Another easy way to get educated and earn the continuing education credit needed to renew your dealers license is to attend the WSIADA 2017 Education Fairs, July 18th in Spokane and August 17th in Tacoma. Registration information is both in this magazine and on our website. I encourage you to attend one of the Education Fairs; not just for the classes, the lunch and the CE Credit, but also to mingle with dealers like you, who love the car business and believe that an investment in knowledge pays the best interest.

10 Simple Summer Car Care Tips. This particular article is aimed at consumers and how to take care of their vehicles in the summer however it’s a good guide for dealers to consider with cars that they’re trying to put in service with new customers. We believe that if you take care of these 10 tips you can do a lot to minimize your Implied Warranty risk.

Also consider offering these tips to all you customers for that extra measure of customer service.

Your Paper Tracks. Any of you new dealers who have been through my Pre-Licensing class understand the importance of documentation.

This article reminds us how important good documentation is from a lawyer’s perspective. That’s usually when you need it most. Remember that you need to keep one year original paperwork in deal jacket format. After that, you can scan years two through five. If you decide to keep original paper for five years and do not have scanned copies, years one and two must be available at your Place of Business.

Years three, four and five need to be accessible within three business days.

Ten Simple Summer Car Care Tips

C

ar care doesn’t take a vacation between Memorial Day and Labor Day. The warmer months present some challenges to personal transportation and maintenance, but this list will help us all have a summer we can enjoy. Here are our top 10 tips to keeping your car--and its passengers--in good shape this summer.

1. Coolant System Keeping cool is paramount, not just for ourselves but also for our cars. In addition to checking the level of coolant in your car, go the extra mile and inspect the state of the hoses and the coolant reservoir. Keep an eye out for leaks, especially at joints and connection points, such as where a hose connects to the engine block. Also, squeeze the hoses (when the engine is cool) every once in a while to make sure they feel firm and not excessively squishy or soft.

2. Engine Belts There is usually a serpentine belt that runs between the alternator, the fan and several other components. It can deteriorate, become loose, start to squeal, and sometimes just break for no apparent reason. It needs to be in good condition and at the right amount of tension. If you see cracks in the belt or small pieces missing, it’s time to replace the belt.

3. Wipers

These liquids never stop being used and consumed. Speaking of brake fluid, how do the brakes on your car feel in general? Are they lacking in bite? Feeling a bit spongy? If so, new pads and a system bleed might be required. This is the kind of maintenance you should have your mechanic or dealership take care of.

5. Air-Conditioning System Air-conditioning is a summer essential. If the system hasn’t been working properly but wasn’t really a pressing issue over the winter, now’s the time to get serious. If it’s an older system, then leaking Freon into the atmosphere is not good. There are plenty of leak-sealing products and refrigerant rechargers available from hobbyist stores and even places like Walmart. Remember, if there’s not enough refrigerant in the system, you have a leak. Have a qualified mechanic fix the leak before paying to have the air-conditioning system recharged.

should be free of stones, stray nails and the like, and all four should be in good condition. Good condition means no cracks, no uneven wear (this might be caused by a suspension problem) and plenty of tread depth. Since summer is a time for road trips, it wouldn’t be a bad idea to have a can of Fix-A-Flat that could at least get you to a shady spot where you could change the wheel more comfortably. The spare obviously needs to be usable, too.

8. Dashboard Sunshade For those times when you’re not driving, but the car is still out in the sun, a cover that goes in the windshield will protect the dashboard against ultraviolet rays and help the cabin stay a

little cooler. Some even have solar panels to keep the battery charged.

Consider shades for the rear side windows, too, as they’ll provide some protection for the kids. This also helps prevent areas such as the rear seats and dashboard from fading over time.

9. Clean the Car

It’s hot out there. Make sure everyone’s hydrated. It’s better to make a few more bathroom breaks and stretch your legs than to end up cranky and fatigued. Plan road trips as if you were a general marching against an opposing army. Make a list of everything you’re going to need. For example: sunglasses, hats, travel mugs, games for the kids, snacks, chargers for the phones and tablets, route planner, weather forecasts, emergency triangle, flashlight and a small tool kit. If a scheduled service is coming up, think about getting it done before a long drive. It’s also wise to make sure your insurance and driving license are up to date. Have a great summer, enjoy the roads, and take care of yourself and your car.

Those long, balmy evenings when the sun is a huge, orange orb hanging low in a pinky-blue sky sound blissful. But they can also be a hazard, especially when your car’s windshield is dirty. Even from the inside, that haze will diffuse the light and make things hard to see. That grime has a tendency to build up over a long period, so we don’t really notice it. Things look much sharper after your car has had a good wash,

Playing With Fire

If it’s too good to be true, it probably is!

H

ave you heard the new one? A sales trainer is suggesting a new sales trick that has salespeople regularly selling vehicles for more than the advertised price. The practice essentially invites customers to pay an additional amount above the advertised price as a tip for excellent service or for getting an exceptional deal. The trainer claims this is kosher, provided the additional amount is fully disclosed and the customer agrees to it.

It sounds too good to be true, right?

That’s because it probably is. Most states have laws that explicitly require that dealerships sell vehicles at or below the advertised price, often referred to as the “ad price rule.”

But even if your state does not have a clear rule, your state’s Unfair or Deceptive Acts or Practices (UDAP) statute may bar this sales tactic.

Keep in mind, prosecutors­--and in some states, plaintiffs’ attorneys--use these laws to challenge unfair business practices. Further, the Federal Trade Commission (FTC) is very much interested in unfair and deceptive practices, and has built a body of case law it or state prosecutors can use against your dealership.

House Approves Dodd-Frank Replacement Bill

W

ith the U.S. House’s passage of H.R. 10 on June 8, U.S. Rep Jeb Hensarling (R-Texas)’s crusade to dismantle the Consumer Financial Protection Bureau-creating Dodd-Frank Act took a major step forward.

The passage of the bill, which passed the House by a primarily partisan 233to186 vote, is less certain in the U.S. Senate, where Republicans hold 52 seats. That means they’ll need Democrats to cross party lines to get the necessary 60 votes.

“Every promise of DoddFrank has been broken,” said Hensarling, who chairs the House Financial Services Committee, which passed the bill in May by a completely partisan 34 to 26 vote. “Fortunately for all, there is a better, smarter way. It’s called the Financial CHOICE Act. It stands for economic growth for all, but bank bailouts for none.”

Hensarling’s legislation would roll back a number of DoddFrank financial regulations, including Volcker Rule restrictions on certain speculative investments by banks. It would also eliminate the Federal Deposit Insurance Corporation’s orderly liquidation authority and establish new provisions regarding financial institutions bankruptcy.

The bill would also repeal the Durbin Amendment’s limitations on fees charged to retailers for debit card processing. It would also scale back the CFPB’s authority to regulate large banks and payday lenders, convert the regulator into a consumer law enforcement agency, subject it to congressional oversight, and eliminate the agency’s authority to take action against entities for abusive practice.

The legislation, which was received by the U.S. Senate on Monday, would also nullify the CFPB’s guidance on dealer participation, and add a few more steps to the CFPB’s guidance writing activities.

“Access to affordable credit is essential to customers and their dealers,” said Peter Welch, president and CEO of the National Automobile Dealers Association (NADA). “Chairman Hensarling, members of the House Financial Services Committee, and the members of Congress who supported H.R. 10 and worked to include these

vital consumer protections should be commended for their efforts to keep auto financing affordable and available to consumers everywhere.

I look forward to the Senate taking timely actions to help cement these consumer protections into law.”

The House vote came four days before the U.S. Department of the Treasury issued its first in a series of reports to President Donald Trump addressing regulatory reform in the financial services industry. In February, the president signed an executive order directing the secretary of the Treasury to consult with members of regulatory agencies and report back in 120 days and periodically thereafter.

“We congratulate the House on passing the Financial CHOICE Act,” said U.S. Treasury Secretary Steven T. Mnuchin. “The report we are releasing today focuses on solutions the executive brand can execute through regulatory changes and executive actions.”

The 150 page report contains more than 100 suggested changes, including consolidating regulators with similar missions, easing the burden of statutory stress testing, and reducing the powers of the CFPB, among other recommendations. As a next step, the Treasury and the Trump administration will begin working with Congress, independent regulators, the financial industry, and trade groups to implement the report’s recommendations, according to the Treasury’s press release.

“Properly structuring regulation of the U.S. financial system is critical to achieve the administration’s goal of sustained economic growth and to create opportunities for all Americans to benefit from a strong economy,” Mnuchin said. “We are focused on encouraging a market environment where consumers have more choices, access to capital and safe loan products — while ensuring taxpayer-funded bailouts are truly a thing of the past.”

Richard Hunt, president and CEO of the Consumer Bankers Association, issued the following statement regarding the Treasury Department’s report: “The Treasury Department’s report is an important first step in recognizing how a duplicative and onerous regulatory environment harms banks, the economy, and, more importantly, consumers. … We especially applaud Secretary Mnuchin and the department for suggesting reforms to the CFPB’s governing structure, as CBA believes a bipartisan commission at the bureau is paramount to creating longterm stability and certainty for the industry. In addition, we also encourage the department’s recommendation to provide a process over federal regulators to streamline regulatory efforts.”

avid Andrews, owner of City Auto in Memphis, Tenn., and other automotive enterprises, began his 2017/18 term as president of the National Independent Automobile Dealers Association (NIADA) by receiving the President’s Ring during last week’s National Leadership Awards Banquet at the association’s 71st annual convention and expo at The Mirage in Las Vegas.

During his address at the banquet, Andrews, who succeeds 2016/17 president Billy Threadgill of South Carolina, encouraged his fellow independent dealers to keep pace with the rapidly changing automotive marketplace.

“Are times changing? Definitely,” Andrews said. “We are all pioneers, we are all trailblazers and we are all visionaries. These are times ripe with opportunities, times for making the seemingly impossible possible. There are millions of low-mileage, late-model cars hitting the used car market, and the availability of credit has never been better….Now is the best time ever to be a used car dealer.”

Andrews, 65, got his start in the car business as a teenager, working at his father Sonny’s dealership. He soon went into business for himself, opening his own dealership at age 20 — “and I never looked back,” he said. Andrews has grown that single underfunded lot into a thriving operation that includes four retail dealerships — two each in Memphis and the Nashville areas — as well as five wholesale auctions located throughout Tennessee and Alabama, a management company, a floorplan company and a finance company.

Andrews previously served on the NIADA executive committee as a regional vice president, senior vice president and President-elect, and is a past president of the Tennessee

Independent Auto Dealers Association (TIADA).

Others honored at Wednesday’s ceremony included Auction Direct USA CEO Todd Hoagey, who was named NIADA CPO Dealer of the Year. Hoagey also won the inaugural award last year. The honor recognizes the quality of dealership operations, the quality of dealership operations, the vehicle certification process, the number of CPO vehicles sold and the dealer’s commitment to providing a better product and level of service to his customers and the community.
