SPURNED by the Supreme Court, enraged petitioners against the K to 12 program have vowed to continue resisting the government program until it is scrapped. The high court dismissed all six petitions calling for a stop to the implementation of K to 12, as announced by SC Public Information Office Chief, lawyer Theodore Te on Tuesday, March 15. “The Court denied the prayer for the issuance of a temporary restraining order and or writ of preliminary injunction,” said Te. The Suspend K to 12 Alliance was “saddened” by the SC decision, and said “people power is the only recourse against the K to 12.” “We have tried our best to convince the Supreme Court with volumes of documents that prove the unconstitutionality of K to

12, yet our petitions for a TRO have been denied,” the group said in a statement. They call on students, teachers, parents and concerned citizens to collectively “carry on with the fight against this anti-Filipino, Labor Export Policy-obsessed, anti-teacher and anti-student education scheme.” The petitioners against K to 12 assert that the government is not ready in implementing the flagship program in education of the Aquino administration. Another petitioner, Kabataan Partylist Rep. Concerned citizens, resort owners ask SC to stop PHP18B Sasa port project DAVAO City) -- Two members of the City Council, Peter Laviña, two more concerned citizens and the Samal City Resort Owners Association, Inc (SCROA) asked the Supreme Court to issue a Writ of Kalikasan to stop the Department of Transportation and Communications (DOTC) from implementing the PHP18.9billion project to modernize the Sasa Port here. Councilor Pilar Braga, Diosdado Mahipus, Laviña, Antonio Vergara, Benjie Badal and SCROA represented by lawyers Harry Roque and Roger Rayel, filed the urgent petition for writ of continuing mandamus/writ of Kalikasan with prayer for Temporary Environmental Protection Order (TEPO) to the SC alleging that the project was overpriced. Roque said the project is overpriced and being rushed by the government during the election season.

The petitioners also said the DOTC did not secure an environment clearance certificate and did not consult with affected communities. Sasa Port is a government operated port terminal with a total area of 18.09 hectares. The facility handles mainly container cargo, some general and break bulk cargo and small number of passengers. The Sasa port modernization project is a project enrolled under the Public Private Partnership (PPP). DOTC has invited bidders to finance, design, construct, operate and maintain the Sasa Port project. Majority of the councilors voted for the resolution rejecting the project believing that there was violation of Section 2 and 27 of the Local Government Code requiring consultation and prior approval from the City Council before proceeding with any national See project, page A11

Davao marginalized sector formally endorses Duterte for president By Lilian C. Mellejor of PNA

DAVAO City -- Almost a hundred members of the Association of Differently-Abled Persons (ADAP) gathered at Rizal Park here on Monday morning to formally endorse Mayor Rodrigo Duterte as their bet for president in the May 9 elections. In wheelchairs and canes with some of them coming with their guides and parents, the people with disabilities braved the busy streets and the heat of the sun to join others and let their voices be heard. Some of them even came from Davao del Norte, Davao Oriental, Region 10, Compostela Valley and Davao del Sur. The PWD is the most marginalized sector of society. Her voice could not be heard but Jolly Rose, a leader of the deaf mute sector, displayed strong commitment to support Duterte. In

sign language interpreted by Darlito Palemo, NAPC (National Anti-Poverty Commission) XI leader for persons with disabilities sector, she urged people to give their votes and support to Duterte while pointing to her Duterte-Cayetano baller. The visually impaired led by Elmar Olivar committed solid support for Duterte. “Mao lang ni atong tsansa mo-suporta niya, dili nato kini sayangan (This is our only chance to support him, we must not waste this),” Olivar said. On the other hand, Palemo, who came in wheelchair, was strong enough in pushing the candidacy of Duterte even if it means resigning from his job at NAPC, the front line office on poverty alleviation under the Office of the President. Palermo, who is an Apolinario Mabini awardee, said there is no other mayor who has given them equal access to every opportunity. ADAP is the country’s

biggest among Persons with Disabilities (PWD) organizations in terms of membership. The members of ADAP, which was established in Davao in 1993, have been beneficiaries of Duterte’s housing program. About 30-50 families were given houses in ADAP village in Los Amigos. The families were also provided with livelihood opportunities such as the rice selling store and arm chair making for the Department of Education (DepEd) and the Department of Labor and Employment (DOLE) project. Naprey Almario, the newly-elected president of ADAP, said another village is being put up by Duterte in the third district. Almario said PWDs were also given opportunities to work as job orders of the city government which initially hired 50 PWDs as moviehouse ticket checkers under the City Treasurer’s Office. This way the city

was able to collect correct business taxes from moviehouse operators. Most of all, PWDs, Almario said have so much to thank for when Duterte caused the passage of the Anti-Discrimination Ordinance of the city because it has opened more opportunities for them. Almario said they have been empowered. In fact, Almario said some of them have ventured into other work and business. ADAP was also provided by Duterte an office space at the Sangguniang Panlungsod building for free. “Whenever we have a campaign we always get the full support of the city government,” said Almario, adding, “how can we forget the yearly gift giving events of the mayor for the PWDs during Christmas. “We have so many stories to tell in our individual encounters with Mayor Duterte,” Almario said. Lavina, head of the Team Duterte’s media group, said the rally is projected to be the biggest political event in the history of the city, as he encouraged the

Dabawenyos to come out and join in the rally to support Duterte’s candidacy. In a text message to MindaNews, Rocky Balili, a political leader and member of the Run Rodrigo Duterte and Duterte Diehard Supporter (DDS)-Davao Region, said an estimated crowd of 35,000, including contingents coming from outside the city, will join the rally. March 16 also marked the 79th founding anniversary

of Davao City. This will be the first time that Duterte will hold a rally in the city after the official start of the election campaign for national officials last February 9 where he held his opening salvo in Tondo, Manila simultaneous with provincial rallies nationwide. Right of Reply must expand freedom of expression THE Right of Reply should expand the freedom of expression in the country. It is true, the Right of Reply defends the people’s rights, reputation, honor and integrity against attack by the media. But equal opportunity must be given to those persons affected by the actions, statements, rumors and other mischievous statements of the media. But we should see to it that the right of reply bill does not curtail nor trample the freedom of expression. Since the exercise of freedom of expression, is not a monopoly of the media, the law should also encourage interactions through journalistic expressions, the ideas, answers and stands of all sectors not connected with media, on issues at hand. Newspapers just publish both sides, and broadcast media must also air both sides. The freedom of expression as enshrined in the 1987 Constitution pertains to the right of every Filipino to express his or her opinion in whatever form or format or in any forum.

Media should also exercise caution and practice responsible journalism in all aspects whether in print media, broadcast media or by electronic format. Sereno’s Warped Logic

GENERAL Santos City-Who taught Chief Justice Lourdes Sereno “Logic” and “Argumentation and Debate”? She has warped logic in her response to the criticisms by critics and legal experts that the Supreme Court ruling to allow Sen. Grace Poe to run for president is unconstitutional (The Daily Tribune, March 11, 2016: Sereno: Judge after reading opinions). Last Tuesday, March 8, the Court announced it had voted 9-6 to allow Poe to run for president without releasing its “Decision” — together with the concurring and dissenting opinions — reversing the decision of the Commission on Elections canceling Poe’s certificate of candidacy. As quoted in the national media on line, the court spokesman Theodore Te said: “I am authorized to say that there will be four concurring opinions to the Majority Decision, and five dissenting opinions. Please note that since the Court has only authorized the release of the vote, it may not be safe to report which ground the Court ruled upon and used as basis for the vote, i.e., between citizenship and residence. Thus, it may be best to simply say, ‘the SC grants Senator Poe’s petitions, 9-6,’ allowing her to run for the presidency.” He said a final copy of the majority opinion will be forthcoming in the next few days. In The Daily Tribune cited above, “Sereno appealed for pa-

tience in the release of the main decision and the accompanying concurring and dissenting opinions on the Poe cases”. Should Sereno fault the critics and legal experts? Without the “Decision” and the concurring and dissenting opinions, they can only judge the 9-6 voting according to their clear reading of the Constitution on citizenship and the facts and circumstances pertaining to Poe’s residency. The President, in the last two days, was reported to be confused and of urging the Court to clarify the issue on Poe’s citizenship. Yet, in The Daily Tribune report, this was exactly what Sereno did – fault the critics and legal experts. Referring to the yet-tobe released “decision and opinions”, the Tribune report quoted her as telling reporters: “Why don’t you read them and decide for yourselves. I don’t want to say that we are very clear, or what, because that is a matter that is best left to the reader. And you are going to be the readers of this soon-to-be released decision and opinions.” She was really addressing the critics, legal experts and the President. Why did she allow the announcement of the 9-6 without the “Decision” and the opinions of the justices? And now she is faulting the critics and legal experts – also the President for being confused – for not judging the 9-6 vote according the “soon-to-be-released decision and opinions”. If that is not warped log-

ic, Mr. Webster should change the meaning of “warped”. Incidentally, Sereno is just being consistent. One fundamental rule in argumentation is: “Argue according to the issue.” At issue in the cancellation of Poe’s COC is her status as a natural-born citizen due to her being a foundling. On this issue, there is no room under the strict constitutional provisions and doctrine for Poe to be a natural-born Filipino citizen unless she can positively prove – e.g., by DNA test – her biological father or mother is a natural-born Filipino citizen. So, Sereno changed the issue to the grave injustice on thousands of foundlings in the Philippines should Poe not be allowed to run for president. Two or three other justices followed her argument – the same emotional appeal of Poe to the media. As the saying goes, if you cannot solve a test probl e m , ch ange t he problem. Obviously in sympathy for Poe, Sereno changed the issue in order to win her argument to have Poe qualify to run for president not as a natural-born Filipino citizen but as a foundling representing the thousands of foundlings and their rights. *** (Author’s Note: Mind da News, the alternate of COMMENT, is a comment on current news. CAGAYAN de Oro City -Thirteen agrarian reform beneficiary organizations (ARBOs) from Caraga received recognition for good performance as borrowers of the Agrarian Production Credit Program (APCP) of the Department of Agrarian Reform (DAR), Department of Agriculture (DA) and Land Bank of the Philippines. The recognition was handed by DA Secretary Proceso Alcala, DAR Undersecretary Rosalina Bistoyong and Landbank Board Member Gerardo Bulatao during the 2nd National Agro-Fisheries Credit Program Assessment and Planning Workshop held here last March 9-10, 2016. According to DAR-13 Regional Director Julita Ragandang, the farmers organizations were able to achieve 100 percent

repayment of their loans. “This means, the farmers are doing well and the program works to their advantage,” she added. “The APCP is a very helpful program because this gives us farmers access to credit which we cannot access in the regular credit windows of the banks,” says Winefredo Maldos, chairman of the Baleguian Organic Farmers Irrigators Association (BOFIA) of Jabonga, Agusan del Norte. PhilRice promotes agriculture in senior high THE Philippine Rice Research Institute (PhilRice) in Midsayap, North Cotabato has signed a Memorandum of Understanding (MOU) with Midsayap-Dilangalen National High School (MDNHS) to promote agriculture to senior high school students, 8 February. Effective this year, senior high school students of MDNHS will undergo an immersion-training program under the crop production curriculum. PhilRice Midsayap will provide technical assistance through lectures and hands-on activities on crop production. “We want the students to have a deeper interest in agriculture. This will also serve as their training ground in actual office and technical operations to strengthen their formal learning,” said Melda C. Villora, school principal. The said program will be part of the students’ requirements prior to graduation. As trainees, the students will have access to various rice production and management facilities at the PhilRice Midsayap station. “This partnership can boost the number of students who will be interested to take up agriculture courses,” said Dr. Sailila E. The Catholic Church through the Caritas confederation has already reached out to 1.8 million people affected by Yolanda, and managed a total of P3.2 billion over the last two years. It can be recalled that the recent encyclical of Pope Francis, Laudato Si, highlighted the adverse impacts of climate change on the poor and most vulnerable, and the scale of the climate crisis.(PNA)

THE warming of Earth may not have directly caused all of the extreme weather events that have taken place in the past two decades, but climate change has in some way had an impact on them, a new report showed. A 10-person committee of the US National Research Council has issued a report that examined the influence of humans on recent extreme weather events. Though the committee stopped short of saying that climate change is causing more frequent and severe events -- a link difficult to prove in a short timeframe -- the connection, it acknowledges, is unmistakable. “Scientists used to say that we can’t attribute any one event to climate change,” said Philip Mote, an Oregon State University (OSU) climatologist and co-author on the report. “But that is a copout. Every extreme weather event has the fingerprint of climate change. The question is not whether global warming caused Hurricane Sandy; but rather how much stronger it was because of global warming.” “There is little doubt that Hurricane Sandy would have had less impact without climate change,” Mote said. The committee issued its report on Friday in the National Academies Press, published by the National Academies of Science, Engineering and Medicine. David W. Titley, who chaired the Committee of Extreme Weather Events and Climate Change Attribution, noted in the report’s preface that “the consequences of

this change to the climate are seemingly everywhere: average temperatures are rising, precipitation patterns are changing, ice sheets are melting and sea levels are rising.” Despite progress on understanding these changes, scientists are trying many different approaches to understanding the causes of extreme events. Since 2012, the number of research groups issuing studies on the attribution of extreme weather events has exploded, shedding new light on the external “forcing” mechanisms of events and how they are similar or different from other events. “The clearest tie between climate change and weather is in heat-related events,” said Mote, who wrote the sections on heat and drought in the report. “Droughts are getting worse and some aspect of every major heat-related event is stronger today because of climate change. In fact, most types of extreme events are getting stronger or more frequent, except those related to cold events, which are weaker or less frequent.” A warming planet does not affect every region uniformly, he added, nor does it make every season warmer than average. The three US west coast states -- California, Oregon and Washington -- experienced major drought in 2014-15. “I’m frequently asked if we can expect more of the same in the future for the See signal, page A11

CEB launches maiden flight to Guam, USA 15 March 2016 -- The Philippines’ leading carrier, Cebu Pacific (PSE: CEB), launched four times weekly flights between Manila and Guam, its first US destination, today. CEB is the only lowcost carrier flying directly between the Philippines and Guam. He said his group was supposed to present the new data they culled that shows that in the National Capital Region (NCR) alone, only 22 percent of public schools offer senior high school. San Juan said cited the Department of Education (DepEd) estimate that some 500,000 public school students will be forced to transfer to “forprofit” private schools due to lack of ample public senior high schools. He said these students will be burdened with additional expenses, as the government voucher cannot cover the total amount of tuition. “This is a violation of the right to free secondary education,” San Juan said. He added that “tens of thousands of part-time professors will be out of work.” “Di n’yo po ba nakikita na nagkakagulo na?” (Can you not see the disorder) San Juan said to the justices. Antonio Tinio, one of the main petitioners urged the Supreme Court “to reconsider its stance and to summon petitioners and respondents in oral argument sessions, so as to expose the unconstitutionality of the K to 12 Program which violates the people’s right to free education, teachers’ right to security of tenure, and the constitutional provisions on nationalism as a core foundation of education.” National Artist for Literature Bienvenido Lumbera, another lead petitioner also remarked that the SC’s decision “will negatively affect the molding of nationalist and socially-conscious citizens of the Philippines, as K to 12 abolished Philippine History in high school, and Filipino, Literature and Philippine Government & Constitution in college.” Lumbera expressed hope that “the Supreme Court will be persuaded to revise its stance, once the voices of those who will be affected by K to 12 are heard in oral arguments sessions.” For its part, the Suspend K to 12 Alliance “vowed to conduct more forums and assemblies to help expose the ill effects of K to 12, and carry on with the struggle for its suspension or junking.” Sure profits Meanwhile, Ridon said with the SC decision, the private school owners are now guaranteed of their profits. “Today, private school owners might be laughing, as their income from the government’s billion-peso voucher program has also been assured,” said Ridon referring to the P21.2 billion ($451 million) allocation for the Government Assistance to Students and Teachers in Private Education (GASTPE) and the Senior High School (SHS) Voucher Program. Ridon had assailed how portions of the basic education budget for 2016 are allotted for “sure profits” of private schools. “The Aquino administration has continually increased funding for GASTPE, which is essentially a budget for direct profits of private schools, yet this fund is not even audited

by the Commission on Audit (COA),” Ridon said. Ridon questioned the over 150 percent increase in funding for GASTPE despite the fact that said fund is “far from being transparent.” He cited a Commission on Audit 2013 audit report which questioned how DepEd disburses payments to the Private Education Assistance Committee (PEAC) as “subsidy to non-government organization” despite the lack of a detailed accounting report from PEAC. “In essence, DepEd is engaging the services of a private entity without complying with procurement rules,” Ridon said. COA also questioned PEAC’s non-submission of the list of grantees for the Educational Service Contracting (ESC) component of GASTPE and the school address where the grantees are enrolled. Ridon said that under such “shady” mechanism, it is easy for schools to pad and fake its list of beneficiaries to accumulate more profits. Ridon said under the Aquino administration, the government has already allotted P38.8 billion ($812 million) for GASTPE, from 2010 to 2015.
