DAVAO City-- The Davao City Police Office (DCPO) has cautioned women from physically meeting "textmates" or online "chatmates" who are strangers, as authorities recorded an increase in rape cases in recent months. DCPO spokesperson Maj. Teresita Gaspan said Friday they have recorded 100 rape cases from January-August 2022. Forty-nine of those victims, Gaspan said, met their attackers through text messaging and online social media apps. "These abusers are already someone they know via text or connected in social media. This sends us a message to not easily trust on people and always higher our guards," she said. Gaspan said 100 rape cases recorded in the first half of 2022 indicated an increase from the 104 reported cases in 2021. On the positive side, she said the high reporting rate means that victims of sexual abuse are gaining confidence to report perpetrators. "We have been strengthening our linkages to potential victims by conducting educational awareness among school teachers as students who have fallen victims to these crimes would also see them as someone they can confide to," said Gaspan, who also chairs the DCPO's Women and Children's Protection Desk. THE Monetary Board has approved the amendments to the minimum capitalization of rural banks that would enable them to enhance their risk management systems, upgrade resources and manage operational costs, meet prudential standards, and accelerate digital transformation.Thisispart of the initiatives under the Rural Bank Strengthening Program (RBSP), which aims to enhance the operations, capacity, and competitiveness of rural banks. “The revised minimum capital requirements shall result in stronger and wellcapitalized rural banks, underpinning a Philippine banking system that is stable, sound, resilient, and inclusive for Filipinos,” Bangko Sentral ng Pilipinas (BSP) Governor Felipe Medalla said in a statement Friday. “With a strengthened capital base, rural banks would be able to withstand adverse financial shocks and at the same time, tap opportunities to enhance income potential, expand banking operations, and provide better credit facilities and services responsive to the needs of their clients and the banking public.” The minimum capital levels of rural banks are PHP50 million for the head office only and those with up to five branches; P120 million for those with six to 10 branches; and P200 million for those with more than 10 Givenbranches.theliberalization in branching regulations and digitalization of banking services, the tiering of the new minimum capital requirements for rural banks only considers these banks’ network size, as indicated in the number of branches (including head office), and no longer considers their area of operations. Affected rural banks, including those already authorized by the Monetary Board to establish a rural bank, shall be given five years to comply with the new minimum capital requirements by referring to the available options under the RBSP. These include merger/ consolidation, acquisition/ third party investment, voluntary exit/upgrade of banking license, capital buildup program (CBUP), and supervisory intervention.

“The BSP continuously engages the BSFIs, relevant government agencies, and industry associations for a cohesive and industrywide approach to addressing emerging threats and risks, as well as enhancing cyber incident response, threat intelligence, and overall situational awareness in the country,” the central bank said.Former BSP Governor Benjamin E. Diokno in December said the central bank is looking to issue stronger regulations on banks’ cyber defense following hacking incidents involving BDO Unibank, Inc. and UnionBank of the Philippines, Inc.The National Bureau of Investigation in January arrested several people allegedly behind the hacking incident that affected more than 700 BDO clients. In March, the central bank approved BSP Circular No. 1140, amending risk management regulations to strengthen cybersecurity and minimize losses from online fraud and illicit activities. “The BSP constantly reminds the public to practice cyber hygiene under its cyber awareness and digital literacy program themed, #E-Safety is Everyone’s Responsibility,” the central bank said.

Lk 6,6-11) That was when Christ made his point when he asked: “Is it lawful to do good on the sab bath rather than to do evil, to save life rather than to destroy it?” We have to realize then that we cannot simply depend on our human estimation of things based simply on our sciences and technologies, on our feelings and passions, on our different social, political and cultural consensus, etc., though they too are important, but as secondary means of our way of knowing the truth and of loving everyone and every thing.We should try our best to know God which should lead us to love him also. By so doing, we would know every body and everything else properly and to love them properly as well, as a Andconsequence.knowing and loving God, the pattern of our own knowing and loving, should not be that difficult because these have been shown to us by Christ, the full ness of God’s revela tion to us. We should just do our part of sitting down and spending time and effort to study the life and teaching of Christ and of the Church, and to develop a working plan of a life of piety that would help us to nour ish our relation with God through prayers and sacrifices, ascetical struggles, recourse to the sacraments, devel opment of virtues, etc. We have to remem ber that our life ought to be always a life with God through Christ in the Holy Spirit. We have to adapt ourselves to this basic truth of faith about ourselves, because we are notori ous in believing that our life is simply our own, and relying only on our own estimation of things.Wereally need to humble ourselves to accept this truth of our faith, because it is usu ally our pride that pre vents us to realize this truth. We need to work on our faith in order to keep it alive, vibrant and functional, especially in some difficult if not impossible occasions. We should not be surprised that life and all the challenges and trials we are going to face in it will always demand from us things beyond our powers and resources. And that’s simply because we are meant to go to God for all our needs, without neglecting any effort we can give along the way. Only through God can we know and love everybody and every thing else properly.

8. Defendant TERENCE JAKE OLMEDO is of legal age, Filipino, and a resident of Sto. Niño, Baroy, Lanao del Norte. Summons, notices, and other processes of this Honorable Court may be served through his representative, Jaime L. Olmedo, of legal age, Filipino, and a resident of Sto. Niño, Baroy, Lanao del Norte. 3. Under Section 4 of the same law, plaintiff was granted the power of eminent domain, subject to the requirements of the Constitution and existing laws. 4. Plaintiff is engaged in the business of transmitting electric power from the generating plants of power producers to distributors. As such, plaintiff’s business is imbued with public interest.

C O M P L A I N T (With Urgent Prayer for Issuance of Writ of Possession)

Considering that plaintiff is a private corporation performing a public service, it is a quasi-public entity entitled to enforce such easement of right-of-way of up to 60 meters in width on the subject property without cost, except for the improvements that will be damaged by the17.project.As shown in the aforementioned said sketch plan, plaintiff’s project merely imposes a ten (10)-meter wide easement of rightof-way over the subject property, which is well within the sixty (60)-meter wide easement reserved under Section 112 of C.A. 141. 18. To enable plaintiff to construct and maintain the Project, it is both necessary and urgent to enforce an easement of right-of-way pursuant to Section 112 of C.A. 141 and/or acquire the portion of the subject property, to ensure stability and reliability of the power supply in Mindanao and other regions of the country.

11. The property subject of this complaint is a parcel of land, identified as Lot No. 2412, PLS-13 situated in Brgy. Pange, Baroy, Lanao del Norte, registered in the name of Corazon Valiente married to Espedito Valiente under Original Certificate of Title No. P-10,578 and declared in the name of Corazon Valiente under Tax Declaration (TD) No. H-130006(03).

Under Section 2 of Rule 67 of the Revised Rules of Civil Procedure, plaintiff may already enter and possess the affected portion of the subject property during the pendency of the expropriation case. 21. Section 2 of Rule 67 of the Revised Rules of Civil Procedure states that: “SEC. 2. Entry of plaintiff upon depositing value with authorized government depositary. – Upon the filing of the complaint or at any time thereafter and after due notice to the defendant, the plaintiff shall have the right to take or enter upon the possession of the real property involved if he deposits with the authorized government depositary an amount equivalent to the assessed value of the property for purposes of taxation to be held by such bank subject to the orders of the court. Such deposit shall be in money, unless in lieu thereof the court authorizes the deposit of a certificate of deposit of a government bank of the Republic of the Philippines payable on demand to the authorized government depositary.” [Emphasis supplied] 22. In compliance with the notice requirement, plaintiff notified defendant through a Letter Offer of its intention to file an expropriation case if the possession over the subject property cannot be timely secured and/or issues regarding compensation for the subject property cannot be resolved except through judicial intervention. Plaintiff further serves, simultaneous with the filing of the instant Complaint, a Notice to Take Possession (attached as Annex “B”) upon the defendants. 23. To comply with the deposit requirement, without prejudice to the applicability of Section 112 of CA No. 141, plaintiff shall deposit with the Honorable Court the total amount of FIFTY-ONE THOUSAND NINE HUNDRED SEVENTY-FIVE PESOS (Php51,975.00), equivalent to 100% BIR zonal value of the total affected area of the subject property. Such total amount to be deposited by plaintiff includes the 100% BIR zonal value of the Affected Area-Easement of Right-of-Way amounting to Php47,475.00, which defendants are not entitled to receive by virtue of Section112 of CA 141, but plaintiff is willing to deposit only for purposes of issuance of writ of possession. 24. Notwithstanding that R.A. 10752 does not specifically apply to plaintiff, it shall deposit the said amount with this Honorable Court consistent with the purpose of the said law and OCA Circular No. 113-2019 to simplify the deposit requirement in expropriation cases for the benefit of the defendants and in the interest of immediate implementation of projects intended to benefit the public. 25. Upon deposit of the provisional amount, plaintiff would have fully complied with the requirements for the issuance of a writ of possession as mandated by law. In a long line of cases, the Supreme Court ruled that, once the above requirements are complied with it, it becomes the ministerial duty of the trial court to issue the writ of possession in favor of the plaintiff, without need of any further hearing. Therefore, the Honorable Court can already immediately issue to the plaintiff an order to take possession of the property and start the implementation of the26.project.However, since the subject property is covered by Section 112 of C.A. 141 and defendants are not entitled to compensation for the Affected Area-Easement of Right-of-Way, the provisional deposit representing the 100% BIR zonal value of the said affected area amounting to FIFTY-SEVEN THOUSAND FOUR HUNDRED SEVENTY-FIVE PESOS (Php47,475.00) should remain in custodial egis until the issue on the applicability of Section 112 of C.A. 141 in this case is resolved with finality.

27. Moreover, it must be emphasized that an expropriation proceeding is an action quasi in rem, wherein the fact that the owner of the property is made a party is not essentially indispensable insofar as it concerns the immediate taking of possession of the property and the preliminary determination of its value, including the amount to be deposited. 28. An action quasi in rem names a person as defendant, but its object is to subject that person’s interest in a property to a corresponding lien or obligation. In a proceeding quasi in rem, jurisdiction over the person of the defendant is not a prerequisite to confer jurisdiction on the court, provided that the latter has jurisdiction over the res. 29. The purpose of summons in actions quasi in rem is not the acquisition of jurisdiction over the defendant but mainly to satisfy the constitutional requirement of due process. 19. Plaintiff negotiated with defendants, through Jaime L. Olmedo, informing them of its intention to take immediate possession of Lot No. 2412, PLS-13 for the implementation of its project. Plaintiff likewise offered defendants the acquisition cost for Affected Area-Tower Site. However, no agreement was reached between the parties. Hence, plaintiff has no other recourse but to file the instant complaint to enforce its rights under Section 112 of Commonwealth Act 141. 20. Section 13 of R.A. 11361 provides that Rule 67 of the Revised Rules of Civil Procedure governs plaintiff’s expropriation cases. Under Section 2 of Rule 67 of the Revised Rules of Civil Procedure, plaintiff may already enter and possess the affected portion of the subject property during the pendency of the expropriation case. 21. Section 2 of Rule 67 of the Revised Rules of Civil Procedure states that: “SEC. 2. Entry of plaintiff upon depositing value with authorized government depositary. – Upon the filing of the complaint or at any time thereafter and after due notice to the defendant, the plaintiff shall have the right to take or enter upon the possession of the real property involved if he deposits with the authorized government depositary an amount equivalent to the assessed value of the property for purposes of taxation to be held by such bank subject to the orders of the court. Such deposit shall be in money, unless in lieu thereof the court authorizes the deposit of a certificate of deposit of a government bank of the Republic of the Philippines payable on demand to the authorized government depositary.” [Emphasis supplied] 22. In compliance with the notice requirement, plaintiff notified defendant through a Letter Offer of its intention to file an expropriation case if the possession over the subject property cannot be timely secured and/or issues regarding compensation for the subject property cannot be resolved except through judicial intervention. Upon deposit of the provisional amount, plaintiff would have fully complied with the requirements for the issuance of a writ of possession as mandated by law. 26. In a long line of cases and in accordance with OCA Circular No. 113-2019, once the above requirements are complied with it, it becomes the ministerial duty of the trial court to issue the writ of possession in favor of the plaintiff, without need of any further hearing.
