been in the automotive industry since 1992. I earned an associate degree in Automotive Technology and a bachelor’s in business management.

I worked as an ASE Certified Technician for

several years and later became a shop owner for 12 years. I started my own used car dealer All Right Auto Sales late 2008 and joined the Washington State Independent Auto Dealer Association (WSIADA) in 2009.

As a business owner for many years, I found out that happy customers are the best way to advertise my business. Those who know me know that I am a firm believer in the Golden Rule which is the principle of treating others the way you want them to treat you.

Taken into considerations some of the basic rules of the universe such as (nothing is prefect), and (no one is perfect), I believe that we should always give others the benefit of the doubt and should always try to help each other as much as possible. It is my ambition in business and life in general to abide by the Golden Rule.

During the last 10 years of being a WSIADA member I’ve enjoyed many of the benefits such as the education constantly available to make running a car dealer less complicated, compliant, and legal.

The enormous amount of supplies available at discounted prices for members, the ability to ask an expert a question or share your business concern with someone who can do

something about it, and many other benefits.

The auto industry is one of the most important industries in the United States. Historically, “it has contributed 3-3.5 percent to the overall Gross Domestic Product (GDP).”

It is great to become a part of the team that listen to other dealers’ concerns and fight for them. I encourage every licensed dealer in the state of Washington to become a member of WSIADA. Let us all work together to make our voices heard in Olympia and elsewhere. Let’s try to persuade the governments to make decisions that support us. Let’s keep enhancing the image of the auto sale business by rejecting those who intentionally choose to do unethical, dishonest, and deceiving business.

As they say unity is a famous ingredient for every successful recipe. Alone we can do so little but together we can do so much.

I am looking forward to making a difference.

Practical Guide to a Successful Compliance SelfAssessment

an ever-changing regulatory environment, it is now more important than ever to establish and maintain compliance through all aspects of your business, both in your dealership and in your related finance company, if applicable.

While federal agencies and consumers continue to be active in the consumer finance space, state agencies are becoming more and more involved as well. Thus, it is of utmost importance that compliance be an integral part of each piece of your business, from advertising and inventory, to sales and collections, and so much more.

Self-assessments are a valuable tool to pinpoint areas for improvement and ensure that compliant policies and procedures are implemented and being followed. Here, I will discuss a few areas that you should review during any self-assessment.

Advertising An “advertisement” is defined in Regulation Z as a “commercial message in any medium that directly or indirectly promotes” a transaction with a consumer.

A best practice is to have upper management review any advertisement before it is published. It is important that companies properly educate and monitor employee posts on social media, as these could be considered advertisements.

Disclosure of certain financing terms can trigger additional disclosures under Regulation Z. Reviews and approvals of any advertisements should be documented.

Inventory Walk the lot and check your inventory. Make sure the vehicles on hand match your inventory report and that each vehicle is

accounted for. In addition, check for compliance with the FTC’s Used Car Rule by ensuring each vehicle is properly displaying either a compliant buyer’s guide or a “not for sale” sign. Finally, ensure that the buyer’s guides are properly filled out by checking the appropriate box for either “as-is” or “warranty”.

Showrooms, Sales Offices and Closing Rooms: Walk your showroom, sales offices and closing rooms. Are your licenses properly displayed and up to date?

Do you have required disclosures clearly and conspicuously posted?

Is all consumer nonpublic personal information (“NPI”) appropriately secured and safeguarded per the Gramm-Leach-Bliley Act? Ensure that you are familiar with what constitutes NPI, as the definition is broader than you may think.

Title Transfers and Taxes One of the most common issues I see in the industry is failure to timely transfer title to the vehicles into the consumer’s name. A dealer has only thirty days to transfer title, while buy here, pay here dealers typically have 45 days. Failure to timely transfer title could result in a penalty of $10,000 per occurrence.

Taxes must be timely remitted on a monthly basis. If a buy here, pay here dealer is eligible to remit deferred sales taxes, failure to timely remit such taxes could result in a loss of the privilege and an immediate tax liability.

Deal Jackets and Retail Installment Sales Contracts (“RISCs”) Ensure that your deal jackets include all required documents and are consistently filed, retained and disposed of in accordance with your records retention policy.

All deal jackets should be kept in accordance with a written Safeguards Policy so as to protect all NPI. Regularly audit your RISCs to ensure compliance with Regulation Z and the Truth in Lending Act

Servicing and Collections: Servicing and collections is an area ripe for compliance pitfalls if you are not careful. Below are some common areas that companies struggle with. Make sure to understand your obligations under the Telephone Consumer Protection Act (the “TCPA”) and the Fair Debt Collections Practices Act (the “FDCPA”). Contact times and number of contacts are important, as are honoring “do not call” requests and restrictions on thirdparty contacts.

Repossessions Repossessions are best performed by a licensed and bonded thirdparty. Once a vehicle is recovered, proper notices, including a notice of intent to sell, must be timely sent in accordance with applicable laws. After the sale of collateral, the company must properly account for any deficiency or surplus, and any surplus must be paid to the consumer. Personal property must be accounted for and securely held. Notice must be given to the consumer to retrieve the property, and fees for storage may not be charged.

Credit Reporting The FCRA governs credit reporting.

Companies that report credit must establish policies and procedures to allow consumers to dispute reported information. Lenders have a duty to investigate and timely respond to credit disputes. A quality assurance check on a Metro II file prior to submission will help ensure accurate reporting.

Policies, Procedures and Trainings Additional areas to consider when thinking about compliance include Red Flags, Safeguards, Office of Foreign Asset Controls (“OFAC”) checks and Servicemember Civil Relief Act (“SCRA”) requirements.

More on Dealer Plates

he Nov/Dec edition of the Front Row included an article titled “Continuing Education Requirements.”

Section J referenced the use of Dealer Plates (reprinted here).

Based on dealer member feedback, a correction and expansion of the discussion would be helpful to dealers.

The “requirements” stated that dealer plates may not be used on a personal driver. That statement is not entirely accurate. Under certain circumstances anyone who is entitled to drive dealership inventory with a dealer plate may use the vehicle as a “personal driver”.

However, depending on the circumstances, the dealership would be liable for use tax on the unit(s) in question. This would apply to the dealer, corporate officer, member of LLC their respective spouses and employees.

There are two general categories that the Department of Revenue considers: Executive Vehicles and Demonstrator Use of Vehicles.

• Executive Vehicles applies to the “dealer or a person associated with a dealership (e.g., firm executive, corporate officer, partner, manager) who does not have a recent model car registered and licensed in his/her own name for personal driving”.

• Demonstrator Use of Vehicles applies to a dealership’s sales staff.

I recommend that dealers consult their accountant or the DOR to ensure that your dealership is properly accounting for the use tax that might be payable in either or both of these situations.

NOTE: Dealer plates may NOT be used on a vehicle belonging to an individual such as the dealer, officer, spouse or member of the dealer’s family.

BEST PRACTICE Issue a copy of the dealership’s vehicle insurance card to each individual authorized to drive with a dealer plate.

Periodically check to ensure that personnel driving vehicles with dealer plates have a current copy of the dealership’s “blue card” and a copy of the vehicle insurance car. The “blue card” is the registration for each vehicle in the dealer’s inventory.

Remember, if someone driving with a dealer plate gets pulled over, the officer is going to ask for license, registration and insurance.

LEGISLATIVE FCRA bills advance in House: Just before the end of 2019, the House Financial Services Committee reported two bills that would amend the Fair Credit Reporting Act for consideration by the full House of Representatives.

The bills were among a series of proposals designed to overhaul the credit reporting process that were passed by the committee earlier in the year.

The Restoring Unfairly Impaired Credit and Protecting Consumers Act (H.R.3622) would shorten the amount of time negative credit information

stays on consumer credit reports and would quickly delete fully paid or settled debt from reports.

It would also grant credit relief for student borrowers who took education loans when the lender engaged in fraudulent activity.

The Improving Credit Reporting for All Consumers Act (H.R.3642) would impose new requirements for conducting reinvestigations of consumer disputes and allow consumers to appeal the results of reinvestigations, as well as requiring furnishers to retain records to substantiate the accuracy and completeness of furnished information.

It would also ban misleading and deceptive marketing of credit scoring products and services as well as automatic renewals for promotional consumer reporting products or services.

USMCA tightens rules of origin for auto parts and requires a larger share of cars to be made by workers earning at least $16 per hour, a provision intended to keep American

automakers from relocating factories to Mexico because of cheaper labor.

The Trade Representative’s Office estimated the auto industry will invest roughly $34 billion and create 76,000 jobs within five years of USMCA’s ratification.

Let it snow‌

Prepare now to prevent winter losses

Cool weather, rainy days, fog, even ice and snow.

From a sales point of view the winter selling season can mean the sale of all-wheel or four-wheel drive vehicles, sport utility vehicles, and pickups. It entices those who ignored that leaky heater core or broken heater fan to consider starting fresh with a warm car that works.

Though the shorter, colder days may result in a reduction of lot traffic, often times those who do show up are serious buyers. As any sales professional knows, less traffic means a greater need to focus and capitalize on the opportunities in front of you.

The winter season also brings with it some unique challenges by way of loss prevention that takes an equal amount of focus. A good rule of thumb in preparing your business for winter is to focus on your Property, your People, and your Profits!

Here are some strategies to help prevent losses at your dealership this season:

Prevent frozen pipes by adding caulk and insulation at all exterior wall locations. Consider adding a wireless sensor to monitor the main water line. Keep a backup power supply/generator large enough to run a space heater and emergency lighting.

Get your roof inspected before the snow falls. An inspection usually costs only a couple hundred dollars and will not only provide piece of mind, it can prevent costly, dangerous losses to property and injury to employees or customers. If we do get substantial snow call a roofer. Many offer a snow removal service for your roof for a reasonable fee.

Coordinate a snow plow service now- also before the snow falls. Landscapers and snow removal companies keep a list of clients who contact them before the weather hits.

Get yourself on the short list now so you can focus on selling rather than hammering the phones looking for someone willing to fit you in. Clearing your parking lot and sidewalks will help make it easier for your customers to shop and prevent costly slip and fall accidents.

Make sure to stock up plenty of ice melt while its still in stock.

Establish a foul weather test drive route with right hand-only turns in a low traffic area. An established, safe route lowers the exposure to your vehicles and helps put your prospects at ease.

Prevent auto theft when warming up lot cars. This time of year it is pretty common to have a car stolen while it is warming up for a test drive. If you must leave the vehicle unattended you should always lock the door and keep the keys with you. Never hand the keys to the prospect. That friendly, eager customer may be waiting for an opportunity to steal your car right from under your nose when you step in to grab a demo plate.

Make sure you have winter windshield washer fluid and check the anti-freeze levels in your used vehicles. A clear windshield reduces the chance of an accident and proper anti-freeze levels will prevent a costly break-down.

Awareness. One of the best strategies you can implement to prevent losses is to simply set the expectation for your staff and your customers verbally and with proper signage. Offer a gentle reminder that the road conditions can be slick and dangerous before anyone gets behind the wheel. Encourage them to use caution, give plenty of space to brake, pay attention to other drivers, and turn off cell phones when operating your vehicles. Nobody will be offended when you offer safety suggestions. Add a bright colored caution sign or safety cones near steps or other slip and fall exposures.

Make sure your insurance policy is up to date and active. Ask your agent to ensure you have coverage for liability losses due to slips and falls, property damage, and damage you might cause to your customers autos as well as damage to or theft of your lot vehicles. Be aware that these are not automatic coverages with a dealer policy, they are optional.

The old saying in business, “it’s not how much you make, it’s how much you get to keep that matters.“ Awareness and preparedness is the best way to protect your bottom line.

Washington State Transportation Commission adopts recommendations on road usage charging Commission recommends gradual approach; recommendations move to legislature

I

n December the Washington State Transportation Commission(WSTC) adopted their final recommendations on road usage charging, taking into consideration public input, extensive research, statewide public engagement and detailed analysis of the participant feedback and system performance of the 12-month Washington Road Usage Charge Pilot Project.

The WSTC’s adopted recommendations will be transmitted to the Washington State Legislature, Governor

is encouraged to begin a slow and gradual transition away from the gas tax, starting with requiring vehicles in the state-owned vehicle fleet to pay a road usage charge in lieu of the gas tax. The commission also recommends applying a road usage charge to electric vehicle owners who pay no gas tax and hybrid vehicle owners who pay little gas tax.

The commission also recommended that a full transition to a road usage charge of all vehicles in the state should not occur for at least 10 years, and likely several decades.

o RUC compliance and enforcement o Travel between states o Opportunities to reduce operational costs o Improving the driver experience in transition away from the gas tax

Key state policies and considerations needed for a RUC system ❏ • Implement privacy protection measures in state law specific to a RUC system. ❏ • Restrict RUC revenues to highway-related expenditures by making RUC subject to the 18th Amendment of the Washington Constitution. ❏ •Current programs that receive gas tax refunds for non-highway activities should continue receiving their same share of funding during the transitional period to RUC.

The adopted recommendations in large part came from the list of preliminary recommendations shared with you in October in which the WSTC sought your input. Over 2,000 people provided comments and all of those were shared with the WSTC in advance of their December 17 meeting for their review and consideration. Comments responding to the question posed generally aligned with concerns and questions that have been expressed throughout the pilot project including transitioning to a road usage charge (RUC), privacy concerns, equity and fairness, compliance and administration costs and vehicles subject to a RUC. At the core of the adopted recommendations, the Legislature

NAAA 2019 Auto Auction of the Year for Excellence in Community Service

our years ago DAA Northwest made a long-term commitment to Sunset Elementary when the auction “adopted” the school located just two miles from its Spokane, Washington, site as a way to help the underprivileged students and overstretched staff.

More than 200 auction employees volunteered to participate in a payroll deduction plan to provide healthy weekend snacks for the students through the “Bite2Go” program, with a company match for all contributions. The auction purchased a van employees use every Friday to deliver an average of 150 Bite2Go packages that other staff volunteers made at Second Harvest Food Bank.

In addition, staff members donate their time to Prime- Time Mentoring, an accredited mentoring program, where they spend lunch hours once a week with students and have purchased items like board games, yo-yos and craft projects to do with the children.

They also regularly take lunch and home-baked treats to the school staff as a thank you for their dedication to education.

“Once a week the DAA team is there, spending time one-on-one doing activities with these students, but most importantly, they’re listening to what the child has to say and providing them with the encouragement to do better,” notes Chuck Teegarden, executive director of Spokane County’s Communities in Schools program.

DAA Northwest’s ongoing service to the school, along with its other fundraising and volunteer efforts to address domestic violence, abuse, homelessness, hunger, and other issues afflicting the children of a historically impoverished community earned it NAAA’s “2019 Auction of the Year Award for Excellence in Community Service.”

The auction was one of four finalists representing NAAA’s Eastern, Midwest, Southern and Western chapters competing for the top honor. Before the winner was revealed at the annual convention last October, each of the contenders was presented with a crystal trophy and $5,000 payable to a charity of the auction’s choice. DAA Northwest received an additional $20,000 for its chosen charity.

Sunset Elementary isn’t the auction’s only focus. Every November in conjunction with DAA’s annual Anniversary Sale it hosts a dinner and fundraiser auction that has contributed a total of more than $1.8 million to various local nonprofits, including the Vanessa Behan Crisis Nursery and Union Gospel Mission. In addition to the items sold to the dealers and guests, DAA produces specially embroidered caps that are given away for a $50 donation, with 100 percent of the proceeds going to the featured charities.

During the past year, the auction has made contributions to the American Cancer Society, Adult & Teen Challenge, YMCA, Young Life, Spring of Hope International, Spokane River Forum, Northwest Harvest, Meals on Wheels, Boys & Girls Clubs of America, Joya Child and Family Development, The Gee Foundation, Community Cancer Fund and school athletic programs.

“It doesn’t take much to read in the New Testament what we’re called to do, for the widows, the orphans, and all those who can’t stand on their own we’re called to help them and that’s what drives us,” explains Bob McConkey, president and chief executive officer of the McConkey Auction Group, which includes DAA Northwest. “First there comes an awareness there’s a need and when we become less selfish it gives everyone throughout the ranks here a sense that they’re actually doing pretty good in their lives and are in a position to help their neighbors who are downtrodden and destitute.”
