AGAYAN de Oro City--Malacañang ordered Cagayan de Oro City Mayor Oscar Moreno to submit a verified answer (not a motion to dismiss) in 15 days in connection with the charges filed against him involving the missing P79 million, a former barangay official here said Wednesday.

CAGAYAN de Oro City-The Bureau of Customs in Region 10 (BOC-10) has ordered a shipping vessel not to set sail unless it could rectify its alleged infraction, which authorities said have falsified its documents just to pay lower taxes and duties to the government.

CAGAYAN de Oro City-Mandatory drug testing begins at city hall.

This as the 18th City Council during its 55th regular session Monday presided over by Vice Mayor Raineir Joaquin V. Uy enacted an ordinance promoting a drug-free workplace in the city of Cagayan de Oro through the conduct of a mandatory drug test to all officials and employees in the city government.

The ordinance was authored by Councilor Edna “Inday” Dahino, chair of the committee on women and family relations, and on finance, budget and appropriations.

Relative to this, legislators also appropriated P1.2 million to cover the cost for the conduct of the mandatory drug testing, and authorized its inclusion in the city’s Supplemental Budget.

“Reefs do not form overnight. They take thousands of years to develop,” he said, adding that the coral reef crisis cannot be resolved by coral gardening as it is expensive and is not practical.

Coral gardening is the cultivation of corals for commercial purposes or coral reef restoration.

According to him, the method is also risky as instead of actually repairing the damaged coral reef, it might harm the reef even more.

Another sad reality is that, he said, 80% of the coral mortality is actually caused by various human activities and not natural calamities.

MARINE biologists and experts recently put forward science-based solutions that address issues in coral protection in the country.

Dr. Wilfredo Roehl Y. Licuanan, in his talk entitled “Current Status of PH Coral Reefs and Prospects for the Near Future’”, recommended to “fix the reef first before transplant.”

He was speaking at the recent forum on National Coral R&D Program which highlighted the current status of the Philippine coral

reefs, the importance of research for the conservation of corals, the exploration of our scientists and researchers of the Philippine Rise and its overall impact to the economy of the Philippines.

“The better thing to do is to take care of the remaining reefs,” he said.

Dr. Patrick C. Cabaitan, also a speaker, discussed the topic ‘Sexual Production of Corals and Why Sex is not Enough?’

He said that studying coral reefs is essential to

the economy of the Philippines as they also provide for the ecotourism of the country. He emphasized that scientific intervention is an important tool in coral production.

“C o r a l s r e p r o d u c e through asexual and sexual means, but sex is not enough for the corals,” he said.

He suggested that researchers or anyone interested in studying corals pursue basic science to un-

derstand reefs; consider other ecological processes in conducting reef restoration efforts, and integrate restoration with management efforts.

CAGAYAN de Oro City-President Rodrigo Duterte once again reiterated his call for a clean, honest and corruption-free government.

Speaking before business executives of the local and national chambers of commerce in Cagayan de Oro City during the 26th Mindanao Business Conference and Expo, Duterte disclosed his intention to abolish 3 government agencies, as these he said, have become “uncontrollably corrupt.”

Of the two national agencies, however, Duterte specifically exposed the questionable practices of the Sugar Regulatory Administration. The President said that the present management hired the services of an overpaid consultant.

Recent unverified reports from sources inside the agency diclosed that the Administrator of SRA contracted consultants for the formulation of a Disaster Risk Reduction and Management Program, one

of the consultants was apparently paid P1.2 million in six months for the professional services rendered.

The lavishness of the agency seemed to have earned the ire of the President, who said during his State of the Nation Address and reiterated many times, that he will not allow excessive, extravagant, and unconscionable salaries, allowances, incentives, benefits and bonuses across all GOCCs. The NTC says that there are, again, many text messages being circulated by unscrupulous persons which say that the recipients of the text messages won hundreds of thousands of pesos in a raffle contest which they did not participate in, in the first place.

The latest text messages in this scam say that the cellphone users won P500,000.00 from the PAGCOR, or the Philippine Amusement and Gaming Corporation, and that this amount could be received from the PAGCOR Chair-

man. If the cellphone users are duped into believing the text scam, they would then be asked to shell out money, allegedly to expedite the release of the raffle prize.

1. The new GM can withdraw the application for approval of rates for the PSA that was submitted to the ERC by the dismissed GM. As I pointed out in the report, the PSA between BUSECO and NBPC did not go through a legitimate least-cost acquisition process (as evidenced by the Power Supply Plan that was submitted during the initial hearing by BUSECO), and BUSECO did not conduct a generally-acceptable process of power supply procurement prior to negotiating

the PSA with NBCP. (The ERC claims that BUSECO did a CSP that is compliant with ERC requirements, but the process carried out by BUSECO would not comply with EPIRA requirements.

This issue against ERC will have to be brought to the Court of Appeals.)

2. The new GM can also apply in the legal courts (or even with the ERC, if the present commissioners are removed) for the cancellation of the PSA between BUSECO and FDC Misamis Power Corp.

The old GM of BUSECO was dismissed by the NEA after finding him guilty of “grave misconduct, dishonesty and conduct prejudicial to the best interest of the electric cooperative and its member-consumer-owners” in connection with the

power supply contract with FDC Misamis coal plant.

The PSA with FDC Misamis could therefore be annulled for being prejudicial to the interest of the MCOs. How prejudicial? The consumers are paying 5.18 pesos per kWh for power supply from FDC Misamis, when they could be paying only around 4.00 pesos per kWh for power supply from other coal plants in Mindanao.

3. The new GM can also apply in the legal courts (or the ERC with a new set of commissioners) for the cancellation of the PSA for power supply from the Mt. Apo geothermal power plant, because the PSA was entered into without going through any form of competitive procurement of power supply.

power supply that being paid by BUSECO consumers are brought down to fair and reasonable levels, we can go forward to the 14 other electric cooperatives that have PSAs that are exorbitantly priced, so that these rates also can be reduced to reasonable levels.

And the way to do this is to organize the consumers at these electric cooperatives so that they can work at correcting the anomalies in their electric cooperatives.

The foundational framework of federalism

QUEZON City--Many federalism advocates were expecting President Rodrigo Duterte to push even harder for federalism in his second State of the Nation Address.

But the President could only say that this matter is something “we have to tackle sooner or later.”

That time has come given that the members of his Consultative Committee on constitutional reform have been named, although they have y et to be formally announced.

Pertinently, the leaders of both chambers of Congress have declared that federalism will be treated as a priority in the Second Regular Session of the 17th Congress. Although it must be noted that their respective committees responsible for constitutional reform have already conducted hearings towards this end.

So the same federalism proponents may be right.

The federalization of the Philippines is indeed about to begin.

Apolinario Mabini be-

lieved that federalism, “besides being the most perfect among the republican forms, is best suited to the topography of our country”. Clearly, this is an endorsement of federalization that must not to be ignored.

However, a caveat not be ignored as well was raised

by Raphael N. Montes in Understanding Federalism, “Designing a federal system is not a very easy task. Besides its basic principles, federalism is very customizable. The peculiarities of a country would define the different features of its own brand of federalism.”

In sum, a federal structure of government is a good fit for the country but defining the nitty-gritty of the federal framework will be very difficult. In the words of our President, this endeavour would entail “long, very contentious discussions”.

Stick out your tongue

THINK a minute.

Have you noticed that one of the first things a doctor does when he examines you is ask you to stick out your tongue.

It’s sometimes possible to know what’s wrong inside a person’s body just by looking inside a person’s mouth. Some diseases and sicknesses can actually be seen on a person’s tongue.

In fact, our tongue gives away many other things about us. Our accent and way we talk shows where we’re from. Our tongue also reveals what’s inside our heart and mind.

We usually talk about the things we really care about, such as money, status, food, gossip about others, or sports. But even more than our words and actions, it’s our reactions that show what kind of person we really are inside.

Most of the time we can be good actors and control our tongue, especially when we want to impress and look good in front of others. So we carefully choose our words before we say them.

But then if somebody suddenly wrongs and hurts us, we may react quickly out of anger and try to hurt them

back with unkind words.

It’s in those unexpected pressure times that you and I show what is really in our heart by what comes out in the words on our tongue.

We show our true feelings of anger, pride, prejudice, or unforgiveness, which we usually hide under the nice mask or act we put on in front of others.

But Jesus Christ loves us and knows we cannot clean and change our talking until we’ve first cleaned and changed our heart inside.

Just like clean water cannot come out of a water tank that’s dirty inside,

debate. But there are three fundamental features of a federal framework which are indispensable. These are: 1) a streamlined allocation of responsibilities between the central and state governments; 2) a state government structure that reflects a collective approach to governance; and, 3) mechanisms that foster cooperation and collaboration among the state governments in addressing national concerns.

First, the assignment of responsibilities between the federal and state governments must be clear and coherent. The distribution scheme must be formulated in such a way that the designation of accountability

is unequivocal.

This prescription is very critical because the correct allocation of tax powers and other revenue-raising measures between the two levels of government hinges on it.

It will also influence how the scope of federal legislative power is delineated.

Second, the current subnational government apparatus must be replaced because it has entrenched the patronage relationship between the local executive and his constituency. An effective countermeasure against this culture of patronage in local politics is to integrate a sense of community at the state level government. The structure itself must be configured to

facilitate a collective governance mindset.

An example of such would be a parliamentary type of configuration like the “leader-and-cabinet model” used by local governments in the United Kingdom. As a corollary to this restructuring, the mechanism of sectoral representation can be further enhanced in the “cabinet” to widen and deepen community participation in policy formulation and implementation.

Other measures to ensure the sustained and significant involvement of the people in local politics such as an anti-local dynasty mechanism and political party prescriptions are like-

Indeed, federation is not just about the devolution of political and fiscal powers to the sub-national level, but it is also about institutionalizing coordinated efforts towards national development.

Business sector sees Asean membership beneficial to PH

HE business sector in the countr y has the lowest appre ciati on of the benefits that come with its membership in the Association of Southeast Asian Nations (ASEAN).

This was according to Dr. Sheila Siar, research information director at the Philippine Institute for Development Studies (PIDS).

Siar shared this in her presentation of the Philippine results of the study “What Does the ASEAN mean to ASEAN peoples?” during the Public Symposium on Building the ASEAN Socio-cultural Community held recently in Davao City.

The symposium was organized by PIDS and Jakarta-based Economic Research Institute for ASEAN and East Asia (ERIA), in partnership w it h t h e M i n d a n a o Development Authority (MinDA) and the ASEAN Society.

According to Siar, the ERIA-funded study, which was also conducted in other ASEAN members t at e s , s h ow e d t h at Filipino respondents from the business sector agree that the country’s membership in ASEAN is important in increasing

access to international markets, travel, and jobs, as well as in maintaining peace and stability.

These benefits, however, are perceived by the business sector as meagerly impacting the county, she said.

Perceptions and challenges Siar pointed out that this response can be attributed to issues related

to trade, investment, and regulation that continue to affect the business sector. As an example, she cited a PIDS study conducted by Dr. Erlinda Medalla and Melalyn Mantaring of the PIDSled Philippine APEC Study Center Network.

The study showed the negative effects of nontariff barriers on the Philippines’ trade

activities with other ASEAN countries.

Corruption also remains a major issue in the ASEAN region.

Moreover, the business sector reported moderate awareness of ASEAN. Siar said this was also found in other respondent groups, including those from government, academe, and civil society. In general, all of them reg istere d mo derate awareness of ASEAN and moderate identification as ASEAN citizens.

This can be explained in part by the low media coverage of ASEAN, which also figured in other ASEAN memberstates.

In the case of Indonesia, Dr. Alexander Chandra, associate fellow of the Habibie Center in Jakarta, mentioned that the media only focuses on domestic or negative news. “ASEAN news is [considered] not controversial, hence ‘not sexy’ for media coverage,” said Chandra.

Other recommended strategies include holding cultural heritage activities that emphasize unity in diversity and increased use of traditional and social media.

Yazaki-Torres told to regularize 5,000 workers

T

he Department of Labor and Employment (DOLE) has ordered the management of Yazaki-Torres Manufacturing Inc. in Calamba, Laguna to regularize close to 5,000 of its workers after its contractor, Kabalikat sa Hanapbuhay MultiPurpose Cooperative, was found to be a labor-only contractor.

Based on the compliance order issued by DOLE Regional Office IV-A Director Zenaida Angara-Campita, Yazaki-Torres Manufacturing Inc. was found to be engaged in labor-only contracting arrangement and the Kabalikat sa Hanapbuhay Multi-Purpose Cooperative in Sto. Tomas, Batangas, was found to be a labor-only contractor.

The principal employer Yazaki-Torres Manufacturing Inc. is engaged in manufacturing, production, and assembly of wiring harness and related products.

Kabalikat is its contractor.

The DOLE, through its

Labor Laws Compliance Officer (LLCO), initially conducted joint assessment at Yazaki and its contractor last February and March where a number of violations were found.

Yazaki was found to be contracting out jobs, work, and service with an in-house agency that does not have substantial capital or investments in the form of tools, equipment and machinery. It was also proven to be engaged in prohibited practices, such as hiring of employees under a training modality called “Barangay Assistance Training Program (BATP).

The labor inspectors were also able to establish that Kabalikat was a laboronly contractor because it does not have control over the performance of its workers since Yazaki provides the directives and instructions to the workers. DOLE also found that the contractor is operating with an expired D.O. 18-A registration.

Not only do they love teaching others, but the subject material they teach thrills them. Stories abound of wouldbe teachers switching out of college majors to pursue the career they love.

In other cases, teachers work with their sub-

ject material – whether it is English, Math, Science, or whatever – in arenas beyond just their classroom. They feel complete when they work with and talk about what they love.

The truth is that teachers regularly love “this stuff,” whatever it is they may be teaching.

The question is, “How can passionate teachers get their students to be passionate, too?” After all, unless students have some degree of interest in the topic, they are not going to be motivated to excel.

Be open with your own passion. It’s unbelievably boring to learn from someone who doesn’t even seem

The Malacañang order pertains to the case involving the issuance of eight “unrecorded and unsubstantiated disbursement vouchers” with a total amount of P79 million by the City Treasurer in 2015 in favor of Oscar Moreno as the Payee.

The order cited the findings of the Commissions on Audit (COA) in Region 10 dated May 19, 2015, which reported that Moreno along with the city treasurer, city budget officer, and city accountant, “acted surreptitiously in releasing the eight checks.”

The checks cover the city government’s account in the Philippine Postal Service Bank, the Philippine Veterans Bank, the Land Bank of the Philippines, and the Development Bank of the Philippines (DBP).

According to the COA findings, the checks were issued and cashed out, but the covering vouchers, payrolls, and their documents were reportedly submitted in violation of COA circulars 2012-005 and COA circular 2009-006.

The COA reported that the eight checks were missing, not recorded in the books of account. The Malacañang order involved anti-graft cases filed against Moreno as Cagayan de Oro City Mayor.

In the same order, Malacañang dismissed the charges against the City Treasurer, City Budget Office, and City Accountant for the lack of jurisdiction.

Last week, Moreno obtained a consolidated temporary restraining order (TRO) from the Cagayan de Oro-based Court of Appeals (CA) in connection with six dismissal order by the Office of the Ombudsman involving graft and corruption cases.

His lawyers said that the CA granted their petition to issue a consolidated TRO involving the six dismissal orders of Moreno by the Office of the Ombudsman.

The Office of the Ombudsman has also issued a separate 18 dismissal order against Moreno after the City Mayor obtained a TRO against the six dismissal orders.

The case stemmed from an anti-graft cases filed when Moreno was then provincial governor of Misamis Oriental before he jumped to Cagayan de Oro City and ran for the city mayor.

Aside from ordering Moreno dismissed from service together with eight other city officials (formerly working at the provincial capitol in Misamis Oriental), the anti-graft court also filed 18 criminal cases against Moreno with the Sandiganbayan in August 2017.

Moreno is facing 48 anti-graft cases with the Office of the Ombudsman allegedly involving unauthorized and illegal rentals of heavy equipment amounting to P20.5 million considered by the COA as “fictitious.”

A month before the local elections in 2016, the Ombudsman had, including the recent dismissal, already dismissed Moreno 50 times from service, but the complainants were dismayed because the DILG always served the order late like when it served the dismissal order only in June, days before the

city leadership changed hands in July 2016.

However, the DILG was able to serve the Ombudsman order the day before the 10-day period required to serve the order expired. Thus, the then Vice Mayor formally assumed the post as City Mayor.

Moreno, however, contested the DILG order and obtained a TRO from the local CA although the dismissal order was already served and the Vice Mayor already officially installed.

Since 2016 until 2017, Moreno easily gets TRO and subsequently the writ of preliminary injunction (WPI) from the CA every time a dismissal order by the Office of the Ombudsman is issued against him.

He said the ship was en route to an oil milling facility in Jimenez, Misamis Occidental to deliver the copra when a team from BOC-10 and the Philippine Coast Guard boarded the ship on August 28.

“Customs then coordinated with the MARINA, which later issued a certification that the vessel’s special permit to operate in the BIMP-EAGA was fake,” Enciso said.

The Customs then inquired about the records of the duties and taxes that they paid, but the ship’s 19 Filipino officers and crew reportedly failed to present any proof.

According to BOC-10, it found out that the ship’s owner, Villa Shipping Lines Inc., allegedly deceived the government by making it appear that the M/V Jake Vincent Seis was plying the ports within BIMP-EAGA when its operations was only limited to domestic routes in the Philippines.

Enciso said the ship’s owner allegedly pretended to use the vessel in plying the BIMP-EAGA route purposely to avail of the privileges of not paying duties and taxes, adding some shipping lines resort to this modus operandi to get away with paying less obligations to the government.

If the M/V Jake Vincent Seis is plying within the BIMP-EAGA shipping route, he said, “the ship is covered by the Free Trade Agreement that would allow the vessel to deliver and pick up cargo within the member countries… If it was imported for this purpose it would have been spared from paying the duties and taxes.”

“But if the ship was converted to travel only within domestic waters, they would have to get clearance from government agencies such as the Maritime Industry Authority (Marina) and the BOC,” Enciso added.

In a separate interview, Jamail Marohomsalic, BOC-10 district collector, said the M/V Jake Vincent Seis was issued with a warrant of seizure and detention by the agency on September 8.

“If the ship was not diligently searched, we would not have found out about the bogus special permit they presented in order to legitimize their activities,” said Marohomsalic.

Samson Pacasum, the subport collector at the Mindanao Container Terminal (MCT) in Tagoloan, Misamis Oriental, said they are on a lookout for vessels that may have falsified its papers or, carrying undeclared or illegal items within its jurisdiction.

For his part, Nash Guro, chief of the MCT Assessment Division, said they are intensifying their efforts to ensure that all cargo vessels that dock at the MCT port have the proper permits.

Dr. Hildie Maria E. Nacorda, in her talk entitled ‘On the Benham Bank Biodiversity: Taking Learning to the Next Step’, discussed the expeditions the

Philippines has done to determine the economic potential of Benham Rise, now called the Philippine Rise.

Though the two expeditions done in 2014 and 2016 have discovered the existence of marine species in the Philippine Rise, Dr. Nacorda said that further studies are needed to fully understand the potential of the rise.

Initial findings of the nationwide assessment of coral reefs In relation to this call to the public of the marine experts to help in the preservation of the remaining coral reefs, DOST and Department of Environment and Natural Resources are working on a coral reef assessment throughout the country to create a National Coral Reef Status next year.

This is because despite of the Philippine archipelago being well known for its species-rich coral reefs, there is a lack of updated information on the present status of its coral reefs.

The initial findings of the Nationwide Assessment of Philippine Coral Reefs by Licuanan, et al were published in the Philippine Journal of Science last June 2017.

Reefs sampled were randomly selected from around the country, with the number of assessment stations for each of six biogeographic regions stratified by the total area of reefs in each of these regions.

For two years, 166 reefs have been sampled.

Based on live coral cover, more than 90 percent of the sampled reefs are in the poor and fair categories.

So far, the mean hard coral cover of the country at 22 percent is comparable with that of the Indo-Pacific region, but much lower than previous estimates for the Philippines.

According to her, the push for establishing the ASCC was grounded on the idea that “Southeast Asia must be bonded together as a partnership of caring societies.”

In 2007, during the Philippines’ chairmanship of ASEAN, the summit adopted the theme, "One caring and sharing community", to highlight the importance of the socio-cultural dimension of the ASEAN integration. The Philippines pushed for the Cebu Declaration on the protection and promotion of the rights of migrant workers. This initiative, according to her, was met with resistance given the conflicting interests between the migrant sending and receiving economies in the ASEAN. The Cebu Declaration directs the 10 ASEAN member-states to develop effective mechanisms to safeguard migrant workers, including an ASEAN instrument to protect and promote their rights.

Ten years after the declaration, there is still no legally binding instrument or treaty to implement the commitment. However, Arroyo is hopeful that under the

Philippines’ chairmanship of the ASEAN this year, the instrument to implement the Cebu Declaration will be finalized and signed in November during the ASEAN Leaders’ Summit.

Meanwhile, Prof. Hidetoshi Nishimura, president of ERIA, lauded ASEAN’s decision to include the ASCC as a major pillar of the ASEAN Community.

He noted ASEAN’s emphasis on upholding cultural diversity and social harmony, which are at the core of the ASCC. According to Hidetoshi, this “was insightful and clearly different from the integration process of the European Union”.

“Mindful of the diversities among its member-states, ASEAN discovered the consensusbuilding approach [which] today is called the ‘ASEAN Way’.

Despite their diverse cultures, languages, religions, and political systems, ASEAN has built peace and stability as a region and as a community in the past five decades,” Nishimura said.

The whole-day forum was filled with panel discussions and presentations on various topics, including education, social protection, the Brunei Darussalam-Indonesia-Malaysia-Philippines East ASEAN Growth Area, human rights, and peace and security.

In her closing remarks, PIDS Senior Research Fellow Erlinda Medalla, who represented PIDS President Gilberto Llanto, stressed the importance of instilling in the minds of ASEAN peoples the relevance of the association and regional integration in their lives. “This is where the role of strengthening the socio-cultural aspect of integration comes in. In a region where 10 diverse cultures come together to form a community, it is important that the people understand the beginnings and journey of ASEAN.” Meanwhile, Secretary Datu Abul Khayr Alonto, chair of MinDA, called on ASEAN members to build stronger ties in order to move forward in “united steps in the midst of disputes and differences”.

Alonto also urged ASEAN peoples to take pride in the fact that they belong to a “culturally diverse yet united ASEAN”. He expressed his hope that the people in the region can work together gradually, creating an ASEAN consciousness that recognizes “Southeast Asian neighbors as more than just trading partners and political allies, but as partners for change and development.”

“Yet, the email addressees and the cellphone owners never at any point joined any raffle or purchased any lottery ticket.

Surprisingly, however, many are still enticed to respond, and, much to their regret, later on find out that they were duped into sending either cellular phone loads or money supposedly to be used for processing the prizes to be given to them.

“The key here is this: those doing these scams know that many Filipinos are too greedy for sudden riches, and could therefore be easily victimized.

It must be emphasized that for the government structure to be truly federal, the new charter must depart from the non-self-executory standing of local autonomy in the 1987 Constitution. Meaning, these three fundamental attributes of federalism must be evident in the text of the projected federal constitution itself and should no longer require any enabling legislation for its institutionalization.

A last caveat that must not be ignored comes from noted federalism expert and constitutional scholar from the Melbourne Law School, Professor Cheryl Saunders. She warns that whatever the final federal design is, there should be amongst the people both a shared understanding of what has been created and a shared commitment to making the new system work. Otherwise, federalization may not produce the outcomes many Filipinos are so excited about right now. (Michael Henry Ll.
