Court orders PNB to return P24 million to Davao trader

AVAO City - A Regional Trial Court (RTC) judge here has ordered the Philippine National Bank (PNB) to return the multi-millionpeso and dollar deposit of a prominent Chinese businessman which they had transferred from the bank’s branches in Davao City and General Santos City to their head office four years ago.

In a decision, RTC Branch

16 Presiding Judge Emmanuel Carpio directed the PNB to return the P11,109,202.10 and 306,147.89 dollars (about P13.4 million), and P284,793.94 to the bank accounts owned by a trader (name withheld for security reasons) in Davao City and General Santos City, respectively.

Carpio further ordered the bank to pay 6 percent interest per annum to the deposits, P200,000 as attorney’s fees and the cost of

the suit.

The businessman filed a civil suit for sums of money and damages after, despite several demands, refused to return his multi-millionpeso and dollar deposits to his accounts in Davao City.

In his complaint, the businessman claimed that on May 23, 2000, the PNB branches in Sasa, Davao City and General Santos City closed his accounts without his knowledge and consent, and transferred his money to the bank’s head office in Manila.

The complainant added he made several demands to the bank but to no avail.

In court, the bank admitted that they took the deposits contained in several accounts of the businessman in PNP Sasa Branch and in

General Santos City, as settlement of the past due loans of the complainant in the amount of P578,512,477.31 and 4,947,979.55 dollars.

The bank added that the deposits of the businessman were to be applied to the payment of the outstanding accrued interest of P54,222,085.50 and 444,939.22 dollars.

PNB also argued that there’s no deposit to speak of “because it was applied to the loan”.

The bank said the businessman “knew fully well that the said deposit accounts have already been closed”.

The bank also said the action of the complainant in suing them was barred by laches since it was brought 10 years after the alleged

commission of the bank’s act.

“Not only were the plaintiffs sleeping on their spurious rights, but also the long delay in enforcing their alleged rights signifies only that the plaintiffs themselves are aware of the falsity of their claims,” the bank argued.

The bank also used the principle of res judicata in his defense since a previous case relating to the unpaid obligations of the complainant had been finally decided before another court.

“The plaintiff conveniently concealed the vital antecedents that will shed a proper light on the reasons why their deposits were transferred to PNB’s head office and thereafter applied as payment of their loans,”

the bank added.

But after assessing the evidence on record, the court ruled as “improper and invalid” the act of the bank since the compromise agreement executed by the businessman and PNP involving the multi-millionpeso and dollar loans, does not mention about deposit accounts of the complainant to be used as payment of the loans.

In deciding the case, Judge Carpio cited the “parole evidence rule” prohibiting the modification of the agreement when the written instrument was already clear and leave no doubt on the contracting parties.

“When an agreement has been reduced to writing, the parties cannot be permitted to adduce evidence to prove alleged practices which to all purposes would alter the terms of the written agreement. Whatever is not found in the writing is understood to have been waived and abandoned,” Judge Carpio said, citing a Supreme Court ruling.

‘Seat Belt Law’ violators told to pay fines to LTO, City Hall Human rights groups from Mindanao march to Luzon

CAGAYAN de Oro City–– About 300 human rights victims from various areas in Mindanao on Friday starts the more than 1,400-kilometer caravan to Manila to dramatize protest against alleged human rights violation in Mindanao.

Datu Jomorito Guaynon, representing the indigenous people and farmer sectors, said that the multi-sectoral group starts the symbolic send off Friday morning in Cagayan De Oro City’s

“Freedom Park” dubbed as “Manilakbayan ng Mindanao Campaign 2014.”

In an interview, Guaynon said that the group expects to join the more than 2,000 protestors, most of them coming from the Kapisanan ng Mga Magbubukid sa Pilipinas in Southern Luzon before proceeding for a grand rally in Malacanang.

“For our part, we would bring to Malacanang the various cases of unsolved human rights violations summar y killings, and military abuses in the various areas in Mindanao,”

AGAYAN de Oro City––Traffic officials here on Friday said that violators of the “Seat Belt Law” should pay the required fines only to the Land Transportation Office (LTO) or at the City Hall.

Guaynon said.

He said that the group expects that President Aquino will positively act to expedite the resolution of unsolved cases of the human rights victims, particularly Engr. Nonito Oclarit, the victims of Maguindanao head of the city’s Road and Massacre.

Traffic Administration Guaynon said that the multi-sectoral group composed of farmers, tribal groups, religious leaders from Tacloban, Bicol, and Laguna will also join the protest-rally caravan, which is expected to last for over a month.

(RTA), issued the warning after receiving reports that some traffic enforcers are accepting payments of fines imposed against violators of the “Seat Belt Law.” Oclarit said that payments should only be made to the LTO’s regional office in Bulua, this city, if the apprehending officer is an LTO enforcer or to the City Treasurer’s Office at City Hall if the RTA enforcer is the apprehending officer.

He said that the LTO and

the RTA have joined forces in the implementation of the “Seat Belt Law” as required under Republic Act 8750.

The 14-year-old Seat Belt Law was enacted in 2000 but LTO officials started to vigorously impose the law all over the country only last Nov. 10, 2014, Oclarit said.

He said that a fine of P 1,500 is imposed for first time offenders, P 3,000 for second offenders and P 5,000 for the third offenders.

Public school teachers in CDO demand higher wages

Six-year term for barangay officials?

How about a six-year term for all barangay officials?

The proposal dubbed as HB No. 5073 wasx recently filed by Rep. Joselito “Jonjon” R. Mendoza (3rd District, Bulacan.

Mendoza noted that Republic Act No. 7160, otherwise known as the Local Government Code of 1991, mandates the role of the barangay as the basic political unit with officials serving a three-year term.

The Code gives barangay officials the vital role of being front liners

Editorial in the delivery of basic services to the people at the grassroots level, thus the necessity to increase the duration of their term.

Barangay officials share the same term with other local and nationally elected officials, thus they have to contend with political changes every three years despite their heavy task for their community. And their term is too short to do the task.

Citing Article X, Section 8 of the 1987 Constitu-

tion which grants Congress the power to fix the terms of barangay officials, it is just proper for the proponent to suggest that Congress should explore the possibility of extending the term of barangay officials to six years.

The proposal is based on the following reasons: 1) to minimize political interference in the barangay level and improve local stability; 2) To allow barangay officials to focus on long term service goals; 3) To maximize training programs for barangay officials; and 4) To save

public funds that would have been spent on barangay elections.

The bill also provides that the “voluntary renunciation of the office of any length of time shall not be considered as an ‘interruption’ in the continuity of service for the full term for which the elective official was elected.”

The provision on voluntary renunciation would prevent barangay officials from circumventing the law and allow them to run for a third term due to said “interruption” in his second term.

IPs, etc? Will the implementing mechanisms that will bring development be exclusively controlled by the MILF? Yes, there are motherhood statements claiming “inclusiveness” but there is a common lingering feeling of doubt that this is only “good in words and not in deeds”.

One footnote worth mentioning is the basic mind-frame of some Malacanang officials who merrily proceeded with dealing only with the MILF to the “exclusion” of other actual players like the MNLF , whom they condescendingly described as a “spent force” as if only the MILF matters.

Even the leaders of Mindanao’s interfaith dialogue group, the BISHOP ULAMA CONFERENCE was intentionally sidelined and “deadma-ed” (is there such a word?) all throughout simply because the “Ulamas” and the bishops composing it played a key role in peace building and peace dialogues during the previous ARROYO Administration.

Disturbing mind sets, if u ask me, but yes, a judgment call they are entitled to. But obviously paying “lip service” to inclusivity. (Hohum!)

CAN MILF DO IT? --More questions like: can the capacitation of the MILF (as new leaders professing good governance and development) happen in so short period of time as the original timelines envisioned? Earlier, I said that the transition period given to the MILF to win elections and govern is too short.

They won’t stand a chinaman’s chance to change the status quo, their good intentions notwithstanding. Moreover, disturbing incidents about continuing bombings, terrorist activities, conflicts and shooting incidents within the proposed Bangsamoro territory and its peripheries still hound us. There are even disturbing reports of one MILF commander in Lanao starting to enforce the “Shariah Law” in his area, without waiting for the final law allowing it. Then other reports of some MILF armed elements already making pre-emptive moves using the force of arms in claiming back lands from others that they plan on taking back when the Bangsamoro law is entrenched.

This is not to mention the arming of some non-Bangsamoro

elements who are girding for a showdown just in case. These are supposedly areas that people expect the MILF to handle and help pacify. These incidents are disturbing signs of clear challenge and defiance . Although I know the sincerity and the overriding intentions of the MILF in forging peace as I had the privilege of working closely with them, the question still remains: “Can the MILF hack it”?

DEVIL IN DETAIL -- There are also other significant developments lately that need to be addressed if we want to do a reality check. One, there is credible report that the MNLF has already sent word to its members that it will, for the moment, “stand down” from collaborating on the MILF’s Bangsamoro peace deal; two, the non-Bangsamoro residents in Mindanao are objecting to -- and are asking policy clarity about -control of the Bangsamoro of the sources of power and energy and other vital resources like minerals and marine resources. Then of course. the sensitive issues of disarmament or “decommissioning and demobilization”. There are other concerns that are now being closely scrutinized. Simply the effect of: “the devil is in the detail”.

WORRISOME -- Although reports appearing in the media show a “surge” of support, it is still worrisome that the island provinces of Sulu, Basilan and Tawi-tawi are still “cool” to the Bangsamoro deal. Again, a reality check will tell us that except for an insignificant number, there is no significant presence of the MILF in these areas. There are more MNLF there than MILF. Then the “gut” issue there is about Sabah where thousands of locals rely on livelihood -- not to mention their domain claims -- and obviously, Malaysia’s patronizing support to MILF is a turn-off for locals.

Then the matter of the expected resistance of the entrenched and powerful political and tribal leaders who will not easily and willingly allow the “johnny-comelately” neophyte and “new kid in the block” MILF to take over just so easily. I do not wish to give it more significance than what it deserves, but the observation that key political leaders in the ARMM

REALITY CHECK ON BANGSAMORO PAC

Over the past few days, I came across both good and bad news about the Bangsamoro peace deal.

A reality check of some sort.

“Good” because the government, the MILF and the prospective donor countries and international agencies came together recently in a Philippine Development Forum (PDF) to commit massive logistics support to the peace efforts. (Although the “lousy” media handling spoiled what otherwise was an auspicious event.) This sent very strong signals that enduring peace and prosperity for the Bangsamoro are just around the corner because there will be massive development resources to make things happen. This is “good” because the surge and the momentum for peace are sucking in more supporters including the so-called “doubters” and “non-believers”.

Whatever the future of the peace deal will be, improving the lives of the Bangsamoro is paramount.

But “bad” because the expectations for dramatic and immediate results are so high that not meeting them will only be another formula for disaster. We know miracles do not happen and peace does not come overnight.

It is incremental and a work of a lifetime. So, it’s good to do a reality check from time to time.

VALIDATION -- It was propitious that the night before, I had an interesting chat at our Seagull Beach Resort in Davao City with some of my former co-workers during my days in Malacanang.

PERILS -- Up to this time, my former Malacanang colleagues told me that there were still serious concerns that must be addressed especially on the continuing misgivings and doubts of many citizens on the capability of the MILF to handle such a gargantuan and sensitive task of bringing peace in the Bangsamoro territory. While the sudden surge of hope and optimism is a good, positive sign , it has also its PERILS. The public expectations that the peace deal will bring dramatic and immediate results are so high that unless such expectations are managed accordingly, there may be widespread disappointment and frustration that can spoil the efforts at the early stage.

INCLUSIVE? ---Then there is still the issue of “inclusivity”.

There are pestering questions. Will the peace deal be principally for the MILF or will it be inclusive as to include as “key players” other non-MILF Muslims, the MNLF, the sultanates, the tribes, the entrenched politicians, the

DA bent on pushing for food staples sufficiency

agayan de Oro City -- With less than two years of helming the Department of Agriculture (DA), Agriculture Secretary Proceso J. Alcala revealed that the agency is firm in increasing the country’s food staple sufficiency levels.

“Ang prayoridad pa rin po lagi pong kasama diyan ang pagsusulong pa rin na maabot pa rin nang pagtaas ng food staple sufficiency natin,” he stated.

In 2015, the DA chief added that the agency will be allotted around P60 billion.

He said that the national government through the department will continue to pour down interventions such as farm mechanization, seeds improvement, technology transfer, livestock production, among others.

Although the DA has fall short in reaching the 100% selfsufficiency level for the Philippine staple food crop rice at the end of 2013, Secretary Alcala explained that the agency is still on track towards attaining its target.

“We have designed a program nga tuloy-tuloy pa rin sanang tumaas kaysa sa datihan nating level of sufficiency ang performance ng kagawaran,” he said.

Despite the said heretofore thrust of the agency, the DA chief has underscored the apparent strides of the agriculture department since his headship in 2010 under President Benigno

Sulu concludes sports fest attended by thousands SULU – Sulu has successfully concluded a four-day sports competition participated by hundreds of athletes from different schools in the province.

Thousands of people also flocked to the annual sports event.

The Sulu Provincial Athletics Association Meet was so successful that next year’s event is expected to draw thousands of people from different towns here.

This year’s theme “School Sports in the Context of K to 12 Curriculum and Beyond” showed the camaraderie and unity not only of teachers and athletes and their trainers, but the people of Sulu as well.

The event was held at the provincial sports complex in Patikul town which was packed with people as it were in the previous years.

Governor Totoh Tan, who is the chairman of Sulu Sports Development Council, and Vice Governor Sakur Tan have actively supported the event.

Governor Tan, himself a sportsman, has urged the youth and the students to get actively in sports because it is not only good for the health, but also improve the activity of the brains and every organ in the body.

“The interest in sports, both as a hobby and a competitive undertaking, should be instilled among the youth, and if possible while they are still in their primary level of education and the the fact that sports is integral to the holistic concept in education,” he said.

ZAMBOANGA CITY – “Communication is very crucial in saving lives of the people especially during crisis situation,” said Christian Olasiman, executive assistant to Mayor Ma. Isabelle Climaco-Salazar, in yesterday’s session of the 12th Mindanao Communicators Network (MCN) congress at the Grand Astoria Hotel here starting Nov. 12-14.

Olasiman, who represented the mayor, underscored the importance of communication during emergencies like what the city had gone through during the Zamboanga siege in September last year.

“We realized that communication is very important especially in the disaster affected communities.

It is a crucial element in providing life-saving information to the people,” Olasiman explained.

“We believe that communication and information are basic needs in helping out people in crisis situation,” he added.

Olasiman also bared that the city government is now pursuing a campaign dubbed “Build Better Zamboanga” as part of the rehabilitation and recovery programs by way of communicating to base families, various stakeholders, and even to many young people and children.

Olasiman said “the theme, ‘Building Back Better Mindanao’ is an opportunity to share experiences by highlighting the best practices and what can be done to improve our communication systems in Mindanao….”

He also believed that communication is powerful, as “it would help advocate government’s rehabilitation and recovery programs in the disaster-stricken areas in Mindanao.”

DOH-12 assures it can handle Ebola, MERS-CoV GENERAL SANTOS CITY — The Department of Health (DOH) in Region 12 assured on Thursday it was ready in case the deadly Ebola Virus and the Middle East Respiratory Syndrome-Corona Virus (MERS-CoV) entered the area.

Dr. Teogenes Baluma, DOH Region 12 director, said Thursday said they have established mechanisms to ensure the proper monitoring and handling of possible Ebola and MERS-CoV cases, especially among returning Overseas Filipino Workers.

He said they have linked up with airports and other point of entries near the region for the tracking of returning OFWs from countries with recorded outbreaks of the two diseases.

Baluma said they have designated the Cotabato Regional Medical Center in Cotabato City as treatment facility for possible Ebola and MERS-CoV cases that would emerge in the area.

Also known as Soccsksargen, Region 12 comprises the provinces of South Cotabato, Sultan Kudarat, Sarangani, North Cotabato and the cities of General Santos, Koronadal, Tacurong, Kidapawan and Cotabato.

The World Health Organization (WHO) had declared parts of northwest Africa and the Middle East as hotspots for Ebola and MERS-CoV, respectively.

The country has so far remained free of Ebola and MERS-CoV. Baluma said their monitoring covers returning OFWs who were deployed in the identified disease

hotspots and residents who have travelled to and near these areas.

He specifically cited returning Muslim faithful who recently travelled to the Middle East for the annual Hajj or Islamic pilgrimage to Mecca in Saudi Arabia.

“We are carefully checking their health records and keep track of their travel plans for immediate tracing in case something comes up,” he said in a radio interview.

He said countries of origin of the returning overseas workers and travellers issue health certificates before they are allowed to travel.

The health certificates are issued after they properly pass the tests for the two diseases based on standards set by the WHO. But for Ebola, Baluma said returning OFWs and travellers are still required to undergo 21 days of mandatory quarantine following arrival in the country.

Those returning from the Middle East are free to proceed to their destinations once they are cleared

by DOH monitors at the airport for possible MERSCoV infection, he said.

In September, the region had a brief scare with suspected MERS-CoV after a nurse from South Cotabato who returned home from Saudi Arabia was reported to have contracted the disease.

The nurse, who hails from Banga town, and her family were immediately quarantined at the Southern Philippines Medical Center in Davao City but eventually turned out negative of MERS-CoV. (MindaNews)

Teachers play crucial tasks in educating youngsters. They are the ones who educate children with knowledge and values molding them to be great individuals.

Teachers take over the rule of the parents once a child enters the classroom. He should observe how a student behave and correct him if he does wrong. Moreover, the teacher also answers a student’s curious questions explains to him why and how such things happened.

Thus, it is very important for parents to collaborate with teachers in regarding their child’s education. Might be, it concerns on the child’s study habits and behaviour. The parents also cooperate with

the teacher on how to improve appreciated values and reprimand bad practices.

Patrece Charles-Freeman, an American author, said that it is good that parents would build a positive relationship with children’s teachers.

Charles-Freeman also suggested that once a parent has seen a problem regarding their child’s education and the teacher, parent should not go directly over the teacher’s heads or immediate bosses.

The parent should confide to the teachers first before principals because it might upset them once a parent will do otherwise.

Another is to feel neutral between the child and the teacher’s problem. In other words, a parent should not be angry before getting the

facts. There are times that parents know something that teachers don’t know and vice versa. Possibilities also happen like parents and teachers have different ideas on one story.

The exchange of information is a great help in avoiding misinterpretation and further, resolve problems in school.

Parents should also remember that most teachers are sensitive especially with regards in their job.

Parents and teachers should be collaborative partners in making a child’s learning process successful and productive.

He added that the university held this event for recognizing Cagula as an “exceptional leader”.

John Villadolid, current university student council chairperson, recalled that during Cagula’s helm at the student council, he was tireless in educating students such as the protest on budget cuts on the state universities.

Cagula was also executive vice president of the consortium of UP system wide alliance, Kasama (Kalipunan ng mga Sangguniang Mag-aaral) sa UP. Villadolid said “Kasama [sa UP] is honored to have Cagula who showed the organization’s long tradition of service to the Iskolar ng Bayan and the people.”

“He is the epitome of selfless leadership that transcends generation to come that will be worth remembering,” he said.

“It befits that we remember him by this homecoming. His fight is worth remembering and worth carrying on. Mabuhay Kuya Perper,” he said.

Activism in action Gelyne Alapag, anthropology major and activist, said Cagula’s action as a student leader impressed her most on what activism was about.

“At first I didn’t like activists; I would decline their invitations to education discussions. But when I listened to Perper, then I realized what they are talking about,” she said.

Alapag recalled how she first encountered Cagula when the latter was campaigning for the student council elections.

“My first impression of Perper is he’s smart. He likes to ask questions in discussion,” she recalled.

She recalled Perper was with her in every major campaign in campus.

“We worked together during the first graduation protest in UP Mindanao and other protests afterwards,” said Melgarejo.

“I would remember my term in 2010. There was a month were every day we went around classrooms and posted publicity materials to encourage more people to join the protest against the state university and colleges budget cuts in Aquino’s term,” she recalled.

The program ended with a mural presented to Perper’s parents. The

mural had a huge portrait of Perper smiling and a quote saying : “I join my bigger family to struggle to end the sufferings of the people, be it in the streets or in the countryside.”

Students also sang the UP hymn with clenched fist as they faced the UP Oblation statue to salute perhaps UP Mindanao’s brightest student to date.

Pe r p e r’s f at h e r Joy thanked the UP community for staging the event.

“I felt how much the teachers loved him. I am thankful. I am moved,” he said as he held back tears.

Joy said that he had only praise for his son.

“My regret was he could have done more. He told me before in our phone conversation that this is his life, he is happy. Many need people like him. I am proud of my son,” he said.

AMBOANGA City - At least 56 casualties were reported Saturday by the Philippine military in fierce clashes with Abu Sayyaf militants, many of them believed high in drugs, in the southern province of Sulu.

The Western Mindanao Command told the regional newspaper Mindanao Examiner that 5 soldiers were killed and 26 more wounded in the battle that began Friday afternoon in the hinterlands of Talipao town. The fighting lasted well into the night leaving at least 25 rebels dead and wounded and among the slain were two notorious Abu Sayyaf commanders Hairullah Asbang and Julie

Ekit.

Col. Alan Arrojado, commander of the Joint Task Group Sulu, said Asbang was the brother-inlaw of a senior Abu Sayyaf leader Radulan Sahiron.

“Among those who died were notorious leaders Hairullah Asbang and Juli Ekit. We accounted 10 dead and 15 Abu Sayyaf members wounded. We are confident that the Armed Forces of the Philippines can gradually decimate the Abu Sayyaf ranks,” he said.

Arrojado also said all wounded soldiers, mostly members of the 1st Scout Ranger Regiment, were rescued in Talipao and evacuated to hospitals on Friday night. He said more

troops were sent to the town to block the Abu Sayyaf ’s escape routes.

“The Abu Sayyaf has nowhere to hide if the civilians will cooperate with the military in identifying them and pinpointing their jungle hideouts,” he said.

Among the wounded in the fighting was 1st Lt. Michael Asistores, member of the Philippine Military Class of 2007, and leader of the 1st Scout Ranger Company. He said that at about noontime on November 14, his troops crawled stealthily and came as close as 20 meters from the Abu Sayyaf positions in their forest lair at the foot of Mount Tunggul and Mount Bunga.

“It was my recon elements led by (platoon leader) Lt. Dante Espiritu who spotted the bandits in a makeshift hut. He radioed to me that they will initiate contact as one of the bandits unknowingly approached their hiding positions in order to relieve himself.”

Unknown to them, all surrounding hills nearby were occupied by at least 300 rebels led by notorious Abu Sayyaf leaders Radulan Sahiron, Jurim Hussein, Hatib Sawadjaan and the group of Asbang and Ekit.

As i s t ore s s a i d t h at Espiritu called for reinforcement minutes into the firefight during which two of his patrol members were wounded. “I could hear Esprite’s voice over the radio amidst the heavy volumes of fire from various directions. They were almost surrounded by the enemy,” Asistores said, adding, they were only about 100 meters in their designated rally point.

Asistores said he assembled a platoon to help the

embattled soldiers following attacks from all directions. “The bandits wanted to annihilate the platoon of Espiritu by attempting to surround them, so I positioned my platoon about 50 meters behind of the bandits to join the fight,” he said.

But Asistores said he was also assaulted by the Abu Sayyaf. “The younglooking bandits were very daring and unmindful of our fires. They kept running towards our position despite being hit repeatedly. They were very ferocious and daring,” he said.

Asistores said he also dispatched soldiers to collect the casualties from the position of Espiritu. Seeing the dead and wounded soldiers around him, Asistores said he pressed the fight by rallying the remaining soldiers to hold their line to provide support as the casualties are being evacuated.

After about 2 hours of clashes, Asistores said he was hit by shrapnel, but continued the fighting along with other soldiers.

He said they also recovered marijuana cigarettes in

the Abu Sayyaf lairs. “The Abu Sayyaf borrowed their courage from the marijuana leaves that they smoked before the firefight. My men recovered some of the left-over of smoked marijuana in the encounter site. That solved the puzzle about their bravery in combat. They are drugcrazed fighters,” he said.

Asistores said that he and his men, who are now recuperating in military hospital at the Western Mindanao Command in Zamboanga City, are all willing to go back to Sulu and rejoin their unit to fight the Abu Sayyaf. “I will gladly go back and be with my men in the frontlines. We must crush the Abu Sayyaf and end its kidnapping atrocities,” he said.AFP Chief General Gregorio Pio Catapang, Jr., who condoled with the families of soldiers killed in the fighting, ordered the military on Saturday to immediately send medical teams, mission-essential equipment and additional supplies for the troops battling the Abu Sayyaf in Sulu.

I got a surprise call sometime ago from Zamboanga City Congressman CELSO LOBREGAT who simply asked permission if he could reprint my earlier published article entiled : “THE MILF PEACE PACT ... WHAT IF?”. I wrote my initial personal assessment as early as April this year about the risks and dangers and the things that we should address if we want the peace pact to succeed. I was informed by my friends lately that Cong. CELSO has heavily circulated my printed thoughts. What is disturbing to me is that more than half a year later has elapsed since and the same worrying signals are still around that need to be addressed; the risks need to be mitigated.

DONOR FATIGUE -- In short, the task is not easy. Most important is MANAGING EXPECTATIONS principally of the Bangsamoro constituency, the key players, including the international donor community partners who are prone to suffer from the so-called “donor fatigue” syndrome that can somehow afflict their respective anxious and impatient country capitals and head offices. This was WHAT HAPPENED in the case of the 18-year old MNLF peace pact of 1996 that , up to the present, still needs further nurturing and attention. Lessons learned, of course.

“MORAL HAZARD”-- Whatever the outcomes of all these, it is imperative that we MUST improve the lives of the Bangsamoro, which is now long overdue.

That is the bottom-line! That’s the over-riding reason why we welcome the generous help and support of the international donor community like the World Bank.

Of course, with a clear warning (call it gentle admonition) that if there is lack of “inclusivity” in the implementation of development projects on the ground, “moral hazard” or dissatisfaction leading to more conflict by those excluded will be inevitable. We have learned from the past that peace deals or agreements, altho important milestones, are not necessarily or solely the exclusive fountainhead of peace and progress.

So let’s NOT put all our eggs in that one basket.

ZAMBOANGA CITY––The local police blamed the Abu Sayyaf for the recent twin bomb explosions that injured a K9 handler and a bomb-sniffing dog in this city.

The incident that took place 15 minutes apart in the evening of November 9 at De Luxe Massage and Karaoke Bar along Tomas Claudio Street downtown injured PO2 Franklin Ined, a member of the explosive ordnance demolition team and a bomb-sniffing dog named “Diego.”

Senior Supt. Angelito Casimiro, city police director said the incidents were the handiwork of four followers of Basilan-based Abu Sayyaf leader Puruji Indama.

Casimiro said two of the four are twins and all are from Barangay Baguindan, Tipo-Tipo, Basilan. One of them was identified as a certain Yaser.

The police official described Yaser as more or less 22 years old, 5’6” in height, around 55 kilograms, small built, with brown complexion and shoulderlength curly hair.

He said one of the twin brothers is more or less 20 years old, 5’4” in height, around 54 kilograms, small built, with brown complexion and short straight hair. The other twin is more or less 20 years old, 5’6”

in height, around 60 kilograms, with brown complexion and short curly hair.

He said the fourth suspect is described as more or less 20 years old, 5’5” in height, small built, with white complexion and short straight hair.

Casimiro said the suspects had stayed in a bunkhouse unit of Gafur Pingli in Barangay Taluksangay, this city, prior to the twin bomb explosions.

“This information is under validation by the intelligence section of ZCPO,” he added.

Casimiro further disclosed that one of the four suspects was recognized through the facial composite sketch by a department store sales lady as the one who bought from them the plastic container that was used to conceal the second bomb.

He said the official receipt attached to the plastic bag that was used to wrap the plastic container that contained the second bomb revealed where the plastic container was bought.

DA urges private sector to support full commercialization of organic products

DAVAO City - The Department of Agriculture (DA) vowed to meet the deadline on converting five percent of the country’s agricultural land to organic farms by next year.

Agricultural Secretary Proceso J. Alcala told the Philippine News Agency (PNA) that there is no stopping their agency to push for that five-percent target.

“We urge the private sector for this and encourage more farmers to go organic,” he said.

Alcala was in Davao City on November 11, for the 11th National Organic Agriculture Congress (NOAC) together with guest speaker, Senator Cynthia A. Villar, Senate Committee Chair on Agriculture and Food, and House Committee Chair on Higher Education Roman

T. Romulo. Also present were DA Undersecretary Bernadette Romulo Puyat, chairperson, National Organic Agriculture Board, Agriculture Office on Special Concerns and Undersecretary Emerson U. Palad, DA-Office of Operations.

Davao City Mayor Rodrigo R. Duterte also delivered his brief message and personally welcomed the guests and close to 2,000 farmer-participants of NOAC from November 11 to 13 held at the SMX Convention Center, this city.

In his message during the opening ceremony of NOAC, Alcala also vowed to push for organic agriculture with the strong support of Senator Villar on their proposal to allocate a budget for acquisition of machineries for organic agri production.

He said there is a need

to push sustainable agriculture anchored on DA’s advocac y campaign of “Pagkain sa Filipino, Tiyak na Ligtas”.

Alcala said, “We are glad that the Organic Agriculture program in the country has been having a good response not only from the farmers, practitioners and consumers themselves but also from the government officials.

During the three-day congress, a mini-trade fair featuring organic products of the different areas in Mindanao highlighted the three-day Confab. There were sessions on best organic agricultural practices in growing of various crops and also discussions on the latest farming technologies that supplement current methods will be accessible to the farmer participants.

GVC, which is also provided by other regional cooperation and free trade agreements (FTAs), is expected to bring gains to the linked countries, especially the ASEAN economies, in terms of expansion of production.

The country will hold the National Exporters Week on December 1-7 carrying the theme “Integrating SMEs to Global Value Chains” in the hope of seizing these opportunities with government support to facilitate trade.

Trade facilitation involves the simplification of procedures, reduction of transaction costs and improved business environment in the country.

The National Export Congress 2014 will be held on December 5 where industry stakeholders will collaborate to harness the individual strengths of firms, share best practices and harmonize policy reforms that

can enhance SMEs’ ability to gain greater participation in the GVC. Key officials who will speak at the Congress are Senator Paolo Benigno “Bam” Aquino, Department of Trade and Industry (DTI) Secretary Gregory Domingo, Philippine Exporters Confederation Inc. (PHILEXPORT) President Sergio Ortiz-Luis Jr. and DTI Undersecretary Ponciano Manalo Jr. Other key government officials and export executives will also gather for panel discussions to talk about trade facilitation initiatives and GVC lessons and best practices for SMEs. Regional offices of the DTI, PHILEXPORT and the academe will also be celebrating the event with various activities in line with the year’s chosen theme.

Various trade fairs and export sale showcasing Philippine-made products and forum are scheduled for the week-long event.

The holding of the yearly national event is in line with Presidential Proclamation 931, series of 1996, and House Resolution No. 33 that which declared the first week of December as the Exporters’ Week.

NNC-X launches 10 Kumainments; strengthens Promote Good Nutrition among communities

n efforts to pace up with the country’s changing hunger and nutrition situation, the National Nutrition Council region 10 has launched its new revised version of nutritional guidelines for Filipinos dubbed as the 10 Kumainments on November 14, Thursday at Dynasty Court hotel, this city.

According to Marissa DM. Navales, regional nutrition program coordinator, 10 Kumainments is the commandments on how to live a healthy lifestyle.

“The National Nutrition Council eyes to disseminate good words on health and nutrition to all Filipinos, transmitting it to families and communities,” Navales said.

Allow me to set the premise before you continue on reading and I want to offer a disclaimer that I personally believe in the principle of hardwork.

I am a very hardworking person myself. But this is what I’ve discovered, it doesn’t really matter how much work, effort, and time you put in, if you do not know what you’re doing, everything you worked for seems to be useless. In other words, we should not only work hard but we should also work SMART. These are my following personal observation. There is a big difference between people who are working hard versus working smart.

People who work smart achieves more, people who work harder don’t.

People who work smart focuses on the goal while people who only work hard focuses on the role.

People who work smart focuses on producing the desired result while people who only work hard focuses on the activity.

People who work smart enjoys what they are doing while people who only work hard experiences more stress.

People who work smart wants to know and learn the process of doing things while people who work hard wants only to make money.

People who work smart knows how to leverage off other people’s time and effort while people who work hard rely only on his own time and effort.

My prayer and hope, once you read this short blog, you will be encouraged not only to work hard but also to work smart.
