The Constitution Vs. The Commander-In-Chief: The Duty To Disobey Unlawful Orders By John & Nisha Whitehead
Every military service-member’s oath is a pledge to defend the Constitution against all enemies, foreign and domestic. It is not an oath to a politician. It is not an oath to a party. And it is not an oath to the police state. Yet what happens when those same men and women are being told—by their own government—that obedience to power and loyalty to a political leader come before allegiance to the Constitution they swore to uphold? That question isn’t hypothetical. It is the moral line now being tested in real time, and it goes to the heart of what kind of country we are: do we live in a constitutional republic governed by the rule of law, or in a militarized police state where “legality” is whatever the person with the most power and the biggest army say it is? The answer becomes painfully clear when you look at what our troops are being ordered to do— and what “we the people” are tacitly allowing them to be ordered to do—in the so-called name of national security. It’s legally dubious enough that the military is being used to enforce immigration crackdowns and police protests in American cities. But now they’re being tasked with killing civilians far from any declared battlefield in the absence of an imminent threat—all while being told that questioning the legality of those missions is itself a form of disloyalty. So, which is it: obedience to the Constitution or the Commander-in-Chief? At the center of this latest maelstrom is a report that Defense Secretary Pete Hegseth issued a verbal order to “kill everybody” on a maritime vessel in the Caribbean that was suspected of transporting drugs. According to multiple accounts, after an initial “lethal, kinetic” strike disabled the vessel and killed nine men on board, a second strike was carried out to kill two survivors clinging to the wreckage—an alleged “double tap strike” that legal experts warn could constitute murder or a war crime if the survivors no longer posed a threat. Intentionally killing survivors clinging to the remains of a boat in the middle of the ocean, in the absence of an imminent threat, whether or not the U.S. is engaged in “armed conflict” with drug cartels, is unlawful. Not surprisingly, the Trump Administration has done an about-face. Suddenly, the White House— which had been gleefully chestthumping over its power to kill extrajudicially—is signaling its willingness to scapegoat subordinates in the chain of command. Here’s the problem, though. While the media fixates on who will bear the blame for ordering the double-tap strike, the government war machine is moving forward, full steam ahead. The September 2nd boat strike was part of a broader Trump Administration campaign of maritime attacks that has already killed at least 80 people at sea, all
without a formal declaration of war or due process—evidence of who they were or what they had done—to warrant an extrajudicial execution. This is yet another of Trump’s everywhere, endless wars—this time at sea—sold as toughness on “narcoterrorists” at a moment when his poll numbers are slipping, economic promises have failed to manifest, and new Epstein-
without just cause and without congressional authorization. The legal landscape is not murky—it is clear. Three bodies of law converge here: the Constitution’s allocation of war powers, the international law of armed conflict, and the Uniform Code of Military Justice. First, there has been no declaration of war by Congress. Under the Constitution,
related revelations continue to surface. When presidents manufacture new fronts in a forever war whenever they need a distraction, we should all beware. The Trump Administration has tried to frame this preemptive maritime war on suspected “narco-terrorists” as a “noninternational armed conflict” with designated terrorist organizations. Yet what it amounts to is an undeclared war, launched in international waters,
only Congress can declare war. The president cannot start wars based solely on his own authority. Second, the law of armed conflict and the law of the sea forbid killing shipwrecked survivors who pose no immediate threat. Third, the Uniform Code of Military Justice requires every service-member to refuse manifestly unlawful orders. A command to “kill everybody” is
precisely the kind of order these guardrails were written to forbid. Every military recruit is supposed to learn in basic training that there is a duty to obey lawful orders, and an equal duty to disobey manifestly unlawful orders. No president—Republican or Democrat—can override that principle. The Commander-in-Chief may issue orders, but he does not get to erase the Constitution or rewrite the laws of war by fiat. The White House rationale— that a preemptive “kill everybody” attack “was conducted in selfdefense to protect U.S. interests”—should terrify every American. If the government can redefine “self-defense” to justify killing incapacitated survivors on a sinking boat, then it can justify killing anyone—at home or abroad, in uniform or out of it. The danger becomes even clearer when you examine the rhetoric now shaping national policy. Now Trump wants to launch land attacks on Venezuela, a country that is conveniently richer in oil reserves than Iraq—all in the so-called name of fighting the war on drugs. Meanwhile, Trump just issued a presidential pardon to Juan Orlando Hernandez, the former President of Honduras, who had been sentenced to 45 years in prison for conspiring with drug traffickers to move cocaine into the U.S. So the president is blowing up boats in the Caribbean he claims—without proof—are ferrying drugs all the while pardoning someone who was convicted of conspiring to transport hundreds of tons of cocaine into the U.S. This corrupt double standard has become business as usual for the Trump Administration. Yet conscripting the military to do the dirty work of the police state—and then throwing them under the bus for doing so—takes us into even darker territory. The U.S. government’s weaponization of the armed forces for political power is a betrayal of the Constitution, but it is also a betrayal of the very men and women who swore to give their lives for it. This has never been about public safety. As I make clear in my book Battlefield America: The War on the American People and in its fictional counterpart The Erik Blair Diaries, this has always been about power—who wields it, who is protected by it, and who is crushed under it. This betrayal of those who swore an oath to the Constitution is not an accident—it is a warning. Be warned. Representative Johanna Lopez And Senator Mack Bernard File Legislation To End Corporal Punishment In Florida’s Public Schools Representative Johanna Lopez (DOrlando) and Senator Mack Bernard (DWest Palm Beach) have filed House Bill 109 and Senate Bill 662, to prohibit the use of corporal punishment in Florida’s public schools. The legislation seeks to modernize the state’s approach to student discipline and ensure that all students, regardless of background, ability, or ZIP code, learn in a safe and supportive environment. Florida is one of 17 states that still allow corporal punishment in public schools, a practice defined in law as the “moderate use of physical force or physical contact” to enforce school rules. Although once common nationwide, school corporal punishment has fallen sharply out of favor as research increasingly shows it is ineffective, counterproductive, and potentially harmful. Despite this, 19 school districts in Florida still authorize it, and in the 2023–2024 school year, the Florida Department of Education
recorded 516 incidents. Additional records show that the vast majority of these incidents, 84% between 2018 and 2022, stemmed from minor or subjective behaviors such as “inappropriate language” or classroom disruption, rather than violence or danger. Many of the same students are punished repeatedly, reinforcing long-term negative outcomes rather than improving conduct. Students with disabilities experience corporal punishment at disproportionately high rates. During the 2023–2024 school year, roughly 40% of all reported instances involved students covered under IDEA or the Rehabilitation Act, despite these students making up roughly 20–22% of their districts’ populations. Decades of research show that corporal punishment is associated with lower academic achievement, higher absenteeism, increased dropout rates, and greater risk of Mental Health challenges. Studies have also linked physical punishment to
atypical brain functioning similar to the effects of more severe trauma. Meanwhile, some school districts that have eliminated corporal punishment have not experienced increases in Behavioral Issues. Evidence-based alternatives, including restorative practices and positive behavioral interventions, have proven far more effective at improving student outcomes. Moreover, corporal punishment is prohibited in settings such as prisons and the military due to its potential for abuse and its failure to support rehabilitation or positive behavioral change. “As a former educator and as a mother, I know firsthand that violence has no place in our classrooms. This bill is about protecting our children’s dignity, their safety, and their right to learn without fear. Corporal punishment is not discipline; it is harm. Florida’s students deserve support, guidance, and evidence-based practices that help them thrive, not methods that traumatize them. With this bill, we take a
stand for compassion, for modern education, and for every child’s future,” said Representative Lopez. “The use of corporal punishment is inconsistent with the school’s goals of promoting honesty, responsibility, and self-discipline. Studies show a significant relationship between corporal punishment as a child and future violent behavior. Violence begets violence,” said Senator Bernard. HB 109 and SB 662 remove all statutory language in Sections 1002.20, 1003.32, 1006.07, and 1012.28 Florida Statutes, that authorizes corporal punishment, and prohibits its use in public schools statewide beginning July 1, 2026. The legislation brings Florida in line with a growing number of states which have adopted bipartisan reforms to protect students, particularly students with disabilities. If enacted, these bills would take effect on July 1, 2026.

Flooring throughout features Mediterranean-inspired tiles, while rich natural finishes—lime-wash walls, warm wood, and natural stonework—evoke the Cote d’Azur’s coastal villages. Truly stealing the show was the Lobster Spaghetti, featuring one and a quarter pounds of Maine lobster bathed in a creamy bisque sauce with just the right touch of spice—a dish that epitomizes CLAUDIE’s fusion of luxury, showmanship and approachability. Guardian Angel Drone Pilot Program Launches In Three Florida School Districts It’s the Florida Department of Education’s mission to support districts in providing a safe learning environment for students and educators. (Credit: https:// www.fldoe.org/safe-schools/) Recently, Commissioner Anastasios Kamoutsas announced that three school districts, Broward, Leon and Volusia, will participate in the new Campus Guardian Angel Pilot Program, increasing the safety and security measures in these districts. The Campus Guardian Angel Program uses drones to distract active shooters while providing real-time audio and video feeds to guardians and Law Enforcement during potential threats on school campuses. The program will also be fully integrated with the Alyssa Alert platform in each participating district. “Ensuring students and teachers have a safe and secure learning environment is one of my top priorities as Commissioner. Florida remains the national leader in school safety because we continue to invest in solutions that protect students and support a rapid, coordinated response,” said Commissioner of Education Anastasios Kamoutsas. “The Guardian Angel Program is an important step in expanding the safety tools available to our districts. I thank Governor DeSantis for driving these efforts forward

Florida continues to lead the nation in school safety thanks to the efforts championed by Governor DeSantis to ensure every campus is better protected, including: • In 2019, House Bill 7030, required implementation of a standardized behavioral threat assessment instrument and ensured the expedited transfer of student records to support school safety continuity. • In 2020, House Bill 70 required all public schools to implement Alyssa’s Alert, a mobile panic alert system capable of real-time coordination with multiple first responders. • In 2021, House Bill 590 enhanced requirements related to involuntary examinations of students and guaranteed parents timely notification and access to safety data.
• In 2022, House Bill 1421 required the development of model family reunification plans, strengthened Law Enforcement involvement in active assailant drills and updated statewide emergency drill requirements. • In 2023, House Bill 543 created a statewide behavioral threat management system, updated SESIR reporting to ensure proper law enforcement notification and launched the Florida Safe Schools Canine Program for firearm detection dogs. • In 2024, House Bill 1473 expanded Guardian eligibility to former law enforcement officers, strengthened access control requirements for gates and doors and required clearly marked safe shelter areas within instructional spaces. • In 2025, Senate Bill 1470 enhanced Guardian certification, required additional reporting at the state and district level, established updated access control standards for instructional and common areas and required all substitute teachers to review safety protocols before beginning work. Consider using batteryoperated flameless candles whenever possible. If you do use real candles, keep them at least 12 inches away from anything that can burn and never leave them unattended. Always extinguish candles before leaving the room or going to sleep.

For people in recovery (or anyone choosing to skip alcohol), this time of year can bring unique challenges. Invitations pile up, expectations rise, and the pressure to “just have one” can feel relentless. But staying sober doesn’t mean missing out on the joy, connection, and celebration that makes the season special! As Community Outreach Coordinator at Virginia Recovery Centers, an alcohol and drug rehab in Virginia, I’ve seen firsthand just how attainable it is to enjoy holiday gatherings confidently and alcohol-free. All it takes is careful planning, self-awareness, and the right support. That said, below are practical, empowering strategies to help you navigate holiday events without compromising your sobriety. Know Your Triggers Before You Go Holiday gatherings can be emotionally charged, especially when family dynamics, long-standing traditions, or stressful environments are involved. Before accepting an invite, take a moment to reflect on which situations might make you feel vulnerable. Common triggers during the holidays can include being around heavy drinkers, feeling socially anxious, experiencing loneliness or nostalgia, navigating family conflict, and managing unstructured time at long events. Other common triggers are encountering certain people, places, or rituals tied to past drinking. Awareness of these triggers doesn’t eliminate challenges, but it can help you prepare for them. If a certain event has historically been difficult, consider skipping it this year or attending for a shorter amount of time. Protecting your sobriety is more important than maintaining appearances.

Choose Events That Support Your Sobriety You don’t have to attend every holiday gathering. If a party is centered around drinking, rowdy traditions, or people who don’t respect your boundaries, it may not be the best environment. So consider alternatives like sober holiday potlucks, morning or afternoon events instead of

Sobriety isn’t about restriction; it’s about freedom and allowing yourself to enjoy the holiday season with clarity and authenticity in a way alcohol simply cannot. Build New Holiday Traditions If drinking used to be a big part of your holiday celebrations, this is your chance to reinvent your traditions by focusing on what truly brings joy, meaning, and peace into your life. New sober-friendly traditions might include hosting a cookie-decorating night, starting a holiday movie marathon, crafting ornaments or decorating the tree. Or, you can take a winter hike or morning walk, attend a holiday concert or light show, prioritize self-care rituals on busy weekends, or create nightly gratitude lists throughout December. Traditions grounded in connection and creativity last far longer (and feel far more fulfilling) than any cocktail. Reward Yourself After the Event After the party, take time to acknowledge your accomplishment! Staying sober in a social setting (especially during the holidays) is something to be proud of. Reward yourself by treating yourself to a special dessert, watching a favorite show, taking a warm bath, writing in a gratitude journal, buying a small gift, or simply reflecting on how good it feels to stay committed. Celebrating these wins reinforces your progress and helps strengthen your sobriety.
Have a Plan and a Backup Plan Going into a holiday party with a strategy gives you control over the experience. Think ahead about how you’ll handle conversations, cravings, or unexpected pressure. For example, decide your arrival and departure time. Also, give yourself an “escape plan” so you’re not stuck if things get uncomfortable. It would also be wise to bring your own beverage. Whether it’s flavored sparkling water or a festive mocktail, having something in your hand often prevents people from offering drinks. Telling a trusted friend you’re attending sober can also be helpful, as you may feel more grounded and accountable if you know someone is aware of your intention. I also recommend planning a grounding activity before the event. A walk, meditation, journaling, or a call with a supportive friend can set a calm mindset. And remember that while having a plan is helpful, having a backup plan is essential. If you feel overwhelmed, you can always leave early, shift conversations, step outside for fresh air, or call someone from your support system.
