What does it take to be a Learner-centered teacher?

For so many years teachers are doing a lot of things for their students. Practically, they do everything to make the students learn. They ask the questions, they call on students, and they add details to their answers. They offer the examples. They organize the content. They do the preview and the review. On any given day, in most classes teachers are working much harder than students. That is why at the end of the day, teachers are very much exhausted from a day’s encounter with the learners.

I’m not suggesting that teachers will never do those tasks mentioned above, but I don’t think students develop sophisticated learning skills without the chance to practice and in most classrooms the teacher gets far more practice than the students.

Nowadays, there are different theories of learning that emerge in the scenario of teaching – learning process.

One of which is the so called “learning by doing”. The role of the teacher here is only to facilitate students’ learning by: first, giving explicit instruction. The teacher here teaches the students how to think, solve problems, and evaluate stu-

dents’ performance based on the instructions given.

Whether we agree or not, students are creative. They only need to be properly guided to come with a good output – those that are even better than expected.

Second, teachers need to encourage students to reflect on what they are learning and how they are learning it.

Learner-centered teachers include assignment components in which students reflect, analyse and critique what they are learning and how they are learning it.

The goal is to make students aware of themselves as learners and to make learning skills something

students want to develop.

And third, teachers allow students to learn while collaborating with others. Research consistently confirms that students can learn from and with each other. Certainly the teacher has the expertise and an obligation to share it, but teachers can learn from students as well. Learnercentered teachers work to develop structures that promote shared commitments to learning. They see learning individually and collectively as the most important goal of any educational experience.

Boosting pupil’s reading comprehension

One of the major challenges that posts among the teachers of today, basically aside from making and enabling every pupil able to read and write, is to boost their reading comprehension skills. Inasmuch as reading does not solely rely on the ability of the pupil to read every line and phrase, it must connote also that they would be able understand what they are reading, further apprehending and comprehending the same.

According to Wikipedia, reading comprehension is the ability to read text, process it and understand its meaning. Although this definition may seem simple to teach, learn or practice, an individual’s ability to comprehend text is influenced by their traits and skills, one of which is the ability to make inferences. If word recognition is difficult, pupils use too much of their processing capacity to read individual

words, which interferes with their ability to comprehend what is read. However, it is worthy to note that there are now schemes, strategies and approaches to improve the reading comprehension of the pupils, their vocabulary and even their reading strategies.

1. Making inferences. In everyday terms we refer to this as “reading between the lines”. It involves connecting various parts of texts that aren’t directly linked in order to form a sensible conclusion. A form of assumption, the reader speculates what connections lie within the texts.

2. Planning and Monitoring. This strategy centers around the reader’s mental awareness and their ability to control their comprehension by way of awareness. By previewing text (via outlines, table of contents, etc.) one can establish a goal for reading“what do I need to get out of this”? Readers use context clues and other evaluation

strategies to clarify texts and ideas, and thus monitoring their level of understanding.

3. Asking Questions. To solidify one’s understanding of passages of texts readers inquire and develop their own opinion of the author’s writing, character motivations, relationships, etc. This strategy involves allowing oneself to be completely objective in order to find various meanings within the text.

4. Determining Importance. Pinpointing the important ideas and messages within the text. Readers are taught to identify direct and indirect ideas and to summarize the relevance of each.

5. Visualizing. With this sensory-driven strategy readers form mental and visual images of the contents of text. Being able to connect visually allows for a better understanding with the text through emotional responses.

6. Synthesizing. This method involves marrying multiple ideas from various texts in order to draw conclusions and make comparisons

across different texts; with the reader’s goal being to understand how they all fit together.

7. Making Connections: A cognitive approach also referred to as “reading beyond the lines”, it involves finding a personal connection to reading, such as personal experience, previously read texts, etc. to help establish a deeper understanding of the context of the text.

Thus, it is of much importance and significance that pupils should comprehend what they are reading so as not to defeat the purpose of integrating the above-mentioned strategies and approaches. Also, in Tagbalogo Elementary School, I, together with our school administrator and fellow teachers and the non-teaching staff, always make it sure that the pupils will be provided with the best quality education they deserve, and one of the fundamentals is to boost the pupils’ reading comprehension skills.

The students try to follow their teacher in manners, dress, etiquette and style of conversation.

During children’s early education, students tend to determine their aims in life and their future plans. A good and visionary teacher

can play a prominent role in establishing the future of his/her students.

When we speak of quality teachers, it means that a teacher must be a symbol of faith and should have a fairly good knowledge of the subject. He or she should feel that the students are entrusted to the teacher and the teacher should avoid any breach of that trust.

The Coach as an Athlete

Dedication, so with perspiration at the same time are the need most ingredients to win a race.

The YES-O of Quezon National High School, Quezon, Bukidnon prepared an activity to promote awareness and involvement of student, teachers and stakeholders, Fun Run held last September 2, 2016 The course is from Freedom Park to the School Site of QNHS that is about three-kilometer distance.

The coach who recently harvested medals from the Division Athletic Meet 2016 got chance to compete. Tension comes more than excitement as it is his first time joining a race. As they were released, he hurdled the first 200m together, side by side with the athletics secondary girls coach. When the edge of gap was marked he then maintained it.

As it goes, the secondary coach advance over him to mark distance from his chasers. The coach

then, tried to relax by walking to recover more strength and finish the said race. The second thirds of the course challenged him more for its inclination. A student volleyball player then came to his side, go by him and cheered him up saying, “Kaya lagi na sir.” Unknowingly the final thirds has been reached a chaser wants to steal his lead. “This is a mind game,” he thinks of it, though he was tired enough, he stood up still and pretended to be okay, increasing the gap, the gap to become the event’s first finisher.

Coach (Richard B. Yap) was proclaimed first place in Stakeholders Category.

The athletics secondary girls coach (Charlie M. Bonifacio) for teacher’s category. And, the DAM two-bronze medalist James Ryan Redondo for the students category.

Indeed, dedication and perspiration are the best ingredients to win over a race.

Challenges Teaching Profession

There is no denying that the profession of teaching is evolving faster than ever.

While the core purpose of transmitting knowledge to the next generation — remains extremely important, the realms of teacher selection, accreditation and assessment are changing very swiftly. Moreover, increasing demand for human capital, due to the rise of the knowledge-based society and the expansion of new technologies, are also impacting the profession.

However, all the focus on structural change must not make us overlook the only truly indispensable element of teaching — teachers themselves. While many pay lip service to the importance of teachers, in practice the rhetoric does not match the reality.

If teachers aren’t respected in society, children won’t listen to them in class, parents won’t reinforce the messages that are coming from school

and the most talented graduates will continue to disregard teaching as a profession… Over time, this declining respect for teachers will weaken teaching, weaken learning, damage the learning opportunities for millions and ultimately weaken societies around the world.

The need for better education through better teaching is clearer than ever. Real improvement can only come when we address the big picture: It’s not only a matter of improving teacher training, but also of attracting more innovation into the sector, through the engagement of new players and new providers. This requires drafting new rules and new regulations that boost competitiveness via openness, particularly through easier accreditation processes. It’s argued that the best performing education systems usually do include the best teacher training systems.

T h e DT I h a s b e e n conducting stakeholder consultations through its One Country, One Voice (OCOV) program which allows stakeholder participation in trade policy formulation. OCOV, launched in 2011, facilitates transparency and accountability as government undertakes the process of engaging in dialogues, building mutual trust, and arriving at rational, sound and balanced trade policies in pursuit of national development.

To date, consultations have been conducted in key cities in the country, particularly on the country’s trade engagements with Japan, the EU, and EFTA – Norway, Iceland, Liechtenstein, and Switzerland.

Rodolfo said that the DTI is set to foster dialogue and gather stakeholder feedback on cross cutting trade and industry policy issues. “Our goal is to build on our offensive interests, identify possible roadblocks and determine the necessary measures to better prepare and strengthen industries to upgrade, thrive, and compete with the country’s European partners,” he added.

Meanwhile, Trade and Industry Assistant Secretary Anne Robeniol said that the upcoming OCOV consultations will focus on promoting wider involvement of stakeholders in the Philippines’ trade engagements with Europe, particularly in further defining the country’s offensive interests and sensitivities in FTA negotiations.

“While we are working to create a more robust trading and investment relationship with the EU and EFTA, our priority is to utilize the current tangible and concrete gains of our trade engagement through

the EU-GSP+ and build on these gains through FTAs,” added Robeniol.

The EU-GSP+ is a preferential tariff scheme which allows the country to export more than 6,000 products to any EU member country tariff free. Last year, with the EU-GSP+ in force, Philippine exports to the EU market grew by 27 percent as compared with total figures recorded in 2014.

According to Robeniol, this is part of DTI’s parallel three-pronged strategy to establish a stronger foothold in the European market which also include securing long-term duty free market access in the EU and the EFTA through separate free trade agreements (FTAs).

Currently, the Philippines is preparing for the 2nd round of negations with the EU on a possible FTA as well as the executive ratification and senate concurrence of the recently signed PH-EFTA FTA. The consultations will be held on 16 September at the DTI International, 19 September at the Seda Abreeza Davao, and 21 September at the Quest Hotel Cebu.(DTI)

TITLE. This Ordinance shall be known and cited as the “COMPREHENSIVE CHILDREN’S WELFARE CODE OF MISAMIS OCCIDENTAL, AS AMENDED”;

Section 2.

DECLARATION OF POLICIES AND PRINCIPLES. The Provincial Government of Misamis Occidental recognizes the important role of children in developing the province and shall promote and protect their physical, moral, spiritual, intellectual, and social well-being; it shall inculcate in the children patriotism and nationalism and encourage their involvement in public and civic affairs.

The Provincial Government also recognizes that the children have rights as provided in the United Nation’s Convention of the Rights of the Child and other international and national instruments.

Thereby, affirming to be the policy of the Local Government of Misamis Occidental that the survival, development, protection and participation rights of children must be given the utmost priority by initiating, developing an integrated, participative, sustainable and equitable development framework and shall work towards the recognition and respect of the role of the family, and shall support the efforts of parents, other child care and development workers, non-government organizations (NGOs) and communities in the nurturing and caring of children.

The Local Government of Misamis Occidental shall ensure that all programs aimed at pursuing the goals for the upholding of the rights of children must be given premium attention when resources intended for the same have been identified and allocated. The Local Government of Misamis Occidental shall ensure that such programs for the children are strictly implemented and protected even in times of adversities, disasters and other structural adjustments.

Moreover, the Provincial Government shall ensure the adoption of all local government units, if applicable, all programs and projects that directly benefit and develop the children and their well-being.

PURPOSES. This Code is enacted with the following purposes: a. To advocate for the rights of children of Misamis Occidental including the three (3) component Cities of Oroquieta, Ozamis and Tangub and promote their welfare and development; b. To ensure that the children’s rights (survival, development, protection and participation) are given priority action by the local government in all aspects including compliance to national government mandates and the United Nations Convention on the Rights of the Child (UNCRC); c. To provide advancement of the quality of life of children enabling them to develop their potentials; d. To provide opportunities for wider community participation in developing the province; e. To ensure the utmost protection of children against all forms of abuse, neglect, violence and exploitation and discharge the principle of restorative justice to children in conflict with the law.

DEFINITION OF TERMS. As used in this Code, the following terms shall mean as follows: (references P.D. 603, R.A. 7610, R.A. 9344, UN-CRC) a. BENEFIT DANCE – refers to any activity which requires women to dance in order to raise funds. b. CHILDREN - refers to persons under the age of eighteen (18) years and those children who are above eighteen, but are unable to fully take care of themselves or protect themselves from abuse, neglect, cruelty, exploitation or discrimination due to physical or mental disability or condition. c. CHILD ABUSE - refers to the maltreatment, whether habitual or not, inflicted to the child which includes any of the following: (1) Psychological and physical abuse, neglect, cruelty, sexual abuse including those done through the internet and emotional maltreatment; (2) Any circumstance(s) which debases, degrades or demeans the extrinsic or intrinsic worth and dignity of a child as a human being; (3) Unreasonable deprivation of his/her basic rights whether survival, development, protection and participation rights. d. CHILDREN AT RISK - refers to children who are vulnerable to, or at risk for being influenced, exploited and/or abused by reason of any personal or family or social circumstances such as, but not limited to, the following: (1) Dysfunctional or broken family; (2) Child prostitution, statutory rape and any forms of sexual abuse; (3) A community with high level of criminality and drug addiction; (4) Being affected by armed conflict-related conditions; (5) Exposure to working conditions hazardous to health, safety and morals which unduly interfere with their normal development; (6) Exposure to street life whether in the urban or rural areas in order to earn a living (child labor); (7) Extreme discrimination, being children of indigenous people or with disability/special needs; (8) Living condition is in extreme poverty and deprived of access to basic services; (9) Being a victim of a man-made or natural disaster or calamity (children in emergencies, and victims of trafficking after a disaster strike or even at normal circumstances); (10) Analogous circumstances which endanger the life, safety and normal development of children. e. CHILDREN IN CONFLICT WITH THE LAW - refers to a child who is alleged, accused or adjudged as having committed an offense under National or Local Laws and Ordinances. f. CHILDREN WITH DISABILITIES OR CHILDREN WITH SPECIAL NEEDS - refers to children with either physical or mental infirmities whether congenital or acquired after birth. g. COMMUNITY REINTEGRATION PROGRAMS - refers to programs established for the purpose of rehabilitating and preparing the child to go back to the community without any prejudice and discrimination. h. DAY CARE - is the provision of substitute parental care and stimulating experiences for the development of children from three to four (3-4) years old when their parents are unable to take care of them during part of the day because of work and some other situations. i. DAY CARE CENTER - is a facility where day care services are provided by an accredited day care worker particularly to three to four (3-4) years old children. j. DEVELOPMENT RIGHTS - these include all opportunities for education, play, leisure, cultural activities, access to information, freedom of thought, conscience and religion that are meaningful to the achievement of their fullest potential. k. DIVERSION - refers to the appropriate process of determining a child’s responsibility or culpability for an alleged offense as well as in determining the measures, if any, to be undertaken by the children and other persons without resorting to formal court adjudication. l. DIVERSION PROGRAMS - refers to programs that children in conflict with the law are required to undergo after they are found responsible for an offense, without undergoing formal court adjudication. m. FAMILY - the basic unit of society and the venue of primary socialization and formative years of children. n. KATARUNGANG PAMBARANGAY - refers to Sections 399-422 of the Local Government Code of 1991 which is commonly known as the Katarungang Pambarangay Law that is responsible in the resolution of conflicts within the Barangay, except, domestic disputes. o. NEWBORN SCREENING – refers to a mandatory procedure to find out if a baby has a congenital metabolic disorder that may lead to mental retardation or even death, if left untreated. p. PARTICIPATION RIGHTS - opportunities to children to take an active role in their respective communities and the entire province means that a child is aware of, informed about and encouraged to communicate his/her views about a topic and matters that pertains to them, and this could result in decisions that will significantly impacts his/her and other children’s survival, holistic development, protection and involvement in their families, respective communities and entire province. The freedom to express their opinions and can make decisions affecting their own lives. To take active part in associations and to assemble peacefully; the right to privacy; the right to age-appropriate and culturally-sensitive information, all in accordance to the child’s evolving capacity. q. PROTECTION RIGHTS - covers circumstances such as special care for refugee children, protection from torture and all forms of abuses, involvement in armed conflict, child labor, drug abuse and sexual exploitation that children be safeguarded. r. RECOGNIZANCE - refers to an undertaking in lieu of a bond assumed by a parent or guardian who shall be responsible for the appearance of the child in conflict with the law, whenever required. s. RESTORATIVE JUSTICE – refers to an approach that emphasizes the ways to heal the tainted relationships of people in the community caused by a criminal act, a process by which the offender can mend the harm he/she has inflicted to the victim and the community and the assurance that the offender can go back to the community without any prejudice and discrimination after going through juvenile delinquency preventive activities. t. SCHOOLDAYS - the days from Mondays to Fridays where classes are to be held, excluding national and local holidays, and those days that classes are suspended as declared by proper authorities. u. STREET CHILDREN - are those children spending or staying in the street eight (8) hours or more without a place to go home or has a home, but refuse to go home and or as defined by United Nations International Children’s Emergency Fund UNICEF as follows: (1) Street Living Children - children who ran away from their families and live alone on the streets.

(2) Street Working Children - children who spend most of their time on the streets, fending for themselves, but returning home on a regular basis.

(3) Children from Street Families - children who live on the streets with their families. w. SURVIVAL RIGHTS - covers children’s rights to life and their basic needs necessary for existence, these include an adequate living standard, shelter, nutrition and access to medical assistance.

ARTICLE II

ARTICLE III PROGRAMS AND SERVICES FOR CHILDREN Section 7.

Community-based services and programs which respond to the special needs, problems, interests and concerns of young persons and which offer appropriate counseling and guidance to children and their families should be developed, or strengthened where they exist.

PROCESS IN FORMULATING COMPREHENSIVE CHILDREN’S PROGRAMS. The process in coming up with Comprehensive Children’s Programs shall be participatory and consultative. The Local Government Unit (LGU) through the Local Council for the Protection of Children, shall call on all sectors concerned, particularly child-focused institutions, non-government organizations (NGOs), people’s organizations, children and youth organizations, educational institutions, churches and other religious institutions, private institutions and government agencies involved with children’s concerns like the Local Social Welfare and Development Offices, Local Health Offices, and the Department of Education (Dep-Ed) to participate in the planning process, in coordination with the national line agencies. The LGU should see to it that children and youth participate in the identification of needs, in the formulation, development and implementation of these programs. The Comprehensive Children’s Program shall be the basis for the formulation of the Local Development Plan for Children and the Local Investment Plan for Children in the Province.

Section 10. PERIODIC REVIEW AND ASSESSMENT OF THE COMPREHENSIVE CHILDREN’S PROGRAMS. The Local Government Units (LGUs) through the Local Councils for the Protection of Children shall conduct a yearly review and assessment of the Comprehensive Children’s Programs as to their effectivity in preventing violations of children’s rights based on the indicators identified in the program. The programs may be modified accordingly.

Section 11. PROGRAMS TO PREVENT VIOLATIONS OF CHILDREN’S RIGHTS a. PREVENTION PROGRAMS. Prevention programs which shall be an important component of the Comprehensive Children’s Program to be implemented by the Local Government Units (LGUs) through the Local Councils for the Protection of Children, schools, youth organizations, and other concerned agencies. These programs shall consist of three levels: (1) Primary Prevention - general measures to promote social justice and equal opportunity which tackle perceived root causes of violations of children’s rights, such as poverty and other forms of marginalization; (2) Secondary Prevention - measures to assist children who are identified as being more particularly at risk, such as those whose parents are themselves in special difficulty or are not caring appropriately for them; (3) Tertiary Prevention - schemes to avoid and prevent violations of children’s rights from happening again. b. In all three levels of prevention, official intervention should be pursued and guided by fairness and equity primarily for the best interest of the child.

Section 12. PARENTING ORIENTATION SEMINARS/SESSIONS/TRAININGS a. Parenting Orientation Seminars/Sessions/Trainings shall be integrated into the curriculum of all primary and secondary schools in Misamis Occidental subject to the Department of Education rules and regulations. b. Marriage License applicants shall be required to participate in a Pre-marriage Counseling with Gender and Child Sensitivity, among other requirements, prior to the issuance of a marriage license by the Office of the Local Civil Registrar. This course becomes an integral part of the existing family planning seminars on reproductive health courses. The Local Councils for the Protection of Children in close coordination with the Provincial Health Office, and the Provincial Population Division shall update the design of the family planning seminar in consonance with this Ordinance. c. As a follow-up to par. (a) and (b), parents/guardians shall also be required to participate in any Parenting Orientation Seminars/Sessions/ Trainings such as Responsible Parenthood and Natural Family Planning Program, Parent Education Sessions (PES), Enhancement and Reaffirmation of Parenting Abilities (ERPAT), Family Development Sessions (FDS), KAlalakihang Tapat sa Responsibilidad at Obligasyon sa PAmilya (KATROPA) and other similar parent education sessions containing values formations initiated by other agencies. d. Local Government Units shall enjoin couples and guardians of children to participate in the Responsible Parenthood Movement initiated by the respective Local Government Units in coordination with the Commission on Population and other government and non-government entities/instrumentalities. e. Such course may also be incorporated in Parent-Teacher Community Association (PTCA) activities for the school year in the elementary and high school levels.

Section 13. Implementing guidelines for the Parenting Orientation Seminars/Sessions/Trainings shall be formulated by the Local Councils for the Protection of Children within one year from the effectivity of this Code.

Section 14. The Local Councils for the Protection of Children and the Offices of the Local Social Welfare and Development and Municipal Population Officers shall initiate the designing of modules for any of the courses referred in to Section 12 in close coordination with non-government organizations (NGOs) with child-focused programs.

Section 15. Comprehensive Programs for Children

The children’s program as embodied in the preceding articles shall be implemented by the PGMO including its component cities and municipalities immediately upon approval of this Code.

Section 9.

ARTICLE IV SURVIVAL RIGHTS OF CHILDREN Section 16. PRIMARY HEALTH CARE - Primary health care is an approach to essential health care based on practical, sound and socially acceptable methods and technology made readily accessible to individuals and families in the Barangay through their full participation and at affordable cost.

In primary health care, people in the barangays are empowered to prioritize their health problems and address them accordingly. The community in itself through the existing organizations such as Women Organizations and child-focused organizations at the Barangay level participates in health planning with the Local Government Units. Implementation of health programs and projects at the Barangay level are made possible by the Barangay Health Workers (BHWs), Barangay Nutrition Scholars (BNS) and other health volunteers who are extension arms of the Rural Health Midwives, Nurses and Doctors of Rural Health Units. Health volunteers and care givers organized by non-government organizations (NGOs) with child health programs shall compliment with the existing health programs of the local government units and shall be part of the councils for synchronization of health interventions. The Provincial Government shall implement a primary health care program through the Provincial Health Office in coordination with or assistance of the City/Municipal Health Offices.

Section 17. The Provincial Government of Misamis Occidental shall ensure to the maximum extent possible the survival of the child. The program on survival shall include the following: a. Pre-natal care of all pregnant women, immunization of 2 doses of tetanus toxoid shall be administered. Based on the policies on the nationwide implementation of the Expanded Program on Immunization or AO No. 39 S-2003, women of child-bearing age (15-49 years old) shall receive tetanus toxoid according to the five (5) dose schedule. Distribution of ferrous sulfate with folic acid to pregnant women from 6 months. b. Monitoring of high-risk pregnancies for immediate referral to proper tertiary or secondary hospital for competent obstetrical and pediatric medical care for mother and child who are at risk; c. All local government units are hereby encouraged to establish birthing clinic manned by skilled and trained health personnel in all far-flung barangays. d. Compulsory compliance of newborn screening. Pursuant to RA 9288 known as the “Newborn Screening Act of 2004”, all newborn babies should undergo newborn screening to determine congenital metabolic disorder within 2 to 3 days after birth but not less than 24 hours from birth. A trained physician, nurse, midwife or medical technologist will collect blood samples for newborn screening. A fee of PHP 600.00 is charged for non-Philhealth members. Newborn screening is covered by Philhealth; e. Monitoring of registration of births and the completion of the immunization series for prevention of the seven (7) immunizable diseases like tuberculosis in children, hepatitis B, diphtheria, pertussis, tetanus, poliomyelitis and measles before reaching the age of one (1) year; f.

Growth and nutritional monitoring with nutritional feeding at school and community and supervision of nutritional intake at home; g. Micronutrient supplementation and universal vitamin A distribution during Garantisadong Pambata implementation and the use of iodized salt at the household level per R.A. 8172; h. Enforcement of R.A. 8976 and on the use and consumption of fortified food products; i.

Pursuant to DOH Administrative Order No. 2009-0025 or Adopting New Policies and Protocol on Essential Newborn Care, providing globally accepted evidence-based essential newborn care focusing on the first week of life. j.

Initiation of breastfeeding within one (1) hour after birth and exclusive breastfeeding to six (6) months and shall be strictly continued until the 12th month and onwards with complimentary feeding; k. Mass Drug Administration to two (2) years old and above with five (5) Diethylcarbomazine and one (1) Albendazole tablets given for five (5) consecutive years for the control and elimination of filariasis; l.

Provision of dental health services to one (1) year to seventeen (17) years old and pregnant women like basic oral health care and education and counseling on health effects of tobacco smoking, diet and oral hygiene; m. Installation of women and children protection unit particularly at the Misamis Occidental Provincial Hospital; n. Screening of the children, preschoolers and primary schoolers through urinalysis and accordingly treat with antibiotics the children with positive findings or with urinary tract infection.

Section 18. PRIMARY HEALTH CARE PROGRAM. The Local Government Units shall establish Barangay Health Centers in all municipalities and cities that shall implement the Primary Health Care Program. Each Barangay health center shall have an Integrated Management on Childhood Illness (IMCI) trained midwife tasked to monitor child health in the Barangay level with a salary commensurate to the task assigned.

Section 19. To further ensure the implementation of Section 16 & 17 of this Code, all Local Government Units shall take appropriate measures: a. To combat communicable and non-communicable diseases and malnutrition within the framework of Primary Health Care, by applying readily available technology and through the provision of adequate nutritious foods and clean drinking water, taking into consideration the dangers and risk of environmental pollution. b. To monitor the full implementation of the Milk Code of the Philippines or the E.O.51 and strictly follow the standards set by law in the processing of any dairy product produced in the province. c. To conduct massive information education on breast feeding by utilizing existing reference materials for effective breast feeding education program and establishment of Milk Bank and Madonna Centers (Breastfeeding Room) in accordance to the standard set by R.A. 10028 also known as “Expanded Breastfeeding Promotion Act of 2009” specifically for working lactating mothers and mothers with nipple abnormalities.

Privileged for BF 4 hours/day. d. To conduct regular environmental sanitation inspection on the availability or sources of potable water supply. e. To likewise conduct regular inspection of the presence of sanitary toilets in every household.

Section 20. CHILD-FRIENDLY HOSPITAL AND CLINICS IN THE PROVINCE. All hospitals and clinics in the province shall set-up Women and Child Protection Unit (WCPU) to include rooming-in facilities and pediatric-appropriate mechanisms and gadgets. Likewise, all hospitals with WCPU shall serve as a one-stop center for victims of violence against children and provide health, medico-legal, legal and psychosocial services. The Provincial Council for the Protection of Children shall establish a committee task to monitor and ensure the compliance of all hospitals in the province.

Section 21. ESTABLISHMENT OF COMMUNITY AND HOUSEHOLD BACKYARD GARDEN. All households within the barangay shall set-up a backyard garden to produce organic and chemical free vegetable for healthy consumption. The Provincial Agriculture Office shall provide necessary seeds and seedlings and necessary technical assistance to the communities to provide the children with healthy foods.

ARTICLE V

RIGHTS AND OBLIGATIONS OF THE CHILD Section 5.

RIGHTS OF THE CHILD: (1) To be born well; (2) To have a name and a nationality; (3) To be free; (4) To have a family; (5) To have a good education; (6) To have enough food and have healthy and active body; (7) To be given opportunity for play and leisure; (8) To be given protection against abuse, danger and violence; (9) To live in a peaceful community; (10) To be assisted and defended by the government, and (11) To be able to express their own views. b. Adopting the UNCRC, the Provincial Government recognizes the following rights of children: (1) Survival (2) Development (3) Protection (4) Participation as specified in the following Articles.

RESPONSIBILITIES OF THE CHILD. Every child, regardless of the circumstances of birth, sex, social or economic status, religion, political

COMPREHENSIVE PROGRAM FOR CHILDREN. Upon approval and pursuant to the provisions of this Code, all component cities and municipalities of Misamis Occidental shall formulate their respective comprehensive programs for children covering at least a period of three years.

Such program shall include prevention of violations of children’s rights, as well as rehabilitation program for Children in Conflict with the Law, to include juvenile delinquency, drug addiction, and other children’s issues.

THE COMMUNITY APPROACH. The Community Approach shall be given special attention in the Comprehensive Program for Children.

This involves addressing community-wide issues and improving the over-all environment of the neighborhood in order to prevent violations of children’s rights through mobilization of human resources within the community. Volunteerism among members of the community to assist in the implementation of the programs shall be encouraged.

DEVELOPMENT RIGHTS OF CHILDREN Section 22.

RECOGNITION OF THE RIGHTS TO EDUCATION The Provincial Government of Misamis Occidental recognizes the right of the child to education and to achieve progressive realization of these rights on the basis of equal opportunity, and shall ensure to: a. Make education free and compulsory according to age bracket based on K to 12 Program (R.A. 10533): (1) 3-4 years old – Day Care (2) 5 years old – Kindergarten Education (3) 6-11 years old – Elementary level (4) 12- 18 years old Secondary Education

(12-16 or 4 years for Junior High School; and 16-18 or 2 years for Senior High School) (5) Special Classes for Children who are gifted and talented or with special needs i.e. autism, hearing-impaired, visually impaired, behavioral disorders, physical disability etc. shall be in accordance to the criteria set by Enhanced Basic Education Act of 2013 particularly under the inclusiveness of enhanced basic education programs designed to address the physical , intellectual, psychosocial and cultural needs of learners. b. Make early childhood, elementary and secondary education available, accessible and free to every child. c. The Barangay Council for the Protection of Children (BCPC) shall coordinate with the school authorities for learners who are at risk of dropping out, marginalized and ensure that learners will be given proper alternative delivery modes.

Promote and encourage the cooperation of non-government organizations, private and people’s organizations, and other funding groups to provide financial assistance to less fortunate and deserving children.

Section 23. EARLY CHILDHOOD CARE AND DEVELOPMENT. The Provincial Government of Misamis Occidental shall ensure the implementation of Early Childhood Care and Development Program for Children zero to four (0-4) years old under the provisions of Early Years Act of 2013 or R.A. 10410, R.A. 8990 ECCD Act. a. Early Childhood Care and Development Program. Two or more of the following forms can exist in one center or venue depending on the needs of the children. In this case, the assistance of a parent volunteer is necessary.

(1) Center-Based Infant Care or Child Minding Centers. For children ages 0-3 years old. The facility can only accommodate a maximum of 10 children. It (2) should be located near the workplace of the parents or it should have a strategic location.

(3) Supervised Neighborhood Play (SNP). Supervised Neighborhood Play- is for children 2-4 years old. SNP provides children with early childhood enrichment activities together with older children through play activities. Each SNP may accommodate children of various ages, but should only have a maximum of 10 members.

(4) Family Day Care Centers. Provide 0-4 years old children with temporary care and creative experiences in the home of an accredited family Child Care (5) Worker for a period of a few hours or whole day, while their parents are attending to important family matters. It serves 6 children at the most.

(6) Day Care C2enters. Pursuant to Republic Act 6972 or the Barangay Level Total Development and Protection of Children Act, Day Care Centers shall be set up in every barangay. The number of centers shall depend on the number of children, preferably proportionate to a ratio of 1:30 of center to children especially in heavily populated sitios/puroks.

(7) Establishment of Standard Day Care Centers: (i) The barangay is enjoined to establish the Standard Day Care structure with the dimension of 6 meters X 8 meters (48sq. meters) and the prescribed standard playground and child-friendly facilities such as swing, see-saw, and slides. (ii) The center must be situated in a safe area and enclosed with a perimeter fence.

(8) Day Care Workers. Preferably a resident of the barangay, at least second year college, shall possess good moral character, has passed a psychological evaluation, and undergone trainings on Early Childhood Care and Development Program (ECCD) of the Department of Social Welfare and Development DSWD. The Municipal Social Welfare and Development MSWD Officer shall conduct a regular technical assessment and monitoring recruitment and hiring of the Day Care Workers and must meet the standards set by the Revised Assessment Tool for Accreditation of Service Providers of DSWD Administrative Order No. 29 dated 2004.

(9) Accreditation of Day Care Workers and Centers. Every Day Care Center and Worker shall be accredited by authorized accreditors of the DSWD. Accreditation shall be based on Revised Assessment Tool and Users’ Manual for the Accreditation of Day Care Worker, other ECCD Centers and Service Providers of DSWD A.O. 29 dated 2004. Renewal of accreditation on or before the expiration of the license shall be compulsory and be done immediately depending upon the result of the assessment. The MSWD Officer shall supervise and monitor the renewal of the accreditation of the day care centers and workers.

(10) Accreditation Period and Security of Tenure. The period of accreditation shall be based on the result of the evaluation on the service provider and the day care center by the accreditors based on the standards set by the DSWD. For purposes of the continuation and stability of the program, the accredited Day Care Worker and Barangay Nutrition Scholar shall in no way be transferred, removed or suspended during the period of his/her accreditation without justifiable cause and due process.

(11) The Provincial Government, in cooperation with the national government agencies and other learning institutions, shall establish training facilities for day care workers which will enable them to earn units equivalent to the units required by the DSWD for accreditation and licensing of Day Care Centers and Day Care Workers.

(12) Honorarium. The Barangay shall allocate funds for the monthly stipend to all day care workers based on the income classification of the Barangay/ municipality which shall be determined by the Sangguniang Barangay. The component cities/municipalities concerned may also provide additional incentives to their Day Care Workers and Barangay Nutrition Scholars. The Provincial Government shall regularly provide yearly incentives, of PHP 2, 000.00 per Day Care Worker to be taken from the General Fund. The Barangay Nutrition Scholars shall likewise receive an Honorarium of PHP 1, 000.00 per year.

(13) Incentives. Barangay Day Care Workers / Barangay Nutrition Scholars with outstanding performance rating shall be given cash reward and/or other incentives by the Provincial, City, and Municipal Government. Reward shall be given during the Provincial Convention of Day Care Workers and Barangay Nutrition Scholars. There will be an annual search for the Most Outstanding Day Care Center/Worker and Barangay Nutrition Scholar.

(14) SSS and PhilHealth Membership. (i) One (1) year after the approval of this Code, all Day Care Workers and Barangay Nutrition Scholars, except those holding regular plantilla or casual positions in the LGUs, shall be enrolled in the Social Security System (SSS) as voluntary member upon entrance to the service. (ii) The Provincial Government, Component Cities/Municipalities and the Barangays, shall each share in the premium payments with the SSS in the following percentage 50% City/Municipality and 50% Barangay.

Section 24.

The shares for premium payments of the Barangay and, Municipality/City shall be taken from their 5% of the General Fund and/or other available sources. (iii) The Day Care Workers/Barangay Nutrition Scholars shall also be enrolled in PhilHealth program. The premiums shall be equally shared by the Municipality/City and the Barangay.

(15) Day Care Workers/Barangay Nutrition Scholars Manuals. A Revised Manual for Day Care Workers/Barangay Nutrition Scholars shall be provided by the Provincial Government in coordination with the Department of Social Welfare and Development (DSWD) and National Nutrition Council (NNC).

(16) Human Resource and Development Program for Day Care Workers. This refers to the competencies and continuing education of the service providers to be undertaken by the DSWD and or the DepEd in coordination with the P/C/ MSWDO. (i) Special Training of the Service Provider on Early Detection on Development Disorder of Children and Child Protection. (ii) Orientation Training and or Review of the Revised Day Care Workers Manual. (iii) Orientation Training of DCWs on the Early Childhood Care and Development Checklist. (iv) Preschool (Kindergarten) aged 5 years old: (a) Institutionalization of Kindergarten based on the K to 12 Basic Education Program. (b) Absorption of Kindergarten teachers into the regular teacher’s plantilla if qualified for the position according to DEPED standards. (v) All Day Care Workers and other Early Childhood Care Teachers shall undergo training in Early Childhood Education Trainings/Courses in public or private institutions to ensure quality education for children. a. PRIVATE SECTOR ECCD PROGRAM. Private Sector programs are those funded and managed by private organizations and institution, NGOs and POs duly recognized and/ or accredited by national government agencies in accordance with the standard set by the national agencies in consonance with Republic Act No. 8980. b. INSTITUTIONALIZATION OF THE ECCD PROGRAM. The Early Childhood Care and Development Program shall be institutionalized in all cities and municipalities in the Province of Misamis Occidental. c. ESTABLISHMENT OF HEADSTART (FOR THE GIFTED AND THE TALENTED) AND SPECIAL EDUCATION (SPED) CENTERS IN EVERY CITY AND MUNICIPALITY. The DepEd with the assistance and support of the Local Government Units, shall ensure that a Special Education Center be set-up in every city and municipality consistent with the Accessibilty Law and Early Years Act of 2013.

All children who are gifted or with special needs and children with disabilities shall be enrolled in Special Education Centers/Classes and ensure involvement and participation in any community/school programs and activities.

ELEMENTARY AND SECONDARY EDUCATION. In coordination/consultation with DepEd, it shall be the duty of every barangay in the province to establish at least an annex public primary/elementary school to cater to the needs of children in the far-flung/remote areas. Likewise, every city/municipality shall set up at least one Public High School and Integrated School.

The LGUs through the Local School Board shall provide accessibility of schools for children by providing financial and/or material assistance in the construction, maintenance/repair and rehabilitation of school buildings and facilities.

The LGUs through the Local School Board shall monitor the compliance of DepEd order and issuances related to collection of fees.

The LGUs in coordination with NGOs and/or other private organizations shall provide scholarships or educational assistance, but not limited to, school uniforms, school supplies and other innovative initiatives to indigent, but deserving children in public schools.

In partnership with the Local Health Board and Local Nutrition Council, the Local Government Units (LGUs) and the Department of Education (DepEd) shall collaborate for the monitoring of health and nutritional status of children in schools; promotion of proper hygiene and sanitation; and establishment of hygiene and sanitation facilities such as hand washing facility, potable water, separate sanitary toilets for boys and girls and the like.

Section 25. TERTIARY EDUCATION. The Provincial Government shall establish a College Scholarship Program to encourage poor but deserving high school graduates in the pursuit of their college education. a) The scholarship grantees shall be distributed equally to all municipalities at four (4) slots per municipality and to be screened by the Scholarship Committee created by the Chief Executive. b) The basic qualification of the scholars shall be the following: (1) The applicant must be a resident of the Province of Misamis Occidental since

(2) The family income shall not be more than One Hundred Twenty Thousand (P120,000.00) per annum.

(3) Other qualification requirements as may be provided by the Council such as but not limited with the grade requirements.

(4) The applicant have passed the qualifying examination.

The scholars shall enjoy free tuition fees, other school obligations and other benefits as may be prescribed by the Council until his/her graduation.

Section 26.

As much as possible, after graduation the scholars concerned shall render services within the Province of Misamis Occidental in private or public entities at the minimum of 5 years. The Provincial Council for the Protection of Children (PCPC) is the one responsible in the placement and monitoring of the graduates granted by scholarship who are ready to and/or already rendering their services.

PROVISION OF SPORTS FACILITIES AND MUSICAL INSTRUMENTS AND OTHER SKILLENHANCING FACILITIES. Twenty percent (20%) of the 10% of the Sangguniang Kabataan Funds shall be used to provide sports facilities for children (below 18) such as, but not limited to, basketball, badminton, and volleyball courts, soccer fields and baseball diamonds.

Likewise, musical instruments shall also be provided, such as guitars, drums and other instruments.

Provide funds from the Local School Board for sports facilities, equipments and musical instruments to schools that have facilities but are inadequate. Also, the funds from the Local School Board shall be allocated to procure skill-enhancing facilities like equipments used in dressmaking, carpentry, and other life skills activity integrated in the school curricula or under Home Economics.

OUT-OF-SCHOOL CHILDREN. The Unlad Kaunlaran Program (UKP) should be strengthened. Said program shall ensure that skills training and sports development shall be given to Out-of-School Youth (OSY). As much as possible, the skills training must be relevant to the talents, potentials and interests of every child.

The Provincial Federation President of the Sangguniang Kabataan, Federation Members of Children and Youth Associations and the Provincial Social Welfare and Development Office (PSWDO) of the Province are hereby mandated to formulate an annual plan for the out-of-school youth that will benefit their respective community. Twenty percent (20%) of the 10% of the Sangguniang Kabataan Funds will be used for activities related to the Alternative Learning System (ALS) and all other activities of the association. Further, constant monitoring and evaluation of programs/projects implemented for out-of-school-youths (OSYs) shall be closely done by the PSWDO. BALIK-ARAL PROGRAM. In consonance with Education for All (EFA), the City and Municipal Government shall support the implementation of the Balik-Aral Program under the Alternative Learning System (ALS) The City and Municipal Government shall make yearly assessment of the number of children and youth that have stopped going to school and shall ensure they are informed of the Balik-Aral Program that could grant them opportunity to go back to school.

SUPPORT TO EDUCATION PROGRAMS. Fund Appropriation. The Local School Board shall set aside appropriation from the Special Education Fund, likewise the Local Government Units (LGUs) shall allocate portion of their 20% component of the Internal Revenue Allotment for any or all of the following: a. Capability-Enhancement programs/trainings of teachers and parents b. Upgrading of school buildings and facilities and equipments with inclusion of children with disability c. Scholarship and training programs to deserving DepEd teachers including specialized team of educators handling Muslim and IP classes d. Program materials for preschool e. Reading literacy program for elementary school f. Development and production of contextualized children’s literature and relevant materials g. Strengthening of Local School Board h. Award system as incentive to high performing teacher/school i. Other educational related activities The Local School Board Fund shall also be made accessible for all elementary and secondary schools.

ROLE OF PARENTS. Pursuant to PD 603 otherwise known as the Child and Youth Welfare Code, all parents are required to enroll their children in schools to complete at least an elementary education. All necessary assistance shall be given to their children in the form of school supplies, school uniforms or whatever constitutes as a bar to a child’s regular attendance in schools or access to education.

PRACTICE OF ONE’S CULTURE AND RELIGION. The right of the children to choose their religious and cultural beliefs shall be respected.

ARTICLE VI PROTECTION RIGHTS OF CHILDREN

Section 32.

RESPONSIBLE PARENTING. Being a parent carries with it great responsibility. It is a role that cannot be played on the basis of chance. It involves skills, responsibilities and experiences in attending to and providing for the physical, emotional and spiritual needs of children. Therefore, would be parents shall undergo Responsible Parenting Seminar by an accredited marriage counselor to properly guide them in child rearing to include positive ways of disciplining children. The Pre-Marriage Counseling Team composed of the Local Population Commission, Social Welfare and Development Office, Health Office and Agriculture Office and church leader/s shall conduct the counseling activity as scheduled. Married couples shall likewise undergo a compulsory Marriage Counseling Service as stated in Section 12 of this Code.

Likewise, a value formation focusing on spiritual nurture shall be incorporated in the counseling sessions, health education classes, parent-teachers-community association assemblies and family development sessions initiated by the Provincial Social Welfare and Development Office (PSWDO).

Section 33. RESPONSIBILITY OF PARENTS / GUARDIANS / FAMILY. Family members and persons entrusted with the care and custody of children shall have the duties and responsibilities: a. Refrain from using any form of physical, verbal, emotional and psychological abuse and corporal punishment towards their children, instead use positive discipline. b. Educate parents on all forms of abuse, neglect, exploitation and violence against children and to be aware of the safety measures as provided for by law. c. Provide equal, fair treatment to their children and care within their financial means and shall not make poverty the reason of neglecting and abandoning their responsibility towards their children. d. Provide adequate support to their children and not to force them to work for augmentation of family income and be exposed to hazard. Parents shall not alter or falsify nor conceal the age of their children in order to facilitate child’s employment. e. Provide support to the gifted and special children with special attention, education and training by appropriate institutions private or government, depending on their capability or resources. f. Provide opportunity to children to express views, opinion and participate in decision making at home and will always consider the best interest of the child. g. Provide information and capacitate their children on what to do before, during and after a disaster strike their community. This not only refers to natural but with man-made disasters as well. Children must first be equipped by their parents on what to do and how to help themselves and others in times of disasters.

Section 34. MANDATORY REPORTING. It shall be the duty of every citizen who has personal knowledge of the facts and circumstances of the child suffering from any abuse, neglect, abandoned by his/her parents or guardian to immediately report the matter by any means to the nearest Office of the Provincial/City/Municipal Social Welfare and Development or any Police station and other law enforcement agencies or to the Local Council for the Protection of Children.

The Provincial/City/Municipal Social Welfare and Development Office shall ensure that their communities are well-informed of what child protection is and the various issues on child abuse, as well as, the reporting mechanism and process which a citizen can follow.

Section 35. MANDATORY APPEARANCE DURING COURT HEARINGS. It shall be the duty of the government and private physician concerned to appear before the court with corresponding medical records and other pertinent documents to facilitate the resolution of the case per R.A. 9262 and R.A. 9344 and failure to appear for the purpose, the Court shall issue summons to compel the persons concerned to appear in court.

Section 36. CHILDREN IN CONFLICT WITH THE LAW. The Provincial / City / Municipal Government in coordination with the Philippine National Police, Prosecutors Office, Department of Health, Department of Social Welfare and Development and the Commission on Human Rights shall ensure that Children in Conflict with the Law are protected from any form of abuse, exploitation and discrimination as provided for in R.A. 9344 otherwise known as the Comprehensive Juvenile Justice and Welfare Act of 2006: a. Bahay Pag-asa for Diversion Program of Children in Conflict with the Law shall be established by the Provincial Government in coordination with the Department of Social Welfare and Development and in support of the City/Municipal Government to take care of children who have been apprehended and whose case is still pending before the court or whose sentence has been suspended due to minority age. Further, a Bahay Pag-asa Youth Home/Center shall be established as transition home for children in conflict with the law (CICL) and shall be equipped with necessary facilities. b. Comprehensive Juvenile Intervention Program. Each Local Government Unit shall formulate a Comprehensive Juvenile Justice Program through the Local Council for the Protection of Children and in coordination with other stakeholders, NGOs and other child institutions in the locality for planning and implementation. c. A certified and competent psychologist/psychiatrist shall be hired by the Provincial Government, and a Registered Social Worker to be hired by the respective LGUs to handle Children in Conflict with the Law as provided for in R.A. 9344. d. Children admitted at the Bahay Pag-asa shall be provided with the support services which include among others: (1) Psychosocial or stress debriefing support services (2) Practical Skills Development Training (3) Personal Enhancement Training (4) Livelihood Program, and (5) Value Formation e. The Provincial/City/Municipal and Barangay shall implement the Principle of Restorative Justice by requiring a process of resolving conflicts with the maximum involvement of the victim, abuser, parents and community. Reparation for the victims and reconciliation of the abuser to the offended party and the community shall be the ultimate goal, thereby effecting child’s reintegration into the society.

Section 37. CREATION OF WOMEN AND CHILDREN PROTECTION UNIT (WCPU) AND WOMEN AND CHILDREN PROTECTION DESK AND POLICE PROCEDURES. The Provincial Government shall create at the local level a Women and Children Protection Unit which composition, functions, operations and programs shall be provided by the Philippine National Police Office (PNP).

Further, every police station in the province shall have a Women and Children Protection Desk tasked to handle cases involving children. Child-friendly police procedures as contained in the Police Handbook on Cases of Children in Especially Difficult Circumstances shall serve as the basic guideline in dealing with cases involving children. Each PNP element/personnel

shall be provided a copy of the said handbook. The said section must be administered by a female police officer.

STRENGTHENING OF THE LOCAL COUNCIL FOR THE PROTECTION OF CHILDREN (LCPC) AND THE BARANGAY COUNCIL FOR THE PROTECTION OF CHILDREN (BCPC).

The Provincial Government and the DILG shall ensure that every city, municipality and barangays have functional LCPC and BCPC. Section 39. CHILDREN AND OTHER SEXUAL ABUSE. Children, whether male or female, who, for money, profit or any other consideration or due to coercion or influence of any adult, syndicate or groups, indulge in sexual intercourse or lascivious conduct, are deemed to be children exploited in prostitution and other sexual abuse.

Section 38.

The penalty as prescribed in Section 5 of Republic Act 7610 shall be imposed upon the following: a. Those who engage in or promote, facilitate or induce child prostitution which include, but are not limited to, the following: (1) Acting as a procurer of a child prostitute by means of written or oral advertisement or other similar means; (2) Inducing a person to be a client of a child prostitute by means of written or oral advertisements or other similar means; (3) Entering into a relationship with, or taking advantage of a child as prostitute; (4) Threatening or using violence towards a child to engage him/her as a prostitute or participant in indecent shows; (5) Giving monetary consideration, goods or other pecuniary benefit to a child with the intent to engage such child in prostitution. b. Those other persons who commit the acts as stated in the Article III of Republic Act No. 7610 and shall be penalized accordingly as prescribed thereof.

Section 40. OBSCENE PUBLICATIONS AND INDECENT SHOWS. Any person who shall hire, employ, use, persuade or coerce a child to perform in obscene exhibitions and indecent shows, whether live or in video, pose or model in obscene publications or pornographic materials shall suffer the penalty as prescribed in R.A. 7610.

Section 41. BAN OF CHILDREN IN BENEFIT DANCES AND SIMILAR ACTIVITIES. Children are banned to participate during benefit dances and other similar activities such as foam parties, bikini opens, discos and other similar performances. Fund raising activities shall not include benefit dance as defined in this code. Any person caught promoting such act in the barangay shall be punished after due proceeding by the court of justice having jurisdiction thereof.

Culturally relevant activities shall be promoted, yet, under responsible adult supervision.

School-based activities that are not exploitative of children are not included in this provision.

Section 42. CHILD TRAFFICKING. Any person who shall engage in trading and dealing with children including, but not limited to, the act of buying and selling of child for money or for any other consideration or barter, shall suffer the penalty as prescribed in R.A. 9208.

Section 43. ATTEMPT TO COMMIT CHILD TRAFFICKING. There is an attempt to commit child trafficking under any of the following circumstances: a) When a child below 18 years of age travels alone without written permit or justification from the child’s parents or legal guardians; b) When a pregnant mother, father or guardian executes an affidavit of consent for adoption for a consideration; or gives his/her consent, participates or in any manner causes the registration of the birth of such child in the name of another with or without consideration, and c) When a person, authority, agency or institution who are witnesses to and fails to reports transactions related to circumstances in child trafficking.

A penalty prescribed in R.A. 9208 shall be imposed upon the principals of the attempt to commit child trafficking under this Code.

Section 44. MANDATORY SERVICES TO TRAFFICKED PERSON. Pursuant to Section 3 of R.A. 9208, there shall be collaborative efforts among Local Governments Units in coordination with other concerned national agencies, non-governmental organizations and private sectors to provide available services to trafficked person.

Section 45. CURFEW HOURS FOR CHILDREN. Upon the discretion of each city/municipality, and depending upon prevailing conditions, curfew hours for minors may be imposed by such city/municipality subject to existing laws.

Section 46. GAMBLING, COCKPIT, MAHJONG, VIDEO KARERA AND OTHER GAMBLING PLACES. Children should be totally banned from direct or indirect participation, promotion and the like, from any form of gambling and betting.

Children caught inside gambling premises shall be dealt with based on local ordinances without demeaning the dignity of the child.

OWNER/S, OPERATOR/S, MANAGER/S OR ANY RESPONSIBLE PERSONS. The owner/s, operator/s, manager/s or any responsible person of a cockpit, mahjong parlor, funeral parlor (where gambling is being made during wake) and other gambling establishments, whether licensed or not, operating within the Province, shall be strictly prohibited from admitting or allowing children to enter/participate in the said establishment for business or profit and for whatever purpose.

PRESUMPTION OF CONSENT. If a child is found inside any gambling establishment and is participating, it is presumed that his/her entry is with the permission of the owner/ operator/manager or any responsible person of the said establishment.

CORPORATE-OWNED GAMBLING ESTABLISHMENT. If a gambling place is owned by a corporation, the President or its Chief Executive Officer or any member of the Board of Directors who personally authorized, allowed, consented, or acted in conspiracy with the manager or any person responsible for the commission of the prohibited acts shall be also held criminally liable as principal.

NO ADMITTANCE OF CHILDREN. No children shall be admitted in any bars, clubs, cafes or any similar establishments, which sell liquors. However, children between ages 13 to 17 years maybe allowed entry to the said establishments if accompanied by their parents, adult relatives and other responsible adults.

Proof of ages shall be required from the parents or guardians before children aged 13 but below 18 may be allowed entrance.

CONTROL ON MINORS ENTRY TO HOTELS, MOTELS AND LODGING HOUSES. Minors are prohibited to check-in in hotels, motels and lodging houses within the city except when accompanied by parent/guardian who is obliged to show proof of filial relationship between the latter and the minor through presentation of IDs, other document or available means of establishing filial relationship.

PROMOTION OF POSITIVE DISCIPLINE AND PROHIBITION OF CORPORAL PUNISHMENT. The Provincial Council for the Protection of Children (PCPC) shall develop a comprehensive program to promote positive discipline in lieu of corporal punishment of children. A continuing information dissemination campaign shall be conducted regarding benefits and long term effects to the child.

The use of corporal punishment which includes emotional, degrading and humiliating punishment on children shall be prohibited in the home, early childhood care and development facilities and day care centers, schools and other educational institutions, child caring centers, religious institutions, health care centers and facilities, community centers, sports centers, government units, and in other places where there are children. Parents, yayas, house helpers and caregivers, foster parents, guardians, relatives who have custody of the child, or other persons legally responsible for the child including those exercising special or substitute parental authority, school teachers, personnel and officers of both public and private academic and vocational institutions, employers and supervisors, service providers, nuns, priests, pastors and other members of religious congregations or churches, or any other person under whose care the child has been entrusted to and who inflicts corporal punishment on the child shall be liable in accordance with existing penal laws.

PROHIBITION OF EARLY, FORCED AND ARRANGED MARRIAGE. Marriage including informal or customary union or live-in arrangement between an adult and a child or between two children is prohibited. Existing penal sanctions shall be imposed on adults who are involved in these unions.

PERIODIC MONITORING. There shall be a Task Force created in each city/municipality which shall be mandated to conduct periodic monitoring at least twice a year at -the karaoke/videoke bars and other establishment for the purpose of ensuring compliance of this Code. A report shall be submitted by the secretariat of the said Taskforce to the Local Council for the Protection of Children (LCPC).

REGULATED ACTS OVER INTERNET CAFES AND COMMERCIAL VIDEO CENTERS. Owners of internet café and commercial video centers shall share the responsibility of promoting and protecting the best interest of children that facilitates their educational development.

VIDEO / COMPUTER ESTABLISHMENT. The owner, operator or responsible person of any commercial video or computer establishment, operating within this Province shall be STRICTLY PROHIBITED from admitting or allowing student-minor or pupil/s in all levels from any school, public or private, including technical or vocational schools, to enter and avail services of such establishment during school days from 7:00 in the morning to 5:00 in the afternoon except during those periods and cases expressly provided by the succeeding section.

CONDITION FOR THE ADMISSION OF STUDENTS TO VIDEO/ COMPUTER ESTABLISHMENT DURING SCHOOL HOURS. Any commercial video or computer establishment allowing children to enter the said establishments during school days pursuant to the authorized research or activity for educational purposes shall not be covered by this Code; provided, that the student or group of students/pupils can present a school clearance or permit signed by the Principal or the Teacher-In-Charge.

For this purpose, the internet café owners are authorized to provide a maximum of two (2) hours for children to access the internet.

Section 58. PRIMA FACIE. Unless proven satisfactorily, when a child is found inside a commercial video or computer establishment there is a prima facie presumption that he/she managed his/her way in the admission or permission of the owner, operator or responsible person thereat.

Section 59. INTERNET CAFÉ. Internet café owners are mandated to install parental control utilities/ softwares in order to prevent children from accessing pornographic sites/ materials and prevent the children to engage in any pornographic activities. Installation of private room is also prohibited.

Section 60. POSTING OF SIGN. The internet café owners are mandated to post the following statement within their establishment: “ACCESS TO PORNOGRAPHIC SITES AND MATERIALS ARE PROHIBITED IN THIS ESTABLISHMENT” Section 61. SMOKING BAN TO CHILDREN. It shall be unlawful for a minor to smoke cigarettes.

Children are barred from procuring and/or trying the vice of smoking. Presidential Decree No. 603, as amended, shall be made to apply to minors caught smoking cigarettes.

Section 62. UNLAWFUL SELLING OF CIGARETTES. It shall be unlawful for any person to sell to, or entertain the purchase of cigarettes or cigar products to a minor.

Section 63. POSTING OF NO SMOKING SIGNAGES AND GRAPHIC HEALTH WARNING POSTERS. The owner of establishment offering, distributing or selling tobacco, alcohol products and other mind-altering substances to minors shall post warning signs at the conspicuous area in their establishment informing the public of its health hazards to minors.

Section 64. ROLE OF PROVINCIAL INFORMATION OFFICE AND SANGGUNIANG KABATAAN RELATIVE TO SMOKING BAN AND SELLING OF CIGARETTES. There shall be collaborative efforts of the Provincial Information Office and Sangguniang Kabataan Federations at all level for massive information dissemination on the negative effects of smoking among children.

intensify campaign through fora, symposia and other activities against substance abuse either drugs, and other addictive substances among children and using children as handler, dealer and seller of prohibited drugs in coordination with the PNP and Local Social Welfare and Development Office (LSWDO). Any person caught using children as handler, dealer, seller and even user of prohibited drugs and other substance shall be penalized according to existing laws.

PROHIBITION AGAINST WORST FORMS OF CHILD LABOR. No child shall be engaged in the worst forms of child labor which refer to any of the following as stated in R.A. 9231: a. All forms of slavery, as defined under the “Anti-Trafficking in Persons Act of 2003” or practices similar to slavery such as sale and trafficking of children, debt bondage and serfdom and forced or compulsory labor, including recruitment of children for use in armed conflict, or b. The use, procuring, offering or exposing of a child for prostitution, for the production of pornography or for pornographic performances; or c. The use, procuring or offering of a child for illegal or illicit activities, including the production and trafficking of dangerous drugs and volatile substances prohibited under existing laws; or d. Work which by its nature or the circumstances in which it is carried out, is hazardous or likely to be harmful to the health, safety or morals of children, such that it; (1) Debases, degrades or demeans the intrinsic worth and dignity of a child as a human being; (2) Exposes the child to physical, emotional or sexual abuse, or it is found to be highly stressful psychologically or may prejudice morals; (3) Is performed underground, underwater or at dangerous heights; (4) Involves the use of dangerous machinery, equipment and tools such as powerdriven or explosive power-actuated tools; (5) Exposes the child to physical danger such as, but not limited to, the dangerous feats of balancing, physical strength or contortion, or which requires the manual transport of heavy load; (6) Is performed in an unhealthy environment exposing the child to hazardous working conditions, elements, substances, co-agents or processes involving ionizing, radiation, fire, flammable substances, noxious components and the like, or to extreme temperatures, noise levels or vibrations; (7) Is performed under particularly difficult conditions; (8) Exposes the child to biological agents such as bacteria, fungi, viruses, protozoans, nematodes, and other parasites; (9) Involved the manufacture or handling of explosives and other pyrotechnic products.

EMPLOYMENT OF CHILDREN. a. Children as defined in this Code shall not be employed, unless: (1) The minimum requirements as stated in Section 12 of R.A. 7610 and R.A. 7658 and R.A. 9231 are present; and (2) The employer registers the child who is above 15 years old at DSWD based on rules and regulations of such office, aside from the other regulations of the law. b. Prohibition on the Employment of Children in Certain Advertisements. No person or corporation shall employ a child as a model or endorser, in whatever form, for any commercial or advertisement promoting alcoholic beverages, intoxicating drinks, tobacco and its by-product, junk foods and any product or advertisement that promotes violence.

CHILDREN AS SOCIAL INDICATORS OF LOCAL CONDITIONS. Children are hereby declared as social indicators of local conditions. It shall be the responsibility of the LGUs in Misamis Occidental and other sectors in civic society to resolve armed conflicts, mitigate the effects of disaster, calamities and climate change through the provision of various programs and services to realize the mandates stipulated in UNCRC. RESPECT FOR THE INTERNATIONAL HUMAN RIGHTS AND HUMANITARIAN LAW RELEVANT TO ARMED CONFLICT, DISASTERS/CALAMITIES AND CLIMATE CHANGE. The Provincial Government of Misamis Occidental undertakes to respect and ensure compliance of the rules of international human rights and humanitarian law applicable to Philippine armed conflict, disasters, calamities and climate change relevant to the child.

Specifically, the following policies shall be observed: a. Children shall not be the object of any attack and shall be entitled to special respect.

They shall be protected from any form of threat, assault, torture and other cruel, inhuman and degrading treatment; b. Children shall not be recruited to become members of the Armed Forces of the Philippines, or its civilian units, or other armed groups, not be allowed to take part in any fighting, nor used as guides, couriers or spies; c. Delivery of basic social services such as education, primary health, protection and emergency relief services shall be kept unhampered and organized; d. The safety and protection of personnel who provide service including those who are involved in fact-finding missions, relief and rehabilitation from both government and non-government institutions shall be ensured. e. Public infrastructures such as day care centers, schools, Barangay health centers, playgrounds, hospitals and rural health units shall not be utilized for military purposes such as, command posts, barracks, detachments and supply depots; f. Appropriate steps shall be taken to ensure that children are not separated from their families as a result of displacement due to armed conflict, disaster/calamities, and facilitate the immediate reunification with their families of separated children; g. The Provincial Disaster Risk Reduction and Management Office (PDRRMO or (PDRRMCs) shall set up early warning systems to effectively inform and warn the general public about natural hazards or conflicts that are likely to occur in the city.

EVACUATION OF CHILDREN DURING ARMED CONFLICTS, DISASTERS AND CALAMITIES. The Provincial Government shall give priority to the needs of children and adolescents, pregnant women and girls, lactating mothers and persons with disabilities in the event of an evacuation as a result of armed conflict and disasters. The Provincial Government shall likewise ensure that children evacuated are accompanied by persons responsible for their safety and well-being as well as their protection.

CHILDREN AND FAMILY PSYCHOSOCIAL SUPPORT PROGRAM. The Provincial Social Welfare and Development Office (PSWDO) in coordination with Department of Health (DOH) and non-government agencies shall design a comprehensive psychosocial support program for both children and their families affected by armed conflicts, disasters, calamities and other crisis situations experience by the child/children.

DIFFERENTLY-ABLED FRIENDLY STRUCTURES. Differently-abled friendly structures shall be established in government buildings, schools, public markets and other places.

RIGHTS OF CHILDREN ARRESTED FOR REASONS RELATED TO ARMED CONFLICT. Any child involved in armed conflict that has been rescued or surrendered is regarded as a victim and entitled to the following rights: a. Treated with respect and in a child-sensitive manner. b. Immediate tracing of and reunification with the victim’s family is separated. c. Immediate access to culturally-sensitive and appropriate medical and health services, psychosocial services and rehabilitation and reintegration programs including alternative parental care, if needed. d. Interventions for Muslim and IP children shall be provided in recognition of the traditional structures and institutions in their communities. e. Access to education programs that are appropriate to his or her needs. f. Immediate free legal assistance and physical security upon rescue. g. Immediate notice of such arrest should be given to the parents or guardians of the child not to exceed 24 hours; and h. Release of the child on recognizance within 24 hours to the custody of the LSWDO or any responsible member of the community as determined by the court.

MONITORING AND REPORTING OF CHILDREN IN SITUATIONS OF ARMED CONFLICT, DISASTERS AND CALAMITIES. The Punong Barangay or any designated official of the Barangay affected by the armed conflicts, disasters and calamities shall submit names, sex and birthdays of children residing under his jurisdiction to the CDRRMO, which shall forward to PSWDO within 24 hours from the outbreak of the armed conflict, disasters and calamities.

CIVIL REGISTRATION AND VITAL STATISTICS (CRVS). The Local Government Unit shall ensure that birth registration are free and in any case that the Civil Registry records will be washed out by any disaster or calamities, the LGU shall provide free reconstruction of birth registrations.

The Provincial Government of Misamis Occidental shall uphold the right to participation of children in development and governance. Likewise, it shall ensure child representation in the Local Council for the Protection of Children (LCPC) in the Provincial, Municipal and Barangay levels.

PARTICIPATION OF CHILDREN IN SOCIAL NETWORKING AND MEDIA. The interest and welfare of children in the family, school, community and other organizations/institutions shall acknowledge the right of children to be heard. Each child, regardless of age, sex, and tribe has the right to express his/her opinion freely insofar as such opinion is not contrary to law, morals, public safety and public policy. It shall be taken into account through conduct of training/seminar to children, social participation and provide a column on the existing newsletter of the Province wherein children are the contributors.

Further, the Provincial Government shall observe every second Sunday of December as National Children’s Day of Broadcasting in recognition of the right of children to freedom of thought and expression. Under this law (R.A. 8296), television, and radio stations nationwide shall allocate a minimum of three hours airtime to children.

RIGHT OF CHILDREN TO INFORMATION. In accordance to Republic Act 8370 or Children’s Television Act of 1997, the Province shall uphold the right of children to access information particularly on programs affecting or benefiting them either in schools and communities. It shall be disseminated to children through various platforms like the use of social media; campaign activities; information, education materials; forums and other awareness raising activities in coordination with the LGU, schools and NGOs. CONVENTION OF MINORS FOR PURPOSES OF CONSULTATION. It is important to consult and provide venue for expression of children’s rights relevant herewith, it is necessary that children 7 to 12 years old and 13 to 18 years old (based on their evolving capacity) are convened once a year specifically during the Children’s Month Celebration to hear collectively their clamors and needs. All children representing schools, churches, child-led organizations, out-of-school children and youth shall be part of this event and ensure children’s participation in the planning and implementation of the convention/ assembly. Every NGO concerned with these groups of children shall be instrumental in the process of the preparation and evaluation of the convention.

PARTICIPATION OF CHILDREN IN MONITORING CHILD RIGHTS AND OTHER CHILDFOCUSED LAWS. The Provincial Government through PSWD and PCPC shall ensure children’s participation in the monitoring child rights based on UNCRC and other childfocused laws. The Provincial Government shall develop and implement a set of objective criteria and process of selection to ensure that the process is inclusive and ensure that the periodic review of Convention of the Right of the Child (CRC) is participated by children as well as report is submitted to higher governing body for inclusion.

The Province shall promote the formation of child-led organizations formal or informal groups and support their initiatives that will serve as venues for children to express their talents, develop their capacities and participate in child-friendly community affairs. Such right can be expressed by children through membership to LCPC, federations, and other organizations.

Membership in the Local Council for the Protection of Children shall be subject to review and amendment of the Department of Interior and Local Government through appropriate issuances per IRR of R.A. 9344.

Section 83. CHILD REPRESENTATIVES. The child representatives shall at all times be given the opportunity to participate in all the undertakings of the Local Council for the Protection of Children (LCPC), including the right to express their views and opinions in all matters affecting their welfare. He/she shall be willing, articulate, and able to express the issues and concerns of children in the community.

Criteria for the selection of child representative: a. Must be between 10-15 years old b. Must be an active participant of the community c. Must be an active member of an accredited organization in the barangay, school, or faith-based group d. Must be able to articulate children’s issues and concerns e. Must have at least a residency of one (1) year in the barangay f. Must have good leadership skills g. Must have balanced views on gender, religion and ethnicity, and disabilities DUTIES OF THE BARANGAY. It shall be the duty of every barangay to organize a children’s organization which shall be guided/facilitated by a member of the Barangay Council for the Protection of Children as chosen by the children’s organizations.

OFFICERS OF THE FEDERATION OF CHILDREN’S ORGANIZATIONS IN THE BARANGAYS. The different Children’s organizations in the barangays, such as, but not limited to, the following: theater arts groups, church groups, school-based organizations, sports groups, shall convene and elect among themselves their own set of officers as follows: a. Federation President b. Vice President c. Secretary d. Treasurer e. Auditor f. Public Information Officer g. Social Managers

Provided that, incumbent Sangguniang Kabataan Officers are disqualified from being elected as Federation officers.

MUNICIPALITY/CITY CHILDREN FEDERATION. The Presidents of Children’s Organizations in Barangays shall elect among themselves, two (2) representatives to the Municipal Council for the Protection of Children (MCPC). In like manner, the municipal child representatives shall elect among themselves two (2) representatives to the Provincial Council for the Protection of Children (PCPC).

TERM OF OFFICE. The term of office of the Child Sector Representative for the LCPCs is two (2) years.

LOCAL DEVELOPMENT PLAN FOR CHILDREN. The LCPC shall formulate a five-year comprehensive Local Development Plan for Children and the corresponding Local Investment Plan for Children based on the Formulated Comprehensive Children’s Program by the LCPC through a consultative and participatory process. It shall encourage the participation of children which may include: public forum, children’s congress, festival, games, camping, educational tours, and others. Such Plan shall be integrated to the Local Development Plan and Local Investment Plan at all LGU levels. The said Plan will be revisited every five (5) years as stipulated in Sections 7 and 9 of this Code.

LOCAL ANNUAL STATE OF CHILDREN REPORT. The Provincial Government of Misamis Occidental with the Provincial Council for the Protection of Children shall report annually of the accomplishments of the province and the cities/municipalities on the annual state of children to the public based on the indicators of the Local Development Plan and Investment Plan for Children.

NOVEMBER AS CHILDREN’S MONTH. In keeping with the mandate of Republic Act No. 10661 signed on May 29, 2015 declaring the month of November as National Children’s Month, commemorating the adoption of the Convention on the Rights of the Child by the United Nations General Assembly on 20 November 1989 and seeks to instill its significance in the Filipino consciousness. The Local Council for the Protection of Children in cooperation with the Municipal Councils for the Protection of Children shall conduct child-focused activities for the month promoting the rights of children.

IMPLEMENTING MECHANISM Section 91.

THE PROVINCIAL COUNCIL FOR THE PROTECTION OF CHILDREN. The Provincial Council for the Protection of Children (PCPC) is hereby reactivated and strengthened. The Council is tasked to coordinate with the City/Municipal and Barangay Governments in the reactivation and strengthening of the City/Municipal/Barangay Councils for the Protection of Children.

The PCPC shall ensure the effective implementation of the Philippine Government’s commitment to the Convention on the Rights of the Child, and the Philippine Strategic Framework for Children in the 21st Century (Child 21).

COMPOSITION AND FUNCTIONS OF THE PROVINCIAL COUNCIL FOR THE PROTECTION OF CHILDREN.

needing assistance into the Provincial Program for Children; (2) Monitor and review the implementation of city, municipal and barangays programs for children; (3) Submit quarterly status reports on the implementation of the Provincial Program to the Regional Committee for the Welfare of Children (RCWC) through the Provincial Development Council (PDC); (4) Recommend policies and programs to the RCWC, PDC and other policy-making bodies, which includes, but not limited to: creation of Drug Watch for Children, (5) Bantay Bata Program, creation of Task Force for Children in Specially Difficult Circumstances, and Hotline for Children; (6) Provide the necessary technical assistance to the city, municipal, and barangay, if called for; (7) Mobilize resource assistance, specifically, provide appropriate support to child-related projects and activities as recommended by the Local Councils for the Protection of Children; (8) Advocate for the passage of ordinances pertinent to child survival, development, protection, and participation with appropriate funding support; (9) Identify and recommend programs and services to be conducted or implemented

by NGOs and other entities in the implementation of this Code; (10) Develop and implement various support mechanisms that maximizes public and private resources to support needy and high-risk children from poor communities.

(11) Ensure the implementation of the Local Development Plan and Local Investment Plan for Children.

(12) Ensure that the Provincial Government shall report on the Annual State of Children in the Province.

SECRETARIAT. Support services shall be provided by the Office of the Provincial Director, Department of the Interior and Local Government (DILG). There shall be created a Team for Children’s Concern under the Office of the Provincial Director, DILG, to do the following: a. Shall be responsible for the documentation of the proceedings of meetings and preparation of the reports and other necessary documents as needed by the Council; b. Oversee and coordinate the implementation of this Code, and c. Be in charge of the day-to-day operations of the PCPC. LINKAGES WITH OTHER ORGANIZATION. The Local Sanggunian shall invite NGOs with child-focused programs for membership in the LCPC, provided that these NGOs are duly accredited by the Sanggunian and DSWD, based on its criteria and recommendation.

FORMULATION AND GUIDING RULES OF PCPC. Sixty days (60) upon the approval of this Code, the Provincial Council for the Protection of Children (PCPC) shall meet, formulate and adopt their own Internal Rules of Procedures and Regulations to serve as guidelines for the members in the discharge of their official functions, such as: the organization’s structure, parliamentary procedure, order of meetings and quorums and such other rules as the Council may deem necessary.

SPECIAL COMMITTEES. The Provincial Council for the Protection of Children (PCPC) shall create, from among its members, special committees, as necessary, that shall ensure that the programs and services as well as protective measures of this Code are duly implemented.

It may likewise create special committees for the following: a. Early Childhood Care and Development Program, b. Provincial Anti-Crime Task Force for Children, c. Provincial Anti-Child Trafficking Task Force, d. Provincial Anti-Child Labor Task Force and other committees, as it may deem proper and necessary.

Section 97. STRENGTHENING AND REACTIVATION OF THE CITY, MUNICIPAL, AND BARANGAY COUNCILS FOR THE PROTECTION OF CHILDREN. The Sangguniang Panlungsod, Sangguniang Bayan, and Sangguniang Barangay shall create the City, Municipal, and Barangay Councils for the Protection of Children, respectively, its composition is provided in Section 82 hereof. The functions of which shall be based on existing provisions of laws and issuances, such as PD 603, MC 2002-121 and R.A. 8980.

Section 98. ECCD OFFICER. As mandated in Section 8 of R.A. 8980, the position ECCD officer with salary grade 26 is hereby created. The ECCD Officer shall coordinate and monitor the implementation of ECCD program of the Province. The ECCD Officer shall have the following qualifications: a. Master’s degree in any ECCD-related field such as social work, community development, health, education, nutrition and psychology; and b. Experience in program management in related ECCD fields.

Section 99. REPRESENTATION OF NON-GOVERNMENT ORGANIZATIONS IN THE LOCAL COUNCIL FOR THE PROTECTION OF CHILDREN. The Local Sanggunians shall invite the NGOs with child-focused programs for membership in the Council for the Protection of Children, provided that these NGOs are duly accredited by the respective Local Sanggunian Section 100. SEARCH FOR MOST CHILD-FRIENDLY CITIES AND MUNICIPALITIES. There shall be an annual Search for Most Child-Friendly Cities and Municipalities in the Province of Misamis Occidental Awarding of winners will be done in every month of November during the Children’s Month Celebration. The Local Government Units shall be assessed based on twelve (12) criteria. The assessment shall use a scaling system in measuring the results and the performance consistent with the national standards, averages and targets.

Section 101. HONORARIUM OF PCPC. The members of the Provincial Council for the Protection of Children may receive an honorarium during regular meetings, the amount of which shall be determined by the Council.

Section 102. IMPLEMENTING RULES AND REGULATIONS. The Implementing Rules and Regulations (IRR) of this Code shall be drafted by the special committee created by the PCPC within six (6) months from the effectivity of this Code.

Section 103. ESTABLISHMENT OF BANTAY-BATA HOTLINE. A round-the-clock monitoring and reporting base against child abuse shall be established and anchored by the Provincial, City, and Municipal Police Station through the Children and Women’s Desk. Said hotline shall act as the 24-hour vanguard of children in all crimes and abuses committed against them by any person. Upon receiving information regarding any crime committed against a child, the Bantay-Bata Hotline shall immediately report to the appropriate authorities such incident and shall monitor every progress that may occur in relation to the apprehension and prosecution of the offender.

Section 104. CREATION OF PROVINCIAL ANTI-CRIME TASK FORCE FOR CHILDREN (PACTFC).

For the protection of the children in the Province of Misamis Occidental, there is hereby created the Provincial Anti-Crime Task Force for Children (PACTFC) whose main task is to keep children away from prohibited drugs and all forms of crimes against children such as child trafficking, child labor, prostitution, pornography, violence, exploitation, abandonment, neglect and all forms of abuse as defined by law through advocacy, awareness raising and other preventive programs and activities thereby ensuring their physical, educational, moral and social development. As much as possible all barangays shall establish a child protection system through the BCPC in coordination and partnership with government and non-government organizations.

(3) To make presentation with government agencies/offices including Non-Government Organizations (NGOs) with programs for the protection of children on their campaign/operation against all forms of violence and crimes against children; (4) To formulate and recommend policies, strategies and measures to the Provincial Council for the Protection of Children (PCPC) on how to effectively protect children’s rights and make our homes, schools, organizations, institutions and communities totally free from all forms of violence against children.

(5) To hold regular meetings which shall be once (1) in every three (3) months or special meeting to address urgent problem and to submit corresponding report to the PCPC; and (6) To perform such other functions and duties as may be directed or required by the PCPC. Section 106. SECRETARIAT. The Secretariat support for the Task Force shall be provided by the Secretariat of the PCPC through the Office of the Provincial Social Welfare and Development.

FUNCTIONS AND DUTIES OF PACTTF. ARTICLE IX PROHIBITED ACTS AND PENALTIES Section 110. PROHIBITED ACTS. In addition to all acts defined in and penalized under Republic Act 7610 on Child Abuse and Exploitation, Republic Act 7658 on Child Labor and other pertinent laws, Republic Act 9231 on Elimination of the Worst Forms of Child Labor, Republic Act 9208 on Anti-Trafficking in Persons Act, Republic Act 9344 on Juvenile Justice and Welfare, the following acts shall likewise be punishable: a. Refusal of parents to let their children attend school - Parents forcing their children to work to augment family income instead of their children going to school. b. Illegal Recruitment - Any person who recruits other persons for work shall be required to register with and secure a permit from the Office of the Punong Barangay in the place of recruitment with understanding not to recruit children.

Inducing a minor to use drugs, cigarettes, alcohols and other intoxicating and mindaltering substances. u. Appropriate schools refusing to enroll or accept a differently-abled child merely by reason of physical disability. v. Branding or labeling Children In Conflict with Law (CICL) as young criminals, juvenile delinquents, prostitutes, snatchers, rugby boys or attaching to them in any manner any other derogatory names. w. Employment of children below fifteen (15) years old except those instances provided for in Art. 7658, as amended. x. Parents to coerce or force the child to work in hazardous situation. y. To sell, force, coerce, deceive children or and their parents/guardians for the purpose of engaging the children in prostitution or pornography. z. To recruit, transfer, transport, harbor, hold a child for the purpose of engaging them in prostitution, pornography and other sexual activities, especially by the parents/guardians of the child.

Section 111. PENALTIES. The penalty for any violation of this Code, which is not penalized elsewhere in other sections of this Code or in a national law, shall be upon conviction by the proper court, an imprisonment of six (6) months to one (1) year and/or a fine ranging from One Thousand Pesos (P1, 000.00) to Five Thousand Pesos (P5, 000.00) shall be imposed.

There is a presumption of illegal trafficking when a person is found together with two or more minors not his/her relatives at the pier or port of exit, or bus/jeepney terminals for the purpose of transporting the minors to another place without any permit from the Punong Barangay. Operators/managers of piers/terminals or ports shall likewise post signages with regard to Anti-Trafficking Ordinance.

Pushing/Enticing Minors to Live-In Arrangement - it shall be unlawful for parents to entice, encourage and/or force their children to live together with any person as husband and wife in exchange for money or any other consideration.

Sexual Exploitation of Minors - Sexual exploitation of children by any person, foreigner or otherwise, shall be prohibited. Consorting with children not related by affinity or consanguinity, with public display or lascivious conduct shall be considered prima facie evidence of sexual exploitation.

Smoking and drinking of Minors is strictly prohibited - It shall be unlawful for a child to smoke and drink intoxicating liquor.

It shall likewise be unlawful for any person to sell to a child, cigarettes, liquor, rugby and any other additive substances.

Smoking in enclosed places and public conveyances - It shall be unlawful to smoke inside buses and jeepneys and other public conveyances. Smoking for adults must be done in areas designated as such.

Parents are prohibited to command their children to buy or light cigarettes for them.

Gambling of minors is strictly prohibited. - Parents are directed to monitor their children not to indulge in any form of gambling.

Street-Children engaged in Begging is Strictly Prohibited–The local government through the Social Welfare Office shall ensure that no children-beggars be found in the vicinity.

The selling and distribution of pornographic materials to minors is prohibited. The Local Councils for the Protection of Children, the local law enforcers shall monitor and prevent the entry of such pornographic materials.

Control on exposure to technology - Commercial establishment renting out video games and internet cafes open to children during school hours shall be prohibited.

Students and Pupils who will do research through the internet during school hours shall be required to secure permit from the school principal.

Pre-arranged marriage (buya) made by parents or guardians to marry off their children or wards against their will is prohibited under this Code, except in communities where it is allowed by their cultural traditions.

Calling a child any name or identity other than his/her own for the purpose of insulting, belittling or humiliating the child.

Facilitating, encouraging or coercing the child or parent/guardian of the child to falsify any entry in the child’s records, including birth, baptismal or school records.

Refusing to accept a child for enrolment or imposing sanctions by public school because of the child’s or his/her family’s religion, culture or ethnical background.

Forcing, coercing a child to change or join a certain religion or belief.

Discriminate against children of minority culture and indigenous people because of their culture, religion or beliefs.

Causing undue publicity about cases of child abuse or other cases involving Children

For first time offenders, in cases where the offender is the parent/guardian or teacher of the child or relative within the fourth civil degree of consanguinity, if the offender admits the offense and is sincere and willing to reform, the penalty may be waived subject to the written consent of the victim child. Penalties for second and recidivist offenders shall not be waived.

PERSONS WHO MAY FILE A COMPLAINT. Complaints of unlawful acts committed against children may be filed by any of the following: a. The offended party; b. The parents, in case it is the parent who is the offender, the non-offending parent, or guardians; c. Ascendants or collateral relative within the third degree of consanguinity; d. Officer or social worker or representative of a licensed child caring institution; e. Officer or social worker of the Department of Social Welfare and Development; f. Provincial, City, Municipal or Barangay officials, or g. At least three (3) concerned responsible citizens with direct knowledge of the offense committed who are residing in the community where the violation occurred.

PROTECTIVE CUSTODY OF THE CHILD. The offended party shall immediately be placed under the protective custody of the Social Welfare and Development Officer pursuant to Executive Order No. 56, series of 1986. In the regular performance of this function, the Social Welfare and Development Officer shall be free from any administrative, civil or criminal liability.

Custody proceedings shall be in accordance with the provisions of Presidential Decree No. 603.

CONFIDENTIALITY. At the instance of the offended party, his/her name may be withheld from the public until the court acquires jurisdiction over the case. It shall be unlawful for any editor, publisher, and reporter or columnist in case of printed materials, announcer or producer and director in case of the film in case of the movie industry, to cause undue and sensationalized publicity of any case of violation of this Act which results in the moral degradation and suffering of the offended party.

REPORTING. A person who learns of facts or circumstances that give rise to the belief that a child has suffered abuse may report the same, either orally or in writing, to the Department of Social Welfare and Development, the Office of the Provincial/City/Municipal Social Welfare and Development, to the Law Enforcement Agency or to the Barangay Council for the Protection of Children (BCPC) concerned.

MANDATORY REPORTING. The head of any public or private hospital, medical clinic and similar institution, as well as the attending physician/s and nurses shall report either orally or in writing, to the above-mentioned department or agency the examination and/or treatment of a child who appears to have suffered abuse within forty eight (48) hours from the knowledge of the same.

DUTY OF GOVERNMENT WORKERS TO REPORT. It shall be the duty of all teachers and administrators in public schools, probation officers, government lawyers, law enforcement officers, barangay officials, correction officers and other government officials and employees whose work involves dealing with children to report of possible child abuse to the authorities mentioned in the preceding sections.

FAILURE TO REPORT. Any individual mentioned in Section 116 and 117 above who possess knowledge of a possible child abuse and fails to report the case to the proper authorities shall be punished under RA 7610.

IMMUNITY FOR REPORTING. Any person who, acting in good faith, reports a case of child abuse shall be free from any civil or administrative liability arising therefrom. There shall be a presumption that such person acted in good faith.

KNOWLEDGE OF PUBLIC OFFICIAL. Any public official who has any knowledge or learns of facts and circumstances that a child will be, or may be, or has been subjected to abuse, exploitation and/or trafficking and fails to report such to the C/MCPC or LCPC shall be penalized with a fine of P5, 000.00 and imprisonment of one (1) year or both at the discretion of the Court.

CANCELLATION OF LICENSES OF ESTABLISHMENTS THAT VIOLATE THE PROVISIONS OF THIS CODE. In addition to imprisonment and/or fine, violators shall be subjected to suspension of business permit to fifteen (15) days on the first offense and, one (1) month suspension of the same plus a fine of Five Hundred Pesos (P500.00) on the second offense and, confiscation of any equipments used in violation of any provisions of this Code as provided, and finally, cancellation of the business permit of said establishment on the third offense with additional penalty of barring such establishment to put up business of the same nature.

BUDGETARY REQUIREMENTS Section 122. APPROPRIATIONS. The Provincial Government shall allocate one percent (1%) of the Internal Revenue Allotment for children’s program (DILG Memorandum Circular No. 2012120 per Sec. 15 of RA 9344) to carry out the provisions of this Code.

Section 123. THE CITIES, MUNICIPALITIES, AND BARANGAYS SHALL LIKEWISE ALLOCATE ONE PERCENT (1%) OF THEIR RESPECTIVE INTERNAL REVENUE ALLOTMENT. ARTICLE XI MISCELLANEOUS PROVISIONS Section 124. AMNESTY OF LATE REGISTRATION OF BIRTH. Within one (1) year from the effectivity of this Code, an amnesty on the late registration of births shall take place for all unregistered individuals who are under eighteen (18) years old who were born in the province of Misamis Occidental. No penalty shall ever be imposed or exacted for late registration of births.

Section 125. COMPREHENSIVE PROGRAM. The Provincial Social Welfare and Development Officer and all City/Municipal Social Welfare and Development Officers shall submit to the Provincial Governor and their respective City/Municipal Mayors/Sanggunians a comprehensive program for children formulated by the LCPC through a participatory and consultative process as stipulated in Section 9 that need local funding at an appropriate and reasonable time for inclusion in their annual budget.

Section 126. CITY/MUNICIPAL CODE AND THIS CODE. If both the City/Municipal Ordinance and this Code punish the acts prohibited herein, this Code shall prevail. However, if a case has already been filed by either the City/Municipal Ordinance or this Code, the cognizance and prosecution by one shall exclude the other.

ARTICLE XII SEPARABILITY/APPLICABILITY / REPEALING CLAUSE Section 127. SEPARABILITY CLAUSE. If for any reason or reasons, any part or provision of this Code shall be held to be unconstitutional or invalid, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect.

Section 128. APPLICABILITY CLAUSE. The pertinent provisions of existing laws and other ordinances shall govern all other matters relating to the impositions or regulations provided in this Code. This Code shall apply to all the people within the territorial jurisdiction the Province of Misamis Occidental and to all persons who may have committed violations on any of the provisions of this Code.

Section 129. REPEALING CLAUSE. All Ordinances, Resolutions, Executive Orders and other issuances which are inconsistent with any of the provisions of this Code are hereby repealed or modified accordingly.

ARTICLE XIII EFFECTIVITY CLAUSE Section 130. EFFECTIVITY CLAUSE. This Code shall take effect thirty (30) days upon approval and publication in a newspaper of general circulation within the Province of Misamis Occidental and the posting of copies, preferably translated in vernacular, in conspicuous places in the Provincial Capitol and in all Component Cities and Municipalities within the Province.

Teachers follow students through each pivotal stage of development. At six to eight hours a day, five days a week, you as a teacher are poised to become one of the most influential people in your students’ life. After their parents, children will first learn from you, their elementary school teacher. Then, as a middle

school teacher, you will guide students through yet another important transition: adolescence.

As children become young adults, learning throughout middle school and into high school, you will answer their questions, listen to their problems and teach them about this new phase of their lives. You not only watch your students grow you help them grow.

Muyco said they will also submit a proposal to President Rodrigo Duterte through the Secretary, seeking an issuance of an Executive Order for the creation of a national council composed of government agencies and representatives of the sector to set a clear direction for the cacao industry.

“The council will serve as a policy advocacy body that will guide and oversee the cacao industry,” Muyco said.

Meanwhile, he said the Philippine Cacao Roadmap will be handed over to the Secretary for submission also to the President.

The roadmap indicates the specific plans, activities, and targets.

It will also show the industry’s direction as it aims to come up with a Philippine brand for cacao.

He said they will craft protocols in branding that must be followed, met and

applied.

He said the protocols will be adopted in the propagation of cacao as this is an important requirement especially in trading to foreign markets. He said this would set rules to meet international quality standards.

The market for cacao beans and other products in the world is so huge but the Philippine cacao production is only .001 percent of the global demand.

According to Muyco, 80 percent of the country’s production is contributed by the Davao Region.

He said the production

in 2015 accounted to15,000 metric tons and increasing the production means expanding the areas planted to cacao.

He said they are targetting a production volume of 50,000 metric tons and “we need to have additional 35,000 hectares to support this goal.”

Bai Lawanen shines at JCI Mindanao awards

The JCI Bai Lawanen is the first all female chapter in Mindanao of the Junior Chamber of the Philippines.

Founded 39 years ago,the chapter is composed of empowered women who want to create positive.

JCI Bai Lawanen has always been very active when it comes to community service in the city. More than just beauty queen makers (Organizing the Miss Cagayan de Oro Pageant for the last 4 years), their name is more synonymous with service most notably their Byaheng Tulong Barangay which is on its 8th year of implementation. The Princesses without Equal (the English meaning for Bai Lawanen) are also behind the Sendong Memorial Wall which can be found in Gaston Park.

In the recently concluded Gawad Mindanao Area Conference of JCI Philippines last Sept. 2-4, 2016 in Zamboanga City, the local organization chapter has garnered the following awards: Most Outstanding Local Organization Chapter President for Category 3 for 2016 LO President Sarah Corpus; Best Long Term CommunityProgram for Byaheng Tulong Barangay Year 8; Merit Award for Education for Peace Category, Husto Na-Zero Tolerance for Bullies (An Anti-bullying campaign); Merit Award for Cultural Program, Dayeg and Merit Award for Best Personality Development Program, Miss Cagayan de Oro. 2016 proved to be a very busy year for the Princesses without equal having implemented 35 projects. They have also organized and attended a total of 43 trainings regarding official and non-official JCI courses. And they’re not not yet ready to rest on their laurels just yet. Only weeks before the National Convention in Cebu City, they still have several activities lined up: Husto Na Anti Bullying Campaign and Gender Equality Seminar in Camaman-an Elementary School with their 500+ Grade 6 students, Baila Cares: Maternal Care, Livelihood Seminar & Clean Water and Sanitation Project in Barangay 17 and NHA. The Capitol University Museum of Three Cultures launched an art exhibit entitled “Id” last September 02, 2016 Friday by Schennette Pearl A. Magno and the participating artists.

The curatorial concept draws on the artists’ exploration through different lens; as artistic points of reference for the artists in their creative learning, living, and production – introspective, cracked, but human nonetheless.

They explore these

facades and strip down the human psyche to its core – life, beauty, love and decay.

Europe Peter Moosgaard who is currently a residency program in Davao City. Also curated by the museum artist Mr. Nic Aca. The exhibit showcases the amazing artworks that started from a pen and paper and enhanced through digital art. During the opening, viewers enjoyed the amazing works installed at the gallery and a musical performance by John Uy and Rotsanjani Mojica. at the Art gallery with Angely Chi Co-Director at the Unifiedfield Nomadic Artist In Residence Program in the Philippines which who also talked about Better Living Through Xeroxography (BLTX) and another speaker Peter Moosgaard presented the SUPERCARGO. NO less than the CEO of University of Mindanao, veteran racecar hobbyist Willie Torres, graced the 25th anniversary of Wild Z 94.3 in Cagayan de Oro City last September 7 at Rosario Pavilion. The event also served as the reunion among ex-disc jockeys of the station from announcers to spinners.

In an interview at the sidelines of the affair, Torres said that the challenge now of University of Mindanao Broadcasting Network in this Internet age is to cement its market in the provinces, in the workplaces, in vehicles.

“We will maintain ratings through better programming, more interesting promotions,” he said.

When Wild Zee 94.3 was founded in 1991, vinyl records were still playing. Now people already have Spotify and mp3 lists on their cellphones and at home, they’re contented streaming endlessly on YouTube while doing their homework or even

sleeping.
