‘Ombud’ dismisses Oca, Kikang is new Mayor Volume VII, No. 210

CAGAYAN de Oro City-Vice Mayor Reiner Uy is the new City Mayor of this trading hub of about 600,000 people in Northern Mindanao.

The Department of Interior and Local Government (DILG) served the dismissal order against incumbent City Mayor Oscar Moreno and three others at 3:48 Monday afternoon.

The Mindanao Daily News (MDN) obtained copies of the dismissal order.

Also ordered dismissed were Elmer M. Wabe, Patrick U. Gabutina, and Rolando M. Pacuribot.

Moreno and the three other city officials were ordered dismissed for Grave Misconduct, Serious Dishonesty and Conduct Prejudicial to the Best of Public Service.

The dismissal order also carries the penalties that cancels eligibility, forfeiture of retirement benefits and perpetual disqualification for re-employment in public service.

PDEA hit for abusing ‘search warrant’ in case vs state college president in NorCot KIDAPAWAN City--The lawyer of an embattled president of a state-run college in Arakan, North Cotabato, from whose residence inside campus authorities claimed finding P500,000 worth of shabu and various high-powered firearms, has lambasted the Philippine Drug Enforcement Agency (PDEA) for ordering a manhunt against his client even though there was no arrest warrant issued by the courts.

Lawyer Israelito Torreon noted that only a search warrant was issued for authorities to check the President’s Yard – a compound inside campus where the administraiton building and the residence of Dr. Samson Molao, president of the Cotabato Founda-

tion College for Science and Technology (CFCST), are situated – ­ and yet the raiding party arrested the school’s guards.

Last January 29, PDEA operatives from the national headquarters led by Levi Ortiz, director for Special Enforcement Services, and elements of the police’s Special Action Force, conducted the raid before dawn inside campus located at Barangay Doruluman in Arakan, North Cotabato reportedly because of the existence of a shabu laboratory and the proliferation of highpowered firearms.

Molao was reportedly not in the campus during the raid starting around 3 a.m. and still at large as of press time.

THE Maute Group is now considered “virtually decimated” as it has “no capability to wage war and it will take years before they could recover, if at all,” Western Mindanao Command chief Lt. Gen. Carlito Galvez told MindaNews in a telephone interview.

City Council puts on hold proposals to commend wounded SWAT member KIDAPAWAN City--The legislative council here has put on hold proposals to give a wounded member of the Special Weapons and Tactics (SWAT) team commendation for his valor and heroism.

Kidapawan City councilor Jivy Roe Bombeo, author of the resolutions, said the council has yet to dig deeper into the incident that involved Police Officer 3 Erick John Yamuta, SWAT member who was critically wounded after he engaged in a shootout with a group of armed men on January 27.

The proposals were referred to Councilor Fran-

cis Palmones, chair of the Committee on Peace and Order; and Councilor Ruby Padilla-Sison, chair of the Committee on Human Rights of the Sangguniang Panlungsod ng Kidapawan.

Bombeo, in an interview over radio station DXND here, said the council is set to invite to a question hour city police director, Chief Inspector Ramel Hojilla, to shed light on the issue.

Initially, Bombeo said he was shown footages of the close-circuit television (CCTV) that captured the shooting incident.

Based on the CCTV footages, Yamuta, who at that time was doing a security

check along the highway, responded to the shooting incident that transpired at a commercial district here and engaged a group of gunmen in a shootout.

The police identified these gunmen as Sugar Rey Dimaano, David Adolfo, and Mario Pagaduan dela Cruz.

Dimaano, police records showed, was a drug surrenderer.

Investigators also considered illegal drugs trade as one of the motives for the shooting.

Provincial council confirms 2017 Revised Traffic Code of Panabo City

The Sangguniang Panlalawigan of Davao del Norte has recently confirmed City Ordinance 31-17 otherwise known as the 2017 Revised Traffic Code of Panabo City.

According to Public Transportation Committee Chair JOB FAIR. However, why do some learners get low scores during periodical tests?

Generally because they did not develop in them the love for reading. One of the interventions that English and reading teachers do in the classroom is the DEAR program or Drop Everything and Read.

DEAR is a time set aside for teachers and learners

Read. The goal of DEAR is to encourage independent silent reading for particular time on a daily or weekly basis. Students choose the book they wish to read, share what they’ve read, and receive the support they need for further reading explorations and reflections.

Through this reading program of the Department of Education,the teachers could also develop the children’s love of reading,peer teaching, the independent readers would help the

‘Kikang’ should exercise his mayoral authority As expected, supporters of beleaguered Cagayan De Oro City Mayor Oscar S. Moreno would immediately troop to the City Hall every time reports of alleged suspension or dismissal order were about to be served to the city mayor.

With the dismissal order served last Monday afternoon, the supporters would likely swarm in front of the City Hall in the guise of a “prayer rally” to purportedly ask “divine intervention” to prevent the dismissal or suspension of Moreno to prosper. But, this trick is no longer credible.

It is of note that the use of the “prayer rally” and the “church” as a means of shielding oneself, particularly by a politician from possible arrest or dismissal has become rampant and incredible.

porters who come along to join the “prayer rally” are those who always want to gain something from the administration.

Anyway, what divine intervention are we talking about here? There is no such thing as divine intercession.

On the contrary, in the case of Moreno, the divine intervention would mean the release of the restraining order by the Court of Appeals.

Last week, prior to the release of the memorandum of the latest dismissal, Moreno’s camp has filed a “status quo ante” with the CA. Of course, the status quo ante was meant to prevent the latest dismissal order to be served. What happened?

Perhaps, the CA already feels the people’s consternation of the court’s propensity of releasing a restraining order every time Moreno

is suspended or dismissed that, this time, the court has not responded with the “status quo ante” of Moreno’s camp.

Anyway, will the status quo ante become enforceable when the dismissal order was already served?

Does anyone remember the TRO issued by the CA a day after the DILG’s dismissal order was served against Moreno in 2016?

Well, if the CA would again set aside the latest dismissal order by granting the “status quo ante,” what does anyone expect of this administration?

The fact that despite the dozens of anti-graft cases, the ruling political party has welcomed Moreno to its fold means only one thing – this administration is ready to protect its allies at all costs.

obsession to rid this government of corruption is only a “double talk.” A cheap political overture, so to speak.

It is sad, that while Duterte enjoys the so called “popular support” (as far as the SWS Survey is concerned), his fight against corruption in the government remains unpopular.

On the contrary, Duterte is aiming guns against the judiciary, which, for some, is an indication that Duterte wants the judiciary to toe the line with his administration.

Call it preposterous, but it is the public perception when the highest elected public official of the land fails to act with decisiveness against those perceived to be corrupt “allies and friends.”

by Loren Allred WE can’t simply begrudge Big Business for making money — that’s the basis of their capitalist thinking, no debate about that.

However, we get annoyed when Big Business hides under corporate rugs their tax obligation with the government.

More so, when they deliberately manipulate their income in ways that are clearly not in the best interest of the government, but solely for their abusive practice of corporate greed.

Under Malacanang’s TRAIN or the Tax Reform for Acceleration and Inclusion, the Duterte economic measure is expected to go full steam in creating a more just, simple, and effective system of tax collection The rich will have a bigger tax contribution and the poor benefitting more from the government’s programs and services.

The measure is expected to generate P130 billion, which will fund the Duterte administration’s “Build Build Build” program, construction of public school facilities, and potable drinking water supply in public places, among others.

On the other hand, Malacanang’s campaign against corruption is in full steam, rallying through the bureaucracies of both the government and the business sector.

Accordingly, President Duterte signed Executive Order No. 43 creating the Presidential Anti-Corruption Commission.

The EO stated that the commission is mandated to directly assist the President in investigating and/or hearing administrative cases primarily involving graft and or corruption against all presidential appointees.

Likewise, EO 43 is dedicated to providing assistance to the President in the investigation and hearing of administrative cases and complaints, and in the conduct of lifestyle checks and/or fact-finding inquiries.

Further, EO 43 also serves as ‘look out’ on presidential appointees and other public officers allegedly involved in graft and corrupt practices, or have committed other higher

crimes and/or violations of the Code of Conduct and Ethical Standards for Public Officials and Employees.

The commission would have power, on a complaint, or motu proprio, and concurrently with the Office of the Ombudsman to hear, investigate, receive, gather, and evaluate evidence, intelligence reports, and information in administrative cases against all presidential appointees.

There’s a story about a man and woman who had been married for over 60 years. They had shared and talked about almost everything. But the wife had kept a special box in her closet. She had asked her husband never to open it or even ask her about it.

Then one day, the old woman got very sick and the doctor said she would never recover. Her husband began to sort through all of his wife’s belongings. When he found the box, he brought it to his wife’s bedside. She

agreed that it was finally time he knew what was in the box. Her husband opened it and found 2 little handkerchiefs and a stack of money totaling $25,000!

His wife explained: “When we were married, my grandmother told me that the secret of a happy marriage was to never disagree or argue. She told me that if I ever got angry with you I should just keep quiet and sew a handkerchief.” The old man was so touched and moved he had to hold back the tears. Only 2 handkerchiefs were in the box. He

She answered: “Oh, that’s the money I made from selling all the other handkerchiefs.”

Now, back to where the CYNOSURE starts, the new City Mayor of Cagayan De Oro is Ranier “Kikang” Uy. Uy, son of the incumbent Congressman Rolando Uy of the city’s first district, is a hesitant City Mayor.

The catch is that Kikang thinks that the CA might grant the “status quo ante” soon that, it would cut short his mayoral stint.

With the thought of Moreno’s coming back, Kikang could neither renew the job order contracts of Moreno’s men nor hire his (Kikang) followers.

But, if Kikang wants to assert his authority as the new designated Mayor, he should not renew the job order contracts of Moreno.

Kikang must replace all the job order contracts with his own people. That is the only way Kikang could take hold of the City Hall even for a day or two.

Such action would give credence to Kikang’s authority and would send a strong message that, if given a chance, he has the political will to rule the city government.

Kikang should remember that the exercise of power and the symbol of authority is measured by centimeters – not by feet or meters.

It means that a single stroke of the pen by those who wields power is enough to change the present condition and ultimately influence the future.

LAC stands for Learning Action Cell. This is a group of teachers who engage in collaborative learning sessions to solve shared challenges encountered in the school facilitated by the school head or a desig-

nated LAC Leader. LAC will become the school-based communities of practice that are positive, caring, and safe spaces. This has been stipulated from D.O. 35, s. 2016 with its implementing guideline as a K to 12 Basic Education Program School-Based Continuing Professional Development Strategy for the Improvement of Teaching and Learning.

Sara Duterte willing to appear before Senate *

DAVAO CITY – Mayor Sara Duterte-Carpio will appear before a Senate investigation into the alleged violation of Anti-Money Laundering Act (AMLA) only when there is a subpoena with contempt.

“I respect the authority of the Senate as part of a legislative branch, so if there is subpoena I will go and attend. But if it is an invitation I will not attend,” the city mayor told reporters in a press interview Monday at the sidelines of the Davao City-Kaui’I, Hawaii Sister City Agreement signing at the Marco Polo Hotel here.

“But then he was tweeting saying the President refuses to issue a waiver so that AMLC (documents) will be issued. So how come he has in his possession the purported AMLC documents? It only shows he is not making sense,” DuterteCarpio said.

The mayor was concerned that Trillanes is not helping the country, and taking down the President will not help the country.

Davao, Hawaii sisterhood to boost agri, tourism DAVAO CITY -- Davao City and the county of Kaua’i, Hawaii on Monday formally inked a sisterhood agreement that is seen to boost agricultural trade, tourism and cultural exchange between two cities.

Kaua’i Mayor Bernard Carvalho Jr. said his government is initially looking at coffee and cacao agricultural industries to kick-off the sister-city relations.

He said Davao’s cacao will open opportunities for chocolate products in his city.

In tourism, Carvalho said Davao City and Kaui’I

have so many opportunities where families from Kaua’i can explore when they visit Davao City.

“But at the top, we are moving to the direction of agriculture,” Carvalho said during the press conference on the sidelines of the signing ceremony held at the Marco Polo Hotel.

The sister-city agreement was formally sealed a year after the visit of Kaua’i delegation last year to explore trade opportunities in the city.

Kaua’i is Hawaii’s fourth largest island and called the “Garden Island”.

According to Kaua’i’s tourism website, the county is draped in emerald valleys, sharp mountain spires and jagged cliffs aged by time and the elements. It is home to a variety of outdoor activities like kayaking in the Wailua River, snorkelling on Poipu Beach, hiking the trails of Kokee State Park, or go ziplining above Kauai’s lush valleys.

Carvalho said that being the first county in the US to be sister-city of Davao is a big impact on the Philippines and United States of America relations.

“We are not too big. We

are not so small,” he said.

Carvalho stressed that being small township government is more connected to the people.

Vinta’ intensifies into severe tropical storm, threatens the Eastern Kibawe

It is expected to move west at 25 kilometers per hour.

My Philosophy towards My Vocation as a Teacher

“A Leader is one who knows the way, goes the way and shows the way” according to John Maxwell.

A good teacher is a good facilitator of learning. Knowing that our students actively construct and transform their own knowledge based on past experiences and prior learning, they learn differently with one another. It is my responsibility as a teacher to be an effective discoverer of students’ interests, abilities, and prior knowledge. I must plan learning experiences that will both challenge and allow every student to think outside the box until learning takes place.

I believe in the theory of multiple intelligences, our diverse pupils inside our class if properly manage and given differentiated instruction maximum learning takes place.

Smooth deliveries of the class with active participations from the pupils are likely the manifestation of success in teaching.

I believe a good teacher is a good motivator of success. I want all my students to achieve high in their studies and not

underestimating their capacity.

Students learn in a unique way and simple achievements they’ve got will truly means a lot to them. Giving positive feedback and praise will inspire them to do better next time. And letting them join in academic contest will boost their morale and become a competitive student someday.

A good teacher must be well prepared in class. Every day is a new learning experience from your pupils. Coming to school prepared provides you a clear vision on what to do in your class. You can set your students to modes of critical thinking, encouraging them to analyze, apply, synthesize, and evaluate all they read and hear. In the end you will find out how lucky your pupils are to have a committed teacher like you.

A good teacher cannot begin or continue to inspire learning without being a learner. The good teacher must constantly learn what is new in the discipline.

In fact, the good teacher often helps to create new knowledge and continuously examine his/ her teaching methods and find

new ones. This is the true essence of effective teaching.

I believe a teacher is a good role model. I have to “walk my talk” with my students. If I want my pupils to respect me, I have to instill in their minds the good values at an earlier age and show to them the importance of it. As what the bible says, Train up a child in the way he should grow and when he is old he will not depart from it.

Finally, my teaching philosophy evolves on being a good facilitator and role model. I believe many of us have come to accept a working definition that teaching means giving information, which I believe is only the beginning of teaching and certainly only a small part of learning. I am beginning to understand that the teacher’s greatest gift to the learner is helping the learner to be motivated to think and apply them in real life situations. A committed, dedicated and flexible teacher is what our Government’s need to achieve the Departments vision and mission. These are my doctrines in choosing this vocation called Teaching.

MANILA -- Philippines’ inflation rate hit 4 percent in January 2018, the upper end of the government’s 2017-19 target and the highest after the 4.3 percent in October 2014.

This uptick, however, was expected, Bangko Sentral ng Pilipinas (BSP) Governor Nestor Espenilla said, referring to the central bank’s 3.5 percent to 4 percent target for the month.

Last month’s inflation rate is a big jump from the December 2017’s 3.3 percent and the 2.7 percent in January 2017.

Excluding volatile food and oil, core inflation jumped to 3.9 percent from the previous month’s 3 percent.

BIR mulls amnesty of taxpayers with pending cases

MANILA -- The Bureau of Internal Revenue (BIR) is considering including in its planned tax amnesty program those with pending tax evasion cases.

During the hearing of the House of Representatives’ Ways and Means Committee Monday, BIR Assistant Commissioner Alfredo Misajon told lawmakers that the BIR was considering to allow individuals with pending tax evasion cases to avail of the condonation but they needed to explain why they erred in their duty to pay taxes.

Misajon said the mere filing of the case was not enough to bar any taxpayer from availing of the condonation unless the court had already decided on the charges.

In an interview after the hearing, Misajon said he had no idea how many individuals had pending tax evasion cases, citing that this information belonged to another department that was not under his jurisdiction.

He, however, said that once these individuals cmyk

availed of the planned tax amnesty, it was being considered to give them higher penalty than those who had not been found to have questionable tax payments.

“Maybe it’s better that they are given special rates, higher rates, to distinguish them from the ordinary availers,” he said.

Misajon, however, declined to give any figures or possible rates.

“Well, it’s really up to our congressmen. We at the BIR only implement it,” he said.

He said the amount they hope to collect from the planned amnesty program was substantial but he declined to give any figure, pointing out that “these are all preliminary figures that need to be proven in court.”

He said the number of possible tax evaders would not reach a thousand. “We act on certain information that comes to our office, either walk-in information or those gathered through an exchange of information among government offices,” he explained.

OFW Watch app launched in Davao

DAVAO CITY – Overseas Filipino workers (OFWs) now have a platform to empower and protect them, after the unveiling of a mobile social networking technology called OFW Watch Mobile App. In partnership with the Department of Labor and Employment (DOLE) and the Overseas Workers Welfare Administration (OWWA), the new app features the “Find Others function” and the “Volunteer Switch”.

T he “F i n d O t he rs” feature uses geo-location data to connect the user with other OFWs, expats and community groups nearby. Profiles of nearby users including links to their social networks such as Facebook are used to facilitate a connection if both parties mutually agree.

There is tight integration of the feature with Google Places’ “Check In” function that helps identify popular and safe locations nearby.

The “Volunteer Switch” function when flipped makes the user part of a global network of Overseas Filipino Volunteers.

As a volunteer in the network, the OFWs may receive alerts if a kababayan nearby is in trouble or may be alerted for assistance in sharing critical information with other nearby Filipinos and via their public social network pages.

Myrna Padilla, a former OFW and currently president and founder of OFW Watch, said the mobile app was launched in Hong Kong last year as a pilot project to see what needs to be enhanced based on the users’ feedback.

“We are eyeing to reach countries where our OFWs are. This is already accessible on both android and IOS,” said Padilla, who worked abroad for over 20 years.

For safety and protection the app also contains an “Emergency SOS” button to report concerns of abuse or maltreatment as well as the ability to ask questions on any subject related to OFWs’ stay overseas.

But Lacson clarified this does not exempt PCSO from its duty to go after illegal gambling operators.

“PCSO, not the Philippine National Police (PNP), is still ‘ultimately responsible’ for stopping a gaming firm from engaging in ‘illegal gambling in the guise of operating a lawful STL’ since it gave those gaming firms authority to operate,” he said.

Balutan explained the agency has maintained close coordination with the PNP. “Immediately after the last congressional meet, hearing last December, we summoned the PNP and asked them to investigate such violations. Because as far as we are concerned, kami po ay walang (we do not have) police power,” Balutan said.

In a separate hearing of the same committee at the House of the Representatives, Quezon Rep. Danilo Suarez also shared the same sentiment on how to eradicate illegal gambling.

Suarez lamented that it is high time the government should come up with a clear statement and commitment from the DILG (Department of Interior and Local Government).

“Even with the clear intention, PCSO cannot stop proliferation if there’s no police assistance. Wala ho talaga,” Suarez said.

The last time the government implemented tax amnesty is in 2008 and it collected about PHP13 billion from that program, which is being considered by the current administration to fund its infrastructure projects.

The Duterte administration has set an infrastructure program amounting to at least PHP8 trillion until 2022.

It eyes to increase infrastructure spending to about seven percent of GDP from the current five percent in a bid to ensure that necessary infrastructure facilities are constructed.

The planned tax amnesty is under the proposed Package 1-b of the DOFproposed tax reform program.

House of Representatives Ways and Means Committee Chair Dakila Carlo Cua, of the Lone District of Quirino, told reporters after the hearing that he was hopeful that the tax amnesty measure would be approved under the proposed Package 1-b.

He eyes the completion of the committee report on the measure to be approved “early March possibly.”

Under his proposed measure, amnesty rate will be based on eight percent of the taxpayers’ network but stressed that this will still depend on the lawmakers.

He added the lawmakers were considering the proposal of the BIR and the National Tax Research Center (NTRC), which had suggested that the rate should be based on taxpayers’ total assets.

“I can’t see how it can be a better system than the networth as of today. We need to study it,” he said.

The lawmaker said careful study of the measure was needed because “it’s a risk and reward issue that we have to decide.” (PNA)

The DILG central office said that it received the Ombudsman’s endorsement dated Dec. 20, 2018 signed by assistant Ombudsman Edna Dino only on January 5, 2018 ordering the DILG to implement the order within 30 days.

Records showed that the DILG regional office received the DILG memorandum from Manila at 4:30 p.m. on Feb, 2, 2018.

The DILG officials led by Area Regional Director Abdullah Matalam served the dismissal order of the Office of the Ombudsman involving the graft case against Moreno and the city officials when they were still serving in Misamis Oriental.

The case stemmed from the alleged “illegal” lease of equipment while Moreno was still the provincial governor in Misamis Oriental. The amount involves P 20.5 million.

Moreno argued that he has already obtained a consolidated Temporary Restraining Order (TRO) against the projected dismissal order against him involving the case.

The Mindanao Daily News (MDN) learned that Moreno’s camp has, last week, filed a “status quo ante” with the Court of Appeals (CA) to prevent the new dismissal order to be served.

The information only confirmed that Moreno and his camp already knew before the Ombudsman’s latest dismissal order was issued.

According to MDN sources, the DILG’s regional office got the copies of the memorandum of the DILG’s central office ordering the dismissal of Moreno about 4:30 Friday afternoon last week.

Moreno’s lawyer Dale Mordeno received the dismissal order Monday because Moreno was not around when the order was served.

PNP receives no bribes from STL - Balutan

Philippine C harity Sweepstakes Office (PCSO) General Manager Alexander Balutan on Monday defended the Philippine National Police (PNP) regarding the organization’s monthly revenue shares from the Small Town Lottery (STL).

Balutan said the PCSO and PNP have a Memorandum of Agreement (MOA) giving the latter the lead role in eradicating illegal gambling such as jueteng in connection with Executive Order No. 13, or the all-out war against illegal gambling, issued in 2017 by President Rodrigo Roa Duterte.

Earlier, gambling operator Charlie “Atong” Ang alleged that the PNP receives bribes from STL operators.

This did not sit well with PNP Chief Ronald “Bato” dela Rosa.

The STL made history by generating P15.7-billion revenue in 2017 (P1.3 billion/month) from mere P4.7 billion in just one year during Balutan’s watch.

Out of the P1.12 billion STL shares, PCSO gave P314.9 million to the Philippine National Police, P78.7 million to the Criminal Investigation and Detection Group (CIDG), P472.4 million to the cities/municipalities, P103.7 million to Congressional District, and P150.3 million to the provinces.

Meanwhile, Balutan clarified that while the President tasked PCSO to eradicate illegal gambling the agency is powerless in terms of conducting operations against illegal gambling operations.
