CAGAYAN de Oro City-Vice Mayor Cesar Ian Acenas stepped down as City Mayor on Thursday, Nov. 19, after the Court of Appeals (CA) released an order that sustained the temporary restraining order to be effective prior to the serving of the dismissal of City Mayor Oscar Moreno by the Office of the Ombudsman.

The Department of the Interior and Local Government (DILG) sought clarification from the CA after Moreno and Acenas continued to function as the city’s chief executives, since November 13.

This, after the DILG installed Acenas as mayor on November 12 while Moreno remained holed up in his office and stayed there by virtue of the TRO issued by the CA on November 13.

Obama calls for tax credits, subsidies for green initiatives

UNITED States President Barack Obama has urged governments to provide tax incentives for the production of clean energy, and to finance research

and development of green initiatives.

During a forum in the Asia-Pacific Economic Cooperation (APEC) CEO Summit that he moderated,

President Obama highlighted the government’s role in providing tax incentives and subsidies for entrepreneurs to be able to produce clean energy.

Solar energy, for example, requires heavy subsidies on the front end, but the reduced cost per BTU in the past years “exceeded many of our expectations”, he said.

REINSTALLED Mayor Oscar Moreno informed all city government employees, including those reassigned earlier by temporary Mayor Caesar Ian Acenas, to get back to their November 13 posts.

This, after the Court of Appeals (CA) issued a resolution upholding its November 13 temporary restraining order (TRO) preventing the Ombudsman from implementing its decision to dismiss Moreno from office.

30-minute power interruption on November 22

To facilitate the re-energization of Ponciano Substation, Davao Light and Power Co. will conduct a 30-minute power interruption on November 22, Sunday, anytime between 12:01 a.m. to 2:00 a.m.. This will affect customers connected to selected feeders in Ponciano, Ecoland, Sta. Ana and Bajada Substations.

He said that upon arrival at the SM Van Terminal, three passengers remained.

Daag recalled a male passenger disembarked in front of the terminal, while his two other passengers, a male and a female got off inside the terminal.

Investigator still determine the persons and the motive behind the incident.

Chief Inspector Milgrace Driz, spokesperson of the DCPO urged the public not to share in the social media videos about persons of interest relative to the latest IED explosion.

She said doing so might hamper the investigation.

“Let us wait for the final of the investigation before releasing any videos/documents.

41 flights cancelled at Davao airport due to APEC Summit

DAVAO City––A total of 41 flights from Davao to Manila and vice versa have been cancelled from Novemb er 15 to 20 to give way for the arrival of heads of states attending the APEC Leaders’ Summit in Manila.

In an advisory issued on Tuesday by the Civil Aviation Authority of the Philippines (CAAP), the cancellations of flights started on Sunday, affect-

ing passengers of ManilaDavao-Manila flights of Philippine Airlines (PAL).

She was in the city for a vacation and was about to return to her work in Riyadh as a phlebotomist.

GENERAL Santos City--At the country’s tuna capital, environmental group Greenpeace presented the results of their Tuna Cannery Ranking Report for the Philippines. An initial survey of local tuna canneries, the report exposed the lack of transparency and traceability in the Philippine tuna industry and also highlighted cases of human rights abuse in the supply chain.

The cannery ranking came a year after Greenpeace exposed the rampant

catching and trading of juvenile ‘baby’ yellowfin and bigeye tuna at the General Santos fishport. These juvenile tuna were found to be less the average size of 1 meter in length and below the weight limit of 500g set by the Fisheries Administrative Order. Environmentalists and scientists say the continued catching of juvenile tuna contributes to the decline of stocks, not just in the Philippines but globally.

Of the nine local tuna canneries surveyed this year,

while PAL will do the same for six of its flights.

For Friday, five Cebu Pacific flights and two PAL f lig hts have b een cancelled.

A PAL official, who refused to be named, told MindaNews that affected passengers have been informed ahead of the cancellations and were rescheduled already for the next available flights.

No complaints from affected passengers have so far been received, the source said.

The Court of Appeal (CA) has nailed the issue on the effectivity of the Temporary Restraining Order (TRO).

Whether the CA’s resolution upholding its Nov. 13, 2015 allowing the City Mayor Oscar Moreno to resume exercising his mayoral functions after the interior government served the order of the Office of the Ombudsman that “dismissed and perpetually disqualified” Moreno from public office, is flawed is, for now, water under the bridge.

After all, the people of Cagayan De Oro could heave a sigh of relief and that the Holiday Season for the City Hall employees would not be “bluer than blue.” The city government workers could enjoy their salaries and wages and bonuses for the season. Cheers!

not blame the embattled Moreno exhausted every available means in defending his rights and assailing the “rule of law” as his only shoulder to lean on.

In any case, Moreno was right in obtaining the TRO to prevent the Ombudsman from implementing its dismissal order. But, the argument that the application of the TRO should “reckon” at the time the manifestation was filed in the court is awkward.

While admitting that we are ordinary citizens and are deprived of the position to argue the essence of the law, we have the right to a common understanding of

things. Thus, it is the right of the ordinary citizen, like us, to have our own views and opinions about laws and its operations. Of course, with no intention to abrogate or defy court orders.

It is on this ground that we are obfuscated in the idea that the “effectivity of the issuance of the CA resolution reckons at the time the manifestation or petition was filed in court” rather than at the exact day when the noticed of resolution was approved and issued.

While we respect the decision of the CA, we could, but telescope the ill-effect of the cases that would be filed in court in the future, bearing the same semblance of the instant case. When that day comes, it won’t matter anymore if the court issues a restraining order in a week or two, provided that the petition for the TRO is filed earlier, even if a decision is already promulgated because the danger of being “mooted” no longer exists. It seems, this is a new legal ground that have to be explored.

We believed ‘though that

until the legal ground is duly established, the prevailing legal application of the restraining order remains. “Nihil mutatur nisi mutatum” (Nothing is changed, unless changed!)

And, in spite of the shortcomings, one could not but also commend the steadfast character of Vice Mayor Caesar Ian Acenas and his camp for holding on to what was right. After all, being the Vice Mayor, Acenas assumption of the Office of the Mayor albeit briefly was within the bounds of the law. To the people of Cagayan De Oro City, be patient.

But, until the Office of the Ombudsman issued a final resolution of the Motion for Reconsideration (MR) of City Mayor Oscar Moreno, the dismissal of Moreno would also remain vague and obscure. If it is true that Moreno’s “counteraffidavit” was lost, was it purposely done in order to give Moreno the leverage to fight and hold in abeyance his dismissal order?

We should pray that we shall be benefited more than the others in terms of opportunities and business prospects to alleviate our situation. I wish our country will be fully industrialized and could stand on level with Asian nations like Japan, China, Korea and others. Certainly, we are not so poor, but because of the more than a hundred million people in our land, we need a lot of employment, food, medicines, education and everything to survive with comforts. We need all these things from our neighbors who are much wealthier than us.

With the advent of modern science more particularly in medicine, we noticed people now live longer and

by this, surely follows the need for food.

We need employment for our people to break even with the law of supply and demand. In short our country needs more income for our people to sustain life in the homes and contributing unwittingly the growth and development of our nation.

We must have the right connections to lure investors via our friendliness, hospitality and culture.

We should even appreciate if more big world leaders can come to our country and see for themselves the opportunities of not only establishing good relationship but trade and industry in our favor. Some years ago some naughty compatriots described our country as a tiger of Asia.

It was not true as we remained lagging behind our brother nations. One thing certain, though, we are no longer the sick man of Asia.

With some neighbors, realizing our potential, we can rise comfortably and join the regatta of rich nations.

THINK a minute.

There were two very sick men who shared a room in a hospital.

The man whose bed was by the window was allowed to sit up for an hour each day to help drain the fluid from his lungs. But the other man, who was not able to sit up, spent all his time laying flat on his back.

Dengue cases in Caraga region down by 48%

BUTUAN City--Dengue cases in Caraga region dropped by 48% from January 1 to October 24 this year with 3,540 cases and 25 deaths

recorded compared with last year’s same time period with 6,827 cases and 44 deaths, the Department of Health (DOH) - Caraga reported.

Most of the cases were recorded in Surigao del Sur at

704, followed by Butuan City with 676 cases, Agusan del Sur with 645 cases, Surigao City with 341 cases, Agusan del Norte with 307 cases, Bayugan City with 262 cases, Surigao del Norte with 246

cases, Bislig City with 110 cases, Cabadbaran City with 105 cases. Then, Tandag City with 73 and Dinagat Islands’ 71 cases.

Of these cases, 54% were males and 38% belonged

to 0 to 10 years age group according to records from the Regional Epidemiology Surveillance Unit (RESU) of the DOH 13.

that the best way to eradicate this problem is by searching and destroying mosquito breeding places and be updated to the dengue status of each barangay in the locality.

Zambo City employees start receiving bonus, cash gift ZAMBOANGA City -- The local government has allocated PHP23.65 million for the yearend bonus and cash gift of the 2,120 employees to be released this month.

City Hall Information Officer Belen Sheila Covarrubias said the amount represents half of the employees’ Christmas bonus, which is equivalent to their one month salary and PHP5,000 cash gift for this year.

The other half of the Christmas bonus and cash gift was already released in May this year.

Paris climate deal can help stimulate economy

Sealing a new climate deal in Paris this year may just be what’s needed to help rev up the global economy.

In Metro Manila for various Asia-Pacific Economic Cooperation (APEC) activities this week, US President Barack Obama raised such possibility by pointing out that a universal deal on lowering climate changedriving emissions of carbon dioxide and other greenhouse gases (GHGs) will fuel demand for clean technologies so countries can mitigate these discharges accordingly.

“An ambitious agreement in Paris will prompt investors to invest in clean energy technologies because they’ll understand the world is committed to a low-carbon future,” he said.

He also expects the new climate deal to help open up opportunities for jobs and other economic activities.

International delegates to UN’s 2015 climate change conference in Paris will seek to arrive at a universal agreement that’ll keep global temperature rise to below 2°C. Experts continue warning about GHG emissions, noting these accumulate and trap heat in the atmosphere so global temperature rises and this results in climate change.

such possibility. “There’s a lot of capital out there looking to invest,” he said.

If countries can demonstrate seriousness in reducing GHG emissions, he said this can be an “enormous generator” of business opportunities. “That’s a signal to the private sector to go all in on REtechnologies,” he also said.

He noted last year, RE accounted for more than half of all new power plants built around the world.

“APEC is working to double RE and reduce energy intensity by 45 percent over the next two decades,” he said further.

Citing advances in clean technology application during his term, Mr. Obama said the US is already producing thrice as much wind power than when he assumed the presidency. “We’re producing about 20 times as much solar power as when I came into office,” he also said.

He noted RE investments made over the years helped make wind and solar power in some US areas cheaper than dirtier conventional power.

“Since 2005, even as our economy’s growing, America cut its total carbon pollution more than any country on earth,” he said.

The CA, in issuing the clarificatory order, resolves to note the manifestation filed by petitioners Moreno and Banez, private respondent and the DILG, which installed Acenas as mayor of the city on November 12, 2015.

On November 13, 2015, the CA issued a temporary restraining order (TRO) and a writ of preliminary injunction that both constitute temporary measures availed of during the pendency of the action.

“They are, by nature, ancillary because they are mere incidents in and are dependent upon the result of the main action. It is wellsettled that the sole object of a temporary restraining order or a writ of preliminary injunction, whether prohibitory or mandatory, is to preserve the status quo until the merits of the case can be heard,” the CA order says.

The CA further instructs “all concerned that the declaration of the DILG, a party to this case, is conclusive as to the status quo sought to be preserved by our TRO which binds all parties, agencies or persons concerned to refrain from doing any act or acts disruptive of the status quo.”

Acenas, during a press conference he called with installed Vice Mayor Candy Darimbang, said it was not his fault if he and Darimbang assumed as mayor and vice mayor, respectively, of the city.

Acenas said that he was only called upon to assume after the Ombudsman released the dismissal order against Moreno and Banez, otherwise, he may be charged with dereliction of duties.

And, in stepping down, he and Darimbang only want normalcy and order in Cagayan de Oro City.

He called upon Moreno to stop orchestrating the situation and blaming him for the rather chaotic scenario at city hall.

William Guialani, the erstwhile barangay chairman of Taglimao, was the primary complainant in the case which led to Moreno’s dismissal.

Last March, Guialani filed a graft complaint against Moreno and city treasurer Glenn Banez, alleging that they entered into an August 2014 agreement that cut Ajinomoto Philippines Corp. taxes to only P300,000 from more than P2.9 million covering the period 2006 to 2012.

Guialani stated in his complaint that the alleged agreement was illegal because it did not have a supporting resolution passed by the City Council.

The Ajinomoto case was a fourth in a string of eight cases filed by Guialani, a self-professed moral crusader who is seeking a City Council seat independently, against Moreno since 2014.

Of the eight, only the Ajinomoto case was able to render an Ombudsman decision.

In an October 6 decision, Ombudsman Conchita Carpio Morales found Moreno guilty of grave misconduct, stating that the non-authorization from the City Council constitutes a violation of the Local Government Code.

Moreno said the decision stated that he failed to file his counter-affidavit.

He claims that either his counter-affidavit was misplaced or someone deliberately removed it so the Ombudsman investigator could not examine it, but he did file.

“It’s too late to complain whose fault. Whether your fault or my fault, let’s solve the problem together. It’s the combination--we’re combining the work of government, private sectors, scientists, and sociologists and philanthropists. We have to work together,” Ma said.

Govt to mainstream energy infrastructure THE government will further work to mainstream energy infrastructure planning in local development activities nationwide.

The move aims to help the Philippines better address climate change and achieve energy resiliency which the Asia-Pacific Economic Cooperation (APEC) envisions for the country and other nations in the region.

“Energy infrastructure planning will be integrated in local development nationwide,” said Climate Change Commission (CCC) Assistant Secretary Joyceline Goco.

She said it is among the activities under the 2015-2019 ‘Support to the Philippines in Shaping and Implementing the International Climate Regime (SupportCCC II)’ project of the Philippine and German governments.

Among SupportCCC II’s components include renewable energy (RE) and energy planning.

Germany’s Ministry for the Environment, Nature Conservation, Building and Nuclear Safety will provide nearly 5 million euros for the project which will build on the previous German-funded “Support to CCC in implementing the National Climate Change Action Plan” project.

Launched in Metro Manila last week, SupportCCC II targets strengthening key Philippine actors’ capability in carrying out and coordinating the country’s national climate change regime.

“We don’t want to be forever the face of climate vulnerability,” said CCC Commissioner Emmanuel de Guzman.

The project also enables the Philippines to help shape the international climate regime by sharing local experiences and best practices in adaptation and mitigation.

“The project is going beyond the national to the international level,” said Goco.

“With regards to sustainability, we discovered that there are a lot of juvenile tuna being caught through the use of payaos or fish aggregating devices (FADs) in purse seine fishing. This is devastating the tuna stocks, with big eye tuna now down to 16%. We should already be sounding the alarm bells and calling for fisheries closures.”

In addition to the call for more sustainable fishing methods and transparency in the fishing industry, Greenpeace Philippines also expressed concern over unfair labor practices. A key criteria in the cannery ranking report was on the equitability of the tuna stocks. The report documents how tuna in some places is being caught by

Legarda cited the need for carrying out vulnerability assessments and emergency response planning to identify major energy networks facing dangers from natural hazards.

“The energy infrastructure system receives the brunt of disaster impacts, resulting in disruptions to business and delivery of basic services,” she said.

Climate change elevated the need for protecting energy infrastructure, Legarda continued.

“Energy security and climate security are two stories under the same plot,” she noted.

Under SupportCCC II’s en-

ergy component, the government will promote the use of RE nationwide.

Government will also align the country’s national energy planning towards a coherent and climate-friendly power sector.

“We hope that through collective efforts of parties involved in the project, there can be integrated energy planning,” said Mario Marasigan, chief of the energy department’s Renewable Energy Management Bureau.

CCC, the energy department, other actors at the national and local levels as well as German aid agency Deutsche Gesellschaft fur Internationale Zusammenarbeit are partners in SupportCCC II. In Cebu last month, APEC’s energy ministers adopted the Cebu Declaration which promotes energy resilience in Asia and the Pacific.

“The ministers agreed climate-proofing energy infrastructure is a significant endeavor towards energy resiliency,” Department of Energy Sec. Zenaida Monsada said at the meeting’s press conference.

They also affirmed energy resiliency’s importance in promoting energy security and sustainable development in Asia and the Pacific.

“We recognize that the APEC region has become the lynchpin of world economic progress,” the miisters said in the declaration.

“Our combined growth rate is estimated at four percent annually over the past 10 years - one of the more dynamic economic regions in the world. This growth has translated into an annual increase of about three percent in energy consumption.

We reaffirm that energy remains a critical input for intensifying and sustaining productivity improvements across all sectors in the economy which supports APEC’s economic development.”(PNA)

“We join Greenpeace and other allies in calling on the tuna industry to end destructive fishing, while respecting the labor and human rights of people working across the supply chain,” said Josua Mata the Secretary General of Sentro ng mga Nagkakaisa at Progresibong Manggagawa or SENTRO, an organization assisting the United Workers of Citra Mina Group of Companies (UWCMGCU) which is currently in a deadlock with the tuna company for violating labor standards.

Mata added that unless the tuna industry makes a fundamental shift in their

fishing methods and labor practices, it will continue to receive tremendous pressures, like Citra Mina. “We shall stand with Greenpeace and all those workers affected until the company’s practices are changed. There can be no sustainable fishing industry until people working across the supply chain are safe and treated with dignity,” Mata said.

Greenpeace and SENTRO believe that across the globe, the tide is shifting towards the need for sustainable seafood. The Philippine tuna industry has no recourse but to reform and adhere to international standards and to what the public demands.

“Globally, consumers are demanding for traceable, sustainable and equitably caught seafood. There is a new consciousness among people who buy and choose tuna brands that do not jeopardize the very resources that we all rely on,” concluded Cinches.
