At Sugarfina USA LLC. we want to help ensure our consumers are informed and can fully enjoy the delicious sweets we have brought from all over to them. One of the ways we are doing this is by updating our language used for marking product shelf life/acceptability to the phrase “Best If Used By”. Our operations team will begin using this phrase abbreviated as “BIUB” on product starting February 1, 2020 – product that was packaged before that date will have the previous language of Best By. The full code on products starting February 1st will follow the format below:
BIUB: DD/MMM/YYYY Lot code JD2
Where DD = 2-digit day, MMM = 3-letter month, YYYY = 4-digit year
To give a little background behind this decision - in May 2019, the FDA determined that minimizing the type of language used for date coding would reduce food waste caused by confusion around acceptability of food. Consumer surveys done before this time had found that there was lack of clarity for how long product was good to consume as there were too many phrases before date codes – sell by, display until, enjoy by, use by, best by, etc. The FDA recommended at this time that the industry limit the communication to only 2 phrases for clear date coding:
Best If Used By (BIUB) – for items that may not taste or perform as expected after that date but are safe to eat – OUR PRODUCTS
Or Use By (UB) – for perishable products that should be consumed by that date or disposed of – i.e. raw meat, salad mixes, etc.
Currently our product uses the phrase “Best By”. Sugarfina has decided to follow the FDA’s recommendation, as mentioned above, starting February 1st any product coded on or after that date use the new language of “BIUB”. For any Sugarfina products which Customer intends to market or sell in California, Customer must comply with the Safe Drinking Water and Toxic Enforcement Act of 1986 (otherwise known as “Prop 65”) warning requirements. If Sugarfina products are sold via e-commerce, Customer must ensure that purchasing webpages for the Sugarfina products contain a warning notice in compliance with the requirements of Prop 65. If Sugarfina products are sold in any retail establishment in California, Customer must have appropriate signage at point of purchase through either the recommended : a) purchase Prop 65 compliant labeling from Sugarfina at an added premium of $0.05 per item, or b) ensure that Sugarfina products made available for sale in any retail establishment are at all times accompanied by a Prop 65 compliant warning notice in the form of an appropriate warning on the product display i.e. ‘shelf talker’.
