THE Department of Education (DepEd) is more than ready to welcome students this June 2 even if some classes would just be conducted in temporary learning spaces in typhoonravaged areas. “We are very, very ready. If we are able to reopen schools as early as December (2013) and January 6 we are more than ready for June 2. MARAWI City––Government troops are still tracking down the suspects who ambushed a prosecutor and his driver before noon time on Monday in Barangay Marawi City. Sr. Supt. Nickson B. at around 11:45 in the morning on May 19. He said Alawi’s driver, Mr. Saiben Doron Baiza, 46, also sustained multiple

gunshot wound on his back and upper face. Police investigators were able to recover empty shells from .45 and 9mm pistols at the crime scene. Government authorities are now conducting thorough probe to unmask and arrest the suspects behind Monday’s ambush slay of a prosecutor in Marawi City, an official disclosed, the Philippine News Agency reported. The police and military authorities are now looking into all possible motives, said Army’s 1st Infantry Division Public Affairs officer-in-charge Capt. Franco Suelto.

CA refuses to allow Napoles to go on bail THE Court of Appeals (CA) has refused to allow businesswoman Janet Lim Napoles to go on bail. Napoles is the alleged “brains” behind the P10billion pork barrel and the P900-million Malampaya Fund scams. This, after the CA did not stop the Makati City Regional Trial Court (RTC) with the plea of Napoles to allow her to post bail in the serious illegal detention case filed against her for allegedly abducting Benhur Luy. In a two-page resolution of the CA Special 7th Division, it instead ordered Makati City RTC Branch 150 Presiding Judge Elmo Alameda and whistleblower Luy to submit their explanation in the petition for certiorari filed by Napoles on April 10, 2014. MISAMIS Occidental––Elements of the 55th Infantry Battalion, 1st Infantry (TABAK) Division, Philippine Army, under Lt. Col. Gerry Besana, commanding officer, figured in an encounter while on routine community security patrol against some 30 New People’s Army (NPAs) of the local NPA group Section Committee “Sendong” at vicinity of the boundaries of Sitio Katulungan Dako, Barangay Carmen, Jimenez, and Barangay San Lorenzo, Sinacaban, Misamis Occidental, Sunday, around 9:00 in the morning. One rebel was killed and one M-16 rifle was recovered.

(One way of taking care of your [farmers] road so that it will last long is to cut the grass if it reaches the road and see to it that there’s no water stuck in drainages or canals that could ruin the road),”Paulican said. Engr. Paulican also said that he had talked with Mayor Panulaya about a water fall in Barangay Dahilig that could possibly be turned into a tourist site. He added that the Department of Tourism (DOT) won’t have a hard time funding the additional road going to the falls since there is already an existing road. National school feeding program for preschool, elementary public school children nears Committee approval MISAMIS ORIENTAL - A Misamis Oriental legislator’s proposal to institutionalize a national school feeding program for public pre-school and elementary school children is nearing approval by the House Committee on Basic Education and Culture of the 16th Congress. “The technical working group (TWG) of the said Committee has come up with a draft consolidated bill that took into consideration our House Bill 1548 titled ‘An Act Providing For A Mandatory National Child Nutrition Program In All Public Elementary Schools And Barangay Day Care Centers.’ With the impending committee approval, the said consolidated bill titled ‘National School Feeding Program Act’ will go to plenary for second reading and eventual approval of Congress,” Misamis Oriental second district Rep. Juliette Uy said. “In recent years, the feeding programs in public schools were implemented only for a limited duration and in select areas. With this measure, the National School Feeding Program (NFSP) will be gradually implemented in all public schools in the

country," Rep. Uy said. The feeding program shall be implemented in all public schools throughout the country since most of all school children suffer various degrees of undernourishment and malnutrition since they come from poor families. “The children’s absorption capacity for school lessons to attain average academic performance cannot be expected to if they are able to go to school but are hungry. The draft consolidated bill shall thereby make the Department of Education (DepEd) the lead agency among other executive offices to make the NFSP annually funded and appropriately implemented by the national government,” the Misamis Oriental lady legislator said. The Fourth Quarter 2013 Social Weather Survey conducted by the Social Weather Stations (SWS) on December 11-16, 2013, revealed that 18.1 percent (3.90 million families) of the population experienced involuntary hunger at least once in the past three months. Moderate Hunger was surveyed at 5.4 percent while Severe Hunger was pegged at 2.7 percent by the said

survey. “The proposed consolidated measure of the Committee on Basic Education and Culture will help the government ramp up its Philippine Plan of Action for Nutrition (PPAN) 20112016 to critically address malnutrition that is also anchored on the Millennium Development Goals (MDGs), especially those related to nutrition that target halving number of underweight among school children and households with inadequate energy intake. The NFSP bill will help the government address the challenges of hunger and child under-nutrition,” Rep. Uy said. The said House panel is headed by Pangasinan Rep. Kimi Cojuangco and the legislators who have authored similar bills on the NFSP are Reps. Banning premature campaigns? A veteran lawmaker has moved to “reinstate” the prohibition against premature campaigning and revive election offenses committed prior to the start of the campaign period. HB 4105 prohibits “electoral campaign or partisan political activities except during the campaign period and providing a penalty therefor.” But under the present state of our laws, there is no longer any prohibition against premature campaigning. Premature campaigning has already been decriminalized in the 2009 case of Penera v. Comelec, et al, (G. R. No. 181613, Nov. 25, 2009, En Banc). Based on the Penera case, the rule now is that two (2) facts must concur in order for a person or aspiring candidate to be liable to an election offense: first, he must have filed his certificate of candidacy; and second, the campaign period has commenced. This means that a candidate in our (automated) elections could campaign much earlier than the start of the campaign period and not incur any criminal liability for premature campaigning under our election laws. To say that the legal conundrum arising from such a jurisprudential rule not only decriminalizes premature campaigning, but any and all election offenses committed prior to the campaign period as well is debatable.. Whether the majority of the Court realizes this

grave implication from its ruling, it merely washes its hands by conveniently stating that “the forum for examining the wisdom of the law, and enacting remedial measures, is not this Court but the Legislature.. Whether the fault lies in the flawed phraseology of the law on automated elections (as the majority seems to imply), or the infirm legal reasoning or interpretation of the ponencia (as the minority suggested), one thing clearly stands out – “there is an urgent need for remedial legislation in this particular area of our election law,” thus Congress should do something about it. Section 1 of HB 4105 states: “Prohibition against premature campaigning – It shall be unlawful for any person, whether or not a voter or candidate, or for any party, or association of persons, to engage in an election campaign or partisan political activity except during the campaign period: Provided, that the person or aspiring candidate in whose favour the premature campaigning was done eventually files his/ her certificate of candidacy; and provided further, that the prohibition against premature campaigning shall apply in all kinds of election, whether done manually, automated, or otherwise.” Section 1 further states: “Nothing in this Act shall prohibit parties or association of persons from holding conventions or meetings to nominate their official candidates within thirty days before the commencement of the campaign period and forty-five days for Presidential and Vice-Presidential election.”

One solution untried before is the spiritual solution---reading the Bible and obeying its commands insofar as rains, floods and winds are concerned. Helping hands One day, after a super typhoon “Yolanda” slammed Eastern Visayas, I received a phone call from the German TV news channel N24 in Berlin to deliver some live reports, because during that time I was the only “available German journalist” in this country. Since that day, “Yolanda” and all news about it remain as a daily part of my journalistic work. The fact is, the rehabilitation work goes on; life is “somehow back”, but many international organizations pledged more support for rebuilding efforts as they noted some encouraging signs of recovery in areas

MELBOURNE, Australia–– The Bangsamoro Basic Law (BBL) is expected to be enacted by Congress before the next State of the Nation Address (SONA) of President Aquino. Meantime however, some provisions in the Comprehensive Agreement on the Bangsamoro (CAB) have already invited scrutiny from Constitutional Law experts such as Fr. Joaquin Bernas, S.J. and Sen. Miriam Defensor-Santiago. Pertinently, the Philippine Constitution Association recently described the CAB as “littered with constitutional infirmities.” The Transition Commission (TC) certainly faces a huge challenge to “accommodate and entrench” any contested provisions of the BBL within constitutional parameters. Amending or revising the Constitution is an immensely unsettling undertaking. The country has stubbornly avoided this path for the 1987 Constitution despite the various Cha-Cha movements that sprouted along the way. Indeed, this quality of immovability makes the words “accommodate” and “entrench” associated with the amendment process seem misplaced. An underlying utilitarian motivation behind the BBL is hard to ignore for any amendment proposals arising from it is palpably a mere step to overcome potential Constitutional objections. Such a limited approach to the amendment process is objectionable because it overlooks the significance for a nation-state to have a written constitution. I would like to believe that the Constitution means so much more than a piece of legal document that can be trifled with. It is generally known that a constitution establishes the institutional allocation of government power. More profoundly though, a nation’s constitution embodies

its peoples enduring values and principles. In the 1987 Constitution for example, two legacies of the Filipinos’ victory over 20 years of dictatorship are firmly entrenched, i.e. direct democratic participation and respect for human rights. Indeed, this monumental document signifies the Filipino nation’s character, our people’s soul. Clearly, its provisions cannot be altered simply to “accommodate”

transitory contingencies. Nevertheless, whether a thorough reform of the 1987 Constitution should be undertaken is still a legitimate question to ponder on. Its Preamble states that Filipinos desire “to establish a Government that shall embody our ideals and aspirations.” A corollary of this goal is the intent “to prohibit political dynasties” (Section 26 of Article II). No need to elaborate here

but the current government certainly does not embody our ideals and aspirations whilst traditional elites continue to have a firm grip on the country’s political system. These two unfortunate realities clearly point to an anomalous area in the Constitution that begs to be addressed. A more organic irregularity in the Constitution was illustrated by See LAW, page 11

Police arrest 3 men for possessing illegal guns PAGADIAN CITY – Police arrested three people, including a teenager after they were caught carrying gun in the southern Philippine province of Zamboanga del Sur. Police said a 17-year old resident of Santa Lucia village was apprehended by a police p at rol a long Pajares Street in Pagadian City over the weekend. Police said the teener is facing criminal charges for possessing an unlicensed hand gun. Bukidnon’s Impasugong— Home of the country’s finest cowboys IMPASUGONG, Bukidnon, May 4 (PIA)—Famous for its flourishing forest and healthy livestock, Impasugong town in Bukidnon is the home of the country’s finest cowboys, where the spectacular rodeo show draws large crowds to watch spills-and-thrills as “vaqueros” (cowboys) show off skills in a cattle roundup. Impasugong town Mayor Mario T. Okinlay, a professional rodeo cowboy, said there are nine commercial cattle farms in the area holding more than one thousand heads in all. “The local government also manages a communal ranch in a 649-hectare grazing land that holds 300 cattle heads,” the mayor said. PRESERVING HERITAGE IN CHANGING TIMES Villagers used to herd cattle across long distances. However, since it requires more time and skill, becoming a cowboy was every herder’s dream. For over several decades, the “dreamers” gradually learned to perfectly tend cattle and perform many of their duties on horseback. The town still has preserved its cultural heritage and ethnic identity, which led Star Cinema to unveil the beauty of Impasugong. The blockbuster film “Love Me Again” starring Angel Locsin and Piolo Pascual was shot in the town’s vast grazing land and valleys. Its colorful mountains, grassland, rocky canyons and gorges are all fabulous tourist spots. With the town’s richness derived predominantly from cattle farms—aside from pineapple, palm oil trees, and high value crops—rodeo shows also prospered. Cowboys compete in five rodeo events namely breakaway roping, steer wrestling, team roping, bull riding and calf ribbon picking. The Breakaway Roping: A roper is on horseback with one end of the rope tied to the saddle horn. When the calf is released from the chute, the roper will be in hot pursuit, with lasso swirling in the air overhead. When the loop is thrown, it must pass completely over the calf ’s head. As the calf pulls away from the rider, the rope grows taut and the string will break away from the saddle horn. The fastest run wins. The Steer Wrestling: This involves strength, speed, and precision. A cowboy on horseback, with an assistant known as hazer, chases a steer (neutered bull), drops from the horse to the steer, and then wrestles the steer to the ground twisting its horns. The fastest cowboy to plunge the bull to the ground wins the race. The Team Roping: This features a steer and two riders. The first roper is the “header” who ropes the front of the steer, usually around the horns or neck. The second is the “heeler” who ropes the steer by its hind feet. The fastest performer wins. The Bull Riding: Involves a rider getting on a large bull and attempting to stay mounted while the bull bucks or jumps upward. The rider must tightly fasten one hand to the bull with a long braided rope. A rider who stays longer atop the bucking bull wins. actually form a “shrivelled state.” Essentially, the Constitution has established a schizophrenic state which is once again a sad reality that clearly yearns for remedial action. Clearly, the changes required cannot be attained via simple amendments. Therefore, the utilitarian treatment of the amendment process in the CAB can hardly be justified given that a complete overhaul of the Constitution is warranted. Obviously, the revision process cannot deviate from the procedure prescribed in the Constitution [ARTICLE XVII]. However, it can be augmented to ensure the widest opportunity for the public to deliberate and reflect as well as to actively participate in the drafting process. Time should not be bound by anything less than allowing the people to take ownership of the revision process itself. This way Filipinos will see themselves not merely as passive observers in the sidelines but as continuing stakeholders to the Constitution’s evolution. Hence, I suggest a preConstitutional Convention phase be added to the whole revision process. The Philippine Association of Law Schools (PALS) could be officially tasked to produce a working draft of the revised Constitution. Members of this organization could conduct grassroots consultations at the provincial level. Summarized provincial findings shall then be pooled at the national level and out of this the PALS could produce a working draft. The latter shall then be used as a starting point for the eventual Constitutional Convention. This additional preliminary stage not only significantly expands public participation but also professionalizes the writing process.

The next phase could be any of the procedures prescribed in the Constitution. I suggest only two modifications. The first is to use the PALS as an official consultant during the proceedings. Second, for the campaign period not be treated as a simple yes or no proposition. I think this time should be spent explaining to the people that the revision of the Constitution is not a zero-sum game. On the contrary, the outcome of this process is about ALL Filipinos forming a strong democratic nation. Indeed, a written constitution is the unequivocal proof of the people’s decision to constantly strive for social cohesion and integration amidst the robust diversity among them. But look, Herod was disturbed upon hearing the name of Jesus since of the wrong belief that John was resurrected for revenge. PDIC to continue processing claims of Rural Bank (Zambo) depositors Your Mindanao-wide Community Newspaper

T

he Philippine Deposit Insurance Corporation (PDIC) announced that it will continue to receive and process deposit insurance claims from depositors of the closed Rural Bank of Pres. M.A. Roxas (Zamboanga del Norte), Inc. at the PDIC Claims Counter, 4 th Floor, SSS Bldg., 6782 Ayala Avenue corner V.A. Rufino Street, Makati City. Claims may also be filed through mail. PDIC conducted the onsite claims settlement operations (CSO) for the

closed Rural Bank of Pres. M.A. Roxas at the bank’s premises and completed the CSO from April 2 to 4, 2014. PDIC sent notices of payment to depositors amounting to P7.5 million involving 3,086 accounts with balances of P50,000 and below where the filing of claim is waived by PDIC. Meanwhile, PDIC paid 1,362 claims during the onsite CSO involving 1,350 accounts for a total amount of P17.7 million deposits. As of April 4, 2014,

PDIC has yet to receive deposit insurance claims for 3,045 accounts that require the filing of claims. The total amount of deposits covered by these outstanding accounts is P10.0 million. When filing deposit insurance claims, depositors are advised to personally present their duly accomplished Claim Form, original evidence of deposit, and two (2) valid photo-bearing IDs with signature of the depositor. Depositors may also file

their claims through mail and enclose the same set of document requirements. Depositors who are below 18 years old should submit either a photocopy of their Birth Certificate issued by the National Statistics Office (NSO) or a duly certified copy issued by the Local Civil Registrar as an additional requirement, with the Claim Form signed by the parent. Claimants who are not the signatories in the bank records are required to submit an original copy

of a notarized Special Power of Attorney (SPA). In the case of a minor depositor, the SPA must be executed by the parent. The procedures and requirements for filing deposit insurance claims are posted in the PDIC website, www.pdic.gov. ph. The Claim Form and format of the Special Power of Attorney may also be d ow n l o a d e d f rom t he PDIC website. In accordance with the provisions of the PDIC Charter, the last day for

filing deposit insurance claims in the closed Rural Bank of Pres. M.A. Roxas is on March 20, 2016. After said date, PDIC, as Deposit Insurer, shall no longer accept any deposit insurance claim.
