REALTOR ACKNOWLEDGMENT AND CONSENT FORM REALTOR INCENTIVE PROGRAM Last Updated: April 17, 2026 As a licensed real estate professional in the State of Nevada, I acknowledge and consent to the following in connection with my participation in the Summerlin Realtor Pass Program (the “Program”): 1. I have received, read, and understood the Program’s Terms & Conditions.

2. I acknowledge that any incentive I may receive under the Program—including but not limited to gift cards or other items of value—is not tied to any specific real estate listing, purchase agreement, or completed transaction.

3. I understand and agree that I am responsible for complying with all applicable laws and regulations, including but not limited to Nevada Revised Statutes (NRS) Chapter 645, including NRS 645.254, which governs compensation from persons other than my client, in addition to any agreements with my sponsoring brokerage.

4. I understand that any incentive I receive under the Program must be disclosed to any client involved in a relevant transaction as required by law, including but not limited to NAC 645.640.

5. I represent and warrant that my participation in the Program will not violate any applicable real estate laws, including federal law (e.g., RESPA) and any restrictions on unlawful inducements.

6. I agree that participation in the Program constitutes my agreement to comply with these legal obligations and professional standards.

REALTOR PASS: TERMS & CONDITIONS Last Updated: April 17, 2026 Welcome to the Summerlin Realtor Pass (the “Program”). These Terms & Conditions (“Terms”) govern your enrollment in, access to, and participation in the Program and any events, activities, or promotions associated with it. By registering for or using the Program, you agree to be bound by these Terms, as well as the Summerlin.com Terms of Use and Privacy Policy, which are incorporated here by reference.

If you do not agree to these Terms, you may not participate in the Program.

1. Eligibility & Enrollment To enroll in the Program, you must be at least 18 years old and provide accurate and complete registration information. You are responsible for keeping your contact information up to date.

Single Account; No Combining of Accounts or Incentives. Each individual Realtor may maintain only one Program account. Accounts are personal, non-transferable, and may not be shared, sold, or assigned. If you register for the Program using multiple email addresses, phone numbers, license numbers, or other

identifiers, all such registrations will be treated as a single account associated with you. Program activity, check-ins, incentives, rewards, perks, gift cards, or other items of value may not be combined, aggregated, or “stacked” across multiple registrations or accounts. Incentives and other Program benefits are limited to one per person per qualifying event, visit, or promotion, regardless of the number of accounts or registrations you maintain.

Participation in the Program is voluntary. Howard Hughes Communities or its affiliates (“Company,” “we,” or “us”) reserve the right to accept, deny, suspend, or terminate any enrollment at any time.

2. Program Overview The Program is designed to enhance your engagement with Downtown Summerlin and the broader Summerlin community through: •

Special events

•

Fitness and wellness activities

•

Check-in–based promotions

•

Offers, perks, and experience-based rewards

Program offerings may change from time to time and are provided at Company’s discretion.

3. Check-In, Participation Tracking & Data Use By enrolling in the Program, you acknowledge and agree that: •

The Program may include “check-in” requirements to verify attendance or participation.

•

Your participation activity (e.g., event attendance, check-ins, reward usage) may be collected and used to administer Program features.

•

Program communications may be sent to you via email, app notification, or SMS (if you separately opt in to SMS messaging).

All data collected through the Program is handled in accordance with the Summerlin.com Privacy Policy.

4. Image, Likeness & Media Release By attending or participating in any Program-related event or activity, you grant Company the irrevocable right to: •

Photograph, record, or otherwise capture your image, likeness, voice, or performance;

Use, reproduce, publish, display, distribute, and create derivative works from such materials in any media now known or later developed;

•

Use such materials for lawful marketing, promotional, or informational purposes, without compensation to you.

You waive any right to inspect, approve, or claim ownership of such materials and release Company from all claims related to their use.

5. Assumption of Risk & Release of Liability Participation in Program activities, especially wellness, fitness, outdoor, or community events, may involve inherent risks, including but not limited to: •

Physical exertion

•

Weather conditions

•

Uneven surfaces

•

Crowds or other participants

•

Unforeseen hazards

By participating in any Program event, you acknowledge and agree that: 1. You voluntarily assume all risks, whether known or unknown, associated with participating in Program activities.

2. To the fullest extent permitted by law, you release and waive all claims against Company, its parents, subsidiaries, affiliates, officers, directors, employees, and agents for any injury, accident, loss, damage, or liability arising from or related to your participation.

3. This waiver does not apply where prohibited by law.

6. Program Communications Program participants may receive communications related to: •

Event reminders

•

Check-in confirmations

•

Perks, offers, and promotions

•

Realtor Pass updates

If you separately opt in to SMS messaging, such messages will be governed by the Summerlin SMS Terms & Conditions.

You may opt out of marketing emails at any time by using the unsubscribe link provided in each message.

7. Changes to the Program We may update, modify, or discontinue the Program, or any part of it, at any time at our sole discretion.

Changes will be effective upon posting to Summerlin.com.

Continued participation after changes means you accept the updated Terms.

8. Termination We may suspend or terminate your access to the Program at any time, including for: •

Violations of these Terms

•

Fraudulent or abusive activity (including creating, using, or attempting to use multiple accounts to obtain duplicative or additional incentives, rewards, gift cards, or other Program benefits);

•

Misuse of Program features

•

Conduct harmful to other participants or to Company

Upon termination, all benefits and eligibility under the Program may be forfeited.

9. No Compensation or Guarantees Participation in the Program does not guarantee any reward, perk, or benefit. All Program offerings are discretionary and subject to availability.

Company does not provide compensation for cancelled events, withdrawn offers, or program modifications.

10. Governing Law These Terms shall be governed by the laws of the State of Nevada, without regard to conflict-of-law principles.

11. Binding Arbitration; Class Action Waiver Binding Arbitration. To the fullest extent permitted by law, you and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Program, your participation in any Program-related activities, or your use of the Website (collectively, “Claims”) shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, except that this arbitration requirement does not apply to claims filed in small-claims court.

Location and Procedure. Arbitration shall take place in Clark County, Nevada, unless the parties mutually agree otherwise, and may be conducted by telephone or video conference when appropriate.

No Class Actions. You and the Company agree that arbitration shall be conducted only on an individual basis, and not as a class, collective, representative, or private attorney general action. The arbitrator may not consolidate the claims of multiple individuals.

Governing Law. The arbitrator shall apply the laws of the State of Nevada (for the Realtor Pass Terms) or Texas (for Website Terms), without regard to conflict-of-law rules.

Exception: Injunctive Relief. Either party may seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect its rights pending arbitration.

Waiver of Jury Trial. By agreeing to arbitration, you and the Company waive any right to a trial by jury.

12. Entire Agreement These Terms, along with the Summerlin.com Terms of Use, Privacy Policy, and any event-specific notices provided at sign-up, constitute the entire agreement regarding the Program.
