“A watered-down FOI bill will just reinforce what is already a pattern of information denial by the government which is fearful of genuinely engaging its citizens on policies it knows are antipeople and anti-developmental.” --Ibon Foundation By RONALYN V. OLEA of Bulatlat.com
Advocates of the Freedom of Information (FOI) bill have called for transparency in governance but what if the version that awaits approval by the Congress would institutionalize secrecy? The consolidated bill House Bill 6766 or the FOI bill lists ten points of exceptions, all of which are present in Malacañang’s version of the FOI. These exceptions
prompted the Makabayan coalition of progressive partylist groups in Congress to withdraw their sponsorship of the bill. Groups that frequently ask government agencies to release information on various matters also raised objections to the exceptions. ‘Misnamed’ Independent think-tank Ibon Foundation deemed that the current FOI bill bill | page 10

Amid GDP growth hype, Hike in tax collection jobs situation in PH worsens Business Matters
By PAT SAMONTE and JOEL PORTUGAL of Mindanao Daily News
BUTUAN City––Business permit tax collection for this year has increased by nine percent to P68,518,479.94 compared to 2012. This was learned from

THE reported 6.6% growth in the gross domestic product (GDP) in 2012 being played up has not improved the jobs situation in the country, which even worsened last year. According to research group IBON, the number of unemployed and underemployed Filipinos increased to 11.9 million in 2012. IBON estimates that the number of unemployed Filipinos increased by 48,000 to reach 4.4 million and the number of underemployed by 349,000 to reach 7.5 million in 2012 – for a total of 11.9 million
unemployed and underemployed. The unemployment rate remained at 10.5% while the underemployment rate increased significantly to 20.0% from 19.3% the year before. These figures are based on IBON’s estimates on official data correcting for the change in methodology that now underreports unemployment. The official government unemployment figure for 2012 is 7.0% but which is also unchanged from the year before. As it is, the Philippines still has the worst worsen | page 10

Move to save forests of mining town snowballs By CHRIS V. PANGANIBAN of Mindanao Daily News
ROSARIO, Agusan del Sur--Better late than sorry. Local government executives here have snowballed a movement to protect and preserve what has critically left of this mining town’s forest reserve inside the watershed areas. Ironically, the move to revitalize the multi-sectoral forest protection council could be a big challenge considering that multi-millionaire Mayor Jose Cuyos and most of the local officials are engaged in gold mining tunnel operations and small-scale logging activities. Cuyos, a former “habalhabal” passenger motorcycle driver who struck big fortune from an abandoned gold mining tunnel in the “high grade” mountainous small-scale mining areas called “red mountain” is seeking reelection in the coming May polls. At the meeting held at the session hall of the Sangguniang Bayan on Monday, Municipal Environment and Natural Resources Officer Nemesio de Paz admitted the move to save the remaining forest of the town’s watersheds is a tall order because the local government has not prioritized environmental protection as a matter of policy. “We need to redirect to our degree of priority,” de Paz said as he warned in his power point presentation that the forest reserves particularly in Maputi Spring move | page 10

TWO separate explosions rocked Northern Mindanao in less than 12 hours wounding nine and killing one on Monday. The first explosion occurred in Tubod, Lanao Del Norte near a bus stop past 11:00 Monday morning wounding five people. The second explosion took place in a remote farming village in Baungon, Bukidnon past six Monday evening wounding four and killing one. An army report identified those wounded in the Tubod explosion as Judith Padilla Gomez, Pamela Dalman, Cherrie Molina, and Peter de la Vega, all of Iligan City. The other was Saipuden Bucay of Bulod, Tubod, Lanao Del Norte. Rescuers brought the victims to a hospital in Baroy, Lanao Del Norte. Maj. Edgardo P. Amores, spokesperson of the army’s 1st ‘Tabak’ Division based in Pagadian City, said that an improvised explosive device placed in motorcycle went off in front of Ysmael Restaurant along the national highway in Tubod, Lanao del Norte past 11 Monday morning. Amores said that investigators were looking at politics as possible motive of the explosion since town mayor Sultan Johnny Tawantawan of Salvador, Lanao Del Norte, and his lawyer
Yusop Omar were eating at the restaurant when the explosion occurred. He said the military and police were trying to establish identities of the suspects and the ownership of the motorcycle parked by an unidentified person near a bus stop in front of the eatery. Inspector Christian Relebo, of the Baungon police, said that an unidentified person lobbed a grenade and strafes the house of Puklawan family past 6:30 Monday evening in the farming village of Balintag, Baungon, Bukidnon wounding four and killing a member of the family. He identified the lone fatality as Ramil Blanela Puklawan who went missing Monday night. Police recovered his body with various shrapnel wounds and a bullet wound early morning Tuesday in the rabbles of lumbers demolished in the explosion. Relebo said that police also recovered a magazine with live ammunition of a carbine rifle and several empty shells in the place of explosion. Police were still looking into the motive of the grenade throwing and strafing of the house of Puklawans. Relebo said that the police were suspecting a group of armed bandits roaming in the hinterlands of Bukidnon responsible in the grenade throwing and strafing of the Puklawan’s house.CD

Senator Loren Legarda, the Chairperson of the Senate Committee on Climate Change pressed the national government to undertake continuous reforestation programs as some 887 kms of forest area are denuded every year. In Bukidnon, the increasing demands of urbanization have led to environmental transgressions such as illegal logging and intentional forest fires. Law-making body of the Province of Bukidnon should legislate total log ban. We have noticed large areas of forest lands all over the country have been converted to mining and marginal upland agriculture. Based on the 2001-2003 satellite imageries of the Forest Management Bureau of the Department of Environment and Natural Resources (DENR),the total forest cover of the Philippines is estimated at 7.168 million hectares or only 24.27 percent of the country’s total land area. As an archipelago our country is vulnerable to climate change. We had already experienced droughts, storms, severe floods with increasing intensities and frequency in the past ten years. All these must be considered, reforestation must be continuous effort all citizenry in response to climate change.

Duterte gives 24 hours for drug pushers, murder-for-hire to leave Davao By MARILOU AGUIRRE-TUBURAN of DavaoToday.com
DAVAO City Vice Mayor Rodrigo Duterte, once again, gave his classic tough guy ultimatum to drug pushers and killers: leave the city in 24 hours. As to a former councilor linked to drug syndicates, Duterte also gave him 48 hours to prove his innocence. Duterte made the statement addressing those who had links to police personnel SPO4 Allan Balingit who was killed during a police operation at 1 AM the Sunday February 3. Balingit, allegedly, had been involved with drug syndicates. “Kamong tanan nga konektado niya, dili na ta magbinolahay. Kabalo mo nga kamo akong ginatunong. Tagaan ta mo’g 24 oras. Makita ta mo sa Davao, mosuroy ko. Sorry na lang. Ayaw kog mahaya (Those of you who are connected to him, this is not the time for joking. You know that I’m referring to you. I’m giving you only 24 hours. I will go around the city and once I see you, you’ll be sorry. Don’t blame me.),” Duterte warned during his weekly television program Gikan sa Masa, Para sa Masa, February 3. He mentioned an unnamed jail guard, who was also allegedly involved with the crimes. “Ang imong buhaton, isulod na ang imong kaugalingon sa prisohan. Unya hangyoa ang warden nga ikandado ka sa sulod (I’m telling you, surrender now. You ask the jail warden to lock you up in the prison cell),” Duterte advised the said jail guard. Of Balingit, Duterte said “Dugay na man nako ning gi-istudyohan ang iyang lihok (I’ve been investigating him).” He also showed a matrix linking Balingit with other individuals in the police, government and the civilian community. He also named alias Kano, Winay, Ponyong, Bruce Lee and one from Bangkal. “Ang uban naa na sa prisohan, ang anak ni Galope, number one man pud to dinha sa Talomo [Some are already in prison like Galope’s son who was number one (drug pusher) in the Talomo area],” he said. There are over 10 individuals on his list, including their profiles, which he DUTERTE | page 10

THINK a minute. Have you ever missed a bus or plane because you were just a little too late? Recently I had to catch a plane for a very important meeting, so I got to the airport early and waited for the announcement to board the plane. The announcement never came. When I finally went to the gate, I was shocked to see it was closing and the airplane engines had started! I panicked and tried to get the airline worker to let me on. I had nothing to lose and was desperate so I told her I wasn’t asking for justice, I was begging for mercy. Well, she did not give it to me. You know that terrible
Think A Minute Jhan Tiafau Hurst feeling when you’ve done something wrong and you know you deserve to suffer the consequences? Every religion, except Christianity, has certain rules or rituals and good deeds that people must do to try to earn their god’s forgiveness for their wrongs. Some religions even make people torture and punish themselves to pay the penalty for their own wrongs.
But Jesus Christ showed that there is absolutely nothing we can do to earn or deserve God’s forgiveness for all the wrongs we’ve done. Not even our religious prayers, duties, and deeds come close to paying our debt to Him for all our sins. We don’t need justice, we need mercy! None of us can ever reach God’s standard of perfect goodness in everything we
think, say, and do. That’s why God the Son became a human being to do it for us. Jesus said that our only hope is His mercy, because He has already paid the penalty for all our sins by giving His own perfect life for us on the cross. We just have to ask and believe that He will give us His free gift of forgiveness and new, eternal life. Then we can start life all over again, loving Him and living His right way that He plans for us to enjoy. So today, won’t you ask Jesus for His free gift of forgiveness and new life? Then ask Him to start changing you so you can live His successful and satisfying way He created you for. Just Think a Minute.
The Initao experience: Rigging the May elections
THE Commissions on Elections (Comelec) said that the mock elections conducted nationwide on SatATTY. MARIO T. JUNI atty. roberto a. cantago jr. urday were successful. It said that Legal Counsels the Comelec was able to identify some problems, which could mar the smooth conduct of the midterm marketing PartnerS elections in May this year. A Venture Mktg Corp. (PCOS) machines validated only about 10 ballots out Pinagkaisahan, Makati City of 20 ballots casted. The case in Initao was worth studying. The incident JUN ESCUADRO-0917-511-1724 44 Lungos, Pulilan, Bulacan could take place in almost all parts of the country during elections. The Comelec invited 50 voters to cast votes in RICHARD ALMENANZA-0920-9467267 all places in the country where the mock elections took Suit 701 C Dansalan Condominium place. Initao was not an exemption. Mandaluyong City However, of the 50 voters invited to cast votes in Initao Elementary School, only 29 voters reportedly FREDDIE PAR-0932-867-2326 participated in. We could say that the Initao experience was isolated. In justifying, Comelec officials said that the forms used as election ballots in Initiao were inferior - the reason PCOS rejected the election forms. After all, the PCOS machine would have to try four times in validating the ballot before the Comelec decides whether the vote becomes invalid. The argument might be sensible. Observers believed otherwise. Comelec Chair Sixto Brillantes said that whether doomsayers were here to assist the Comelec were another thing. Brillantes could not blame the electorates especially the opposition candidates of thinking the possibility of rigging results of the May elections. Considering that automated elections, rigging its results through electronic tamperings would also not be far behind. It is true that each PCOS machine functions separate and distinct from the other. This is as far as considering ordinary thinking. The truth is that technology adopts common language that makes automation possible. Information engineers and technologists know how these integers interact under a common condition. They know how to manipulate the characters of automation. Well, I would say that the automated elections are invulnerable to rigging and fraud. On the contrary, information technologists say otherwise. React crisguardian@yahoo.com

LIFE’S INSPIRATIONS: “… I love you, Lord, my strength. The Lord is my rock, my fortress and my deliverer; my God is my rock, in whom I take refuge, my shield and the horn of my salvation, my stronghold…” (Psalm 18:1-2, the Holy Bible). -ooo“SC DECLARES LIBEL AS UNCONSTITUTIONAL”: Article 354 of the Revised Penal Code, which provides for the crime of libel, has already been declared unconstitutional by previous Supreme Court rulings, a ranking member of the tribunal is reported by the Manila Bulletin to have clarified during the oral arguments on 15 petitions questioning certain provisions of Republic Act 10175, or the Cybercrime Law of the Philippines. In its report written by veteran newsman and longtime Supreme Court reporter Rey Panaligan, the Manila Bulletin quoted Senior Associate Justice Antonio T. Carpio as having explained that, because of these previous court rulings on the
Kakampi mo ang batas Atty. Batas Mauricio unconstitutionality of the existing libel law, “Art. 354 cannot stand scrutiny of constitutionality.” The Bulletin however failed to indicate in the report what these rulings or decisions of the Supreme Court were. Mr. Panaligan should have pursued this matter in his article, because this is the first time I am reading that the Supreme Court, allegedly through its previous decisions, actually declared Art. 354 of the Revised Penal Code as “unconstitutional”. -oooLIBEL IS VIOLATIVE OF THE 1987 CONSTITUTION: I am taking particular interest in the article because I have printed here, for a number of days about two months ago, several parts
of a petition which lawyer and UP Law Professor Harry Roque filed for various nongovernment organizations asking the Supreme Court to declare Art. 354 of the Code and its provisions punishing libel as contrary and violative of the 1987 Constitution. Basically, Roque argued that, on several grounds, the provisions on libel of the Revised Penal Code are completely and violently against the freedoms of the press and of speech enshrined under the Bill of Rights of the Constitution. While the Constitution allows complete freedom of the press and free speech, libel stif les these freedoms. Roque also argued that the 1987 Constitution contains a provision adopting
all international agreements and treaties which the Philippines signed and entered into, so that these agreements and treaties are parts of the law of the land which are obligatory in this country. One such international treaty requires the abrogation of any law on libel in the State that signed it, and since the Philippines signed that treaty, it is bound to obey it and therefore remove libel as a criminal offense. -oooPENAL CODE PROVISION ON LIBEL A NULLITY: Here is a part of what I wrote here on January 03, 2013: “Quite clearly, the gist of the arguments presented before the Supreme Court by UP Law Prof. Harry Roque and other groups and personalities to remove libel as a crime in the Philippines is that the 1987 Constitution contains a provision which prohibits punishing libel as a crime, on account of an international treaty that the country signed and approved. “Roque said in an declares | page 10

is misnamed “because it institutionalizes government confidentiality and secrecy to the detriment of genuine transparency, accountability and participation by citizens in democratic governance.” The HB 6766 exempts information pertaining to national security or defense, information that refers to the foreign affairs of the Republic of the Philippines from public access. Records of minutes during decision-making and policy-formulation, including the opinions and advice given then, are not to be disclosed. Drafts of resolutions, ordera, memoranda or audit reports of any branch of government are also to be exempted from access. Any information that pertains to internal or external defense, law enforcement and border control is also not to be disclosed. Information obtained by any committee of either House of Congress in executive session is also to be exempted from disclosure. Other exceptions include trade secrets, personal information of a natural person, classified as privilege communications in legal proceedings by law or by Rules of Court, and if information is already made accessible through other means. “The Malacañang-driven bill confirms that the government is afraid of genuinely empowered citizens who will take them to task for their pro-foreign and pro-elite governance,” Jose Enrique Africa, executive director of Ibon Foundation, told Bulatlat.com in an email interview. Africa lamented that “policy-making is already very secretive and opaque” and the restrictions in the FOI bill “would just formalize and institutionalize what is already being done under an Orwellian-speak Freedom of Information law.” Orwellian describes the situation, idea, or societal condition that George Orwell identified as being destructive to the welfare of a free and open society. Already secretive In a recent report, Presidential spokesman Edwin Lacierda claimed that FOI proponents “had no qualms” about the Aquino administration’s transparency. “In fact we have been very transparent and, in fact, we intend to show you the list of measures that we have done to show that we have been transparent in our transactions,” Lacierda said. Lacierda’s statement is contrary to what Ibon Foundation has experienced as well as the results of independent studies. Africa revealed that several times government agencies denied them vital information. Among the official requests the research institute made include information on far-reaching

The group also asked for data on the oil monopolies in the country, particularly oil pricing, trade, stocks and inventory data; on mining firms’ operations, particularly environmental impact assessments; on so-called anti poverty programs, the operational data and impact assessments of the conditional cash transfers, on the US military presence in the country particularly data on visits by US land, sea and air forces, and many others. A recent report by USbased International Budget Partnership listed the Philippines as one of the 77 countries that failed to meet basic standards of budget transparency. A 2011 study by the Philippine Center for Investigative Journalism (PCIJ) revealed that access to information is “more difficult” under Aquino compared to the previous administration. “The Office of the President is among the topnotchers in denying transparency,” Malou Mangahas, PCIJ executive director, revealed during a forum in 2011. Dangerous provisions Africa said the exemptions for records of minutes and drafts pre-empts real participation at the crucial early stages of policymaking. While there is already jurisprudence that expressly limits executive privilege, Africa noted, it is not a standing absolute blanket right rather, as the name implies, “a privilege that moreover needs to be justified on a case-to-case basis.” “Expressly exempting records and drafts institutionalizes undemocratic executive secrecy. All these exemptions abridge the people’s right to participate in the most important social, economic and political decisions of government,” Africa pointed out. The group also said that “the very broad and very general definition of national security unfortunately means that information on foreign affairs can also be included among the exceptions from disclosure.” Ibon Foundation has been consistent in its research work on international agreements that affect Filipino people’s lives. “The government is already abusing its authority and control over information as it is – the anti-FOI law just gives them further legal basis for doing so,” Africa said. Me anw h i l e , hu m an rights group Karapatan also raised alarm on the inclusion of “national security” in the list of exceptions. In an interview, Cristina Palabay, secretary general of Karapatan, said the Malacanang-imposed FOI would provide “legitimate
mechanism to absolve state actors in cases of human rights violations.” “Every violation cannot be investigated thoroughly as state forces or the President can easily invoke national security in non-disclosure of information,” Palabay said, “This also blurs the question on command responsibility.” Palabay said invoking national security is “very dangerous” as this “would abridge almost all civil and political rights of the people.” “With the realities today – many are being killed, disappeared and tortured by state security forces – a Malacanang-sponsored FOI bill would worsen the violations,” Palabay said. “There is so much information that, were it available to the public, could be used to feed a more genuinely democratic and consultative process of decisionmaking,” Africa said. “A watered-down FOI bill will just reinforce what is already a pattern of information denial by the government which is fearful of genuinely engaging its citizens on policies it knows are anti-people and anti-developmental.” (http://bulatlat.com)

BPLD OIC chief Paul Cabrera said that from January 2 to 23, 2013, the city’s business permit tax take climbed to nine percent above the P66,775,232.10 collection in 2012. Collection for 2013 marked an increase for the third straight year, he said. Records show that in 2010, the city collected P48,527,633.66 in business permits tax, and P61,171,171.96 in 2011. Dizon said that compared to 2010, when Mayor Ferdinand Amante, Jr. took over as city chief executive, the city’s business permits tax collection jumped to 70 percent. Meanwhile, the city government will receive a Performance Challenge Fund amounting to P3 million pesos. A report from the city mayor’s public information said the PCF has been alloted for this city as representatives from the Local Government Academy and International Finance Corporation arrived to conduct actual inspection of the Business Permits and Licensing Division. The LGA and IFC representatives conferred with BPLD OIC chief Paul Cabrera, OIC City Treasurer Arthur Castro, City Administrator Leah Mendoza and Vice-Mayor Lawrence Lemuel Fortun about the reforms introduced in the city’s business permits and licensing system resulting in consistent increases in annual tax collections. They also interviewed BPLD employees and clients. Cabrera said that since Mayor Ferdinand Amante,
Jr. implemented the Business Fastlane Program as part of reforms in the Business Permits Licensing System, tax collections have “tremendously and consistently increased.” The P3 million Performance Challenge Fund is seen as the city’s award for improving its tax collection system. It will be used for the installation of fountains at the renovated Guingona Park here.

unemployment in East Asia compared for instance to Thailand (0.6%), Singapore (1.7%), Malaysia (3.0%), Korea (3.0%), China (4.1%), Taiwan (4.3%), Vietnam (4.4%), and Indonesia (6.5%). According to IBON, the jobs situation has worsened because the Aquino administration has not changed the failed economic policies of past administrations, which have already resulted in over a decade of jobless growth in the country. The last decade has seen the fastest growth in the post-Marcos era, yet has also seen record joblessness and increasing numbers of poor Filipinos aside from severe inequality. The government’s hype is meant to create an appealing image of the Philippine economy for foreign investors, even if the growth figures are meaningless to the ordinary Filipino. The group stressed that jobs and higher wages are the best mechanisms for inclusive growth, which can only be achieved with welldeveloped Filipino industry and equitable agricultural development. Sustainable job generation and poverty reduction requires active and responsible state intervention to build Filipino industry and develop local agriculture, IBON said.

which is the main source of potable water to residents of the Poblacion is already depleted and even threatened by the presence of mining tunnels at the top of the ridge. He also disclosed the P17-million farm-to-market road connecting remote villages has been already dilapidated because this also served as roads used by overloaded trucks carrying illegal logs. Engr. Marianito Bayron, Municipal Planning and Development Officer, said watershed management is now a major concern for the local government because the quality and quantity of water supply from the sources is already critical. “We need to track down the prevailing issues so that we will plan,” Bayron said. For his part, Bayron also admitted environmental governance got a failure mark in the “State of Local Government Report for 2011” prepared by the
Department of Interior and Local Government while adding that the town council has yet to enact an ordinance to declare as protected areas, the town’s watersheds. The Catholic churchb as e d Par ish Pastora l Council-Justice,Peace and Integrity of Creation agreed with the reports and disclosed in their own studyt from an ocular visit in the watershed areas that there are not enough trees aside from rampant small-scale mining activities at the foot of the mountain. Alarmed by the reports, local mediamen attending the meeting challenged local officials to get their acts together and lead the drive to save the remaining forest of the watershed areas. “Are the local officials willing to commit all the way?” asked Max Tutor, station manager of DXSF 96.1 ‘San Franz Radio” FM as he particularly challenged Mayor Cuyos to lead by example and spearhead the move. During deliberations to formally organise the Municipal Mult-Sectoral Forest Protection Council, a move was raised to let local officials lead in the covenant signing before a large gathering later this month to show their sincerity to save the remaining environmental resources of their gold-rich town.

said he will furnish to the Philippine National Police, the Commission on Human Rights and the Department of Justice. In his typical tough guy fashion, Duterte held no punches and said he’s ready to be sued in court saying, “Idemanda lang ko. Walay problema sa akoa (Just sue me).” “Dugay na kung nagsulti. Kung mosulod mo (dinhi), mopugos gyud mog negosyo, kay panginabuhi man ni, kwarta man ning droga ug murder for hire, mag-unay ta diri (I’ve been warning you. But if you insist in running your (dirty) business here, then you’ll be dealt with accordingly),” Duterte said. Meanwhile, Duterte pointed at the Mini-Forest in Boulevard as the stronghold of drug syndicates in the city. “Pinakamalakas ang droga dyan, may 24-hour camera kami, hinayaan ko lang dyan (Drugs are rampant there. We have installed surveillance cameras in a 24-hour basis,” Duterte revealed, saying prohibited drugs coming from outside the city are being unloaded/delivered in the area, especially at dawn. With this, he took a lashing at village captain and former councilor Amilbangsa Mandin. “Ako nagdududa ako sa yo. Kahibalo ka nga kontra ko gyud na, wala gyud kay gibuhat. Naa pay balita nga nagabayad daw ang mga pusher dinha sa imo as protection (I’m suspecting you. You knew all along that I oppose that kind of activity, and you just did nothing. There are even loose talks that pushers are paying you for protection),” he said. He gave Mandin only two days to prove his innocence. “I am demanding now that you resign or get out of the way. Otherwise, I will transfer the police headquarters right in your home. And I will also demand the PNP to transfer their headquarters in the Mini-Forest. Bahala na’g mag gyera mo dinha (I don’t give a damn if a war will erupt there),” he warned. Duterte said he’s doing this to avoid problems in the future. “I expect you to do something about it. I’ll give you about 48 hours. Iprove mo sa akin na wala kang pakialam dyan sa droga, na hindi ka kasali. Pero makialam ka sa law and order (Prove to me that you have nothing to do with it. If you’re not involved with drugs, then be involved with law and order,” he said. “Kung mag combine yang droga at murder for hire, kung walang droga, mag shift dyan sa murder for hire at kidnapping, then we have a problem (The combination of drug pushing and murder-for-hire is dangerous. If there are no drugs to sell, they will shift to murder-forhire or kidnapping. That’s when we’ll have bigger problems),” he said. (Marilou Aguirre-Tuburan/ davaotoday.com)
