Ricardo Domingo, 48, public information officer of the provincial government and news anchor of NBN’s “Tutok Balita” and two other passengers Richelle Canayong and SFO2 Henry Saumat were killed on the spot when the Hyundai Starex van they were riding slammed through the back of a speeding truck in the opposite direction along the national highway in Barangay Afga, Sibagat town. Domingo who was seated at the left side of the back seat sustained the most fatal

injury when his face was hit by the back bumper of the truck which ripped off the side of the van and thrown him off the side of the road. Other passengers including the driver were critically hurt and were rushed to hospitals in Butuan City. The truck driver immediately escaped right after the accident and is now the subject of police manhunt. Alfredo Plaza, station manager of DXDA, said he had assigned several reporters to deeply look into the accident after they found

out that the van which travels the San FranciscoButuan City route turned out to be operating illegally and did not have franchise as public utility vehicle. Many passenger vans mostly running on aircondition has been thriving means of transportation in San Francisco town towards Butuan City and Davao City destinations that already threatened the long-time monopoly of Bachelor Express buses. DXDA reporters however found out that some of these vans still bear

green plates issued by the Land Transportation Office which is considered just a private vehicle. Vans to be allowed to travel with passengers should bear yellow plates. Plaza said they are working out for the P100,000 death benefit of Domingo from Kapisanan ng mga Brodkasters ng Pilipinas (KBP) since he is a regular member of the organization. The Philippine flag at the Naliyagan Plaza of the provincial capitol was raised at half mast to pay tribute to Domingo.

Benaldo’s camp responds to health centers issue By GERRY LEE GORIT Correspondent

CAGAYAN de Oro City––In response to a radio broadcast last Saturday about the barangay health centers in the first congressional district of Cagayan de Oro City, the chief of staff of Congressman Benjo A. Benaldo has issued a clarification regarding the issue. Andrew Bascon said it should be Benaldo who is to be credited for the establishment of the health centers because he is the representative of the first district. Bascon, in a radio in-

terview, said Congressman Benaldo has been part of the city-wide investment plan for health under Mayor Vicente Y. Emano and that among his projects in all 24 barangays of the first district are health programs. Bascon lambasted at Barangay Carmen chairman Rolando Uy for allegedly not providing enough projects for all the barangays in the first district during the latter’s term as congressman. He said it is Congressman Benaldo who has improved the road networks between the rural barangays especially at Lumbia,

Tumpagon, San Simon and Besigan. “Congressman Benaldo has given each of the 24 barangays at least three or four projects including Barangay Carmen,” he added. Bascon said that because Congressman Benaldo is the assistant majority floor leader he was able to get more projects for the city’s first district. “He has truly represented his constituents,” Bascon said of Benaldo. Asked why the people should re-elect Benaldo, he said it is because Benaldo is in the best position to continue his public

service to the barangay residents and that he could add more to his already numerous projects covering infrastructure, agriculture, health, livelihood

programs, education and others. Benaldo is running under the Padayon Pilipino party of Mayor Emano and Vice Mayor Caesar Ian Ace-

nas. The party’s candidates for the city council in the first district include Inday Dahino, Alden Bacal, Pepe Abbu, Gil Banaag, Maya Enteria and Annie Daba.

FTS in Libertad NHS successful BUTUAN CITY – The final testing and sealing of the Precinct Count Optical Scan (PCOS) machine in one of the precincts of Libertad National High School was successful. “We are all ready for the May 13 elections and we hope it will be successful,” said BEI Fernando Sarmiento Jr. chair. A f t e r t h e s a mp l e b a l l o t s were checked and found to have matched the results from the PCOS machine, watchers and representatives of volunteerorganizations then signed the final poll results The BEI, composed of the chair, clerk and a member, briefed and demonstrated to the watchers, representing different local candidates and the representatives of volunteer-organizations, how the PCOS machine is used. Among those who tested the machines were personnel of the Philippine Information Agency and members of the local media. Sarmiento said ballots rejected four times, while feeding it into the machine will no longer be forced to be scanned in the ma-

chine. Instead, they will be placed in an envelope and sent to Comelec Manila, as part of the report recorded in the minutes. “ The PCOS machine won’t be able to read properly or even accept the ballot, if it incurs unnecessary marks. Over-voting of candidates in a position also won’t reflect in the PCOS machine, so voters have to ensure that their ballots are clean and properly-shaded,” explained Sarmiento. Sarmiento also said that on election day, an express lane for pregnant women, persons with disabilities and senior citizens will be established in his precinct, per Comelec guidelines. (Jennifer P. Government troopers, NPAs clash in AguSur By 1Lt Hazel A Tabago

PROSPERIDAD, Agusandel Sur - Soldiers of the 75th Infantry Battalion and elements of the PNP Special Action Force had an encounter with 10 NPA rebels on Road 88 in Brgy. Bunawan Brooks, Bunawan, Agusandel Sur, Monday evening The troopers were on a joint security patrol in the area when they chanced on the armed group, believed to be from Section Committee 14 of the North Eastern Mindanao Regional Committee. The encounter resulted in the wounding of one government trooper and several on the rebel side. Col. Gregory M.Cayetano, commander of the 401st Infantry Brigade, immediately ordered the 75IB to pursue the rebels. Col. Cayetano thank the local residents for tipping them off about the presence of the enemies in the area even as he appealed to the families of the rebels to

encourage them to abandon the armed struggle and return to the folds of the law and live a normal life. He also reminded the public that “for more than four decades now, “we have all felt the pain that the armed struggle has brought us.” In fact, the struggle has deterred development and progress, particularly in the countryside, he pointed out. Col. Cayetano described the AFP’s concept of Bayanihan as far better than the revolutionary concept of completely overthrowing the government. “In Bayanihan, we are all benefitted, while in the armed struggle, we are all losers,” said Col Cayetano. On the other hand, Lt. Col. Danilo Benavides, commanding officer of 75IB, assured the civilians that “any information they provide us will be treated with utmost confidentiality.” (NCLM/1Lt Hazel A Tabago, 4ID, PA/PIA-Caraga/asf )

PNP-Caraga moves on new roadmap By PO3 DarlinCabalinan-Migullas

CAMP RAFAEL C. RODRIGUEZ, Libertad, Butuan City – The Police Regional Office (PRO13) is currently moving along with the new PNP roadmap, called PATROL Plan 2030. Geared towards the delivery of highly capable, effective and credible police service, PATROL Plan 2030 carries such perspectives on Resource Management, Learning and Growth, Process Excellence and Community Perspective. PATROL, an acronym for Peace and order Agenda for Transformation and upholding of the Rule-OfLaw, is being eyed to be achieved by 2030. ‘R e s o u r c e m a n a g e m e nt’ s e r v e s a s s o l i d foundation for the other perspectives, “along

which, we in the police s e r v i c e a r e m a n d at e d to optimize our limited resources,” said Police Supt. Martin M. Gamba, chief of PRO-13 information office. This, by observing high standards of transparency and accountability in all of financial and logistical transactions. Under the ‘learning and growth’ perspective, the PNP would look at things much better, more effectively and efficiently wit h more comp etent, capable and disciplined personnel. “Here, the PNP aims to invest in human resources and processes, so as to earn the support of the stakeholders,” he added. Meanwhile, the ‘process excellence’ perspective refers to the differ-

3 armed rebels give up to military By 1LT Krisnen Peter G Sarsagat

PROSPERIDAD, Agusandel Sur-- Three armed rebels, belonging to Guerrilla Front 88 of the New People’s Army’s North Central Mindanao Regional Committee, have voluntarily surrendered to the 26th Infantry Battalion of the Philippine Army, under Lt. Col. Jose Leonard Gille, very recently. The surrender was made possible through the effort of the soldiers and

concerned citizens, who concertedly convinced the three to lay down their arms and return to the folds of the law. The former rebels also turned-in their M14 rifle with two magazines; one sub-machinegun Ingram pistol with one magazine, and one cal. 38 revolver. As of this writing, the three are undergoing custodial debriefing at the 26IB

headquarters. Based on initial interview, the rebels opted to surrender for fear of having killed in encounter with government forces. “Right now, they just would like to be reunited with their families and loved ones and live a peaceful life,” Lt. Col. Gille said. “We, your soldiers, are very happy to welcome our brothers back to the main-

stream of our society. Surely, their respective families can now sleep tight knowing that the three are already safe,” he added. The command is now coordinating with other line agencies for necessary assistance to the three returnees, as they start a normal and decent life. “Those who are still in the underground movement, REBELS | page 11

ent core of operational processes and practices the PNP uses in carrying out its mission. “Wit h t he PATROL concept, the PNP is giving top consideration to the four core processes of intelligence, investigation, op erat ions and p olice community relat ions,” he stated. Police Supt. Gamba further said that PATROL Plan 2030 highlights the two concrete strategic objectives of the PNP, such as as improvement on crime prevention and solution; and improving community safety awareness, through community-oriented and human rights-based policing. He also said that “with the other regional offices of the PNP, we are giving so much importance to people in the community, they being the direct beneficiaries of an improved police service.” PATROL Pl an 2020 likewise emphasizes the need for every PNP personnel to reach out to the communities they serve to obtain people’s active support, cooperation and eventually gain a higher level of trust and confidence in every police personnel and in the PNP organization, as a whole. The new COMPLAN will be implemented in three phases, namely

preparation, execution, and monitoring and evaluation. The PNP is still in the execution phase, providing the stakeholders with deep sense of understanding and appreciation of the PNP PATROL Plan 2030. Police Supt. Gamba enumerated such activities as cascading of enhanced PNP PATROL Plan 2013; promoting and nurturing governance culture; and strengthen partnership. It can be recalled that when Police Director General Alan La Madrid Purisima assumed as chief of the PNP, he provided the strategic focus encapsulated under “CODE P” (C ompetence, Organizational Development, Discipline, Excellence and Professionalism), which is seen to be very vital in the accomplishment of PNP mission. In line with CODE P, he encourages every PNP member to keep moving forward in the journey for real and lasting transformation. With these being put in place, the PNP hopes to realize its vision for ‘A safer place to live, work and do business’, Police Supt. Gamba concluded. Some of the issues media were trying to clear with him included loose talks that he is an opportunist using his relations with the President Noynoy Aquino, and his services as chairman of the National Youth Commission under the administration of President Gloria Arroyo. Arroyo administration’s scandals included appalling graft and corruption issues and even suppression of media freedom and oppression of youth groups who opposed Arroyo’s regime. Another issue was his television campaign ad where he was criticized for using the name of the late President Cory Aquino. Media chided him, “why was he using the name of President Cory when the great woman president was already resting in peace?, just to get votes? Such critical issues were not answered by Bam Aquino, the Zambo media concluded.

AS the May 13, 2013 election day nears, the true nature of candidates surfaced. What have these candidates (local) achieved in the last 45-day campaign period? These candidates exposed the rotten election system where personal destruction became the main focus of campaign platforms. It is very frustrating that in reality, most candidates who delved on the platform of personal destructions Cris Diaz were those who have more to explain about themselves and their accomplishments. These candidates, especially the ambitious and power hungry candidates, believed they could get the sympathy of the voters through deceptive antics. By the way, Oscar Moreno, a Liberal Party mayoral candidate in Cagayan de Oro City, has yet to answer allegations of his extravagance at the provincial capitol. Moreno has been accused of squandering more than P 100 million through cash advance that has remained unsettled. Is Moreno leaving Misamis Oriental scot-free? It is sad to say that Moreno has not made a convincing explanation of his failure to settle the cash advances. Although Moreno argued that the cash advances were availed of by capitol workers, there were still suspicions that Moreno benefited from those cash advances. One could not imagine that an ordinary employee (some were casuals) could get hundreds of thousands to millions of

cash advances. How could these workers pay the loan when these workers received only a little more than the required monthly minimum wage? Moreno must have learned the strategy from his predecessor who has the penchant of making cash advances through his staff. This method is one way of getting away with possible graft charges. The point is that the governor is not directly involved in the transaction. The cash advanced was made through the employee while the governor acted only as an approving authority. When one examines the records, there is no paper trail that would point to the governor as directly involved in the cash advances. The record would show that it was the employee who applied and get the amount specified in the cash advance. These cash advances are subject to settlement as required by the Commission on Audit (COA). Perhaps, it is for this reason that Moreno is not bothered with the unsettled cash advances at the provincial capitol in Misamis Oriental. The worker who made the cash advance would go to jail – not Gov. Moreno. Maybe, Moreno thinks that the people of Cagayan de Oro are not aware of what he has done at the provincial capitol. Moreno believes he has nothing to explain at all. After all, more than 50 percent of the workers at the provincial capitol lived or are registered voters in Cagayan de Oro City. The sufferings of these workers in the hands of Moreno will definitely reflect in their ballots. React: crisguardian@yahoo.com

Do you plan to retire someday?

ONE of the most important questions we ask each individual as financial programming consultants goes like this: “Why do you strive hard to work and earn money each day? What is it all for?” In short, what drives and motivates you to do so? Questions like this often stir up our inner philosophical musings. The world does not require you to have to get up and do work for the day, it’s a requirement you set for yourself ! And it’s a personal decision whether you do so or not. But by not doing so, what does it mean? What effect will it have on your daily grind? It has been said that for us to have enough reason to seek and to do the “how to’s,” we should know and understand the “why’s” first. Apart from many other alternatives, there is one common answer almost all individuals have to this question. And that is “retire-

For who hath known the mind of the Lord? or who hath been his counsellor? This is a “clear presentation” that we could not “fathom the fullness and mystery” of God but despite of this, He revealed Himself to us through His creation. Romans 1:20For the “invisible things” of him from the creation of the world are “clearly

But what does “retirement” really mean for you? Different people have varied concepts of being “retired.” But for purposes of brevity, and to limit our discourse strictly within the confines of its financial aspects, retirement could perhaps best be defined as “that stage of your life where you are not obliged to strive hard to earn your keep, because you can live assured having enough monetary buffer to back you up indefinitely even for the rest

of your lifetime.” The great business philosopher Jim Rohn says it with distinction: “Do what you have to as quick as you can, so you can do what you want to as long as you can.” For most, retirement usually “comes” at age 60 or 65. But for all, what is most empowering is to understand that “retirement” is something that either comes by choice or by force! When it comes to making personal choices, some people would like to be able to retire “early” so they would be able to enjoy doing what they want to for the rest of their lives without the constraint of being

Republic of the Philippines ENERGY REGULATORY COMMISSION Pacific Center Building San Miguel Avenue, Pasig City IN THE MATTER OF THE APPLICATION FOR APPROVAL OF THE ENERGY SUPPLY AGREEMENT (ESA) BETWEEN SURIGAO DEL SUR I ELECTRIC COOPERATIVE, INC. (SURSECO I) AND THERMA SOUTH, INC. (TSI), ERC CASE NO. 2013-_____ RC SURIGAO DEL SUR I ELECTRIC COOPERATIVE, INC. (SURSECO I), Applicant. x--------------------------------x

Applicant SURIGAO DEL SUR I ELECTRIC COOPERATIVE, INC. (“SURSECO I”), through counsel, unto this Honorable Commission, respectfully alleges, that: 1. SURSECO I is a non-stock, non-profit electric cooperative, duly organized and existing under and by virtue of Philippine laws, with principal office at Brgy. San Fernando, Bislig City, Surigao del Sur. 2. It is the holder of an exclusive franchise issued by the National Electrification Commission (NEC) to operate an electric light and power distribution service in the City of Bislig and the Municipalities of Lingig, Hinatuan, Tagbina and Barobo, all in the province of Surigao del Sur. 3. Pursuant to Rule 20 (B) of the Energy Regulatory Commission’s Rules of Practice and Procedure (“ERC Rules”), and other pertinent rules and regulations, this Application is being submitted to this Honorable Commission for its consideration and approval of the Energy Supply Agreement (“ESA”) executed by and between SURSECO I and Therma South, Inc. (“TSI”). STATEMENT OF THE FACTS 4. SURSECO I currently sources the bulk of its electricity requirements from the Power Sector Assets & Liabilities Management Corporation (“PSALM”) and the remainder from Therma Marine, Inc. (“TMI”). 4.1. PSALM & SURSECO I executed a Contract for the Supply of Electric Energy (“CSEE”) which was in force from 26 August 2011 to 25 December 2012, or one (1) year after the Department of Energy’s declaration of open access in Mindanao, whichever comes first. 1 However, in a certification dated 16 November 2012, PSALM confirmed that it has insufficient capacity to supply the additional power requirements of the Mindanao distribution utilities beyond the contracted energy and equivalent demand in its existing CSEEs. 4.2. PSALM & SURSECO I subsequently executed a new CSEE covering the period from expiration of the previous CSEE and until 25 December 2016. However, the average contract energy from the previous CSEE was reduced by approximately 37% under the new CSEE. 4.3. On 16 November 2010, SURSECO I entered into an Energy Supply Agreement (ESA) with TMI for the supply of two (2) MW. The ESA is duly approved by this Honorable Commission and will expire on 25 September 2013. 2 5. It is expected that the energy requirements of SURSECO I will significantly increase in the next few years as demonstrated by SURSECO I’s Actual and Forecasted Load Data and Distribution Development Plan. 6. The expiration of the PSALM CSEE in 2016 and the expiration of the ESA with TMI in 2013 as well as the projected increase in the energy requirements of SURSECO I customers will result in a shortage of the energy available to SURSECO I. 7. There exists a region-wide power supply deficiency problem in Mindanao resulting in frequent brownouts and power interruptions. Moreover, Mindanao is heavily reliant and dependent on hydro electric power; 3 thus, during the onset of the summer months and the occurrence of the El Nino phenomenon during certain years, the supply of power in Mindanao is further and drastically reduced. The current power crisis in Mindanao underscores the need for SURSECO I to enter into a bilateral agreement with generation companies for the stable supply of electricity to its customers. 8. In 2012, TSI, a generation company duly organized and existing under and by virtue of Philippine laws with principal office address at the Brgy. Binugao, Toril District, Davao City, conducted a series of road shows to market the capacities of its 300MW coal-fired power plant to be constructed on a site straddling the boundary of Davao City and municipality of Sta. Cruz, Davao del Sur (“TSI Power Plant”). At the road shows, TSI declared its intention to supply energy in Mindanao by entering into bilateral agreements with interested distribution utilities and make available the 300MW capacity of the TSI Power Plant. 9. Sometime after the road shows, SURSECO I commenced negotiations with TSI for the execution of the ESA. On 7 February 2013, SURSECO I and TSI signed and executed the ESA, subject of the instant Application. ABSTRACT OF THE ESA AND OTHER RELEVANT INFORMATION 10. In order to supply power to SURSECO I under the ESA, TSI shall construct, own, operate, manage and maintain the TSI Power Plant. The Commercial Operation Date of the power plant is expected to be in 2015. 11. Executive Summary. The Contract Capacity to be made available by TSI to SURSECO I is fixed on a monthly basis equivalent to Three Thousand kilowatts (3,000 kW) and to be delivered in accordance with the Schedule of Contract Energy which is fixed on a daily and hourly basis. TSI shall exert best efforts to source replacement or alternative supply replacement power during scheduled and unscheduled outages to supply all or part of the Contract Energy. On the other hand, when SURSECO I is unable to take the Contract Energy or a portion thereof for reasons other than Force Majeure and there is no WESM in Mindanao, SURSECO I may request TSI to make available to third parties all or a certain portion of the Contract Energy (“Available Contract Energy”), at such intervals specified by SURSECO I, subject to the payment of a Marketing Fee of Php0.02/kWh of the Available Contract Energy and the corresponding reduction in SURSECO I’s Contract Capacity. 12. Salient Features of the ESA. The ESA between SURSECO I and TSI contains the following salient terms and conditions: 12.1. Term. The ESA has a term or contract period commencing from the Effective Date until twenty-five (25) years after the Operations Effective Date. 12.2. Contract Energy. TSI shall make available and SURSECO I shall receive Contract Energy at the Delivery Point 4 specified under the ESA. On the other hand, to make available for delivery, Contract Energy shall be based on the Schedule of Contract Energy attached to the ESA. 12.3. The Contract Capacity and/or Contract Energy in respect of a particular Billing Period may be adjusted either by (a) TSI submitting an offer to SURSECO I to increase the same, subject to SURSECO I’s acceptance or refusal, or (b) SURSECO I requesting an increase in the Contract Capacity and/or Contract Energy, subject to TSI’s approval. In both instances, SURSECO I or TSI, as the case may be, must send a written notice 30 days before the date the intended increase is to take effect. 12.4. At any time during the Contract Period, SURSECO I may also send a written request to TSI to increase the Contract Capacity and/or Contract Energy, no later than 60 days prior to the effectivity of the proposed increase, subject to TSI’s approval, to be paid by SURSECO I at the Contract Price. 12.5. Any proposed adjustments (increase/decrease) to the Contract Capacity and/or Contract Energy which is intended to apply to the succeeding contract year shall be sent by SURSECO I in writing to TSI no later than 60 days prior to each anniversary of the Operations Effective Date, subject to TSI’s approval. In case of an increase, the additional Contract Capacity and Contract Energy shall be paid for by SURSECO I at the Contract Price, while a decrease shall cause SURSECO I to compensate TSI in the amount of the Buy-Out Charge, computed as follows:

If no agreement in writing is reached by the anniversary of the Operations Effective Date, the prevailing Contract Capacity and/or Contract Energy shall continue to apply. 12.6. Stages of Supply. TSI shall supply power to SURSECO I in various stages, as follows: 12.6.1. During the period of testing and commissioning of the Power Plant, SURSECO I shall purchase the proportionate net electrical output of the Power Plant generated by TSI subject to the payment of Commissioning Energy Charge as provided in Schedule 7.1 of the ESA. SURSECO I may also request for additional quantities subject to TSI’s approval. 12.6.2 In the event that TSI is ready to deliver capacity and energy prior to the Target Commercial Operation Date, TSI shall have the option to: (a) offer early commencement of delivery of Contract Capacity and Contract Energy to SURSECO I; or (b) sell the electrical output of the Power Plant to Third Parties until the Target ERC Case No. 2011-128RC. ERC Case No. 2011-064RC. 3 53% of the total Mindanao dependable capacities in 2009 comes from hydroelectric power [Power Development Plan, 2009-2030]. 4 Under Schedule 7.4.2 of the ESA, the Delivery Point refers to the High Voltage side of the transformer at the Power Plant. 1 2

Commercial Operation Date. 12.6.3. Beginning on Operations Effective Date, TSI shall supply and deliver Contract Capacity and Contract Energy (whether from the capacity of the Power Plant or the power plants owned or operated by any of its affiliates, WESM, if any, or any other supplier) to SURSECO I during the Billing Periods specified in the Contract Energy Schedule. 12.7. Share in Minimum Load Requirement. In all Intervals as provided under the ESA, SURSECO I shall nominate no less than the Share in Minimum Load Requirement of One Thousand Two Hundred kilowatts (1,200kW), subject to the conditions under the ESA in case the aggregate nominated energy of all customers of TSI is less than the Minimum Load Requirement due to Force Majeure event affecting one or more customers. 12.8. AQUARIUS (January 20 – February 18) - You are feeling quite avant-garde today -- so much so that you may confuse your people quite a bit. That’s not a big problem, as they are sure to catch up with you eventually. Enjoy the mystery! PISCES (February 19 – March 20) - You need to deal with someone who is definitely not as they appear to be. That doesn’t mean you’re getting cheated or hoaxed, but it could mean that you are the savior when the mask comes off. ARIES (March 21 – April 19) - You may meet someone new today who is almost alien in their understanding of life. That can be really great for someone like you, so stick close by them and soak up whatever you can. TAURUS (April 20 – May 20) - Things may not be going your way today, buy that just means that you need to stay the course. Your energy is not quite right for this, but a challenge can be invigorating, so try your best anyway! GEMINI (May 21 – June 21) - You’ve got to share your thoughts and feelings with your people today, and that’s pretty easy. Things are good for all of you, even if at least one person is starting to freak out. CANCER (June 22 – July 22) - You are feeling a little leery of someone you ordinarily trust. That’s not a terrific feeling, of course, but you need to honor it and ask probing questions to see what, if anything, is really going on.

Comelec orders inventory of CdO election paraphernalia By Froilan Gallardo

CAGAYAN DE ORO CITY (MindaNews/07 May)--The Commission on Elections (Comelec) has ordered the inventory of all election paraphernalia in Cagayan de Oro City following allegations that poll forms, envelopes for voting and counting, pens and indelible inks were stolen Monday night. Comelec of f icer R au l Pabito ha nded Tuesday morning the order to city

ality of the PCOS machines, he said the assigned board of election inspectors and technicians also tested the accompanying backup batteries and transmission signals. During the testing process, Casquejo said two of the 208 PCOS machines that were assigned to the area encountered some technical problems but they were later resolved. The touch screen display of a PCOS machine assigned to a clustered precinct in Barangay Dadiangas South Elementary School initially failed to turn up but technicians were able to fix it after making some calibration, he said. In Barangay Conel, he said one of the PCOS machines failed to totally function and was immediately replaced. “Those were the only problems we encountered and we immediately reported them to the (Comelec) central office so they can be addressed properly,” Casquejo said. In South Cotabato, the final testing and sealing of the PCOS machines started last Sunday and are still ongoing, said election assistant Nancy Tano. She said the final sealing and testing of the PCOS machines in T’boli and Lake Sebu towns, which both host the province’s remotest polling centers, was scheduled on May 9. The Comelec has assigned 893 PCOS machines for the province’s 10 towns and lone city. “So far, we did not encounter any major problems but there were some minor aberration reported in Koronadal City,” Tano said. In Sarangani province, provincial election supervisor Jose Alvin Quiñanola said only one of the 406 PCOS machines that were assigned to the area encountered a technical problem during the final testing and sealing process on Monday.

She also provided the media with copies of the inventory report of the ballots and other forms of supplies that the City Treasurer’s Office (CTO) received from the Comelec. Late Monday afternoon, tension ran high after a group of NAMFREL volunteers spotted three City Hall workers spiriting out four boxes from the CTO. Fearing a repeat of the 2010 incident when ballots and compact flash memory cards

for PCOS machines were found dumped at the sanitary landfill, the NAMFREL called in their volunteers to hold a vigil at the City Hall. Hundreds came, including supporters of Misamis Oriental Gov. Oscar Moreno, who is running for mayor in Cagayan de Oro. The call elicited a similar response from supporters of reelectionist Mayor Vicente Emano, who is seeking a second term. treasurer Marilyn Legaspi at the Cagayan de Oro City hall amidst the mounting political tension following the discovery of the alleged theft. “Please notify the different stakeholders and this office prior to the schedule of said inventory and conduct the inventory in the presence of Comelec representative(s), citizens’ arm, candidates and epresentatives/watchers of political parties to erase doubts as to the integrity of

the election paraphernalia,“ the order from City omelec chief Palmer Palamine said. Cagayan de Oro has a voting population of 277,931. Legaspi immediately ordered her personnel to notify all political parties, the National Citizens’ Movement for Free Elections (Namfrel) and the Parish Pastoral Council for Responsible Voting (PPCRV) to send heir representative to witness the inventory scheduled at 2 p.m. today (Tuesday).

He said the PCOS machine assigned in clustered precinct No. 3 at the Maasim Central Elementary School in Maasim town failed to function due to problems with its security pin. Gertrudes Omaña, Maasim election officer, said the assigned technician tried to fix the hitch but still failed to get past the problem with the “incompatible security pin.” She said the technician immediately reported the matter to the PCOS supervisor, who then elevated it to the Comelec central office’s national support center. “We actually have backup PCOS machines but we can’t use them unless we are advised to do so by the central office,” she said. Omaña said they decided to just postpone until Tuesday the final testing and sealing procedure for the affected precinct. In 2010, the election results in Maasim town turned up erroneous after the PCOS machine assigned in clustered precinct No. 21 in Barangay Kablacan transmitted the results of the testing process instead of the actual voting. The wrong results led to the proclamation as mayor of independent candidate Jose Zamorro, who trailed then administration bet Arturo Lawa in the actual voting. Zamorro held on to the post until he was removed by the Department of the Interior and Local Government in March last year based on a Supreme Court decision that nullified his proclamation as mayor in 2010 due to the erroneous results. da Joson later came forward, claiming that the boxes contain her “personal effects.” But she refused to open the boxes unless there is a court order. Namfrel local chief Nestor Banuag said they welcome the Comelec order, saying this would lower the political tension in Cagayan de Oro. “The inventory will allow us to see if anything valuable in the election paraphernalia is missing or not,” Banuag said. The inventory list provided by city treasurer Legaspi to the media includes election forms, envelopes for voting and counting, indelible ink and other supplies from the Comelec. Banuag said they will also inspect if the 360 boxes containing the ballots are intact and not tampered. (MindaNews) EXTRAJUDICIAL SETTLEMENT OF ESTATE OF ISABEL GAMBI WITH WAIVER OF RIGHTS

SKorea expects north’s missile test by Monday UNITED States and South Korean forces remain on heightened alert for a North Korean missile test that officials say could take place at any time. Seoul’s defense ministry on Thursday said it is at a “full readiness posture” as it monitors the North for possible launches. A spokesperson said the South believes the test could take place on or before the Monday birthday of North Korea’s late founding leader, Kim Il Sung. But the defense ministry refused to comment on a report by Japan’s Kyodo news agency, which on Thursday quoted an unnamed Tokyo defense official as saying Pyongyang has placed a missile launcher in a raised position in apparent preparation for a test. Joint U.S.-South Korean forces have already raised their alert level to “WatchCon 2,” indicating a vital threat is present. At the Pentagon, Defense Secretary Chuck Hagel warned Pyongyang against making more threats. At the Pentagon, U.S. Defense Secretary Chuck Hagel warned Pyongyang a g a i n s t m a k i n g m ore threats. “North Korea has been, with its bellicose rhetoric, with its action, has been skating very close to a dangerous line. Their actions and words have not helped defuse a combustible situation,’’ Hagel said. South Korean Foreign Minister Yun Byung-Se told lawmakers Wednesday it is “highly likely” North Korea will test one of its new missiles “at any time.” “We believe that the missile will be a Musudan, which is a new form of mid-range missile with a range of 3,500 kilometers. How far it will travel depends on North Korea’s will,” Byung-Se said. South Korean soldiers look at North Korea through binoculars from Dora Observation Post near the border village of Panmunjom, April 10, 2013.

South Korean Foreign Minister Yun Byung-Se told lawmakers Wednesday it is “highly likely” North Korea will test one of its new missiles “at any time.” The European Union Wednesday told North Korea it would not pull its diplomats despite North Korea’s warning that it could not guarantee their safety after April 10. During talks in London with U.S. Secretory of State John Kerry, Russian Foreign Minister Sergei Lavrov sought to present a united front. “On North Korea, we have no differences with the United States. You should not scare anyone with military maneuvers. And then there’s a chance everything can calm down,” Lavrov said. Chinese Foreign Ministry spokesman Hong Lei also urged restraint. “Under present circumstances, all sides should stay calm and restrained, not provoke each other, strive to alleviate the tension, bear in mind the regional peace and stability, work towards the resumption of the six-party talks, strengthen contact and dialogue, strive for

denuclearization to achieve a long-term security and stability in Northeast Asia,” Lei said. North Korea is reported to be in the final stages of preparing for a mid-range Musudan missile test. The previously untested missile could potentially reach South Korea, Japan, or the U.S. territory of Guam. Unconfirmed reports also suggest Pyongyang is preparing to test other missiles simultaneously. Some analysts expect the test to occur sometime around the Monday birthday of Pyongyang’s founding leader, Kim Il Sung. The commander of the U.S. forces in the Pacific confirmed North Korea has moved a Musudan to its east coast in apparent preparation for a launch. Testifying Tuesday at a U.S. Senate hearing, Admiral Samuel Locklear insisted that any North Korean missile could be intercepted if it poses a direct threat to the U.S. or its allies.

Warnings to foreigners North Korea state television has been urging foreigners to leave South Korea, warning they could be caught up in an allout military conflict or a “nuclear war.” South Korea Unification Ministry spokesperson Kim Hyung-suk on Wednesday played down the threat to foreigners. “Various actions from the North are very likely to be psychological, creating anxiety. I will say that we should not be paying too much attention or feeling anxious,” Hyung-suk said. North Korea has threatened to attack the South, the United States and U.S. allies in the Asia-Pacific region in retaliation for the latest economic sanctions imposed on Pyongyang by the U.N. Security Council. Those sanctions have been aimed at punishing Pyongyang for carrying out nuclear and missile tests in defiance of Security Council resolutions.

ZAMBOANGA City––Two persons were killed in a fire that hit a commercial building in Zamboanga City in the southern Philippines. Zamboanga City Fire Marshall Dominador Zabala said the burned bodies were recovered during an inspection at ZamSulu Building along Veteran’s Avenue. “Confirmed at may dalawa tayong bankay na na-recover sa loob ng building pero hindi pa natin matiyak kung sino ang mga ito, ngunit may balitang mga helpers ang dalawang biktima,” Zabala said. The fire hit the 3rd floor of the building that houses residential units and various shops, including a bank. The building is owned by the Chua family, but none of its members spoke to the media about the fire. Zabala said they are still investigating the cause of the fire.(Mindanao Examiner. the period of the illness. If it were respiratory, taking in plenty of fluids, eating a balanced nutritious diet and rest will go a long way. It is said that in one’s lifetime, one cannot evade the possibility of having that virus affect you: but, you and I can do something about it and come out better and healthy persons.

Cherry Orendain, Anakbayan Southern Mindanao spokesperson, said the decrease in the number of HEIs applying for tuition fee increase “does not please the youth and students,” adding that the CHED allegedly failed to control the “alarming trend” of tuition fee increases among private schools in the region. “The fact remains that education is still a business and that the CHED has perfected its role as the spokesperson of the capitalist educators,” she told MindaNews. Bai Ali Indayla, second nominee of Kabataan Partylist, earlier said that some 150,000 students from private schools were affected by tuition fee increases in the school year 2012-2013. She cited that in the last three years, tuition fee increases ranged from P3,150 to P4,200 per semester, with the average tuition paid by a student reaching P40,000 per school year. Indayla said her group gathers complaints from parents and students on school violations related to tuition fee increases through the “Kabataan Hotline” with numbers 082- 221-6589 and 0942-980-8413. She said that “redundant and exorbitant fees” have turned out as the most common complaints of parents and students. Indayla stressed that education in the country has become commercialized and expensive, making it hard to the reach of the poor. Alvarez said the issues related to hikes in tuition and other fees require consultations as mandated by Article III of CHED Memorandum Order (CMO) No. 3, Series of 2013. Based also on the order, 70 percent of the tuition fee shall go to personnel salaries and benefits, 20 percent for school upgrading or improvement, and only 10 percent for return of investment. talk to the troops who launched a standoff, “in a brotherly way.” The MNLF leader said the governor of Tawi-Tawi Sadikul Sahali and “somebody from the national government” has pleaded with him to join an entourage going to Kuala Lumpur and Sabah.

“They want me to contact these young people, tapos ngunit ngayon, aywan ko (but now, I don’t know),” he said. Misuari said another way of solving the problem, is by making an appeal to his friend Malaysian Prime Minister Datuk Seri Najib Tun Razak. He claims the Prime Minister is a cousin of his grand nephew, whose grandfathers are brothers. “So I intend to send him there, to talk to Najib and persuade him to desist from sending more forces [in Sabah].” He said he will also talk to Sultan Jamalul Kiram III, not to aggravate the situation. “I can mediate with them, anyway, Sabah and Sarawak belong to me, and my clan. It doesn’t belong to the Sultanate, because this is the property of my great great grandfather Panglima Pahabasal Elija,” Misuari added. Misuari flew in to Davao Saturday after attending a month-long meeting with the parliaments of the Organization of Islamic Conference (OIC), conferred with Vice Mayor Rodrigo Duterte in Mandaya Hotel to talk on these options. He clarified that the accusations of his involvement in the Sabah tension are “baseless and unfounded.” Duterte, for his part, assured Misuari of support if anything happens. The Vice Mayor, without elaborating, offered help “in connecting and talking it out” with the national government. Misuari said he talked to Sultan Kiram in a discreet meeting the night before he left for Davao. He told the Sultan be careful because “(the government is) preparing to arrest you.” “Sabi niya, mas gusto ko ma-arrest na ako para makapagpahinga na ako sa loob ng prison. (He said, he wanted to be arrested so he can relax in prison.)” Misuari thinks it is a big gamble on the Sultanate royal army to send their troops and mass up in Sabah. He is worried that violence might spread in Kunak, then to Kota Kinabalu in Sandakan and to other places. Misuari said he does not want any trouble with Philippine government and Malaysia. He thinks the problem is better left between the Bangsamoro people and the Malaysian people to resolve. “We should not allow other people to come in. It might only aggravate the situation,” he said. Misuari lashed at President Benigno Aquino III for saying the Sultan’s claim and actions are “a hopeless cause”. “He knows nothing about what he is talking about. He will become a laughing stock in the whole world with the way he presents himself before the eyes of the peoples of the world.” Maintaining that he has no hand in the incident, Misuari said he is in the

midst of preparing for the resumption of peace talks between the Philippine government and the MNLF this month in Jakarta. Indonesia has offered to broker the resumption of the talks. Misuari sounded firm that peace is at hand in Mindanao, “if not for the Sabah problem.” Misuari said, he will leave the next day and meet with them [MNLF troops]. “Maybe the brother might want me to report to them about my travel abroad, and possibly will also include the whole Sabah,” he said. Misuari is expected to attend the 6th Mindanao Indigenous Peoples C onvent ion/2nd ATM G enera l Ass embly /1 st Bangsamoro-Highlanders Mindanao Grand Summit this afternoon where he will be conferred as “adopted sons of Mindanao” with senatorial candidate Jack Enrile. the sultanate’s men. The “intention of the entire sultanate is not to be intransigent but to start the long process of talks. What the situation required is listening to the sultanate’s demands,” said Abraham Idjirani, spokesman of the sultanate of Sulu and North Borneo in an AM radio interview this week. He bewailed Aquino’s tack which then consisted of sending a delegation to Lahad Datu to make them go back to the Philippines. “If they went there only to fetch our brothers, they are committing a sin against us, their brothers in the Philippines and not just those in Malaysia. In that case, there is already a connivance between governments of Malaysia and the Philippines,” Idjirani said. The Aquino government also threatened the group that charges may be filed against them. Charges include inciting to sedition and illegal possession of firearms, according to Justice Secretary Leila de Lima. Some critics countered though that the Aquino government needs to look at the position of the Sultanate of Sulu beyond Philippine laws, considering that the said Sultanate has been in existence even before the Philippines was “discovered” and named by Ferdinand Magellan. Tolentino of Katribu said the struggle for the rights of the country’s national minorities—both the indigenous peoples and the Moro people – is not recognized by the State. The Aquino government has a tendency to dismiss the indigenous peoples’ ancestral domain, and in the case of the Sultanate of Sulu, “Aquino has dismissed the Sultan’s assertion to claim Sabah as ‘foolhardy.’ This only reveals how the Philippine state abandons the issue and leaves the

Moro people on their own to assert their rights to their ancestral territory,” Tolentino said. What is happening in Lahad Datu, Katribu says, is the result of “the State’s negligence of minority issues.” The multi-sectoral group bagong Alyansang Makabayan (Bayan) also criticized Aquino’s “absurd point that recognizing the ownership of the Sultanate over Sabah and Sulu could pave the way for its eventual secession from the Philippines.” Sultan Jamalul Kiram and his siblings had repeatedly said they consider themselves as Filipinos and they are merely asking the government to assert their and the country’s claim to Sabah. Aquino’s sham patriotism is the true spoiler to peace process Aquino’s “defeatist” attitude concerning the Philippine claim on Sabah contrasts starkly with his administration’s treatment of the Spratlys and Panatag Shoal dispute with China, said Carol Araullo, chairperson of Bayan. She pointed out that in the case of Spratlys, no less than the head of state engages in open polemics on the territorial dispute at every available opportunity, domestic or international. “It has even filed a case against China for international arbitration,” she said. While “we have strong grounds to assert our sovereignty over the Spratlys and Panatag Shoal, we have even more compelling historical and legal bases to claim Sabah,” Araullo said. Bayan regards this double standard in handling the Sabah and Spratlys/ Panatag Shoal issues as a demonstration of the Aquino government’s “deceitful and sham patriotism.” It demonstrates, they said, that Aquino’s noises with China over territorial dispute has little to do with its patriotic duty to defend the national sovereignty and territorial integrity but more about “using the Spratlys/Panatag Shoal dispute to promote US imperialism’s hegemonic schemes in the region.” The Aquino government “is using the dispute with China to justify the ever increasing presence of American troops, warships, jet fighters and drones, and other war materiel in the country’s territory under the auspices of the Visiting Forces Agreement (VFA),” Araullo said. About the same time the Malaysian troops started shooting at the guards of Sultan Kiram in Lahad Datu, the negotiating panels of the Aquino government and the Moro Islamic Liberation Front (MILF ) were signing one of the completed annexes to the previously signed Framework Agreement. Unfortunately, the two parties reportedly said certain groups have been supposedly egging on the sultanate to act like a spoiler

to the peace process. “Aquino has subsumed the Sabah claim to political and geopolitical considerations, in particular the wish to bring an end to the Moro secessionist movement in the South through USbacked peace negotiations with the Moro Islamic Liberation Front (MILF) where Malaysia has played a key role as facilitator,” Araullo of Bayan commented in a statement. She said the Aquino regime, together with the US which has taken a hands-off posture on the Sabah stand-off, apparently views the Sabah claim as a potential stumbling block, if not complete spoiler, to inking the coveted final peace compact with the MILF. But Aquino’s handling of the Sabah issue is ultimately the true peace spoiler. As Araullo said, “The Aquino administration is not only surrendering our territorial integrity and national sovereignty, it is also creating conditions that make an enduring peace with justice in Mindanao more elusive.” (http://bulatlat.com)

Tuition... from page 3

Southern Mindanao spokesperson of Anakbayan, a nationwide mass organization of Filipino youth, however pointed out that not once, in their experience, have such consultations prevented the increases in tuition fees. In fact, Orendain said, such consultations are usually “staged” to the effect that students are practically rendered powerless in the face of such exercise. Orendain said they are dismayed as CHED is supposed to be “a regulatory body to control school fees,” but the agency instead, “has become an instrument in the launching of such staged consultations for tuition hikes in campuses.” “The CHED is practically useless in terms of protecting students from high costs of education,” Orendain said. A first year student of the University of the Philippines –Mindanao for instance, pays P600 per unit, so if a student enrolls in 20 units of courses, he pays at least P16,000 pesos per semester, Orendain said. A Bachelor of Science in Elementary Education student of the University of Mindanao pays P394 per unit, so he pays P7,900 for 23 units, on top of the almost P7,000 cost of miscellaneous fees, she added. A student of Ateneo de Davao University pays P900 per unit, so 20 unit enrollment would entail a cost of P18,000 per semester, exclusive of miscellaneous fees. Orendain said they expect many students to drop out next school year. “The costs of basic goods are already increasing. How can we expect our parents to be able to send us to school with such expected round

of increases?” Orendain said their group is set to conduct massive consultations with students from colleges and universities to discuss how they can oppose the increases. “Expect massive protests from students,” Orendain warned. (Irene V. Dagudog, davaotoday.com)

his duties and responsibilities expected of a commander and to implement President Aquino’s program of reform and peace and order. Among the activities during his short stint were Fluvial Parade and Kick-off Football for Peace spearheaded by Pres. Aquino to symbolize his support for the Framework Agreement on the Bangsamoro. It was jointly participated in by Moro rebels and APF personnel and held at the grounds of Camp Siongco. A media fellowship was also held last December where journalists and media practitioners from Cotabato, ARMM and South Cotabato gathered to socialize with the AFP personnel as partners in peacekeeping and peace-building. Gapuz, who swore to abide by the AFP’s principles of accountability and transparency especially in logistical and financial aspects says, “I will continue the peace efforts of my predecessors especially on the on-going peace process, the peace talks and the programs and projects that will help contribute to the attainment and maintenance of peace, order and security in Mindanao.” Present in the ceremony were line agency heads, AFP, PNP and LGU officials like Maguindanao Governor Toto Mangudadatu, Congresswoman Bai Sandra Sema, Cotabato City Mayor Muslimin G. Sema, and DILG Sec. Atty. Macmod Mending who represented the ARMM Regional Governor Mujiv S. Hataman, CSOs and stakeholders.

Clark International Airport (CIA)’s role as international gateway to Central Luzon is very important, being accessible to 23 million people from the National Capital Region and Central and Northern Luzon. Besides, Clark houses several industries such as manufacturing, logistics, services, airlines and tourism, among others. Lim said Cambodia airports have delivered Best Practice in airport management, which the Philippines can emulate. She said the airport in Cambodia is owned by the private sector. A French group Vinci owned 70 percent and a MalaysianCambodian joint venture have 30 percent stake in the airport.
