North M’danao to spend P197-B for reg’l recovery CAGAYAN DE ORO CITY -- Addressing the socioeconomic impacts of coronavirus disease (COVID)-19 pandemic and aiding the region to transition to the new normal, the National Economic and Development Authority (NEDA)-10 bared that P197,609,824,000 is allocated for the Regional Recovery Plan.

Regional Director Mylah Faye Cariño said during the NorMin COVID-19 Response Task Force press conference, July 7, that such amount cover the sectors for economy (P14 billion), social services (P150 billion), environment (P2 billion) , governance and cross-cutting concerns (7 billion), and transportation (23 billion).

Based on estimates on current prices, the region marked P17.86 billion in losses from March 15 to May 31 with disruption of work. For the whole year, NEDA-10 estimated P61.13 billion on economic loss but this will be revisited based on how things will turn out with the crisis.

Prov’l lawyers ask court to lift TRO vs. 2020 budget

MISAMIS ORIENTAL: Provincial Governor Yevgeny Vincente Emano on Wednesday apologized to the people of Misamis Oriental for the failure of the provincial government to deliver the basic services for the past weeks.

Emano admitted that the temporary restraining order (TRO) stopping the province to disburse the approved 2020 Budget has technically crippled the operation of the provincial government.

A regional trial court in Cagayan De Oro City issued a 20-day TRO effective June 29, 2020 after it granted the petition filed by opposition members of the provincial board.

“I would like to apologize to the people of Misamis Oriental for our failure to respond to their demand for assistance that requires financial aid at this trying time,” Emano told the local press here.

Davao City’s response vs. Covid-19 in the eyes of Dabawenyos

DAVAO CITY – With the city’s ongoing battle against the deadly coronavirus disease 2019 (Covid-19), Dabawenyos found themselves mainly relying on the various interventions provided by the local government to ease the current health crisis.

Daily sustenance of affected Dabawenyos has been a great concern of the city government, especially during the start of the enhanced community quarantine (ECQ) that caused massive job disruption among its residents.

On April 4, this city was placed under ECQ and Dabawenyos braced for stringent measures that include the suspension of mass transport and the limitation on people’s movement.

On the first week of the ECQ, even government employees and agencies dealing with emergencies and essential services felt the initial shock of being confined in their homes, unable to render their publicoriented duties.

Immediately following

the ECQ, however, the city government sprung into action and rolled out four types of food relief programs to enable the majority of Dabawenyos to put food on the table and provide basic necessities for their families.

City’s Covid-19 response Mayor Sara Z. Duterte said the city’s four food programs consisted of direct interventions for poor families: the food ration run by the City Social Welfare and Development Office (CSWDO); the agri-food program jointly implemented by the City Agriculturist Office (CAO) and City Veterinarian’s Office (CVO); the “hot meals on wheels” program; and the barangay rice distribution program.

On top of these, the city government also provided counterpart and assisted the national government’s TUPAD, or Tulong Panghanapbuhay sa Ating Disadvantaged/Displaced Workers program, enabling public utility vehicle drivers to find temporary employment after their main livelihood was greatly affected by the Covid-19 containment

measures.

When the general community quarantine (GCQ) was declared weeks later, Mayor Sara announced the “Work for Davao” and “Eskwela Davao” programs.

As part of the local government’s continuing response to the Covid-19 crisis, the city government launched the educational assistance program for 22,000 schoolchildren whose parents have lost income from the health crisis.

Likewise, the “Work for Davao” program benefited a total of 42,915 workers who have been displaced due to the temporary closure of businesses.

Under the program, each beneficiary receives PHP396 a day until December 7 this year.

“The city government will help and protect the Dabawenyos. All I’m asking is for you to follow the protocol set by the doctors for us to be safe and control the spread of this disease,” Duterte said in a previous radio interview.

member to maintain their mental health.

For one of the most affected sectors during ECQ, PUJ driver Teodor Alicom told PNA that he was initially worried when the government stopped the transport sector from operating.

“I worried about what to feed my family. I am just fortunate that I was able to avail of the TUPAD program of the city government,” he said in the vernacular.

Restrictions Adelaida Larsuma, a street vendor in Barangay Sasa here, said the restrictions imposed by the city government have greatly affected their business, but said she understood them as the measures were meant to contain the infection.

To limit the movement of people in the city, Mayor Sara implemented the issuance of food and medicine (FM) passes as well as the clustering of barangays.

The coded pass allows residents to go out on a number of days in a week.

During the ECQ implementation, no one was allowed to go out on Sundays.

Larsuma said if the local government did not impose such restrictions, the outcome would have been worse than losing their business.

“It is for our good. We will abide by it,” she said in the dialect.

DA pours in production support to help bat insurgencies in Cabanglasan town CABANGLASAN, Bukidnon, July 1 – In a bid to contribute in the government’s peacekeeping efforts, the agriculture department in Northern Mindanao (DA-10) accorded farm inputs assistance to the conflict affected areas of sitios Tumbaga, Tagbakan, Katablaran and Saluringan, all of barangay Canangaan.

Held at the town center, a total of 100 bags of hybrid corn seeds worth P500,000 were turned over to select leaders of such communities, as crop production assistance that can cover at least 50 hectares of land.

Lt Sancho S Tomaquin, Charlie Company Commander, 88th Infantry Battalion, Philippine Army, said the recipients are among those nearly 200 displaced individuals, who fled from their farmlands and homes brought about an armed confrontation between the Communist Party of the Philippines - New People’s Army (CPP-NPA) and the government troops which transpired nearly two weeks ago.

Since June, of this year, the army official reported, that they have set off to the munici-

pality of Cabanglasan to conduct its Community Support Program (CSP), particularly in barangays Paradise, Mandahican, Mandaing, Cabulohan and Canangaan.

Out from the five barangays, they have identified that most of the enemies are in the hinterlands of Canangaan, of whom have set up camps in the sitios.

“From here, we have undertaken our CSP to clear the area from being CPP-NPA infested.

After the operations, we need to sustain the peace and order situation for development to come through. Once absent ang basic services, talagang magre-rebelde ang tao,” Tomaquin remarked.

In particular, the CSP aims to bring people back to the fold of the government while empowering communities through a synergy of development efforts among soldiers, government agencies, and the local governments.

Further, he emphasized that such initiative uses the whole-of-nation approach to end the local communist armed conflict in attaining inclusive and sustainable peace, as provided in President Duterte’s Executive Order

70.

of the 300 bags that were previously handed over to Cabanglasan town,” she explained. Such reinforcement is eyed to drum up the municipality’s corn production.

Based from reports of the local agriculture office, as of June 2020, there are 4,408 corn farmers, cultivating 5,937 hectares with an annual average production of 6.4 metric tons, specifically for hybrid corn.

“We, at the department, encourage you to form a group, as this will be instrumental in gaining more access and availing of assistance from the

government such as DA,” Lopez added.

Such declaration is also opportune, as the government troops are set to assist the locals in the affected sitios to fully organize and have them registered with DOLE, Lt Tomaquin stated.

The Wounded Soldiers Cooperative IN the book, “The Little Prince,” it was said, “only through the heart that one can see clearly; what are essentials are invisible to the eye.” This truism can be attested by 1st Lt. Jerome Jacuba, the Chairman of the Wounded Soldiers Cooperative with more than 100 members who were disabled in doing their duties as soldiers in the world’s 2nd longest battle, the Mindanao War. Chairman JJ (as I call him) is a 31 yr.-old first lieutenant who became totally blind two years ago when a bomb exploded in an encounter in Maguindanao.

As he was recovering then in VLuna Hospital, no less than the Commander-in-Chief President Mayor Rodrigo Duterte visited and even embraced him with tears in his eyes.

A year after that incident, the wounded soldiers who now belong to PWDs (persons with disabilities

) were organized into a cooperative led by no less than a brilliant brave soldier named Chairman JJ who is now a good friend whom I brought along when I visited the cooperatives of the internally displaced persons (IDPs) in Marawi a year ago. Some of these IDPs were former combatants either of the MILF or MNLF who are now organized into cooperatives but were once in combat with the military where 1st Lt. Jerome Jacuba was leading. Now they belong to one family, the cooperative family.

In his talk with former adversariesin a Cooperative Summit in Marawi City, Chairman JJ declared, “before when I have eyes, I could not see; today that I am blind, I can see that the war in Mindanao cannot be stopped through arms but through cooperativism.

‘Bullying’ the people of Misamis Oriental

THE action taken by Misamis Oriental Vice Governor Jeremy Pelaez and his opposition clique at the Sangguniang Panlalawigan to secure a temporary restraining order (TRO) stopping the disbursement of the approved 2020 Budget bullies the people of Misamis Oriental.

Aside from making a mockery of the Misamisnons, Pelaez and provincial board members Jerry Khu and Jessa Mugot did not take into consideration the government’s national health emergency in response to the COVID-19 pandemic.

The clique filed a case with “declaratory relief ” through the issuance of the TRO to stop the implemen-

tation and disbursement of the approved 2020 Budget of Misamis Oriental because of various grounds like the failure to “post the ordinance in conspicuous places” among others.

Under the national guidelines issued by the Inter-Agency Task Force on the Management of Emerging Infectious Diseases (IATF-MEID), the local government units (LGUs) were directed to adopt measures to mitigate the possible spread of COVID-19 virus in their areas.

There is no question that waging a war against an unseen enemy (virus) requires enormous logistics – both human and financial resources. However, the re-

If and when, the people could only blame Pelaez and his clique for an action that exemplifies “disservice to the people” to the highest order.

A course of action. Professional conduct in life.

Progress through life. What is a careerist? One, who rushes widely and makes his advancement his or her aim in life. In times of Covid-19, you may not think about your career. Sure. But somehow life goes on, and career doubts rise again.

When career doubts won’t go away? What if you’re not happy with your job? Is it possible that you’re in the wrong entirely?

My parents always (!) wanted me to become a banker. So far so good. Why not? Maybe I would have been more (or very happy) in my job. Or not?

The pressure “to be” someone starts in life early indeed. Not only my parents, but also peers, and teachers have begun to exert influence. Yes, I even didn’t know where my inclinations lie.

Being a doctor or a lawyer? Yes, I was interested in law and medicine during that time.

“The way that people pick careers is incredibly primitive,” said Nicholas Lore, founder of the Rockport Institute, a career coaching firm, and author of “The Pathfinder”. So, it’s no wonder, he said, that so many people are dissatisfied with their jobs.

Terrorism

THE Anti-Terrorism Law (ATL) is not unique to the Philippines. In fact, its passage by Congress and the signing into law by President Rodrigo R Duterte is quite late.

But better late than never. The country has been a comfortable haven for foreign and homegrown terror organizations. In not a few instances, there were indications of how terrorists would connive to pursue their diabolical agenda.

Unfortunately, those who violently oppose the ATL ignore these because of diverse reasons. The law impinges on their political agenda, they felt secure in their gated subdivisions anyway and for some idiotic notions that reading Theology of Liberation is enough reason to be arrested and detained.

President Duterte and the principal author of the bill, Sen. Panfilo Lacson, are no strangers to the carnage inflicted by terrorists. Shortly before he was elected Mayor of Davao City, the Catholic San Pedro Cathedral was a scene of insane bombings that killed and maimed parishioners who attended an evening mass. When he became City Mayor, the Davao International Airport was bombed. Before the mourning for the dead ebbed the Davao seaport was bombed again with the use of improvised explosive device. Another attempt of a Jemaah Islamiyah suicide bomber to inflict harm on a large crowd at the Peoples Park did not materialize as the suspect was killed by law enforcers before he can detonate the explosives.

Yes, the relevance of cooperativism is now being seen during these most challenging times to democratize wealth and power in a highly skewed societal order.

They now see that the only way to draw the marginalized sectors into the development processes is to harness their collective spirit, to pool their resources together, although how meager, to fight poverty and hunger.

publication, the article was published on May 29, 2012, and the cybercrime law was only enacted on September 12, 2012. Penal laws cannot be applied retroactively. But in February 2014, Rappler corrected a typographical error -- a misspelled ‘evation’ to ‘evasion’ -- prompting the DOJ to consider it a republication, and is thus now covered by the cybercrime law.

These two issues are within the province of the legislature, and I am not a lawyer. But what bothers me is how media organizations, human rights groups, and even foreign state actors were quick to use these issues to question the verdict, package the conviction as an attack on press freedom, and link the issue to President Rodrigo Duterte.

I must have missed something, because critics are certainly missing the most basic issue at the heart of all these contentious arguments: Were the rights of Wilfredo Keng violated when Rappler published a single-source article that maligned his name and reputation? Was the article in question libelous? And did Rappler adhere to the basic journalism tenets of fairness and balance when it failed to publish Keng’s side?

The article claimed that the late former chief justice Renato Corona allegedly used vehicles from various businessmen, including Keng. It cited an alleged intelligence report which stated that Keng had been under surveillance by the National Security Council for alleged involvement in illegal activities, namely “human trafficking and drug smuggling.”

Keng has denied the accusations against him.

In 2016, the businessman’s lawyer, Leonard de Vera, got in touch with Rappler to give them a copy of a

certification from the Philippine Drug Enforcement Agency clearing Keng of any derogatory records.

And in Rappler’s own primer on the case, the online news site admitted that it failed to publish Keng’s side on the PDEA certification. Rappler said “they needed to countercheck the PDEA certification – a process that they didn’t get to finish as Rappler became busy with its coverage of the drug war. It is also SOP for any claim to be verified with other sources before it is published.”

This kind of dismissive explanation -- as if being so busy absolves you of bad journalism, and for goodness’ sake, what decent newsroom is not busy?

-- begs the question: Why didn’t Rappler apply the same due diligence in counterchecking Keng’s statements clearing his name when it quickly published an alleged intelligence report besmirching Keng’s name? Was the SOP only for attacking Keng?

Keng himself raised these valid points: “Where is the violation of press freedom there? They have totally forgotten their duty to uphold the truth. With the power they wield, they have forgotten their accountability.”

In defending Maria Ressa, critics of the verdict were silent on these issues.

They focused, instead, on big words that painted the case as a “cautionary tale,” the decision as a “dark day” for independent Philippine media.”

“Don’t be afraid. Because if you don’t use your rights, you will lose them,” Ressa said in a press conference after she was convicted.

She is absolutely right, except perhaps she should have said that with a mirror in front of her. Keng exercised his right. Rappler violated his rights. Thus,

the guilty verdict.

Judge Estacio-Montesa, in her ruling, underscored the same. “The exercise of freedom should and must be used with due regard to the freedom of others. As Nelson Mandela said, ‘for to be free is not merely to cast off one’s chains but to live in a way that respects and enhances the freedom of others.’”

The unfounded and baseless allegations linking President Duterte to the conviction should not drown out the real issue -- that of Keng’s pursuit of justice to protect his own human rights. Freedom of the press and freedom of speech continue to remain vibrant and strong in the Philippines despite how some people choose to paint the decision of the court as a suppression of media freedom. The Duterte administration has constantly been one with the international community in the belief that having a plurality of voices — including critical ones — is an essential requirement for the continued functioning of any democratic country.

The verdict was not an attack on the media, but an adherence to the rule of law and due process prescribed in our democratic constitution. This is a case of accountability.

As for me, I’d like to end this with my own cautionary tale. This is how democracy truly dies -- by a thousand cuts of sloppy reporting that hides behind the shield that is press freedom, by irresponsible journalists who act like they cannot be held accountable, and by the collective and deafening silence of those who should demand ethical reporting from their colleagues.

WHEN a Philippine court on June 15 convicted journalist Maria Ressa, executive editor of the online news site Rappler, for cyber libel, criticisms from both the local and international fronts were quick and cutting.

A major blow to press freedom. A proof of a broken rule of law. A travesty of justice. This is how democracy dies.

As a former journalist, and finding myself at the office by the Pasig River that was on the receiving end of all the stinging rebuke, it became imperative for me to take a second hard look at the verdict.

Ressa, along with former Rappler reporter Reynaldo Santos Jr., are the first journalists in the Philippines to be convicted of cyber libel.

In handing out a guilty verdict, Judge Rainelda Estacio-Montesa also awarded $8,000 for moral and exemplary damages to the complainant, businessman Wilfredo Keng, but allowed Ressa and Santos to post bail, pending an appeal.

Critics have zeroed in on two legal issues: the prescription period for cyber libel and the republication of an online news article.

Libel, under the Revised Penal Code, has a prescription period of only a year.

And since Rappler’s article was published in 2012, and Keng filed his complaint only in 2017, they argue that the case should have been dismissed immediately. The cyber libel provision of the cybercrime law, however, is silent on the prescription period. The Department of Justice then used Republic Act No. 3326 which states that for special laws that are punishable by jail time of six years or more, the prescription period then becomes 12 years.

As to the issue of rethy and deceits. Enough of the selfish pursuit of instant wealth, power and self-aggrandizement. It is time for collective action to unfetter the people from the vicious cycle of economic difficulties.

BDO issues USD 600 million senior notes

ON 6 July 2020, BDO Unibank, Inc. (BDO) announced its issuance of USD 600 million in Fixed Rate Senior Notes under the Bank’s Medium Term Note (“MTN”) Program.

The transaction was oversubscribed, with orders reaching USD 2.9 billion, equivalent to almost 5 times the offered amount.

The issue has a coupon rate of 2.125 per cent per annum and a tenor of 5 & 1/2 years. The bonds were rated “Baa2” by Moody’s.

Community-based organizations that focus on creating interdisciplinary

climate change education resources and professional development opportunities provide support and guidance to teachers who want and need to teach about climate change.

Climate change in education isn’t just about saving our ecosystems: we must equip the next generation for an every developing economical, social and political landscape.

As lockdown eases and schools slowly start readmitting students, an ongoing debate examines the importance of educating the next generation on the climate crisis, sustainability and climate justice.

While headlines and politicians continue to discuss the importance of a ‘green recovery’ post Coronavirus, it is clear that systemic change is required throughout society.

SEC Pushes Social Bond for Economic Recovery THE Securities and Exchange Commission (SEC) is pushing the issuance of social bonds to support efforts to contain the COVID-19 pandemic, curb its socioeconomic impacts and build resilience to future shocks.

Social bonds are financing instruments whose proceeds are exclusively used to finance or refinance new or existing projects that directly aim to address or mitigate a specific social issue and/or seek to achieve positive social outcomes.

The Commission cited the potential of the social bond market as a funding source for COVID19-focused projects, as it approved the country’s first issuance in accordance with the ASEAN Social Bond Standards (SBS).

On June 17, the SEC approved the application of Bank of the Philippine Islands (BPI) to use the ASEAN Social Bond label for its COVID Action Response (CARE) Bonds.

BPI looks to raise at least P3 billion from the ongoing offering to finance and refinance eligible micro, small and medium enterprises (MSMEs).

The CARE Bonds, which represents the third tranche of the bank’s P100 billion bond program, will have a tenor of 1.75 years and an interest rate of 3.05% per annum.

“COVID-19 has given rise to serious socioeconomic issues globally, pushing enterprises to the brink of failure and leaving millions of people jobless,” SEC Chairperson Emilio

B. Aquino said.

“The social bond market could boost our response to and recovery from the pandemic by unlocking the much-needed capital for the promotion of public health, reopening of businesses and preservation of jobs, among others.”

ASEAN Social Bonds Social bonds have gained traction among issuers and investors across the world.

In 2018, the ASEAN Capital Markets Forum introduced the ASEAN SBS to enhance transparency, consistency and uniformity of social bonds issued in the region and thereby contribute to the development of a new asset class, reduce due diligence costs and help investors make informed investment decisions.

The Philippines adopted

the ASEAN SBS in April 2019 through the issuance of the Guidelines on the Issuance of Social Bonds. Under the ASEAN Social Bond Standards in the Philippines under SEC Memorandum Circular No. 9, Series of 2019.

The ASEAN SBS reflect the four core components of the Social Bond Principles launched by the International Capital Market Association (ICMA) as voluntary process guidelines in 2017, namely use of proceeds, process for project evaluation and selection, management of proceeds, and reporting.

Issuers may use the ASEAN Social Bond label in raising funds for projects benefiting the poor, excluded or marginalized populations and communities, vulnerable groups,

including those affected by natural disasters, the unemployed, people with disabilities, migrants and displaced persons, the undereducated and the underserved.

Eligible projects include those providing and/or promoting affordable basic infrastructure, access to essential services, affordable housing, employment generation, food security, and socioeconomic advancement and empowerment.

BPI will be the second to issue ASEAN Social Bonds in the region. In 2019, Bank of Ayudhya of Thailand issued the first ASEAN Social Bonds, which also represent the first ever private sector “gender” bond issuance in Asia and the Pacific, to raise $220 million for lending to women-led SMEs.

The CARE Bonds being offered by BPI, however, will be the first ASEAN Social Bonds whose proceeds will be used to mitigate the socioeconomic impact of the COVID-19 pandemic.

COVID-19 Social Bonds At the height of the COVID-19 pandemic, the ICMA released guidelines on how social bonds can finance projects aimed at addressing or mitigating social issues wholly or partially emanating from the coronavirus outbreak.

ICMA confirmed social bonds may finance COVID19-focused social projects such as those seeking to increase capacity and efficiency in provisioning healthcare services and equipment, and those supporting medical research.

THE volume and value of transactions of tax payments done through the GCash app doubled during the first six months of the year, buoyed by the growing demand for digital transactions amid the new normal.

GCash saw the value of transactions for payments to the Bureau of Internal Revenue (BIR) surging by 117 percent to P574.89 million in the first half of 2020 from P265.19 million the year prior.

This growth is driven by the 90-percent increase in

the volume of BIR transactions during the first semester of the year, ending at 225,222 transactions from 118,731 in the same period last year.

“The surge in both volume and value for tax payments is a reflection that GCash is fast becoming a preferred mode of payment for taxes. Taxpayers opt for a safe and convenient way of paying their taxes. We fully support the government in pursuing a more cashless Philippines, as we all adapt to the new normal,” GCash President and CEO Martha

Sazon said.

The increase in BIR transactions made through the GCash app reflects preliminary government data, which showed that 77 percent of the BIR’s total tax collection from January 1 to June 15 were made through electronic means.

The filing of income tax returns was extended from April 15 to June 15 due to the limitations on mobility because of the national health situation.

Through its partnership with the BIR, GCash enabled its users to pay for their taxes through their mobile phones. They simply have to click on the Bills Pay tile, select Government,

and then click on the BIR option. From there they only have to enter the details required such as form series, the return period, their taxpayer identification numbers (TINs), branch code, and the amount before hitting the pay button.

“By partnering with the government, we are bringing government services closer to the masses -- especially now that we are facing a threat that forces us to limit human interaction. Through our platform, we are enabling people to pay their taxes safely, conveniently, and securely, while empowering the government to process these payments more efficiently,” Sazon said.

Aside from tax payments, GCash also allows users to pay their government dues for their applications or contributions to the Department of Foreign Affairs (DFA), the Pag-IBIG Fund, the Maritime Industry Authority (Marina), the Metropolitan Manila Development Authority (MMDA), the National Bureau of Investigation (NBI), the National Home Mortgage Finance Corp.

That said marriage did not last long due to lack of love and affection until the relationship manifested incompatibility and sustained misunderstanding between petitioners and reached the point of irreconcilability and they separated for four (4) year now, they decided to separate live physically in bed and board, thereby, executed Memorandum of Agreement in order to formalize their separation. Since there separation, they had never been communicating or supporting either financially or emotionally to each other, neither minding each other affair’s; Petitioner’s seek judicial decree of divorce, thereby, severing their marriage bond on July 23, 2011, so that they will have free hand to do what a single man or woman could do without marital burdens. Reconciliation between them has already been diligently employed but all proved futile.

WHEREFORE, finding this petition to be sufficient in form and substance, set the initial hearing of this case on JULY 31, 2020 at 9:00 a.m. at which time, date and place. EXECUTIVE ORDER NO. JRUM 0097, S. 2020 IMPLEMENTING RULES AND REGULATIONS OF MUNICIPAL ORDINANCE NO. 617, SERIES 2020 OTHERWISE KNOWN AS “THE INTEGRATED ECOLOGICAL SOLID WASTE MANAGEMENT” IN THE MUNICIPALITY OF VILLANUEVA, MISAMIS ORIENTAL WHEREAS, Municipal Ordinance No. 617, Series 2020 otherwise known as the Integrated Ecological Solid Waste Management shall provide for an ecological solid waste management program, creates the necessary institutional mechanisms and incentives, imposes fees, declares certain acts prohibited, and provides penalties or violations; WHEREAS, pursuant to the Local Government Code of 1991 and existing national laws, the Integrated Ecological Solid Waste Management which promotes protection of public health and the environment; WHEREAS, one of the agenda of the Municipal Administration includes the protection of the environment and welfare of the general public; NOW THEREFORE, I, JENNIE ROSALIE U. MENDEZ, Municipal Mayor of Villanueva ,Misamis Oriental by virtue of the powers vested in me by law, do hereby issue and provide the Implementing Rules and Regulations (IRR) of the Integrated Solid Waste Management Ordinance in the municipality of Villanueva, Misamis Oriental.

Rule I GENERAL PROVISIONS

Rule II IMPLEMENTATION AND UPDATING OF THE 10 YEAR SOLID WASTE MANAGEMENT PLAN Section 1. The 10-Year Solid Waste Management Plan - The 10-Year Solid Waste Management Plan of Villanueva Misamis Oriental shall be implemented in accordance with the implementation schedule, strategies guidelinescontained in the said plan as adopted and approved by the Sangguniang Bayan through Ordinance No. 617 Series 2020. The Plan shall be updated in every 3 years.

Rule III CREATION OF THE MUNICIPAL ECOLOGICAL SOLID WASTE MANAGEMENT BOARD Section 1.Municipal Ecological Solid Waste Management Board - The LGU shall create an Ecological Solid Waste Management Board (ESWMB) that shall have the following duties and responsibilities.

Section 1.Title.These rules shall be known and cited as the Implementing Rules and Regulations of Integrated Ecological Solid Waste Management Ordinance of Villanueva, Misamis Oriental.

a)

Develop the Municipal Solid Waste Management Plan that shall ensure long-term management of solid waste as well integrate the various solid waste management plans and strategies of the barangays in its area of jurisdiction;

Section 2.Purpose.These rules are promulgated to prescribe the procedures and guidelines for the implementation of the Integrated Ecological Solid Waste Management Ordinance of Villanueva, Misamis Oriental in order to facilitate compliance therewith and achieve the objectives thereof.

b)

Adopt measures to promote and ensure the viability and effective implementation of solid waste management programs in its component barangays;

c)

Monitor the implementation of the Municipal Solid Waste Management Plan through its various political subdivisions and in cooperation with the private sector and the NGOs;

d)

Adopt specific Revenue-generating measure to promote the viability of its Solid Waste Management Plan;

e)

Convene regular meetings for purposes of planning and coordinating the implementation of the solid waste management plans of the respective component barangays;

f)

Oversee the implementation of the Municipal Solid waste Management Plan;

g)

Review every two (2) years or as the need arises the Municipal Solid Waste Management Plan for purposes of ensuring its sustainability, viability, effectiveness and relevance In relation to local and international developments in the field of solid waste management;

h)

Develop the specific mechanics and guidelines for the implementation of the Municipal Solid Waste Management Plan;

i)

Recommend to appropriate local government authorities’ specific measure proposals for franchise or build operatetransfer agreement with duly recognized institutions, pursuant RA 6957 TO provide either exclusive or non-exclusive authority for the collection, transfer storage processing, recycling or disposal of municipal solid waste. The proposals shall take into consideration appropriate government rules and regulations on contracts, franchises and build-operatetransfer agreements;

j)

Provide the necessary logistical and operational support to its component barangays in consonance with subsection (f) of Sec. 17 of the Local Government Code;

k)

Recommend measures and safeguards against pollution and for the preservation of the natural ecosystem; and

l)

Coordinate the effort of its component barangay in the implementation of the Municipal Solid Waste Management Plan.

Section 3.Scope.These rules shall lay down the powers and functions of the Municipal Environment and Natural Resources Office and other concerned department in the LGU, the rights and obligations of the people with respect to the implementation of the Integrated Ecological Solid Waste Management Ordinance of the municipality of Villanueva, Misamis Oriental.

Section 4.Administration and Enforcement.These rules and regulations shall be administered by the Municipal Environmental and Natural Resources Office and other concerned LGU departments and other instrumentalities of the LGU for assistance in the form of technical expertise, personnel, facilities and other resources as the need arise in the discharge of the functions.

Section 5.Mandates.

a) Republic Act No. 9003 otherwise known as Ecological Solid Waste Management Act of 2000 provides for an ecological solid waste management program creates the necessary institutional mechanisms and incentives, declares certain act prohibited and provides penalties for violations;

b) Section 10 of Republic Act No. 9003 provides that pursuant to the relevant provision of R.A. no. 7160, otherwise known as Local Government Code of 1991, the LGUs shall be primarily responsible for the implementation and enforcement of the provision of this act within their respective jurisdictions;

c) Section 16 of Republic Act No. 9003 provides that the municipality through its Local Solid Waste Management Board shall prepare its respective 10-year Solid Waste Management Plans consistent with the National Solid Waste Management Framework. Provided that the waste management plan shall be for the re-use recycling and composting of wastes generated in their respective jurisdictions. Provided further, that the solid waste management plan of the LGU shall ensure the efficient management of solid waste generated within jurisdiction;

d) Section 47 of Republic Act No. 9003 provides that the local government unit shall impose fees in amounts sufficient to pay the cost of preparing, adopting, and implementing a solid waste management plan prepared pursuant to this act;

e) Chapter 3. Section 391 (1) of Local Government Code of 1991 provides that the Barangay Council headed by the Barangay Captain is recognized having the important role of delivering an efficient effective and economical governance, the purpose of which as related to the implementation of laws and regulations related to control of pollution and protection of the environment, particularly to solid waste management as a matter of general welfare of the Barangay and its inhabitants;

f)

Section 4 Rule XIX of the Implementing Rules and Regulations (IRR) of Republic Act No. 9003 provides that Local Government Units shall be required to legislate appropriate ordinances to aid in the implementation of Republic Act No. 9003 and in the enforcement of its provisions: provided such ordinance shall be formulated pursuant to relevant provisions of R.A. 7160.

Section 6. Definition of Terms. For the purpose of these Implementing Rules and Regulations, the following words and phrases shall have the following meanings:

Collection

- refers to the act of removing solid waste from the source or from a communal storage point.

Compostable

- refers to biodegradable or compostable materials free from contamination such as pathogens and hazardous substances and considered sale for agriculture use.

Composting

Junkshop

- refers to any building, including its premises in which junk is stored. It can be with aparticular kind of junk or with all kinds ofjunk and ifmaythus assume a different business name.

Market Vendors

-

refersto the controlled decompositionof organic matter bymicroorganism mainly bacteria and fungi, into a humus-like product.

Section 2. Membership of the Municipal Ecological Solid Waste Management Board - The Municipal SWM Board shall be composed of the Municipal Mayor as chair with the following as members: a)

One (1) representative of the Sangguniang Bayan preferably chairpersons of either the Committees on Environment or health whowill be designated by the presiding officer

b)

President of the Association of Barangay Councils in the municipality;

c)

Chairperson of the Sanggunlang Kabataan Federation;

d)

A representative from NGOs whose principal purpose is to promote recycling and the protection of air and water quality;

e)

A representative from the recycling industry;

f)

A representative from the manufacturing or packaging industry; and

g)

A representative of each concerned government agency possessing relevant technical and marketing expense as may be determined by the Board.The Municipal Solid Waste Management Board may, from time to time call on any concerned agencies or sectors as it may deem necessary.

Section 3. Creation of a Barangay Solid Waste Management Committee - The Barangay SWM Committee shall have the following functions and responsibilities: a)

Formulate solid waste management program consistent with Municipal plan

b)

Segregated collection of biodegradable, compostable, reusable wastes

Material Recovery Facility - refers to the designated and or established building or structure designed to receive temporarily store, sort, separate and recover wastes before the transfer, transport and final disposal of remaining non-reusable waste into the identified sanitary landfill site.

c)

Establish materials recovery facility

d)

Allocate barangay funds, look for sources of funds’

Organize core coordinators

The Barangay SWM Board shall be composed of the barangay captain as chair with the following as members:

a) One (1) Kagawad

b) SK chair

c) Presidents of Home Owners Association

d) Public/Private school principals or representative

e) One (1) Parents and Teachers Association or president or representative

f) One (1) Religious organization representative

g) One (1) Bus community representative

- refers to a waste disposal site designed constructed operated and maintained in a manner that exert engineering control over potential environmental impacts arising from the development and operation of the facility.

h) One (1) environmental NGO representative

i) President of Market Vendors Association:

refers to the process of recovering the waste materials intended or the same or different purpose without alteration of the physical characteristic of the recovered materials.

Section 1 Segregation of Waste at Source - That the segregation of waste shall be primarily conducted at the source or point of origin to include household, institutional, Industrial, commercial/business establishment, public market, health care center and agricultural sources.

c) Household level, a garbage collection fee shall be determined by the barangay for biodegradable and recyclable waste materials.

Section 2. Rule of the Barangay LGU - The segregation of waste shall be primarily managed at the barangay level specifically for the compostable, recyclable and reusable waste.

d) Business Establishments/ Industries, a collection fee shall be determined based on the volume of waste, a fee of PnP 500 per cubic meter shall be paid to the LGU.

That it shall be the duty of the respective Barangay Councils to primarily enforce and supervise the solid waste management, collection, segregation and resource recovery of the waste generated by the households, buildings, their premises and the premises or place of business within their respective political boundaries.

Section 6. Accreditation of Private Haulers/Collectors – All private individuals and companies engage in garbage collection and hauling within the municipality shall be accredited by the LGU. The following are the guidelines for accreditation.

Section 3. Marked and Color Coded Receptacles –There shall be a properly identified marked wastes container and receptacle for each type of waste and corresponding color code according to the classification of the segregates waste.

Provided that waste receptacles from residences institutional, commercial establishment and other sources must be stored in properly sealed and/or tied in spill proof container and should brought outside during collection time only.

Section 4. Requirements for the Segregation and Storage and set out of Solid Waste - The following shall be the minimum requirements for segregation and Storage of solid waste pending collection: a) There shall be a separate container to each type of waste from sources. In the case of bulky special waste, it shall be placed in a designated area. b) All waste generators to include household, institution, and market, industrial, commercial establishment and farmers shall place their recyclable and residual waste in the Purok transfer station/s following the 3R’s (Reduce, Reuse, Recycle). All generators shall kept their biodegradable wastes and process it through composting. c) All generated recyclable and residual wastes from the Purok transfer station shall be collected by the Barangay and kept it at the Barangay Material Recovery Facility (MRF) for final sorting. d) All residual wastes from the Barangay MRF shall be collected by the LGU on an On-Call basis, meaning the residual wastes from the Barangays shall only be collected when it reaches 3 tons in volume and shall be transferred by the LGU to final disposal area.

Rule V ESTABLISHMENT OF THE MATERIALS RECOVERY FACILITY Section 1. Operation of Materials Recovery Facility – Barangays shall be responsible for the collection segregation, recycling of biodegradable recyclable compostable and reusable wastes MRFs will be established in every barangay or cluster of barangay.

For this purpose the barangay or cluster of barangay shall allocate a certain parcel of land of the MRF. The determination of site and actual establishment of the facility shall likewise be subject to determination by the barangay through its Sanggunian.

a) It shall be unlawful for any person, firm, association, partnership or corporation to operate as garbage collector/hauler or to do business In garbage collection and hauling at any place within Villanueva Misamis Oriental, in any manner contrary to the provisions of this Ordinance and without first having obtained of Business Permit for such purpose. b) Garbage collectors/haulers shall submit the necessary documents for review and evaluation to determine that it meets the criteria.

i.

Complete list of vehicle for collection that includes the body number the name, and telephone number of thecollector/hauler for identification purposes. ii. Complete list of establishment’s subdivisions, institutions and industries serviced for collection. iii. Certification of the Barangay on the area where segregation, storage and recycling take place.

All transport vehicles shall be in good running condition. LTO registered.

All drivers operating the vehicle must have a valid driver’s license.

All open vehicles must be covered with nets/tarps upon transport to the Sanitary Landfill.

All garbage collectors must provide personal protective equipment (PPE) to all working personnel.

Cancellation of accreditation upon violation of the conditions set forth in this Ordinance and its IRR. Only residual waste shall be dumped in the sanitary landfill, all recyclable and biodegradable materials shall be diverted at source.

Certificate of Accreditation shall be issued to the garbage collectors/haulers upon determination of the MSWMB with technical recommendation of MENRO that it meets the criteria for accreditation and duly certified by the Municipal Mayor: The certification of accreditation shall be valid for three (3) years, provided that no violations committed; A fee of Php 1,200 shall be paid to the Municipal treasurer’s Office upon complying the requirements.

Rule VII ESTABLISHMENT OF SANITARY LANDFILL Section 1. The LGU shall establish a Sanitary Landfill which shall be provided with all the required support facilities/equipment in accordance with the schedule and guidelines proscribe in the 10-Year Solid waste Management Plan and shall conform to the guidelines provided in the Implementing Rules and Regulations of RA 9003.

Section 2.The sanitary Landfill shall be provided for resource recovery at the discretion of the municipal government and may mechanize operations to ensure it can cope with the required rate of processing of disposed solid waste.

The MRF shall receive the segregated wastes such as biodegradable waste for composting and recyclable waste for recycling from different sources in the barangay. The remaining residual wastes shall be transported to sanitary landfill for final disposal.

Section 3. The support facilities and equipment that shall be provided to deliver effective and cost efficient operations all be determined by the LGU and may include transfer Station. Block Compactors, Pay loaders, Dozers, Sheds, Lifters, Mechanized segregators, loading and Unloading Augers/Conveyors Receptacles/Bins. Leachate treatment and processing facility, weigh-bridge and related operation and maintenance facilities.

Materials recovery facilities shall be design to receive only process residual materials and recyclable materials efficiently and in an environmentally sound manner. The facility shall address the following considerations:

Section 4.The LGU shall impose tipping fees for all private haulers companies and individuals to dispose solid waste in the sanitary landfill/RCA to sufficiently support the cost of operation and maintenance of the facility.

Tipping fee charges to any party or entity who would like to avail the services of the Sanitary Landfill Facility/RCA for the disposal of their residual waste at the rate of Php 553.00 per tons of residual waste from residential, commercial, institutional and industries.

a) The building and/or land layout and equipment must be designed to accommodate efficient and safe materials processing movement and storage b) The building must be designed to allow efficient and safe external access and to accommodate internal flow c) If the MRF includes a composting operation it shall comply with the applicable provisions to composting of compost, d) The following records shall be kept and maintained such records shall be submitted to MENRO upon request: i. Record of daily weights or volumes and sources of waste received: ii. Record of weights or volumes of biodegradable wastes processed for composting and recyclable wastes for recycling iii. Record of weights or volumes of wastes removed from the MRF including the residual waste for disposal to sanitary landfill/RCA. e) Daily logbook of the following information shall be maintained: fire, special occurrences, unauthorized loads, injury and property, damage.

Section 2. MRF IN SCHOOLS- Schools and other educational institutional and offices of national government agencies and Private Corporation shall come up with an Ecological Waste Management program, including the segregation at source and provision of Materials Recovery Facility.

Section 3. DUTY OF BARANGAY COUNCILS- That it shall be duty of the respective Barangay Councils to primarily and supervise the solid waste management collection, segregation, and resource recovery of the waste generated by the households, buildings, their premises, and the premises or piece at business within their respective political boundaries.

Section 4. STORAGE DURATION OF WASTE – The appropriate duration for the storage of waste in the Materials Recovery Facility shall be determined by the barangay Council in coordination with the Municipal Environment and Natural Resources Office.

Section 5 MRF IN SUBDIVISIONS- That all subdivision owner and/or developers in Villanueva Misamis Oriental shall provide sufficient space for establishment for MRFs to store recyclables and store compostable materials of the homeowner or in coordination with the barangay.

Section 6 MRF IN SUBDIVISION LAYOUT PLANS– For subdivision developers who are planning to put up a subdivision or any land development projects in Villanueva Misamis Oriental, they shall incorporate the establishment of a MRF in their subdivision lay-out plan.

Rule VI COLLECTIONS AND TRANSPORT OF SOLID WASTE Section 1 Non-collection of Unsegregated Solid Waste - Only segregated waste and only the types of waste that are schedule for collection on a particular day and time shall be collected. Unsegregated waste shall not be collected. Repetitive disposal of unsegregated solid waste shall constitute a violation of this ordinance and shall be fined in the amount stated below.

1st offense – 500.00 2nd offense – 1,000.00 3rd offense – 1,500.00

After 3rd offense – 2,000.00 plus filing of appropriate legal action

Section 2. Collection Vehicles - Only collection vehicles covered with nets, tarpaulins and other similar materials shall be allowed to transport solid waste from the collection area to the Sanitary landfill/RCA. For the purpose at identification vehicles shall bear the body number, the name, and telephone number of the contractor/agency collecting solid waste.

Section 3. Required Personal Protective Equipment - All collectors and other personnel directly dealing with collection of Solid waste shall be equipped with personal protective equipment and cleaning implement such as, but not limited to gloves masks and safety boots to protect them from the hazard of handling solid wastes.

Section 4. Garbage Collectors Training - The Municipal Health Officer/MENRO shall provide necessary training to the collectors and personnel to ensure that the solid wastes are handled properly in accordance with the guidelines pursuant to the act.

Rule VIII MAINTENANCE OF CLEAN AND SANITARY SURROUNDINGS Section 1. Public thoroughfares, open spaces and grounds, unattended private and public lands shall be kept clean jointly by the municipal and barangays.

Section 2. Residential buildings and its surrounding shall be kept clean and tidy by the owner or lessee of the building at all times.

Section 3. Trees, shrubs and other vegetation within the vicinity of residences shall regularly be cared for and maintained to minimize generated waste/yard waste by the property owner and the barangay.

Section 4. The lobby and/or sidewalks, immediate grounds fronting the business and commercial establishment, stalls open spaces at markets shall be maintained and sanitized by the owner/operator or lessee/renters of the establishment.

Always keep the business area clean (5 meter radius from the edge of the building or up to the tip of the road if building is situated more than 5 meters to the edge of the road to maintain the 3-bins (biodegradable, recyclable and residual waste).

To clean the area before closing the establishments or any Structure utilized for business transactions.

To inform the customers and by-standers to dispose their garbage directly into the respective trash provided for the purpose.

Rule IX PLASTIC BAG REGULATION Section 1. The LGU through MENRO shall regulate the use of plastic bags in all commercial establishments in the Municipality.

No plastic bags shall be prodded to customers for dry goods and to wet goods that are already wrapped in plastic materials.

Section 2.This concerns plastic bags used to carry goods purchase at point of sale such as wholesale and retail business, fast food outlets, pharmacies, markets, food kiosks, sari-sari stores, ambulant vendors, and the like shall not provide plastic bags and/or sando bags as packaging materials for dry goods or cooked foods to customers.

Section 3. List exempted plastic bags: Transparent roll-on bag solely used to contain fresh chilled or frozen meat, seafood, poultry, vegetables and fruits and other than canned or packed foods.

A bag designed used to the disposal of waste.

A bag used for sampling and analysis purposes.

A bag that constitutes or forms an integral part of the packaging in which goods are sealed prior to sale in the local market.

A biodegradable bag duly certified by the Department of Science and technology and/or concerned government agency.

Section 4. The use of recyclable and reusable bags as alternative packaging materials shall be promoted such as natural fiber bags, woven bags (bayong), cloth bags, rattan baskets, shopping bags made from recycled waste materials.

Section 5. All stores and markets shall adopt the “Bring Your Own Bag (BYOB) Program” to mainstream the use of reusable bags.

MENRO shall promote and provide Information materials lo be utilized by the commercial establishments and public markets.

MENRO shall provide e-copy of information materials to a commercial establishments for printing to be displayed in conspicuous areas of the establishment.

Section 5. Authority to Collect Garbage Collection Fee – The LGU shall impose fees in amounts sufficient to pay the costs of operation and maintenance based on the type and volume of waste.

Section 6. All commercial establishments are mandated to formulate appropriate incentives to costumers such as point system and/or provide special counters to be called as “to encourage and recognize customers who are using reusable bags”.

a) The amount and schedule of fees shall be defined and provided for by the implementing Rules and Regulations however payments shall be consistent with the accounting system of government.

Rule X JUNKSHOP OPERATION

b) Large quantities of rubbish to be removed from any private buildings, premises or place. The occupant shall notify the MENRO at least 24-hours prior to the removal of the garbage, in order to validate and proper transportation may be furnished for the same; a fee in the amount of PhP 500 per cubic meter shall be paid to the municipality.

Section 1. No junkshop shall be established along water bodies, such as rivers and creeks, coastal areas and inside subdivisions.

Section 2. It shall be unlawful for any person, firm, association, partnership or corporation to operate or maintain a junk shop or junkyard, or to do business in junk at any place within the Municipality of Villanueva Misamis Oriental, in any manner contrary to the provisions of this ordinance and without first having obtained a business permit for such purpose. The documents required for the application of business permit shall be followed.

Section 3. Any space, piece or parcel of land, licensed and used as junkshop whether existing now or hereinafter created, shall have gate entrances and exits shall be properly and enclosed or separated from adjoining lots by walls or fences, such that all junk materials shall be stocked inside the junk shop premises and not be visible to the public Orderliness and sanitation within premises shall be followed.

Section 4. Sidewalks shall be free from stockpile of any junk materials.

Section 5. The LGU through MENRO shall have access to every junkshop owner/operator transaction books or registers to record acquisition or purchases, disposals or sales of junk materials for monitoring and regulation purposes.

Section 3. An incentive scheme shall be devised by the LGU for barangays utilizing their own facilities in the collection of residual wastes in their respective jurisdictions with the following guidelines.

1. The barangays have functional Barangay Solid Waste Management Committee;

2 The barangays have approved Barangay SWM Ordinance;

3. The barangays have approved SWM action plan with corresponding budget allocation;

4. The barangays have fully implemented the waste segregation at source and segregated collection;

5. The barangays have devised the garbage collection system for biodegradable, recyclables and residual wastes:

6. The barangay have functional Materials Recovery Facility (MRF) for recyclable waste;

7. The barangays have a conditioned garbage truck to carry their residual waste to sanitary landfill;

8. The cash incentive shall be given to barangay corresponding to the amount of residual waste disposed in sanitary landfill.

Section 6. The junkshop owner/operator shall permit law enforcers to conduct inspections of junkshop premises and transaction books or registers, and to present proof of purchases when requested.

Rule XIII JURISDICTION OF MUNICIPAL PUBLIC AGENCIES

Rule XI PUBLIC EDUCATION AND INFORMATION DRIVE

Section 1. The Municipal Environmental and Natural Resources Office (MENRO) shall insure the proper implementation of this Ordinance in coordination with other department in the LGU.

Section 1. The LGU led by MENRO in collaboration with key agencies and organizations shall conduct continuing education and public awareness and effect behavioral Change among citizen on solid waste management.

Section 2. The Municipal Economic Development Office (MEDO) shall be responsible for the supervision in the proper segregation and disposal of solid waste in the public markets and terminals including the municipal public cemeteries in coordination with the Municipal General Services Office (MGSO).

Section 2. The Municipal Government through MENRO shall produce a Solid Waste Management Information Education and Communication (IEC) Plan in close coordinator with the barangay LGU’s for its implementation.

Section 3. The LGU shall recognize the key roles of Civil society organizations in the promotion of Ecological Solid Waste Management by endorsing and patronizing environmentally acceptable packaging of products and materials.

Section 4. The LGU shall forge partnership with the Department of Education and the Commission on Higher Education to integrate ecological solid waste management into the school curricula at all levels.

Section 5. The LGU shall coordinate with the barangay LGUs to convene/organize and deputize local volunteer groups who shall serve as authorized Solid Waste Management agents to frontline in the Information, Education and Communication Campaign and enforcement of this ordinance.

Section 6. Solid Waste Management IEC materials such as stickers, flyers and other kinds of collaterals shall be posted and disseminated in strategic public places arid in public transposition vehicles.

Rule XII INCENTIVE MECHANISM Section 1. The LGU shall develop incentive mechanisms to encourage barangay institutions commercial establishments industries and Civil Society Organization options to develop and under lake socially acceptable and effective solid waste management interventions and actively participate in any promotional programs Section 2. The LGU shall adopt the BAYLO BASURA STORE PROGRAM as one of the incentive mechanisms with the following guidelines/mechanics.

1) The following guidelines/mechanics for the BayloBasura Store Program includes the following:

a. All 11 Barangays shall have a BayloBasura Store that shall be established in their Barangay Hall.

b. The MENR Office shall have its own BayloBasura Store, so there shall be a total of 12 BayloBasura Stores in the Municipality of Villanueva.

c. There shall be at least two Officer In-Charge in every BayloBasura Store.

d. Opening of the BayloBasura Store shall be every Monday, Wednesday and Friday.

e. Each Barangay shall provide their own weighing scale and record book for recording purposes.

f.

g. The BayloBasura Store Program shall be a point system basis. In which the trader (the one who will exchange their wastes to the store) shall be given a point coupon depending on the weight of wastes surrendered.

After purchased, they shall be given a leaflet about RA 9003.

h. The points coupon can be kept for a big redemption of items. No minimum or maximum volume required.

i.

The more segregated waste the trader bring the more points he/she can get from the stores.

j.

The goods to be exchanged shall be from MENR Office. All barangay shall be visited by MENRO staffs for the weekly audit.

k. All the segregated wastes from the traders shall be clean and dry and shall be place in the sack.

l.

The MENR Office BayloBasura Store shall be open every Tuesday and Thursday only.

Waste that has been traded shall have a label (trader’s name, pieces or kilos of wastes, date) for the verification before putting in the MRF.

Section 3. The Municipal Agriculture Office (MAO) shall provide technical assistance such as training and promotion of acceptable technology on composting and livelihood development or processing of Biodegradable/Compostable waste.

Section 4. The Municipal Engineering Office (MEO) in coordination with theBarangay shall be responsible over the cleanliness rivers, streams, canal esteros, storm drainage or in any natural and man -made waterways. Likewise, coordinate with MENRO on the operation and management of the sanitary landfill.

Section 5. The Municipal Health Office (MHO) shall ensure that all food related businesses in the Municipality shall be clean and sanitary.

Section 6. The Municipal Agriculture Office shall ensure the enforcement of the Ordinance on stray animals which may scatter Garbage in streets, highways, and such enforcement shall be coordinated with barangays.

Section 7. The Municipal Social Welfare and Development Office (MSWD) in coordination with barangays shall provide alternative livelihood opportunities for waste pickers in the municipality.

Section 8. The Municipal Information Office (MIO) in coordination with MENRO shall develop education and advocacy campaign program for ecological solid waste management.

Section 9. The Municipal Treasurer’s Office and/or its deputized agent shall collect and/or receive payment of fees and fines.

Rule XIV PENAL PROVISIONS Section 1. Prohibited Acts -The following acts are prohibited: a) Littering, throwing, dumping of waste matters in public places, such as roads, sidewalks, canals, esteros or parks, and establishment or causing or permitting the same. b) Removal, relocation, scattering and spilling of any wastes after it has been placed in the properly marked and color coded receptacle or in any manner interfere in the duty of garbage collection. c) Removal or taking away any coded garbage receptacles from duly designated locations other than the persons authorized by the Municipal and/or Barangay. d) Re-mixing of source-separated recycle material with other solid waste in any vehicle, box, container or receptacle used in solid waste collection or disposal. e) Open burning of solid waste. f) Burying of biodegradable or non-biodegradable materials in flood-prone areas. g) Causing or permitting the collection of non-segregated or unsorted waste. h) Squatting in sanitary landfill. i)

Importation of toxic wastes misrepresented as recyclable or with recyclable content.

j) Transport and dumping in bulk of collected domestic, industrial, commercial and institutional wastes in areas other than the Sanitary Landfill. k) Construction of any establishment within two hundred (200) meters from the sanitary landfill.

Section 2.Penalty Clause (a) Any violation of Article 14, Sections 56 a, b, c, d, e, f, g, Article VI Section 17 and Article VIII Section 31 of this Ordinance shall upon conviction be penalized with a fine of not less than five hundred pesos.(P500.00) or Community Service for one (1) day but not exceeding to two thousand pesos (P2, 000.00) or Community Service for five (5) days. (b) Any violation of Article IX Sections 30 (c), (e) end (g) of this Ordinance shall upon conviction be penalized with a fine of not less than five hundred pesos but not exceeding to three thousand pesos (P3, 000.00). (c) Any violation of Article XIV, Sections 56 h, I, j, k of this Ordinance shall upon conviction be penalized with a fine of not less than Five Thousand pesos (P 5,000.00) or imprisonment of not less thirty (30) days but not more than six (6) month or both (d) LGU and barangay officials who fail to comply with this Ordinance and its implementing Rules and Regulations shall be charged administratively in accordance with RA 7160 and other existing laws, rules and regulations, (e) National and Local government officials who fail to comply with this Ordinance and its implementing Rules and Regulations shall be charged in accordance with this Ordinance.

Rule XV ADMINISTRATIVE AND ENFORCEMENT MECHANISMS Section.1 Enforcement of this Ordinance shall entail the following procedure.

(1) Apprehension (2) Issuance of Citation Ticket (CT) (3 Payment of fine depending on prescribed penalty; and/or filling of case in court, if necessary.

Section 2. The Municipal Mayor shall deputize persons, individuals, or entities to be solid waste management enforcers, giving them the authority to affect the apprehension of violators in accordance with this Ordinance, and its Implementing Rules and Regulation. Provided however, that no person shall be deputized until he/she has completed the necessary training and capacity building for the effective implementation of the Ordinance.

Section 3. The MENRO and other deputized agents shall issue Citation Ticket (CT) to violators; Payment of fines imposed for violation(s) of this ordinance shall be made at the Municipal Treasurers Office and/or authorized representative.

The city government already requested such through the Social Development Council of the Regional Development Council (RDC). They also tapped the Commission on Higher CHED to shoulder the internet subscription fee in item number 14 where they can charge for distance learning.

“The initial plan was to give students the tablet for free, but because there’s no infusion of the budget from the national government, we sourced out our funds. We saw that we are still lacking in terms of the subscription fee; so the students must add P1,000 when they enroll and then we give them the tablet,” the mayor said.

Tan added that once CHED and the national government respond positively to such need for the next semester, the gadget can be given free to the learners.

Tangub City also partnered with DICT and other private service providers for a student convergence area “para palakasin ‘yung internet provision for the barangay halls as a study area for students if ever they will not go to the school to listen or observe social distancing,” Tan said.

CHED has already approved certain universities to train other universities on flexible learning to boost online learning capabilities under the new normal.

The beneficiaries are not limited to doctors, nurses and other healthcare workers but also extends to medical technologists and technicians, janitors, security guards, ambulance drivers and the like – as long as they can prove that their job involved regular exposure to COVIDpositive patients,” Macasaet explained.

Petitioner is seeking a judicial recourse in this petition, instead of availing herself of Republic Act No. 9255 because the said law is applicable only to illegitimate children born on March 19, 2004 and thereafter, while the subject person Queenny Tabamo was born on June 18, 2002 or before the effectivity of R.A. 9255. In a letter dated March 18, 2019, the Acting Municipal Civil Registrar of the Municipality of Sugbongcogon advised the petitioner that “pursuant to R.A. No. 9255, illegitimate children born on August 3, 1988 to March 18, 2004 cannot use the surname of the father. However, a petition in court may be filed in order that the child can use the surname of the father.” Hence, Republic Act No. 9255 cannot be applicable to the subject person. Since any change in the entry in the Civil Register could be made only upon a Judicial Order and to solve the predicament of subject person Queenny Tabamo, thru her half-sister, the Court is convinced that the present judicial remedy is proper.

The Court finds the Petition sufficient in form and substance.

Hence, the Court admits this petition. Let, therefore, this Petition be set for hearing on August 6, 2020 at 8:30 o’clock in the morning at Branch 26, Regional Trial Court (RTC), Medina, Misamis Oriental. At the expense of petitioner Geraldine A. Saraus, let a copy of this Order:

Mambajao underscores feats on 165th foundation day MAMBAJAO, Camiguin -- Despite threats of coronavirus disease (COVID)-19, the Municipal Government of Mambajao marked numerous achievements and developments on its 165th founding anniversary, July 6.

In his State of the Municipality Address (SOMA), Mayor Yñigo Jesus Romualdo cited various efforts of the government in uplifting the lives of its constituents including activities on COVID-19 response, social services, disaster risk reduction and management, infrastructure development, environmental protection, agriculture, and tourism.

“Truly, we have come a long way since 1855. Mambajao achieved so many milestones and endured so many challenges. And in all of these, we have become a much bigger community and a much better town in

“Through the creation of the Municipal COVID-19 Task Force, we were able to speed up the delivery of information and education to all our 15 barangays.
