THE past few days have been near freezing in my place here in Charlotte, North Carolina and I’ve been holed up and spending time reading for the most part. First, allow me to thank Ermin Pimentel of Cagayan de Oro City for emailing me recent events in my city or giving links for follow-ups on it. I owe you Ermin. I’m saying this outright; even if it is too early he deserves a seat at the City Council. He has been doing work for Xavier University way back in time long when others were still sleeping or awake, but were scared of the powers that be around that time. His works on citizen’s engagement in good governance, environmental concerns, youth social formation and involvement among others are worth mentioning. But in due time I would be talking especially about the engagement in good governance and ask this son of lawyer Erlington Pimentel to explain to us what is engagement in good governance. Pimentel should be at the City Council to forward his advocacies to legislation. Anyway, Ermin emailed

me the Order of the Court of Appeals granting the petition of Mayor Oscar Moreno which was a day late. I have nothing to say about it except I have something to say about the separate concurring opinion that was on the last page and many would not give attention. It was signed by Justices Edgardo A Camello and Pablito A Perez. The pages not only enlightened, but gave me an explanation of what happened to that crucial day on Thursday in Cagayan de Oro. I read it several times to see the meaning in between the lines of the separate concurring opinion. Eureka; for the benefit of others a concurring, dissenting opinion or separate opinion isn’t given attention. In a case of a separate concurring opinion, it means justices concur to the majority of those who wrote the order that granted the certiorari to Mayor Oscar Moreno. In this case it is poetic justice as it explained why the justices earlier inhibited themselves and why Moreno’s petition was not acted with dispatch when it was needed most. I can understand now

why the justices earlier inhibited due to their personal relationship with either of the parties of the petition. Read the lines slowly and carefully and think about them. They make total sense and they are very clear. But the justices already reconsidered their position and now instead of inhibiting they granted and justices Camello and Perez concurred for the issuance of the certiorari. They justified this by saying that in a time of disturbing public conflict, they would not allow for chaos to prevail in “this disturbing times.” They corrected themselves and realized that they should stand by the law. My interpretation was that they were ready, mean-
ing the Court of Appeals, to grant Moreno’s petition but it was delayed because of their personal relationships, though what kind of relationships they had and with whom was not explained. These two justices have already reconsidered their position by correcting themselves and concurred with the justices that granted the temporary restraining order at a time of “disturbing public conflict.” Good faith is present in here as the error of inhibition if it was an error was rectified with dispatch by not considering relationships, but by taking into account public interest that is served by the judiciary, the executive and legislative. Even if it was a day late. By the same vein, I would like to raise this issue on the two mayors of Cagayan de Oro at this time. One elected by thousands of Cagayanons and one by succession. This conflict if not acted upon would result to confusion by the public especially the poor. Hence an appeal to Vice Mayor Ian Acenas whom I believe to be a good Christian, to act and give way to the interest of the many. That Acenas’s loyalty to

The situation is getting serious everyday with rumors that China and Iran are backing up Russia’s misadventures in the area. This only means one thing--that the problem is spreading wider. Powerful countries took turns in announcing the launching of new invention of missiles, nuclear weapons, up-to-the-minute fighter jets, modern submarines and battleships. Training of troops, establishment of military bases,
advance military science and tactics and the like crop up uncontrollably and these things quietly instill fears in the heart of all nationalities around the planet. North Korea, Iran and others are as mischievous as others and go on with the manufactures of deadly weapons in the midst of hunger and poverty among their people. Everyday is a time of seemingly endless suspense as more tragic developments dominate the headlines of media outlets. It is truly scary and no one knows how to manage things to stop these problems that seems unstoppable. It is a new kind of conflict that involve young minds and intelligence to the detriment of the future of humanity. What makes even worse is the alignment of nations specially the great powers which may determine which one can pull the trigger first. As a christian, I always invoke the power and miracles of prayers as the last resort and only weapon or tool we can project in the instant situation. We have practically reached the headboard or the end of all things although there is still hope. We must all pray for the safety of the world and people and for understanding could save peace in our midst. We must avoid regrets if there ever is a possibility to do so. By all means we must kneel together in our desire to restore friendship among all men and better understanding by and among nations.

Acenas and Vice Mayor Lourdes Candy Darimbang took their oath last week as mayor and vice mayor of the city under the law of automatic succession upon receiving the order of the Ombudsman implemented by the Department of the Interior and Local Government (DILG) on the dismissal of Mayor Oscar Moreno. In a special session Friday, the 17th City Council adopted Resolution No. 12188-2015, recognizing Acenas as the newly-installed city mayor and Darimbang as the vice mayor of Cagayan de Oro City by operation of law. Legislators also authorized Mayor Acenas or Vice Mayor Darimbang and acting City Treasurer Ramon Antonio R. Mendoza as the official signatories for any and all transactions of the city government with the city’s depository banks. The ordinance cites that under the Local Government Code it is the city mayor who is authorized to sign checks covering bank transactions under the executive branch. The same law, likewise, grants authority to the city vice mayor to sign checks covering bank transactions under the legislative department. During the regular session Monday, and in response to the special report of Councilor Roger Abaday on the need to resolve the issue as to who is the rightful mayor of the city, Councilor Tabor reiterated that the resolution adopted last Friday still stands. He stressed that the City Council is not in a position to decide on the matter. “Leave that to the courts and lawyers to discuss procedural and substantive law on the matter,” he cited. Attacks on transmission facilities escalate: NGCP By PAT SAMONTE Caraga Regional Editor
Another tower of the National Grid Corporation of the Philippines (NGCP) in Patani, Marawi City was bombed on the evening of November 6, 2015, eight days following the bombing of three transmission towers in the same area. NGCP Regional Corporate Communications and Public Affairs Officer Milfrance Capulong reported that Tower # 13 along Agus 2 – Kibawe 138 –kilovolt (kV) line 2 in Guimba, Marawi Sity was bombed by yet to be identified perpetrators making it the 10th tower bombed this year. Capulong said the tower did not topple, but the dam-
age it sustained caused the structure to lean, putting the transmission facility in a more critical condition. Last October 9, three towers along the same transmission line were bombed. Of the three, two structures, Towers #19 and #20, were toppled. The third tower, # 21, sustained damage, but was not toppled. According to Capulong, NGCP was able to fully restore the Agus 2 – Kibawe 138kV line 2 after implementing temporary measures to transmit electricity, produced by Agus 1 and 2 hydropower plants, to the rest of the Mindanao grid. ments were assisting NGCP in entering the properties of the landowners to expedite restoration. NGCP has repeatedly appealed to the government and the Philippine Army for assistance and resolving escalating security and right-of-way issues in Mindanao, Capulong added.

A MATURE and strong El Nino event, which is contributing to extreme weather patterns, is expected to strengthen further by the end of the year, according to the latest update from the World Meteorological Organization (WMO) on Monday. The WMO said the peak three-month average surface water temperatures in the east-central tropical Pacific Ocean would exceed 2 degrees Celsius above normal, placing this El Nino event among the three strongest since 1950. Previously, the three strongest El Nino events took place in 1972-73, 198283 and 1997-98. Typically, El Nino events peak late in the calendar year, with maximum strength between October and January of the following year. They often persist through much of the first quarter of that year before dying down. “Severe droughts and devastating flooding being experienced throughout the tropics and sub-tropical zones bear the hallmarks of
this El Nino, which is the strongest in more than 15 years,” said WMO SecretaryGeneral Michel Jarraud. The WMO released its update on the eve of an international El Nino conference in New York. The conference aims to increase scientific understanding of this event as well as its impacts, and help boost resilience to anticipated global socio-economic shocks related to it. “Our scientific understanding of El Nino has increased greatly in recent years. However, this event is playing out in uncharted territory. Environmental, agriculture groups tell APEC, ASEAN: Stop GMO policy integration THE Greenpeace, together with Magsasaka at Siyentipiko para sa Pag-unlad ng Agrikultura (MASIPAG) and Sibol ng Agham at Teknolohiya (Sibat), called for a halt on genetically- modified organisms (GMO) policy integration in the ASEAN and APEC agendas, and urged the Philippine government to support the research and development of Ecological Agriculture in the country. The activists also launched a large balloon with banner message clamoring “For a food-secure and GMO-free APEC and ASEAN”. Leaders of the Asia Pacific Economic Cooperation (APEC) member-economies are meeting in Manila from Nov. 18-19, shortly after which the Association of the Southeast Asian Nations (ASEAN) will meet on Nov. 21-23 in Kuala Lumpur, Malaysia. “We are concerned that the Philippines, as host of APEC, is promoting genetically modified crops in the region despite the opposition and legal challenges that it faces in its own territory,” says lawyer Zelda dT Soriano, Legal and Political Advisor of
Greenpeace Southeast Asia, a non-profit environmental group. The Department of Agriculture (DA), meanwhile, continues to advocate for the creation of an economic community, which will establish a single market and production base that will set a ‘common standard’ for GMO crops across the ASEAN region. In October, the DA also requested APEC delegates to show improvements in implementation of GMO regulations in the country. At the press conference, Soriano pointed out that there is no scientific consensus on the safety of GM crops and there are still no established results that support its cost and benefit. Greenpeace and its allies believe that while the Philippines is the first ASEAN country with a GM crops regulatory system in the region, it is far from being an ideal model or benchmark. Though a policy statement and administrative order are in place, there is no law or legislation passed that governs GM crops fieldtesting, commercialization, and related activities. “The current adminis-
trative order and its implementation is beset with complaints and questions for lack or inadequacy of economic, social, environmental and other safeguards from the potential adverse impacts and risks of GM crops,” Soriano added. In 2013, the Court of Appeals granted the petition of civil society groups and farmers against fieldtesting of genetically modified eggplant or Bt talong in the Philippines. The the following year, an extraordinary administrative opposition— signed by more than 25,000 Filipinos— was submitted to the DA-Bureau of Plant Industry calling for transparency and reforms in the regulation of GM crops. The agriculture agency has yet to act on the administrative petition. “Government policies are often contradicting, like promoting chemical farming, GMOs, and organic farming. Controlling the transboundary flow of GM crops - in the context of ASEAN economic integration -is even more challenging. Contamination by natural or accidental means have been documented in so many countries and many
times over,” said Dr. Chito Medina, Executive Director of MASIPAG. An alternative—Ecological Agriculture, a farming method that combines modern science and innovation with respect for nature and biodiversity—is available, according to Shen Maglinte, Executive Director of SIBAT. Ecological Agriculture ensures healthy farming and healthy food. It protects the soil, the water and the climate. It does not contaminate the environment with chemical inputs or use genetically engineered crops. And it places people and farmers – consumers and producers, rather than the corporations that control food supply – at its very heart. “Not all modern technologies in agriculture are good and appropriate. Chemical fertilizers, pesticides and hybrid seeds introduced 50 years ago, through the Green Revolution, impoverished farmers and damaged their farms. GM crops will do the same. Adopting reading as a habit is a good start to a passion of exploration and adventure for reading opens mind, makes it rich with knowledge and transcends a person to where the setting of the book is. Most children who achieved academically are pupils who love to read. It is indeed a good thing for pupils to be able to introduced in reading early for they will appreciate it eventually. True, parents and teachers play big role in guiding their children in order for them to be at their best and be competitive in reading. It is a fact, however, that the learning to read critically and thoughtfully cannot be achieved in just one snap. There are determined problems that come towards reading competency. Thus, it is important for teachers or parents to understand the source of reading problem of each child in order for it to be addressed. Below are just few. The child might not recognize start or end sounds.
Many children know their letter sounds, but cannot recognize these sounds when trying to sound out words. He cannot spell the word. While there are a number of spelling rules, conventions and exceptions that take time to learn, spelling in the early grades is only a concern if regular, phonetic words are misspelled. Spelling is a key decoding skill. The child resists reading. Many children with reading difficulties start to resist reading out loud to their parents, and become easily distracted in reading times in school. He might not find reading an enjoying activity. Many students do not enjoy reading for any reason text books, assigned texts, novels, newspapers, and magazines. These are just few of several sources of reading problems among pupils. Parents and teachers play big role in determining the reason behind a child’s difficulties in reading because once determined, they will be directed on which part to focus, in order for the child to learn reading easier.

In its annual observance of the National Rice Awareness Month (NRAM), which is celebrated every month of November, the Department of Agriculture – Regional Field Office 10 (DA-RFO 10) continued the conduct of its series of ‘RICEponsible Forum’, in Tubod, Lanao del Norte. About 150 farmers from the different municipalities of the province attended the event, where they were encouraged to contribute in the attainment of rice self-sufficiency throughout the country. By and large, they were asked to promote responsible rice consumption by adopting to recommended farming technologies, reducing rice wastage, eating alternative food staples and persuading policymakers to create resolutions to serve healthier rice options (Brown Rice and Rice Mix) and to create ordinances requiring food establishments the serving of half cup of rice and making it the default serving for plated meals, at the same time. The rule of law should also be the guiding light of Mayor Oscar Moreno on why he should remain in position as the duly elected local chief executive. To abandon the post by not questioning with vigor his dismissal without a fight is a slap on the face of the thousands of people that voted for him. Cagayan de Oro’s current political situation finds a parallel in the classic Charlies Dickens novel of “The Tale of Two Cities” in which there was a time of great confusion among the people in France and England where the real victims were the poor. This novel best illustrates how the powers held by different or opposing parties would victimize the public if not one of them would sacrifice for the greater good. Let this readiness to sacrifice and yield to the public interest serve as the litmus test among the leaders in Cagayan de Oro City. I know this would be the talk of the town until a Solomonic solution is arrived at to resolve this protracted conflict. This is not an increase but is rather a testament to the total disregard of PNoy to our poor plight. We are asking for a substantial increase and not for alms! Adding insult to the injury is the large chunk of pay increase government directors and executives including lawmakers and the president will receive under the said proposal,” added Ms. Casstro. Under the proposed Salary Standardization of 2015, the president will receive a total of 223.41% wage adjustment bringing the president’s salary to 388,096/month from the current 120,000/month. “The government executives and politicians are already receiv-

Cacdac said policemen were also sent to guard all the gates of City Hall and to frisk everyone coming in for hidden weapons. “We want to prevent their followers from making trouble and ensure the public has safe access,” he said. Panadero sent the request to Moreno and the Padayon Pilipino’s Acenas, the vice mayor who was sworn in as mayor on Thursday night. The DILG asked Moreno and Acenas not to hold separate flag raising rites while they wait for advise and instructions from the Office of the Ombudsman. ”We deemed it prudent to seek the advise of our principal, the Ombudsman, on how to proceed with the TRO issued by the Court of Appeals,” Panadero said. The Court of Appeals issued the TRO Friday after Moreno and his co-accused, Glenn Banez, officer-in-charge of the City Treasurer’s Office, filed a petition for certiorari assailing the Office of the Ombudsman’s decision to dismiss them for grave misconduct. The DILG carried out the order last November 12.
In their motions for reconsideration, Moreno and Banez said the Office of the Ombudsman decided their case without taking into consideration their counteraffidavits which the investigators claimed they did not receive. “The Supreme Court in a recent ruling gave the Court of Appeals the power to review cases decided by the Ombudsman and grant ancillary reliefs, “ Justice Henri Jean Paul Inteng of the CA 22nd Division said. Inteng directed the DILG and all concerned agencies not to implement the Ombudsman’s decision for 60 days pending the resolution of the motion for reconsiderations filed by Moreno and Banez. Panadero said they are hopeful the Ombudsman would decide on the issue of who is the mayor of Cagayan de Oro now but as of 8 p.m. Monday, no order or notice arrived at City Hall from DILG region 10. Moreno and Acenas had agreed to heed the request of the DILG to prevent any trouble at City Hall. Councilor Ramon Tabor of Padayon Pilipino said they are recognizing Acenas as the city mayor and Councilor Candy Darimbang as the vice mayor after the DILG swore them into office Thursday night. Tabor said the TRO issued by the Court of Appeals is considered “moot and academic” after the DILG swore in Acenas and Darimbang. “We have to perform our duties otherwise the DILG might charge us with dereliction of duty,” Darimbang said. Darimbang presided the City Council’s session Monday afternoon. Moreno called on his and Padayon Pilipino supporters to exercise caution “in order not to add to the overwhelming emotions that may result to violence.” “We stand on solid legal ground therefore we call upon the DILG to take definitive action to defuse escalating tension and obviate possible violent outbursts,” Moreno said in a statement. The three highest salary grades covering the president, vice president, cabinet secretaries, senators, congressmen and justices will see increases of 186-223% in their basic pay or by P167,809 (SG31) to P268,096 (SG33). This is a tripling or more of their current basic pay to P3.4-5.1 million annually. In contrast, the basic pay of the lowest 13 salary grades only increases by 12-23% or just P2,068 (SG1) to P3,796 (SG13). This is only a marginal increase in basic pay ranging from P11,068 (SG1) to P25,232 (SG13). The largest part of government employees are found in the lowest salary grades with perhaps up 800,000-one million at SG15 or lower. As it is, those in the lowest six or seven salary grades may still be taking home less than the decent living wage of P16,000 per month. The basic pay does not yet include the midyear 14th month bonus, enhanced performance-based budgeting (PBB) and any allowances. While this will slightly increase the final salaries received, the basic gross inequity in the salary increases remains. The inequity in government pay is getting worse, said the group. The last round of salary increases also saw the highest ranking officials seeing much higher increases of 70-140% compared to just 40-45% in the lower salary grades. Civil servants, like all workers and citizens, deserve decent pay and living wages for themselves and their families. However the argument that more “competitive” salaries are needed for high ranking officials is based on a wrong notion of public service. The high executive pay of private profit-seeking corporations comes from underpaid and increasingly contractualized workers and from charging the highest prices possible for goods and services. Making these bloated private sector salaries the benchmark for those in public service and of the highest public officials diminishes their ability to lead the government and the citizenry by example. Excessive salaries will also reinforce and institutionalize the already yawning gap between their lifestyles and the conditions of the mass of poor Filipinos, Ibon said.
