Intensify ‘intel’ work: Purisima

PNP Chief Alan Purisima on Monday ordered all local police commanders in the country to intensify their intelligence and target hardening efforts in areas with a history of terroristic activities.

CDO blast suspect calm and cool, spoke few words

CAGAYAN de Oro City--The man suspected to have acted alone in the blast that has so far claimed eight lives appeared calm and cool when he walked into Kyla’s Bistro at the LimKetKai Rosario Arcade, picked a table and ordered a bottle of San Miguel Light from a waiter last Friday night, police said.

Supt. Michael John Deloso of the city police said the mediumbuilt bombing suspect, estimated to be between 36 and 40 years old and 5’4” to 5’5” in height did not stay long.

Deloso said that less than five minutes after the suspect left Kyla’s Bistro, the bomb exploded killing three persons on the spot and injuring over 40 others. The five other fatalities died in the hospital.

“Our witnesses described him as very cool. The suspect never spoke in a complete sentence.

‘Sige, San Mig Light’ were the only words the suspect spoke,” the police official said.

Police released Monday two cartographic sketches in Cagayan de Oro and three in Manila based on the testimonies of witnesses and the images of the suspect caught in five CCTV cameras at the LimKetKai Rosario Arcade.

Police also did a reenactment and a reconstruction of the crime scene after Interior and Local Government Secretary Mar Roxas scolded them for allowing the restaurant owners to clean the blast site less than 24 hours after the incident.

Deloso said that based on the witnesses’ accounts and CCTV images, the suspected lone bomber who was wearing a grey t-shirt and dark-colored short pants, arrived at Kyla’s Bistro before 11pm Friday.

He said the suspect, who

was wearing a bull cap, picked a spot at Kyla’s and ordered beer from a waiter.

At the time, the street party along the row of upscale restaurants at the LimKetKai Rosario Arcade was in full swing. Most of the partygoers were doctors and medical representatives who were in the city to attend the national midyear convention of the Philippine College of Chest Physicians.

During the reenactment last Sunday, witnesses told police probers the suspect placed a black bag on the table as a waiter came to ask for his order.

Deloso said the suspect stood up and went to the comfort room inside Kyla’s as soon as the waiter left to get his order of beer.

When the suspect came back, the witnesses saw him transfer the black bag from the table to a chair and left, he said.

“The suspect did not even wait for his beer. He left abruptly.

Less than five minutes later the bomb exploded,” Deloso said, adding the suspect’s departure from Kyla’s was recorded by a CCTV camera in one of the restaurants.

The police official said a total of five CCTV cameras were working at the time of incident.

The number of computer drawings presented by the police (three in Manila and two in Cagayan de Oro) created confusion as to the number of suspects in the blast.

“There is really one suspect only. There are many sketches because these are the general descriptions of witnesses who were able to see the suspect with or without the bull cap and pair of eyeglasses,”Deloso said.

Amendment of CdeO health, sanitation ordinance pushed

CAGAYAN de Oro City-Instead of having weekly check-ups, professional massage and spa therapists may have to go only twice a month.

This will be one of the provisions of the amendatory ordinance endorsed by the City Council committee on health and sanitation chaired by Councilor Dante Pajo to the committee on laws and rules chaired by Councilor Ramon G. Tabor.

The move is in response to the formal proposal submitted by Cagayan de Oro Chamber of Commerce and Industry president Efren Uy seeking the amendment of health ordinance on the provision that requires therapists of massage and spa parlors to seek weekly medical attention.

Section 18 of Ordinance No. 011195-2008, which amends Ordinance No. 10022-2006, requires all

entertainers, masseurs and others with similar occupation to undergo compulsory weekly medical check-up to be conducted on regular basis at the Social Hygiene Clinic of the City Health Department.

The business group cited that therapists are subjected to the same examination processes as that of commercial sex workers and are even queuing in the same area where the latter are lining up. Such is reportedly degrading of therapists and respective businesses.

“Our business is not a breeding ground for prostitution and fornication.

We offer legitimate health and wellness services. Our day spa business is one that delivers personal care treatments such as massage, facial steam treatment and even exercises aimed to improve one’s health, beauty

and state of mind,” he cited in a letter.

According to the Oro Chamber, the ordinance is outmoded and needs to be revised. It was likewise proposed that the city comes up with an ordinance regulating the spa and wellness industry in the city.

During the meeting, Oro Chamber representative Lordelie Enhambre said the request was filed two years ago and was just revived.

She expressed hopes that consideration will be given on their concern.

Dr. Joselito Retuya, Social Hygiene Clinic Physician of the City Health Office (CHO) said the weekly check-up is one of the proactive measures as part of the drive for the prevention of sexually transmitted diseases and HIV/AIDS in the city.

Aside from this, orientation seminars are being

held for new registrants, he added.

The CHO representative, however admitted that Republic Act 856, known as the Code on Sanitation of the Philippines and the city ordinance were both enacted when there was no spa yet in the city.

It was only during the last five years that spas and wellness clinics started to open, he added. But since spas involve body massage and body contact, medical check-ups are still required.

Dr. Retuya also maintained the need for an ordinance disallowing massage therapy in parks saying the practice is unaesthetic and unhealthy.

Councilor Pajo said the request of the Oro Chamber and other possible revisions will be inserted as provisions of the proposed amendatory ordinance.

Whirlwind hurts 1, destroys buildings VALENCIA City, Bukidnon-A whirlwind or thunderstorm, locally known as “ipo-ipo” ripped through two (2) villages in Valencia City, injuring 84-year old resident at 3:45 p.m. on July 24.

along its path.

It tore off roofs of a school building, City Hall administration extension office, and uprooted some decade-old trees in the city.

The City Disaster Risk Reduction and Management Council (CDRRMC) immediately provided the emergency rescue teams of the local government unit, Philippine National Police, and civic communication volunteers, among others, reports reaching the office

of Gov. Jose Ma. R. Zubiri Jr said.

Based on CDRRMC’s rapid damage assessment and needs analysis report, the whirlwind’s destruction reached P800,000.

However, there were no forced evacuation orders from the local government because the CDRRMO provided immediate service assistance to affected areas in the form of towing trucks and chain saws to cut uprooted trees. Besides, houses

were just slightly damaged, said Hipolito Ucang, Officer In-Charge, City Social Welfare and Development Office.

Valencia City DRRM office is still conducting ocular inspection in affected areas.

Lawmakers have filed a measure penalizing necrophiles or those who morbidly derive sexual gratification by copulating with a corpse.

House Bill 1375 authored by Reps Gloria Macapagal-Arroyo (2nd Dist r ic t, Pamp anga) and Diosdado Macapagal Arroyo (2nd District, Camarines Sur) seeks to criminalize necrophilia and include it in Act 3815 as amended, otherwise known as The Revised Penal Code.

The measure defines necrophilia as sexual intercourse, anal and/or oral sex with a corpse.

In filing the bill, Arroyo said “sexual violation of or sexual intercourse with a female corpse is presently beyond the pale of our criminal justice system.”

“Article 309 of the New Civil Code on desecration of the dead merely gives rise to liability for damages,” Arroyo said.

Arroyo said necrophilia should be penalized to the fullest extent of the law.

“Article 335 of the Revised Penal Code as amended by RA7659, forcible or violent violation of a woman’s chastity under any circumstance is a most detestable crime, a heinous crime and penalized, in qualified cases, with the penalty

US, Ph sign new ‘debt-for-nature’ fund agreements

THE United States and Philippine governments recently signed two agreements governing a new US$31.8 million (approximately P1.34 billion) “debt-for-nature” deal, authorized under the U.S. Tropical Forest Conservation Act (TFCA).

United States Ambassador to the Philippines Harry K. Thomas, Jr. and Finance Secretary Cesar V. Purisima signed the agreements last July 18, 2013.

A statement form the U.S. Embassy in Manila said the agreements will redirect toward conservation approximately US$31.8 million in debt payments owed by the Philippines to the U.S. Agency for International Development (USAID) and will establish a second Tropical Forest Conservation Fund.

The fund will be used to provide grants to con-

serve, maintain and restore key tropical forests in the country, with particular and priority emphasis on the Sierra Madre, Samar and Leyte, Palawan Islands and Bukidnon/Misamis areas.

In addition to helping to preserve the Philippines extraordinary terrestrial biodiversity, the fund will also contribute to international climate change mitigation efforts.

In 2002, the U.S. and the Philippines signed a bilateral debt reduction agreement under the TFCA wherein the U.S. treated US$8.1 million in outstanding loan interest which the Philippines used to create a fund for the conservation of tropical forests in the country.

Republic of the Philippines Province of Misamis Occidental Provincial Capitol Complex, Oroquieta City, Philippines Office of the PROVINCIAL GOVERNOR IMPLEMENTING RULES AND REGULATIONS GOVERNING ORDINANCE NO. 05 - 12

WHEREAS, the Sangguniang Panlalawigan of Misamis Occidental enacted Ordinance No. 05-12 entitled “The Revised Smoke-Free Ordinance of Misamis Occidental”;

WHEREAS, there is a need to issue the Implementing Rules and Regulations in order to guide the various stakeholders covered by the Ordinance especially the enforcement agencies;

NOW, THEREFORE, I, HERMINIA M. RAMIRO, Provincial Governor of the Province of Misamis Occidental, by virtue of the powers vested in me by law, do hereby promulgate the following Implementing Rules and Regulations: RULE I - GENERAL PROVISIONS Section 1. Title

These Rules shall be referred to as the Implementing Rules and Regulations of Provincial Ordinance No. 05-12 “THE REVISED SMOKE-FREE ORDINANCE OF MISAMIS OCCIDENTAL”; Section 2. Coverage

These Rules shall apply to all persons, whether natural or juridical, resident or non-residents, and in all places, found within the territorial jurisdiction of Misamis Occidental. The phrase “in all places” shall include Public Conveyances, Public Outdoor Spaces, Public Places and Workplaces.

Section 3. Interpretation

These Rules shall be construed in a manner that can achieve the primary objectives of the Smoke-free Ordinance of Misamis Occidental which is to safeguard public health and to ensure the physical well-being of all Misamisnons, including minimized risk from exposure to tobacco smoke.

RULE II – DEFINITION OF TERMS Section 4. Definition of Terms

For purposes of these Rules, the following terms, or words or phrases, shall mean or be understood as follows: a. Advertising and Promotion – Means any form of commercial communication, recommendation or action with the aim, effect or likely effect of promoting a tobacco product of tobacco use either directly or indirectly. b. Civil Society Organization [CSO] – Refers to a legally constituted voluntary civic and social organization of institution created with no participation of government, including but not limited to, charities, development non-governmental organizations [NGOs], community organizations, faith-based organizations, professional associations, coalitions and advocacy groups. As used in this Ordinance, CSO does not include organizations or associations related to or connected with the tobacco industry in any way. c. Enclosed or partially enclosed – Means being covered by a roof or enclosed by one or more walls or sides, regardless of the type of material used for the roof, wall or sides, and regardless of whether the structure is permanent or temporary. d. Minor – refers to any person below eighteen [18] years old. e. Outdoor advertisement – Refers to any signage, model, placard, board, billboard, banner, bunting, light display, device, structure or representation employed outdoors wholly or partially to advertise or promote a tobacco product to the public. f. Person-in-Charge – Refers to: in case of public places, public outdoor spaces and workplaces, the president/manager/operator in case of a company, corporation or association, the owner/proprietor/operator in case of a proprietorship, or the administrator in case of government property, office or building; in case of public conveyances, the owner, driver, operator, conductor, or the captain of the public conveyance. g. Point-of-Sale – Refers to any location at which an individual can purchase or otherwise obtain tobacco products. h. Public Conveyances – Refers to modes of transportation servicing the general population, such as, but not limited to, elevators, airplanes, ships, jeepneys, buses, taxicabs, trains, light rail transits, tricycles and other similar vehicles. i. Public Places – Means all places, fixed or mobile that are accessible or open to the public or places for collective use, regardless of ownership or right to access, including, but not limited to, establishments that provide food and drinks, accommodation, merchandise, professional services, entertainment or other services. It also includes outdoor spaces where facilities are available for the public or where a crowd of people would gather, such as, but not limited to, playgrounds, sports grounds or centers [includes government, cockpit arenas, sports complex, the streets within the perimeter of these centers], school campuses, church grounds, health/hospital compounds, transportation terminals [includes the streets within the terminals], markets [includes the sstreets within the markets], parks, resorts, walkways, entrance ways, waiting areas, and the spaces covered within 10 meters perimeter from entrances and exits of business establishments. j. Second-hand Smoke – Means the smoke emitted from the burning end of a cigarette or from other tobacco products usually in combination with the smoke exhaled by the smoker. k. Smoking – Means being in possession or control of a lit tobacco product regardless of whether the smoke is being actively inhaled or exhaled. l. Tobacco Products – Means products entirely or partly made of the leaf tobacco as raw material which are manufactured to be used for smoking, sucking, chewing of snuffing, such as cigarettes and cigars. m. Workplace – Means any place used by people during their employment or work, whether done for compensation or voluntarily, including all attached or associated places commonly used by the workers in the course of their work [for example, corridors, elevators, stairwells, toilets, lobbies, lounges].

Vehicles used in the course of work are considered workplaces.

RULE III - PROHIBITED ACTS, DUTIES AND OBLIGATIONS OF PERSONS-IN-CHARGE, PERSONS LIABLE, AND PENALTIES Section 5. Prohibited Acts

The following acts are declared unlawful and prohibited by this Ordinance: a. Smoking in enclosed or partially enclosed public places, workplaces, public conveyances, or other public places, defined in Section 4 of this IRR. b. Selling or distributing tobacco products in a school, public playground or other facility frequented by minors, or within 100 meters from any point in the perimeter of these places. c. Selling or distributing tobacco products to minors. d. Placing cinema and outdoor advertisements of tobacco products. e. Placing, posting, or distributing advertising materials of tobacco products, such as leaflets, posters and similar materials, outside the premises of pointof-sale establishments.

Persons-in-charge shall be held similarly liable for the above acts if they are found to have allowed, abetted, or tolerated the same.

Section 6. Duties and Obligations of Persons-in-Charge

The Persons-in-charge shall: a. Prominently post and display “No Smoking” signages in the locations most visible to the public in the areas where smoking is prohibited, including vehicles.

At the very least, a “No Smoking” sign must be posted at the entrance to the area. The “No Smoking” sign shall be at least 8 x 16 inches in size and the international No Smoking symbol shall occupy no less than 70% of the signage. The remaining lower 30% of the signage shall show the following information:

Warning violators and requesting them to stop smoking within the area of which he/she is in charge and if they refuse to comply, asking them to leave the premises, and if they still refuse to comply, reporting the incident to the provincial health officer and the nearest peace officer. e. Ensure that all the employees in the establishment are aware of this Ordinance and the procedure and measures for implementing and enforcing it. f. Allow inspectors acting under Sections 14 and 15 of the Ordinance and representatives of the designated civil society organization under Section 22 entry into the establishment during regular business hours for the purpose of inspecting its compliance with this Ordinance.

Section 7. Persons Liable

The following persons shall be liable under this Ordinance: a. Any person who commits any of the prohibited acts stated in Section 5 of the Ordinance; and b. Persons-in-charge who knowingly allows, abets, or tolerates the prohibited acts enumerated in Section 5, or who otherwise fails to fulfill the duties and obligations enumerated in Section 6 of the Ordinance.

Section 8. Penalties

The following penalties shall be imposed on violators of the Ordinance:

Violation of Section 5(a) – Smoking in enclosed or partially enclosed public places, workplaces, public conveyances, or other public places, as defined in Section 4, and violation of Section 7 – Duties and Obligations of Persons-in-Charge, shall be fined P500.00 for first offense or violators may opt to render six (6) hourss of community service. For Second Offense, violators shall be fined P1,000.00 or violators may opt to render twelve ((12) hours of community service. For Third and Subsequent Offenses, violators shall be fined P2,500.00 or violators may opt to render thirty (30) hours of community service.

Violation of Section 5(b) – Selling or distributing tobacco products in a school, public playground or other facility frequented by minors, or within 100 meters from any point in the perimeter of these places, and Section 5(c) – Selling or distributing tobacco products to minors, shall be fined P1,500.00 for first Offense or violators may opt to render eighteen (18) hours of community service. For Second Offense, violators shall be fined P3,000.00 violators may opt to render thirty-six (36) hours of community service. For Third and Subsequent Offenses, violators shall be fined P5,000.00 or violators may opt to render sixty (60) hours of community service.

Violation of Section 5(d) – Placing cinema and outdoor advertisements of tobacco products, and Section 5(e) – Placing, posting, or distributing advertising materials of tobacco products, such as leaflets, posters and similar materials, outside the premises of point-of-sale establishments, shall be fined P1,500.00 for First Offense or violators may opt to render eighteen (18) hours of community service. For Second Offense, violators shall be fined P3,000.00 violators may opt to render thirty-six (36) hours of community service. For Third and Subsequent Offenses, violators shall be fined P5,000.00 or violators may opt to render sixty (60) hours of community service. a. Suspension of License. The license to operate of any establishment or of any public conveyance covered by this Ordinance shall be suspended for at least one (1) week but not more than one (1) month: 1. Failure of the establishment or public conveyance to comply with the provisions under Section 5 & 6 which was violated as stated in the Citation Ticket within ten (10) calendar days of its issuance, regardless of whether or not the Citation Ticket was accepted.

2. Failure of the establishment or public conveyance to pay the fine indicated in the Citation Ticket within 10 calendar days of its issuance, regardless of whether or not the Citation Ticket was accepted. The suspension shall be lifted upon proof of compliance with the cease-and-desist order or payment of fine stated in the Citation Ticket.

RULE IV – CITATION TICKET SYSTEM AND GUIDELINES FOR APPREHENSION, FILING OF CASES AND DISPOSTION OF VIOLATORS Section 9. Issuance of Citation Ticket

Violators of this Ordinance shall be informed of their violation and the penalty associated with such violation by means of a Citation Ticket System with the following guidelines: a. Official booklets of Citation Tickets shall be issued by the Provincial Treasurer’s Office to duly authorized enforcers within ninety (90) calendar days of the effectivity of this Ordinance. b. A Citation Ticket shall be issued to the person/s liable for any violation of this Ordinance upon finding of the violation by duly authorized enforcers. c. A Citation Ticket shall contain the following information: 1) A checklist of the violations under this Ordinance; 2) The Fines associated with each violation; and 3) Due date for compliance with the obligations imposed by the ticket. d. When a Citation Ticket is issued to a violator, the violator shall report to the Provincial Treasurer’s Office or any of each bonded collectors together with the apprehending officer after such issuance, where he or she shall either pay the fine imposed or render community service under Section 18 of the Ordinance. e. Copies of the citation ticket shall be furnished as follows:

1st copy: Violator

2nd copy: Apprehending Officer

3rd copy: Provincial Treasurer’s Office / its bonded agencies

4th copy: Provincial Health Officer f.

The Health Officer shall keep a duplicate of all Citation Tickets issued to violators as well as all other records of violations of this Ordinance.

Section 10. Protocol in the Apprehension of Violators

The following operational guidelines shall be applied in the apprehension, filing of cases and disposition of violators of the Smoke-free Ordinance.

1. Violation of Section 5(a) – Smoking in enclosed or partially enclosed public places, workplaces, public conveyances, or other public places, as defined in Section 4. The following shall be the primary procedure to be applied in the apprehension of violators of Section 5(a) of the Ordinance caught in flagrante delicto. a. The rule on warrantless arrest shall be applicable in the apprehension of violators of Section 5(a) who are caught in flagrante delicto. Hence, the apprehending officer must inform the person arrested of the reason for the apprehension and his rights under the Miranda Doctrine. b. Immediately upon apprehension, the arresting officer must issue to the violator a citation ticket by indicating in the ticket and its duplicate copy the complete name and address of the violator including any identification number if the violator is able to present any identification document. c. Upon the issuance of the citation ticket, the apprehending officer shall inform the violator that he has 48 72 hours to settle his/her liability by paying the amount or rendering community service and presenting the citation ticket or the certificate of completion of Community Service to the Office of the Provincial Treasurer who shall issue an official receipt therefor. The official receipt or the Certificate of Completion of Community Service, together with the citation ticket, shall thereafter be submitted to the police station where the violator was apprehended.

In case the violator is willing to pay the fine out-rightly, then a citation ticket shall be issued with the amount corresponding to the penalty imposed.

An official receipt shall likewise be issued as proof of payment.

Only the deputized apprehending officers are authorized to issue an official receipt and collect payment. Fines collected should be remitted to the Provincial Treasurer within 72 hours from collection.

However, if the apprehending officer can no longer locate the cigarette used by the violator, the witness/es’ affidavit shall be sufficient evidence of the violation. e. If the apprehending officer and/or witness/es has a camera, or any other similar device, it is recommended that before the arrest or apprehension will be effected, the apprehending officer and/or witness/es will first photograph the violator while in possession of the lighted cigarette, which photograph may be printed out later or identified by the apprehending officer during the course of his testimony when a case will already be filed against the apprehended violator. f.

As much as possible, detention of the violator should be avoided specially if the apprehended violator voluntarily receives the citation ticket and commits to settle the amount or render community service within the 4872-hour period. However, in cases where the violator refuses to receive the citation ticket or resist the apprehending officer, he will be subjected to the application of Section 20 of Ordinance 05-12. g. If the apprehended violator fails to comply the penalty within the 72 48-hour period as required under Section 10 paragraph 1(c) hereof, and is unable to submit the official receipt or certificate of completion of community service, the PNP shall indicate such fact of failure to comply the penalty in the police blotter. The Treasurer’s Office shall provide a list of non-paying violators to the PNP and the PLO. The PLO shall then endorse cases to the appropriate Prosecution Services Office.

Violation of Section 5(b) – Selling or distributing tobacco products in a school, public playground or other facility frequented by minors, or within 100 meters from any point in the perimeter of these places, and Section 5(c) – Selling or distributing tobacco products to minors. The following shall be the primary procedure to be applied in the apprehension of violators of Section 5(b & c) of the Ordinance caught in flagrante delicto. a. The rule on warrantless arrest shall be applicable in the apprehension of violators of Section 5(b & c) caught in flagrante delicto or “caught in the Act”.

Hence, the apprehending officer must inform the person arrested of the reason for the apprehension and his rights under the Miranda Doctrine. b. Immediately upon apprehension, the arresting officer must issue to the violator a citation ticket by indicating in the ticket and its duplicate copy the complete name and address of the violator including any identification number if the violator is able to present any identification document. c. Upon the issuance of the citation ticket, the apprehending officer shall inform the violator that he has 48 72 hours to settle his/her liability by paying the amount or rendering community service and presenting the citation ticket or the Certificate of completion of Community Service to the Office of the Provincial Treasurer who shall issue an official receipt therefor. The official receipt or the Certificate of Completion of Community Service, together with the citation ticket, shall thereafter be submitted to the police station where the violator was apprehended. d. The apprehending officer shall likewise see to it that the effects of the offense such as the tobacco products being sold or distributed by the violator in a school, public playground or other facility frequented by minors, or within 100 meters from any point in the perimeter of these places or the tobacco products being sold or distributed by the violator to a minor is confiscated from the violator, and properly stored and recorded for evidentiary purposes.

However, if the apprehending officer can no longer locate the tobacco products being sold or distributed by the violator, the witness/es’ affidavit shall be sufficient evidence of the violation. e. It shall not be a defense for the person selling, distributing or purchasing cigarettes or any tobacco products that he/she did not know or was not aware of the real age of the minor to whom said cigarettes or any tobacco products was sold or distributed. Neither shall it be a defense that he/she did not know nor had any reason to believe that the cigarette or any other tobacco product was for the consumption of the minor to whom it was sold. f.

In case of doubt as to the age of the buyer, retailers shall verify, by means of any valid form of identification paper containing both the photograph and the date of birth of the bearer, such as, but not limited to, passport, driver’s license, Social Security System identification card, postal identification card and the like, that the buyer is at least eighteen (18) years old. g. If the apprehending officer and/or witness/es has a camera, or any other similar device, it is recommended that before the arrest or apprehension will be effected, the apprehending officer and/or witness/es will first photograph the violator while in the act of selling or distributing tobacco products to a minor or in a school, public playground or other facility frequented by minors, or within 100 meters from any point in the perimeter of these places, which photograph may be printed out later or identified by the apprehending officer during the course of his testimony when a case will already be filed against the apprehended violator. h. As much as possible, detention of the violator should be avoided specially if the apprehended violator voluntarily receives the citation ticket and commits to settle the amount or render community service within the 2-day period. However, in cases where the violator refuses to receive the citation ticket or resist the apprehending officer, the violator may be held for not more than 12 hours on the ground that he is caught committing the crime of resistance and disobedience to a person in authority or his agents as penalized under Article 151 of the Revised Penal Code.he will be subjected to the application of Section 20 of Ordinance 05-12. i.

If the apprehended violator fails to comply the penalty within the 4872-hour period as required under Section 10 paragraph 1(c) hereof, and is unable to submit the official receipt or certificate of completion of community service, the PNP shall indicate such fact of failure to comply the penalty in the police blotter. The Treasurer’s Office shall provide a list of non-paying violators to the PNP and the PLO. The PLO shall then endorse cases to the appropriate Prosecution Services Office. The PNP shall then proceed with the filing of the appropriate charges against the violator.

Violation of Section 5(e) – Placing cinema and outdoor advertisements of tobacco products, and Section 5(f) – Placing, posting, or distributing advertising materials of tobacco products, such as leaflets, posters and similar materials, outside the premises of point-of-sale establishments. The following procedures shall be applied in the apprehension of violators of Section 5(e and f) of the Smoke-free Ordinance. a. The rule on warrantless arrest shall be applicable in the apprehension of violators of Section 5(d and e) caught in flagrante delicto. Hence, the apprehending officer must inform the person arrested of the reason for the apprehension and his rights under the Miranda Doctrine. b. Immediately upon apprehension, the arresting officer must issue to the violator a citation ticket by indicating in the ticket and its duplicate copy the complete name and address of the violator including any identification number if the violator is able to present any identification document. c. Upon the issuance of the citation ticket, the apprehending officer shall inform the violator that he has 48 72 hours to settle his/her liability by paying the amount to the Office of the Provincial Treasurer who shall issue an official receipt therefor. The official receipt, together with the citation ticket, shall thereafter be submitted to the police station where the violator was apprehended. d. The apprehending officer shall likewise see to it that the effects of the offense such as the copy of the cinema and outdoor advertisement, as defined in Section 4(e) hereof, being placed or distributed by the violator is confiscated from the violator, and properly stored and recorded for evidentiary purposes.

However, if the apprehending officer can no longer locate the copy of the cinema and outdoor advertisement being placed or distributed by the violator, the witness/es’ affidavit shall be sufficient evidence of the violation. e. If the apprehending officer and/or witness/es has a camera, or any other similar device, it is recommended that before the arrest or apprehension will be effected, the apprehending officer and/or witness/es will first photograph the violator while in the act of placing or distributing cinema and outdoor advertisement, which photograph may be printed out later or identified by the apprehending officer during the course of his testimony when a case will already be filed against the apprehended violator. f.

As much as possible, detention of the violator should be avoided specially if the apprehended violator voluntarily receives the citation ticket and commits to settle the amount or render community service within the 4872-hour period. However, in cases where the violator refuses to receive the citation ticket or resist the apprehending officer, he will be subjected to the application of Section 20 of Ordinance 05-12. g. If the apprehended violator fails to comply the penalty within the 72-hour period as required under Section 10 paragraph 1(c) hereof, and is unable to submit the official receipt or certificate of completion of community service, the PNP shall indicate such fact of failure to comply the penalty in the police blotter. The Treasurer’s Office shall provide a list of non-paying violators to the PNP and the PLO. The PLO shall then endorse cases to the appropriate Prosecution Services Office.

4. Violation of Section 7(a, b and c) – Duties and Obligations of Persons-in-Charge. The following procedures shall be applied in the apprehension of violators of Section 7(a, b and c) of the Smoke-free Ordinance. a. This procedure shall be applied in those cases where the person is apprehended violating Section 5(a) – Smoking in public places such as restaurants, playgrounds, resorts and other public places as defined in paragraph (i) of [Section 4e IRR] Section 4 of the Smoke-free Ordinance, and Section 7(a) – Prominently post and display “No Smoking” signages in the locations most visible to the public in the areas where smoking is prohibited, including vehicles; 7(b) Remove from the places where smoking is prohibited, all ashtrays and any other receptacles for disposing cigarette butts; 7(c) – For persons-in-charge of schools, public playgrounds or other facilities frequented by minors, post the following statement in a clear and conspicuous manner: “SELLING OF CIGARETTES OR OTHER TOBACCO PRODUCTS IS NOT ALLOWED WITHIN 100 METERS FROM [SCHOOL/ETC.] PERIMETER”; and 7(d) – For persons-in-charge of point-of-sale establishments, post the following statement in a clear and conspicuous manner: “SALE/DISTRIBUTION OF TOBACCO PRODUCTS TO MINORS IS UNLAWFUL UNDER PROVINCIAL ORDINANCE NO. 05 SERIES OF 2012”. b. The Inspection Team shall see to it that non-posting of the required signages is properly entered in the Inspection Form duly filled up the by Inspection Team and signed by the owner/proprietor/person-in-charge to signify his/her conformity thereto. c. Immediately upon re-inspection and finding non-compliance, the Inspection Team must issue to the violator a citation ticket by indicating in the ticket and its duplicate copy the complete name and address of the violator including any identification number if the violator is able to present any identification document. d. Upon the issuance of the citation ticket, the Inspection Team shall inform the violator that he has 48 72 hours to settle his/her liability by paying the amount to the Office of the Provincial Treasurer who shall issue an official receipt therefor. The official receipt, together with the citation ticket, shall thereafter be submitted to the police station where the violator was apprehended. e. As much as possible, detention of the violator should be avoided specially if the apprehended violator voluntarily receives the citation ticket and commits to settle the amount or render community service within the 3-day period. However, in cases where the violator refuses to receive the citation ticket or resist the apprehending officer, he will be subjected to the application of Section 20 of Ordinance 05-12. f.

If the apprehended violator is unable to settle the amount of the penalty within the 23-day period required, and is unable to submit the appropriate official receipt to prove payment of the fine, the PNP shall indicate such fact of failure to comply the penalty in the police blotter. The Treasurer’s Office shall provide a list of non-paying violators to the PNP and the PLO. The PLO shall then endorse cases to the appropriate Prosecution Services Office.

5. Violation of Section 7(f) – Duties and Obligations of Persons-in-Charge. The following procedures shall be applied in the apprehension of violators of Section 7(f) of the Smoke-free Ordinance. a. This procedure shall be applied in those cases where the person is apprehended violating Section 5(a) – Smoking in public places such as restaurants, playgrounds, resorts and other public places as defined in paragraph (i) of Section 4 of the Smoke-free Ordinance [and Section 4(e) of IRR], and Section 7(f) – Warning violators and warning them to stop smoking within the area of which he/she is in charge and if they refuse to comply, asking them to leave the premises, and if they still refuse to comply, reporting the incident to the municipal health officer and the nearest peace officer. b. When a person is apprehended smoking in any of the public places as defined under the Ordinance, the apprehending officer shall immediately inform the person-in-charge of the establishment or public place of the apprehension and shall verify from the said person-in-charge if they are aware of the activity of the apprehended violator. c. Immediately after the apprehension, the apprehending officer shall likewise issue a citation ticket to the person-in-charge of the public outdoor space or public place informing him/her of the fact that a person was apprehended smoking within the premises under his/her control, and informing that as the person-in-charge of the premises, he/she is likewise liable for violating Section 7(f) of the Ordinance and that he/she has 48 72 hours within which to settle the amount indicated in the citation ticket or submit his/her explanation on the surrounding circumstances, and whether or not he/she has knowledge of the smoking being committed by the apprehended person. d. The procedure for the payment of the penalties imposed as stated in Section 8 of the Ordinance shall apply hereof.

Section 11. Treatment of a Minor Violating the Smoke-free Ordinance 1. Violation of Section 5(a) - Smoking committed by a minor. The following shall be the primary procedure to be applied in the apprehension of minors violating Section 5(a) of the Ordinance caught in flagrante delicto. a. The apprehending officer has the duty to immediately release the child to the custody of his/her parents or guardian, or in the absence thereof, the child’s nearest relative. b. If it has been determined that the child taken into custody is fifteen (15) years old or below, the authority which will have an initial contact with the child has the duty to immediately release the apprehended minor. Said authority shall give notice to the local social welfare and development officer who will determine the appropriate programs in consultation with the child and to the person having custody over the child. If the parents, guardians or nearest relatives cannot be located, or if they refuse to take custody, the child may be released to any of the following: a duly registered nongovernmental or religious organization; a barangay official or a member of the Barangay Council for the Protection of Children (BCPC); a local social welfare and development officer; or when and where appropriate, the DSWD. If the child referred to herein has been found by the Local Social Welfare and Development Office to be abandoned, neglected or abused by his parents, or in the event that the parents will not comply with the prevention program, the proper petition for involuntary commitment shall be filed by the DSWD or the Local Social Welfare and Development Office pursuant to Presidential Decree No. 603, otherwise, known as “The Child and Youth Welfare Code”. [Section 20, RA 9344]

b.1 Upon assessment of the minor concerned and the recommendation by the P/C/MSWD person-in-charge, the said minor along with the parent/guardian shall be referred to the nearest Smoking Cessation Clinic for counseling.

The P/C/MSWD shall coordinate with the Smoking Cessation Team in order to monitor compliance of the referred minor and his/her parent/guardian. c. A child above fifteen (15) years but below eighteen (18) years of age shall likewise be exempt from criminal liability and be subjected to an intervention program, unless he/she has acted with discernment, in which case, such child shall be subjected to the appropriate proceedings in accordance with the Law. [Section 6, RA 9344] d. Students (minors) caught smoking shall be referred to the School Principal or Guidance Counselor for appropriate disciplinary measures.

Section 12. Community Service and Undertaking a. If a liable person is found guilty by the court, but is unable or incapable to pay the fines, he/she may choose to render community service to the Municipality/ Cityprovince where the violation was committed.municipality or city within the province, nearest to his/her place of residence.. b. Community service may be the following:

1. Cleaning/sweeping parks and other public places.

2. Garbage collection and disposal.

3. Cleaning of public CR.

4. Tree planting/growing.

5. Cleaning silted canals and RC pipes.

6. Coastal clean-up.

7. Search and destroy breeding places of mosquitoes. c. Further, if the violator should decide to instead opt for community service, he shall be required to execute an undertaking with the following contents: UNDERTAKING

13. Filing of cases against violators

The following procedures shall be employed in the gathering of evidence and filing of cases against violators of the Smoke-free Ordinance. a. Upon the lapse of the 72 48-hour period within which to pay the fine imposed under the Ordinance, the Provincial Treasurer’s Office or its bonded agencies will submit the list of non-paying violators to the PNP and the PLO. The PLO shall then endorse case/s to the appropriate Prosecution Services Office. b. The filing of case shall be pursuant to the usual applicable Rules of Criminal Procedure which shall contain as attachment any of the following documents: 1.

Copy of the citation ticket blotter entry of the apprehension of the violator; 2.

The affidavit of the apprehending officer; 3.

The affidavit of the witnesses to the commission of the offense other than the apprehending officer, if there are any; 4.

The photograph of the violator while in the commission of the offense, if there are any; and, 5.

The documentation of the effects of the offense such as the cigarette used or caught in the possession of the violator which will be later on presented as object evidence;.

6. Certification from the Treasurer’s Offices or bonded collector that the violator failed to pay the penalty.

The Chief of Police may assign the preparation of the formal complaint to the police investigator or he/she may assign it to any other police officer within his/

Section 21. Electronic Database System for Tracking Records of Violations and Actions Taken An electronic database system for tracking records of violations and corresponding penalties/actions taken shall be developed. The Smoke-free Management Information System (SF-MIS) shall serve to cater user-friendly access to real-time data. Computer sets and software shall be installed at the Records Section’s server of the Provincial / City/ Municipal Police Station.

Section 14. Disposition of Violators

The following procedures shall be applied in the disposition of violators of the ordinance particularly those who have opted to undergo or render community service instead of paying the fine imposed under the ordinance. a. Once a violator chooses to render community service instead of paying the fine applicable, the apprehending officer shall forthwithnotify the violator that he/she shall report to and undergo community service at the nearest Municipality/City Health Office.

A copy of the undertaking shall be given to the Rural/City Sanitary Inspector under which the community service will be supervised.

Upon receiving the transmitted documents pertaining to the rendition of community service, the City/Municipal Health Officer shall forthwith schedule the community service of the violator and assign a specific personnel [RSI/health personnel] to supervise the work of the violator.

RULE V – INCENTIVES FOR REPORTERS AND ENFORCERS Section 15. Incentives for Reporters of the Violations and Enforcers of the Ordinance

Penalties stipulated under Section 18 of the Smoke-free Ordinance shall be strictly imposed. Shares of the penalties shall be appropriated as follows: a. 40% will be given to the individual/group who reported the violations against the Ordinance; b. 20% will be given to the enforcer; c. 40% will cover the maintenance and operational costs in implementing the Ordinance which may include, but not limited to, the following: honorarium of the task force members, coordination meetings, fuel and oil, among others.

Collection from penalties shall be deposited by the Provincial Treasurer under Trust Fund. The reward due to the reporter and apprehending enforcer shall be given immediatelysubject to existing COA laws, rules and regulations. The amount generated from the payment of the penalties shall be deposited under Trust Fund account of the province and shall be used solely by the Smoke-free Task Force subject to the discretion and approval of the Local Chief Executive for the effective implementation of the Ordinance. All fund disbursements shall be subject to COA rules and regulations.

RULE VI – SMOKING CESSATION PROGRAM Section 16. Smoking Cessation Program

The Health Officer, with the assistance of the Health Education and Promotion Officer and the CSO representative designated under Section 16 of the Ordinance, shall develop and promote a Smoking Cessation Program and encourage the participation therein of public and private facilities which may be able to provide for its requirements. Smokers found violating the Ordinance and those who are willing to quit shall be referred to the Smoking Cessation program and its facilities.

A Smoking Cessation Program [SCP] Team shall be created to be composed of the following:

a.

Medical Doctor

b.

SP on Health c. Nurse d. Dentist

e.

Health Educator f. Midwife

g.

Rural Sanitary Inspector

To effectively carry out the implementation of the program, the members of the SCP Teams shall: a. Undergo appropriate trainings and other similar activities. b. Provide trainings to guidance counselors of schools, barangay health workers and other identified stakeholders. c. Ensure the development of a system to effectively implement smoking cessation services in each municipality.

The Information Communication Technology – Geographical Information System installation of the Smoke-Free Management Information System (SF-MIS).

RULE VII - ENFORCEMENT Section 17. A. Anti-Smoking Enforcement Council

An Anti-Smoking Enforcement Council shall be created and is tasked to set guidelines and policies in the enforcement and monitoring of this Ordinance.

The Council shall be composed of the following: Provincial Governor - Chairman Vice-Governor - V-Chairman Members:

- Chairperson of the Committee on Laws, Ordinances and Style – Sangguniang Panlalawigan

- Chairperson of the Committee on Health and Social Services – Sangguniang Panlalawigan

- President of the Municipal and City Mayor’s League

- Provincial Legal Officer

- Authorized Representative from the Provincial Prosecutor’s Office

- Provincial Director of the Philippine National Police or his duly authorized representative

- Provincial Health Officer

- Representative from the Accredited Civil Society Organization

- Representative from the Department of Education

Section 23. Qualification Requirements for Enlistment of Deputized Enforcers a. Members of the Enforcement Team must be non-smokers. b. Members of the Enforcement Team shall undergo Enforcers Training which shall include modules on Smoke-free Laws and Policy Guidelines; The Harmful Effects of Cigarette Smoking and Use of Other Tobacco Products; How to Deal With the Tobacco Industry Interference, among other related subjects. c. When financial resources allow, subject to existing COA laws, rules and regulations, members of the Council and the Enforcement Team shall be issued official Identification Cards and appropriate uniforms.

RULE VIII – CONDUCT OF INFORMATION CAMPAIGN Section 24. Information Campaign

The Information, Education, Communication (IEC) Campaign for the Ordinance shall follow the twin approach of advocacy and social marketing.

Advocacy. It shall focus on generating support from policy-makers such as the Municipal and City Mayors, Barangay Captains and the members of the City/ Municipal/Barangay Council. In view of this, the Anti-Smoking Enforcement Team shall conduct orientations in all barangays.

Social Marketing. It shall focus to influence the behavior of people and institutions. Towards this end, the following shall be undertaken: 1.

Within sixty (60) calendar days of the effectivity of the IRR, the Health Office, In coordination with the Office of the Provincial Governor shall: a. Provide at least two (2) copies of the Ordinance and the IRR to the PNP station or precinct and in the 17 LGUS of the province; b. Provide a primer of the Ordinance to every member of the PNP and Barangay Tanods in the cities and municipalities; and c. Conduct lectures to brief members of the PNP of the provisions of the Ordinance and its IRR and of their responsibilities with respect to its enforcement.

On Establishments a. In coordination with the Permits and Licenses Office, shall give a copy of the Ordinance and its primer to all existing establishments that are licensed to operate and are open to the public, as well as to those applying for a new license. b. The Anti-Smoking Enforcement Team, through the permits and license division of the province, shall provide copies of the Ordinance, the primer and corresponding guideline for every establishment that applies for a new license. c. A period of sixty (60) days from notice of the Ordinance shall be given to the person-in-charge of the premises to comply with the requirements of the Ordinance. d. Failure to comply with the requirements set forth in the Ordinance shall be a ground for the Inspection Team to recommend for cancellation of the business permit by the Office of the Business Permits and Licenses Department of the municipality/city.

On Public Conveyances a. Within sixty (60) days after the effectivity of the Ordinance, the Smoke-free Task Force, in coordination with the Information Officer, shall give a copy of the Ordinance, a primer and corresponding guidelines, to all public utility vehicle operators in the province. b. A period of sixty (60) days from notice of the Ordinance shall be given to the public utility vehicle operators to comply with the requirements of the Ordinance. c. Failure to comply with the requirements set forth in the Ordinance shall be a ground of the Inspection Team to recommend to the LTFRB for the cancellation of the public utility’s license to operate within the City/Municipality or a prohibition of the utility’s use within the metes and bounds of the locality or to the Sangguniang Bayan of the City/Municipality for the cancellation of jeepney’s and tricycle’s license to operate.

4. Public Billboards, Notices in Barangays

Upon effectivity of the Ordinance, the Engineer’s Office shall put up billboards in conspicuous places in the cities/municipalities/barangays to notify the public of the restrictions and sanctions imposed by the Ordinance. The Information Office shall also immediately issue for dissemination at the barangay level notices regarding the obligations of persons-in-charge. The Anti-Smoking Enforcement Team shall undertake an Information and Educational Campaign to ensure compliance with the law.

5. Conduct of Orientation Seminars and Trainings

Within sixty (60) calendar days from the effectivity of the Ordinance and periodically thereafter, the Health Officer, with the assistance of the Health Education and Promotion Officer and the CSO representative designated under Section 16 of the Ordinance, shall develop and conduct a series of orientation seminars and trainings for the enforcers of the Ordinance, at least one for each group, including but not limited to, deputized enforcers like the barangay health workers, barangay tanods and the local PNP. 6.

On Key Messages in the Educational Campaign a. The harm caused by smoking and second-hand tobacco smoke exposure; b. The fact that elimination of smoke is the only science-based solution to ensure complete protection from exposure; c. The right of all workers to be equally protected by the law; and d. That smoke-free environments do not adversely affect economic interests, particularly those of the hospitality industry; rather, the evidence indicates economic benefits for all sectors in addition to any health benefits achieved.

RULE IX – COORDINATED IMPLEMENTATION

The Council shall meet at the soonest possible time after the approval of the IRR. B. Anti Smoking Enforcement Team

An Anti-Smoking Enforcement Team shall be created to aid in the implementation, enforcement and monitoring of the Ordinance as well as to conduct educational awareness campaigns, information dissemination programs, and capacity building programs, that will inform the constituents and train enforcement officers.

The Enforcement Team shall be composed of the following: 1. Provincial Director of the PNP or his duly deputized officer - Chairperson 2. Provincial Health Officer 3. Municipal Health Officers 4. Authorized representative of the Vice-Governor 5. Chairperson of the Committee on Health and Social Services 6. Authorized deputized Agents –

6.1. Traffic enforcers

6.2. Tanods

6.3. Peace Officers of the Province 7. Legal Officer/Provincial Fiscal 8. Building Officer 9. Provincial Information Officer 10. Business Permits and License Officer 11. Provincial Sanitary Inspector 12. A representative of the designated accredited Civil Society Organization

Section 25. Clustering of LGUs

To implement this Implementing Rules and Regulations effectively, the 17 LGUs of the province will be grouped according to Inter-Local Health Zones as follows:

Oroquieta ILHZ: Oroquieta City, Lopez Jaena, Aloran, Panaon, Jimenez

Ozamis ILHZ: Ozamis City, Sinacaban, Clarin, Tudela

Tangub ILHZ: Tangub City, Bonifacio, Don Victoriano

Calamba ILHZ: Calamba, Plaridel, Baliangao, Sapang Dalaga, Concepcion

Each ILHZ must choose among itself thru the League of Municipalities/Cities a representative who shall serve as Focal Person for the Smoke-free Ordinance

implementation and shall coordinate with the Smoke-free Task Force.

RULE IX – FINANCING Section 26. Funding a. An initial funding to defray the expenses necessary for or incidental to the implementation of the Ordinance in the amount of One Hundred Thousand Pesos (P100,000.00) shall be sourced from both the Provincial Health Office and the Office of the Governor to cover the costs of information dissemination, trainings of enforcement team, meetings, printing of citation tickets and other costs necessary for effective implementation of the law. Every year thereafter, an amount of One Hundred Thousand Pesos (P100,000.00) maybe appropriated in the Annual Budget of the province for the implementation and enforcement of the Ordinance, based on the provincial plans and programs.

The above expenses include, but are not limited to:

The Anti-Smoking Enforcement Council and Anti-Smoking Enforcement Team shall not include as a member any person or entity connected in any way to the tobacco industry.

The Legal Officer/Provincial Fiscal shall: 1) Review reports of and complaints for violations of the Ordinance and in determining liability.

2) Promulgate rules of procedure in order to enable persons who wish to contest the violations stated in the Citation Ticket.

d.

The Building Officer shall: 1) Compose of the three (3) city engineers and fourteen (14) municipal engineers / Municipal Planning and Development Coordinators (MPDC).

2) Conduct, together with the Health Officer or on its own, inspection activities as provided in the Ordinance; and 3) Determine whether or not enclosed or partially enclosed public places, workplaces or other public places comply with the requirements of this Ordinance.

4) Recommend the order of suspension or revocation of permits and licenses of establishments found to have violated the Ordinance, subject to the provisions of Section 8 of the Ordinance; and 5) Denial of application for renewal of permits and licenses of violators of the Ordinance.

e.

The Information Officer shall: 1) Print the copies of the Ordinance for distribution to the public; 2) Make a primer summarizing the provisions of the Ordinance to be issued for dissemination down to the barangay level; and 3) Publicize activities related to the implementation and enforcement of the Ordinance.

f.

The CSO Representative shall: 1) Assist in preliminary inspections and in monitoring violations of the Ordinance; 2) Assist in promoting awareness of the Ordinance and in encouraging public support and participation in its implementation and enforcement; 3) Assist in developing and promoting a smoking cessation program; 4) Assist in developing and conducting orientation seminars and training seminars for enforcers; and 5) Assist in evaluating the performance of the Task Force and the effectiveness of the implementation and enforcement of the Ordinance.

g.

The PNP and Authorized/Deputized Agents shall: 1) Apprehend violators in accordance with the provisions of the Ordinance; and 2) Assist provincial/municipal/city officials and deputized civilians in apprehending violators and in filing the appropriate complaints.

h.

Immediately after the approval of the IRR, the Enforcement Team shall convene.

Section 19. Enforcement on Public Conveyances a. Members of the PNP and deputized officers shall inspect public conveyances during their regular hours of operation and shall issue Citation Tickets upon discovery of any violation of the Ordinance. They shall forward copies of the tickets they issue to violators to the Health Office regularly, every month. b. The franchise of a tricycle shall be suspended for at least one (1) week but not more than one (1) month upon a third and subsequent offense transpiring therein; or, if the violator is a person in charge of a public conveyance, the vehicle used shall be prohibited from plying the thoroughfares and from using public loading facilities, whether for goods or passengers, for a period of one (1) month. For the other franchisees [e.g. multicabs], they shall be recommended to the LTFRB for possible sanctions under existing laws and regulations.

Section 20. Enforcement on Establishments a. Sixty (60) calendar days after the effectivity of this Ordinance, an Inspection Team composed of representatives from the Health Office, the Engineer’s Office, and the Permits and License Office, Building Official, Market Supervisor and PNP, shall conduct inspections of establishments and buildings to determine their compliance with the provisions of the Ordinance. b. Inspection on Establishment and Buildings – The Inspection Team shall conduct an inspection upon receipt of a complaint or on its own in priority areas that shall be identified by the Task Force/Enforcement Team based on substantial number of people affected, number of complaints received, and the like, for purposes of determining compliance with the requirements of the Ordinance and its guidelines. c. The Inspection Team shall inspect the compliance of the establishments and buildings based on the duties and obligations set forth in Section 13 and those specified in the guidelines; taking into consideration the purpose of the law which is to protect all people from the pernicious effects of tobacco smoke. The inspection may take place at the regular hours of operation of the place to be inspected and said inspection should be undertaken at least once every two months or simultaneously with other regular inspections, whichever is more frequent. d. The Inspection Team shall issue a Citation Ticket indicating the violation and corresponding fine. Failure of the establishment to pay fines indicated in the Citation Ticket after due process will serve as basis for denying renewal of its permit/license. A Citation Ticket can be issued for each day that the establishment is found to be non-compliant of the Ordinance. e. In the course of inspection, the inspection team may apprehend individual violators and request the assistance of the PNP in doing so. f.

If the establishment fails to comply with the obligations stated in the Citation Ticket upon re-inspection, the inspection team shall recommend the suspension for at least one (1) week but not more than one (1) month of the license to operate of the establishment, consistent with Section 8(d) of the Ordinance. g. The Inspection Team shall return to re-inspect the cited establishment to determine its state of compliance. Re-inspection of the establishment may occur at any day after the day of issuance of Citation Ticket but shall not, in any case, be more than sixty (60) days. If the establishment has failed to comply within sixty (60) days after receipt of the first Citation Ticket, the inspection team shall recommend the suspension or cancellation of the establishment’s license and permit, as well as the closure of the establishment to the Local Chief Executive of the concerned LGU. h. This provision shall not preclude daily re-inspection by the Inspection Team. Unscheduled, surprise inspections, as well as visits made in response to complaints may also be made. i.

The Inspection Team shall recommend to the PNP the filing of criminal charges against liable persons-in-charge and individual persons for non-compliance of the Ordinance pursuant to existing court procedures. j.

A new license to operate may only be granted upon proof of compliance and payment of all fines. Proof of compliance shall be by means of a re-inspection of the premises by an Enforcement Team/Task Force.

Costs of printing copies of the Ordinance, the Citation Tickets, and information, education and communication materials pertaining to tobacco control; Costs of inspection and enforcement by the Anti-Smoking Enforcement Team, including allowances for meals, the amounts of which shall be set by the Office of the Provincial Governor; 3. Incentive or reward for private citizens who report violations and for the enforcers of the Ordinance; 4. Institution and operating expenses of the smoking cessation program and facility; and 5. Other expenses associated with the implementation and enforcement of the Ordinance.

The Provincial Health Office shall determine the amount needed for the initial implementation of the Ordinance and submit its recommendation to the Local Finance Committee. The Local Finance Committee shall determine from the budget of the Provincial Health Office and the Office of the Provincial Governor the source of fund that would initially implement the Ordinance. In case funds are unavailable, the Local Finance Committee shall identify the source of fund from any available free resource and recommend to the Governor for approval and appropriate action of the Sangguniang Panlalawigan.

Proceeds from the administrative fines shall form part of a Trust Fund that will be used to defray costs of operations of the Anti-Smoking Council and the Enforcement Team. The Council shall determine how the Trust Fund is to be utilized in furtherance of the Ordinance. An Annual Work and Financial Plan shall be prepared by the Anti-Smoking Council and shall be submitted to the Provincial Accounting Office to be the basis of Trust Fund disbursement.

Section 18. Duties and Responsibilities of the Anti-Smoking Enforcement Team Members

Other than (1) receiving, reviewing and processing reports of and complaints for violations of the Ordinance and (2) deputizing enforcers under Sections 13 to 16, the Enforcement Team shall have the following respective duties and responsibilities: a. The Provincial Health Officer shall: 1) Serve as the overall coordinator among all the provincial offices involved in the implementation of the Ordinance; 2) Make tobacco control, including the implementation and enforcement of the Ordinance, a part of the health program to be proposed for funding by the general budget of the municipalityprovince; and 3) Assign a hotline or any other number to which violations of the Ordinance may be reported by telephone call or by SMS, and a person to operate the line and record reports.

The Health Education and Promotion Officer shall: 1) Include Health Education and Promotion Officers of the Provincial Health Office and other agencies that have health education and promotion aspect.

2) Develop and produce information, education and communication materials on the harms of second-hand smoke as well as on the provisions of the Ordinance; 3) Encourage constituents of the Province of Misamis Occidental to monitor and report violations of the Ordinance; and 4) Assist the Health Officer in developing and promoting a smoking cessation program.

Within thirty (30) calendar days from the effectivity of the Ordinance, the Health Office shall designate, with the approval of the Office of the Provincial Governor, a Civil Society Organization (CSO) to discharge the duties and responsibilities enumerated in Section 18(f) of the Ordinance. b. The Task Force may deputize qualified civilians to serve as enforcers of the Ordinance subject to the approval of the Provincial Governor. c. Any person can file with the Task Force a report of or complaint for any violation of the Ordinance.

Parts of the tasks of the SCP Teams are the following: a. Proactively recruit smokers who are ready to quit smoking. b. Follow up the enrolled clients of the smoking cessation program until they completely stopped smoking. c. Refer to the designated pulmonologist if pharmacological intervention is needed.

The Council shall henceforth authorize collection of honorarium to the Enforcement Team. The Enforcement Team is required to submit the following documents for the granting of monthly honorarium: a. Monthly report of apprehension and accomplishment. b. Roster of deputized enforcers signed by the council The Council shall henceforth issue guidelines in the manner of the granting of honoraria. d. For the succeeding years, the Provincial Government shall ensure the mandatory funding of the Smoke-free Ordinance, as a provincial commitment, to be sourced from the Peace and Order Fund and any other funds pursuant to Section 10 of the Ordinance. The Provincial Anti-Smoking Council, through the Provincial Health Office, shall submit an Annual Work and Financial Program to the Provincial Planning and Development Office which shall be incorporated to the Annual Investment Program of the province. The Annual Work and Financial Program shall contain the Programs, Projects and Activities with their corresponding Outputs and Funding Requirements to implement the Ordinance. e. The Provincial Anti-Smoking Council, with the support of the Technical Working Group shall also access funds from other sources such as national government agencies, foundations or funding institutions provided that such funding institutions are not connected in any way with the tobacco industry.

RULE X – FINAL PROVISIONS Section 27. Legal Counsel

The Legal Officer, or in his absence, the Provincial Prosecutor shall act as the legal counsel of the Misamis Occidental Anti-Smoking Enforcement Team.

Section 28. Repealing Clause

All rules and regulations or parts thereof contrary to or inconsistent with the provisions of this Implementing Rules and Regulations are hereby repealed or modified accordingly.

Section 29. Separability Clause

If any part or provision of this Implementing Rules and Regulations is declared unconstitutional or invalid, the same shall not affect the validity and effectivity of the other parts or provisions hereof.

Section 30. Effectivity Clause

This Implementing Rules and Regulations shall take effect fifteen (15) days after its publication in a newspaper of local or general circulation and posting in at least two (2) conspicuous places in the province.

BEFORE DEATH -- I read somewhere, I think it was Microsoft Billionaire BILL GATES, who said: “ I do not want to be the richest person in the cemetery! “ Meaning, with all his massive fortunes, he wants to share them before he dies.

A good reminder to all that you can’t possibly bring to the grave all your wealth. It is also a grim reminder that death is the great EQUALIZER. We all die, whether rich or poor. So, share those blessings while you still can.

And one need not be as rich as Mr. Gates to do this. If you have more than enough of what you need or want, go ahead and share to those who have less. Unless you want to be called the “richest man” in the cemetery!

At the strike of 1 a.m., all beer mugs and bottles, whisky, wine and champagne glasses WILL SUDDENLY DISAPPEAR and give way to coffee mugs and cups, tea pots and shaded or non-transparent water jugs.

Never mind what’s inside!

Case in point: When I was in Congress during the late Speaker Monching Mitra’s time, hard liquor was off limits at the congressmen’s lounge especially during session time. Well, the waiters

A newspaper reported about a man who had killed his best friend. Later the police asked the man what had happened. He answered: “My friend and I began talking peacefully about politics till we disagreed and argued. I killed him when I ran out of words.”

Many of us lose control of our anger over the smallest things. When we think someone treated us rudely or talked to us without respect, or in a way we just don’t like. Or if another driver on the road cuts in front of us and offends us.watch out! They call it “road rage,” which many people now struggle with.

Sometimes we get angry because we have unresolved anger from the past. We’re still angry about how somebody wronged or hurt us months or even years ago.

Maybe it was a family member, friend, neighbor, or coworker. We still have not forgiven that person and let

go of our anger. So our anger is like a time-bomb inside us, ready to explode at the smallest offense, causing real hurt and damage to others, including ourselves. That’s why it’s so important for us to forgive that person and get over it! In fact, it’s the only way we’ll get free to get on with healthy, happy living.

because we’re very tired and stressed. Like the mother who hardly slept the night before and worked hard all day. It is wrong to limit proposals for the additional long-term electricity requirements of electric cooperatives to Baseload Power. The need of the electric cooperatives in Mindanao is not specifically for 300 MW of Baseload Power, but for any power plant that can supply any

proportion of the annual ENERGY requirements of the electric cooperatives for a period of 20 years from 2017 onward.

The Invitation to Bid, therefore, should be for any amount of energy up to a maximum of 300 MW x 8,784 hours per year from any power plant of any technology.

Proposals can then be submitted for proposed power plants in Mindanao of any technology that could guarantee delivery of fixed amounts of energy annually, even though they may not be able to guarantee delivery of particular amounts of energy for 24 hours. That is, they need not be baseload power plants. And proposals from renewable energy power plants will qualify for selection.

From the proposals submitted, the PSAGCOR can select the least-cost offers,

until they can build up a portfolio that will meet the requirement of the electric cooperatives for 300 MW of dependable capacity at the required annual capacity factor.

The PSAGCOR should reject the Tender issued by INDRA, and call for another consultant to devise another Tender that will be truly open to all electric generation technologies.

It will mean PSAGCOR will have to go back to square one in their search for reliable electricity at affordable rates. But that is better than proceeding with the INDRA proposal because the proposal has a fatal legal defect, and is, therefore, inherently incapable of producing a portfolio of power plants that will provide at least-cost the additional annual electric energy requirements of the electric cooperatives from 2017 onward.

Steag starts shutdown of unit; reduces power capacity by half

MINDANAO’S biggest coalfired power plant, Steag State Power Inc. (SPI), has begun its preventive maintenance work on one of its units last Saturday (July 27), reducing to half the electricity it prov ides to t he island ’s power-stricken grid.

The plant’s 210-megawatt capacity accounts for about 20 percent of the island’s electric generation mix. It is by far the most modern and the biggest in Mindanao on a per unit capacity.

The ASEAN or Association of South East Asian Nations comprises ten (10) countries namely: Indonesia, Thailand, Malaysia, Singapore, Philippines, Vietnam, Burma, Brunei, Cambodia and Laos. On 8 August 1967, five leaders – the Foreign Ministers of Indonesia, Malaysia, the Philippines, Singapore and Thailand – sat down together in the main hall of the Department of Foreign Affairs building in Bangkok, Thailand and signed a document. By virtue of that document, the Association of Southeast Asian Nations (ASEAN) was born. The five Foreign Ministers who signed it – Adam Malik of Indonesia, Narciso R. Ramos of the Philippines, Tun Abdul Razak of Malaysia, S. Rajaratnam of Singapore, and Thanat Khoman of Thailand – would subsequently be hailed as the Founding Fathers of probably the most successful inter-governmental organization in the developing world today. It also codifies ASEAN norms, rules and values; sets clear targets for ASEAN; and presents accountability and compliance. The ASEAN Charter entered into force on 15 December 2008. A gathering of the ASEAN Foreign Ministers was held at the ASEAN Secretariat in Jakarta to mark this very historic occasion for ASEAN. With the entry into force of the ASEAN Charter, ASEAN will henceforth operate under a new legal framework and establish a number of new organs to boost its community-building process. In effect, the ASEAN Charter has become a legally binding agreement among the 10 ASEAN Member States.

The leaders of the ten countries had made an agreement that by 2015 there will be somewhat like open market for business investments and workforce hiring on professionals like architects, accountants, surveyors, medical practitioners, dental practitioners, engineering and nursing as well. Furthermore, the agreement also emphasizes on the open market to travel with ease in accessibility among the member nations. This development might give both positive and negative effect to our country. Positive in the sense that as we all know our unemployment and underemployment rate is continuously going up every year might be lessened as doors of opportunities will open to them. Travelling in these member countries will now be like visiting from a municipality to another easily which can be a positive impact to our tourism industry. Most importantly we can now showcase the talent of the Filipinos with our Southeast Asian counterparts. On the other hand, this can greatly affect our local businesses because more and more foreign and cheaper products will be bombarded to our country most especially that we Filipinos are fond of imported products that might lead to higher and tougher competition that will perhaps result

What will happen by 2015 is something we still don’t know about.

But our government should start looking the both sides of this opportunity to prepare us with counter measures for the challenges and opportunities it brings to us. With greater competitions surely the Filipinos will find its way to shine and succeed in whatever fields of endeavor that we would like to be in with but it should be accompanied by our government’s efforts and support. Lastly, ASEAN Community by 2015 will serve as a wake-up call for our government to double time with plans and preparations for the big change that is about to happen because it seems that they were just too busy attending on local and national issues but not with international ones.

How could we boost pupils to do well in elementary school? Study ensures that school preparedness makes a school achieve their goal in producing competent pupils. Therefore, we should provide an fun and learning experiences for children to increase school readiness.As we all know that education starts at homeand parents are the first teachers of our pupils, so supporting
