Understanding Immediate Relative Visas: IR-1/CR-1, IR-2 and IR-5 Visas By Mary Wilkowski

This article is Part 1 of a series on family-based immigration to the United States. Family-based visas provide one of the most meaningful paths to immigrate to the United States. U.S. citizens and lawful permanent residents, commonly known as green card holders, may be able to sponsor certain relatives for permanent residence. However, not every family relationship qualifies, and the rules governing eligibility can be surprisingly detailed. Immediate relative visas are generally available to the spouses, unmarried children under 21, and parents of U.S. citizens. These visas offer several important advantages, including the opportunity to obtain lawful permanent resident status without being subject to a visa backlog or waiting list. The immediate relative visa categories include: • The IR-1/CR-1 visa for spouses of U.S. citizens; • The IR-2 visa for under 21, unmarried children of U.S. citizens; and • The IR-5 visa for parents of U.S. citizens who are at least 21. Understanding the differences among these visa categories can help families better navigate the immigration process.

AUGUST 2026 • AVENTURA DIGEST • PG 2

What is an IR-1/CR-1 visa? The IR-1/CR-1 visa is available to the spouse of a U.S. citizen. In addition to receiving lawful permanent resident status, qualifying applicants may be eligible for work authorization and travel during the adjustment process, as well as an expedited path toward U.S. citizenship. To qualify, the marriage must be legally valid and bona fide. In other words, the couple must have entered into the marriage for legitimate reasons rather than to evade U.S. immigration laws. Immigration officers carefully review evi-

dence demonstrating that the marriage is genuine, such as documentation showing a shared residence, joint financial responsibilities, or children together. What is a conditional green card? If the couple has been married for less than two years when permanent residence is granted, the immigrant spouse will receive conditional resident status and a two-year conditional green card. Before that status expires, the conditional resident must file Form I-751 during the 90-day period preceding the expiration date. This filing requests the removal of the conditions and, if approved, allows the resident to obtain a 10-year green card. If the marriage remains intact, the individual may later apply for naturalization after three years. If the couple separates or divorces before that time, naturalization generally may be pursued after five years. Lawful permanent residents may also renew their green cards by filing Form I90 during the six months before expiration. What is an IR-2 visa? The IR-2 visa is designed for the unmarried child of a U.S. citizen. Like other immediate relative visas, the IR-2 category is not subject to a visa backlog or waiting list for lawful permanent resident status. In certain circumstances, an IR-2 visa may also result in the child’s automatic acquisition of U.S. citizenship. Who qualifies for an IR-2 visa? Eligibility depends on several factors. The child must be unmarried and under the age of 21, and the sponsoring parent must be a U.S. citizen. Additional requirements may apply depending on the family relationship. Adoption and stepparent relationships are also subject to specific eligibility rules.

Does an IR-2 child automatically become a U.S. citizen? If an IR-2 beneficiary is under the age of 18 and resides in the United States with the parent after admission, the child should automatically acquire U.S. citizenship. Children who do not automatically become citizens receive lawful permanent resident status and may apply for naturalization after five years. What is an IR-5 visa? The IR-5 visa allows a U.S. citizen who is at least 21 years old to sponsor a parent for lawful permanent residence. Like the other immediate relative visa categories, the IR-5 visa is not subject to annual visa backlogs. It also has no annual numerical limit, allowing qualified applicants to obtain lawful permanent resident status upon approval. Who qualifies for an IR-5 visa? To qualify, the petitioner must be at least 21, and there must be a valid parentchild relationship. Depending on the circumstances, that relationship may be biological, adoptive or through a stepparent. The required supporting documentation varies from case to case but may include: birth certificates, marriage certificates, divorce decrees, adoption records, death certificates, annulment decrees establishing the qualifying relationship, etc. Successful applicants receive a 10-year green card. They may apply for naturalization after five years or renew their green card before it expires. Immediate relative visa categories provide valuable opportunities for families to reunite in the United States. However, eligibility requirements differ depending on the relationship involved, and every case is different. Careful preparation and thorough documentation are important components of a successful application. Consulting an immigration attorney can help families understand the available options, identify potential complications

CITY NEWS Alzheimer’s Foundation Of America Launches Groundbreaking National Research Study On Dementia’s Impact On Spouses The Alzheimer’s Foundation of America (AFA) launched a groundbreaking national research study examining the impact caring for a spouse or partner with Dementia has on Physical and Mental Health, stress levels, brain function, social relationships, and overall quality of life. Individuals who provide(d) care for a spouse with Alzheimer’s Disease or another type of Dementia can learn more or participate in the free online survey by visiting: https://alzfdn.org/spousal-caregiving-study/ AFA’s study aims to gather crucial, evidence-based data directly from spousal caregivers about how Dementia caregiving affects them physically, emotionally, and socially over time. Findings will help guide future programs, resources, and policies to better support the millions of Americans caring for loved ones with Dementia. Despite the central role spousal caregivers play, their health outcomes remain under-studied and under-represented in research. Most Dementia research focuses on the person who is diagnosed. Far less data exists about the caregiver walking beside them — particularly spouses who are aging themselves, navigating emotional and health challenges while continuing to provide care. Filling this critical gap is essential to help drive change where caregivers need it most. More than 11 million Americans serve as caregivers to a loved one with living with Dementia, providing over 18 billion hours of unpaid care, according to the Centers for

Disease Control and Prevention (CDC). The demands of caregiving can have a significant impact on caregivers’ own health and well-being. “Spousal caregivers devote tremendous amounts of time, energy, and compassion to caring for their loved ones, sometimes at the expense of their own health,” said Charles J. Fuschillo, Jr., AFA’s President & CEO. “By participating in this study and sharing their experiences, caregivers will help provide crucial information needed to help improve support for families affected by Dementia.” “Our healthcare system has made remarkable advances in understanding Alzheimer’s Disease, but there is a lack of quantifiable, evidence-based data on what caregiving does to the spousal caregiver,” said Donna de Levante Raphael, Ph.D., AFA’s Director of Research and the study’s principal investigator. “This research will help generate the evidence needed to improve care and support for millions of caregiving families.” Eligible participants must: • Be 21 years of age or older. • Serve as the full-time primary caregiver for a spouse or partner living with Dementia. • Live in the United States. • Have access to the internet.

Participation consists of a confidential online survey that takes approximately 30 to 45 minutes to complete. There are no in-person visits or travel requirements. Families can learn more or participate in the free online survey by visiting: www.afacaregiversurvey.com. About Alzheimer’s Foundation of America (AFA): The Alzheimer’s Foundation of America is a NonProfit Organization whose mission is to provide support, services and education to individuals, families and caregivers affected by Alzheimer’s Disease and related Dementias nationwide and to fund research for better treatment and a cure. Fishing For Wishes RCASF Event Raises $220,000 To Help Make-A-Wish Improve The Lives Of Sick Kids And Families Four-year-old Beau Tripp may be too young to understand the community that has mobilized around him as he battles health issues, but the Roofing Contractors Association of South Florida (RCASF) has demonstrated they are squarely by his side. The NonProfit Organization recently hosted Tripp and his family at their 47th Annual Fishing Tournament in Islamorada, an event that raised $220,000 to help MakeA-Wish® Southern Florida grant life-changing wishes for critically-ill children. The Pembroke Pines resident, who recently underwent a kidney transplant, had his wish to visit Florida theme parks underwritten by CL Burks Construction, one of the many companies within the association committed to making a child’s dream come true by sponsoring their wish. To date, more than $2.3 Million has been raised by local roofing contractors through the partnership with Make-A-Wish Southern Florida. “The impact we’ve been able to have within our community from this event is a testament to the association and their sincere desire to improve the lives of children in South Florida,” said Corey Daley, Chairman of the RCASF fishing tournament. “Meeting the Tripp family, and hearing all they’ve gone through with Beau’s health, really reinforced how important the wish experience is and the role our fundraising plays in making it happen.” Much of the money RCASF raised during its three-day event at Cheeca Lodge was from signature sponsors that pledged to underwrite the cost of a wish. These donations from individual companies within the association began more than a decade ago when Earl and Lynne Johnston (Earl W. Johnston Roofing) made the first commitment. The number of those willing to help has grown each year, a fitting legacy for Earl Johnston, who passed away after the 2025 tournament. “It’s our mission to identify and grant a life-changing

Beau Tripp, Corey Daley, and Savannah Tripp wish for every critically-ill child in our territory,” said Norman Wedderburn, President & CEO of Make-A-Wish Southern Florida, which includes 22 Florida counties and the U.S. Virgin Islands. “The ongoing generosity of the Roofing Contractors Association of South Florida helps us make a difference for Beau and so many other deserving children.” In addition to Make-A-Wish, proceeds from the RCASF’s largest annual fundraiser also benefitted the International Game Fishing Association. About Make-A-Wish Southern Florida Make-A-Wish Southern Florida (www.wish.org/sfla) has granted more than 15,000 life-changing wishes since 1983 for children who have critical illnesses. It aims to grant a wish for every medically-eligible child in its territory and understands wishes aren’t just nice, they’re

Connor, Roxanna, Savannah and Beau Tripp necessary for kids and families at some of the most difficult times in their lives. Wish kids most often ‘wish to be’ (something), ‘wish to meet’ (someone), ‘wish to go’ (somewhere), ‘wish to have’ (something), or ‘wish to give’ (to a cause) and the NonProfit Organization makes this happen for the child and his/her entire family at no cost or obligation. Follow and engage with them on Facebook, X, Instagram, YouTube, LinkedIn, and TikTok. The Roofing Contractors Association of South Florida (www.rcasf.org) is a Not-For-Profit Trade Association whose purpose is to educate and foster a high standard of business ethics among roofing contractors and associate members. RCASF members endeavor to ‘give back’ to their community throughout the year by hosting several charitable events.

CITY NEWS Paper Cut By Andrew Rosendorf - A Dramatic Look At The Emotional Toll Of War Island City Stage, an award-winning South Florida theater company, is mounting a nationwide lead actor search for its 15th Anniversary Season production of Paper Cut by Andrew Rosendorf, a dramatic look at the emotional toll of war. The award-winning theater company is seeking male applicants, aged 25 – 40, of any ethnicity, who embody true authentic disability representation. Performers with lower limb amputations (left, right, or bilateral) are encouraged to apply for the role of Kyle, a Veteran dealing with the emotional cost of war long after the battlefield has been left behind. The show will run Thursday, March 11th, 2027 - Sunday, April 4th, 2027, with rehearsals from Tuesday, February 16th, 2027 Wednesday, March 10th, 2027. “Paper Cut is a powerful and intimate story about courage, love, and resilience that challenges perceptions of what it means to be a hero,” said Andy Rogow, Artistic Director for Island City Stage. “While this is not the first time that we have looked outside of our local area for actors and directors for specialty roles, it is the first production that requires an actor with a true physical disability. Authenticity is key. To best honor the playwright and his work, we are committed to finding the best and most genuine actor possible for this role.” After rehabbing at Walter Reed from injuries caused by an IED explosion, Kyle, now an amputee, finds himself navigating the personal and emotional minefield of returning home. Paper Cut is a raw exploration of the physical and emotional toll of our returning soldiers as well as the signature wound of the war in Afghanistan: the loss of limbs. And in Kyle’s case, far more. Kyle, an amputee (leg), is a 26-year-old male Afghan

war Veteran; rugged and attractive but weathered from major injuries and PTSD. He is gay, but not comfortably out, especially due to his military service. The role will

The FDA Is Moving Faster On Psychedelics By Peter J. Pitts

Nearly a quarter of U.S. adults suffer from a mental illness. Depression affects one in five adults -- a historic high. access. If approved, they would be prescribed by licensed clinicians, administered in controlled healthcare settings, and subject to the same high standards that govern any FDA-approved drug. There is plenty of precedent for this approach. A ketamine-derived medicine is legally available for certain patients with treatment-resistant depression -- but only in approved clinical settings. Once the FDA approves a psychedelic-based medicine, the Drug Enforcement

Administration must reschedule the substance before it can become available to patients -- another step in the process that should happen swiftly and in coordination with the FDA. None of this requires lowering scientific standards. It demands that regulators and researchers apply those standards without bias -- evaluating new medicines based on evidence, not assumptions. For too long, America’s mental health

system has forced patients to endure a trial-and-error treatment process that often leads nowhere. The FDA’s announcement offers a different way forward that takes the urgency of this crisis and the potential of new science seriously. Peter J. Pitts, a former FDA associate commissioner, is President of the Center for Medicine in the Public Interest. A version of this column was first published in the Washington Examiner.

AUGUST 2026 • AVENTURA DIGEST • PG 17

Every 11 minutes, an American dies by suicide. Millions more struggle to manage their mental health, cycling through medications, therapy, and hospital visits without finding relief. In April, the FDA took a decisive step toward addressing this prolonged health emergency. In response to President Trump’s recent executive order, the agency announced plans to expedite review of certain psychedelic medicines for serious mental health conditions. It’s about time. America’s mental health crisis condemns millions to daily suffering. The government should not let psychedelic medicines languish in regulatory limbo. Science-backed psychedelic treatments should be evaluated with the same urgency as other promising medicines. Nearly a quarter of U.S. adults suffer from a mental illness. Depression affects one in five adults -- a historic high. Today’s standard of care often falls short. Most widely prescribed medications rely on mechanisms developed decades ago and often take weeks to produce modest effects, if they work at all. At least 30% of patients with major depressive disorder don’t respond to multiple courses of antidepressant treatment. About half of patients receiving antidepressants reported being dissatisfied with the results. It is against this backdrop that a new class of treatments -- psychedelic compounds such as psilocybin -- has begun to attract serious scientific and regulatory attention. Once dismissed as fringe, researchers are now investigating these medicines in clinical trials under strict federal oversight. The FDA granted breakthrough therapy designation to several psilocybinbased treatments in 2018 and 2019. Today, there are more than 120 clinical trials underway. The New England Journal of Medicine recently published the results of the largest-ever clinical trial for psilocybinbased medicine. A single dose of the medicine led to a significant improvement in depressive symptoms in just three weeks. Skepticism is understandable. Psychedelics carry cultural baggage, and patients may have questions about safety. But the public debate around these compounds too often conflates recreational drug use with regulated medical use. The psilocybin medicines under review would not pave the way to casual

Complimentary beach amenities, bicycles for exploring the neighborhood, a fitness center, and thoughtfully designed communal spaces encourage travelers, from multigenerational families to business travelers passing through, to experience Miami Beach at their own pace, whether they’re visiting for business, leisure, or a little of both. Beyond overnight stays, Uma House has also become a destination for gatherings of all kinds. The property’s collection of flexible indoor and outdoor venues, including the expansive Sunrise Rooftop, the intimate Sunset Rooftop terrace, The Library, courtyard, and dedicated meeting room, creates distinctive settings for everything from corporate meetings and brand activations to mile-

stone celebrations. For groups who want some space to themselves, The Library, a secluded 10-room cluster in the Sunrise Building, is available for full buyout, making it a favorite for bachelorette weekends, wedding parties, and family reunions looking to celebrate in their own space. As part of Yurbban Hospitality Group’s Uma collection, the hotel is rooted in the philosophy that “there’s a stay for every journey.” At Uma House by Yurbban South Beach, that philosophy comes to life through thoughtful design, genuine hospitality, and two distinct towers that invite guests to experience Miami Beach from a fresh perspective. Whether drawn to the character of the Sunrise Tower, the contemporary comfort of the Sunset Tower, or simply the opportunity to experience South Beach at a slower pace, travelers will find a stay designed to feel as memorable as the destination itself.
