Prosecutors, police attend forum for ‘effective conviction’ of cases

BFAR-10 to investigate ‘fish kill’ in Oro barangay

CAGAYAN de Oro City— The Bureau of Fisheries and Aquatic Resources in Region 10 (BFAR-10) yesterday said it will investigate to determine what really caused the “massive dieoffs” in Barangay Tablon on Sunday morning.

Some residents in Purok 12, Baloy in Barangay Tablon were in festive mood after valley of dead “Tamban” (sardines) surfaced on the shore around 10 in the morning. Some residents

even ate the dead fish after cooking.

But Dr. Jennifer Marie Rivero, a veterinarian at BFAR-10, said people should not have eaten the dead fish until the agency could determine what really caused its death, although she noted that the fish appeared to be in good condition and the sea water contained no toxic substance.

“We would highly discourage eating the fish, since we don’t know what caused its death,” said Rivero in an interview in the BFAR-10

regional office in Barangay Macabalan on Monday.

Rivero said a fish kill could occur with the change of the quality of the water, illegal fishing practices, and the release of sewage of manufacturing facilities into the sea.

The village’s coastal area is the site of a handful of factories, among them a corn processing factory and a dressed chicken facility.

Rivero noted there were reported fish kills in the past few years.

Waste woes demand long-term investments from LGUs: expert

AN expert said there is a need for local government units (LGUs) to invest in anaerobic digesters - tanks where microorganisms break down biodegradable waste into useful material - to improve solid waste management (SWM) nationwide.

"Long-term SWM investments will help turn biodegradables into organic fertilizer and biofuel while protecting the environment and reducing the volume of trash for disposal," said Eligio Ildefonso, executive director of the National Solid Waste Management Commission (NSWMC) Secretariat.

Ildefonso stressed the urgent need for anaerobic digester investments stems from the increasing volume of waste, as well as the government crackdown on illegal dumpsites and the permanent closure of the Payatas sanitary landfill where Quezon City had been dumping its trash.

The government target to increasingly divert waste from landfills increases this urgency, he added.

According to experts, anaerobic digestion is a biological process that occurs naturally when microorganisms break down organic matter in environments with little or no oxygen.

Data from the Environmental Management Bureau (EMB) indicate the extent of biodegradable waste and the potential for harnessing the anaerobic digestion process in several Metro Manila LGUs. The data showed that biodegradables account for the bulk of waste in the cities of Caloocan (48.6 percent); Mandaluyong (46 percent); Marikina (46.54 percent); Pasay (41.20 percent); Quezon (54 percent); Taguig (52.37 percent); and Valenzuela (46 percent); as well as the municipality of Pateros (57.46 percent).

Biodegradables also form a significant part of waste in Las Piñas (27.73 percent); Makati (36 percent); Parañaque (28.36 percent); and Pasig (38 percent).

The volume of waste Metro Manila LGUs dispose of daily varies from 487 cubic meters in Las Piñas to 3,507.7 cubic meters in Caloocan, according to the

EMB data.

"LGUs can reduce the volume of waste for disposal by turning biodegradables into organic fertilizer and biofuel through anaerobic digestion using proper facilities," said Ildefonso, noting that locally available basic anaerobic digesters cost about PHP1 million each.

To meet financing requirements, he said several barangays could form a cluster and pool their funds to purchase an anaerobic digester for their common use.

"That will be more practical and cost-effective in the long run than transporting all waste to sanitary landfills," he said.

The Department of Environment and Natural Resources (DENR) earlier announced plans to close down a total of 500 illegal dumpsites nationwide before 2022, with more than 50 of them due to be closed this December.

The department warned that it would file charges against local officials who would allow the operation of illegal dumpsites in their areas of jurisdiction.

Such moves are aligned with the intensified implementation of Republic Act 9003 on Ecological Solid Waste Management.

Last month, the DENR also rejected Quezon City's request to reopen the Payatas sanitary landfill until December due to various environmental violations in the dumpsite and its susceptibility to trash slide.

With Payatas' closure, the NSWMC noted that Quezon City can opt to bring its garbage to the sanitary landfills in Rizal province's Rodriguez and San Mateo municipalities as well as in Pampanga province's Clark area and Bulacan province's Norzagaray municipality.

Taguig City Mayor Lani Cayetano recognizes the need for more cost-effective SWM measures, noting that hauling waste in her area of jurisdiction is becoming "overwhelmingly expensive".

She said Taguig collects an average of 550 tons of waste a day, mostly from restaurants in high-end Bonifacio Global City.

Lumad elders, leaders to meet with BTC on BBL provisions A 34-MEMBER panel comprising Lumad (Indigenous Peoples) elders and leaders will engage the 20-member Bangsamoro Transition Commission (BTC) in a roundtable discussion in relation to the 36 provisions of the draft Bangsamoro Basic Law (BBL) that may “adversely impact our rights and way of life.”

Lawyer Reuben Lingating, chair of the five-member Indigenous Peoples (IP) panel recently created by the Office of the Presidential Adviser on the Peace Process (OPAPP) said on Sunday that the Mindanao Indigenous Peoples Legislative Assembly-BBL (MIPLA-BBL) Panel of Representatives is composed of 34 elders and leaders from the Autonomous Region in Muslim Mindanao (ARMM), Zamboanga Peninsula and Caraga whose ancestral domains cover some parts of the territory of the ARMM. The ARMM, which is the proposed core territory of the Bangsamoro, the new autonomous political

entity that would replace the ARMM, comprises the provinces of Basilan, Sulu, Tawi-tawi, Lanao del Sur and Maguindanao and the cities of Marawi and Lamitan.

It is not clear how many among the 34-member panel of representatives come from the proposed core territory of the Bangsamoro.

But the BTC, the body tasked to draft the BBL, has two Lumad representatives from the proposed core territory of the Bangsamoro, one nominated by the government and the other nominated by the MILF. The BTC is supposed to be a 21-member Commission but one Commissioner, Samira Gutoc Tomawis, resigned in the early days of the Marawi Crisis citing personal reasons and policy questions.

Lingating said the meeting between BTC and MIPLABBL panel will happen in two weeks after it was moved from September 1, the closing of the three-day MIPLA at the Mergrande Ocean Resort in

Talomo, as it was a nationwide holiday in observance of the Eid’l Adha (Islamic Feast of Sacrifice).

He said members of the MIPLA-BBL Panel of Representatives will meet again to consolidate the output of the seven group sessions during the legislative assembly after the roundtable peace conversation with the BTC members.

He said the BTC and MILPA-BBL panel representatives will “engage separately or jointly the Congress.”

The BTC submitted the draft of the new BBL to President Rodrigo Duterte on July 17. It was transmitted to the two houses of Congress in mid-August but has yet to be filed as a bill in either house.

The BBL is not on the list of 28 priority bills agreed upon by the Legislative Executive Development Advisory Council.

Lingating said the OPAPP “provided for a new peace table to serve as a platform of peace conversation between

them so just to exhaust all remedies available to them as diverse peoples, with distinct identities, culture, history, and political conceptualizations in dealing with their aspiration to be united as Bangsamoro peoples following the Administration’s policy of inclusivity in the peace process.”

He said they have submitted to IP Committee representatives in Congress the result of their “sharing, discourse and proposals concerning 36 provisions in the BBL that may adversely impact their rights and way of life.”

81 barangays in Normin drug-free

CAGAYAN de Oro City-The Philippine Drug Enforcement Agency (PDEA) has declared 81 drug-free barangays in Northern Mindanao region as a result of their intensified anti-drug operation and drug clearing program as of June 29.

Agent Joerick S. Tacal cited during the monthly meeting of the Regional Law Enforcement Coordinating Committee (RLECC) region 10 that the province of Misamis Occidental has the most number of drug-free barangays with 43; Misamis Oriental, 18; Camiguin, 12; and Bukidnon, 8. Lanao del Norte, however, has not declared a single barangay yet.

Based on the Dangerous Drug Board, before a certain barangay will be declared as drug-free, they must undergo assessment and validation with the chief of police and certified by the mayor, PDEA, the Department of Health and Department of the Interior Local Government (DILG) before the issuance of certificate for drug-free.

These parameters include non-availability of drug supply; absence of drug transit/transshipment activity; absence of clandestine drug laboratory; absence of clandestine drug warehouse; absence of clandestine chemical warehouse; absence of marijuana cultivation site; absence of drug den, dive or resort; and compulsory drug treatment and rehabilitation processing desk.

Also, absence of drug pusher; absence of drug user/dependent; absence of protector/coddler/financier; active involvement of barangay officials in anti-drug ac-

tivities; active involvement of Sangguniang Kabataan (SK) to help maintain the drug liberated status of the barangay; and existence of drug awareness, preventive education and information and other related programs.

The PDEA, Tacal said that among the general guidelines provided in the drug-clearing program are the mandatory creation of Barangay Anti-Drug Abuse Councils (BADACs); the conduct of barangay drugclearing operations which is divided into three phases, namely the Pre-Operation Phase, Operation Phase and Post-Operation Phase; the classification of barangays in determining the priority areas for clearing operations; the duties of local chief executives in the barangay drug-clearing program; and the penalty for non-compliance.

The BADACs were deputized and empowered to plan and implement strategic policies; and evaluate programs and projects on drug prevention and control, given the political and police powers of the barangay to administer the affairs of the community.

The conduct of sustaining clearing operations against drug-affected barangays in the initial phase include the activation of BADACs, capability enhancement of all stakeholders through seminars, preventive education and trainings, organization of house clusters to determine all essential facts of illegal drug activities happening in the neighborhood, submission of report containing watch-list of drug personalities, establishment of a

rehabilitation referral desk in every barangay, among others.

The Operation Phase is the actual implementation of drug supply and demand reduction strategies in drugaffected areas. This is where PDEA and other support agencies come into play.

The Post-Operation Phase is aimed to maintain the ‘drug-cleared’ status of the barangays after drugclearing operations through sustainable support projects such as sports, religious and social activities, implement sustainable livelihood projects as a reintegration program to former users and pushers, and continuing anti-drug awareness programs.

Tacal noted that the local chief executives are duty bound to ensure the organization of BADAC in all barangays within their territorial jurisdiction, allocation of substantial portion in the barangay budget and ensure compliance with the duties and responsibilities of the BADAC in the antidrug campaign.

Meanwhile, PDEA in coordination with the Philippine National Police (PNP), National Bureau of Investigation (NBI) and other operating units made a total of 364 anti-drug operations from July 1, 2016 to June 30, 2017 which resulted to the seizure of drugs with an estimated value P18,875,111.91.

Reactivation of Gensan’s anti-bird flu task force set GENERAL Santos City-The city government is set to reactivate its special task force against avian influenza or bird flu as it moves to maintain the entire area free from the viral disease.

Dr. Antonio Marin, chief of the City Veterinarian’s Office (CVO), said preparations are underway for the reactivation of the General Santos City Avian Influenza Task Force (GSCAITF) in coordination with the Department of Agriculture (DA) in Region 12.

He said City Mayor Ronnel Rivera has scheduled a meeting with concerned stakeholders on Sept. 7 for the revival of the task force.

The official said the GSCAITF will be headed by the mayor and composed of officials and representatives from the CVO, DA, City Agriculture Office, City Health Office, city police, Army-led Joint Task Force

GenSan and the city poultry raisers association.

“We are initially planning to hold a series of trainings for task force members and the city’s quick response team (QRT),” he said.

Marin said the trainings will include mechanisms on monitoring and surveillance activities, and the proper use of prescribed personal protective equipment or PPE. He said QRT and GSCAITF members will utilize the PPEs in taking blood samples from chickens and birds that could be infected by the disease.

The task force and QRT are tasked to respond and handle cases of possible bird flu outbreaks within the city’s 26 barangays.

The team will spearhead the implementation of quarantine measures, collection of samples and proper testing for suspected cases.

“The collected blood

samples would be sent to the DA laboratory in (Barangay) Lagao for confirmatory tests,” Marin said.

He was referring to DA12’s Regional Animal Disease Diagnostic Laboratory here.

As of Tuesday, the official said the city remains free from bird flu, which could potentially affect humans, and measures are being undertaken to prevent the entry of the disease in the area.

DA-12’s Veterinar y Quarantine Services has been closely monitoring the city airport, Makar port and the public transport terminals for the possible shipment or movement of live fowl and poultry products from bird flu affected areas in Luzon.

The agency earlier quarantined a shipment of fighting cocks that entered the city through a commercial flight from Manila.

Greenhouse effect and Climate change

THE blistering heat in the past days has taken a toll on my immune system.

Cough and cold breached my biological clock. Headaches and insipidness seems to be the order of the day.

Definitely, there appear to be changes in the planet’s temperature. Everybody could feel it.

Unlike in our younger days, the heat of the sun seems bearable. Lately, the heat of the sun seems to penetrate the human skin.

One could feel that something’s wrong. Obviously, climate change is changing everything in the planet.

One of the most accepted observations is the “global warming” phenomenon.

There are a lot of theories that contribute to global warming. One of the most popular is the “greenhouse” effect. The other is that the Sun, the center of the Sombrero Hat nebula, is getting nearer the solar system where planet Earth is. In most cases, the latter appeared to be realistic.

The greenhouse effect is based on the theory that the Sun’s heat is captured

in the Earth’s atmosphere instead of bouncing back to space.

Scientist blamed the greenhouse effect of atmospheric pollutants where carbon gases build upon the Earth’s atmosphere.

The pollutants are divided into primary and secondary pollutants.

Primary pollutants are substances that are directly emitted from the car exhausts (carbon monoxide) sulfur dioxide from coal-fired power plants and factories, and the ash from a volcanic eruption.

The secondary pollutants are not emitted directly.

Rather, it is formed in the air when the primary pollutants react or interact. An example of the secondary pollutant is the “ground level Ozone.”

Ozone is formed when the pollutants emitted by cars, coal-fired power plants, industrial boilers, refineries, chemical plants and other sources react chemically in the presence of Sunlight.

The ground level, Ozone is Sulfur Dioxide (SO2),

Nitrogen Oxides (NOx), Carbon Monoxide (CO), an odorless, colorless, poisonous gas, Particular Matter (dust, ash, salt particles), and Volatile Organic Compounds (VOC’s), a highly reactive organic compound.

The scientist concluded that “ozone at ground level is a harmful air pollutant.”

Thus, the greenhouse effect, which contributed to the heating up or rising of planetary temperature, takes place with the combination of the primary and secondary pollutants.

These pollutants are too thick in the atmosphere that it traps the sunlight when it entered the Earth’s atmosphere.

A classic example of the “greenhouse” effect is sitting inside a car - without an aircon - with all its doors and windows closed under the sun. While the sun’s visible light could not penetrate in the car, the sun’s Ultraviolet rays can. With a close doors and windows, the sun’s UV could not escape resulting in the building up of heat inside the car. Thus, if one stays

any longer in the car – with all the doors and windows closed – under the heat of the sun, dehydration sets in, which means certain death.

Now, we are experiencing the greenhouse effect.

Even if one stays at home, the greenhouse effect could still be felt. It is only lucky that Planet Earth is still capable of synthesizing the pollutants in its atmosphere.

Under this situation, people could still live normally.

However, how long can the Earth sustain the atmospheric pollution? Yes, one of the elements that a Planet needs in order to survive is carbon dioxide.

The Earth has abundance of carbon dioxide, which being consumed by the plants and forests. Arellano, who was removed from office by the National Electrification Administration in July 2017 after finding him guilty of “grave misconduct, dishonesty and conduct prejudicial to the best interest of the electric cooperative and its member-consumer-owners” in connection with an anomalous power supply contract with the FDC Misamis coal plant in Villanueva, Misamis Oriental.

1.1 Considering that the misconduct of GM Arellano was in connection with power supply contracting, it is probable that the power supply contract between BUSECO and NBPC is also prejudicial to the interest of BUSECO and the member-consumer-owners of BUSECO. Therefore, we suggest that further hearings on the application should be cancelled by the ERC, and the application that was submitted to the ERC by BUSECO should be returned to BUSECO for scrutiny by the new general manager of BUSECO. 1.2 It may be appropriate on the part of the new general manager of BUSECO to write to the ERC a letter to withdraw the application for the approval of the PSA between

BUSECO and the NBPC. 2. From the allegations of BUSECO in their application, it is apparent that BUSECO did not carry out a generally-accepted process of least-cost acquisition of power supply (as required by the EPIRA) prior to entering into the power supply agreement with the NBPC. For one thing, BUSECO did not make any advertisement in a newspaper of general circulation calling for proposals from power suppliers to supply its peak power requirement.

And BUSECO did not invite an adequate number of generating companies to submit proposals to supply the new power requirement of BUSECO. Only two generating companies were invited to submit proposals to supply peak power to BUSECO, and the two gencos that were invited to submit proposals had non-comparable power plants, one a diesel-fueled power plant and the other a solar photovoltaic power plant. The two power plants could not be logically compared with each other to determine the bid which would be more advantageous to BUSECO. In effect, the Competitive

ASEAN likely to adopt declaration on rights of migrant workers

MANILA -- The Philippines is optimistic that the declaration on the protection and promotion of the rights of migrant workers will be adopted by the leaders from Association of Southeast Asian Nations (ASEAN) this November.

The Philippines’ yearlong hosting of the 50th ASEAN Summit will culminate with the Leaders’ Meeting.

“Most of the (JCM) meetings will discuss the remaining outcome documents which are not yet released.

Hopefully, migrant workers instrument would be finalized; the text by October and then by November for adoption by the leaders,” he said in an interview this week.

Under the declaration,

ASEAN member states recognized the importance of adopting appropriate and comprehensive migration policies on migrant workers.

They also acknowledged

the need to address cases of abuse and violence against migrant workers, whenever such cases occur.

Apart from the migrant workers’ instrument, Bolivar

further said ASEAN members are also working on key statements and declarations, including those on countering terrorist financing and climate change.

ASEAN groups 10 countries are Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, the Philippines, Singapore, Thailand, and Vietnam.

CMB settles Nestle strike; P223M CBA benefits inked

The two-month strike at Nestle Philippines in Lipa, Batangas was settled recently following a series of conciliation meetings, the National Conciliation and Mediation Board reported yesterday.

The Manggagawa ng Nestle Lipa Factory – Philippine Transport and General Workers’ Organization (NCWU-PTGWO), the company’s workers’ union and Nestle management signed a P223 million fiveyear collective bargaining agreement to benefit the 263 rank-and-file employees.

The CBA signing was witnessed by Labor Secretary Silvestre Bello III and NCMB Executive Director Shirley Pascual together with the Conciliation Team.

“I commend the parties for resolving their differences in between scheduled conciliation conferences to expedite the bargaining process that resulted to a P223 million worth of economic package for the workers,” Bello said.

The CBA provides for a P12,000 wage hike spread over a period of five years and a host of other benefits for workers including the increase in medical and hospitalization benefits and special occasions and holidays incentives.

Cebu Pacific defers A321neo deliveries; orders 7 A321ceo instead

Leading Philippine carrier Cebu Pacific (PSE: CEB) ordered an additional seven A321CEO (Current Engine Option) aircraft from Airbus, for delivery from March 2018.

The aircraft will meet the airline’s increased capacity requirements pending the start of delivery of 32 A321NEO aircraft starting the 4th quarter of 2018.

CEB has chosen to defer the A321NEO deliveries due to delays in the delivery of the Pratt & Whitney engines selected to power the aircraft.

Maute uses unexploded bombs vs. govt troops MARAWI City--As government troops tightened the grip around ISIS-inspired gunmen in Marawi City, the terrorists are fighting back with all they have, including unexploded ordnance dropped from warplanes.

Armed Forces Western Mindanao Command (WestMinCom) Chief Lt. General Carlito Galvez said fighting has been intense during the past two days along Quezon Avenue that runs along the Banggolo business district.

Galvez said the terrorists have been using everything they have from Molotov cocktails to improvised explosive devices (IEDs) fashioned from plastic water bottles.

He estimated around 45 ISIS-Maute gunmen are still fighting it out in a small pocket in the city.

“Only 300 structures remain to be cleared from 600 previously but our troops are finding more IEDs in the buildings,” Galvez said of the slow progress of the government troops.

Three soldiers died while 52 others were injured when they took back control of Bayabao Bridge in Banggolo last week.

Capt. Joane Petinglay, spokesperson of AFP Joint Task Force Marawi, said most of those injured were inflicted by IEDs.

A military officer who is familiar with the fighting said the terrorists got hold of explosives by salvaging unexploded ordnance and bombs dropped by the Philippine Air Force warplanes.

“They cut up the shells and bombs to get to the gunpowder and put them in small plastic bottles. They really know the stuff,” he said.

Galvez said the ISIS gunmen inside Marawi were able to get reinforcements despite the presence of gunboats watching Lake Lanao, the country’s second biggest lake.

He said the reinforcements of one or two persons hide behind water lilies or water hyacinths to camouflage themselves and taking advantage of bad weather at night.

“We believe one or two gunmen were able to reinforce those in the main battle area using these tactics,” Galvez said.

Last week, government troops repulsed a small group of terrorists out to attack the nearby town of Marantao and spoil the opening of classes at the Mindanao State University.

The seven Airbus A321CEO planes have a total value of US$812 million, based on current list prices and will be on top of the existing order of the 32 Airbus A321NEO aircraft.

He said the DOJ is demanding this of its prosecutors on the ground not to compete, but to complement the police capabilities and skill set.

Fadullon said only by working together can the law enforcement and prosecution be effective in upholding the criminal justice system.

What prosecutors should do, he said, is to help the police in “looking for the right kind of evidence” that would lead to the conviction of the accused.

Regional Prosecutor Merlynn Uy said there must be cooperation and collaboration between the law enforcement and the prosecution.

For his part, Chief Superintendent Timoteo Pacleb, Philippine National Police-10 (PNP-10) regional director, said the regional police have a healthy working relationship with the prosecutors in Northern Mindanao.

“We are always working closely with them (prosecution), especially in the [investigation of cases],” Pacleb said.

He said the Martial Law Special Action Group (MLSAG), a special agency composed of the law enforcement and state forces, raided Pamatong’s compound in Sitio Tabucnai, Barangay Tablon last August 31.

fragmentation grenades, military uniforms, combat boots, inverted Philippine flags, American flags and other items.

The MLSAG raiding team carried with them a search warrant issued by a judge after neighbors complained for harassment allegedly committed by the lawyer’s firearm-wielding men.

Oclarit has dispelled the allegation from Pamatong that the firearms and explosives found inside the compound were planted.

He said it was unlikely that the items seized from the compound were put there on purpose by authorities since the raid was conducted with the presence of local government officials and members of the press who were covering the search.

“We have no personal grudge against him, we just based our search on the complaint of individuals,” Oclarit said, referring to the alleged planting of evidence against Pamatong.

He said should the court issues an arrest warrant for Pamatong, the CIDG and MLSAG are prepared to apprehend him and his cohorts.

“The government forces are ready for any eventuality after the warrant of arrest is issued,” he added.

He said they are still hunting for the suspect adding they are intensifying their intelligence gathering and to monitor his movements so he can be located.

2 killed in MILF, BIFF clashes in Maguindanao C O TA BAT O C I T Y - Fighting between joint government forces and Moro Islamic Liberation Front (MILF) and ISISinspired Bangsamoro Islamic Freedom Fighters (BIFF) in Maguindanao has continued, the latest of which happened Sunday that left two MILF fighters killed.

The MILF Task Force Ittihad (Unity) clashed over the weekend with BIFF Esmael Abdulmalik faction in Barangay Tee, Datu Salibo, Maguindanao, Capt. Arvin John Encinas told reporters.

Among those reported killed was an operation officer of MILF 118th base command.

Encinas, spokesperson for the 6th Infantry Division, said the Army has been providing blocking positions around the so called “SPMS box” or the adjoining towns of Shariff Aguak, Pagatin (Datu Saudi town), Mamasapano and Datu Salibo.

Fighting between MILF

and BIFF has been going on since three weeks ago after the ISIS-inspired group tried to encroach MILF communities in the SPMS box.

Von Al Haq, speaking for the MILF, said his group will continue to defend its areas to prevent the ISIS-inspired armed men from encroaching civilian communities.

Under the 1997 ceasefire agreement between the government and the MILF, the rebel movement is mandated to help the government get rid of terrorists and kidnappers.

Senior Supt. Agustin Tello, Maguindanao police provincial director, said the police have remained on alert alongside the Army’s 601st Infantry Brigade and 2nd Mechanized Infantry Brigade to prevent spillover of clashes between the MILF and BIFF to other Maguindanao towns and in North Cotabato.
