Dear CIPMA Members, As we continue to deal with the global pandemic, Canada has reached its first vaccine benchmark of administering 3 million COVID-19 inoculations. With this ever-evolving situation and associated regulations, CIPMA will continue to support our members with near-daily rapid updates and weekly policy round-ups on priority policy developments. March has been a busy policy month. The carbon tax got the constitutional green light from the Supreme Court of Canada and a surprise endorsement from the American oil lobby. Line 5 has received strong support from the Government of Canada following a federal committee meeting and the appointment of a mediator to settle the dispute between Enbridge and the State of Michigan. No decisions have been made, but we will continue to keep a close eye on this situation and others to ensure you are informed of all relevant policy developments. We will also continue to monitor all potential opportunities arising from the surplus in electric vehicle investments coming from the federal government of late. Provincial budgets have committed to increasing manufacturing capabilities for electric vehicles, and internationally companies are looking for opportunities to implement electric vehicle charging networks. As the sector prepares for post-pandemic recovery, these are clear signs of the opportunities on the horizon to build diversified client offerings at retail sites. As restrictions loosen throughout the country in the coming months, we understand that our top priority must remain the safety of your retail site employees, to ensure they are protected while they provide an essential service for Canadians. The gradual easing of constraints and the opportunities that an enviro-economic-driven future present make us optimistic for the rest of what 2021 can offer our members. The update serves as a recap and reference point for our members regarding the latest policy impacts on the energy market. We will continue to monitor and communicate any policy changes directly to members as they happen. The updates below are for the period beginning March 1 and ending March 31, 2021.

• Environment Minister Jonathan Wilkinson issued an immediate statement lauding the decision as “a win for the millions of Canadians who believe we must build a prosperous economy that fights climate change.” Clean Fuel Standard Regulation: comment period now closed • Comments in response to the government’s updated Clean Fuel Standard Regulation published on December 19, 2020, in the Canada Gazette, Part I were due to Environment and Climate Change Canada (ECCC) Thursday, March 4, 2021. • This marks the end of the 75-day consultation period. ECCC is targeting late 2021 to publish final regulations. Canada’s carbon price is set to increase April 1, 2021
The Supreme Court of Canada rules carbon tax is constitutional • •
The Supreme Court of Canada has ruled in favour of the federal government’s carbon pricing regime due to the “serious threat climate change poses to the world.” Alberta, Ontario, and Saskatchewan have been opposed to the carbon tax, arguing that natural resources are provincial jurisdiction.
• •
Part of the federal government’s broader plan to raise the price by $10 per tonne each year, capped at $50 per tonne in 2022, the next increase is set for April 1. The current price of $30 per tonne of industrial greenhouse gas emissions will be raised to $40 per tonne, which translates to an extra 8.8 cents per litre of gasoline for regular consumers, according to the Canada Revenue Agency.

Canada and Germany sign hydrogen green energy deal • The Honourable Seamus O’Regan Jr., Canada’s Minister of Natural Resources, and the Honourable Minister Peter Altmaier, Germany’s Minister of Economic Affairs and Energy, entered into an energy partnership. • The agreement positions Canada as a clean energy partner with Germany for hydrogen, critical minerals, and liquefied natural gas. Federal government announces funding to raise awareness of hydrogen fuel cell vehicles • The Honourable Seamus O'Regan Jr., Canada’s Minister of Natural Resources, announced $46,000 in funding to the Canadian Hydrogen and Fuel Cell Association (CHFCA) to promote the benefits of hydrogen fuel cell electric vehicles (FCEV). • The initiative aims to increase hydrogen fuel cell technology knowledge across the municipal sector to lower emissions across the transportation sector. The goal is to accelerate FCEVs’ adoption by government and private-sector fleets. • Funding for this initiative comes from Natural Resources Canada’s Zero-Emission Vehicle Awareness Initiative, supporting the government’s goal of 100 percent zero-emission passenger vehicle sales by 2040.

WESTERN REGION New electric vehicle chargers in Vancouver
• Canada’s Minister of Natural Resources, the Honourable Seamus O’Regan Jr., announced a more than $119,000 investment to install 34 Level 2 electric vehicle (EV) chargers at six sites in Metro Vancouver, British Columbia. Regina to invest in biofuel processing plant
• The City of Regina has approved a request by True North Renewable Fuels Ltd. (TNRF) for a $1-million grant to construct a new biofuel processing plant near the city. • This is the second grant True North has secured; the first was $1 million from Canada's Agricultural Clean Technology (ACT) program. • The plant will focus on turning locally grown canola into biodiesel to be used in the aviation and rail industries. Federal Government invest in EV chargers in Manitoba
• Canada’s Minister of Natural Resources, the Honourable Seamus O’Regan Jr., announced a $155,000 investment to Eco-West Canada to install 31 Level 2 electric vehicle (EV) chargers in Winnipeg and several rural municipalities in southern Manitoba.

Nunavut increases its fuel debt to keep gas prices low
• Bill 68, an Act to Amend the Revolving Funds Act, No. 2, passed third reading in the Legislative Assembly. The amendment will allow Nunavut’s Petroleum Products Division to carry up to $20 million in debt from fuel purchasing, helping to keep fuel prices low in the territory.
• The provincial budget was tabled Wednesday, outlining its plan to spend $186.1 billion with a focus on pandemic management and recovery. • The budget tackles two pillars: Protecting People’s Health, including health care, long-term care, and COVID-19, and Protecting Our Economy with support for families, workers, and employers. The budget includes $1 billion for a province-wide vaccination plan and an additional $2.3 billion for testing and contact tracing.

Budget commitments related to the environment and climate change
• Included in the budget is a commitment to invest $56.4 million to create the Ontario Vehicle Innovation Network (OVIN) over the next four years. This investment will build on the Autonomous Vehicle Innovation Network (AVIN) to accelerate the development of next-generation electric, connected, and autonomous vehicle and mobility technologies. • The OVIN will boost the province’s role in manufacturing electric vehicles through partnerships between small and medium-sized enterprises (SMEs), academia, the auto industry, and the battery sector, including critical minerals development in Ontario’s North. Quebec 2021 Budget
• The provincial budget was tabled with a $12.3-billion deficit that is expected to take six years to balance and a commitment that there will be no tax increases or other deficit-reduction measures until Quebec reaches pre-pandemic employment levels. Budget commitments related to the environment and climate change
• $2.1 billion in the budget is committed for the implementation of an environmental framework policy, including public transit, the electrification of transportation, and the decarbonization of the industrial sector. • The budget also includes $472.7 million to implement additional environmental protection measures. Canada invests in wind energy to reduce diesel in northern Quebec
• To reduce reliance on diesel in rural and remote communities, the federal government announced a $7.1-million investment for TUGLIQ Energy Co. to help fund the third phase of its wind energy project that will displace diesel generation in northern Quebec. Canada and Quebec invest in electric vehicle battery assembly
• Prime Minister Justin Trudeau and Quebec Premier François Legault announced an equal investment totaling nearly $100 million to Lion Electric to establish a highly automated battery-pack assembly plant. • Lion Electric will be the first Canadian manufacturer of medium and heavy-duty vehicles to have state-of-theart, automated battery-pack manufacturing facilities.
ATLANTIC REGION New Brunswick Fuel Retail Margin Review
• The New Brunswick Energy Utilities Board (NBEUB) held its scheduled three-day hearing on Matter 485: Retail Petroleum Margin this week. Gardiner Pinfold was once again retained to review the maximum retail margins, delivery costs, and full-service costs and to provide a report on its findings. This current review is based on data from 2017 to 2019; the timing precludes using 2020 numbers. • In an amended recommendation, Gardiner has proposed a 7.8% increase to the current margin of 6.8 Cpl, which amounts to a .53 Cpl increase. Summary of proceedings: Much of the hearing focused on the integrity of the sample, noting a low response rate, which has been a challenge in years past. Of the nearly 410 sites active in New Brunswick during the review time period, Gardner’s report reflects useable data from only 93 retailers, of which 20 are considered independents. There was also broad recognition that the margin review process set forth in the 2006 regulation might require legislative review. The NBEUB has made efforts to simplify data collection in the hopes of yielding a greater response rate following CIPMA and ACSA’s intervention in the last review process, which resulted in greater consultation from board staff with associations on the development of a condensed list of expenses. In this week’s hearing, CIPMA acknowledged these efforts and offered further support to board staff to identify strategies to increase awareness and participation in the process in advance of the next review. The Board is expected to deliberate and share its findings at a later date. All files on the matter are available publicly here. Nova Scotia 2021 Budget
• The provincial budget was tabled Thursday, outlining its plan to spend $12.4 billion and return to balance in four years with investments in key sectors such as long-term care, public health, mental health, and the environment. Budget commitments related to the environment and climate change
• $16.4 million for green infrastructure projects to help reduce GHG emissions while ensuring citizens are protected from higher fuel and electricity costs. • $7.6 million for active transportation and public transit.

While the Liberal government continues to work toward a clean energy transition, the cancellation of Line 5 would result in devastating job losses with upwards of 5,000 direct and 23,500 indirect jobs lost, according to the St. Lawrence Corridor Economic Development Commission. Although the majority of those jobs are in the Conservativeheld riding of Sarnia, it’s a risk the Liberals are surely unkeen to take in vote-rich Ontario, where ballots cast can make the difference between a minority and a majority win for a Liberal government subtly positioning for a spring election. Supreme Court’s go-ahead on carbon tax a win for federal Liberals
By Michelle Coates-Mather, Vice President, CIPMA Line 5 a test of political will With a quick executive order, President Biden has signaled the end of U.S.-Canadian pipelines. Keystone XL has been brought to its knees, and the Liberal government gave nary a hint of political will to push against the decision. Joe Biden has spoken. Not so the case for Line 5. Natural Resources Minister Seamus O’Regan has referred to Michigan’s order to shut down Line 5 as a threat to this country’s energy security and considers the continued operation of the Line “non-negotiable.” O’Regan isn’t taking this fight lightly, noting he is prepared to invoke whatever measures are necessary to ensure the line remains operational. He has outright rejected Governor Whitmer’s assertion that Enbridge has refused to take action to protect the Great Lakes, noting it is a safe pipeline.
On March 25 the Supreme Court of Canada brought an end to a four-year-long dispute between federal and provincial governments (Alberta, Manitoba, Ontario, and Saskatchewan) over the constitutionality of a national framework putting a price on carbon for consumers and industrial emitters. In its ruling, the highest court has confirmed the threat of climate change is serious enough to warrant a national approach. Under the ruling, the Greenhouse Gas Pollution Pricing Act will allow the federal government to impose a federal tax on any province deemed not to meet a minimum set of national standards on carbon pricing. This is a significant coup for the federal Liberals, emboldening their view that their re-election in 2019 is proof Canadians want to see governments take serious action to address environmental impacts. Environment and Climate Change Minister Jonathan Wilkinson quickly issued a statement that the ruling is “a win for the millions of Canadians who believe we must build a prosperous economy that fights climate change.”

GLOBAL SHELL PLANS TO DOUBLE DOWN ON RETAILER STRENGTHS IN NEW NET-ZERO WORLD Royal Dutch Shell unveiled its plan to reach net zero emissions by 2050. The plan focuses heavily on selling low-carbon electricity, biofuels and hydrogen directly to households and electric vehicle owners. HYUNDAI REVEALS ULTRA-FAST EV CHARGING South Korean auto group Hyundai is set to roll out an electric vehicle charging service platform called E-pit that will become part of the carmaker’s future ecosystem of clean energy vehicles. The new platform will charge 80 percent of a vehicle’s battery in just 18 minutes.
RUSSIA PIPELINE PIVOTS TO HYDROGEN
While the future of Russia’s NordStream 2 pipeline is still uncertain, sources are reporting that Moscow has been investing in the production of hydrogen, potentially aiming to make it flow through the pipeline. This pivot could be in response to the European Commission putting hydrogen at the forefront of its recovery agenda.

VOLKSWAGEN AND BP EXPAND ULTRA-FAST ELECTRIC VEHICLE CHARGING ACROSS EUROPE The two companies announced they intend to extend and speed up the deployment of ultra-fast electric vehicle charging facilities at BP retail sites across the UK, Germany, and elsewhere in Europe. FLORIDA SENATE COMMITTEE OKS FLAT FEE FOR EVS, HYBRIDS The Florida Senate Committee on Transportation, Tourism and Economic Development passed a new fee on electric and hybrid vehicles, the Tallahassee Democrat reports. The committee also approved a proposal to create a network of electric vehicle charging stations throughout the state. If adopted, the tax would pay for road maintenance and fund grants for charging stations.

TESLA WANTS AUSTRALIA TO CHANGE ROAD LAWS FOR ELECTRIC SEMI-TRUCK
Ohio state lawmakers are urging the governor of Michigan to stop plans to shut off the flow of crude oil through the Enbridge Line 5 pipeline in light of the threat of job loss.
Tesla Inc. has called on Australia to ease vehicle-size limits so the company’s electric truck can legally fit on the country’s roads. Local laws cap a vehicle’s width at 2.5 metres, and the company’s first generation of electric heavy trucks tend to be wider by 34 millimetres, meaning its electric trucks cannot legally fit on Australian roads.

CARBON TAXES WIN ANOTHER ENDORSEMENT FROM THE U.S. OIL LOBBY The same day as Canada’s Supreme Court decision, the American oil lobby came out in favour of carbon pricing. The country’s main oil-industry group, the American Petroleum Institute, endorsed carbon pricing as part of its 13-page list of proposals for climate action.

MIDWEST ENERGY JOINS EV CHARGING NETWORK Midwest Energy announced it has entered into a collaboration with nine investor-owned utilities, promoting the construction of a multi-state network of electric vehicle charging stations throughout the Midwestern U.S. HOW LONG UNTIL ELECTRIC CARS RULE THE ROAD? According to a New York Times article, slow fleet turnover is a significant challenge for climate policy. To meet the goal of net-zero emissions with a fully electric fleet by 2050, sales of gasoline-powered vehicles would likely have to end altogether by around 2035. Right now, fewer than 1 percent of vehicles on America’s roads are electric. Automakers are shifting to electric cars, which analysts predict will make up one-quarter of new sales by 2035.

OIL CLIMBS ABOVE $65 A BARREL Futures in New York climbed above $65 a barrel, while the U.S. dollar was trading lower. Gasoline inventories have declined by more than 25 million barrels in the last two weeks, while a measure for consumption expanded last week to its highest level since November. MEDIATOR APPOINTED IN LINE 5 DISPUTE A retired United States federal judge will now act as a mediator in the dispute between Enbridge and the State of Michigan over the continued operation of the Line 5 pipeline. In February, both sides of the dispute were ordered by the U.S. District Court to jointly propose a mediator. ARGUMENTS MADE IN APPEALS COURT OVER ENBRIDGE’S LINE 3 PROJECT The Minnesota Court of Appeals heard arguments over Enbridge’s Line 3 replacement project in northern Minnesota. Construction on the replacement pipeline started in December of 2020 after a construction stormwater permit was granted by the Minnesota Pollution Control Agency. The Minnesota Department of Commerce, along with the Red Lake Band of Chippewa, the White Earth Band of Ojibwe and several Indigenous and environmental groups, argued before the three-judge panel that Enbridge failed to show long-term need for the Line 3 project. The Minnesota Court of Appeals is expected to issue a decision by June.
NATIONAL PIPELINE REGULATORS IN CANADA TO COMMIT TO RECONCILIATION WITH INDIGENOUS COMMUNITIES The federal body which reviews pipelines, cross-border power lines, and some oil and gas activity in Canada’s North, the Canada Energy Regulator (CER), now says it’s committed to systemic change. Indigenous communities have long accused the CER and other energy-sector review bodies of prioritizing the interests of the fossil fuel industry over those of First Nations.
CONSERVATIVES COMMIT TO REPEALING CARBON TAX Conservative leader Erin O’Toole has reaffirmed his stance that a federal carbon price is not the way to tackle climate change. O’Toole said his approach would focus on partnering with the provinces.

BRITISH COLUMBIA, PIPELINE FIGHTS TO RAMP UP WITH SPRING The Trans Mountain pipeline expansion and Coastal GasLink face resurging opposition across the province as urgency around the future of the pipelines in Ottawa grows following the Keystone cancelation and the Trudeau and Biden climate summit planned for next month. Indigenous leaders announced they are beginning a new wave of action against the projects this month. WESTPORT FUEL SYSTEMS ACHIEVES SUCCESSFUL TESTING ON HYDROGEN-FUELED INTERNAL COMBUSTION ENGINE
Westport Fuel Systems Inc., a global leader in alternative fuel, low-emissions transportation technologies, announced a successful start-up and initial trials of a heavy-duty internal combustion engine running on hydrogen (H2) fuel. The company has its headquarters in Vancouver, British Columbia. BRITISH COLUMBIA GOLF CART COMPANY EXPANDS INTO THE ELECTRIC CAR MARKET The Okanagan company Vernon’s SC Carts is tapping into the low-speed electric car market. Its NXT City electric car has a top speed of 40 km per hour and is to be used in designated communities.

ALBERTA ASKS FEDERAL GOVERNMENT TO COMMIT $30B TO ADVANCE CARBON CAPTURE TECHNOLOGIES Alberta is asking the federal government for $30 billion in funding to explore carbon capture, utilization, and storage (CCUS) technologies. News of the request was first reported on Monday morning by the Globe and Mail, who said it was outlined in a “discussion document” obtained by the publication ahead of the next federal budget. INNOVATIVE FUEL SYSTEMS COMMENCE TECHNOLOGY ROLLOUT The Edmonton-based clean-tech company Innovative Fuel Systems Ltd. announced its technology rollout with Westcan Bulk Transport Ltd. The Multi Fuel Technology Platform, which allows diesel-burning heavy-duty engines to utilize a substantive amount of cheaper, cleaner-burning natural gas, is to be implemented on some of Westcan’s Edmonton-based and interprovincial routes as part of the rollout. OILPATCH SET TO SHED MORE JOBS, WITH LABOUR SHORTAGE ON THE HORIZON A new report indicates employment in the oil and gas sector will shrink again in 2021, following a 2020 decrease of more than 20,000 jobs in Canada’s oil and gas sector due to the pandemic.

CROSS-CANADA PIPELINE TO REPLACE LINE 5 WOULD BE A CHALLENGE A senior executive from Enbridge Inc. told MPs they must prioritize fighting to keep Line 5 as building a cross-Canada pipeline to replace it would be even harder to achieve. The senior executive was speaking to the special House of Commons Committee on the Economic Relationship between Canada and the United States, which is studying the governor of Michigan’s order to shut down Line 5.

IRVING OIL DROPS ITS APPLICATION FOR PRICE HIKE Irving Oil has notified the New Brunswick Energy and Utilities Board it is dropping its application for an increase in petroleum wholesale margins four days before it was scheduled to answer dozens of questions about the request.
However, the industry is expected to add jobs in the following two years, and there are already concerns about labour shortages popping up in some key areas this year. COVENANT ENERGY PREPARES TO MEET THE COMING DEMAND FOR RENEWABLE DIESEL Covenant Energy, a Saskatchewan-based renewable fuel innovator, provided an updated plan on its renewable diesel facility. The facility will be constructed in Southern Saskatchewan to produce 6,500 barrels a day, or 300-325 million litres per year. This is in response to the Government of Canada’s draft Clean Fuel Regulations and commitments to attain net-zero emissions.
