MALAYBALAY City--The police may have used “unnecessary lethal force” in breaking up a barricade by farmers in Kidapawan City on April 1, the New York-based Human Rights Watch said in a press release Monday.

“The police used batons and guns against the protesters, including women and children, some of whom threw rocks at the police,” HRW said. “The Philippine government needs to determine why the police found it

necessary to fire at protesters,” the statement quoted Phelim Kine, deputy Asia director at HRW as saying. “Some protesters were throwing stones, but lethal force may only be used as a last resort to save lives.” See police, page A11

Regencia has been accused of masterminding the ambush on Representative Vicente Belmonte of the lone district of Iligan, last year, near the Laguindingan airport. Atty. Plando said the hearing set on Monday was for they petition for bail and arraignment, but the legal point of view on Regencia’s side is that the petition for bail can be heard even without the arraignment yet. “So, it is not necessary to bring Regencia to Initao court,” said Plando. Initao is s ome 43.5 kilometers away from this city or one hour and six minutes’ drive. Two other lawyers of Regencia proceeded to Initao cour t yesterday while the mayor’s supporters were barricading the premises of the Iligan City Jail. Vehicles, consisting of mini dump truck, pick-up and a bus, blocked the road leading to the city jail, which main entrance was also barricaded by the mayor’s supporters. Plando said they have filed administrative case against Judge Marisa Estabaya whose sala is handling the case against Regencia. The case is now pending with the Supreme Court. “Our three motions -- Motion for Judicial Determination of Probable Cause, Motion to Dismiss on the Ground of Lack of Jurisdiction and Motion for Voluntary Migration -- has all been dismissed by the court,” Plando said. “However, the sole motion of the other party to transfer Regencia from Iligan City Jail to the Provincial Jail in Cagayan de Oro,” Plando said. The provincial jail, according to Plando, has refused to accommodate Regencia due to over-capacity, besides Regencia’s being a high-profile case. “In fact, they filed a Motion for Intervention last April 7, but the judge denied it, saying the Provincial Government of Misamis Oriental has no business intervening with the judicial proceedings due to separation of co-equal branch of government,” Plando added. Edgar Daniel, Iligan chief of police said he has prepared, at least, 200 policemen to assist the BJMP in transporting Regencia to the court in Initao town. “We were directed by the court to assist the

BJMP in bringing Mayor Regencia to Initao that’s why we are here in the vicinity of the city jail. Monsignor Jemar Veracruz, a priest who is running for vice mayor for Iligan under Regencia’s political party, said they suspect that somebody in power would want Regencia out of Iligan City, so he will be forced to relinquish his position as mayor to his vice mayor who is an adversary. “We just want a fair trial for Mayor Regencia and this can come after the election. This will also lessen the brewing tension,” Noli Pardillo, campaign manager of Regencia’s Nationalist People’s Coalition party, said.

DAVAO City--In my sporadic camp sojourns in childhood, I knew foot soldiers as friendly just-adults who fashioned slingshots for me and taught me how to use them. Sometimes they rescued me when I couldn’t get down from the mango tree. They taught me how to make booby traps and chicken snare. They taught me how to hold a knife so nobody could take it away. They didn’t mind if I commandeered their hammock when I wanted to read a book out there where the breeze flirted against my skin. It was remarkable to me then how soldiers seemingly understood what I said no matter what dialect I used. They may not know grammatical English very well, but they could speak so many Filipino languages. It was in camps where the family visited our father that I discovered soldiers to be very good cooks, gardeners, and ditch diggers. It was a soldier who taught me to cook rice over wood fire. No task was too great or too small. A task was something that needed to get done, and done well. And perhaps this is why I have a soft spot for the foot soldier.

My husband, on the other hand, does not like me having a soft spot for any other male person, and especially those in combat fatigues whom in his youth he had come to recognize as those who sowed terror in his home. But sometimes he tolerates my fascination for the warrior psyche. I remember, for instance, him coming home one weekend to take me to see Fury, that WWII movie starring Brad Pitt that so realistically played out all that psychotrauma stuff that helped me earn my PhD in Clinical Psychology. He even brought extra hankies so I could, as expected, cry to my heart’s content. Fury must have inspired whoever micromanaged that Basilan operation that killed 20 of our soldiers and wounded 56 more. That may not be the final count as at the moment there’s a news blackout on the final count. Nevertheless, Fury must have inspired this notion that tanks are oblivious to enemy fire. So roll six of them into enemy territory and watch the enemy quail in his shoes. That must have been quite a sight, quite a sound. One could see, one could hear them coming from

three miles away. Enough time for the enemy to get the anti-tanks in place. Never mind. This operation could call in air assets if things got tight. Well, gee, the problem of our planes not having computerized guidance systems is that the Air Force would require a forward observer to call in the target location. And a forward observer can’t do that when he’s downed along with the rest of the infantry troops he was embedded with. Aha. Tank commanders never thought the enemy had armor-piercing stuff? Well, surprise! They had 10-hours’ worth of those. Ten hours. Enough to deliver mortal damage to six armored vehicles, mow down the troops where they stood, and send the ambushers crowing in triumph. No, said the Chief of Staff, Armed Forces of the Philippines. It was not an ambush. It was an encounter. Yep. One that started with an enemy explosion that immediately killed five of our soldiers. If that was not an ambush, I don’t know what is. Then there was close quarter fighting – like 10 meters apart. How the enemy could have crept up

that close to a phalanx that resembled a WWII convoy is anybody’s guess. Me, I’d wager it’s because WWII ended 71 years ago. Wardaddy’s enemies did not have portable anti-tanks and a selection of assault rifles at his disposal then. I was sitting at the back of the reception hall at the 2nd Scout Ranger Battalion headquarters in Barangay Tuban, Sta. Cruz close to noon on the Third Sunday of Easter when my phone started vibrating with the first anguished messages about the Basilan rout. We were capping our psychosocial support to the troops with a mass to heal their psyche and hopefully restore their peace with their God. At communion time, I surreptitiously read the texts, wondering why my phone was being so insistent on a Sunday. As the enormity of what was going down in Basilan dawned on me, I looked up at soldiers coming back to their seats from receiving the Holy Eucharist, and I couldn’t help thinking that they would soon be sent out there and maybe this is the last time I see some of them with their psychological balance restored, all of their body parts still where they should be.

PopCom Caraga conducts info caravan on wheels for teens BUTUAN City -- The Commission on Population (PopCom) Caraga spearheaded a series of Adolescent Health and Youth Development (AHYD) caravans in the cities of Surigao and Butuan for the religious organizations on March 22 and 28, respectively. Some 300 youth coming from the 25 different faithbased organizations of said cities were actively interact-

ing with enthusiasm in the caravan facilitated by the trained youth and population officers. Viewing of the short film produced by PopCom entitled #Desisyon, starring the writers-actors and students of Caraga Regional High School; U4U Teen Trail Facilitators’ Workshop and U4U Teen Trail were among the activities conducted during the caravan.

In U4U session, young participants journeyed through the exhibit to learn about puberty, self-image, relationships, preventing pregnancy and gender-based violence, and youth advocacy. Before this Court verified joint petition for the approval and registration of the Divorce filed by the petitioners and alleging among others. That petitioners are husband and wife respectively in a marriage performed under Muslim rites on August 25, 2001, they converted to Islam faith, of which conversions to Islam were duly registered with this court, both of them can be served with summons and other legal processes relative to this case at Malaybalay City, Bukidnon and Dalipuga, Iligan City respectively; That said marriage did not last long due to inability of petitioners to perform their respective essential marital obligations such as mutual fidelity, love, respect, support for each other, and irreconcilable differences, the petitioners only lived together for twelve (12) years now and they decided to part ways and still separated at the present, thereby, they executed Divorce Agreement in order to formalize their separation.Since their separation they had never been communicating or supporting either financially or emotionally to each other,neither minding each other affair’s; Petitioner’s seek judicial decree of divorce, thereby, severing their marriage bond on August 25, 2001 , so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them had already been diligently employed but all proved futile. WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on April 29, 2016 at 9:00 a.m at which time, date and place. Any interested party may appear and show why the petition should not be granted. Let copy of this Order be published in a news paper of General Circulation in the City of Iligan once a week for three (3) consecutive weeks at the expense of the petitioners. SO ORDERED. PAGADIAN City -- A total of 49 blood bags (22,050 cc) were collected from the blood donors during the blood drive conducted by the World Mission Society of Church of God (WMSCG) on Sunday at Gaisano Capital Mall here. Ahn Ji Man, overseer of the World Mission Society in his message said the blood drive is a simultaneous nationwide blood letting activity aimed to encourage people in the community to donate blood to help those who are in need of blood transfusion, ensure that the donated blood is safe, and more importantly, to save lives. Man said the blood drive is essential for our

physical and spiritual life. “Jesus Christ shared his blood and gave salvation through his love and Passover of the new covenant,” Man pointed out. He believes that there are still many people in this world who are suffering from shortage of blood due to lack of voluntary donors. “I am hopeful that that the blood drive will benefit those people who are in need of blood,” he said. Man considered the blood donors as heroes because they voluntarily donated their blood to people whom they do not know. “You are all our heroes,” Man declared adding that through their blood, they can save lives of others. Philippine Red Cross

administrator Hildaliza Munoz is optimistic that the activity can provide the blood needed in the province. “If we have enough supply of blood, there will be no more brothers and sisters who will die due to shortage of blood supply,” she added. Munoz lauded the WMSCG for conducting the activity saying that it provided help to the PRC in its campaign for voluntary blood donation. She said the blood that the WMSCG has donated to the PRC is a great help to their campaign. In a related development, Munoz said that the PRC, Zamboanga del Sur chapter is already a regional blood testing center where it has acquired blood bank facility that can

collect, process, and store blood components, platelet concentrate, packed red cells, among others. With the acquisition of this facility, Munoz said dengue patients who are required to undergo platelet transfusion will no longer be brought to neighboring hospitals since the center can already provide what the patients need. Man thanked the blood donors for actively supporting the activity and who have selflessly donated their blood. The activity was participated mostly by young adults, members of the Philippine Army, Philippine National Police, media practitioners, and other concerned individuals. Mis Occ CARP beneficiaries join people’s dialogue OROQUIETA CITY - More than one hundred agrarian reform beneficiaries (ARBs) from the different municipalities of Misamis Occidental attended the People’s Dialogue held recently at the Provincial Farmers Training Center, Capitol Compound, Oroquieta City. The People’s Dialogue was also attended by the beneficiaries of the different government coordinated programs like Pantawid Pamilyang Pilipino Program (4Ps) beneficiaries of DSWD, Barangay Health Workers of DOH, Handog Titulo beneficiaries of DENR. Several national government agency officials graced the event, including DAR Undersecretary for Foreign Assisted and Special Projects Herman Ongkiko, and DAR Region 10 Direc-

tor Faisar Mambuay. During the dialogue, each group of beneficiaries were given time to give their testimonies on how government programs benefited them. They were also given time to ask questions to the representatives of national agencies present during the dialogue on issues concerning them. Teresito Marata Sr. and Almer Galabin Sr., both ARBs and farmer leaders from Tangub City and Plaridel respectively, expressed gratitude for the CARP. “I was able to send my four children to college because of the program,” Marata said in his testimony. “Now, they are all gainfully employed with two of them working abroad,” he proudly added. For his part, Galabin recalled how the CARP had

afforded some 167 tenantfarmers of Mamanga Daku, Plaridel the biggest opportunity of their lifetime. About 139 hectares of agricultural land formerly owned by the Chiongbian family, owner of Virginia Farms Incorporated, was offered to sell to the government’s agrarian reform program for “one peso”, the cheapest landholding ever valued under CARP coverage. “As chairman of the ARB cooperative, I am very thankful for the various support services projects like farm to market roads, communal irrigation projects, potable water supply, livelihood projects and common service facilities (pre/post-harvest facilities) implemented by DAR and other CARP implementing

The Regional Development Council of Region X has unanimously passed a resolution endorsing and adopting the 1st Lumad Festival 2016. The RDC-X Full Council passed Resolution No. 11 series of 2016, “Endorsing and Adopting the 1st Lumad Festival 2016” during its 108th Full Council meeting held at Grand Caprice Restaurant and Convention Center, Cagayan de Oro City 12 April 2016. Initiated by BusinessWeek Mindanao last September 24, 2015 during the grand opening of the National Tourism Week held in SM City Cagayan de Oro, the festival aims to promote peace and cultural understanding by showcasing the various cultures and traditions of its indigenous peoples (IPs) or Lumads of Northern Mindanao’s provinces, cities and municipalities through a dance competition on September 23-24, 2016 in Cagayan de

Oro City “We anticipate around 40-50 contingents from the five provinces, nine cities and 84 municipalities to compete and showcase their cultures and traditions to an estimated 100,000 to 150,000 foreign and domestic tourists through street dancing and ground tableaux,” said Catalino L. Chan III, Region X Tourism Director in his presentation to the council. Earlier, the RDC-X Economic Development Committee during its 07 April 2016 meeting recommended the RDC its endorsement and support to encourage local government units to send their contingents to participate in the festival competition and for the region to adopt the Lumad Festival as an annual grand festival in Northern Mind-

Ensuring Bangsamoro peace process continuity duty of next Congress, says Ferrer CAGAYAN de Oro City -- Government of the Philippines (GPH) chief negotiator Professor Miriam Coronel-Ferrer believes it is the responsibility of would-be members of the next Congress to ensure the continuity of the Bangsamoro peace process by refiling and passing the stalled Bangsamoro Basic Law (BBL) while it was the responsibility of peace-loving voters to elect candidates who would do so. “[A]lam natin na yung ihahalal ngayon sa House of Representatives, sila ang kailangan nating manguna sa pagpapatuloy nitong BBL -- yung Bangsamoro Basic Law -- sa pag-aayos niyan at pagtitiyak na isang magandang batas ang mailabas natin (We know that those who will be elected to the House of Representatives, they are the ones who will lead the continuation of the BBL -- the Bangsamoro Basic Law -- its improvement, and ensuring that a meaningful law is passed), said Ferrer in a recent interview with a radio station in Cagayan de Oro city where she attended the Usapang Kapayapan: A Forum for Congressional Candidates. In behalf of the Peace and Development loving people of the Municipality of Tugaya, Lanao del Sur, would like to express their thanks and gratitude to the Office of the Ombudsman, Davao City, The National Bureau of Investigation (NBI-District Office, Iligan City) for conducting a through investigation of a Graft Case filed against the incumbent Municipal Officials of Tugaya, Lanao del Sur, under Ref. No. FF-M-14-0108. That recently, the Field Investigations Unit (FIU) of Ombudsman Mindanao, have strongly recommended the filing of appropriate criminal and administrative charges against Mayor ALBER NOROL PACALNA BALINDONG et al., in their information letter of March 28, 2016 as per attached copy, for ready reference, that make all our efforts for more than five years, almost a reality. Allow us to state in passing, that in response to the urgent needs of the constituents in the municipality, to have a safe drinking water system, the late Mayor ALIMATAR A.P.GUROALIM, then applied for a Water System Project amounting to 25-M, with the Local Water Utility Administration (LWUA) office, Quezon City, sometimes in 2009 and that the same was approved and released sometimes on January of 2011 under the adminstration of Mayor ALBER NOROL PACALNA BALINDONG, aware of the approval and subsequent released of the project fund, the people had been monitoring the immediate implementation of the priority project but no project could be found anywhere in the Municipality which prompted us to make a coordination with LWUA office in Quezon City, who intimated to us that per records a liquidation report was submitted and they could not confirm the correctness of the Report due to security reasons, the Commission on Audit (COA-ARMM) on the otherhand, informed us that a Liquidation Reports was submitted to their office which is now the subject of verification but no reports was submitted up to this writing. With these very discouraging informations we gathered from these offices, who are supposed to monitor project Implementations and protect the money of the government from misused, we then filed a formal complaint for Malversation of Pubic Fund against the Municipal officials of Tugaya, Lanao del Sur, with Office of the Ombudsman, Davao City, and asked the help of the Department of justice, Manila. That sometimes on November of 2014 and on the strength of a directives form the office of then SECRETARY LEILA DE LIMA of the Department of Justice, Manila, the National Bureau of Investigation (NBI-District Office) Iligan City, under the Team of ATTY ALEX T. CABORNAY, Head Agent, conducted the Fact Findings Investigation in the area and that sometimes on February 2015 a Fact Findings Investigation Reports was submitted to the Office of the Ombudsman, Davao City, confirming our complaint that indeed, the project is a non-existing Project or a Ghost Project. FINALLY, with the recommendation of the Field Investigations Unit of the Office of the Ombudsman, Davao City, for the filing of both Criminal and Administrative Charges against Mayor ALBER NOROL PACALNA BALINDONG et al., the good people of Tugaya, Lanao del Sur, urgently request the Hon. HOME schooling is a fast growing trend not just here in the Philippines but in other countries as well. So is this a good thing? Nobody knows exactly how many children are being educated at home because parents are not in any obligation to tell the Department of Education (DepEd). Pinning down the reasons for the rise is tricky though but parents have various motivations. There’s one parent that

I know saying that home schooling is advantageous for him because he can easily input more values education to his daughter as compared to potential bad influences that she can get from classmates and other peers. On the other hand, another parent argued that the current K to 12 curriculum is similar to curricula offered in home schooling. But the number one reason is that there aren’t enough special education campuses in the country to cater to children with special needs.

The rise of social media has also helped to alert parents to the possibility of home education and to provide support networks. Also, home education numbers may be rising in part because of low family income. Homeschooling, also known as home education, is the education of children inside the home as opposed to formal settings of a public or a private school. Home education is usually conducted by a parent or tutor.

An incongruous thought popped in my head: On the season that celebrates rebirth in faith, there can’t be prayers for the dead on the Sundays of Easter. Who will pray for the fallen? Can the prayers wait till Monday? At around 1pm, I called up Dr. Lolina Bajin, the resident psychologist of the Camp Navarro General Hospital in Zamboanga with whom I’d work for trauma event management of the Albarka incident that claimed 19 lives in October 2011. The good doctor was on leave and had no information of the work awaiting her return. When I told her it was 44IB that suffered the most casualties, she cried. I, too, do not know how Dr. Bajin sustains her passion and commitment in working with traumatized soldiers even as she has to handle the overwhelming task of assessment for recruitment and re-enlistment. Perhaps she too grew up to have good memories of the foot soldier. Or maybe working with soldiers has rubbed off on her that notion that tasks are stuff that had to get done, and done well. As the day progressed, more anguished messages came in, most from troops in the ZamBaSulTa area. Some were from friends and colleagues who are privy to my concern for the Filipino soldier. Even my mother, retired and barely managing to survive the heat wave in Iloilo, texted to say she was praying to my recently departed father to help the boys out there. The Chief of Staff, Armed Forces of the Philippines has some explaining to do. So does the wanna-be Chief of Staff, Armed Forces of the Philippines. You may be stuck in snarling traffic, but in your relaxed mind, you are in Camiguin swinging on a hammock, sipping iced tea. The same endorphines and happy hormones are released. Where the mind goes, the man follows. Studies suggest that meditation can help manage the symptoms of a variety of life-threatening conditions such as cancer, heart disease, high blood pressure, and pain. The relaxation effect from meditation improves heart rate, breathing, lowers blood pressure, and enhances our response to stress. Relaxation exercises can boost our natural killer cells, thus it strengthens our immune system and makes us more resistant to viruses. Meditation can lead to changes in brain patterns that promotes attention, learning and memory. It perks up optimism and positivity. That is the biggest benefit of meditation. It changes the way we approach our problems. Instead of responding with anger and cynicism, which makes our problems seem huge and overwhelming, we tackle our difficulties in a constructive and affirmative way. Problems are not obstacles to make us fall, but challenges to make us strong. Meditation sweeps out the cobwebs from our mind, and makes us see clearly the beauty of life. Our thoughts become gentle and radiant, after scrubbing off the junk of pessimism and negative thinking. Meditation and prayer come from the same vital force that move the universe. What we consider as trials, is actually God’s hand lovingly and wisely rearranging our lives.

Judge Rebecca Elena De Leon set the new hearing on Wednesday to allow the defense team to provide judicial affidavits of the social workers on the indigency of the accused and the attending physicians for those who moved for the transfer of hospital confinement, as well as original copies of the indigency and medical certificates. Lawyer Dionesio T. Alave, president of the Integrated Bar of the Philippines in North Cotabato, on Friday asked the court to reduce the bail for the provisional release of the farmers from P12,000 to P2,000. “As extremely poor farmers with very limited means, it is impossible for them to pay the full amount of their bond… The Provincial Social Welfare and Development Office can attest that they belong to the indigent sector of our society,” he said in the motion. Among the 79 farmers detained in Kidapawan Gym, Kidapawan Convention Hall, and Cotabato Provincial Jail in Brgy. Amas are a 78-year old grandmother and three pregnant women. Orlando Daño, district attorney of the Public Attorneys Office, argued that most of the farmers are not capable of paying the bail as they can even hardly afford to buy rice for themselves. “The accused belong to the farmers and lumads. They are hit so much by the El Niño that a mere statement that the rice would be given induced them to come out of their far-flung areas to Kidapawan City,” he said. The prosecution said they did not object to the motion to reduce the bail but the amount of P2,000 that the defense team sought the court to grant is too small and “might cause convenience and temptation on the part of the accused to ignore court processes resulting to

the delay of trial.” “We do not object as to the reduction of the bail… we are objecting to the amount of bail they are asking, considering the gravity of charges that we filed,” prosecution lawyer Eugene Seron told reporters after the hearing. He also said they wanted to ensure the appearance of the accused farmers in court as they live in the far-flung neighboring municipalities. There are a total of 79 farmers who are charged with illegal assembly and direct assault upon a person in authority. Although they are farmers, Seron said it was not clear how much they earn and if indeed they are incapable of paying the bail. “If the only basis is the allegation that they are extremely poor farmers, all of them through their counsel failed to attach evidences as proof of their income for a specified period of time, no affidavit to prove the authenticity of these… financial capacity is not the only consideration to grant reduction of bail,” the prosecution’s comment to the motion stated. Gregorio Andolana, representing the Diocese of Kidapawan and the Integrated Bar of the Phlippines’ Committee on Legal Aid here said the farmers should not be charged, in the first place, as they only exercised their constitutional right to peacefully assemble. “How can a 70-year old grandmother inflict harm?” he asked. He maintained that the motion be granted on the grounds of humanitarian considerations as he emphasized that setting a bail beyond their capacity to pay is also a deprivation to bail. “The government has all the resources, the government has also many recourses … the government is not short of any alternative,” he said in response to the prosecution’s manifestation that those who post bail may not appear in the hearings of the case. De Leon also requested the defense team to submit judicial affidavits from the Department of Social Welfare and Development (DSWD) 12 to back the certification of indigency of the farmers as proof of their incapability to pay the bail. Representatives from DSWD 12 who were present during the hearing manifested to comply with the affidavits on the same day. On the transfer of hospital confinement, Judge De Leon told the defense team to supply original copies of the medical certificates and judicial affidavits from doctors who attended to the accused victims. In a separation motion, accused Darwin Magyao and Alfie Awe, both confined at the Madonna General Hospital Inc., prayed that they would be allowed to transfer hospital confinement to Southern Philippines Medical Center in Davao City.

“Both accused are presently confined at the Madonna Medical Hospital in Kidapawan City, due to gunshot wounds they sustained. They need to undergo operation and further medical procedures,” the motion said. It added that the Madonna Medical Hospital already allowed their transfer but Judge De Mesa said motion must have a supporting medical certificates and judicial affidavits of the attending physicians. Police officials justified the use of firearms saying they received reports that some of the protesters who numbered around 5,000 were armed. However, the police have yet to show proof of such claim. Since March 28, the farmers had massed in Kidapawan to demand rice subsidy from the North Cotabato provincial government, as the dry spell had damaged their crops. On March 30, they blocked a portion of the Cotabato-Davao highway. Members of a Special Weapons and Tactics unit were then sent to deal with the protesters resulting in a violent dispersal that left two farmers killed and scores of others injured. Police said dozens of their officers were also hurt.
