Oca to opposition: Step down if I win recall polls By Cheng Ordoñez, Associate Editor

Beleaguered Cagayan de Oro City Mayor Oscar S. Moreno has challenged the members of the Majority Block in the City Council to step down should he wins in the Recall Election filed by petitioners with the Commission on Elections last Thursday, July 3. Organizers of the recall petition against Mayor Moreno claimed to have gathered more that 80,000 signatures, calling for the poll measure. Prior to the submission of the petition for recall to the Comelec office last Thursday, a rally was held and attended by members of the city council’s Majority block who were supporting the petition and critics of Moreno’s administration. Moreno said he will face the challenge of the recall election squarely, but said the majority block -- starting from Vice Mayor Caezar Ian Acenas down to his councilor-colleagues who are supporting the petition -- must step down should he wins in the recall election against former mayor Vicente “Dongkoy” Emano. Mayor Moreno branded this as a “win-all” challenge to pave the way for a smooth run of the city government after the recall election -- that is, if he wins the polls. The Emano camp branded Moreno’s challenge as “gabinata” or a childish challenge and without legal basis. Surprisingly, one of the lead petitioners in the recall election carries the name of “Oscar M. Moreno Gaabucayan” of the rural-urban poor sector. Political analysts said petitioner Oscar M. Moreno Gaabucayan could be among those who will run for mayor purportedly for an intended purpose if the poll pushes through.

COUNCILOR Annie Y. Daba, chair of the City Council committee on agriculture and fisheries, reminds all food establishments to include one-half cup serving of rice in their menu with the corresponding one-half price as an option for public customers. This is mandated in Ordinance No. 126885-2013,

due to southwest monsoon which is enhanced by typhoon “Florita.” In an interview, PAGASA weather forecaster Glaiza Escullar said that as of 6 a.m., the eye of typhoon “Florita” is located 650 km east northeast of Aparri, Cagayan (20.3ºN, 128.4ºE) with maximum sustained winds of 185 kph and gustiness of up to 220 kph. It is forecast to move northwest at 24 kph. She added the typhoon is not expected to make a landfall in any part of the country. With its speed and movement, Escullar said the typhoon expected to be out of Philippine Area of Responsibility (PAR) by Tuesday as it headed towards Okinawa, Japan. Escullar also said typhoon Florita has no direct affect but will continue to enhance the southwest monsoon or “hanging habagat” that will induce monsoon rains over the parts of Metro Manila, Western Visayas, Mimaropa (Mindoro, Marinduque, Romblon and Palawan) and the provinces of Zambales, Bataan, Cavite, Laguna and Batangas. She added the rest of Luzon and of Visayas will experience occasional rains while Mindanao will be partly cloudy to cloudy with isolated rainshowers due to localized thunderstorms. PAGASA said moderate to strong winds blowing from the southwest will prevail over the country and the coastal waters will be moderate to rough. PAGASA also issued gale warning as strong to gale force winds associated with surge of southwest monsoon enhanced by typhoon “Florita” is expected to affect the Eastern seaboard of Luzon and seaboards Visayas. “Fishing boats and other small sea crafts are advised not to venture out into the sea while larger sea vessels are alerted against big waves,” it said. Large hectares of still undistributed land shows failure of CARP AS the five-year extension of the Comprehensive Agrarian Reform Program (CARP) expires today, research group IBON says its failure is affirmed by the remaining thousands of hectares of Spanish-time haciendas, as well as up to a million hectares being devoted to commercial agriculture ventures. After 25 years, the group noted that under the extended CARP, land acquisition and distribution (LAD) balance was

still big at 890,671 hectares, a huge part of which are private agricultural lands. Some of these undistributed large landholdings include sugar blocks such as the 6,000-hectare Aquino-Cojuangco-owned Hacienda Luisita and the 7,183-hectare Hacienda Roxas in Batangas, the 16,000-hectare Hacienda Reyes in Quezon, as well as other coconut haciendas owned by the Tans, Uys, and Cojuangcos measuring more than 5,000 hectares. Mostly owned by the

country’s wealthiest families, joint ventures, sugar block farms and coconut haciendas comprise almost half a million hectares supposedly targeted for compulsary acquisition (CA) but have not been issued notices of coverage (NOC) by the Department of Agrarian Reform (DAR). DAR-10 turns over 2 FMR to Lanao Norte LGUs CAGAYAN DE ORO -More agricultural development is expected to happen in the remote barangays of Kulasihan, San Roque and Palao following the completion of the 7.583 km. Kulasihan-Palao farm-tomarket road costing P32.1M in Kalambuan agrarian reform community (ARC) in Kolambugan, Lanao del Norte. The same scenario is also expected in RAKIM ARC, barangay Ramain, municipality of Sultan Naga Dimaporo with the turnover of the 2.2 km. junction national highway to Sitio Langgoyo Ramain road with project cost of P2.2M. Umbao said a manhunt operation has been launched, even as he said that they are working 24/7 to give justice to the Okinlay family. Hundreds of peace advocates joined Impasugong town employees and supporters of slain mayor Mario Okinlay in an indignation rally Monday morning, calling for swift justice for the death of the local executive. Mayor Okinlay was killed in an ambush while his convoy was on its way home from conducting a medical mission in one of the remote villages of Impasug-ong last July 2. He was declared dead on arrival at the Malaybalay Polytechnic General Hospital few hours after the ambush. The New People’s Army has claimed responsibility over Mayor Okinlay’s death. A sniper’s bullet fired by NPA team of the SouthCentral Bukidnon SubRegional Command killed Mayor Mario T. Okinlay of Impasug-ong, Bukidnon, the NPA statement released on Saturday claimed. Allan Juanito, signatory of the statement who claims to be an NPA spokesperson of the North Central Mindanao Region, said Okinlay was killed for allegedly leading a sustained anti-insurgency campaign in Impasug-ong since 2006. Juanito claims the NPA has received numerous complaints on Okinlay’s alleged sins committed against residents of Impasug-ong and the revolutionar y movement in Bukidnon since 2006. Department of Political Science College of Arts and Sciences Western Mindanao State University I. What is the essence of Comprehensive Agreement on the Bangsamoro ( CAB)? The CAB is simply the summation, consolidation, and the affirmation of the understanding and commitment about the various agreements between the Government of the Philippines (GPH) and the Moro Islamic Liberation Front (MILF) as the parties. Also, inter alia, CAB “ is the recognition of the justness and legitimacy of the cause of the Bangsamoro people and their aspiration to chart their political future through a democratic process that will secure their identity and posterity and allow for meaningful self-governance.” The following are the various appended agreements between the GPH and the MILF which are considered as integral parts of the CAB: 1. “Agreement for the General Cessation of Hostilities signed on 18 July 1997 in Cagayan de Oro City, Philippines”; 2. “General Framework of Agreement of Intent between the GPH and MILF signed on 27 August 1998 in Sultan Kudarat, Maguindanao, Philippines”; 3. “Agreement on the General Framework on the resumption of Peace talks signed on 24 March 2001 in Kuala Lumpur, Malaysia”; 4. “Agreement on Peace between the GPH and MILF signed on 22 June 2001 in Tripoli, Libya”; 5. “Declaration of Continuity for Peace Negotiations between the GPH and MILF signed on 3 June 2010 in Kuala Lumpur, Malaysia”; 6. “GPH-MILF Decision Points on Principles as of April 2012 signed on 24 April 2012 in Kuala Lumpur, Malaysia”; 7. “Framework agreement on the Bangsamoro initialed on 12 October 2012 in Kuala Lumpur, Malaysia and signed on 15 October 2012 in Manila, Philippines”; 8. “Annex on Transitional Arrangements and Modalities signed on June 27 February 2013 in Kuala Lumpur, Malaysia”; 9. “Annex on revenue Generation and wealth Sharing signed on 13 July 2013 in Kuala Lumpur, Malaysia”; 10. “Annex on power Sharing signed on 8 October 2013 in Kuala Lumpur, Malaysia”; 11. “Annex on Normalization signed on 25 January 2014 in Kuala Lumpur, Malaysia”; 12. “Addendum on the Bangsamoro Waters and Zones of Joint Cooperation signed on 25 January 2014 in Kuala

Lumpur, Malaysia”; and additionally to the CAB, 13. “Are the various agreements, guidelines, terms of reference, and joint statements duly signed and acknowledged by the parties in the course of the negotiations between the two parties beginning in 1997.” II. The Bangsamoro Transition Commission ( BTC) The BTC which is tasked to draft the Bangsamoro Basic Law (BBL) is composed of fifteen members; seven shall be selected by the GPH and eight by the MILF. It was created by virtue of the Executive Order No.120 issued by President Aquino on December 17, 2012. What is puzzling is why did the President issue said Executive Order No.120 which is only mandated by a mere agreement? IS AN AGREEMENT LIKE THE CAB BE HIGHER THAN THE CONSTITUTION? It must be emphasized, what is constitutionally mandated by virtue of Section 18, Article 10 of the Constitution is the creation of the Regional Consultative Commission (RCC), composed of representatives from Multi-sectoral bodies. III. The Ultimate Consequence of the BBL as mandated by the CAB. The moment the BBL is enacted into law by Congress and will be ratified in a plebiscite by the Bangsamoro people in the core territories, the present Autonomous Region in Muslim Mindanao (ARMM) Regional Government will be abolished to be replaced and governed by the Bangsamoro Transition Authority (BTA) for the interim period and by 2016 regular elective officials will be elected under the typology of the so-called Ministerial Bangsamoro government. Is Ministerial government not inconsistent with our Presidential system of government and the provisions on Local Government, particularly Section 1, Article X of the Constitution? IV. Can the draft BBL by the BTC as mandated by the CAB be enacted into law by Congress without being repugnant to the Constitution? The answer is a resounding NO! It is noteworthy to paraphrase Constitutionalist and former Constitutional Commission member Fr. Joaquin G. Bernas SJ, what he said in his book while it is true that as long as the substantive and procedural limitations found in the constitution are observed, the Congress may legislate on any subject matter. In other words, the legislative power of Congress is plenary but nevertheless, THE POWER OF ANY LEGISLATURE CAN BE LIMITED ONLY BY THE CONSTITUTION. Hence, Section 18, Article 10 of the Constitution is self-explanatory. Sales from these fairs however, were minimal considering the cost of participation from registration to booth management. But this did not discourage Engr. Judith Luis, the business development coordinator of the Municipality of San Fernando to continue promoting the products as Engr. Luis was always h o p e f u l t h at t h e S a n Fernando handicraft products will find its way to a bigger market. During the 1st Mindanao Social Business Summit (MSBS) conducted last June 4-6, 2014 at the Farmers Training Center, CMU-Musuan, Maramag, Bukidnon, the province’s products were showcased through the trade fair which was conducted as a side activity of the summit. The trade fair was conducted to provide an avenue for Micro Small and Medium Enterprises to promote

their products and generate sales. Seventeen DTI-assisted micro small and medium enterprises (MSMEs) participated in the trade fair under the “Bukidnon’s Bounty” booths for food and craft. During the threeday fair the “Bukidnon’s Bounty” booth for crafts and foods generated a total sale of P75,885 with the bamboo products from San Fernando, which generated a total sales of P21,890, garnering the top post. DTI strengthens monitoring of prices of basic commodities D AVA O C i t y - T h e Department of Trade and Industry (DTI) here has strengthened its price monitoring to protect consumer’s rights with the installation of price billboards in 40 public markets this year. These products are the result of the creativity of the producers and the skills training conducted for the bamboo handicraft makers from more than eight barangays of the municipality that started last quarter of 2011 up to 1st quarter of 2012 and the follow through p r o d u c t d e v e l o p m e nt activities. Engr. Luis said in the vernacular “Bulk of the sales was generated by the miniature bamboo bikes and lampshades.” These products also, she said, are constantly ordered by bulk buyers and souvenir companies in nearby areas. Generally, success for

trade fair participation is measured by the number of visitors in an exhibitor’s booth, number of inquiries and amount of outright, booked and under negotiation sales. Total sales generated from a fair participation should, at least, be P25.00 per peso cost of participation. The P21,890 sales of San Fernando’s bamboo products during the 1st Mindanao social Business Summit Product Exhibit may b e w ay b el ow t he targeted sales had it paid for its participation. But since the participation fee was shouldered by the Local Government of San Fernando which has been supporting the project since it started, the amount of sales generated from the product exhibit is already remarkable. The never ending support of the San Fernando LGU for its “Gawang Kamay San Fernando” handicrafts from skills training, p r o d u c t d e v e l o p m e nt up to promotion is very laudable. With the continuing support from the LGU, other business s e r v i c e prov i d e rs and the perseverance of the municipality’s handicraft makers, more milestones can be expected to come. Zamboanga war refugees still languishing in shelters

AMBOANGA CITY – A Filipino lawmaker Carlos Zarate called on the Aquino administration to seriously reassess its priorities and address immediately the appalling humanitarian condition of the more than 100,000 war refugees who are in different shelters in Zamboanga City. The refugees were displaced by three weeks of fighting in September last year between Moro National Liberation Front rebels and security forces. The fighting killed and wounded over 400 people and displaced over 120,000 residents. More than 130 refugees have so far died from diseases in evacuation centers

In a bid to improve the overall health situation, the ICRC said it is refurbishing health stations damaged in the fighting and providing medicines, other supplies and technical and financial support to the local health authorities and the Zamboanga City Medical Center. In May, the ICRC also set up a nutrition program for malnourished children under 5 years of age and for pregnant and lactating women with a view to reducing the number of preventable deaths. V. Conclusion Invoking the “Hierarchy of Laws” or the Doctrine of Constitutionalism, the CAB is beyond doubt inconsistent with the Constitution and therefore, VOID ab initio. It is void because the ultimate subject matter of the CAB which is to establish a Bangsamoro Political Entity or Bangsamoro Government and thereafter abolish the ARMM Regional Government, is repugnant and inconsistent to the Constitution. During the Dialogue Meeting on the CAB in Isabela City Gym, Basilan Province on May 21, 2014, GPH Panel Chair Prof. Miriam Coronel-Ferrer has said, “What is in a name”? “Bangsamoro” and “Muslim Mindanao” are the same. I disagree! Again, Fr. Bernas said, “Muslim Mindanao” is a short-hand expression to designate those areas of Mindanao which are predominantly Muslim. That is not meant to characterize all of Mindanao as Muslim. It is organized within the framework of the constitution and the national sovereignty.” On the other hand, “Bangsamoro”, is not merely an identity but a distinct nationality, separate from the Filipino people. And those who may wish to claim their identity or nationality as “Bangsamoro” are called “Bangsamoro People”. So, how can the phrase “Muslim Mindanao” and “Bangsamoro” be the same? Again, what is allowed by the Constitution is the ARMM Regional Government which is already existing and not the socalled Bangsamoro Political Entity or the Bangsamoro Government. V. Recommendations: In the name of true and genuine peace anchored on SINCERITY, the Rule of Law and Doctrine of Constitutionalism, the following are respectfully suggested and recommended: 1. Congress may revisit the history of the Bangsamoro struggle whose fruits, among others, are already enshrined in the Constitution such as the present ARMM Regional Government which the proposed BBL sought to be abolished; 2 . T h e s t at u s q u o (ARMM) should instead be strengthened, its Organic Act if necessary be amended, and if ever ARMM be abolished by Congress, then it can only be replaced by the new enhanced ARMM Regional Government, with all its additional functions or powers and budget; 3. With the new invigorated ARMM, let the MILF, MNLF, BIFF and ALL OTHER STAKEHOLDERS of the new enhanced ARMM

Regional Government participate in the 2016 election. After all, historically speaking, among others, the present ARMM Regional Government which is the creation of the Constitution is the fruit of the Bangsamoro struggle led by the MNLF and one of the best legacies of former President Corazon “Cory” C. 6 of Republic Act 7581 (Price Act of 1992), it shall cause the immediate dissemination of their prevailing prices or the price ceilings imposed in lieu thereof through means that will result in a wide dissemination. The CdO-CPCC will be chaired by Mayor Moreno as chair, with Atty. Jose Edgardo Y. Uy as co-chair and DTI Misamis Oriental Provincial Director Ma. Eliza A. Pabillore as vice chair. Its members include the presidents of the Cagayan de Oro Groceries Association; Konsumanteng Kagay-anon, Inc.; Cagayan de Oro Press Club, Transport Federation of Cagayan de Oro; chair of the City Council Committee on Trade and Industry and the Heads of the Xavier University KKP-SIO, Social Action Center, Archdiocese of Cagayan de Oro; Agricultural Productivity Office; City Economic Enterprise Department; City Legal Office and the Cagayan de Oro City Police Office Director.
