The fullblood herd was started by Steven in 2000, purchasing a set of open heifers from Plentyview Simmentals. Over the next several years the fullblood herd has grown immensely by the purchasing of bred heifers from purebred sales, and our own replacement heifers. PETERS SIMMENTALS Welcome to the Mid Western Simmental Breeders Sale. Bill and Virginia Peters, Peters Simmentals, have been raising Simmental cattle for over 30 years. Along with our daughter, Tiffany, we run 75 purebred and commercial cattle (red, black and traditional color). Our bulls are sold by private treaty each year. Tiffany was very active in 4-H and has taken a big role in the YCSA program, acting as Saskatchewan President and now the National YCSA President. We have shown cattle at many Summer shows including the Prince Albert Exhibition show and have attended fall shows at Lloydminster Stockade and Saskatoon Fall Fair. We have brought 4 powerful females to the sale this year. With the cattle prices at a high we feel it is the right time to be in the Simmental breed. We have something for every cattle producer. TERMS & CONDITIONS TERMS - The terms of the sale are cash or cheque payable at par at sale location unless satisfactory credit arrangements have been made previous to the sale. The right of property shall not pass until after settlement is made. The sellers reserve the right to require a certified cheque as settlement before releasing any sale cattle. Should any purchaser fail to settle for his purchase, the seller reserves full power to resell the animal to the best advantage either publicly or privately, without further notice. Any loss arising from such resale together with keep and all other expenses shall be payable by the defaulter. All settlements must be made with the clerks of the sale before any cattle will be released. BID - Every animal consigned to the sale must be sold by auction. No private sales will be allowed except as otherwise provided for in the terms and conditions. No by-bidding will be permitted. Each animal will be sold to the highest bidder. DISPUTES - In cases of dispute, bidding will be reopened between the parties involved. If no further bid is made the buyer will be the person from whom the auctioneer accepted the last bid. The auctioneer’s decision in such matters will be final. PURCHASER’S RISK - Each animal becomes the risk of the purchaser as soon as sold. Animals will be cared for at the purchaser’s risk for a reasonable length of time. ANNOUNCEMENTS from the auction block will take precedence over the printed matter in the catalogue. Buyers are therefore cautioned to pay attention to any such announcements. CERTIFICATE OF REGISTRY - The proper Registration or Recordation paper, as the case may be, will be duly transferred and furnished to the buyer for each animal after settlement has been made. BREEDERS GUARANTEE, BULLS - Should any bull fourteen (14) months of age or over, fail to prove a breeder after being used on cows known to be breeders, the matter shall be reported in writing to the seller within six (6) months after the bull has reached fourteen (14) months of age. The seller will then have the right and privilege of six (6) months to prove the bull a breeder. No guarantee is given that semen collected from the bull will be suitable for artificial insemination. FEMALES - Cows represented as being “pregnancy tested safe in calf” have been examined and declared safe by a licensed veterinarian and will be accompanied by a Veterinarian’s Certificate to this effect. They are considered breeders without further guarantee. Cows with calves at side shall be considered breeders also without further guarantee. Cows and heifers represented as “bred” are not guaranteed safe in calf but they and open heifers selling as individual lots are guaranteed to be breeders. No guarantees shall apply to suckling calves. In the event a female is claimed to be a non-breeder and after having been treated by a licensed veterinarian the matter must be reported in writing to the seller within six (6) months of sale date. For heifers under twelve (12) months of age, and purchased as single lots and who fail to conceive in the service of a bull known to be a breeder, the matter must be reported in writing to the seller before the heifer reaches eighteen (18) months of age. The seller shall have six (6) additional months in which to prove any such female a breeder and may use any registered bull of the breed available to him. Any female returned will be at the purchaser’s risk. No guarantee is given that a pregnant female will deliver live calves or that she will carry calves full term nor that the calf carried will not be mummified. The seller is not responsilbe for damage caused by foreign bodies after the animal has been sold nor for sickness not apparent at sale time. EXCEPTION TO GUARANTEE - In cases where the animal is subjected to any hormonal or surgical reproduction techniques after the sale, this guarantee shall be null and void. SETTLEMENT - Transportation charges on animals returned to the seller are for account of the purchaser. No incidental expenses such as fee, A.I., signing fees, interest, veterinary charges, etc. will be charged by either party when making settlements. If the seller is successful in proving the animal in question to be a breeder, then said animal will be reclaimed by the purchaser at his expense. Should the seller fail to so prove the animal a breeder, then the buyer is guaranteed a satisfactory replacement, F.O.B. ranch or location of origin or a refund of the actual purchase price paid FOB selling point. In no event shall the seller be responsible for more than the purchase price. Should a dispute arise over the quality of a replacement animal, the sellers will appoint a mediator. ACCIDENTS - Although every precaution will be taken to protect the safety and comfort of buyers, neither the sellers, auctioneer, or Association assumes any responsibility in this matter and disclaims any liability legal or otherwise in the event of accident of loss of property. RIGHTS AND OBLIGATIONS - The above terms and conditions of the sale shall constitute a contract between the buyer and the seller and be equally binding to both. Resale of animals following purchase in this sale shall constitute a separate transaction and the rights and obligations of the two parties connected thereto are not covered by the terms and conditions of this sale. THE AUCTIONEER shall have the right to refuse bids from anyone who has a previous record of default in payment or who has not made proper credit clearance prior to the sale with the sellers.
