Policeman nabbed for ‘extortion’

GENERAL Santos City-Police operatives arrested one of their colleagues here on Monday afternoon for allegedly extorting from a sister of a police applicant in exchange for favorable results in the required neuro-psychiatric and medical examination. Lt. Col. Aldrin Gonzales, public information officer of the Police Regional Office (PRO)-12, identified the suspect as Master Sgt. Arnel Abellera, 46, a member of the Regional Health Service (RHS)-12 based at Camp Fermin Lira here. He said the suspect was nabbed around 1 p.m. by elements from the Philippine National Police-Integrity Monitoring and Enforcement Group (PNP-IMEG) in an entrapment operation at a Jollibee branch in Crossing Makar, Barangay Labangal. Gonzales said Abellera was caught in the act of mulcting P50,000 from complainant Phoebe Maraguit, sister of a police applicant from Makilala town in North Cotabato. Based on Maraguit’s complaint, the suspect supposedly asked for such payment to ensure that her sister will pass the neuro-psychiatric

DAVAO City--Individuals from various sectors have expressed positive views on the fourth State of the Nation Address (SONA) of President Rodrigo Duterte on Monday, even as they voiced optimism that the administration’s visions for the next three years would be fulfilled. Pilipino Banana Growers and Exporters Association (PBGEA) executive director Stephen Antig said “the President’s instruction to certain agencies and Department Secretaries are laudable”. “Hopefully improvements will really be introduced” before the President’s term ends in 2022, Antig said. However, Antig voiced reservations on the creation of new agencies such as the Department of Overseas Filipino Workers,

pointing out that the country already has agencies for OFWs such as the Overseas Workers Welfare Administration (OWWA). “Creating a new office might just be a duplication,” he said. It was saying hello to a friend and long time partner for peace , Kagi Ibrahim Murad and bidding a final goodbye to a long time personal friend and partner in the profession, Atty Dario Rama. **** KAGI MURAD — Last week, I motored to Cotabato City to visit and meet up with the newly installed Chief Minister of the Bangsamoro Autonomous Region for Muslim Mindanao (BARMM). I haven’t met him since I left government end of November last year, altho we were in touch by phone from time to time. Our work together went a long way back. I’m briefly going back to memory lane just to refresh unforgettables ( and danger-

ous) moments with him. These were times in the past when we were both heads of the peace negotiation panels (MILF and the GRP) and we had to revive collapsed talks even when “war” was going on; we met in MILF camps and even abroad; we witnessed together how our peace meetings were amidst bombings and attacks from both sides; we painstakingly crafted a peace road map amidst moves of “spoilers” ; we both kept the course, “damn those torpedoes”, as the saying goes. In the end, the BARMM was born and now, Kagi Murad whose steady hand and integrity dominated the “conflict environment” made this all possible. *** CHALLENGES— His task now is not easy as he takes a firm hand in nurturing

this new born baby that all bangsamoro, Muslims and non-Muslims alike, nationwide must support. *** THE VISIT — There were a few points discussed during my recent visit that may somehow contribute in our group’s (Advocacy Mindanao Foundation, Inc) modest way to help nurture the BARMM from infancy. There are many offers from the private sector that the BARMM welcomes. Let’s all come around and help. *** GOODBYE DARIO — The last few days also was difficult to say goodbye to my former law professor at the Ateneo de Davao law school who became my law partner and a close family friend. His wife, Dr. Ellen attended to the delivery of all my 4 children. She’s a very close

friend of my wife Beth. **** INTEGRITY — I wish to share this altho some who knew him well may have their own narratives. He joined government in various capacities especially during the administration of President Arroyo. He was Chair of the graftbuster Presidential Anti Graft Commission, then as Comelec commissioner and Postmaster General. I always marvelled at his “old-fashioned”integrity, shown in so many ways. ‘Death penalty’ for drug traffickers, corrupt execs

PRESIDENT Rodrigo Duterte talked about the various programs of his government during his three-year term in office. Halfway before his term ends in 2022, he admitted that the illegal drug trade in the country persists despite the iron-fisted policy of the government. During his 4th State of the Nation Address (SONA) this year with the Congressional bicameral body, Duterte also cited “massive corruption” in the government, which become a trademark of Philippine governance. SONA is an annual tradition practiced by Philippine Presidents delivered at the start of the fiscal year in the Congressional bicameral body. In his speech, Duterte

asked Congress to pass the law that would re-implement the “death penalty” against purveyors of the illegal drug trade in the country. In addition, the President also wants the inclusion of “plunder” as a crime that would merit the death penalty. Understandably, the focus of the imposition of the death penalty would be on crimes against illegal drugs and corruption. Plunder is the mother of all corruption in the government. A government official, especially elected public official, suspected to have pocketed or stolen government funds of, at least, P 50 million could be charged with plunder. Once proven guilty of plunder, Duterte wants the public official meted the extreme

penalty of death. There was sepulchral silence about death penalty imposed on perpetrators of “illegal drug trade.” Perhaps, the august body agrees silently on Duterte’s pleadings to mete the penalty of death against perpetrators of illegal drugs. Duterte’s proposed death penalty for the perpetrators of illegal drugs bring us back to the 70s during the Martial Law era. Sometime on Jan. 15, 1973, Lim Seng, a Chinese businessman who ran a number of legitimate businesses to cover up his illegal drug trade, was meted the penalty of “death by musketry.” By the way, the execution of Lim Seng by “firing squad” was carried out in Luneta Park in Manila in broad daylight witnessed

by thousands of people and covered by the national and international press. Since then, the proliferation of illegal drug trade and syndicates in the country stopped. Nobody dares to experience the “death by musketry” anymore. Perhaps, the illegal drug syndicate relocated has relocated their operation in other countries in Southeast Asia. There is the suspicion that the illegal drug syndicate in the country was reinvigorated in the country when the Aquinos and their political conspirators grabbed power. 31 Army-PNP Enhance Skills, Completes News Writing Training in Butuan City BANCASI, Butuan City--31 personnel coming from the Philippine Army (PA) and Philippine National Police (PNP) enhanced their skills as they completed the 3-Day News Writing Training held at Headquarters of 402nd Infantry (Stingers) Brigade, Philippine Army located at Brgy Bancasi this City. In partnership with the Philippine Information Agency (PIA) Caraga, the Basic News Writing Training participated by twenty one (21) personnel of the 402nd Infantry (Stingers) Brigade and ten (10) personnel of Butuan City Police Office (BCPO) formally culminated in a Closing Ceremony on July 20, 2019. “We are very grateful for including us in this training. It really helped us a lot in learning the skills in news writing and the proper way of conveying our messages to the people”, Police Corporal Mabilog of BCPO expressed at the trainings culmination ceremony. The President issued the directive to Land Transportation Office (LTO), Social Security System (SSS), Bureau of Internal Revenue (BIR), Land Registration Authority (LRA), and PagIBIG Fund as he delivered his fourth State of the Nation Address (SONA) at the House of Representatives. “Based on complaints received by the Contact Center [ng] Bayan, Contact Center [ng] Bayan --that’s in my office-- the LTO, SSS, BIR, LRA, and PAG-IBIG are the top five agencies that need to drastically improve their service,” he said.

MANILA – Rates of Philippine treasury bills (T-bills) went down across the board Monday, which National Treasurer Rosalia de Leon attributed to expectations for lower rates in the near term. This followed hints of imminent rate cuts supposedly coming from officials of both the Federal Reserve and the Bangko Sentral ng Pilipinas (BSP). The Federal Open Market Committee (FOMC) will have its meeting on July 30-31 while BSP’s policy-making Monetary Board (MB) will have its rate setting meet on August 8. Average rate of the bellwether 91-day paper went down to 3.769 percent from 3.883 percent during the auction last July 8. The Bureau of the Treasury (BTr) offered this tenor for PHP4 billion and investors submitted PHP12.41 billion word of tenders. The auction committee made a full award. BAP launches online drive against cybercrimes THE Bankers Association of the Philippines launched its online campaign Be Aware, Be Cybersafe to help raise public awareness on cybersecurity amid growing concerns of cyber attackers shifting their focus to the Asia-Pacific region. Nature of the Complaint 2.1 The foregoing complaint is one for the Judicial Recognition of a Foreign Divorce Decree filed by the Complainant, a Filipino Citizen (and therefore governed by the Philippine Law) against the respondent, an Indian National, pursuant to Article 15 of the New Civil Code and Article 26 of the Family Code, and the Complainant herein seeks to be approved so that said decree, in turn, may be recorded in the Local Civil Registry because she is a Filipino citizen, and she was once married to the respondent and their marriage record or marital status remains as “married” in the records of the Embassy of the Republic of the Philippines in Singapore per Certificate of Marriage under Registry No. 321/2008 dated 17th of November, 2008, copy of which is appended as Annex “B” and made as an integral part of this Complaint. Thus, Complainant seeks for the recognition of foreign divorce decree and the same be recorded in the Local Civil Registry;

III. Factual Antecedents 3.1 The Complainant and private respondent Kailash Bhatti, entered into a contract of marriage on said date which is recorded as Registry No. 321/2008 (See Annex B hereof). 3.2 Subsequently, sometime in 2012, the parties, initiated by the private respondent, obtained divorce decree No. D3572/2012/V issued by the Subordinate Courts of the Republic of Singapore, copy of which is herewith appended as ANNEX “C” and made as an integral part hereof, the original of which was duly authenticated by Zaharah Ramli, Registrar of the Family Courts of Singapore on October 11, 2018; IV. Legal and Procedural Bases 4.1 Pursuant to Sec. 48, Rule 39 of the Rules of Court and the Supreme Court ruling in conjunction with the dictum in Republic vs. Orbeciso III, judgments/ orders rendered by the foreign courts must be passed upon judicially by Philippine Court to prove its validity; 4.2 Filed before this Regional Trial Court, is this instant Complaint for recognition of a foreign decree of divorce that it may be recognizd in this jurisdiction, pursuant to Rule 39 Sec. 48; 4.3 As for the venue of this special proceeding, it is not merely for convenience that Complainant opted to file this Complaint here in Kapatagan, Lanao del Norte, as this right to choose the venue is provided for by the rules. The propriety of venue in civil vis-a-vis criminal case is enunciated in another case where it was held that: It is elementary that objections to venue in CIVIL ACTIONS arising from libel may be waived since they do not involve a question of juisdiction. The laying of venue is procedural rather than substantive, relting as it does to jurisdiction of the court over the person rather than the subject matter. Venue relates to trial and not to jurisdiction, matter. It relates to the place of trial or geographical location in which an action or proceeding should be brought and not to the jurisdiction of the Court. It is meant to provide convenience to the parties, rather than restrict their access to the courts as it relates to the place of trial. In contrast, in criminal actions, it is fundamental that venue is jurisdictional it being an essential element of jurisdiction. 4.4 As the Complaint shows, its filing is properly made with respect to jurisdiction. As for the venue, the Complaint sufficient cited that the parties are now based abroad. To strictly require that the Complaint should be filed and tried in Singapore would now amount to restricting the parties access to the courts, in contravention of the rule that venue is not jurisdictional. According to the report, the number of domestic tourists also reached 110 million, which is an increase of 14.1 percent from the previous year’s figure of 96.4 million. Tourism as an economic driver Tourism also proved to be an important component in driving economic growth as employment in the sector rose to an estimated 5.4 million, 1.8 percent higher than the 5.3 million in the previous year. For 2018, the tourism industry’s contribution to the country’s Gross Domestic Product rose to 12.7 percent, based on the data provided by the Philippine Statistics Authority. The Tourism Direct Gross Value Added (TDGVA) also amounted to PHP2.2 trillion, which is an increase of 14.3 percent from the 2017 TDGVA of PHP1.9 trillion. To harness the potentials of this industry, the Duterte administration, through the DOT and the Department of Transportation, continues to work on developing more ports to improve connectivity in the country. Aside from developing seaports, the Duterte administration also sought to upgrade and rehabilitate domestic and international airports.
