Mayors defy Duterte’s order on clearing main highways of pedicabs, motorcycles METRO MANILA - The Department of Interior and Local Government (DILG) has warned city and municipal mayors on President Rodrigo Duterte’s marching order to clear the main highways from motorcycles, pedicabs and tricabs. Opol beauty bags Miss Kuyamis 2020 crown

EL SALVADOR CITY, Misamis Oriental, Jan. 10 (PIA) --The crowd cheered as Isobel June Teaño of Opol, Misamis Oriental bagged the crown for this year’s Miss Kuyamis 2020.

A total of 21 beauty contingents representing 19 municipalities and two cities in the province battled for the title on January 9, 2020 at El Salvador City Gymnasium.

THE Securities and Exchange Commission (SEC) has moved closer to putting the officers and promoters of Kapa-Community Ministry International (KAPA) behind bars with the filing of criminal charges against the scamming group.

In a separate information filed with the Bislig City Regional Trial Court Branch 29, the Department of Justice (DOJ) accused KAPA of “willfully, unlawfully and criminally” engaging in the selling or offering for sale or distribution of securities to the general public without a registration statement duly filed with and approved by the SEC. Accordingly, the DOJ charged KAPA Founder and President Joel A. Apolinario, Trustee Margie A. Danao and Corporate Secretary Reyna L. Apolinario

of violating Sections 8(8.1), 26.1 and 28 of Republic Act No. 8799, or the Securities Regulation Code (SRC).

The DOJ also indicted Marisol S. Diaz, Adelfa Fernandico, Moises Mopia and Reniones D. Catubigan for violation of Section 26.1 of the SRC for promoting the investment scam.

The DOJ further charged Diaz before the Rizal Regional Trial Court for violation of Section 28. It filed similar Information against Mopia and Fernandico with the Quezon City Regional Trial Court Branch 93.

The concerned judges, upon finding of sufficient probable cause for the issuance of Warrants of Arrest, shall order the arrest of the indicted officers and promoters of KAPA, in accordance with the Revised Rules of Criminal Proce-

dure.

So far, the SEC has verified that a Warrant of Arrest was issued by the Quezon City Regional Trial Court on December 2, 2019 against Fernandico.

The criminal proceedings stemmed from the complaint filed by the SEC on June 18, 2019 against KAPA for the unauthorized sale or offering for sale or distribution of securities to the general public.

In a resolution issued on September 25, 2019, the DOJ found probable cause to bring charges against KAPA, affirming the findings of the SEC. The Commission found KAPA to have enticed the public to invest at least P10,000 in exchange for a 30% monthly return for life, without having to do anything other than invest

and wait for the payout.

The SEC also found KAPA to have employed a Ponzi scheme, an investment program that offers impossibly high returns and pays investors using the money contributed by later investors.

Under Section 8(8.1) of the SRC, securities shall not be sold or offered for sale or distribution within the Philippines without a registration statement duly filed and approved by the SEC. Section 26.1 further provides that it shall be unlawful for any person, directly or indirectly, in connection with the purchase or sale of any securities to employ any device, scheme, or artifice to defraud.

Go lauded for quick action on stalled Central Mindanao Airport

DAVAO CITY -- Mindanao Development Authority (MinDA) Secretary Emmanuel Piñol lauded the quick response of Senator Christopher Lawrence “Bong” Go to resume the work on the stalled Central Mindanao Airport in M’lang, North Cotabato.

Much the better!

WE could spend all year living healthier, more productive lives, so why do we only decide to make the change at the start of the year? Why do we all make (and break) New Year resolutions?

Many of us will start 2020 with resolutions – to get fit, learn a new skill, eat differently. If we really want to do these things, why did we wait until an arbitrary date which marks nothing more important than a timekeeping convention?

British psychologist Tom Stafford asked this. And not only he. The answer tells us something important about the psychology of motivation, and about what popular theories of self-control miss out.

Today is a very cool and rainy day. I am lazy. Not on the mood to do anything. It’s even difficult to write this

column. But my motivation gets bigger and bigger while writing. New Year resolutions? Many writers discussed about this topic already. Here are my two cents in.

While celebrating during New Year’s night, my family and friends found out, that what we want isn’t really straightforward. At bedtime you might want to get up early and go for a run, but when your alarm goes off you find you actually want a lie-in. When exam day comes around you might want to be the kind of person who spent the afternoons studying, but on each of those afternoons you instead wanted to hang out with your friends. Believe me - I heard it many times from my students.

You could see these contradictions as failures of our

self-control: impulses for temporary pleasures manage to somehow override our longer-term interests.

One fashionable theory of self-control, proposed by Roy Baumeister at Florida State University, is the ‘ego-depletion’ account.

This theory states that selfcontrol is like a muscle. This means you can exhaust it in the short-term – meaning that every temptation you resist makes it more likely that you’ll yield to the next temptation, even if it is a temptation to do something entirely different.

A corollary of the ‘like a muscle’ theory is that in the long term, you can strengthen your willpower with practice. So, for example, Baumeister found that people who were assigned two weeks of trying to keep their back straight

whenever possible showed improved willpower when asked back into the lab.

But, and more importantly, that theory doesn’t give an explanation why we wait for New Year’s Day to begin exerting our selfcontrol. If your willpower is a muscle, you should start building it up as soon as possible, rather than wait for an arbitrary date.

Remembering the landing at Lingayen Gulf

75 years ago last week, (January 9, 1945) Allied forces landed in Lingayen Gulf in the second major land offensive to reclaim the Philippines from Japanese occupation forces. The first occurred in Leyte on October 20, 1944.

The Lingayen operation is the subject of a forthcoming book “From Leyte to Bessang Pass” written by this author to commemorate the 75th anniversary of the end of World War II in the Philippines. “From Leyte to Bessang Pass” was based on volumes of books and online materials written about the subject by military historians, foreign and Filipinos alike. MY objections on the peace talks are neither because I am on the hit list of the NPA nor because the New People’s Army (NPA) had attacked an Armed Forces of the Philippines (AFP) detachment or Municipal Hall where the armed forces or police officers are posted. In the laws of war, I am a legitimate target of the NPA being the National Security Adviser and former Chief-of-Staff of the AFP. So to me, it is a fair game if I am in a hit list or if an AFP or PNP detachment or post is attacked.

What is objectionable is when the NPA, surely under the command of National Democratic Front (NDF) and Communist Party of the Philippines (CPP), attacks or ambushes civilians as they did in Barangay Libuton,

events as simply and, as much as possible, sequentially as they happened.

MANILA -- IHS Markit Asia Pacific Chief Economist Rajiv Biswas said Asian markets, including the Philippines, should remain vigilant amid the surging crude oil prices due to the escalation of geopolitical tensions in the Middle East.

In an e-mail, Biswas said a large number of Asia Pacific countries are vulnerable to the rapid increment in world oil prices, particularly industrial nations such as China, Japan, South Korea, India, Thailand, and Singapore. These countries are heavily reliant on imported oil from Middle East.

“If world oil prices rise sharply due to further escalation in the Middle East crisis, many Asian nations are also vulnerable to the impact of higher oil import prices on retail inflation,” Biswas said. “(T)his could hit the P h i l i p p i n e s e c o n o my through higher inflation as well as rising oil import costs, which could further widen the current account deficit,” he said.

Biswas said if world oil prices will rise sharply resulting in higher consumer prices, he forecasted that the Bangko Sentral ng Pilipinas (BSP) would likely postpone its plans to ease monetary policy until global crude prices stabilize.

MANILA -- The peso and the Philippine Stock Exchange index (PSEi) finished up Thursday as investors’ worries on the US-Iran tension slightly eased after the missile attacks on US military bases in Iraq.

The local currency ended the day at 50.651 from 50.756 Wednesday, which BPI Research said “reflected the improvement in global risk sentiment.”

This, after US President Donald Trump decided not to retaliate from Iran’s missile attacks on US bases.

The local unit opened the day at 50.65, an improvement from the 51.16 start in the previous session.

It traded between 50.74 and 50.525, resulting in an average of 50.603.

Volume reached USD1.58 billion, lower than the USD1.96 billion a day ago.

The currency pair is seen to trade between 50.50 and 50.90 on Friday.

The main equities gauge rose 0.79 percent, or 61.40 points, to 7,797.64 points.

All Shares gained 0.38 percent, or 17.25 points, to 4,612.83 points.

Bulk of the sectoral indices followed suit, led by the Mining and Oil with a jump of 2.06 percent.

PANGALAY The PANGALAY a traditional Tausug weeding dance and popularly known as the fingernail is one of the most well-known dances accompanied by a KULINTANGAN ensemble. This dance is distinctive because dancers use metal or golden nail extenderscalled JANGGAY which make fingers stiff and set them apart from the thumps. The Pangalay imitates the mythical Sarimanok bird, a reincarnation of a goddess who loved a mortal man after the dance.

The KALIS were the traditionally Tausug Sword and it is a type of double edged sword often with a “wavy” section and the Kalis’s can be used for both cutting and thrusting.

The kalis blade is defined as one that is wide on the base and double edged. It is capable of delivering both chopping and slicing cuts. While many assume the tradition form of the Kalis is the fully wavy blade the halh-waved half-straight, as well as the fullt straight blads, are equally if not more common, as straight blades were more practical in combat.

Moro Kalis blades generally ranges in size from 18 to 26 inches (46 to 66cm), though as with all Moro’s weapons.

Only recently, the Commission called out Roger Abing Camingawan and Daniel Flash Villas for falsely claiming, in paid radio broadcasts from General Santos City, that KAPA successfully registered as a crowdfunding entity, pursuant to SEC Memorandum Circular No. 14, Series of 2019, among others.

KAPA, through its counsel on record, earlier disclaimed authorizing the publication of such false claims on social

media and noted that only Catubigan and Ronnie Garay may speak on behalf of the group.

tion for a total of 455 years and ordered them to pay the complainants a total of P8 million. In addition, Rosario was sentenced to suffer life

imprisonment in a separate conviction for syndicated estafa, affirmed by the Supreme Court in July 2017.

Likewise, let me also quote the late Fr. Conrado Balweg, the former Cordillera People’s Liberation Army (CPLA) and Cordillera Bodong Association Chairman: “They are organized to take

political power, to become the government, to be the ones in Malacañang. Iyon ang issue sa kanila, hindi peace. Sa peace talks, we are not addressing the problem because we are talking something beyond the point. The NPA is created in order for the CPP to be the ones in government. That is the issue.”

If indeed Joma Sison and the CTG, as well as the 131 Honorable Congressmen who are in favor of peace talks as reported, then let us be clear on what the objectives of the peace talks are. Are we going to hand over governance to the CTG or at least be in a coalition government with them? Are we going to demobilize and demilitarize the NPA or let them become part of the new government armed forces?

Perhaps the answers lie in why the CTGs had been bannering - the so-called Comprehensive Agreement on Social and Economic Reforms (CASER) as a document to be signed prior to the signing of an Interim Peace Agreement.

Let us, therefore, examine their Comprehensive Agreement on Social and Economic Reforms (CASER). They claim that their CASER contains “concrete and doable steps towards liberating the Filipino people from poverty, exploitation, and underdevelopment.”

At first glance, this may appear to be pro-masses as it promises to benefit the majority, if not all, but if we look at it closely, the duplicitous character and self-interest of the CTG become evident, as the provisions do not directly reflect the best interest of the nation, but their own.

For one, their CASER was crafted with the goal of turning the Philippine economic model to nationalist and socialist. This means dismantling the effects of globalization which the CTG views as the source of the country’s continued underdevelopment.

However, dismantling the current economic model means reversing all economic reforms in the past several decades implemented through laws passed by previous administrations. Such move would be an arduous, costly, and extensive process. The Philippines might not only find itself worse off economically if it lets go of the advantages of the current system but also face ostracism and isolation in the community of nations after such a radical shift.

Second, their CASER binds not only the current administration and the CTG, but also ALL THEIR SUCCESSORS. We believe that future conditions merit suitable responses. It would be unreasonable for the current administration to commit to something that would be irrevocable and might present challenges for the next administrations.

Third, the NDF demands that the Agreement shall remain in force and in effect irrespective

of the course and outcome of the peace negotiations. This robs the Philippine government of its ability to negotiate on equal footing with the CTG and therefore might sabotage our efforts in attaining a genuine and lasting peace with the rebels.

Their CASER also wants to demobilize the Philippine military personnel by reducing their functions only for civil works and infrastructure construction. On the other hand, under the CASER, the NPA is designated to play a key role in implementing agrarian reform.

This will be hugely detrimental to the Philippine government because the military must be able to retain its mandate to protect the people and the nation under various kinds of threats.

Moreover, conceding to their CASER version will not only be an act of admission of their accusations but an act of disregard to the efforts of our leaders and lawmakers in addressing pressing societal issues. The President under his administration labored for the passage of fundamental policy reforms and laws that address the root causes of armed conflict.

These policy reforms include the aggressive implementation of land reform, free irrigation, Free Tertiary Education, Universal Health Care, Expanded 4Ps, and the Build, Build, Build Program.

We have had many attempts to end the conflict with the CTG since 1986 with over 40 rounds of peace talks conducted and with the same people as negotiators. But for the longest time, the peace talks were only used as a period to rest when badly beaten, seek reinforcements, and initiate recruitment. Engaging in another round of peace talks after all these years and all our efforts without significant changes is therefore pointless.

After presenting the objectionable provisions of their proposed CASER, would it be beneficial to the nation that we engage the CTG in another round of peace talks?

We have alternatives to peace talks. We are now pursuing local peace engagements which have resulted in understanding and the mainstreaming of rebels.

Moreover, the government has the capacity to fulfill its obligations for social justice and development.

“For safety reasons, no tricycle or pedicab should operate in national highways utilized by four-wheel vehicles greater than four tons and where normal speed exceeds 40 kilometers per hour,” Año pointed out.

He said the government recognizes that pedicab and tricycle operations give livelihood opportunities and income to the marginalized Filipino families but allowing them to ply on the main thoroughfares only put their lives in danger situations, aside from the fact that they can also create traffic.

Año said “The regulation of tricycles and pedicabs on national highways is for the best interest of everyone.”

He also made it clear that said vehicles may only be allowed by virtue of a Sangguniang Panlungsod (city or municipal councils) to traverse to the main highways if there is no other no alternative routes to transfer to other areas in their respective cities and towns.

Año said he ordered the directive after receiving reports that there are a lot of pedicabs and tricycles plying the routes even in the main thoroughfares which really pose hazards and dangers among passengers, vehicles and drivers as a whole.

He also warned municipal and city mayors to strictly adhere to the standards and guidelines provided for by Memorandum Circular 2007-01, which include the basic considerations in the preparation and implmentation of city or municipal pedicab and tricycle franchises, regulatory ordinances or codes.

Among those basic guidelines, Año said, includes banning of tricyles and pedicabs along national highways as well as prohibiting said vehicles to carry more passengers more than the allowable limits, or what is only authorized in their franchises.

Meanwhile, DILG also warned to prosecute municipal and city mayors who did not implement the road clearing project of Pres.

Duterte in their respective places.

The DILG chief executive said the first 10 mayors were among the 97 mayors all over the country who failed to properly answer the directives of their office. They have also failed to implement properly the road clearing order of the president.

In a report, ING Bank Manila senior economist Nicholas Antonio Mapa attributed the increase in bank lending last November to the impact of the cuts in BSP’s key policy rates.

Monetary officials said the impact of these cuts has a lag of several months.

Mapa said impact of the rate easing is starting to feed into the economy.

He added before the improvement of bank lending last November, it was on the decline which may be partly traced to the slowdown of domestic growth in the first half of 2019.

Growth, as measured by gross domestic product (GDP), slowed to 5.6 percent in the first quarter of the year from quarter-ago’s 6.3 percent.

It further decelerated to 5.5 percent in the next quarter but recovered to 6.2 percent in the third quarter due to the catch-up spending program.

“Strong lending growth moves in line with our expectation for a photo finish 4Q (fourth quarter) GDP to clock in at 6.6 percent, enough to lift full year growth to 6.0 percent,” Mapa said.

The economist particularly cited the investment momentum and durable investment activity which had been an integral part of the growth pullback in the second and third quarters, and the recovery could be crucial to the fourth-quarter finish.

“We expect the Philippines to defy the odds and finish the year on a strong note to complete the tale of two halves, firing all cylinders going into 2020,” he added. (PNA)
