Filing of COCs for brgy polls starts today

Aspirants for the October 28 Barangay elections are expected to troop to the local Commission on Elections (Comelec) offices today as the six-day of filing of the Certificates of Candidacy (COCs) starts. Candidates running for barangay chairman and barangay councilors are asked to file their COCs before the City or Municipal Election Officers starting October 11 up to October 17, except October 13, a Sunday. The local Comelec office will be open to accept the COCs during office hours or from 8 in the morning to 5 in the afternoon. “No person shall be elected Punong Barangay and members of the Sangguniang Barangay unless he files a sworn COC in triplicate form prescribed by the commission,” according to poll body Resolution 9740. Misortel explores tie up with PLDT

Police said the two armed guards inside the car were not able to repulse the attack and that the armed holdup men were able to take the shotgun and 38caliber pistol of the two guards as well as the money in a bag. The amount is yet to be determined at the bank but police said the estimate is about P2-million. Police said the holdup men were aboard a 1998 model car and a motorcylce, both of which were found later abandoned. The car was registered to an address in Quezon City. Apparently the holdup men rode in another vehicle for their getaway after abandoning the car and motorcycle. The abandoned vehicles are now in the custody of the Cagayan de Oro City Police Office.

Misor guv to push for P 1.5b budget for 2014 By CRIS DIAZ Executive Editor

GINGOOG City, Misamis Oriental––The provincial governor’s office would ask the provincial board next week to approve P 1.5 billion budget appropriation for calendar year 2014, Gov. Yevgeny Vincente Emano of Misamis Oriental said Tuesday. He said the bulk of the 2014 budget would go mostly to social services getting a total of more than P 700,000 million or 46 percent of the proposed budget.

Emano said that the province general fund would get more than P 400,000 million while budget for special funds would only be a little more than P 300,000 million. He said that the proposed budget for 2014 was less than P 100,000 million compared to the 2013 budget of P 1.6 billion. “The previous administration has bloated the budget which resulted in fiscal havoc due to unrealistic forecast,” Emano added. He said that a report submitted by the Commissions on Audit (COA) for the year 2012 to 2013 accused the previous administration of former Gov. Oscar Moreno of draining the provincial coffers with an overdraft of more than P 500,000 million due to unrealistic budget. “Now, we would be submitting a realistic budget of P 1.5 billion appropriation for calendar year 2013,” Emano added. MNLF followers surrender to police By GERRY LEE GORIT Correspondent

CAGAYAN de Oro City––An undetermined number of Moro National Liberation Front members in Malitbog, Bukidnon, surrendered yesterday to the municipal government. Malitbog Vice Mayor Gary Casino said the surrenderees were unarmed MNLF members from sitio Abyawan, batangay Siloo, a faraway hinterland area accessible via the neighboring town of Manolo Fortich. Casino the MNLF members surrendered their ID cards to inform the police that they no longer want to be identified as

members of the MNLF. This came after a warrant of arrest was issued against MNLF founding chairman Nur Misuari following the MNLF attack in Zamboanga City recently. The MNLF members had sent out surrender feelers and were fetched by a government vehicle to be brought to the municipal center where they surrendered officially to the Philippine National Police. Casino said the surrenderees were most likely under Commander Amir Alibug. Capt. Christian Uy, spokesman of the 4th Infantry Division based in Cagayan de Oro City, said the situation will be monitored by the military.

Agrarian Reform Community in Sursur to spur devt By PAT SAMONTE Regional Editor-Caraga

BUTUAN City––Expectation was visible in the faces of some 100 farmers during the launch of a new Agrarian Reform Community (ARC) in four villages in Tagbina, Surigao del Sur on October 8, 2013. This was how Caraga Department of Agrarian Reform Information Officer Joie Ceballos described the soil tillers as HIMASS Agrarian Reform Community (for Barangays Hinagdanan, Maglatab, Sta. Cruz and San Vicente) which marked the fifth in Tagbina to cover all the town’s barangays, and the 42nd in the province. The Depar tment of Agrarian Reform adopted

the ARC strategy in 1993 to serve as focal points of economic development in the countryside. ARC is a cluster of barangays where a critical mass of agrarian reform beneficiaries is situated. DAR-Caraga Regional Director Faisar Mambuay said that the launch was the start of various projects for the barangays leading to a “holistic” development of the community. Mambuay assured “We will continue to tap partner agencies, local and foreign donors to help us address the development needs of this ARC.” Ceballos said a development plan totaling P220 million was presented by the four chairmen of the covered barangays.

Jose Conja, who represented Cong. Florencio Garay of the 2nd District of Surigao del Sur, expressed confidence that the ARC launching was a good start that would trigger the development of the four barangays “as implementing agencies like DAR, will provide the assistance you need.” Tagbina Mayor Generoso Naraiso thanked Mambuay, Provincial Agrarian Reform Officer Benjamin Mataksil and DAR for their effort that led to the formal launching of the HIMASS ARC. Also present during the affair were representatives from the Department of Environment and Natural Resources and other partner agencies.

SAN Francisco, Agusan del Sur--Forest guards have seized another large volume of hot logs inside the Mt. Magdiwata watershed here despite an intensified drive to protect the mountain from forest encroachers. A joint operation led by forest guards of San Francisco Water District (SFWD) intercepted 79 pieces of natural-grown falcatta logs in the watershed area estimated at 6.8 cubic meters with a commercial value of P50,000. Elmer Luzon, SFWD general manager, said the confiscated logs were felled

“Worst flood” hits Zambo City

A M B OA N GA CITY — Floods due to intermittent heavy rains since Friday submerged parts of this city Tuesday in what an official said is “the worst flood to hit Zamboanga City in recent memory.” Adriano Fuego, Office of Civil Defense director for Region 9, told MindaNews Tuesday morning that at least 11 villages in the city were flooded. By noon, Mayor Maria Isabelle Climaco’s flood update as posted in her Facebook account said 2,869 families or 8,848 persons had been displaced by the floods in 22 barangays and are in 30 evacuation centers. Zamboanga City, which has 98 barangays, is still reeling from the 20-day standoff last month between government and the Moro National Liberation Front (MNLF) under founding chair Nur Misuari that left over a hundred persons dead and at least 100,000 displaced. The standoff also paralyzed the city’s economy as businesses were forced to shutdown. Many of the evacuees had to flee to higher grounds due to the floods. At the Joaquin Enriquez Sports Complex, scores of makeshift tents were flooded as

well. While many sought higher grounds, a number of them stayed on despite the floods. The mayor’s update also said there were “2 casualties –victims of drowning —1 person missing.” The National Disaster Risk Reduction and Management Council (NDRRMC) website listed two persons from Barangay San Jose Gusu died from drowning. Damaged agricultural crops include 640 hectares of riceland; 1,243 hectares corn; 200 hectares of assorted vegetables. About 2,000 hectares of fishpond and 900 hectares of seaweed were also among those flooded, according to the mayor’s update. In some parts of the city, floodwaters nearly reached the second floor of houses, forcing residents to evacuate to nearby schools. The city government cancelled early morning classes in all levels and suspended work in all gov-

ernment offices, except Rep. Lilia Nuño (2nd district) said one of the worst affected villages was Barangay Vitali, which is within her congressional district. She said that her office has already sent some relief goods to the flood victims. In Tungawan town in Zamboanga Sibugay, Angelito Casinillo, OCD area coordinator for Zamboanga del Sur, reported that a landslide along the highway stranded at least 200 vehicles. Casinillo, who was on his way to this city in the morning, said the landslide occurred at around 10 p.m. Monday in Barangay Upper Tungawan. Traffic was back to normal early afternoon. Comelec-Dipolog readies for Oct. 28 barangay polls By ALFONSO T. RUDA

DIPOLOG CITY - The Commission on Elections (Comelec) here is slated to conduct on Oct. 24 and 25 an orientation/training to all public school teachers who will be serving as members of Board of Election Tellers (BET) in the October 28, 2013 barangay elections. City Election Registrar Atty. Edmund Calo disclosed during the weekly “Kapihan sa Dipolog” radio program over RMN-dxDR that BET members will be briefed on their roles in the

conduct of barangay polls. Atty. Calo said the BETs will each receive from Comelec a total honorarium of P3,000 inclusive of transportation and meal allowances. On the other hand, Calo also reminded the candidates that the filing of Certificates of Candidacy (COC) is from October 11 to 17, but there will be no filing of COCs on Oct. 12 and 13. As regards the implementation of Comelec gun ban, Galo said that his office

is closely coordinating with the Philippine National Police (PNP) for its implementation. The gun ban takes effect starting Sept. 28 to Nov. 12, 2013 or one month before and 12 days after the barangay elections. It can be recalled that President Aquino has earlier signed Proclamation No. 656 declaring Oct 28 as a special non-working holiday throughout the country to allow the public to participate in the barangay polls. WHEREAS, in order to provide safety to the riding public, pedestrians and to decongest traffic , this Traffic Ordinance is enacted to regulate the flow of traffic, movement of vehicle, pedestrians and to provide orderliness thereof. WHEREAS, in as much as open areas in the commercial area along the national highway is not enough to provide parking terminals to tricycles, jeeps, vans and provincial buses , temporary terminals are herein designated. WHEREAS, the Sanggunaing Bayan of the municipality of Kapatagan, Lanao del Norte has the power to regulate the operation of tricycles, sikad-sikad and grant franchises for the operation thereof within the territorial jurisdiction of the municipality. WHEREAS, consistent with the legislative authority of the sanggunian to enact rules and guidelines for an orderly traffic and its enforcement , Ordinance No. 31, S-2009 is hereby amended. WHEREFORE, after due deliberation and upon motion of Hon. Allan C. Tabaquero , unanimously seconded, BE IT ORDAIN, AS IT IS HEREBY ORDAINED by the sangguniamgn bayan, in a session duly assembled to amend Municipal Ordinance No. 31, S-2009, otherwise known as the Traffic Ordinance of the Municipality of Kapatagan, Lanao del Norte of 2009. ARTICLE 111 ( As amended ) TRAFFIC ADMINISTRATION Section 1.- Authority of the Sangguniang Bayan: In consonance with the authority granted in Section 447, par 5 ( sub-par v and vi ) of RA 7160, the sangguniang bayan shall exercise such functions as they may see fit from time to time:

RESOLUTION AMENDING ARTICLE 111, ARTICLE IX, ARTICLE XI, ARTICLE XIII, ARTICLE XIV, ARTICLE XV, ARTICLE XVII, ARTICLE XVIII OF ORDINANCE NO. 31, S-2009, OTHERWISE KNOWN AS THE TRAFFIC ORDINANCE OF THE MUNICIPALITY OF KAPATAGAN, LANAO DEL NORTE.

The one way traffic stated in par. ( d ) and ( e ) is hereby suspended due to bad road condition and shall be lifted as soon as the road condition becomes good.

1. Create, define, re-define, eliminate or change all speed zones, one-way streets, through streets, parking areas, crosswalk, loading and unloading areas, bus stops and designate the type of marking to be placed and maintained for the identification of such zones or area. 2. Determine and designate the type of all traffic signs and signboards which shall be uniformed and in so far as practicable conform to the current standard as approved by the DPWH and the LTO. 3. Determine those intersections at which drivers of vehicles shall not make a right turn, left or “U” turn and designate the place at which proper signs at such intersections shall be erected. 4. Authorize the Local Chief Executive for the deputation of Municipal Traffic Aides and Police for the efficient implementation of this code. 5. And shall exercise such authority granted in Section 4R.04 of Article R of the Local Revenue Code.

ARTICLE XI ( As amended ) ADMINISTRATIVE PROVISION FOR THE OPERATION OF TRISIKAD Section 1. Operation of Trisikad: Trisikad shall be allowed to operate within the limit of one barangay except when the driven trisikad is going to another barangay where the driver intends to operate for hire or going home to his barangay of origin. Section 2. Prohibition: a. No person/s shall be allowed to drive a trisikad unless he is eighteen ( 18 ) years of age, who is physically and mentally fit. b. No trisikad unit shall be allowed to operate for hire unless the same is duly registered with the Treasurer’s Office upon payment of the following; ( Local Revenue Code ) 1. ( B ) Functions of the Board- The Board shall have the following functions:

1. Monitor the implementation of this code. 2. Recommend corrective measures for the efficient implementation of traffic rules and regulations to the Sangguniang Bayan. 3. Exercise such other functions that is deemed necessary to ensure public safety and convenience, and whenever practicable recommend the re-routing of traffic specially during civic, military and religious parade without need of Sanggunian approval and only for a limited purpose and duration. 4. Recommend to the Local Chief Executive guidelines and methodology for the efficient enforcement of this code. 5. shall formulate the summons or citation ticket to be used by Traffic Enforcers.

Section 3. Authority of the Traffic Enforcers- The Traffic Enforcers herein referred are those duly designated Traffic Police Officer/s , Traffic Aides paid by the local government of Kapatagan, Lanao del Norte , and those Barangay Tanuds which are designated and detailed as traffic aide by their respective Barangay Councils and assist Traffic Police Personnel, Traffic Management Group and LTO. ( A ) Functions of the Enforcers:

1. shall enforce the provisions of this code and assist Traffic Police Personnel, TMG and LTO in the implementation of all national laws . 2. shall take the name and address of traffic violators whether with or without a driver’s license number; the registration and plate number of the vehicle/s involved. 3. shall issue to the traffic violator a summon or citation ticket informing him/her of the charge/s against him/her and requiring him/her to answer the same at the time and place designated in the citation within seven ( 7 ) days after such violation. 4. shall impound any vehicle / motorcab/ trisikad/ habal-habal / tala-tala driven or operated by the traffic violator and to release the same only upon authority of the officer duly designated by the Local Chief Executive. ARTICLE IX ( As amended ) DESIGNATED ONE-WAY STREETS

SECTION 1. ONE-WAY STREETS.- (1) The streets or portions thereof described below are hereby designated one-way streets. Vehicular traffic, on said streets shall move only in the direction indicated by signs erected and maintain thereon. This provision does not apply in emergency cases but the driver of such vehicle shall exercise extra care in traversing the one-way street.

For any violation under Section 3 hereof by any driver or operator of trisikad not otherwise fined in the immediately preceding paragraph , aside the impounding of the unit shall pay a fine of P100.00 for each violation. If the unit will not be claimed after one (1) year, it shall be sold to public auction under the following procedures; 1. The Municipal Treasurer shall post notice for auction sale for five(5) consecutive days in two (2) conspicuous places in the public market setting therein the floor price as determined by the appraisal committee duly constituted by the Municipal Mayor for the purpose; 2. In case the impounded trisikad is not disposed of within ten (10) days from the date of notice of the public auction, the same shall be considered sold to the Municipal Government and shall be disposed within the first thirty (30) days in accordance with the law; 1. The proceeds of the sale shall be applied to satisfy the costs of impounding, advertisement and conduct of sale. The residue over the costs shall accrue to the

Section 4R. 03. Time of Payment. a. The annual franchise fee shall be paid to the Municipal Treasurer upon application for an MTOP or renewal thereof. b. The filing fee shall be paid upon application for an MTOP based on the number of units. c. Filing fee for amendment of MTOP shall be upon application for transfer to another zone, change of ownership of unit of transfer of MTOP. Section 4R.04. Administrative Provisions. a. Prospective operators of tricycles should first secure a Motorized Tricycle Operator’s Permit (MTOP) from the Sangguniang Bayan. b. The Sangguniang Bayan of this municipality shall : 1. Issue, amend, revise, renew, suspend, or cancel MTOP and prescribe the appropriate terms and conditions therefore; determine, fix, prescribe or periodically adjust fares or rates for the service provided in a zone after public hearing; prescribed and regulate zones of service in coordination with the barangay; fix, impose and collect, and periodically review and adjust but not often than once every three (3) years, reasonable fees and other related charges in the regulation of tricycles-for-hire; and establish and prescribe the conditions and qualifications of service. 2. Only Filipino citizens and partnership or corporation with sixty percent (60%) Filipino equity shall be granted the MTOP. No MTOP shall be granted by the municipality unless the applicant is in possession of units with valid registration papers from the Land Transportation Office (LTO). 3. The grantee of the MTOP shall provide common carrier’s insurance sufficient to answer for any liability it may incur to passengers and third parties in case of accidents; 4. Operators of tricycles-for-hire shall employ drivers duly licensed by LTO for tricycle-forhire. 5. Operators who intend to stop service completely, or suspend service for more than one (1) month shall report in writing such termination or suspension to the Sangguniang Bayan; 6. Tricycle operators are prohibited to operate on national highways utilized by 4-wheels vehicles greater than four (4) tons and where normal speed exceed forty (40) KPH. The Sangguniang Bayan may provide exceptions if there is no alternative route. 7. Tricycles-for-hire shall be allowed to operate like a taxi service, i.e., service is rendered upon demand and only on the approved fixed route within a zone. c. The Sangguniang Bayan may impose a common color for tricycles for hire in the same zone. Each tricycle unit shall be assigned and bear an identification number, aside from its LTO license plate number. The Sangguniang Bayan shall establish a fare structure that will provide the operator a reasonable return or profit, and still be affordable to the general public. The fare structure may either be flat (single fare regardless of distance) as a minimum amount plus a basic rate per kilometer.

3. The proceeds of the sale shall be applied to satisfy the costs of impounding advertisement and conduct of sale. The residue over these costs shall accrue to the owner of the impounded tricycle. If he satisfactorily presented proof of ownership otherwise the residue will accrue to the General Fund of this Municipality. ARTICLE XIV ( As amended ) DESIGNATION OF TEMPORARY TERMINAL Loading and unloading stations Section 1. : Temporary Terminal : Refer to Traffic Routing Scheme ( Map ) The Temporary Terminal for habal-habal/tala-tala and tricycles are hereby change and adopted, the location of its terminal per zone is designated in the Traffic Locational MAP. See Annex A. Section 2. ARTICLE XV ( As amended ) DESIGNATION OF PERMANENT TERMINAL Section 1. Permanent Terminal – The Integrated Bus Terminal shall be the permanent terminal to all provincial buses, jeepneys, van and other puvs. Section 2. Prohibition : it shall be unlawful for any driver/s of provincial buses, van ,public utility vehicles to load, unload or drop passenger/s at any point along the national highway between junction Cangke Street up to Junction Santol/Bulahan Street and vice versa. ARTICLE XVII ( AS Amended ) MISCELLANEOUS PROVISIONS SECTION 1. – It shall be unlawful for any person to knowingly drop, place or throw or cause to drop, place or throw upon any highway, scattered or tacks, nails, wire, scrapped metals, broken glass, bottles or other substances or things injurious to the feet of the persons or animals or the tires or wheels of vehicles. SECTION 2. – It shall be unlawful for any person to puncture or cut or otherwise injure the tire to mar ( ruin ) the finish of or purposely damage, disconnect or take away part of any motor vehicle without the permission and consent of the owner. SECTION 3. – No driver or operator of a public utility service vehicle shall smoke while his vehicle is in motion and actually occupied with passengers nor should he converse or be talking with anybody in the vehicle except when ask to do so or for any valid reasons other merely chatting. SECTION 4. – No person having the control of any vehicle shall negligently allow it to bump, hit or go against or foul upon any person, vehicle or other thing whatsoever, nor shall any person fail to stop his car or vehicle at any place in a street when directed by any person in authority or by any police or peace officer. SECTION 5. – No person having the control of any vehicle shall fail to keep a vigilant watch for all vehicles and persons especially children and aged person nor shall any such person fail to strike his gong, bell or sound his horn several times in quick succession, reduce the speed of his car vehicle upon approaching any team, carriage or person about to cross his path. SECTION 6. – TRACKING MUD UNTO THE HIGHWAY. – No vehicle using the public highway shall track mud or dirt unto the traveled portion of such highway in such quantities as will constitute a hazard when the roadway is wet, or obscure the painted pavement markings thereon. In the event that mud or dirt is unavoidably tracked onto the highway, it shall be the duty of the operator of the offending vehicle to have said mud or dirt remove as quickly as possible. SECTION 7. – RIDING ON MOTORCYCLES – A person operating a motorcycle shall ride only upon the permanent and regular seat attached thereto, and such operator shall not carry any other person nor shall any other person ride on a motorcycle unless such motorcycle is designed to carry more than one person, in which event a passenger shall ride a straddle upon a permanent and regular seat to the rear or side of the operator, said motorcycle should be equipped with adequate foot rest and hand grips, nor shall any other person ride upon such motorcycle not equipped as herein above set forth.

The official rate to be initially adopted shall be a minimum fee of Five Pesos (P5.00) plus One Pesos (P5.00) per km. in excess of four (4.0) km. distance pending the enactment of the prescribed fare structure for the zone by the Sangguniang Bayan.

Section 8. ( amended version ) It shall be unlawful for any person except those authorized by the Local Chief Executive/ Chief of Police acting upon the directive of the Traffic Management Board or the sangguniang bayan to remove, alter, deface, injure or destroy traffic signs, signals where they are officially installed.

Operators of tricycles-for-hire are required to post in the conspicuous part of the tricycle the schedule of fares.

ARTICLE XVIII ( As amended )

d. The zones must be within the boundaries of this municipality. The existing zones which covers the territorial unit not only of the municipality but other adjoining municipalities as well shall be maintained provided the operators serving the said zone secure the MTOP.

Penalty

Section 1. Penalty : Any violation of this ordinance not otherwise specified in any article shall be penalized by a fine of not less than P200 and not more than P1,000.00 or imprisonment of not less e. For the purpose of this Article, a Municipal Tricycle Operator’s Permit Regulatory Board is hereby one month but not more than four months or both in the discretion of the court. Provided , however, composed as follows: that should the violator opt not to be criminally prosecuted in court, an administrative fine shall be SB (Comm. Section 2. PROCEDURE UPON ARREST.- Except when authorized or directed by law to immediately take a person arrested for violation of laws before the court, any authorized police officer or traffic enforcer , upon making the arrest for violation of traffic law , Land Transportation Code ( RA 4136 ) when authorized or this ordinance shall take the name , address and operator’s license number of the alleged violator and the registered number on the motor vehicle involved and shall issue to him in writhing a summon or citation, hereinafter described directing him to answer to the charge against him at a place within seven days after the arrest. In every case, when a citation is used, the original shall be given to the violator or in the case of unattended vehicle, the original of the same shall be affixed. Section 4. Separability Clause: If for any reason, any section or provision of this code shall be declared unconstitutional or invalid by competent authority, such judgment or decree shall not affect or impair other sections or provisions thereof. Section 5. Applicability Clause. All other matters relating to the imposition in this ordinance shall be governed by pertinent provisions of existing laws and other ordinances. Section 6. Repealing Clause, as amended . All ordinances, rules and regulations or part thereof in conflict with or inconsistent with any provision of this ordinance are hereby repealed or modified accordingly. Section 7. Effectivity. RESOLUTION NO. 2008-082 RESOLUTION APPROVING ORDINANCE NO. 16, S – 2008, AN ORDINANCE REGULATING THE SELLING, DISTRIBUTION AND DRINKING OF LIQUORS, TUBA AND/OR INTOXICATING BEVERAGES UPON MINORS and ADULT PERSON, PROHIBITING HABITUAL DRUNKENESS IN PUBLIC PLACES , AND PROVIDING APPROPRIATE PENALTIES THEREFORE.

Any adult person caught in violation of this ordinance shall be penalized in the following: First Offense- shall undergo either physical set-ups , jogging and /or ground cleaning or community service for not more than one hour at the discretion of the court.

WHEREAS, consistent to Section 16 of Ra 7160, otherwise known as the Local Government of 1991, every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom , as well as the powers necessary , appropriate , or incidental for its efficient and effective governance , and those which are essential to the promotion of the general welfare. Local government units shall ensure the promotion of health and safety, maintain peace and order, and preserve the comfort and convenience of the inhabitants.

Second Offense- imprisonment of not more than one week or community service of not more than three days or both at the discretion of the court. Third Offense or more - imprisonment of not more than one month or community service of not more than fifteen days or both at the discretion of the court.

WHEREAS, Section 446, par 1, sub par ( v ) of RA 7160 provides that the Sangguniang Bayan may pass ordinance intended to protect, suppress and impose appropriate penalties for habitual drunkenness in public places and may pass legislative measures for the protection of minor.

Section 8. Administrative Penalties Any business establishment found in violation of this ordinance shall be administratively penalized by cancellation of the business permit “ to sell liquors , tuba and /or intoxicating beverages.”

WHEREAS, the Sanggunian received various complaints of habitual drunkenness in public places resulting to public disturbance, discomfort , annoyance and public disorder ; and out of school minors who had become vagrant , problematic and psychologically uncontrollable. WHEREAS, the local government has the obligation to protect and safeguard minors from the bad influence or harmful effect of liquor and other intoxicating beverages.

Section 9. Construction This ordinance or any provision hereof shall be liberally construed in order not to defeat the spirit of this ordinance

NOW THEREFORE, after due deliberation and upon motion of Hon. Allan C. Tabaquero, duly seconded by Hon. Narciso B. Oporto, BE IT ORDAINED BY THE SANGGUNIAN in a session duly assembled ORDINANCE NO. 16, S-2008 AN ORDINANCE REGULATING THE SELLING, DISTRIBUTION AND DRINKING OF LIQUORS, TUBA AND/OR INTOXICATING BEVERAGES UPON MINORS AND ADULT PERSON, PROHIBITING HABITUAL DRUNKENESS IN PUBLIC PLACES , AND PROVIDING PENALTIES THEREFORE. Section 1. Definition of terms Drunkenness - high and /or under the influence of liquor, tuba, and/or intoxicating beverages. For purposes of this section, an intoxicating beverage can mean any form of beer product or beverage. Adult Person – any natural person 18 years old or above. Minor – any person under the age of 18. Selling – to dispose of the ownership of liquor , tuba and or intoxicating beverages to another or others in exchange for money. Distribution – the dealing of or marketing of liquor , tuba and or intoxicating beverages. Business Establishment – any store, café , disco bar , restaurant, beer house and the like. Habitual – regular , consistent , customary, routine Habitual drunkenness – any person who is regularly, consistently, and/or customarily high and/ or under the influence of liquor, tuba and /or intoxicating beverages. Section 2. Prohibition to sell, serve and drink liquor, tuba, and intoxicating beverages upon minors. It shall be unlawful for any business establishment to sell, serve and/or allow a minor to drink at his/her establishment any kind of liquor, tuba and/or intoxicating beverages. Section 3. Prohibition to sell liquor, tuba and other form of intoxicating beverages upon minors. Except when a minor is assisted by a parent , guardian or adult at the time of procurement, It shall be unlawful for any business establishment to sell liquor, tuba and /or other form of intoxicating beverages to minors at any time of the day and night Section 4. Regulation of time to sell and serve liquor, tuba, and intoxicating beverages upon any adult person. Except on special occasions such as but not limited to town or barrio fiesta, Araw ng Kapatagan and the like, it shall be unlawful for any business establishment to sell and serve to any adult person at his/her establishment any kind of liquor, tuba and/or intoxicating beverages beyond 10:00 in the late evening. Provided further, that no business establishment within a radius of 50 meters from vital learning institutions such as schools and courts shall serve and allow any person to drink at his/her establishment any kind of liquor, tuba and other intoxicating beverages from 7:00 o’clock in the morning to 5:00 o’clock in the afternoon. Section 5. Habitual Drunkenness Upon Any Person, Prohibition. It shall be unlawful for any person to be habitually drunk in any public places and at any time during the day or night. Section 6. Prohibition on Minors. It shall be unlawful for any minor to drink any form of liquor, tuba and/or intoxicating beverages in any business establishment. Section 7. Penalties. Any minor caught in violation of this ordinance shall be brought to the custody of the Municipal Social Welfare and Development. The MSWD shall thereinafter conduct a counseling - seminar on responsible childhood and parenthood to both the minor and the minor’s parent or guardian.

Section 10. Separability Clause If any provision hereof had been found to be inconsistent to national law or the constitution , the same does not affect the other provision of this ordinance. Section 11. Repealing Clause Any ordinance found inconsistent to this ordinance is accordingly repealed, modified and/or annulled. Section 12. DAVAO City––The Davao City Council on Tuesday passed on second reading an ordinance that would increase vehicle parking fees to as much as P20 in the first two hours and an additional P 10 for every succeeding hour. This time, parking of motorcycles and bicycles will also be charged. A fee of P2 will be collected on the first 2 hours and still, P1 for each succeeding hour while trucks and buses would have to shell out P100 for the first two hours and P20 for every additional hour. Some councilors raised objections and appeals on the revisions but to no avail. C ouncilor Mabel SungaAcosta raised her reservations

that the rates could be high, and proposed economic experts to contribute inputs “on how much would be a reasonable cost for Davaoeños.” But First District Councilor Bonifacio Militar, author of the original ordinance in 1990, said the increase of private vehicles by 27% since 2011 showed “more Davaoeños have substantial income” and could afford to pay parking fees. The 2012 data from Land Transportation Office XI registered a total of 148,085 vehicles including 14,391 cars, 33,892 utility vehicles, 5,862 sports utility vehicles, and 8,227 trucks. But Militar said there is no conflict with both laws, saying the Code “is a codification merely of existing ordinances”. Militar said if Advincula has objections to the parking ordinance it will reviewed by the City Legal Office before it will become executory. The parking ordinance, known as Davao City Ordinance 153-A, entitled “An Ordinance Imposing Parking Fees on All Vehicle owners/drivers for Using Certain Streets in Davao City as Parking Spaces,” was enacted in October 8, 1990 during the 9th City Council. Davao City plans river promenade, rehab of parks DAVAO City––The City Government of Davao particularly the City Environment and Natural Resources Office (CENRO) is eyeing the development of a river promenade along the Davao River and the rehabilitation of existing public parks. Eliza Madrazo, CENRO head said that they have submitted the river promenade plan to the City Planning and Development Office for approval. The plans will entail the continuation of the river promenade from Bolton Bridge up until Generoso Bridge. A river promenade was built at the riverbank beside Bolton Bridge but has been neglected, Madrazo said that the plan under

the Davao River Development Program will have the promenade expanded. She said the promenade will be useful as view decks where people can watch fluvial parades. Future plans will include the expansion of the promenade into Madapo, an area beyond Generoso Bridge. She said that though the riverbanks of the proposed promenade are occupied with settlers, it has been identified as a permanent hazard area and the settlers are eligible for relocation. Part of the plan is for the other side of the river bank to be covered with trellises and its banks planted with mangroves to hide illegal settlers and at the same time prevent them from

throwing garbage along the river. A small river park is planned at the Tiongko Football Field just beside the Bolton Bridge. Madrazo said it will be developed as a coastal park. Madrazo hopes that the project will be implemented within three years during the term of incumbent City Mayor Rodrigo Duterte. Aside from River Promenade, Madrazo said they are proposing a budget of P2-million for the fencing of Osmeña Park, right beside the Sangguniang Panglungsod Building. Madrazo said they are planning to make Osmeña Park, a retiree park where kiosks, benches will be put up for the elderly visiting

the park. She noticed that some people have been making the park as home or sleeping quarters to the detriment of other park goers thus the need to fence in the public space. If implemented Osmeña Park will be modelled after the People’s Park where there is an opening and closing time for park visitors. Another plan according to Madrazo is for them to meet subdivision owners and homeowner association presidents, where they are encouraged to plant trees in vacant lots and among roadsides as part of the climate change adaptation strategy of the City Government. The DOT is mandated to implement the development plan and incorporate it in the Department’s overall tourism development program and promulgate the necessary rules and regulations for the proper implementation of this Act. City Councilor Ramon Tabor made the call during a meeting with the city’s jail warden and other other jail officials to conduct a review of the procedures of the Bureau of Jail Management and Penology. During the meeting, Tabor reminded the jail officials of the possibility of bringing in illegal drugs particularly “shabu” (Methamphetamine) which has been reported to be rampant among inmates facing illegal drug charges. Tabor cited the case of a woman who tried to sneak an illegal “shabu” under pretext of visiting an inmate at the provincial jail in Misamis Oriental last month. “If it was attempted at the provincial jail, there is

no reason why it will not be attempted at the city jail,” Tabor said. City Jail Warden Jolly C. Taguiam Jr. said that the city jail has been implementing measures to secure the premises and to help inmates in different aspects such as behavior management, spiritual, and vocational activities. He said that both inmates and jail officials also undergo random drug tests to make sure that no personnel or inmate at the city jail are engaged in drugs. Tabor thanked jail officials for doing everything to prevent the proliferation of clandestine activities inside the city jail here. “At least the city council and the people of Cagayan de Oro City are assured that the city jail and its officials have adopted measures that keep everyone on toes,” Tabor added.
