Duterte and Death Penalty

D

avao City Mayor Rodrigo Duterte never minces words when it comes to his stand in imposing death penalty on criminals convicted of drug trafficking, kidnapping and rape.

We cannot blame Duterte from his rigid position on the imposition of the maximum penalty because we have seen how crimes and criminality proliferate in our country and how these threaten every individual, every home, every family and every community.

Against the stand of the Catholic church, Amnesty International, human rights advocates and even on some officials in our government, Mayor Duterte passionately argues and defends his proposition to re-impose death penalty not only as deterrent but also to eliminate perpetrators of these heinous crimes.

Duterte makes it clear that he values life and that he will come in the way of those who will attempt at snuffing the life of the innocent. For Duterte, members of the drug and

kidnapping syndicates and rapists have very little rights at all. They have to be dealt with severely.

Duterte laments that convicted drug lords and drug pushers live in luxury inside the New Bilibid Prisons. They not only enjoy all the amenities that they have in liberty, but they also continue to ply their illegal trade in prison cells, managing the distribution of drugs via remote control and maintaining their hold on their syndicates.

Duterte warned that most of the victims are young children. He said that once they are into illegal drugs like shabu, you lost your children for they will forever be dependent on the drug. He said, that the lifting of death penalty in the country has encouraged foreign nationals to come to the Philippines and

set up shabu laboratories and establish distribution network not only within our shores but elsewhere.

They ought to be stopped and completely annihilated and one of the means is the reimposition of the death penalty.

Mayor Duterte also insists that the maximum penalty of death should be imposed on kidnappers because experience has it that many of the victims are either killed or if freed, had become in constant fear and trauma because of threats from the perpetrators who make kidnapping a cottage industry.

The rapists for Duterte are of equal footing with drug pushers and kidnappers because either they kill their victims or they destroy the life of their victims just the same.

Duterte makes no qualms about how he deals with criminals in Davao City.

The heinous crime offenders have to be eliminated. If the fight will be within the bounds of the law, convicted drug traffickers, kidnappers and rapists should be sentenced to death by hanging.

It should be by hanging because the electric chair , gas chamber and firing squad is just too expensive for these types of criminals.

The Davao City Mayor also lambasts former Sen. Kiko Pangilinan for his Juvenile Delinquency Law which he said is the prime motivation for the minors to engage in criminal activities. Pangilinan should be blamed for the rise in numbers of youngsters involved in crime.

Since the imposition of the Pangilinan Law, children

below 18 years of age cannot be held accountable for their crime and therefore are freed within 24 hours from the moment the commit crime. How can one discipline these so-called child offenders if there is no modicum of penalty that will be imposed on them.

In Davao City, there are rehabilitation centers established by the local government. This is because the city government can afford it. But what of the other local government units who can barely afford building and operating rehabilitation centers?, Duterte asked.

He said Pangilinan compounded the problem because he did not provide a single centavo for rehabilitation program of the youth offender. So what happens, Duterte said, is that child offenders are let loose in

the streets prompting them to commit one crime after knowing fully well that they are protected by the Pangilinan Law. Duterte said that if he is President of the country, he will have the Pangilinan Law abolished immediately as it was abolished by the State of New York from where Pangilinan copied it after finding out that it abetted criminality among the young offenders.

As President, he said, he will have Death Penalty restored. Well said and the people believe him. The problem here is that he has to be President first.

Now if you value security, love your family, your freedom from threats from criminals then you have to convince Duterte to run for the Presidency. That’s all there is to it.

Would Pnoy’s rating bounce back?

Liberal Party Secretary General Mel Senen Sarmiento said this week that President Aquino’s fall in his net satisfaction rating is only temporary and should be expected to bounce back with the full disclosure of what really happened in the Mamasapano raid which caused the death of 67 people, 44 of them members of the elite Philippine National PoliceSpecial Action Force (PNP-SAF).

Granting that the political opposition has somehow managed to manipulate the Mamasapano issue to pin down president Aquino, allegedly on the basis of mere speculations and one-sided accounts, will the electorate be convinced?

There may be vindication of President Aquino with the findings that he had no hand in the planning and the execution of the Mamasapano raid dubbed OPLAN EXODUS. But would it boost his net satisfaction rating, which plunged anew from +34 during the 4th quarter of 2014 to +19 (percent satisfied minus percent dissatisfied) as per Social Weather Station (SWS)?

The hot issue for this week is print advertisement of the Bureau of Internal Revenue (BIR) painting a sweeping picture of doctors as filthyrich, greedy people and tax evaders.

“We at the PMA, as productive members of the Filipino society, have been working hand in hand with the BIR towards the achievement of this goal.

The newspaper advertisement came as a surprise to us mainly because it was not discussed in our various consultations and joints information campaign activities with the BIR” he said.

Doctors were trained and duty bound to render a very noble service to our beloved countrymen. This involves protecting their health and saving their very lives.”

The problem with some government officials in the Philippines is that they feel more like kings and queens rather than public servants.

Their argument – why complain? If the doctors do not evade taxes, they have no reason to be hurt by the advertisement. That is an argument of an arguer without really arguing anything substantial.

Article 26 of the Civil Code provides that “every person shall respect the dignity, personality, privacy and peace of mind of his neighbors and other persons.” That is the law and government officials are not exempted from observing it. They are not above the law.

Article 19 says that “every person must, in the exercise of his rights and in the performance of his duties, act with justice, give everyone his due, and observe honesty and good faith.” And finally, Article 20 mandates that “every person who, contrary to law, wilfully or negligently causes damage to another, shall indemnify the latter for the same.”

MANOLO Fortich, Bukidnon—Hedcor, Inc., the wholly-owned AboitizPower subsidiary that specializes in generating “Cleanergy” from run-of-river hydropower systems, will “more than double” its installed capacity in Mindanao once its two power plants in this municipality go online in 2016.

Hedcor is currently constructing two cascading plants in this municipality known to be the home of the first pineapple plantation in the far east: the 43.4 MW Manolo Fortich Hydro 1 and the 25.4 MW Manolo Fortich Hydro 2.

Groundbreaking ceremony for these plants was held on April 22.

Once this goes online, we will more than double our installed capacity in Mindanao in 2016,” said Rene B. Ronquillo, Hedcor president and COO. Once they go online, the Manolo Fortich hydropower plants will bring Hedcor’s total installed capacity in Mindanao to 129.7 MWs. At present, Hedcor’s total installed capacity in Mindanao is 60.97 MW. Hedcor’s present Mindanao hydropower plants are the Tudaya Hydro 1 (6.6 MW) and Tudaya Hydro 2 (7 MW) in Davao del Sur and Davao City; Sibulan Hydro A (16.50 MW), Sibulan Hydro B (26 MW) in Sta. Cruz, Davoa del Sur; Talomo Hydro 1 (1 MW) in Calinan, Davao City; Talomo Hydro 2A (.65 MW) and Talomo Hydro 2b (.30 MW), Talomo Hydro 2 (.60 MW) in Mintal; and Talomo Hydro 3 (1.92

MW) in Catalunan Pequeno, Davao City.

Aside from doubling its capacity in Mindanao, the Manolo Fortich plants will add to the total energy mix in Mindanao and help “lighten” the so-called Mindanao power crisis the island has been experiencing during summer since 2010.

“With the incoming coal plants of AboitizPower Corp. and other developers, Mindanao should be okay as far as base load is concerned two to three years from now,” Ronquillo told this paper.

Ronquillo explained that while coal plants are reliable base load plants, especially during the summer months in Mindanao when rivers and dams usually dry up due to the heat (drought) of El Nino, they are still unreliable in the long run because of the volatile prices of coal in the international market. “Indigenous See capacity, page A11

Climaco stands firm Justice for Zamboanga City ZAMBOANGA City -- In the recent plea bargaining proposal for accused MNLF members accused in the September 2013 Zamboanga Siege, City Mayor Beng Climaco defends the City’s stand and clamors for JUSTICE! On April 22, 2015, members of the Panel of Special Prosecutors from the Department of Justice met with City Mayor Beng Climaco and the City Legal Team to discuss recent developments of the cases entitled People of the Philippines versus Chairman Nurulaji Misuari, et.al., where the accused proposed to plead guilty to lesser crimes.

The chief executive’s initial reaction was to outrightly reject the plea bargaining proposal, but later reiterated the need to act intelligently and utmost prudence.

Relative to this development, the Mayor restated the continued clamor of the City for justice commensurate to the damages and trauma caused by the siege which killed 38 security forces and civilians, wounded 266, and displaced 22,196 families.

Under the People of the Philippines versus Chairman Nurulaji Misuari, et.al. case, the accused are facing

charges of Rebellion and violation of the International Humanitarian Law (IHL) which carries a penalty of reclusion perpetua.

The accused are proposing to plead guilty to a lesser crime of Sedition which carries with it a penalty of 6 years imprisonment.

Also, about 145 accused, represented by the Public Attorney’s Office (PAO) of the Pasig City District Office, are offering to plead guilty to a lesser crime of Illegal Assembly which carries a penalty of 1 month and 1 day to 6 months imprisonment; and illegal use of uniform which carries a penalty of 1 month and 1 day to 6 months imprisonment.

“I pose this question to all: Are the terms of the foregoing plea bargaining proposals of the accused commensurate to serve justice to our fallen heroes, the people of the City of Zamboanga?” said Climaco.

Added to this, Climaco holds the MNLF accountable for the 242 deaths in evacuation centers after the siege.

“I shall ensure that justice shall be given to the people of Zamboanga who are victims of the September 2013 siege,” the Mayor declared.

“In Aboitiz, we believe that the best strategy in moving forward would be through the power energy mix. That’s why aside from the coal plants that we have in Mindanao now, we are also developing more hydro and also looking at geothermal plants in other parts of Mindanao,” Ronquillo said.

Customs bureau cancels bidding of P70m worth of smuggled rice

CAGAYAN de Oro City-The Bureau of Customs (BOC) in Northern Mindanao cancelled on Wednesday morning (April 22) the scheduled bidding of the P70-million worth of smuggled rice.

Atty. Roswald Joseph J. Pague, acting chief of the administrative division of BOC-10, said the agency has to cancel the bidding after no bidders submitted bids on Wednesday for the bags of rice placed in 65 containers.

Pague cannot exactly tell when the exact date for the auction of seized smuggled rice but said the original prices will be reduced by 10 to 20 percent in the next auction.

Edwin Dael, was widely credited for making Iponan River clean again the past 20 months, making it possible for residents to bathe and do their laundry there.

For several decades now, Iponan River’s color in the mouth has been noticeably brown due largely to illegal hydraulic mining occurring there.

But Clenro data showed that the total suspended solids in the river was

significantly reduced from 2013 levels of 300 parts per million (ppm) to only 8 ppm as of March 2015.

Since June 2013 when Mayor Oscar Moreno took over, Clenro has b een arresting illegal mining suspects in the city and taking them on in the city prosecutor’s office.

“For an entire generation, children in the riverbank have been deprived of their playground. For an entire generation, children were made to believe that a chocolate river looks normal,” Moreno said Saturday during the simultaneous release of 92,000 tilapia fingerlings, a first for Iponan River. “We must all

be on guard to ensure that our river will remain to be this clean and useful for the next generations.”

City information officer Maricel Rivera for her part said that a few months from now, the public would expect a bloom of tilapia and other freshwater fauna in the river.

But Councilor President Elipe is not impressed with Dael and Moreno’s pronouncements.

“Ngano angkonon man nila nga sila ang nakapatin-aw sa suba when the water at its source in barangay Pagalungan is already clear. It is obvious that the downstream part is clear as well,” Elipe said.

ORE than a dozen young ladies who intend to join beauty pageants in the near future underwent a whole-day summer beauty camp last Wednesday at the City Hall bridgeway – a first for the City of Golden Friendship.

The project, spearheaded by the Miss Cagayan de Oro committee, JCI Bai Lawanen, Inc. and JCI Sen. Gigi Go, was meant to upgrade the quality of beauties that Cagayan de Oro would field in national competitions starting this year and beyond.

The following were the resource lecturers in the clinic and their respective topics: Pageantry 101 (Gean Cesar), Basic Runway Coaching (Dennis Almazaan), Choosing the Right Evening Gown (Joshua Guibone), Grooming and Styling (Zoe Botwin) and Shine in Photoshoots (Dense Modesto).

After the clinic, the ladies are now ready to face their dreams to represent the city one day in beauty contests here and abroad.
