BUTUAN City--Epifanio Guinsod, a tribal leader in the mountain village of El Rio in Sibagat town, is among thousands of residents in Agusan del Sur allegedly duped by vested interest groups to cultivate their farm lands with Napier grass for the production of environment-friendly bio-fuels. Already holding an ATM-like membership card, Guinsod was promised by representatives of an investment firm called “Secura” with P36,000 next year for the production of Napier grass in his one hectare lot and P12,000 each for three releases annually in the following years as payment for

the harvests of such crops. The Secura agricultural investment scam has also spread in other towns including La Paz, Rosario and Veruela because of the promising quick money payment scheme but the legitimacy as a duly recognized business entity remains to be seen.

Secura representatives was reported to have collected a total amount of P800,000 from the thousands of residents who just even paid for their membership fees alone amounting to P150 each. The town council in Veruela however passed a resolution to prohibit farm | page 10

NBI collars ‘Sayyaf ’ with P600k bounty ZAMBOANGA City––A suspected member of the Abu Sayyaf Group who carries a P600,000 reward for his arrest was apprehended on Tuesday in this southern port city by the combined National Bureau of Investigation (NBI) and police operatives. NBI Regional Director Manuel Almendares on Wednesday reported the suspect was arrested inside a shopping mall in downtown Zamboanga City around 12 noon Tuesday. Almendares identified the suspect as Algaber Said alias ‘Talha’ who was nabbed for kidnapping with serious illegal detention. Said carries a P600,000 reward. Said, who allegedly serves as “spotter” of the Abu Sayyaf Group, was arrested when he was sighted inside the shopping mall, Almendares said. The suspect has been tagged as involved in the June 2001 Lamitan siege and the Dos Palmas kidnapping in May 2001, Almendares said.

MALAYBALAY City -- The newly-installed provincial director of the Philippine National Police (PNP) in Bukidnon vowed to focus on law enforcement and peacekeeping campaign to maintain law and order in the province. DIPOLOG City – Around 60 percent of liquefied petroleum gas (LPG) dealers in Zamboanga del Norte, including the twin cities of Dipolog and Dapitan, were violating regulations on LPG business, according to Supervising Science Research Specialist Edmar A. Derla. In the forum on downstream oil industry held here, Mr. Derla refused to name names, but warned that DOE had set penalties for every violation

EMB bares Macajalar Bay water sampling results By: Jorie C. Valcorza CAGAYAN de Oro City The Environment and Management Bureau (EMB) conducted, Wednesday, a public hearing for the water classification of Macajalar Bay in Misamis Oriental. The activity is a way of getting comments and consensus of the stakeholders on their preferred classification based on the revised water criteria under DENR Administrative Order No. 34 (DAO 34). EMB 10 Director Sabdullah C. Abubacar stressed there are the two basic considerations for the process. One is based on its beneficial use and the other on its water quality. He, however, noted that analytical results of the water quality is only secondary and is made to confirm the classification. The EMB, together with the Japan International Cooperation Agency (JICA),

have already completed the necessary field survey, in which they were able to conduct a three-year series water sampling activity, scheduled twice in a year to cover both the dry and wet season.

The sampling stations were distributed in all 14 towns covering the 65 kilometer stretch of the Macajalar Bay coastline from La Esperanza in Kinoguitan town to Laguindingan. Engr. Marivic F. Llui-

sima, chief of the EMB 10 laboratory section said that the towns will either be classified as class “SB” and “SC,” depending on the water sampling results generated, in consideration also to its best usage.

“SB” classification is good for Recreational Water Class 1 (Areas regularly used by the public for bathing, swimming, skin diving, etc.) and fishery Water Class 1 (Spawning areas for chanos chanos or bangus and

similar species. While class “SC” is categorized for Recreational Water Class II (e.g. boating, etc), Fishery Water Class II (commercial and sustenance fishing) and Marshy and/or mangrove areas declared as fish and wildlife sanctuaries. The sampling results, she said, will also serve a basis of action on the part of the local government units in drafting their plans and policies. EMB likewise reminded the LGUs to harmonize its entire comprehensive and coastal resource management plan with its water classification. The EMB is now consolidating the data gathered for the final water classification report which will be transmitted to the EMB central for national publication. LGUs who may wish to submit their position paper or a resolution, may do so, before the December 30, 2012 deadline. (JCV/PIA 10/asf )

DAY 3, THE MORNING AFTER --- Back home in Davao City, during very rare days when Beth would wake up in the morning WITHOUT neck or shoulder pains, I would immediately know. As she would open her eyes free of pain, she would always say: “HELLO TO THE WORLD”. But as I said, that was a rarity. At Room 19 at Villa Medica on Day 3, I woke up early, still dark outside considering the 7 hour time difference. An early rise at 5 a.m. at Edenkoben was 12 high noon back home. So no trouble with that. And I had difficulty adjusting to the local German time. I was engrossed in Sen. Enrile’s “A MEMOIR” and taking down notes of Beth’s procedures and conditions so I had no problem waking up in the middle of the night as it was early morning back home. Due to the relaxants and the antihistamines administered to her, she appeared well rested and sound asleep most of the time during the night, though waking up and rising a few times to go to the bathroom. It was morning. I was reading and looking at the photos on Page 80 of the Sen. Enrile’s “A MEMOIR” when Beth first stirred. Then she opened her eyes, looked around and said softly: “HELLO TO THE WORLD”. Wow, no neck pains that morning! That made my day! And to think I haven’t heard her say those magic words for some time since Manila and Hongkong and Frankfurt. She rose from bed, dressed up and said she was ready to go downstairs for breakfast, only to be reminded that she had to stay in the room for the day. The German nurse came and took her temperature, looked at her injected buttocks and said: “Everything’s okay” and left. Beth looked flush in the face. TODAY, we will celebrate the birth date of Andres Bonifacio, the most authentic national hero among Filipino revolutionaries. There was a time when a debate on whether Bonifacio be given the appropriate title as a national hero better than Dr. Jose Rizal was. The debate rages even to this day. For the working class, Bonifacio was the indisputable hero of the Cris Diaz Filipinos. He led and started the Philippine revolution at a time when Rizal was enjoying his sojourn along with beautiful women in Europe. The Fil-Spanish elite declared Rizal. Bonifacio, a laborer who sell fan and bastion would not qualify as a national hero. He was uneducated. Unlike Rizal who studied various courses in a Dominican friar school in Manila, Bonifacio was illiterate. Bonifacio was a descent of unknown family while Rizal stem | page 10 came from a well-to-do family in Calamba, Laguna. The Spanish government never did recognize Bonifacio as a hero. The friars who controlled the country’s educational institutions identify only Rizal as the hero because of his searing ‘El Felibusterismo’ and ‘Noli Me Tangere’ novels. DAVAO CITY -- The City Government of Davao is hopeful over its bid for 2013 Ad Congress after an inspection team from the congress organizers visited the City last November 23-27. Davao City Investment and Promotions Center head and current City Tourism Operations Office chief Jason Magnaye said the inspection team were visibly impressed with the safe and convenient areas for withdrawal of pensions. Cepalco’s P2B investment for 2012-2015 could lower electricity charges - ERC CAGAYAN DE ORO CITY – To improve its distribution system and give more opportunities for a lower power cost for its consumers, the Cagayan Electric Power and Light Co. is investing about P2 billion over the next four years in projects. The Energy Regulatory Commission (ERC) has approved capital expenditure spending of Cepalco for the third regulatory period (July 2011 to June 2015). This was slightly lower than the P2.14 billion it first asked ERC. The regulatory board has disallowed some of its proposed projects. The ERC said that , under the performance-based regulation (PBR) scheme , Cepalco’s budget for the next four years would result in lower distribution charges for its customers. For regulatory year 2012, Cepalco was able to decreased its current average charges of P1.5705 per kWh, to P1.2491 per kilowatt-hour, as approved by ERC. “The decreasing price trend

on the third regulatory period for Cepalco is a good signal that the benefit of adopting the PRB rate-setting methodology is now taking effect. The PBR has put pressure on the utilities to improve their systems and be more efficient in their operations,” said ERC chairperson Zenaida G. CruzDucut. With the ERC decision, Cepalco can now translate the approved charges of P1.2491 per kWh for 2012 into rate schedules for its different

customer classes and file its application with the ERC for approval. Upon approval of these revised rate schedules, Cepalco can then start charging the lower rates to its customers. Cepalco is the third-largest power distributor in the country, and has more than 100,000 residential, commercial and industrial customers in its franchise area covering Cagayan de Oro and the municipalities of Tagoloan, Villanueva and Jasaan, Misamis Oriental.

Secura from recruiting local residents or they would be arrested by authorities. Alarmed by the incidents, Veronica Lobood, OIC-Provincial of National Commission of Indigenous Peoples (NCIP), vowed to further investigate the activities of Secura after they have learned the NCIP logo was printed in the ID apparently to lure tribal people. An NCIP staff admitted a Secura representative came to their office to ask for support to allow them to recruit tribal leaders and community members but was bluntly told that this could not be possible in the absence of consultation among the council of tribal leaders. The veracity of Secura as a legitimate company remain to be seen since they could not present any legal documents from the Securities and Exchange Commission yet they have already duped thousands of lumads and other residents to pay the membership card. Such alluring quick money scam has become frenzy to the more vulnerable lumad residents in Agusan del Sur of which most of the thousands of hectares targeted are part of the ongoing application for Certificate of Ancestral Domain Titles (CADT). There are about seven CADT applications in Agusan del Sur covering some 102,000 hectares which still awaits final approval from the national government even as lumads in various tribal origins has been working for many years to rightfully own their ancestral lands. This despite multi-sectoral efforts to hasten the processing of their CADTs since last year, an integrated approach that would at least uplift their still impoverished economic plight. Under the Conflict Sensitive Resource and Asset Management (Coseram) Program , thousands of hectares of proposed CADT areas in the barangays of Sta. Maria, Tabon-Tabon, El Rio and Bugsokan which even traverses beyond the provincial and municipal political boundaries are considered pilot areas if ever the processing of these ancestral lands can be fast tracked amid the intricate stages of complying the requirements of CADT before the national government may recognize them under the Indigenous Peoples Rights Act of 1997. Coseram which is a program of German government-supported Deutsche Gesselschaft fur Internationale Zusammenarbeit (GIZ) have reached a working tripartite agreement with National Commission for Indigenous Peoples and the Provincial Government of Agusan del Sur to simplify the processing of the CADT claims and efficiently pursue the Ancestral Domain Sus-

tainable Development and Protection Plan (ADSDPP). A Technical Working Group would provide assistance to the provincial delineation team of NCIP for the validation of CADT claims while Coseram was tapped by the provincial government to enhance the capacities of the TWG to ensure conflict and culture sensitivity of the process. The provincial government has also earmarked an initial P5 million from the proceeds of environmental tax collections to support in the implementation of the program particularly in the delineation of CADT areas. TWG members said Gov. Adolph Edward Plaza has expressed support for the program after he was convinced that this was meant to sincerely enhance the issuance of CADT titles and the elaboration of ADSDPP to make the processing conducted in a fair and culture sensitive manner would improve the investment climate in Agusan del Sur. In Sibagat where there are some four Manobo communities in Barangays El Rio, Tabon-Tabon, Sta. Maria and Bugsokan supported by the GIZ project some large ancestral land areas under the still processed CADT 093 are confronted with another problem : the overlapping of claims for government agrarian reform areas. The Depar tment of Agrarian Reform without coordination from NCIP has started surveying at least half of the 2,000 hectares of ancestral lands in Barangay El Rio for the conversion into Certificate of Land Ownership Award for Agrarian Reform beneficiaries. Guinsod, said a team from DAR have surveyed the lands in their villages said to be awarded to agrarian reform beneficiaries from non lumad lowlanders in Bayugan City. Felipe “Datu Mandagonsa” Mabasle, tribal chieftain of Barangay Tabon-Tabon, also confirmed the DAR survey team had already speculated at least a third of their CADT claims in their village. His cousin and namesake Felipe Mabasle, municipal tribal chieftain of Sibagat, said the tribal council composed of indigenous people’s organizations has never allowed any outsider to deal with any kid of business interest without consultation from them. “Nagkasabot na mi nga dili tugtan ang si bisan kinsa nga mosulod sa negosyo kung walay pagtugot sa among konseho (We have already agreed not to allow anybody to engage in business without consent from the council),” Mabasle said. The colorful autumn leaves kept falling while a maintenance man was busy clearing the road and the pathways using a mobile blower. It was chilly about 5 degrees, no wind so the air was crisp and the temperature penetrating. I was told earlier that a sudden surge of high energy or vitality would be immediately experienced after the treatment and some usual body pains would be somehow minimized or at most, relieved.
