‘Power plays at the city hall’ First of two parts Mayor Oscar Moreno argued that his dismissal by the Ombudsman was “harsh,” and “that his counter affidavit was not given due course.” He denied any knowledge of the Ajinomoto transaction.

Moreno said that the Ombudsman contended that he (Moreno) did not submit his counter affidavit, which could have resulted to his

“dismissal.” He argued that the Ombudsman dismissal order was not final and executory until his motion is resolved. Moreno used this angle as his argument in his petition for certiorari and obtained a Temporary Restraining Order (TRO) from the Court of Appeals.

“This is part of the Rule of Law. I am invoking the Rule of Law in seeking justice in my case,” Moreno said.

DAVAO City--Rubber industry leaders lauded the Aquino government for giving the industry the needed support and serious intervention to save the industry.

Rhodora Dela Cruz Medalla, president of the Philippines Rubber Industry Association (PRIA), said, “I think it is only now that this sector has been given serious intervention from

the government” just in time that the industry is on a down side because the price of raw product remains at the bottom.

Medalla said the government now has been doing serious advocacy among farmers on producing quality rubber products. She said the government has to find ways to help the farmers at this time and strengthen advocacy on good agriculture practices.

Philhealth holds caravan in Davao del Sur

DAVAO Cit y--Around three hundred fifty indigent members are set to participate in PhilHealth’s on-going information drive for poor families dubbed Alaga Ka, Para Sa Maayos Na Buhay, on November 20 at Magsaysay, Davao del Sur. ‘Alaga Ka’ is the agency’s flagship advocacy campaign, in partnership with the Department of Health (DOH), aimed at providing indigent members and their families with greater access to the government’s healthcare programs.

This one-day activity will involve an orientation on PhilHealth’s Primary Care Benefit (PCB) 1 Package which covers preventive services such as consultation and physical examination, screening tests and outpatient medicines for selected illnesses.

The discussion will also feature benefits for maternal and infant health, malaria and tuberculosis treatment, among others.

Household Targeting System for Poverty Reduction (NHTS-PR) and 350 Pantawid Pamilyang Pilipino Program (4Ps) members in Magsaysay.

A total of 1,460 members are identified and sponsored by the Local Government Unit (LGU), while 104 are sponsored by local politicians.

The goal of the agency is to expand the coverage of those who benefit from the activity by making its ser vices and programs genuinely felt at the grassroots level.

Zonta Cagayan de Oro hosts forum on Human Trafficking: A Global Epidemic THE local chapter of a worldwide service organization of executives in business and the professions aimed at advancing the status of women worldwide will host a forum on the global epidemic of human trafficking.

Zonta Club of Cagayan de Oro hosts a forum on Human Trafficking: A Global Epidemic on 05 December 2015 at a local restaurant.

Guest speaker will be Maria Cecilia Flores-Oebanda, founding president and executive director of Manilabased Visayan Forum, which has battled human trafficking, forced labor and other forms of modern day slavery since 1991.

Ms. Flores-Oebanda is the Founder and President of the Visayan Forum Foundation, a national NGO in the Philippines that promotes the rights and development of marginalized migrants, especially those in the invisible and informal sectors, like domestic workers and trafficked women and children.

She has spent most of her life as a freedom fighter and worked with the urban poor, peasants, women, youth and children. Because of her

work, she became a political prisoner for four years under the Marcos dictatorship. She was released from detention as a result of the 1986 EDSA People Power Revolution.

Immediately after her release, she set up the Visayan Forum Foundation. She is the convener of the MultiSectoral Network against Trafficking in Persons, a national alliance of civil society, government and private groups that works for the prevention, protection and reintegration of victims, and prosecution of offenders of human trafficking in the Philippines.

During an interview with HumanTrafficking.org Ms. Flores-Oebanda identified some of the root causes of human trafficking in the Philippines: “Victims are pushed by poverty, unemployment, lack of educational alternatives, peer influence, social expectations and armed conflict, and the mere inability of young people to continue their studies. Many believe in making family sacrifices.”

“In the Philippines, the phenomenon of trafficking in women and children has two faces: serving both the

overseas job markets as well as the local market.

A network of headhunters which scouts for recruits in poor communities earns as much as $10 to $20 per head, putting recruits in a position of indebtedness to recruiters who harbor them.”

“Before reaching Manila and other exit airports, recruiters have to identify, screen, and transport potential victims from poor provinces. Traffickers clandestinely organize their transport operations through different ports and land routes across the country. As it happens inside the country, it is part and parcel of the international dynamics of trafficking, and solutions must be combined addressing these two dimensions.”

The Philippines is considered among the leading sources of migrant workers all over the world. As of December 2003, the Philippine Overseas Employment Administration reported some 7.76 million Filipinos are working abroad. It is part of the Government Philippine Medium Term Development Plan. “Trafficking is also still remains rampant within borders. Inside the Philippines, there is trafficking from rural to urban metropolitan areas. Even overseas recruiters rely on intricate processes that start from far-flung communities,” she noted.

Ms. Flores-Oebanda is also the Philippine and Southeast Asia Coordinator for the Global March Against Child Labor, a worldwide movement on behalf of 250 million working children, 4 million of whom are Filipino. She is also the current chairperson of Child Workers in Asia, a Bangkok-based network of about 100 NGOs working on the issue of child labor in Asia. A recipient of the 2005 Anti-Slavery Award by AntiSlavery International—the world’s oldest human rights organization—she was recognized by the government of the United Kingdom as a “Modern-Day Abolitionist” in the 2007 celebration of the bicentenary of the abolition of the Slave Trade Act. “The Philippines has made notable progress in

the campaign against trafficking in persons, being one of the first countries in Asia to pass a definitive law against trafficking, Republic Act 9208 (Anti-Trafficking in Persons Act of 2003). The law imposes stiff penalties for traffickers and mandates the provision of direct services to trafficking victims.

The challenge for the government is on how to make this law effective and how to fast track the resolutions of cases filed in court.

Second is how to address the root causes of the problem.

“Aware of the archipelagic nature of the Philippines and that internal trafficking is rampant in many of these transit points, Visayan Forum combats trafficking it transit points, such as shipping ports and airports strategically located across the country. This is a crucial stage when traffickers become highly visible, along with their recruited victims.

Within these ports, the VF operates unique facilities called halfway houses.”

“Inside these halfway houses, a team of multidisciplinary staff provide integrative services to protect and heal victims. Such services includes temporary

shelter, counseling, legal assistance, skills training, and referral for aftercare services.”

Visayan Forum offers temporary shelter, healing and repatriation services to women and children. These port halfway houses are also the nerve centers for information and advocacy inside the ports.

Integral to operating the halfway house is to organize a well-entrenched AntiTrafficking Task Force at the Ports geared to enforce laws, detect traffickers, and protect possible victims as they are seen aboard vessels and buses.

They are composed by Port Police, the Philippine Coast Guard, Maritime and Shipping Companies. Managers and key personnel of shipping companies schedule regular orientations and awareness sessions about trafficking on their crew.

They also help distribute informational materials, through posters and desks assistance. They are also developing television “infomercials” to warn passengers about trafficking. The network has adopted its own implementation guidelines and referral procedures.

He has done a lot for the people of Natumulan, even using his personal money to help those in need. Sabio caught the ire of the incumbent mayor who happened to be a classmate and good friend of his father when he signified interest to run for mayor a year ago.

Since last year the relationships have soured that even the garbage or trash

of the Natumolan residents have not been attended to by the municipal government.

The garbage from Natumulan has to make the long trip to Villanueva town, Misamis Oriental. Sabio isn't collecting his salary as barangay chairman or village chief, yet he feels that he is ready to run for mayor.

While Yoyoc Yap is a lawyer by profession who lost to incumbent Mayor Paulino Emano in the 2013 elections. The loss didn't deter Yoyoc from helping fellow Tagoloanon residents despite their political affiliations.

I can see his posts of his community works at his Facebook page every now and then. Yap is also the Parish Finance Council President. Providing water to all constituents and inviting investors are priorities for him if elected as mayor.

Bad days WELL, one of my expatriate friends here in the Philippines admired the “Five Tibetans Monks”. I mean - not the personalities....

Every morning, my friend does these exercises entitled “Five Tibetans Monks”. Since my friend started with that, he hasn’t become sick any more. He also felt mentally balanced. I can’t guarantee it. He kept on swearing it to me.

Another (German) f r i e nd, me anw h i l e 7 5 years “young” can’t enjoy his breakfast without first jogging for an hour or even more starting at 5 a.m. If he’s not able to practice it, he becomes moody, intolerable, aggressive and frustrated.

Bad days...!

Others have to swim three times a day. Good for those, who have a swimming pool or live near a beach or sea shore.

I love a glass of red wine (don’t get me wrong: I said ONE glass!), a good book (what ever that means for you, my dear reader!), and relaxing (old!) classical music. So, each one of us is looking for his or her special ways of being comfortable.

But, some of our dear fellow creatures can’t really get some peace. They heave a sigh and utter a groaning all day long! The Five Tibetans Monks have been blurred.

Jogging is unhealthy; green tea is putting out and forces ill-feeling; swimming in a pool supports logical ring worms! Heaven forbid!

I’m sure, my red wine is never digestible and instead reading a good book while listening relaxing music weigh heavily upon our minds.

A couple of years ago I met an expatriate who loved to swing a pendulum to and fro. Billy occupied himself with astrology and the esoteric. I will never forget one of his first See days, page A11

Watershed council pushes plan for ecosystem sustainability in CDO CAGAYAN de Oro City-Present and future generations in Cagayan de Oro brace to a healthy and balanced ecology in the city.

The Executive Committee of the Agusan-Cugman Cluster of Watersheds Management Council (ACCWMC) has endorsed on 18 November 2015 the proposed Environment and Natural Resources Management (ENRM) interventions of the Balubal Integrated Social Forestry Farmers Association (BISFFA).

Forester Samuel M. Jumawid, technical editor officer of DENR’s Region-

al Project Coordinating Office (RPCO), said the project intends to increase economic condition of the upland communities and forest cover within AgusanCugman Watershed through agroforestry and reforestation, with a cumulative area of 61 hectares proposed to be implemented with Integrated Natural Resources and Environmental Management Project (INREMP) support in three-year period or until year 2018; He further said the government recognizes the vital role of various stakeholders in the protection,

rehabilitation, development, management, and utilization of the natural resources in watershed and river basins; hence the crafting of the proposal has involved the participation of national government agencies (NGAs), non-government organization (NGOs), religious sector, academe, local government units (LGUs), security group, Indigenous People (IP), peoples organizations (POs) and business sectors, and other stakeholders.

BISFFA, comprising a total of 121 households are the actual occupants

of the area which possess tenure security over the area covered by Community Based Forestry Management Agreement (CBFMA) with total area of 250 hectares where ENRM subprojects shall be implemented.

Pablo M. Bactong, BISFFA president, said they are very glad for the favorable action to their proposal.

This is not only benefit the Balubal’s officers but also to all the direct 121 household

beneficiaries.

Among the direct benefits identified come from participation of members to do labor work and harvesting agricultural and timber products.

The implementation of the subproject seen to increase the likelihood of attracting additional possible markets for the people’s organization goods and services.

was organized to promote the formulation of policies and programs in consultation with the stakeholders.

APEC bolsters disaster resilience-building drive

Asia-Pacific Economic Cooperation (APEC) membereconomies agreed facilitating disaster resilience-building across the Asia-Pacific region which accounts for some three billion people and half of global trade while experiencing over 70 percent ofdisasters.

The member-economies reached such decision and adopted this week the APEC Disaster Risk Reduction (DRR) Framework, recognizing such region’s need to better prepare for natural hazards like earthquakes and the “new normal” posed by climate change-driven extreme weather events as well as sea level and temperature rise.

“Through the APEC DRR Framework, we will minimize the losses we endure and ensure that our communities have the support to overcome adversity and to build back better,” APEC economic leaders said in their declaration after meeting in Metro Manila this week.

Their declaration outlines initiatives aligned with the 2015 APEC theme ‘Building Inclusive Economies, Building a Better World.’

APEC groups Australia, Brunei Darussalam, Canada, Chile, People’s Republic of China, Hong Kong, Indonesia, Japan, Republic of Korea, Malaysia, Mexico, New Zealand, Papua New Guinea, Peru, the Russian Federation, Singapore, Chinese, Taipei, Thailand,

USA, Viet Nam and the Philippines.

Introduced during APEC senior disaster management officials’ meeting in Iloilo province this year, the group’s DRR Framework is a collaborative platform for strengthening Asia-Pacific economies’ resilience to natural hazards and climate change.

“The framework will guide policy coordination within and between APEC economies to combat rising frequency, magnitude and scope of disasters that are endangering lives and economic stability like never before,” said APEC. APEC said the framework emphasizes advancement of measures on prevention and mitigation, preparedness, response as well as rehabilitation and rebuilding.

“Under the framework, APEC members will pursue enhanced cooperation across all areas of their policy agenda - from ensuring regional trade and investment flows, business continuity in the micro-, small and medium enterprise sector, and critical infrastructure and financialresiliency, to the protection of food security, health and the environment,” APEC also said.

In their declaration, APEC leaders directed ministers concerned to develop next year the action plan for operationalizing such framework.

“We recognize that our region, located in the Pacific Ring of Fire, is particularly

vulnerable and exposed to disasters,” they said. “We face typhoons, earthquakes, volcanic eruptions, rising sea levels and pandemics the impacts of which are magnified by our densely populatedcities. It has become a new normal for us to face natural disasters of increasing frequency, magnitude and scope - and their resulting disruption of the increasingly integrated and interlinked production and supply chains.”

The leaders also called for renewal of existing DRR-related efforts like strengthening early warning systems, promoting appropriate donations and enhancing capacity-building as well as business continuity planning, search and rescue and post-disaster recovery.

They believe the framework will help “facilitate collective work in building adaptive and disaster-resilient economies supporting inclusive and sustainable development in the face of the new normal.”

Meeting in Vietnam this September, the APEC Emergency Preparedness Working Group (EPWG) noted integrating different sectors to reduce disaster risk will help promote safety and resilience of goods in supply chains even during disasters.

“All precautionary measures can strengthen resilience of the economy and community,” EPWG CoChairperson Dr. Li Wei-Sen said at the meeting.

“Early prevention measures with the participation of communities in all stages - from mitigation, preparedness, response to post-disaster recovery - are most effective in saving lives and minimizing the adverse economic and social impacts,” he said at the meeting.

C ommencing as an informal dialogue group

in 1989, APEC evolved to become the premier forum for facilitating economic growth, cooperation, trade and investment across the Asia-Pacific region.

Free, open trade and investment is the key goal APEC targets achieving in the region through trade and investment liberalization, business facilitation as well as economic and technical cooperation.

Earlier, however, State think tank Philippine Institute for Development Studies (PIDS) warned disastrous typhoons and other extreme weather events can derail the bid to achieve such goal.

“The increasing frequency and intensity of natural disasters could seriously hamper efforts of economies gearing up for higher and sustained growth,” said PIDS which helped organize the May 2015 APEC research conference in Boracay Island.

PIDS noted repeated disasters drain public coffers and contribute to the poverty cycle in affected communities so countries must already set respective disaster funding.

Greenhouse gas concentrations hit record high: WMO report THE amount of greenhouse gases in the atmosphere reached yet another new record high in 2014, according to a new report released Monday by the World Meteorological Organization (WMO).

The report, titled “Greenhouse Gas Bulletin”, said that between 1990 and 2014 there was a 36-percent increase in radiative forcing, the warming effect on our climate, because of longlived greenhouse gases such as carbon dioxide, methane and nitrous oxide from industrial, agricultural and domestic activities.

“Every year we report a new record in greenhouse gas concentrations,” said WMO Secretary-General Michel Jarraud.

“Every year we say that time is running out. We have to act now to slash greenhouse gas emissions if we are to have a chance to keep the increase in temperatures to manageable levels,” Jarraud noted.

The most important longlived greenhouse gas, carbon dioxide, accounted for about 83 percent of the total increase in radiative forcing by long-lived greenhouse gases over the past decade.

Atmospheric concentrations of carbon dioxide reached 397.7 parts per million (ppm) in 2014, which is 143 percent of pre-industrial levels.

In the northern hemisphere carbon dioxide concentrations crossed the symbolically significant 400

ppm level in 2014 spring, when CO2 is most abundant.

In spring 2015, the global average concentration of carbon dioxide crossed the 400 ppm barrier. The global annual average is likely to pass 400 ppm in 2016.

Atmospheric methane reached a new high of about 1,833 parts per billion (ppb) in 2014 and is now 254 percent of the pre-industrial level. In addition, nitrous oxide concentration in 2014 was about 327.1 ppb, equals to 121 percent of pre-industrial levels.

WMO said the Bulletin provided a scientific base for decision-making ahead of the UN climate change negotiations in Paris to be held from November 30 to December 11. (PNA)

The importance of inclusive and productive classroom setting

In order to make promotion of learning effective, it is important for an educator to establish a productive and inclusive climate in the classroom. It is because learning is not just about discussing lessons and making sure that students still remember it when a teacher asks for a recap.

To realize an inclusive classroom environment, it is but proper to examine assumptions.

Example for this is being sensitive in discussing particular matters.

True, it is common for a teacher to assume that student shares own background, but this perception is not really good because a group of students in a classroom certainly varies in religion, sexual orientation and economic class.

Making students feel at home in the classroom is also a step way

up towards achieving an inclusive environment. Calling students by their name in class is also better to make them feel that they are given importance to. This also informs them that their teacher makes an effort to remember names.

It is as well significant to establish ground rules for interac tion to assure that students are also being inclusive and respectful. To generate maximal buy-in into the ground rules, a teacher can involve the students in the process of establishing them and correct them for the occasional noninclusive or disrespectful comment.

An inclusive classroom environment entails productive learning and harmonious relationship. Thus, this should be applied.

As started by Piaget, Vygotzky and Dewey, the use of constructivist approach to teaching is simply breaking the bondage of traditional teaching practices. Teachers nowadays are discouraged to use such traditional approaches in such a way that these in the end make the students passive. Audrey Gray cited in her master’s thesis that constructivist teaching is based on the belief that learning occurs as learners are actively

involved in the process of meaning and knowledge construction rather than passively receiving information. As a Master Teacher, I believe that it is in this sense that through constructivism coupled with proper facilitation of the teachers, the students will become active and creative in their own skills and initiatives.

I messed up with Billy. Sayang! He was a really good friend.

I travelled a lot. I stayed in more than 60 countries. I experienced in some Western countries, that travel agencies recommended trips to Mexico for “Leos” or to Turkey for “Capricorns”.

I went to both countries and didn’t feel anything wrong or bad. I estimated roughly, which dramatic mis-judgements, accidents, and sickness outbreaks or losses have happened in my life during days followed by full moon periods.

The third mayoral candidate is Heckert Vega-Emano, an incumbent Provincial Board member representing Misamis Oriental's second district. He is the first cousin of Misamis Oriental Gov. Yevgeny Emano. Heckert's father, well known surgeon Dr. Hernando ”Nandy” Emano is the elder brother of former governor and former Cagayan de Oro city mayor Vicente Emano.

Heckert will run under the former mayor's Padayon Pilipino party. The fourth mayoral candidate is Dr. Serena Ranizez Emano, ex-wife of the incumbent Tagoloan mayor.

The good doctor is said to be running after she was disappointed that her son with Mayor Paulino Emano wasn't picked as his successor. It was whispered to me that the decision was made

by Paulino's brother and Padayon founder Vicente Emano.

Many have tried but failed to end the Emanos rule in Tagoloan. One person I can remember trying

was the late Ignacio Totong facture who was really a good mayoral candidate.

Some are already dead while others are still alive but have lost their voice or kept their frustrations in their heart. Others already joined them but there remains other people who wish to end the five centuries rule of the Emanos.

Tagoloan town remains the bailiwick of the Emano clan and they would do everything to hold their fort.

Before becoming governor, Vicente Emano ruled Tagoloan for three terms of three years each, while his son Yevgeny Emano also ruled Tagoloan for three terms.

Paulino “Oloy” Emano ran Tagoloan for six threeyear terms or 36 years. This doesn't include the rule of their grandparents Mayor Antonio Cosin and Tecla Cosin.

Not that they aren't good people, they have done a lot for the people and the town.

It's just that I am sure that there are Tagoloan residents who want new faces, not another Emano in office.

Public office isn't a monopoly but the Emanos have kept a tight grip on Tagoloan for all these years. It's up to the Tagoloan residents if they are satisfied with the service done by the Emanos.

I don’t want to judge because that would be another story. But the time will come when the people will get tired and vote for someone else to lead them into the next decade.

When Vicente Emano lost in the mayoral elections in Cagayan de Oro in 2013, it signaled to the Tagoloan residents that the Emanos are mortal after all and can be defeated.

Many believe that next year's elections will signal the end of the Emanos if Yoyoc and Enan would unite against the Emanos.

Inside information I received that there were attempts for the two candidates to meet with the presence of some leaders.

The same source told me that Enan already begged Yoyoc to give him just one term as mayor while he runs as vice mayor so the Emanos won't stay in office one minute longer.

From another source I learned that Yoyoc is amenable to the idea but it's his father Sergio Yap who isn't agreeable.

Both men would be at a disadvantage, say my source, as Heckert would have the solid votes from the Emanos. If Tagoloan residents decide that they are tired of the Emanos and want a change in leadership then Yoyoc may be the winner.

But based on my source, Tagoloan town is still ruled by clans and that would favor Enan who comes from the vote-rich Sabio clan.

Still, many Tagoloan residents still believe that Enan and Yoyoc will join forces.

And I couldn't blame them since it's still a long way to go until December 10.

He said the cargoes were the subject of an alert order issued by Deputy Commissioner Ariel F. Nepomuceno on September 10, 2015.

He said the cargoes were also seized for allegedly violating Section 2503 in relation to Section 2530 of the Tariff and Customs Code of the Philippines (TCCP), as amended.

He said the cargoes came from the Republic of Korea and arrived at the sub-port of Tagoloan town via Asia IPSA 018.

He identified the owner of the cargoes as a certain Mr. Park, a Korean national based in Davao City.

Last month, the BOC10 seized a total of 35 tons of Sodium Cyanide worth millions of pesos due to lack of import permits, for being undervalued and for misdeclaration of quantity.

Prior to the confiscation, Bureau of Customs-Intelligence Group (IG) Deputy Commissioner Jessie Dellosa issued last July 3 Alert Order No. 20150703-101 against said importation with Korea as the port of origin.

BOC-10 Intelligence Officer II Alvin Y. Enciso said two container vans were initially seized, but the consignee appeared to have two more container vans coming, bringing to four the total number of container vans now being seized by the BOC at the Mindanao Container Terminal in Tagoloan town, Misamis Oriental.

Enciso said a warrant of seizure has been issued by Atty. Ruby Claudia Alameda, acting district collector, against the release of the container vans with Sodium Cyanide to the consignee, Central Combal Mining Supply Corp., which arrived at the MCT-Sub-Port on July 2, 2015, on board the Asia Ipsa V. 015, covered

by Bill of Lading No. APLU 011229519 and declared under Import Entry No. C-5277-15.

“We were suspicious

because the importation permit that was given to the consignee, Central Combal Mining Supply Corp., came from the Environmental Management Bureau (EMB) based in Region 4 when the importation is here in Region 10,” Enciso said.

Enciso said the MGB10 here, itself, said that the importation permit is void, because it is the office in this region that should release the permit to the consignee.

A few weeks later, the EMB-10 issued a permit, but the BOC, according to Enciso is contesting it since, on the first place, the items arrived the MCT Sub-Port with without a permit.

Enciso also said the imported items were clearly misdeclared by the consignee, placing the amount of their items at P570,000.

But per verification with the Imports and Assessment Service of the BOC and other similar importation in other regions, the items was supposed to to be at P4 to P5 million. The Import and Assessment Service placed the proper valuation of the items seized at US$2.08/kg.

Enciso also cited the violation on “under valuation,” which over the limit of 30 percent which is seizurable.

Enciso said they are recommending for the automatic forfeiture of the items since it is grossly under valued.

The IG reported that per verification of the consignee, identified as Man Hoon Park, is operating Cyanide sale within the Davao-Cagayan de Oro area.

Enciso explained that Cyanide and Cyanide Compounds are one of the regulated chemicals under RA 6969.

The case involved the anti-graft case filed by William Guialani, a former village official, in Taglimao, in connection with the Ajinomoto case. In his complaint, Guialani contended that Moreno and City Treasurer Glen Banez agreed that Ajinomoto pays PHP 300,000 business tax due the City Government instead of the original PHP 2.9 million.

On Oct. 6, 2015- Ombudsman Conchita Carpio Morales approved the dismissal order of Moreno and City Treasurer Banez and transmitted the order to the Department of Interior and Local Government (DILG) in Manila for implementation within 10 days upon receipt thereof.

Nov. 2, 2015 – The DILG received the Ombudsman’s transmittal order and has 10 days to serve the dismissal order of Mayor Moreno.

Nov. 12, 2015 – At about 7:00 p.m. the DILG regional office served the dismissal order in City Hall by posting the transmittal order in the ground floor of the legislative building because the followers and supporters of Moreno have blocked the

entrance of the City Hall’s main door that leads to the Office of the City Mayor in the building’s second floor.

Nov. 12, 2015 – At about the same time, Vice Mayor Caesar Ian Acenas and City Councilor Candy Darimbang were sworn in and installed as the new City Mayor and Vice Mayor respectively.

Nov. 13, 2015 – In the evening of the day, the 22nd Division of the Court of Appeals (CA) in Cagayan De Oro City issued a resolution granting the petition of Moreno for a certiorari (contesting the Ombudsman decision) and a 60-day Temporary Restraining Order (TRO). The CA resolution was meet with varied legal resistance since it was supposed to have been “mooted” after Acenas was sworn into office.

Nov. 16, 2015 – Moreno, in reply to the CA resolution, filed a petition to pursue the legal argument that the reckoning of the TRO should be counted on the day the petition for the TRO was filed on Nov. 11, 2015, a day before the Ombudsman order was implemented and Acenas was sworn in as City Mayor on Nov. 12, 2015.

Nov. 17, 2015 – The DILG sent a letter recognizing Oscar Moreno as the City Mayor of Cagayan De Oro City on the ground that the Ombudsman has yet to act on Moreno’s Motion for Reconsideration in connection with his dismissal from service.

Nov. 17, 2015 – The camp of installed City Mayor Caesar Ian Acenas described the DILG letter as a “mockery” and a personal letter, which did not affect the validity of Acenas assumption as the new City Mayor.

Nov. 18, 2015 – The CA 22nd Division based in Cagayan De Oro City sustained the petition for certiorari and 60-day TRO of Moreno; agreed that the reckoning of the TRO starts on Nov. 11, 2015, the day of the filing of the petition, and concurred with the letter of the DILG recognizing Moreno as still the City Mayor.

Nov. 19, 2015 – Installed City Mayor Caesar Ian Acenas and Vice Mayor Candy Darimbang stepped down peacefully in compliance with the CA resolution.

Granting without admitting that Moreno’s counter affidavit was “lost” or purposely taken out, who would have done it? Did anybody lobby to deprive Moreno the liberty to submit the “counter affidavit” when all other documents in the anti-graft case against him were supposedly in order? Or, was the counter affidavit purposely taken to give Moreno the upper hand in the legal battle that would ultimately lead to the reversal of the Ombudsman decision?

In this instant case, we could now sense the reversal

of the Ombudsman decision because the anti-graft court erred on the ground of technicality. The next 60-day period, the duration of the TRO, is only a peripheral condition designed to protect Moreno as City Mayor.

However, other observers see the Moreno case from another vantage point. Why at the time when Moreno was severely wounded, he was able to regain strength and effectively regain his Mayoral seat?

First: The Ombudsman rendered a “dismissal order” by creating an “inherent flaw” in order for Moreno to find ways to cleanly escape the implementation of the order.

Second: Amid a barrage of anti-graft cases, the Ombudsman dismissal order was to simply testing Moreno’s popularity and culpability as the City Mayor of Cagayan De Oro. Third: Moreno takes control of the media and the flow of information.

Before anything, ever wonder why the Ombudsman rendered a decision on a case filed by William Guialani, a former village chief, instead of considering the anti-graft cases filed by members of the City Council?

Perhaps, the Ombudsman wants to send a message that it would be easier for the anti-graft court to render a decision on cases that are filed by ordinary citizens than the cases filed by the political opposition, which might be interpreted as politically motivated. The Ombudsman decision that favors Guialani, in the case of versus Moreno, looks credible.
