kg dressed carcase. More positive EBVs indicate better muscling on animals. FAT: Rib Fat EBV (mm) estimates the genetic differences in fat depth at the rib in a 300kg dressed carcase. More positive EBVs indicate more subcutaneous fat and earlier maturity. RBY%: Retail Beef Yield Percent EBV (%) represents total (boned out) meat yield as a percentage of a 300kg dressed carcase. A more positive EBV indicates higher percentage yield for the 300kg carcase size. IMF%: Intra-muscular Fat Percent EBV (%) is an estimate of the genetic difference in the percentage of intra-muscular fat at the 12/13th rib site in a 300kg carcase. Depending on market targets, larger more positive values are generally more favourable. INDEXES An index combines the EBVs with economic information (costs and returns) for specific market

and production systems to rank animals based on relative profit values. Note that the different types of animals can give similar profit values, so you should also consider both the index and the component EBVs when selecting animals for your production system.

BBB Carcase Yield Index (£’s) - Estimates the genetic differences between animals in net profitability per cow mated for an example commercial herd targeting the EU market with no marbling requirement. All progeny are assumed to be marketed at around 550-580 kg live weight (280-320 kg carcase weight) at approximately 19 months of age. Bulls with a higher BBB Carcase Yield Index will have a greater genetic potential to sire heavier finished progeny. As there are no maternal traits included in the calculation of the BB Carcase Yield Index, bulls with a high Index will not necessarily be suitable for breeding heifer replacements. BBB Pedigree Breeding Index (£’s) - This index (£ per cow joined) targets herds that breed their own replacement cows and bulls and slaughter progeny from large framed cows. Steer progeny are slaughter at around 16 months of age at 620 kg live weight (360 kg carcase weight). The main EBV emphases are on weight, carcase retail beef yield and calving ease. The index estimates the genetic differences between animals in net profitability per cow mated for a herd targeting the EU market with no marbling requirement. With this in mind, the index also identifies suitable replacement breeding animals by also considering the maternal and fertility traits of the animal. Therefore, both direct and daughters calving ease are included in the index. This index is only reported for animals with at least moderate accuracy for the key traits. Animals must also be in the top 50th percentile or better for Calving Ease Direct, 400 Day Weight and Retail Beef Yield % EBVs.

British Blue Cattle Society Selected Conditions and Notes for the Pedigree Sales Arena, Moira An Export Sale organised by the Northern Ireland British Blue Club under the auspices of the British Blue Cattle Society

To be read in conjunction with such other conditions of entry or sale, warranties etc, as are printed herein (to which the attention of all vendors and prospective purchasers is drawn) and such other conditions, warranties, etc, as are announced prior to or at sale time. These conditions and/or warranties include terms restricting or excluding the liability of the vendors and/or the Society and/or the auctioneers. Do not bid for, or purchase, any lot or lots unless you have read the conditions and agree to be bound by them. 1a

The show and sale will be conducted under the auspices and rules of the British Blue Cattle Society, the decision of which Council being final and binding on all parties in the event of any dispute. Should a dispute arise, be it concerning warranties, pedigrees or such other matters as are not specifically dealt with in the conditions of sale or sale notes and information, the British Blue Cattle Society may, at its discretion, appoint an arbitrator, whose decision shall be final and binding on all parties. In the event of the auctioneers being required to furnish a report and/or award, the preparation of such report and/or award shall be the limit of their involvement in that particular dispute.

The show and sale being organised and directed by the British Blue Cattle Society, the auctioneers cannot accept any liability in respect of any claim whatsoever or howsoever arising. The descriptions are those supplied by the vendors, who alone are responsible for details and accuracy. The auctioneers will not be answerable in respect of any errors which may occur in the catalogue. Alterations and/or additions to the catalogue may be announced by the auctioneer prior to inviting bids for a particular lot or lots, or at such time as notice is received from the vendor of such alterations and/or additions, prior to the fall of the hammer, and such shall form a part of the contract of sale. The onus is upon each vendor to ensure that the animal presented in the sale ring is the animal described in the catalogue in relation to that particular lot number and upon the purchaser to ensure that the animal that he has purchased and takes delivery of is the one as described in the catalogue.

All exhibitors of pedigree and/or grade registered cattle are fully paid-up members of the British Blue Cattle Society, and all such stock must be registered in the Herd Book issued by the Society and, as such, are eligible for transfer subject to the Societyâ€™s rules and regulations. The exposure for sale of such stock is an implication by the vendor of his or her ability and willingness to transfer the animal(s) in question to the subsequent purchaser only, who shall be the one noted by the auctioneer at the time of sale. In respect of such cattle, the Societyâ€™s auctioneers, on behalf of the Society, will make an appropriate deduction to cover the cost of such transfer(s), before accounting to the vendor. Pedigree and grade registered certificates will be distributed by the Secretary of the Society in accordance with the rules and regulations of the Society.

Whilst exhibitors of other than pedigree and/or grade registered cattle need not be members of the British Blue Cattle Society, they are strongly urged to become so, in the knowledge that their active participation should ensure a strong Society, the better able to represent the breed.

Sale entries may comprise:(a) Pedigree registered (British Herd Book) British Blue males and females. (b) Grade registered (British Herd Book) British Blue females. (c) Non-registered females, either with a pedigree calf at foot, or the recipient of a pedigree embryo

(d) All embryos are sold subject to the resultant calves being able to be registered with the Society i.e. there must be a DNA profile on the sire and dam of each embryo (e) No animals entered shall have horns. 1.

No calf, whether pedigree or crossbred, under the age of 3 months on the day of the sale, will be accepted for either show or sale.

No pedigree entry will be accepted, unless accompanied by a Herd Health Declaration Form, as decreed by the Society, from time to time. (1st January 2009)

It is a statutory requirement that any bull over the age of 12 months, sold through a public auction, shall have a ring in its nose, by which it can be controlled and led safely

All cattle are accepted subject to their compliance with the rules and regulations relating to this sale and such other rules and regulations as are pertinent and laid down by the Society.

All entries of pedigree and/or registered cattle must be accompanied by the appropriate documentation, together with a non-returnable entry fee, as determined by the Society. No entry fees will be returned in respect of cattle rejected after inspection.

Entries of other than pedigree and/or grade registered cattle, if applicable, must be accompanied by the appropriate AI certificate or signed declaration of sire, together with, insofar as members are concerned.

In addition, each lot, with the exception of those cattle entered in a crossbred section of the show and/or sale, if applicable, whether shown by a member or a non-member, will be subject to the payment of a non-returnable fee, as determined by the Society, which represents a contribution to the Society’s/Clubs advertising fund, to be used to promote sales in general.

Upon arrival in the market within the times specified by the Society, whether for show and sale, or for sale only, all cattle must be presented before the Inspectorate (which shall comprise a veterinary surgeon and/or such other persons as shall be approved and appointed by the Society) for a health inspection. No cattle may be penned in the official sale pens until having passed such inspection. Show cattle must be accompanied by the relevant documentation. All cattle inspected as per the criteria laid down by the Society. In addition, all cattle (whether previously inspected or not) will be inspected to ensure that they comply with Society Bye-law No. 7 and 1, the latter which states:The definition of the breed’s characteristics is as follows:“A long, large bodied beef animal with fine bones, double muscle, sloping rump and hidden hips, strong legs and correct mouth. Coat colour can be black and white, blue and white, or blue, or white or any combination of colours that is acceptable to the Council.” Cattle registered with the Society will be identified by ear tattoo, except cattle born after 1st January 1998, which are not required to be tattooed provided that they are double tagged in accordance with DEFRA regulations. Any cattle with illegible tattoo marks will be held back from inspection until such time as the ears are cleaned. Furthermore, all crossbred cattle, including calves at dam’s foot, will be inspected to ensure that they are representative of the breed and are in good health.

The Inspection shall be carries out as per the Society By-Law No. 7 .In the event of any dispute the decision of the Inspectorate will be final and binding upon all parties. By Law 7.9 applies to any reject animal.

Any commercial stock disqualified, for any reason whatsoever, must be withdrawn from the show and/or sale and removed from the market premises forthwith, if practicable, or otherwise to a lairage designated by the Society, at all times remaining the responsibility of the vendor. Disqualified commercial cattle, whilst on the market

premises, must not be offered for sale, or sold, either by auction or by private treaty. In the event of a dispute the decision of the inspectorate will be final and binding upon all parties. All cattle must be in the market by the time specified by the Society or the Northern Ireland British Blue Club, on the day of the show, unloaded under the supervision of the BBCS, in order to be presented for inspection at the start of the stated time. Council hopes, by complying with this regulation, all cattle will have been inspected, washed and in the appropriate sale pens prior to any pre-sale inspection by prospective purchasers, thus giving a more orderly outlook to the sale. 5

All pedigree and grade registered cattle will be sold in guineas (multiples of 105p), and all crossbred cattle will be sold in £’s. Commission will be charged on pedigree cattle at the rate of 5% + Vat, of which 2% + Vat is a levy due to the Northern Ireland Blue Cattle Club, with the exception of commercial cattle, commission on which will be charged at the rate of 2.5% + VAT, 1% + VAT of which is a levy due to the affiliated Northern Ireland Blue Cattle Club.

No stock may be removed from the sale pens without either a receipted account or an authorised pass and, in the interests of orderly marketing, both vendors and purchasers are requested to comply with the reasonable requests of the auctioneers’ staff.

No warranty, other than any stated above or herein, is given or implied in any respect whatsoever. Intending purchasers should note that time is of the essence in respect of any condition of sale, warranty etc., and in complying with any such conditions or giving such warranties, be they stated or implied, it is the stated intention of each vendor that any compensation should in no circumstances exceed that stated, and purchasers will be deemed to have purchased in the full knowledge of this. Whilst the auctioneers will do everything possible to assist in the settlement of any dispute which may arise, it must be accepted that a sale by auction involves a contract entered into by the vendor on the one part and the purchaser on the other part and that these are the two parties which must, perforce, be involved in any settlement. The auctioneers’ part as intermediaries must be seen to be of assistance only, except where they are obliged, under the conditions, to make a pronouncement.

“It is a condition of sale, that where a warranty claim on a bull is upheld, that the purchaser shall agree to the Society or its agent, on behalf of the vendor, should it choose to do so, of having access to all calves that he has bred in the last 12 months, along with their dams if necessary, for the purpose of undertaking DNA parentage checks”.

Notice to Purchasers The objective of the Official Society Inspection is primarily in place to raise the breed standard and the inspection panel’s decision is intended as a purchasers guide only. Prospective purchasers should satisfy themselves as to the suitability of an animal for their particular requirements. By bidding for an animal the intended purchaser accepts the Societies and Auctioneers conditions of sale, the animal being theirs at the fall of the hammer

ADDITIONAL NOTES. 1.

It is compulsory that all females sold as “warranted in-calf” are pregnancy diagnosed before sale time, and whilst the date of the certificate may be within one month of the sale day, the Society strongly recommends that the inspection is carried out as close to sale day as is considered appropriate. Such certificates should be handed to the auctioneers for record purposes.

All Pedigree cattle are sold under the terms and conditions of the National Beef Association, bull and female breeding warranties.

IMPORTANT At all times the BBCS reserves the right to alter in any way the order of sale in the interests of its members, at its sole discretion and without prior notification. September 2011
