NCMB settles XU, XUNTELU dispute Volume VI, No. 145

THE National Conciliation and Mediation Board (NCMB) in Northern Mindanao managed to settle the labor dispute between Cagayan de Oro’s first university and the Xavier University Non-Teaching Employees Union (XUNTELU) during yesterday’s conciliation conference.

In a press statement, XU President Fr. Roberto C. Yap, S.J. said the XUNTELUALU-TUCP has withdrawn its “Notice of Strike” and that the XU has also withdrawn its “Notice to Arbitrate” and its petition to the DOLE Secretary to assume jurisdiction.

During the conciliation conference, Fr. Yap said the XU agreed to give each employee P2,700 as Christmas cash gift in 2016 and P1,800 in 2017.

Both parties also agreed that the sources of the Christmas cash gift shall be left to the sole discretion of the Xavier University President subject to the condition that it shall not diminish existing CBA benefits.

that classes and activities at XU will proceed normally.

And we will certainly celebrate Xavier Festival Days as one community on December 1 to 3, 2016,” said Fr. Yap. Earlier, Dr. Dulce Dawang, designated spokesperson of Xavier UniversityAteneo de Cagayan, filed for compulsory arbitration with the NCMB to have a third party determines whether the suspension of the Christmas Cash Gratuity by the university due to operating losses incurred in the previous two years is a “practice” or “benefit.”

The XUNTELU filed a notice of strike last October 20, 2015 over the suspension of the Christmas Cash Gratuity due to the unprecedented financial losses experienced by XU in 2015.

The union unanimously voted to proceed with its strike on November 22, 2016 and started holding nightly rallies in front of the university starting Tuesday (November 15, 2016).

XUNTELU is a “closed shop union” with a membership of 183, and comprises 16.4% of the 1,118 regular employees of XU in its five campuses See SETTLES, page A7

XU studes unaffected by protests

CAGAYAN de Oro City-Students remain to be unaffected by the holding of nightly rallies by members of the Xavier University Non-Teaching Employees Union (XUNTELU).

“While the issue has only escalated just recently, I personally hope their differences will be settled and we can enjoy the rest of the semester together,” said Mr. Edison Lacea, president of Xavier University Central Student Government.

On one hand, students are busy preparing for the three-day Xavier University Days, where celebrations are held in lieu of classes for the institution’s 58th anniversary commemoration that will kick off on December 3 until December 3.

Should the negotiation spearheaded by the National Conciliation and Mediation Board (NCMB) crashes and the strike would proceed in those days, Mr. Lacea is confident that the festivities would still push through.

“The Xavier University Days are being organized an executive committee which is composed not just by management and students, but also by staff who are also XUNTELU members, said Mr. Lacea, adding, “so far they are still actively contributing to the discussions and preparations.”

There is a total of 13,713 students enrolled for this semester at university.

Mindanao expects 20% rise in tourist arrivals year-on-year

DAVAO City––Tourist arrivals in Mindanao are expected to rise by 10 to 20 percent year-on-year if backed with logistic support from concerned government agencies, a tourism official said.

Department of TourismMindanao (DOT-Mindanao) Assistant Secretary Eden David noted that she sees this possible with the creation of a Mindanao Tourism Agenda (MTA) to go on a full-blown scale by next year.

“The target that has been set is to at least increase it by 10 to 20 percent but it be dependent upon logistic support when it comes to infrastructure,” David said in a press conference in Davao City.

DOT earlier said that the MTA is expected to complement the depart-

ment’s National Tourism Development Plan (NTDP).

“The Mindanao plan will have to be started by 2017. There would be a MOA (memorandum of agreement) that would be undertaken next week and hopefully by end of the year we have initial draft to submit to Malacanang,” David said.

Data from DOT Mindanao showed that the island acquired around 8.5 million tourist arrivals in 2015 with the bulk of these arrivals coming from the Davao Region (Region 11) with around 2.8 million arrivals.

Meanwhile, the Zamboanga Peninsula (Region 9) acquired around 800,000 arrivals, Northern Mindanao (Region 10) acquired around 2.7 million arrivals, Soccsksargen (Region 12) acquired around 1 million

arrivals and Caraga (Region 13) acquired around 1.2 million arrivals.

DOT Secretary Wanda Teo vowed to boost Mindanao tourism under her term especially since she herself and President Rodrigo Duterte hails from the same region.

“My focus is always Davao and Mindanao because I feel like Davao has been left behind,” Teo said.

“Palawan, Boracay, Cebu are already known. Now, it’s Davao’s turn.”

located all over Mindanao, to transport tourists to around 300 tourist destinations within the island.

The Tourism Infrastructure and Enterprise Zone Authority (TIEZA), an attached agency of the DOT, will meanwhile set up information centers to a house souvenir shop, a mini restaurant, shower, restroom, locker and even a prayer room.

David said that routes for the first phase will cover Davao-Bukidnon-Cagayan de Oro and Davao to Butuan. She also assured the safety of tourists.

The next set of buses — around 60 of them — will arrive next year.

DOT-Mindanao is also working on increasing road connectivity within the Davao Region by 80 percent next year through

the construction of a Samal Circumferential Road and a bridge connecting Davao City to the Island Garden City of Samal (Igacos) or simply, Samal Island.

David said that the budget will be coming from the Tourism Road Infra Program (TRIPC), a joint project of the DOT and the Department of Public Works and Highways (DPWH).

DAVAO City––The Overseas Workers Welfare Administration (OWWA) on Monday turned over P50,000 financial assistance to Erlinda Cagalitan, mother of the two-year-old boy who died from a beating of his guardians while staying with them temporarily in Calinan.

Erlinda, a single mother, was forced to leave her children in the Philippines and

work abroad for ten years now as she had to make a living for the family. She previously worked in Saudi Arabia and Kuwait.

“The P50,000 financial assistance will help the family in paying the hospital and medical bills,” OWWA Davao Regional Director Eduardo Bellido said in an interview Monday.

Bellido said the victim,

John Earl Cagatin, was temporarily staying in the house of his mother’s cousin and the latter’s husband.

The boy, reportedly in the care of Ronilo and Sara Jane Alcain, was beaten with a belt after he urinated in Ronilo’s pants. The guardians rushed the boy to the hospital at 11 p.m. on November 14 when they noticed he was experiencing breathing difficulties.

“This case goes to show that it is not only the overseas Filipino workers who need help and protection but also their children,” Bellido said.

He said that aside from the financial assistance, OWWA will also provide livelihood and training assistance to Erlina as well as psychosocial counseling to the family who experienced trauma because of the incident.

The suspects will be charged with murder in relation to Republic Act 7610 or the Special Protection of Children Against Abuse, Exploitation and Discrimination Act. (PNA)

The fault may not lie with the chef, though, but in the plane’s design. Everything is reheated. Sure.

The very nature of air travel, as well as how the plane is built and how it adjusts to high altitudes, make food preparation fundamentally more difficult.

There are some technical limitations to being high in the air that make it far simpler to just reheat premade food, rather than attempt to actually cook from scratch — particularly in the pressurized air of the plane’s cabin.

Francis Pangilinan of the Liberal Party, prohibiting the arrest of child offenders even if they have committed murder, drug pushing, or other heinous crimes, crimes involving these child offenders have increased and skyrocketed, with most of them being used wantonly by criminal syndicates.

In Metro Manila and in other key Philippine cities, street wars by children who have just been weaned from

sucking the breasts of their mothers for sustenance have been occurring nightly, with barangay and police and law enforcement officials professing inability to stop them, because they themselves may be arrested on account of Pangilinan’s law.

That petition is revolting and nauseating because, one, the burial was carried out only after the tribunal already ruled that President Duterte did not commit any abuse of authority when he permitted the burial of the Marcos remains as it was in accordance with existing laws, and, second, the decision to bury Marcos, at the time and date chosen by his family, was not impeded by any legal prohibition.

The Day When Mindanao Mourned THE year brought pride to Mindanao as the nation elected a Davaoeño as the 16th President of the Republic and the legislative branch seated a Kagay-anon as its current Senate President. As the world cheered for the two consecutive triumphs of the prolific boxer from General Santos City in his sport this year, Mindanao celebrates the achievements and influence of its offspring.

But despite the promise that it holds to unite the diversity of its people, it was cheated of its justice when the tyrant that wounded its peace in the previous decades, now lies among the nation’s heroes and was granted the burial of one on November 18, 2016.

It’s a day for mourning, and Mindanao mourned differently from that of the tyrant’s widow at the Libingan ng Mga Bayani.

While she had wept for her husband’s passing 31 years ago, Mindanao could never forget of her husband’s atrocious regime. His twodecade reign particularly affected some towns in Cotabato when the military presence planted fear in the hearts of the civilians; and with the manifestation of their armament, disturbed their peace.

The burial may have been done to mark him as a hero, but he could never be the hero to the recorded 170 victims from Lanao del Norte, Bukidnon, Misamis Oriental, Camiguin and Misamis Occidental whose rights were violated at the height of his military rule.

In February 2014, they gathered in the gymnasium of Barangay Nazareth, Cagayan de Oro City, to receive the compensation accorded for the damages done to them and their family. But for Ofelia Palencia, whose then 19-year-old son was abducted by the military and still hasn’t been returned to her today, any amount may not replace the value of her son’s life.

By these victims’ testimonies, along with those of the recipients of the Human Rights Victims Reparation and Recognition Act of 2013, the man now buried in LNMB contradicts the values of a hero.

ger today? Extremist groups and militants have increased and although their cause can be based on their beliefs, to achieve it by harming innocent lives will only deepen Mindanao’s wounds and prolong its turmoil.

As the late dictator was granted a hero’s burial last Friday, mourning is not exclusive to his widow and family who grieve for his passing.

Mindanao mourned as well, but not for the same reason and not for the same person. The justice it had long sought was buried first

– the same justice meant for the displaced civilians during the insurgencies and the victims in his regime.

Mindanao can only wish for the entire nation to mourn with it.

As multiple protests rise anew, Mindanao longs for its justice to live again just as the land promised life and prosperity to its diverse people.

As long as leaders lavish in greed and lust for bloodshed to retain power, a land like Mindanao which they govern can never fulfill this promise.

Mango producers, food firm eye marketing, supply ties GENERAL Santos City--Mango producers in Region 12 are working on forging marketing and supply agreements with a fruit processor and a beverage company based in South Cotabato province.

Emmanuel Bartocillo, president of the Region 12 Mango Industry Development Council Inc. (RMIDC-12), said Tuesday negotiations are underway for the delivery of mango supplies by local mango growers to processing plants in the area of the SeaBest Food and Beverage Corporation (SFBC) and the Truly Natural Food Corporation (TNFC).

He said the move is an offshoot of a recent marketmatching activity facilitated by the Agribusiness and Marketing Assistance Division of the Department of Agriculture (DA) in Region 12.

“We initially presented proposals for market deals and they showed interest to venture with us,” Bartocillo said.

Govt forces, outlawed BIFF clash in Maguindanao; 5 die CAMP Siongco, Maguindanao--Government forces pursuing armed followers of a town mayor tagged as narco-politician killed four armed men in a clash late Monday afternoon in the Maguindanao marshland, the military confirmed Tuesday.

The government side, however, suffered one fatality in the firefight between Army Special Forces and outlawed Bangsamoro Islamic Freedom Fighters (BIFF).

Among those killed was a soldier, according to Maj. Gen. Carlito Galvez Jr., commander of the 6th Infantry Division based in Maguindanao.

Galvez said the Army

Special Forces were pursuing a group of outlawed Bangsamoro Islamic Freedom Fighters (BIFF) in the borders of Sultan Sumagca (formerly Talitay town) and Datu Anggal Midtimbang towns in Maguindanao when an encounter occurred.

He identified the slain soldier as S/Sgt. Giovanni P. Olimpo, a gunner of M-60 machinegun mounted atop a hovercraft. He was hit in his middle torso and expired at Camp Siongco Hospital here.

“He died serving his country, helping the government carry on its antinarcotics campaign,” Galvez said of Olimpo who was firing at the armed men

positioned along the river bank.

Local officials in Sultan Sumagca confirmed to military authorities that four armed men, belonging to BIFF, were also killed in the encounter.

down armed followers of Mayor Montassir Sabal of Sultan Sumagca, Maguindanao who was tagged by President Duterte as Maguindanao’s narco-politician.

already a permanent benefit and covered under Article XIII of its CBA: Retention of prior and present benefits and other privileges and labor/management cooperative scheme.

Citing Section 7 of the law on labor standards, the union further argued that “on the basis of equitable considerations, long practice, agreement (e.g. CBA), and other peculiar circumstances, cash gift/bonus may become demandable and enforceable.”

“While the Christmas Cash Gift is considered a gratuity but it has been voluntarily practiced by the university for over 20 years and therefore has already ripened into a privilege or a permanent benefit, that cannot be just be withdrawn or stopped otherwise it would be a diminution of benefit.”

“There are however instances when a bonus, even though clearly an act of generosity on the part of the employer, may become demandable. In instances where the granting of a bonus has already become a long-standing practice or policy, the employer can no longer withdraw and to do so is tantamount to a diminution of benefits.

This is prohibited under the Labor Code.”

But Fr. Yap said the union’s claims are erroneous.

“The 2016 Audited Financial Statements of Xavier University show that the correct facts are: XU had losses from school operations, -P89.7 million in 2016, and -P159.4 million in 2015. XU had losses in Total Comprehensive Income, -P138.7 million in 2016, and -P98.5 million in 2015.”

He further explained that as a non-profit foundation, XU does not have “retained earnings” but rather what are known as “fund balances” or “net assets”(assets less liabilities) which it uses to further XU’s educational mission.

The Fund Balance of XU, as of 31 May 2016 is P3.8 billion, was down –P200 million from the previous year’s Fund Balance of P4 billion. The 2016 Fund Balance (P3.8 billion) is held in the form of assets: Buildings, Land and Equipment valued at P2 billion and Investment Funds of P1.8 billion.

T h is Fu nd B a l anc e (P3.8 billion) has been allocated by the XU Board of Trustees for Restricted Funds (P2.2 billion), which are restricted by law or by donors’ intentions for scholarships, professorial chairs, construction, plant & equipment; Required paper accounting entries (P800 million), for revaluation of property, re-measurement losses, unrealized gains/ losses; and, Institutional Fund (P800 million), which is the “savings” which can be used to cover operational losses and deficits.

“The Institutional Fund (P800 million) needs to be managed prudently to

Wednesday, November 23, 2016 cover the expected losses of the K-12 transition years (2016-2021) when we will have no college enrollment by as much as 4,000 college students,” Fr. Yap said.

“This SY16-17 is the first of the K-12 transition years when we do not have college freshmen enrollees; next SY we will have no freshmen and no sophomores; in SY18-19 no sophomores and no juniors; in SY19-20, no juniors and no seniors; in SY20-21, no seniors.”

“The deficit of the budget for SY16-17 approved by the Board of Trustees is projected at -P199 million.

If the average deficit during the K-12 transition years will be -P200 million, then we will deplete our savings (P800 million) in 4 years, by 2020.”

In an open letter dated November 18, 2016 addressed to students, parents, alumni, administrator, faculty and staff, Fr. Yap presented four points regarding the issue.

“Like all gifts, the Christmas gratuity is not an obligation and our unprecedented financial losses compel us to suspend the granting of the pinaskuhan,” he noted.

“Second, XU is working hard to resolve this labor dispute and avert the strike.

Meantime, XU’s classes and activities will continue as normally as possible. And not the least, the safety and security of everyone is a paramount concern.”

However, XUNTELU remains adamant that XU is not losing since it offered a P33-million package with everything monetized when the union was negotiating for its new CBA last February, but that the union opted for the present CBA monetized at P13-million, “for the best interest of the union.”

“Therefore, Xavier University has savings. And, to declare it depleted is something that cannot be accepted. XU must be transparent about it. The Gratuity thing is not the issue here anymore. It is the deliberate and intentional act committed of not giving it. To unilaterally discontinue, eliminate, reduce, and diminish a benefit that has been long enjoyed by the employees is absolutely a Diminution of Benefit in violation of Article 100 of the Labor Code.”

In response, Fr. Yap assured the community that XU is exerting best efforts to achieve a fair resolution to this dispute.

“XU is willing to give a Christmas cash gift, but not by using the savings from the Institutional Fund because this will increase the already large deficit (-P199 million) and will force XU to withdraw more than necessary from the savings,” he explained. “Instead, XU has proposed to give a Christmas cash gift in 2016 by reducing certain items in the SY16-17 budget to contribute to funding the Christmas gratuity. For example, cancel the Uni-

versity Christmas party and contribute the budget for the Christmas cash gift. In this manner, we will not increase the deficit for SY16-17 and not have to withdraw more than necessary from our savings. And everyone in the community will help each other so all can receive something this Christmas.”

Profits [could be] gained from chopping the kitchen out of the plane almost entirely. “Nowadays airlines are breaking out the expenses and leaving it up to consumers to choose what they want,” said Bob van der Linden, who is the air transportation curator at the US National Air & Space Museum. “It’s the market. This is pure economics. After deregulation in ’78, airlines are free to compete anyway that they want — and they found the best way to compete is low prices.”

The shrinking space for food doesn’t, however, mean that airline meals are completely disappearing. The patriarch was declared dead 42 days after he was admitted at a state-owned hospital in Quezon City for “advanced liver cancer” and four days after he lapsed into a coma after a massive heart attack.

Salaysay said to this day she does not believe the patriarch is dead. “Walang hindi nababayaran,” she added.

Salaysay called on President Duterte to also focus on their case. She said she supports and understands the President’s war on drugs but hopes he will also attend to victims of violence like them.

The victims’ children a day earlier participated in an arts workshop in General Santos City to express how they feel about the situation now, seven years later.

Monday afternoon’s clash was related to the law enforcement operation against Mayor Sabal and two other local officials on Friday.

Colonel Markton Abo, speaking for the 6th ID, said the military and the police are hunting down an undetermined number of Mayor Sabal’s heavily armed followers.

Sabal who has been missing since September, was named by President Rodrigo Duterte as among the Maguindanao’s narcopoliticians.

Government forces raided his home in Barangay Poblacion, Sultan Sumagca town but missed him.

Policemen and soldiers, backed by armored personnel carriers and helicopter gunships, arrested on Friday two of Sabal’s armed followers and seized seven huge sachets of “shabu” or methamphetamine hydrochloride and three high powered guns.
