Productivity of degraded lands pushed CAGAYAN de Oro City–– The Department of Environment and Natural Resources (DENR) is pushing for increase productivity of degraded upland areas through an ecologically sustainable method with the use of varied crops.

“We need to develop and make our lands productive.

Cepalco eyes lower rates with new RE power plants

THE electric distribution utility serving 69 barangays of Cagayan de Oro and the municipalities of Tagoloan, Villanueva and Jasaan in Misamis Oriental is eyeing lower generation costs from three of its embedded renewal energy power plants to reduce its total generation charge.

Engr. Richard S. Ratunil, energy compliance officer for the Cagayan Electric Power and Light Co. (CEPALCO) disclosed in a May 24 briefing to energy stake-

holders at a local hotel that the distribution utility (DU) has filed four rate applications with the Energy Regulatory Commission (ERC) which would in effect reduce its average distribution charges.

The ERC would conduct the hearings for the four cases over the next three days starting Tuesday, May 27 at the CEPALCO Corporate Office at 33 Toribio Chaves Street.

First is its annual rate translation for 2015 which seeks ERC approval to adjust the distribution charges for each type of customer.

“The new rate will be applicable for the period July 2014 to June 2015 (Regulatory Year 2015) and has been filed pursuant to the timelines prescribed in the Rules in Setting Distribution Wheeling Rates (RDWR),” Ratunil said.

2015 is the last year of the third regulatory reset of the DU and would reduce its maximum average price from P1.2014 per kilowatt hour (/kWh) in 2014 to P1.1406 in 2015 for a five percent reduction of P0.0608/kWh. Once approved, this would reduce electric rates across the franchise area as follows: Streetlight (0.070; Residential (0.13); Commercial (0.12); Industrial (0.07); and Bulk Power (0.06).

The next three applications cover the DU’s power supply agreements (PSE) with three of its embedded power generators. Embedded generators are power

plants located within a DU’s franchise area which supply power directly to it without passing through the transmission network of the National Grid Corporation of the Philippines (NGCP).

Its PSA with Kirahon Solar Energy Corporation (KSEC) covers a 10MW Solar PV power plant in Kirahon, Villanueva which was signed November 22, 2013 and would start commercial operations by the 1st quarter of 2015.

Another application covers amendments to CEPALCO’s PSA with Bubunawan Power Corporation (BPC) for its 7MW hydroelectric power plant (HEP) in Baungon, Bukidnon.

“The existing approved rate is pegged at the landed rate of the National Power Corporation (NPC) so as not to displace cheap NPC hydro,” said Ratunil.”However, it is no longer applicable because of NPC’s insufficient supply for new loads

so adjustments are needed to adjust energy charges corresponding to actual cost of power plant.”

Another application covers the amendment to CEPALCO’s PSA with sister company Minergy Energy Systems for its 8MW Cabulig HEP in Claveria, Misamis Oriental.

“The Rate impact of three renewable energy (RE) projects is +PhP 0.06/kWh but will lover the generation cost in the entire CEPALCO franchise area since it would displace our more expensive MINERGY Bunker C plant and reduce total generation cost from P4.3015/kWh to 4.1853 or a reduction of 0.1162/kWh,” explained Engr. William U. Lim, senior vice president, Minergy Energy Systems.

Lim said the adjustment of the Capital Recovery Cost based on actual project cost is a allowed under ERC approved PSA of CEPALCO with Minergy.

Ratunil said CEPALCO has been experiencing an unprecedented five percent average load growth for the past 10 years. Should this continue, the DU would need an additional power supply of 101MW over what it now has to accommodate new customers.

Peak load within the DU’s franchise area is expected to double from 141MW (2013) to 281 MW in 2018 and it is

now scouting for additional power supply next year.

Among the options now being evaluated are the coal fired power plant of Therma South Inc. in Davao City, the DOE’s modular genset program, the suspended Interim Mindanao Electricity Market and Kirahon Solar Energy Corp.

“We want to take care of the energy requirements of our service area especially considering the growth is really that fast,” said Marilyn A. Chaves, senior manager for customer and community relations. “We are also working on a power supply agreement with Therma South, and also sourcing from our sister company Minergy Kirahon Solar Plant. Hopefully the 10MW will be available by early next year, plus Cabulig. We are making sure in the next few years we can supply the needs of our service areas.”

Last July 2011, CEPALCO cut its power rates by an average of five centavos per kilowatt hour and has continued to reduce it until 2014 for a cumulative total of 20-centavo cut per kilowatt hour over four years. The cut is equivalent to a P10 reduction in the monthly power bill of the average 200-kilowatt hour consumer household starting July 2011, P20 in 2012, P30 in 2013 and P40 in 2014.

Tagum killings, squabblings embarrassing

AVAOCITY – An embarrassment to Tagumenyos.

This was how an anticrime head described the political leaders’ reactions on the Human Rights Watch (HRW) report that implicated former Tagum city mayor Rey Uy behind numerous summary killings.

Uy has accused his political opponents for coercing and paying the sources interviewed by the HRW in order to thwart his comeback for the mayoralty position in 2016. The matter generated a response from current Mayor Alan Rellon.

But for Cesar Cuntapay, a retired police officer and now appointed as the city’s peace and order board, the political mudslinging is an embarrassment for Tagum City.

“They are destroying the reputation of each other.

They are wasting time. It will not improve the plight of our fellowmen,” he said in an interview with Radyo ni Juan Tagum.

Cuntapay said the report should have prompted officials to get their acts together.

“An investigation has come up not from the people of Tagum but from an external source. That’s an insult to Tagumenyos, no one is brave enough to face this

concern,” said Cuntapay.

He said the HRW report sent a chilling message to the public.

“There has been police, a judge, and a media who have been killed. No one’s exempted. They will feel no one can live peacefully here in Tagum,” he said.

The HRW gathered testimonies from witnesses, former police officers and former death squad members who pinned local officials for supporting the death squad.

The testimonies said the Philippine Drug Enforcement Agency (PDEA) and local officials provided the death squad with a list of targets including petty criminals and youth delinquents. As one death squad member said, the police will be tipped to stay clear from areas where they will conduct their modus operandi.

A local government staff, however, had denied over a television interview that the local government is behind the list of targets for summary killings.

Mayor Rellon acknowledged the report has put the city in the international spotlight and said this should challenge authorities to investigate the matter.

“If they (the death squads) still exist, let us make efforts to dismantle them. I hope these witnesses would come out and not be afraid, and hopefully the authorities can now conduct

formal investigation,” the mayor said.

Davao del Norte Police Director Superintendent Cadingan said they would conduct an investigation.

Cuntapay, however, did not share the optimism of Rellon.

“Ang takbo ng hustisya, marami namang kolor yan (There are many hues on the course of justice),” Cuntapay said. “There is the color of those who are disenfranchised, and those who are in authority. We cannot condemn this. It will take time to resolve this, especially the attitude of those who did not act when people needed them before, nobody dared.”

He minced no words to criticize Rellon saying that as a former councilor and vice mayor, Rellon did not call for the investigation of the killings. Rellon was a former partymate of Uy but bolted out as he sought the mayoralty in 2013, running against Uy’s son.

Cuntapay was Rellon’s running mate. He was then head of the anti-corruption group called Taxpayers Against Crime and a barangay human rights advocacy officer under the Commission on Human Rights.

The Davao del Norte Press Club, who earlier condemned the killing of radio commentator Rogelio Butalid by the Tagum death squad, had not aired their position on the report.

Renewable energy, Solar power and more More lawmakers want the government to invest in solar power to promote energy stability, attain energy independence from oil-dependent energy sources and address the power crisis in the country.

However, efficiency of Solar power is yet debatable.

Clearly it can help mitigate global warming and air pollution but the question at hand is when countries like ours have more rainy than sunny seasons. Solar power is dependent on sunlight. If its effectiveness is dependent on sunlight, the problem is most of Mindanao have more rainy seasons. How can it encourage industry growth and more jobs when its use cannot be sustainable? True, it would lower electricity bills but only for a few months.

In this era of increasingly high prices and foreseeable decline of the global oil supply, government should at the soonest develop fuel alternatives and accelerate the exploration and utilization of renewable sources of energy. And there are other alternatives: geothermal, hydro power, biomass, etc..

Our government must encourage investments in renewable energy and to encourage demand and provide incentives especially to purchasers of small renewable energy systems.

The Philippines would greatly benefit from using renewable sources of energy because of its clean and

sustainable character.

Solar technology is one of these renewable energies. It could be an immediate and sustainable way to deal with the country’s energy problems, if there is an abundant solar energy throughout the country.

Installation of small solar energy systems in homes and business establishments all over the country, targeting a million rooftops in the next 10 years are encouraged, however.

We are second in Southeast Asia in terms of irradiation and insolation, we already have the foundation to become a renewable energy leader in the region owing to the strong semi-conductor industry and the manpower base serving in the manufacturing and service sectors, especially the installers’ sub-sector,” according to our experts.

Proponents suggest incentives and financing facilities should be available to encourage the use of solar energy by ordinary electricity consumers like residences, offices as well as small and medium business establishments. Through this, the demand for clean solar energy, as well as the opportunities for local manufacturing and related solar energy products and services will increase, they say. But it should be augmented with other renewable energy systems.

Napoles affidavit, violation of Constitution LIFE’S INSPIRATIONS: “…

There are those who turn justice into bitterness and cast righteousness to the ground…” (Amos 5:7, the Holy Bible).

-oooWHAT IS TO BE DONE WITH NAPOLES AFFIDAVIT NOW? There is something that the Aquino government and the Department of Justice are not telling the people, relative to the “tell all” affidavit of Janet Lim Napoles which named some 20 senators, 100 or so congressmen and other government officials as direct participants in the P10 billion pork scam: so what is to be done with that affidavit now?

What is more, while President Aquino already reacted to that affidavit by saying he was “confused” by its contents, there is no reaction at all, not even a whimper or even a sigh, from Justice Secretary Leila De Lima who, undeniably, was the one who asked Napoles to come up with a “tell all” affidavit in connection with the pork barrel scam before Napoles was to undergo a medical operation.

Kakampi mo ang batas Atty. Batas Mauricio Indeed, considering the explosive content of the affidavit which implicated government officials in the biggest plunder case ever to hit the Philippines, the least that the President or De Lima should have done was to refer it right away to the Office of the Ombudsman for the proper preliminary investigation of those that have been named therein.

-oooNAPOLES AFFIDAVIT AS A BASIS FOR PRELIMINARY INVESTIGATION: For all intents and purposes (as we lawyers are fond of saying whenever we have run out of arguments), the affidavit of Napoles already constitutes a criminal complaint or accusation that is sufficient to start a preliminary investigation under Rules 110 and 112 of The Revised Rules of Criminal

Procedure (as amended on December 01, 2000).

For one, that affidavit complies with Section 6 of Rule 110 of the foregoing Rules, which says that a “complaint… is sufficient if it states the name of the accused; the designation of the offense given by the statute; the acts or omissions complained of as constituting the offense; the name of the offended party; the approximate date of the commission of the offense; and the place where the offense was committed…”

Then, it also complies with almost all the other sections of Rule 110 which define the conditions by which a preliminary investigation under Rule 112 must and should be carried out---to determine if an offense had in fact been committed and that there is

sufficient reason to believe that the persons named in the complaint were the ones who committed it.

-oooCULPABLE VIOLATION OF THE CONSTITUTION: Considering the clarity of the foregoing rules of law and procedure, it was the undoubted duty of the President and of the Secretary of Justice to have acted to commence the requisite preliminary investigation pursuant to the rules of criminal procedure after receiving the Napoles affidavit.

Surely, no one can deny the fact that it is the duty of both Aquino and De Lima to prosecute criminal cases and the perpetrators of the crime. That duty to prosecute criminal cases is both Constitutional and statutory---meaning that, it is a duty that the Constitution and the laws themselves impose.

With their inaction on the Napoles “tell all” affidavit, could not the President and De Lima have committed a culpable violation the Constitution? Is this not See AFFIDAVIT, page 7

Butuan shores up protection for persons with disabilities

B U T UA N C i t y – – T h e city government here has strengthened the protection of the rights of persons with disabilities (PWDs) as mandated by Republic Act No. 7277 known as the Magna Carta for Disabled Persons.

The city council unanimously passed SP Ordinance No. 4333-2014 prohibiting verbal and/or non-verbal ridicule and vilification against persons with disabil-

ity and providing penalties for violation.

Authored by City Councilors Ferdinand Nalcot and Virgilio Nery, Jr., the local law says the following constitute acts of public ridicule and vilification: 1) Making fun of a person on account of his/her disability, even through jokes in a manner that is degrading resulting in the embarrassment of the person with disability; 2) Making mockery of a person with disability, whether orally or in writing;

3) Imitating a person with a disability in public gatherings, stage shows, carnivals, television shows, broadcast media and other forms of entertainment that are offensive to the rights and dignity of persons with disability or, any other similar acts; 4) No individual, group or community shall ridicule and vilify in public, whether verbal or non-verbal, a person with a disability at any time and place which could intimidate or result in loss of self-esteem of the latter;

5) Calling a person by his/her disability in public which results to humiliation; 6) Using the disability of a person as an example in a manner that is embarrassing and humiliating to the dignity of persons with disability.

The ordinance penalizes a convicted offender with P2,000 fine per offense or imprisonment of not less than 15 days, but not more than 30 days, or both at the court’s discretion.

The ordinance also pro-

vides, “Upon filing of an appropriate complaint, and after due notice and hearing, the proper authorities may also cause the cancellation or revocation of the business permit, permit to operate, franchise and other similar privileges granted to any business entity that fails to abide by the provisions of this Ordinance.”

At the same time, the City Social Welfare and Development Office, in coordination with the National Council on Disabilty Affairs (NCDA), held a Forum on

Disability Rights Promotion at the City Mayor’s Office where the rights of PWDs were taken up and promoted. Also discussed were opportunities for employment for PWDs in various agencies and establishments.

The event was attended by representatives from the city government, different government agencies, private establishments, civil society organizations, non-government organizations (NGOs), and disabled people’s groups.

Zamboanga mayor praises security forces for recovery of Sayyaf bombs

AMBOANGA CITY – Mayor Maria Isabelle Salazar praised the local police force and the military following the recovery of two suspected Abu Sayyaf bombs on a village in Zamboanga City.

Police have recently recovered two 60 mm mortars hidden in a bush at Sitio Salom in San Roque village.

“We thank police and military operatives for their aggressive efforts to avert security threats with the recovery of improvised explosive devices in San Roque,” Salazar said, adding the recovery of the bombs was the result of an operation following the arrest of two Abu Sayyaf militants here.

Section 11 of RA 10531 inserted a new provision referred to as Section 26-B to PD 269 which provides for the minimum qualification of a director of the electric cooperative requiring that he or she is a member of the electric cooperative in good standing for the last five years immediately preceding the election or appointment.

The Department of Energy, however, in Section 14 of the IRR defined a member in good standing as someone who has no unsettled or outstanding obligations to the cooperative which has not been paid within seven (7) days after the due date.

Taken together, according to Vice Governor Pelaez, Section 11of RA 10531 and Section 14 of the IRR, if made to apply in part this year and the succeeding years up to its fifth year of implementation, will certainly violate the constitutional prohibition on the retroactive application of laws.

Laws must be applied prospectively and should not affect the qualifications and conditions of individuals before the law is ever made,” Vice Governor Pelaez said.

Vice Governor Pelaez proposed an amendment to Section 14 of the IRR to clarify that the particular qualification shall apply only after the fifth year of the implementation of RA 10531 or in 2018.

The same provision of the IRR is being assailed as absolutely anti-poor, discriminatory and unreasonable which would readily disqualify any poor member-consumer from running as director of the board, discriminating him/ her from rich memberconsumers who can pay immediately their obligations.

As such, it violates the due process clause and the equal protection clause inscribed in the Constitution.

“In rural areas, majority of the stakeholders in Electric Cooperatives come from our brothers and sisters who have less in life. If we will unreasonably disqualify them from running as a director in the board due to the inconsiderate span of time and very short leeway, we will miss to hear important voices that represent the majority,” Vice Governor Pelaez expressed.

Vice Governor Pelaez proposed that the same section of the IRR define an unsettled or outstanding obligation as an account which has not been paid within thirty (30) days after the due date instead of the existing seven (7) days after the due date which is clearly unreasonable.

“Vice President Pelaez has exerted great time and effort to realize his vision of putting electricity in every Filipino home. Now, his vision has become a real-

ity. I would like to deepen and nurture his vision by allowing those who are less-privileged members of the electric cooperatives to significantly participate in the decision-making and know the status of their cooperative,” Vice Governor Pelaez said.

With the resolution, the Sangguniang Panlalawigan of Misamis Oriental is urging the Department of Education (DOE) and the National Electrification Administration (NEA) to immediately hold in abeyance the Implementing Rules and Regulations to reflect a reasonable and pro-poor requirement/qualification in accordance with law and the Constitution for the directors of electric cooperatives.

According to Paje, there are around 8 million hectares of denuded and degraded areas in the country that the DENR is proposing to utilize the area in order to establish an ecologically-sustainable plantations using native forest species and other high value crops that would strategically address not only the food needs of the Filipino people but also should have high economic value, like rubber and palm oil.

Contrary to news reports, Paje stressed that there is no plan to convert the entire 8 million open and degraded areas to palm plantations.

“While we have a big opportunity to learn from the lessons of other countries, both best and worst practices, we are not recommending the massive monoculture of palm and rubber,” Paje said.

In the same manner, Paje reiterated that the whole 8 million hectares could not be converted into food production such as rice and vegetables as this will engender soil erosion and floods.

What is Alternative Learning System (ALS)

Many of us may not know this. Alternative Learning System (ALS) is a free education program implemented by the Department of Education (DepEd) under the Bureau of Alternative Learning System which benefits those who cannot afford formal schooling. It is for education-interested people who cannot follow regular school schedules.

The program provides a viable alternative to the existing formal education instruction, encompassing both the non-formal and informal sources of knowledge and skills.

In ALS, students have to attend 10 months of school or 800 hours in the classroom. Then their performance are assessed.

Since ALS is a module-based learning system, students come in on a set time and choose a module to read. A quiz is given after each module to test their learning. Instead of teachers, facilitators are always present to answer any questions and sometimes lecturers would discuss a certain module. After several months, the students will take the Accreditation and Equivalency Test (AET).

If they pass the test, they will be given a high school diploma and enroll in col-

lege.

After getting a certificate upon passing, the students have the option to enroll in ALS again or go to a college.

Some of the present learners are maids, fishermen, and babysitters, and even salesladies.

In some ALS centers, enrolees do not even have to go to class five times a week to finish high school.

Participants just sit in front of a computer for about three hours a week. They learn according to their need and speed.

Communication skills, critical thinking and problem solving, sustainable use of resources and productivity, development of self and

a sense of community, and expanding one’s world vision are the strands of ALS learners. Each student in every session uses a computer loaded with digital modules with videos and animation.

A teacher –called facilitator – helps students navigate the digital modules and monitors his/her progress to determine if the learner is ready for the A&E. There are two ways to take the Alternative Learning System, through the modules (and just months of classroom preparation for the test?) and through the Internet (with also just months of classroom with the computers as preparation for the test).

Last year, the sectors of interest were mostly on IT-BPM. The other sectors were energy, solar farm, manufacturing, industrial waste recycling, pharmaceuticals, financial and equities market, physical fitness gear, consultancy firm, trading, electronics and publicprivate-partnership (PPP).

For the first quarter of 2014, the preferred industry of investors is manufacturing, followed by BPM, IT, energy and trade. Other sectors such as garments

and aerospace were clumped under manufacturing.

“As we open more areas of commercial cooperation between the Philippines and the US, we expect to continuously expand not only trade and investment between the Philippines and US but also between the Philippines and Association of Southeast Asian Nations (ASEAN),” Manalo said.

In 2013, US was Philippines’ third major trading partner, second biggest export market, and second import supplier. In the same year, Investment Promotion Agencies (IPA) approved investments from the US stood at US$1.3 billion.

Habito, who is a former secretary for socioeconomic planning, spoke at the “ASEAN Economic Community Conference: Converging towards a National AEC Game Plan” held earlier, at Ortigas Center.

At the same forum, Trade Secretary Gregory Domingo reported that his department established some 600 clusters of SMEs, like those in the coffee industry, in small communities last year, and plans to form 800 more this year.

Large enterprises can also lend their support to the SMEs by including them in their production chains for a more inclusive growth, said Habito.

He also advised SMEs to change their perspective on regional integration and see it as an opportunity to intensify intra-ASEAN trade and take a greater part in regional production networks or value chains.

He noted the increasing complementary nature of intra-regional trade and how the manufacture of intermediate goods in the ASEAN has ballooned in the last decade. This, he said, could lead to increased manufacturing activity between the Philippines and its ASEAN neighbors.

The upside of clustering and regional complementation is greater economies of scale, increased efficiency, and technology sharing, which all lead to higher productivity and lower unit costs, he explained.

A panelist at the forum, Sergio R. Ortiz-Luis Jr., honorary chair of the Philippine Chamber of Commerce and Industry, President and trustee for the resource-based sector of PHILEXPORT, voiced the concern of exporters that

quality and craftsmanship may not be sufficient to sustain Philippine exports because local products are more expensive than similar products being sold in the region.

He underlined the importance of a more immediate resolution to pressing issues such as MSME access to financing, corruption, poor infrastructure network, high energy cost, and insufficient export promotion funds, among others.

Citing a market research firm Euromonitor, the report said the market for single-serve coffee pods is pegged at $725 million a year in Canada, and is projected to grow to almost $1.8 billion in sales by end of 2017.

“Consumers gravitated to the single-serve format as it promised more convenience, improved consistency and fewer excess and wasted brews,” it said.

The report, also provided to the Philippine Exporters Confederation, Inc. (PHILEXPORT), noted that 73 percent of Canadians over the age of 16 consume on average two cups per day, and 63 percent of them brew their own coffee at home.

Apart from coffee, single-brew systems pertain to other beverages such as tea and cocoa.

MisOcc Water District prepares for contingency in case of El Niño OZAMIZ CITY, The Misamis Occidental Water District (MOWD) has laid out its contingency plan in preparation of El Niño.

The plan includes the designation of the Molicay Pumping Station in Barangay Molicay, this city, as its standby reserve station in case water will go scarce due to the phenomenon, Samson N. Naranjo, MOWD Executive Assistant B, said.

He said the expected long drought brought about

by El Niño may result in the decrease of water level, low water production, increase in water demand, salt water intrusion in pumping stations, and possible deterio-

ration of water quality.

He said the frequent power interruptions can also lead to increase in operational water production cost, thus, MOWD will make sure that there is enough supply of reserve diesel fuel for their electric generator sets to ensure an uninterrupted service.

Naranjo, however, said no reports of parched lands, dried up farms or scarcity of water in the households have been monitored and reported to MOWD, as of press time.

But just the same, MOWD will monitor closely the level of water extraction among its other stations, located in ba-

rangays Bacolod, Carangan and Bagakay, and its reservoirs in Barangay Segatic and Bukagan, Malaubang, he said.

Meanwhile, MOWD has planned to launch an information and education drive for the public on how to conserve water.

On the other hand, Naranjo assured that all the pumping stations of MOWD have been insured with the Government Service Insur-

ance System (GSIS) to warrant their immediate repairs in case of damage, if any.

The 4th Infantry (Diamond) Division of the Philippine Army based at Camp Evangelista, Patag, Cagayan de Oro City led the Brigada Eskwela held at Tablon Elementary School last May 19-24, 2014.

The different units under 4ID that include infantry brigades, infantry battalions and companies joined the activity since Tablon is part of their respective areas of operation.

Brigada Eskwela is a program of Department of Education that is held annually in preparation for the opening of classes. In this program, classrooms, school grounds and facilities are prepared and fixed. This is participated by teachers, parents and communities.
