Kickbacks from contracts are nothing new. It’s done everywhere, all the time. It’s that small percentage padded somewhere in the contract, or the open drawer in the office. I’ve heard several people say that it’s a ‘given’ to keep the manager/ purchasing agent/ board member happy enough to secure the agreement and cement relationships for future business.

When it involves a commercial entity, just like product breakage or loss, it is considered the ‘cost of doing business’.

But, when it involves money that is taxed or assessed from the public, investors or condo owners, that is outright theft and according to condominium laws, is fraud.

In the past few months, we became aware of several of these fraudulent acts perpetrated right here in Aventura when management had their ‘hands in the till’ for tens of thousands of dollars. Owners were happy with him. The manager was doing a good job, had a great relationship with everyone, went above and beyond and stole.

“We sort of know these things go on,” says a condo owner in that building, “but it’s hard to prove unless you actually catch someone in the act. When it comes to the surface and you realize how much the owners are paying for kickbacks or padded contracts, it really hurts,” he added.

Florida has more than 47,000 condo and community associations that house approximately 9.5 million residents who pay maintenance fees to pay for common utilities, grounds and amenity maintenances, as well as association insurance.

Opportunistic individuals who have easy access to association funds are easily tempted to divert money into their own pockets. They know the angles and feel they would not get caught. Unfortunately, many do not.

In 2017, a former treasurer of a Boynton Beach homeowners association wrote $50,000 checks to himself from association funds and deposited them in three different banks. He got caught.

Same situation, same year, same amount in Bradenton.

A bookkeeper in a West Palm Beach homeowners association allegedly used the association’s credit cards to charge $95,000 in personal expenses.

A former treasurer of a Palm Beach Gardens homeowners association diverted association checks to a business she owned.

All got caught. Of course, this problem is not limited to Florida.

In May, the New York District Attorney

indicted three women for fraud in an alleged affordable housing scheme. Two co-op board members and an office manager allegedly falsified housing applications by claiming applicants were relatives of existing residents, which skipped a waiting list of 24,000 people. They are reported to have collected $875,000 in bribes. If convicted, the women face 15 years in prison and the applicants who submitted false information can also face charges.

In a different case of fraud here in Florida, the Department of Business and Professional regulation recently referred a case to the local police department of alleged ballot fraud in a condo’s 2019 election. Evidence was produced that two of its incumbent board members were reelected based upon forged signatures. In Florida, signature forgery is only a third degree felony and subject to fines up to $5,000 and as many as five years in jail, but suspicions prevail about how the condo money was being managed.

The owner of a property management company in South Carolina was sentenced to 2 1/2 years in jail and $770,000 in restitution to at least 19 condo associations for her conviction of wire fraud tied to fraudulent billing practices. Although the judge agreed that she probably would never be able to pay that amount, it does make one wonder where did the money go?

However, even when these criminals are caught, it can take years for the association to recover these lost funds.

SO, WHAT SHOULD WE DO? Close scrutiny over those who manage our money would be a good suggestion. But, these people obviously are unscrupulous and know all the angles.

Here are some ‘red flags’ to watch for, issued by the state: • Balances that exceed budgeted amounts • More than one payment to a one-time vendor • Vendor linked to a board member or employee by family name, address • Delayed bank deposits • Duplicate payments • Missing petty cash • Discrepancies in accountspayable or receivable • Suspicious ‘consulting fees’ • Services paid for, but not performed • Checks made out to ‘Cash’ • Copies of receipts other than the original

As for contracts, the full board should be responsible for the following: • Get three bids from reliable companies.

• Have several board members scrutinize why

they are different.

• Check product quality promised.

• Check references and previous jobs personally on-site.

• Have an attorney review the contract for protection in case of default.

• Make sure the association is covered by the mechanics lien law.

Then, scrutinize the job before any additional payments are made. Are the products the same as those listed in the contract? Is the workmanship and time scheduled as stated? Draws can be held if stated in the contract.

As for theft of funds, it should be the responsibility of several board members to review accounts payable at least once a month and question any irregular payout.

So, are kickbacks a given? Only if the board lets it slip by. Thorough oversight could pick it up.

New YMCA Open In Hallandale Beach

This month, a brand new Hallandale Beach YMCA Family Center opened at Bluesten Park as part of the City of Hallandale Beach’s complete renovation of the park. The Y will provide health and wellness programs and services for all ages.

The 40,000-square-foot facility will feature space for adult and family programming, and includes a pool, gymnasium, state-of-the-art fitness center with cardio and weight equipment, group exercise studios, indoor cycling studio, Teen Room, Afterschool Room, Kids Zone, Community Room, sports fields, and more.

Share the Road: Community Bike Event The City of Aventura and the Aventura Police Department will host Share the Road, a bike safety and ride event to promote safe cycling practices on Sunday, October 6, 2019, at 9:00 a.m. at Founders Park located at 3105 NE 190 Street.

What to Expect Various bike safety presentations will be provided and a limited number of helmets, bicycle lights, and water bottles will be distributed before the bike ride starts.

Participants will have an opportunity to interact with police and ask questions about bike safety, get helmets fitted, learn about basic bike maintenance, join a bike rodeo, enter to win prizes, and speak with representatives of the City’s bike-share program, Aventura B-Cycle.

Bicycle Helmets: Getting the Right Fit - Step 1: Size Don’t buy a helmet without trying it on for size. Make sure the helmet fits snugly.

While it is sitting flat on top of your head, make sure the helmet cannot move side to side. Sizing pads come with new helmets; use them if you need a more secure fit.

You can remove the extra pads if your child’s head grows. If the helmet has a universal fit ring instead of pads, adjust the ring size to fit snugly on your head.

Step 2: Position The helmet should sit LOW on your forehead. There should only be one or two finger-widths above your eyebrow. Your child should be able to look upward and see the front rim of your bicycle helmet on your own head.

Step 3: Side Straps The left and right side straps should form a “Y” and meet right below your ear.

The side straps may be easier to adjust if you take the helmet off your head. Roll the little rubber band as close to the side straps as possible to prevent slipping.

Step 4: Chin Strap (Buckle) Buckle the chin strap. Tighten the chin strap until it is snug. No more than one finger should be able to fit under the strap. Take a look at the first image at the top of the post to see how this should look.

Step 5: Final Check 1. Does the helmet fit right? Open your mouth really wide! The helmet should pull down on the head. If it does not, then refer to Step 4 and re-adjust the chin strap.

2. Is your helmet in the right position on your forehead? When looking up, you should be able to see the front of the helmet visor. If you can’t see it, unbuckle and tighten the side straps, retighten the chin strap and test again.

3. Does your helmet lean forward into your eyes? If so, unbuckle the helmet, readjust the side straps/chin strap and test again.

4. Does your helmet slip and move while you shake your head? You may need to apply the sizing pads for a more snug fit or readjust the universal fit ring if your helmet has one.

5. Roll the rubber band down to the buckle. All four straps must go through the rubber band and be close to the

buckle to prevent the buckle from possibly slipping.

Bike Ride Members of the Aventura Police Department will escort the community along a safe bike ride around Aventura at 10:00 a.m. Participants are encouraged to bring their own bikes for the ride. Riders should be able to ride a bike safely on the road.

In Safe Hands The Aventura International Film Series Kicks-Off The Aventura International Film Series begins a new season with In Safe Hands on Tuesday, October 15 at 7:30 p.m. at the Aventura Arts & Cultural Center.

The second feature film from actress-turned-filmmaker Jeanne Herry, the film throws the audience deep into the milieu of the French social assistance services where the fate of one baby boy exposes the conflicting conundrums faced by many women – those giving up their babies and those desperate to have their own.

The Hollywood Reporter says the film is “Intelligently observed and backed by a strong cast.” Not rated, this film from France is shown with English subtitles.

The Aventura International Film Series presented by the City of Aventura is hosted by Shelly Isaacs who introduces the film

and leads a post-screening discussion. Isaacs is founder, programmer and commentator for South Florida’s popular Café Cinematheque International programs. Isaacs holds a master’s degree in Media Ecology Studies from New York University, where he served as an adjunct professor in cultural studies. Presently, he teaches foreign-language film appreciation in the Lifelong Learning Society at Florida Atlantic University and at Florida International University. He is the film expert for Celebrity Cruise Lines during their annual voyage to the Cannes International Film Festival as well as on other scheduled film-related cruises throughout the world. LIFESTYLE Trump Admin Picks the Wrong Approach to Drug Price Reform

It’s been a rough summer for Americans battling chronic diseases.

The Trump administration scrapped a proposal that would have reformed the prescription drug supply chain and saved patients billions of dollars. Now, the administration is trying to impose price controls on drugs administered through Medicare.

The president had it right the first time. Price controls would cripple medical innovation, ultimately harming patients. It’d be far smarter for the administration to reform the opaque supply chain and cut patients’ out-ofpocket costs.

The shelved reform would have targeted Medicare’s Part D prescription drug benefit, which covers over 44 million seniors.

Though subsidized by the federal government, private insurers sell plans to beneficiaries, each featuring different monthly premiums, drugs, and coinsurance

at the pharmacy.

Insurers hire “pharmacy benefit managers” to administer Part D plans. PBMs negotiate with drug companies to decide which medications each plan will cover, and how much patients will pay.

PBMs extract discounts from manufacturers, who want their drugs covered by Part D plans. In 2018, companies offered $166 billion in discounts and rebates on their drugs. PBMs keep a portion of these rebates and pass the rest to insurers, who then reduce premiums by a few dollars for all beneficiaries.

That does little to help patients who rely on multiple drugs. These folks still owe copays or coinsurance -- a percentage of a drug’s total price -based on their drugs’ prediscounted “list” prices.

Say a cholesterol medication costs $100. A PBM might negotiate a 50 percent discount, allowing insurers to pay $50.

Since patients pay coinsurance based on list prices, not discounted prices, folks with 25percent coinsurance requirements still owe $25, rather than $12.50.

President Trump came close to fixing this system. His proposal would have forced insurers and PBMs to use their discounts and rebates to lower patients’ out-of-pocket costs. By one estimate, this would have saved Part D patients as much as $59.5 billion between 2020 and 2029.

Now that the administration has withdrawn the proposal, patients may never see those savings.

Worse, the administration’s plan to impose Medicare price controls could harm patients by impeding future drug innovation.

The proposal is meant to reduce spending in Medicare Part B, which covers drugs administered in doctors’ offices and hospitals. The plan would tie

the prices that Medicare pays for these drugs to the cheaper prices paid in other developed countries. Drugs are cheaper abroad because many countries use price controls.

Over time, this policy would undermine research into new drugs.

Pharmaceutical companies spend $2.6 billion, on average, developing each new drug.

Less than 12 percent of experimental medicines ever make it to market.

Researchers only fund these risky projects on the off-chance that a successful drug will recoup their investment and turn a profit.

But if the government sets artificially low drug prices, companies would have little hope of earning back their upfront costs. As a result, funding for research into new treatments for cancer, Alzheimer’s,

and other conditions will evaporate.

Let’s hope the president nixes his advisors’ proposal and strives

to slash out-of-pocket costs instead.
