Ombud clears Iligan mayor on 2 cases filed by ex-vice mayor ILIGAN City––The Office of the Ombudsman, in a joint resolution, dismissed the two cases filed against Iligan City Mayor Celso G. Regencia for Grave Abuse of Authority and Grave Misconduct.

The Joint Resolution was issued by the Ombudsman pertaining to the cases, OMB-M-C15-0421, for violation of Section 3 (c) and (g) of R.A. No. 3019 and OMB-M-A-15-0513, for Grave Abuse of Authority

and Grave Misconduct filed by then Iligan City Vice Mayor Ruderick C. Marzo on November 2, 2015.

The Ombudsman dismissed the case for no probable cause.

Mayor on Davao blast: ‘Senseless incident’

GENERAL Santos City–– Mayor Ronnel Rivera described the bomb attack in Davao City on Friday night that left 14 people dead and 71 others wounded a “senseless incident” and rallied residents to be more vigilant.

Rivera urged residents “to continue to pray for everyone’s safety and let us unite and help each other” in facing such adversity.

He offered the entire city’s condolences to the families of the victims.

DAVAO City--Fourteen persons, including a 12year old boy, were killed, three of them expiring at the hospital, while 63 others were injured in an explosion at the popular night market along Roxas Avenue here at around 9:50 p.m. Friday.

Six hours later, while visiting the blast site, President Rodrigo Duterte declared a “state of lawlessness” nationwide “until there is a threat against the people and nation.”

He clarified he was not declaring martial law, and that this has nothing to do with the suspension of the writ of habeas corpus but he will ask the Armed Forces of the Philippines and the Philippine National Police “to run the country according to my specifications.”

“There will be a lockdown in the city and there will so many checkpoints along the way. These are extraordinary times and I suppose I am authorized to allow the security forces of our country to do searches” at checkpoints, among others.

“I have this duty to protect the country, I have this duty to keep intact the integrity of our nation,” he said.

Addressing Davao City residents, the President, who served as city mayor for 22 years across seven terms, said: “Be calm,” the President said, adding the bombing is “seasonal in our city.”

“This is not the first time that Davao City has been sacrificed at the altar of violence,” he said.

Blast from the past: 13 years ago Friday night’s blast was the first in the city after 13 years, and the first since Duterte became the President.

In 2003, when Duterte was on his fourth term as city mayor, two bombings struck the city a month apart, killing a total of 38

and injuring 200.

Twenty-two persons were killed and 155 others at the waiting shed of the old airport on March 4. A month later, on April 2, another bomb exploded at the seaport, killing 16 and injuring 45 others.

Then President Gloria Macapagal-Arroyo declared a state of lawless violence on April 3, a day after the second bombing, but the coverage was not nationwide, but only Regions 11 and 12.

General Order NO. 3 directed the AFP and the PNP “to prevent and suppress acts of terrorism and lawless violence in Regions 11 (Southern Mindanao) and 12 (Central Mindanao) and to carry out actions and measures to implement the order with due regard to the constitutional rights of every individual.”

In Friday night’s blast, 10 persons died at the blast site while 66 others were rushed to five hospitals, most of them (34) at the Southern Philippines Medical Center (SPMC)., three of whom died. Twenty-six were brought to the San Pedro Hospital, four in Davao Doctors, and one each in Limso and Brokenshire, for treatment of injuries, a number of them in “very critical” condition.

Dr. Leopoldo Vega, SPMC director told reporters shortly before 1 a.m.

Saturday that 31 victims (the figure was later updated to 34) were rushed to the hospital, two of whom expired while being resuscitated, while seven were rushed to the operating rooms, one of whom later expired.

Asked how this compares with the 2003 bombings, Vega replied, “it’s almost the same if I can remember because I was also in the emergency room at that time. The magnitude of the number of injuries was also the same. I think in 2003 we also saw 20 plus patients.”

But Friday night’s blast is incomparable to the April 1981 bombing at the San Pedro Cathedral, Vega said.

“That was worst. That was different. We did operations for roughly two days,” he recalled, as two grenades exploded inside the church on that Easter Sunday.

San Pedro Cathedral was again bombed 12 years later, on December 26, 1993, killing seven and injuring at least 150 others.

The 1981, 1993, March and April 2003 bombings remain unsolved.

Still investigating Senior Insp. Catherine dela Rey, spokesperson of the Davao City Police Office (DCPO), said they have yet to confirm what caused the explosion as they are still investigating the incident.

But Vice Mayor Paolo Duterte, who arrived at scene at 12:03 a.m. Saturday, said they are suspecting the blast may have been caused by an LPG tank explosion.

President Duterte refered to it as “bombing.”

The vice mayor said that of the 10 who were killed on impact, five were men and five were women.

The Roxas night market was opened in 2013 and was closed for a weeks last month.

“The ground shook” The bomb exploded on the street between the compound of the Christ for All Nations Church and the Ateneo de Davao University’s Community Center Building.

ADDU security guard Benedicto Torres said he felt the ground shake because of the loud explosion.

The victims were immediately taken to the entrance of the Community Center Building by the Central 911 responders. The dead were placed on one side of Padre Zamora Street.

Torres said that after the blast, he saw a smoke that wafted above the tents where the massage therapists were.

A still undetermined number of masseurs were injured, among them the pregnant Vicenta Asperin, 21, who is on her sixth month going on seventh, according to her elder sister, Dahlia. She said it will be Vicenta’s first baby.

SOMETHING must be wrong in the head of the ambassador of Bangladesh when he declared Filipinos are thieves and the women are prostitutes. This is too much of an insult that I am sure every Filipino would wish the diplomat’s tongue be cut off. I felt the pain of his pronouncement and I urge our government to protest or do some legal move to protect our honor and dignity as people. If we leave it that way, other nations might follow suit and call us pigs. He should be declared “persona non grata” for his foolish comment.

000 Deaths are mounting as President Duterte’s war on drugs goes on. While I like his efforts to annihilate drug addiction in the country, I see him as unprepared to pursue it because of lack facilities to handle the aftermath of his program.

-oooZIKA OUTBREAK PREDICTED TO HAPPEN: Whether we believe it or not, this onslaught of the Zika virus in many parts of the world was actually predicted to happen thousands and thousands of years ago.

The predictions claimed that deadly diseases will plague many people causing them to die. Fever and inflammation---the most evident symptoms of Zika, as per medical experts--would kill a great number of people.

The number of deaths from these diseases would be so great that many dead bodies would no longer be buried. One particular prediction along this line says: “Your carcasses will be food for every bird of the sky and wild animal of the earth, and there will be no one to chase them off.”

Then, the predictions also warned about people being subjected to madness and confusion of the mind, which madness and confusion would be so great that people will be unable to distinguish between light and day---that even at noontime, many will feel their way along like blind persons who are in total darkness.

-oooHOW TO FIGHT ZIKA: Why would these ailments and mental diseases be visited upon the world? The predictions attribute this to two things: failure or refusal of many to listen to the Word of God, and failure or refusal of people to obey His commands.

Truth to tell, the predictions not only of ailments and mental diseases but of other tragedies and calamities as well are premised on these two things.

XU commends 10 new agricultural engineers THE Xavier University commended the ten BS Agricultural Engineering graduates who passed the August 2016 Agricultural Engineer Licensure Examination.

Solon: Davao attack meant to taunt Digong THE deadly bombing of a crowded night market in Davao City was clearly intended “to taunt and embarrass” President Rodrigo Duterte, who has declared an all-out war on the extremist Abu Sayyaf Group (ASG), Surigao del Sur Rep. Johnny Pimentel, a member of the House committee on national defense and security, said Saturday.

“But the commanderin-chief is single-minded, and he is absolutely right.

DAVAO City––The Presidential Communications and Operations Office (PCOO) launched on Friday President Duterte’s drug war ads directed by award-winning independent film director Brillante Mendoza.

In a press briefing at the Royal Mandaya Hotel here, presidential spokesperson Ernesto Abella said the ads touch on the ill-effects of drugs not only on the drug user but also on how “it destroys the social fabric” of this country.

“Basically, it shows another face to the drug problem and how it destroys the social fabric,” he said. “It brings out a different

aspect (of drug problem) – the fact of social connectivity that is being destroyed.”

Abella pointed out the ads tackle in “bite sizes” what the Duterte administration wants to address, that is, the depth of the drug menace that he described as “pandemic”.

A premier indie film director, Mendoza said he came up with the concept of the ads that showcase how substance abuse affects the relationships among family members.

“Ayaw natin maapektuhan ang pamilya dahil sa droga (We don’t want the family to be affected by

drugs),” he said.

Two of the ads last 2 minutes and 30-second ads and are for the social media. Four are for TV and last 30 seconds while there are two audio versions for radio.

Mendoza said he wants to influence the Filipino people through these ads by touching the hearts of the viewer on the dangers of illegal drug use.

PCOO chief Secretary Martin Andanar said the country’s giant networks, radio stations, and operators of cinemas have offered to allot free time slots for these ads from this month until December.

In a press briefing at the Davao International Container Terminal aired live over DZMM Friday, President Rodrigo R. Duterte said he is unfazed by the growing criticisms from the international community over his drug war.

“I am not the president of the international community. I am the president of this country. … For all that they can always talks and talk. I am invoking sovereignty,” he said.

He said criticism bother him “not a bit” because there is a crisis in the Philippines with 3.6 million Filipinos who have

figured in drugs according to the Philippine National Police.

He vowed that he will address the drug menace within the limited resources of government.

But he admitted that new rehabilitation centers for drug users might not come too soon due to limited budget.

“The drug crisis hurts so many people including the parents who raise their children from childhood to college, spending money only to realize that at the end of the day, their lives are destroyed.

5 of 14 fatalities in Davao City blast hails from South Cotabato

GENERAL Santos City–– Five of the 14 fatalities in the bomb attack at a night market in Davao City on Friday night were from South Cotabato province.

Four of the victims were previously residents of South Cotabato who have already relocated while one was a student enrolled at a college in Davao City.

They were Melanie Faith and her son Deniel Josh Larida, Evelyn ConceminoSobrecary, Senior Police Officer 1 Jay Adremesin and Kristel Decolongon.

Faith and and Deniel Josh confirmed to radio station Brigada News FM in Koronadal City that the two were formerly residents of Barangay Guinsang-an in Sto. Nino town.

The 14-year-old Deniel Josh and his mother were at a portion of the massage area of the night market along Roxas boulevard when the explosion occurred before 11 p.m.

His father Dennis, who was just a few meters from them, was spared but was among the 71 people listed as injured in the blast.

Adremesin, who is a member of the aviation police unit assigned at the Davao City International Airport, was from San Gabriel, Bo. 7 in Norala, South Cotabato.

SPO1 Adremesin’s wife Ellen said they went to the night market on Friday to spend their “family night” there.

She said they were with their only child, house helper and her husband’s

co-worker.

“He (SPO1 Adremesin) cooked for us that night and later convinced us to go to the night market as he will be getting a massage,” she said in an interview over Brigada News FM. Ellen said she had just brought their child and house helper to a nearby food stall when the bomb exploded at a portion where her husband was having his massage.

Meantime, Barangay Councilor Arnold Decolongon of Libertad, Surallah said Kristel’s parents immediately went to Davao City early Saturday.

He said his 17-year-old niece was among those se-

riously injured in the blast and rushed to a hospital but later died while undergoing a major operation.

Reportedly, the price of the property in question was Php380 per square meter compared to the price of the land owned by Maximo S. Ginco which was only Php100 per square meter with the land area of 38 hectares, very suitable for housing project, a rolling land which is not flood prone area. It is near the Philippine National Police Headquarter, at Tipanoy, and near also to the Landless housing project. As a matter of fact, four (4) hectares was donated to the City Government of Iligan. The total land area for the DSWD Core Shelter Assistant Fund Program was 42 hectares instead of 38 hectares. This land area was the counterpart of the Php 230,000,000 donated by the DSWD that can accommodate 3,495 housing units at 70 square meters land area per housing unit.

According to an email forwarded to MDN by the Iligan PIO, the accusation of Marzo was without Requiring the SP’s ratification after the sale has already been consummated and is allegedly an encroachment on respondent‘s authority.

The decision reportedly said that there is no probable cause to indict respondent for violation of Section 3 (c) of R.A. no 3019. The Resolution gave respondent prior authority to negotiate and enter into a contract of sale in compliance with Section 455 (b) (vi) of R.A. 7160.

The Ombudsman’s decision reportedly indicated that: “Based on the foregoing, it can be gleaned that respondent’s authority from the SP to enter into a contract to sale is not exclusively limited to the complainant alleges that respondent, in behalf of the City, entered into a Deed of Absolute Sale dated 21 May 2014 with Maximo S. Ginco, representing Janel Bianca Cao, for the purchase of land covered by Transfer Certificate of Title No. T-65366 located at Barangay Tipanoy, for the relocation of residents affected by Typhoon Sendong.”

Also, “Respondent’s authority under Resolution No. 13-1216 (Resolution) is limited to landowners identified in the Resolution, who offered to sell their lands.

Respondent was, therefore, not only authorized by the Sangguniang Panlungsod (SP) to enter into a Deed of Absolute Sale with Ginco who was not included in the Resolution, in violation of Section 455 (b) (vi) of the Local Government Code (R.A. 7160).”

By December 1, 2015 Joint Order, respondent was directed to file his CounterAffidavit. And by 7 January 2016 Counter-Affidavit, respondent posit that the Resolution does not restrict his authority to enter into a contract of sale only to the landowners stated therein, citing the Resolution’s “Whereas” clause (Preamble) which reads: “Whereas, there may be other offerors who may, at any time, following the resolution, make last minute offers of their real properties for the (sic) for the same purpose of serving the needs of the DSWD Core Shelter Assistance Fund Program; Whereas, various legal consideration exit [sic] such as, but limited to judicial or extrajudicial settlement in case of estate offered but belonging to deceased owners, the government requirements as to taxes, the appraisal of the City Appraisal Committee, as well as the other laws, rule and regulations pertaining to property acquisition and transfer thereof to the City of Iligan following the sale; offerors indicated in the Resolution.

With such authority, it cannot be said that respondent acted with manifest partiality, “evident bad faith” or gross inexcusable negligence in purchasing the land in question.

The Ombudsman reportedly said: “There is also no evidence that the purchase gave the vendor unwarranted benefits, advantage or preference or it

caused undue injury to the City. There is no probable cause to indict respondent for violation of Section (g) of R.A. No. 3019. There is no evident that the contract entered into by the City, represented by respondent, with Maximo S. Ginco is manifestly and grossly disadvantageous to the government. For the same reasons, respondent’s administrative liability is also not established by substantial evidence.”

Presidential Spokesperson Ernesto Abella has said that the President’s decision to declare a state of lawlessness is constitutional and legal as it is rooted in Article VIII Section 18 of the Constitution which reads: “The President shall be the Commander-in-Chief of all Armed Forces of the Philippines and whenever it becomes necessary, he may call out such Armed Forces to prevent or suppress lawless violence, invasion or rebellion.”

Abella said the declaration is limited such that the Chief Executive can only call out the Armed Forces to suppress the lawless violence.

“It is a different case from the existence of invasion or rebellion. Only if there is invasion or rebellion, and when public safety requires it, can he suspend the writ of habeas corpus or declare martial law,” he added.

The Palace official called on the people to “remain alert to the activities of those who wish to create chaos and prayerfully agree for peace to reign in the land.”

“It takes a courageous and united people who complain less and do more to build the nation we dream of and deserve,” he said.

Drilon said: “While I do not see any widespread lawless violence in other parts of the country to justify calling on the Armed Forces of the Philippines (AFP) to suppress such lawless violence, I defer to the judgment of the President who has access to intelligence information.”

He said the president, however, must be prudent in such declaration because of its effect on the economy, investment and business climate, especially on tourism.

Under the Constitution, the senator said a declaration of lawless violence has no implication on civil liberties.

There is need, however, for the Palace to clarify its parameters to allay the fears of our people, said Drilon.

Set the parameters Meanwhile, Senate Minority Leader Ralph Recto said the president must explain and elaborate in writing his verbal statement placing the whole country under a state of lawlessness.

In a press statement, Recto said a written order will prescribe the specifics and the limits of such declaration, and would result in the clearer enumeration of the activities permitted and prohibited, if any, during the period.

It will also guide the authorities of the strict parameters to be followed in issuing and implementing orders, he said.

If put in writing and formalized through a presidential proclamation, Rector said the nation will be properly informed of the metes and bounds of the state of lawlessness. To prevent the occurrence of the Davao City incident in its jurisdiction, Constantino has directed all police units “to intensify intelligence monitoring, implement target hardening measures, conduct strong checkpoints in constant coordination with Armed Forces of the Philippines (AFP) and other government agencies.”

For his part, PNP-10 spokesperson Supt. Surki Sereñas said the police regional office has yet to receive specific directive from the national headquarters as the agency’s policy implementation of the presidential pronouncement regarding the state of lawlessness and violence.
