AGAYAN de Oro — The Mindanao Daily Express (Mindex) Transport Cooperative, the newest player in the local transport industry, and MDN Digital Channel was officially launched yesterday with Undersecretary Orlan Ravanera, chairman of the Coopeative Development Authority (CDA) as special guest.

MISAMIS ORIENTAL: Provincial Governor Yevgeny Vincente Emano released P 324,000 for the quarantine task force personnel assigned in Lugait, the last town west of Misamis Oriental.

Lugait is the town on the border of Iligan City, the capital town of Lanao Del Norte, 88 kilometers West of Cagayan De Oro City in Misamis Oriental.

Emano said that the fund represents the meal

allowances of the quarantine station personnel who are manning the station 24/7 tasked to deter security threats in Misamis Oriental’s western district.

“The allowance is also intended to encourage the quarantine personnel to be on alert about the movement of hogs and farm animals entering the province of Misamis Oriental,” Emano said.

Shootout in Libertad

LIBERTAD, MISAMIS ORIENTAL ----- Police authorities is now identifying the group of armed men involved in a shootout with the police of Libertad municipal police station that resulted to the death of a police officer and one of the suspects.

The suspect who died in the shootout was identified through his identification card as resident of Barangay Bañadero, in Ozamiz, Captain Rham Camelotes, chief of Libertad police, said they have yet to verify what group the suspects belong to.

The dead suspect identified as Jephone Fabriga Tinamisan, 33, resident of Purok 5, Bañadero, Ozamiz City.

The shootout resulted to the death of Staff Sergeant Ronald Caapuyan, one of

the policemen who managed the checkpoint.

Camelotes said they were holding a regular checkpoint and was alerted of a road crash when a white Mitsubishi Mirage with plate number BO J805 arrived coming from the direction in Cagayan de Oro. It was flagged down and the driver, later on identified as Jephone Fabriga Tinamisan, disembarked.

"He was supposed to be questioned by Caayupan when four suspects alighted and fired at the police. The troops retaliated that resulted to gunfight," Camelotes said.

ARAWI CITY, Lanao del Sur -- The provincial government of Lanao del Sur linked up with village officials in the province to intensify the information and education campaign on the 2019 novel coronavirus disease (COVID-19).

The Provincial Information Office in coordination with the Integrated Provincial Health Office (IPHO) gathered officials of the 1, 159 barangays in the

province Thursday, February 13, for an Orientation on COVID-19.

Dr. Alinader Minalang, IPHO chief, said the orientation aims to share with village officials what they need to know about coronavirus to stay safe.

He noted the importance of educating village officials so that they can also help in the dissemination of proper and complete information about the infection.

During the orientation, Dr. Apasra Mapupuno of IPHO pro-

vided an overview of COVID-19 including its symptoms and transmission. She emphasized that the infection has no vaccine or specific treatment yet.

The Amai Pakpak Medical Center (APMC) preparedness initiative and the BARMM-MILG Memorandum Order No. 03 which calls for the adoption of necessary and preventive measures for the entry and spread of the coronavirus in the Bangsamoro areas.

Zorab Mangotara, Provincial Board Member and Committee on Health Chairperson, said the orientation is part of the information drive of the newly-created Provincial Interagency Task Force on COVID-19 to prevent the entry and spread of the dreaded infection in the province.

City of Taguig shows love for environment via ‘zero waste plan’

OVE makes the world go round.

But as climate change and related issues continue to break the heart of the planet, people, governments and institutions make small but meaningful moves to fix and heal it.

On Valentine’s Day, the city government of Taguig strengthened its resolve to nurturing the environment through its commitment to reduce its solid waste by 80 percent within the next three years which would help its goal of becoming a zero-waste locality.

This, as it unveiled its Zero Waste Plan, an integrated program that introduces measures to reduce solid waste and improve waste management, leading up to an 80-percent solid waste diversion, or reduction in waste going to landfills and dumpsites, by 2023.

“The zero-waste city is the pinnacle of our green governance agenda, so we will pull all the stops to make this target a reality,” Mayor Lino Cayetano told reporters after the program’s launch at the Lakeshore Tent in Barangay Lower Bicutan.

The move aims to contribute to overall health and wellbeing in Taguig, address water and soil contamination, and reduce air pollution.

It will also create employment opportunities and curb flooding in many areas which will yield higher productivity and greater economic development.

The unveiling coincided with the first quarterly meeting of the Taguig City Solid Waste Management Board for this year, where some 150 barangay and city leaders discussed the TenYear Solid Waste Management Plan that was rolled out in 2014 and the state of all the city’s materials recovery facilities (MRFs), which will play a key role in the zero waste roadmap.

The Zero Waste Plan scales up successful efforts in Barangay Fort Bonifa-

cio, which now stands as a model community.

To further strengthen this program, the city government also announced to establish a Sustainable Livelihood Office that will help look for sustainable alternatives, in the event attended by city environment committee heads, barangay and Sangguniang Kabataan (SK) chairs and cluster heads.

All succeeding infrastructure projects of the city will also have an MRF. The waste collected and brought at MRFs goes toward composting for plants, repurposing for community gardens, and landfills.

A technical working group that will sur vey all 28 barangays for the appropriate land for the facilities will be formed for this purpose.

Taguig will also join global efforts to phase out single-use plastics.

Citizens are encouraged to use canvas bags or ecobags as an alternative to plastic bags when shopping for sundries such as meat, fruits, and vegetables.

full support to the Zero Waste Plan. We will make sure all the barangays implement e ver yt hing in it. We will also onboard experts and build all the required hardware to make our beloved city truly green,” he added.

Meanwhile, funds collected from the city’s recycling efforts will be used

to build classrooms, lowcost housing, and other infrastructure projects and provide financial assistance to teachers and police officers in the city.

He said the city is determined to see that every barangay will have diverted solid waste from landfills and dumpsites by 80 percent in the next three years.

God’s book, the Holiest: “Igpanuyadug ta Kinaiyahan” He would die three days later but the last words spoken to me by Higaonon Chieftain of Cagayan de Oro before he was murdered by the armed men of illegal miners and loggers on a Sunday on September 13, 2014 in Sitio Kabalang, Barangay Tuburan, Cagayan de Oro City were still in the inner recesses of my thoughts.

Together with Datu Sandigan then, we implemented the Writ of Kalikasan to stop illegal logging and illegal mining. For being so active, he was murdered by assasins who until now ae scot-free. For the Indigenous People, he said, “ang pinakasagrado nga libro dili mao ang gisulat sa mga Evangelists or well-known prophets pero ang libro nga gisulat ni Magbabaya nga nabuhat sulod sa bilyones nga katuigan, ang kaanindot sa kinaiyahan.” Indeed, the holiest of books is not one written by evangelists or well-known prophets but one authored by God Himself, evolving through billions of years, shown in the beauty of the universe.

Neither is it written in words nor in any language and is open 24 hours a day, has no literacy requirement and can be well understood using not one but five senses.

That book is said to be a manifestation of the Unseen using the great void as its pages and the four

elements of the universe as its alphabets, namely, fire, water, earth and wind. It is called the book of nature written through the ages that contains all the mysteries of life and the laws that must be obeyed irrespective of race, color, belief, gender and class.

I recalled those words last Saturday when together with the “Lumad” leaders, we visited Mindamora Falls in Bayug, Lantud, Talakag, Bukidnon. The original name of the Falls is not Mindamora but called by the IPs as Abaga ta Bayug, a holy ground of the IPs. It is a well-known sacred place of the IPs all over Mindanao, going there once in a while to do rituals to worship Magbabaya, the Unseen Creator but is manifested through the amazing convergence of the beauty of nature.

There is no other place on earth than seeing the continuous flowing of water in the two-storey falls against the backdrop of radiating green scenery of blooming trees. Above are flocks of birds hovering, as if dancing to the natural music of the wind in consonance with the falling waters.

Thus, to keep nature at its best and glorious splendour, the residents of Bayug, led

by Sultan Abdul S. Amoran, organized the Igpanuyadug sa Abaga Ta Bayug Agriculture Cooperative. They have

to organize themselves into a cooperative, as assisted by Mr. Cris Lu Salem, CDS II of the CDA – 10, for their sustenance but best of all, for them to keep their faith and to zealously keep watch and guard over Mother Nature’s gift, the Abaga ta Bayug, which has been their praying ground for over generations and over the years. The TESDA representative Ms. Wilma T. Bathan, has joined the CDA Team also to provide assistance. A multipurpose hall will be built in the area, which will be used for trainings to be conducted

by TESDA for the residents.

With her own advocacy also, Ms. Lydia Tubella, DCM, a doctorate degree holder and a cooperative leader, also has provided assistance for the group. With then was no less than the Chief of Registration Section of CDA-10, Ms. Gloria Barrido, to lead in the registration process.

Our Indigenous Peoples are correct: the Unseen Being is seen in his creation and oneness with God’s creation is the number law of nature as we are all inter-connected. Let us all therefore feel that oneness but such can only happen if man must pass the dark leeways and passages of the mind and come to the core of his being where he finds the intelligence, the principle,

where knowingness, light and love are present.

As discovered by the IPs, there is indeed a cleansing power of water. It has been said that sometimes the passions of the heart emit so much heat which only dies down through the cooling effect of water through the waterfalls. Yes, from the lowly earth grows the mighty tree and the beautiful flower. It may contain all that rot but even the wise, the powerful and the beautiful have to return to the earth as their final destiny.

Let us all learn from the IPs. They said that the 250 million stars in the cosmos can well speak of that element called fire that touches us through the glorious sun. Everytime the sun proclaims a new day, that bursting of the light in the horizon shows that darkness can only be had in the absence of light and no way can darkness defeat the light. In the same breath that truth always prevails over lies, rightiousness over diabolic acts, love over hate, the just over the unjust and life over death.

Go and see the beauty of the Falls and reflect on all of these lessons from nature. That is what our See HOLIEST, page 19

The power of prayer and fasting

THERE is an interesting episode in the gospel where Christ mentioned the great power of prayer and fasting.

It is recorded both in the gospels of St. Matthew (17, 14-21) and St. Mark (9, 1721). It is about a man who begged Christ to cast out a demon possessing his son.

He had previously asked Christ’s disciples to do it but they failed.

When Christ finally drove the demon out of the boy, the disciples asked Christ, “Why could we not cast him out?” And so Christ said, “Because of your unbelief. For verily I say unto you, if you have faith as a grain of mustard seed, you shall say unto this mountain, ‘Remove hence to yonder place, and it shall remove.

And nothing shall be impossible unto you. This kind can only come out by prayer and fasting.’”

Here we are given a clear indication of how our faith can be made strong and powerful. It is through prayer and fasting. It is something that we have to learn to do

as well, especially when we are faced with a big problem or a strong temptation.

Prayer is our duty to maintain our relationship with God and to share in whatever he has. Fasting is like a prayer of our body that also needs to be in vital relation with God. It purifies the body of the effects of our sins and strengthens it to enter into a loving relation with God. Both comply with what Christ said about what we need to do to follow him, that is, we need to deny ourselves and carry the cross. (cfr. Mt 16, 24) We have to make sure that our prayer is real prayer, that is, a real conversation with God. We have to see to it that we are truly making contact with him, which actually should be no problem since God is always around and treats us with love.

We have to be wary of our tendency to just go through the motions of praying.

We can now easily affect the appearance of praying without actually praying.

This is a problem that we have to acknowledge and proceed to find solutions.

We have to check on our attitudes and dispositions.

Are we really exercising our faith? Is our piety fervent?

Or are we, on the contrary, bogged down by laziness, complacency, doubts, and all the forms of pretension and hypocrisy? Prayer will always require effort and sacrifice and demands consistency and unity of life.

This is where some fasting is involved. That’s because our body needs to be disciplined, because with our earthly condition that is wounded by sin, it usually finds its pleasure in earthly things rather than in God. And fasting is one such effective form of self-denial and carrying the cross of Christ.

With fasting we align our body according to the dynamics of God’s love that will always be motivated by the salvation of mankind and will involve sacrifice.

We don’t fast simply because of some health reasons, be

it physical health or mental or emotional. Our fasting should be motivated by love.

And fasting nowadays may involve more than food.

It can involve the use of our modern gadgets and technologies that if resorted indiscriminately can truly spoil and enslave us.

We really need to practice restraint and moderation in the use of these new things so that we would not compromise our spiritual and supernatural bearing. We need to purify our intentions and set clear limits when using them. In fact, we have to come out with a concrete plan to translate this ideal into reality.

We would see that if we truly pray and fast, as Christ indicated, nothing would be impossible to us. We would be truly united to his will and ways. And demons would have no chances of success with us.

Cotabato City seeks exclusion from BARMM until June 30, 2022 D

AVAO CITY – A year after it voted ‘yes’ to inclusion in the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM), Cotabato City now wants exclusion from the BARMM until the end of the transition period on June 30, 2022.

Cotabato City Mayor Cynthia Guiani-Sayadi in a February 7 position paper addressed to President Rodrigo Duterte, a copy of which she sent MindaNews, asked the President to “hold in abeyance the turnover of Cotabato City to BARMM.” At the end of her eightpage position paper, Sayadi, who campaigned for a ‘No’ vote in the January 21, 2019 plebsicite to ratify the Bangsamoro law, said they are “ardently appealing for a Status Quo until such time that the three-year transition period has been completed and the BARMM bureaucracy would have been fully operational.”

The transition period of the BARMM, which is presently governed by the Bangsamoro Transition Authority (BTA), ends on June 30, 2022 when the first elected BARMM officials shall have taken their oath of office.

But lawyer Naguib Sinarimbo, BARMM Minister for Local Government and concurrent BARMM spokesperson, said the inclusion of Cotabato City in the BARMM “is settled already by the Constitution and the Bangsamoro law and that is upon ratification in a plebiscite.”

“The people of Cotabato City have spoken and no one can stop that,” he told MindaNews.

Sayadi, a lawyer, told MindaNews over the weekend that they were “given extension until December 2020” to maintain the status quo.

Mohagher Iqbal, BARMM Minister for Education and concurrent co-chair of the Inter-Governmental Relations Body (he for the BARMM, Finance Secretary Carlos Dominguez for the national government) told MindaNews on Monday they are not aware that a decision

has been made on the appeal of Cotabato City. “We have yet to receive a copy of the decision,” he said, adding that President assured he would give a “fair decision” as the BARMM maintained that the vote of the people in the plebiscite must be respected.

President Duterte met with Sayadi and Iqbal and other BARMM officials and Cabinet Secretaries on February 4 and February 12. Duterte, according to MindaNews sources present during the meeting, asked for a legal basis for the city’s appeal.

Cotabato City voted for inclusion in the BARMM on January 21, 2019, with 36,682 in favor and 24,990 against. The mayor said then that they would file a protest, claiming threats and intimidation prevented voters who opposed inclusion in the BARMM from

casting their votes. A voter filed an electoral protest.

Constitution, Bangsamoro Law, Jurisprudence Sinarimbo explained that since the ratification, Cotabato City has been part of the BARMM but “we could not supervise and regulate because the DILG (Department of Interior and Local Government) field office in Cotabato City has not been transferred to the BARMM, contrary to the mandate of the Bangsamoro Organic Law which is within three months” form the organization of the BTA. “It is now more than three months and we must comply with the provision of the law,” the BARRM said, citing Article 16, Section 11 of the Bangsamoro law. in its seven-page position paper submitted to President Duterte, dated Februrary10.

The BARMM took over from the ARMM on February 26, 2019 but it was formally inaugurated on March 29, 2019, graced by President Duterte. Three months from March 29 would have been June 29, 2019.

Thus far, only the Department of Transportation and Communication and, partly the Department of Public Works and Highways, have complied with the provision of the law.

a constitutional mandate that must be obeyed and the territorial jurisdiction of the BARMM, including Cotabato City, “took effect upon ratification of Republic Act No. 11054.”

EVERY one of us I guess heard this a lot of time, I hate math. Why do we have to do this? Math is boring. Math is hard.

Some may hate it because solving solutions are not their area or field but some may love it. Here is some reasons why some love math.

Math builds problemsolving skills. Math uses critical thinking. Learning to look at a problem— whether a math problem or a life problem—and come up with a plan is an important skill to practice. Math encourages curiosity but math really starts with wondering or asking a question. Helping students to start by wondering builds interest and motivation.

Math is play for your brain. Your body needs exercise and your brain do, too. Think of math as running around at recess for your brain. Finding the answer to solutions is satisfying.

Math problems aren’t easy to solve but finding the answer can be very satisfying. Remind students that some problems are easier than others and part of the fun is figuring it out.

Math is a journey. Math is about wondering and asking questions.

Some people enjoy the mental exercise of working through problem after problem. Others want calculators or computers to do the work for them.

Either way, it starts with a question or a wondering.

Math is useful in everyday life. “When will I ever use this?” is a question that comes up often in math class.

Math is fun. Math is fun! It helps students to see that through your attitude and approach.

However, they do not know that taking the challenge to love math brings you to a higher level of learning. It has offered a lot of benefits.

PH ranks no. 22 in emerging markets logistics index MANILA -- The Philippines still has some ways to go as it is currently no.22 in the Agility Emerging Markets Logistics Index 2020’s overall ranking, slightly above the halfway mark among the 50 most promising emerging logistics markets, down two points from a year ago.

The Top 10 emerging logistics markets are China, India, UAE, Indonesia, Malaysia, Saudi Arabia, Qatar, Mexico, Thailand, and Turkey, in that order, according to the index prepared by logistics market research service Transport Intelligence and logistics company Agility.

“The strongest clusters of emerging markets are in the Arabian Gulf and Southeast Asia, thanks to business-friendly conditions and core strengths,” the recent report said.

Despite its trade and economic problems, China continues to lead the overall index, edging away from the other markets as improvements in core strengths across domestic and international logistics

opportunities offset some declines in business fundamentals, the report said.

Notably, Vietnam is in 11th place, dropping from 10th as Thailand enters the Top 10 for the first time.

COVID-19 is a new virus linked to the same family of viruses as SARS and some types of common cold. 2 killed, 3 wounded, one captured in Misor shootout

CAGAYAN DE ORO CITY: Two were killed, including a police officer, one captured while three others were wounded in a shootout in Libertad, Misamis Oriental, 76 kilometers west of here, Monday evening.

Killed was P/Sgt. Ronald “Boboy” Caayupan, 41, Libertad, Misamis Oriental and one of the suspects identified as a certain Geopane Fabrigas Tinamisan.

Caayupan sustained a fatal gunshot wound on his neck while Tinamisan was killed when the police manning the checkpoint in Libertad returned fire.

Police also recovered five-sachet containing white substance believed to be “Shabu” (Methamphetamine Hydrochloride) in the body of Tinamisan.

Wounded were P/Sgt. Fernando Maestrado, Gemma Patlunag, a civilian caught in

the crossfire and one of the suspects identified as Richard Sonceres, 31, of Bangkal, Mahayahay, Lapu-Lapu City, recently residing in Barra, Opol, Misamis Oriental.

The wounded police officer and the civilian were in stable condition while Sonceres was admitted to a hospital for treatment and tactical investigation.

Pursuing law enforcers captured Sonceres under a bridge, a few meters from the police checkpoint. Sonceres, who tried to escape, broke leg when he jumped down the bridge with a dried-up creek.

Three other suspects, one is reportedly wounded, escaped.

“They are now an object of police manhunt,” P/Capt. Ram Camelotes, commander of the Libertad municipal police station, said.

He said that the police are now in hot pursuit of the three remaining three suspects who could still be in the vicinity of

Imparted with student performance in the learning field, extra-curricular activities aim to develop student skills and talents not only in academic endeavors but outside the typical classroom environment. It helps students to seek opportunities in achieving careers in different contexts. We have general sports clubs and societies, the arts and performing clubs, both indoor and outdoor activities that have several variations.

We also have volunteering activities and part-time jobs for extra income. Extracurricular activities are widely available in most schools and touch almost a lot of fields that’s why students will have no problem with discerning what they would be wanting to partake in. Moreover, it is also where their passion discovery will take a toll.

So why are extracurricular activities essential in involving students? First, its purpose is to help the student earn career experience. These activities assist students in equipping the necessary skills they need to graduate such as leadership and communication skills and versatile environment flexibility.

Even after graduation, these skills will stay and will continue to be used for improvisation and living everyday life. Another thing is that it adds up to

Xavier Ateneo Social Dev’t Week focuses on building ‘metropolized’ CDO Report by ZAIRADEHING

AVIER University Ateneo de Cagayan Social Development (SD) Cluster celebrated this year’s SD Week 2020 from January 20 to 24, with the theme “Urban Development: Social and Environmental Challenges and Opportunities.”

The week-long celebration kicked off with the Tabuan and Food Festival at the Science Center grounds.

The tabuan trading showcased the fresh fruits and vegetables by the farmers from Barangay Langaon, Bukidnon and the Manresa Farm.

In the evening, an Opening Mass was held at the university church, presided

by Fr Roberto C. Yap SJ and Fr Mars Tan SJ. It was attended by the SD Cluster family: vice-president,

admin, directors, program officers, SD volunteers, staff, SD coordinators, and students.

On the second day, the Forum on Metropolization: Social and Environmental Challenges and Opportunities was held at the XU Little Theater (XULT). The local government unit, organizations, and students were invited to the forum.

Dr. Divina Luz Lopez, professional lecturer from the Political Science Department of De La Salle University, highlighted the onset of Cagayan de Oro City’s transformation from a common city into a metropolized city in her keynote speech.

“Metropolization is important because we need to network resources, human technology and economic

resources for economic growth,” Fr. Yap noted.

The emerging development of the city entails more roads, buildings, infrastructures, and influx of people coming in and out.

City Mayor Oscar S. Moreno told the audience that working together is one of the requirements to achieve a metropolized city.

“Metropolization must come from the heart and the willingness and the determination to work together, the ‘bayanihan’ is the keyword for metropolization,” Moreno said.

Teaching isn’t the same as it was back then. In the old days, researching meant spending countless hours in the library, in the hopes of finding the right book to help you write a well-written paper. Back then, while preparing instructional materials, you had to prepare extra Manila papers and marker pens in case you might need them in the middle of the night while writing. Those times where the internet was a scarce resource, most of us relied on the traditional way of learning and teaching.

In this age, however, it seems that everything is already a swipe of the thumb away. Don’t know what the word means?

Just search for it. Not familiar enough with the topic? Then Google it! Tired of handwritten instructional materials? Then print it! Or better yet, just use PowerPoint presentations, you can even add several video clips or trending memes to make your students laugh. Consequently, being

a teacher in the 21st century is not as easy as one would think. The challenges and problem that comes with technology can be burdensome. Technical difficulties such as power outage, faulty PCs and corrupted files due to viruses are just some of them.

These difficulties result in class disruption and the time that we’ve spent preparing gets wasted by an unforeseeable factor.

But what does it take to be a 21stcentury educator? Is it solely because of the technology we have now? Of course not! Teaching in this era means rising to the challenge and adapting to the new environment, earning key skills essential to not only our growth as an educator but for the students who rely on us to guide them learn life-long skills. So despite experiencing setbacks, as educators, we make do with what we have at the moment and continue to teach because this is what we do: We improve. We adapt. We thrive.

ORDINANCE NO. 049-19 Series of 2019 AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 0292-06, SERIES OF 2006, “THE COMPREHENSIVE CHILDREN AND FAMILY SUPPORT SYSTEM IN DAVAO CITY, AS AMENDED”, OTHERWISE KNOWN AS “DAVAO CITY CHILDREN’S WELFARE CODE, AS AMENDED” Be it ordained by the Honorable Sangguniang Panlungsod of Davao City in session assembled, that: ARTICLE I Title, Policy, Principles, and Definition of Terms SECTION 1. TITLE- This Ordinance shall be known as “AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 0292-06, SERIES OF 2006, “THE COMPREHENSIVE CHILDREN AND FAMILY SUPPORT SYSTEM IN DAVAO CITY, AS AMENDED”, OTHERWISE KNOWN AS “DAVAO CITY CHILDREN’S WELFARE CODE, AS AMENDED”.

SECTION 2. DECLARATION OF POLICY AND PRINCIPLES OF THE LOCAL GOVERNMENT OF DAVAO CITY- It is hereby declared to be the policy of the Local Government of Davao City that the rights of children to their survival, protection, participation and development must be given high priority; it will work for the respect for the role of the family in providing for children and will support the efforts of parents, other child care and development workers, Non-Government Organizations (NGOs) and communities to nurture and care for children, from infancy including the earliest stages of childhood to adolescence.

It shall be the policy of the Local Government of Davao City to ensure that the programs aimed at the achievement of goals for the survival, protection, participation and development of children must be given priority when resources are allocated.

Every effort shall be made by the Local Government of Davao City to ensure that such programs are protected in times of economic austerity and structural adjustments.

f) CHILDREN – refer to persons below eighteen (18) years of age or those over but unable to fully take care of themselves to protect themselves from abuse, neglect, cruelty, exploitation or discrimination because of physical and mental disability condition.

g) CHILDREN IN CONFLICT WITH THE LAW – refer to persons below 18 years old who are alleged to have committed or who have been found to have committed offense(s) under Philippine laws.

h) CHILDREN IN NEED OF SPECIAL PROTECTION – refer to children living under circumstances which gravely threaten or endanger their survival and normal development as defined and expanded to include victims of STD-HIV-AIDS, physical and emotional neglect, and sex exploitation; Children in Conflict With the Law, dependent, abandoned, neglected, girl children, and children in various circumstances of disabilities. Also included are those children with disabilities, children involved in armedconflict, children at risk, and those teens who became pregnant.

c) CHILD LABOR – refers to any work or economic activity performed by a child that subjects him/her to any form of exploitation or is harmful to his/her health and safety or physical, mental or psychosocial development as provided by Republic Act No. 9231.

d) CHILD PROSTITUTION – is the sale, purchase, exchange, employment or hiring the services of children, or any attempt thereof, for the purpose of engaging in sexual intercourse or lascivious conduct for money, profit or other considerations by another.

e) CHILD TRAFFICKING – refers to the act of recruitment, transfer, or deployment of a child, and/or harboring or receipt of child with or without the victim’s consent or knowledge, fraud or deceit, violence, coercion, intimidation, abuse of position or authority, within or across national borders for purposes of prostitution, work, services, marriage or adoption and other similar arrangement characterized by forced labor, slavery-like practices of sexual exploitation.

CIRCUMSTANCES WHICH GRAVELY THREATEN OR ENDANGER THE SURVIVAL AND NORMAL DEVELOPMENT OF CHILDREN – these include, but are not limited to, the following: • Being in a community where there is armed conflict or being affected by armed conflict –related activities; • Working under conditions hazardous to life, safety and morals which unduly interfere with their normal development or working without provisions for their education; • Living in or fending for themselves in the streets of urban and rural areas without the care of parents or guardian or any adult supervision needed for their welfare; • Being a member of an indigenous cultural community and/ or living under conditions of extreme poverty or in an area which is underdeveloped and/or lack or has inadequate access to basic services needed for a good quality life; • Being with family members or guardians having psychological problems grave enough for them to commit incest, sibling rape, lascivious acts and other forms of physical and mental abuse; • Being a victim of human-made or natural disaster or calamity; • Being a victim of an illegal transnational union; or child trafficking; and • Circumstance analogous to those above stated which endanger the life, safety or normal development of children.

COMPREHENSIVE CHILDREN’S SUPPORT SYSTEM AGAINST CHILD ABUSE, EXPLOITATION AND DISCRIMINATION – refers to the coordinated program of services and facilities to protect children against: • Child prostitution and other sexual abuse; • Child trafficking; • Other acts of abuse; and • Circumstances which threaten or endanger the survival and normal development of children or as prescribed in the United Nations Convention on the Rights of the Child.

k) COMPREHENSIVE SUPPORT SYSTEM FOR THE DEVELOPMENT OF CHILDREN – refers to the coordinated program of services outlined in Sec. 3 of RA 6972 and as prescribed by the United Nations Convention on the Rights of the Child.

m) CHILD PORNOGRAPHY - refers to any representation, whether visual, audio, or written combination thereof, by electronic, mechanical, digital, optical, magnetic or any other means, of child engaged or involved in real or simulated explicit sexual activities.

n) CYBERSEX — the willful engagement, maintenance, control, or operation, directly or indirectly, of any lascivious exhibition of sexual organs or sexual activity, with the aid of a computer system, for favor or consideration.

o) DEVELOPMENT RIGHTS – pertain to the access of a child to educational opportunities, access to relevant information, play, leisure, cultural activities and the right to freedom of thought, conscience and religion.

p) ENTERTAINMENT ESTABLISHMENTS – are business establishments which include bars, nightclubs, beer houses, cocktail lounges, and massage clinics, karaoke bars/sing-along pub houses within Davao City.

q) KASAMBAHAY DESK OFFICER - Subject to the provisions of Republic Act No. 10361 or the Kasambahay Law and its implementing rules and regulations, a kasambahay desk officer is a person assigned to Kasambahay Desk in the barangay hall who is responsible for accomodating continuous registration of the employers of the kasambahay within the barangay.

r) LEARNERS -shall refer to children enrolled in a school.

x) PERSONS ENGAGED IN PROSTITUTION – shall include/encompass, but shall not be limited to, the pimp, procurer of the service or customer, parents, owners, managers or operators of establishments such as disco bars, sauna baths, massage clinics, movie houses, vehicles like cars, taxi cabs or any other forms of transportation, hotels and restaurants, and any other persons who employ various schemes to prostitute persons.

Article III Protection Rights of Children SECTION 1.

PROGRAM ON CHILD ABUSE, EXPLOITATION AND DISCRIMINATION. There shall be a comprehensive program to be formulated by the Local Council for the Protection of Children (LCPC), other governmental agencies, and the private sector concerned within one (1) year from the effectivity of this Ordinance, to protect children against all forms of child abuse and exploitation including child prostitution and other sexual abuse; child trafficking; obscene publications and indecent shows and other acts of abuse; and circumstances which endanger child survival and normal development.

y) PROTECTION RIGHTS – cover those which guard children against all forms of child abuse, exploitation and discrimination in the major areas where a child is considered in extremely difficult circumstances.

z) QUICK RESPONSE CENTER – refers to the inter-agency center operated by the City Social Services and Development Office (CSSDO) in coordination with the Special Office for Children’s Concerns which created the Kean Gabriel Hotline to provide a 24-hour quick response for children who are in need of special protection.

SECTION 2.

CHILD PROSTITUTION AND OTHER SEXUAL ABUSE. Children, whether male or female, who for money, profit or any other consideration or due to the coercion or influence of any adult, syndicate or groups, indulge in sexual intercourse or lascivious conduct, are deemed to be children exploited in prostitution and other sexual abuse. The following shall be liable under this Ordinance:

aa) SURVIVAL RIGHTS – deal with the provision in relation to parental and governmental duties and liabilities, adequate living standard and access to basic health, health services and social security.

a) Those who engage in or promote, facilitate or induce child prostitution which include, but are not limited to, the following:

• Acting as a procurer of a child for prostitution by means of written or oral advertisements or other similar means;

• Inducing a person to be a client of a prostituted child by means of written or oral advertisements or other similar means; • Entering into a relationship with, or taking advantage of a child for prostitution; • Threatening or using violence towards a child to engage him/her as a prostitute or participant in indecent shows; and • Giving monetary consideration, goods or other pecuniary benefit to a child with the intent to engage such child in prostitution.

bb) WORKING CHILD – as provided by Republic Act No. 9231, it refers to any child engaged as follows:

• When the child is below eighteen (18) years of age, in work or economic activity that is not child labor as defined in the immediately preceding sub-paragraph; and • When the child is below fifteen (15) years of age, (i) in work where he/she is directly under the responsibility of his/her parents or legal guardian and where only members of the child’s family are employed; or (ii) in public entertainment or information.

Article II. Governing Laws SECTION 1.

This Code hereby adopts all relevant and enforceable national laws, rules, and other regulations, and local ordinances governing children, such as but not limited to:

RA 8049- An Act Regulating Hazing and Other Form or Initiation Rites in Fraternities, Sororities, and Other Organizations and Providing Penalties Therefor;

9.

RA 8972 - the “Solo Parents’ Welfare Act of 2000”;

10. RA 8980 – The Early Childhood Care and Development Act of 2000 (ECCD Act);

11. RA 9165 – Comprehensive Dangerous Drugs Act;

12. RA 9208 – Anti- Trafficking in Persons Especially Women and Children;

13. RA 9231 – The Anti-Child Labor Law;

14. RA 9211 – Regulating the Use and Distribution of Tobacco Products;

15. RA 9344 – Juvenile Justice and Welfare Act of 2006;

16. RA 9775 - Anti-Child Pornography Act of 2009;

17. RA 10360 – An Act Strengthening the Juvenile Justice System in the Philippines, Amending for the Purpose Republic Act No. 9344;

18. RA 10410 – Early Years Act (EYA) of 2013;

19. RA 10533 - Enhanced Basic Education Act of 2013;

20. RA 10666 - Children’s Safety on Motorcycles Act of 2015;

21. RA 10821 - Children’s Emergency Relief and Protection Act;

22. RA 10627-An Act of Requiring all Elementary and Secondary Schools to Adopt Policies to Prevent and Address the Acts of Bullying in their Institutions

b.) Those other persons who commit acts as stated in Article III of Republic Act No. 7610 and shall be penalized accordingly as prescribed in the same without prejudice to the prosecution of the same acts under our existing national laws. The Barangay Officials, through the Barangay Council for the Protection of Children shall actively monitor the recruitment of children for purposes of child prostitution at the barangay level and they shall conduct educational and information campaign against child prostitution to facilitate effective monitoring of the same;

SECTION 3.

SANCTIONS FOR ESTABLISHMENTS OR ENTERPRISES WHICH PROMOTE, FACILITATE OR CONDUCT ACTIVITIES CONSTITUTING CHILD PROSTITUTION AND OTHER SEXUAL ABUSE, CHILD TRAFFICKING, OBSCENE PUBLICATIONS AND INDECENT SHOWS. All establishments or enterprises which promote, or facilitate child prostitution and sexual abuse, child trafficking, obscene publications and indecent shows and other acts of abuse shall be immediately closed, their authority or license to operate canceled, without prejudice to the owner or manager thereof being prosecuted under this Ordinance.

The Business Bureau shall designate personnel to act upon complaints to determine and/or validate reports of establishments or enterprises which promote, or facilitate child prostitution and sexual abuse, child trafficking, obscene publications and indecent shows and other acts of abuse.

A sign with words “OFF LIMITS” shall be conspicuously displayed outside the establishments or enterprises by the Davao City Special Office for Children’s Concerns (SOCC) for a period of not more than one year.

SECTION 4.

ESTABLISHMENTS TO POST NOTICES AND INFORMATION AT ENTRY OR FRONT DESKS REGARDING CHILD PROTECTION. All hotels, inns, motels, sauna baths and other establishments of similar services including movie houses shall be required to post reasonable notices and information about child protection.

Night clubs, massage parlors and other establishments intended wholly for adults shall be required to post restrictive notices and information such as “children below 18 years old are not allowed” to serve as deterrent to committing child trafficking, prostitution and other sexual abuse.

To ensure the compliance by the concerned establishments to this section of the Ordinance, the SOCC, through the Business Bureau of the Office of the City Mayor shall require these establishments to post such information or notices before their respective licenses shall be renewed and/or approved.

SECTION 5.

CHILD TRAFFICKING. Any person who shall engage in child trafficking as defined in this Ordinance, shall suffer the penalty as prescribed in Article IV of Republic Act No. 7610.

The arresting authorities are mandated by this Ordinance to file a case on child trafficking against the apprehended individual(s).

The participation of the Department of Labor and Employment (DOLE), Philippines Ports Authority (PPA), Land Transportation Office (LTO), MARINA and the Land Transportation Franchising and Regulatory Board (LTFRB) as well as the Anti-Trafficking Ordinance of the City is enjoined.

When a minor below 18 years old travels alone to or from Davao City by land, by air, or by sea, and using public and private transportation without valid reason therefore and without clearance issued by the Davao City Special Office for Children’s Concerns or written permit or justification from the parents or legal guardians; When a pregnant mother, father or guardian executes an affidavit of consent for adoption for a consideration; or consent, participates or in any manner cause the registration of the birth of such child in the name of another with or without consideration; When a person, agency, establishment or child-caring institution recruits a woman or couples to bear children for the purpose of child-trafficking; When a doctor, hospital or clinic official employee, nurse, midwife, local civil registrar or any other person simulates birth for the purpose of child trafficking; When a person engages in the act of finding children among low-income families, hospitals, clinics, nurseries, day-care centers or other child caring institutions who can be offered for the purpose of child trafficking; or When any person, authority, agency or institution who are witnesses to and fails to report transactions related to circumstances in child trafficking.

Penalties prescribed under this Ordinance shall be imposed upon the principles of the attempt to commit child trafficking without prejudice to the prosecution of the same acts under our existing national laws. In addition, a one-month community service shall be imposed for the commission and omission of acts under Section 3.

This provision shall amend Section 4 (B) of Ordinance No.0532-18, otherwise known as, “Expended Anti-Trafficking in Persons Act of 2012”.

SECTION 7.

PROHIBITION ON ESTABLISHMENTS SELLING OR ALLOWING TO BE SOLD TO CHILDREN CIGARETTES AND OTHER TOBACCO PRODUCTS, BEER, LIQUOR, OTHER INTOXICATING BEVERAGES AND CONTACT CEMENT (E.G. RUGBY) SOLVENT AND VOLATILE SUBSTANCES. All wholesale, retail, hardware, stores, grocery or convenience stores as well as all other business establishments in the city are prohibited from selling or serving beer, liquor, coconut wine and other intoxicating beverages, cigarettes and other tobacco products and contact cement solvent (rugby) to all children.

For purposes of this Ordinance, the penalty for the commission of such act as prescribed in Presidential Decree 1619 and in local ordinances shall be imposed. The filing of cases against establishments violating this provision must be closely enforced and monitored. The victim of the act committed under this section shall be entrusted to the care of appropriate agencies in coordination with the Davao City Special Office for Children’s Concern (SOCC).

Any person/s who shall cause the child to purchase or buy intoxicating beverages, cigarettes and other tobacco products, and contact cement solvent (rugby) shall be penalized under this Ordinance in the same manner as those who shall sell or induce a child to buy or purchase the aforementioned products.

SECTION 8.

CONTROL ON CHILDREN’S EXPOSURE TO COMMERCIAL VIDEO, INTERNET GAMES AND OTHER ELECTRONIC GAMES. Operators of Coin Operated Internet Machines and other Commercial establishments catering rental of electronic video games and/ or offering Local Area Network (LAN) services shall not provide gaming services to children during school days.

Commercial establishments or cafes, including Coin Operated Internet Machines, offering internet and/or Local Area Network (LAN) services and/or other services including, but not limited to, electronic-mail, fax, games, chatting, surfing and other such services covered by Internet technology and/or LAN Technology which are accessed for a fee and/or other business establishments offering a combination of services such as food and Internet, bar and Internet recreation, Internet and other combinations shall not allow children to stay in their premises during school days unless for specific educational or study purposes such as research, datagathering or statistical treatment duly assigned by a teacher or tutor or any educational institution representative. Violators of this specific provision shall suffer penalty prescribed by this Ordinance.

Provided that the commercial establishments referred to in the immediately preceding paragraph, including Operators of Coin Operated Internet Machine, shall not allow internet and/or LAN services to minors for whatever purpose from 9 pm to 6 am on any day unless accompanied by a parent or guardian.

Commercial establishments or cafes offering Internet services and/ or LAN Technology portraying violent games shall be regulated.

Pornography, hacking, and gambling shall be strictly prohibited.

Monitoring of the same shall be ensured at the Barangay level through the Barangay Council for the Protection of Children.

As an alternative to increased patronage of children to commercial videogames, electronic games and internet cafes, all public and private schools are enjoined to put up recreational-educational facilities which shall include but not limited to internet centers and sports facilities to cater to children with the funding support of the Local Government of Davao City.

Physical and outdoor activities shall be promoted.

This provision shall amend Section 8 (g) and Section 13.A.6. of Ordinance No. 0270-15 otherwise known as “The Internet Café Ordinance of Davao City”.

SECTION 9.

APPOINTMENT OF CHILD AND YOUTH RELATIONS OFFICER(S) WITHIN THE WOMEN AND CHILDREN’S PROTECTION DESK. Each Police Station and the Bureau of Jail Management and Pe-

The WCPD must function purely as such, exclusively as WCPD for a period of five consecutive years. A memorandum of agreement with the PNP shall be forged by the local government of Davao City indicating the same. Police stations shall build a separate receptioncum-interview center for the Women and Children Protection Desk (WCPD) to ensure a child-friendly atmosphere in handling cases involving children. All police stations shall promote child-friendly units.

The WCPD personnel shall be on call for 24 hours and shall be assisted by a social worker at the district level and the Quick Response Center. In rescue operations, the personnel must respond with the presence of a social worker in the rescue of children but the case must still be indorsed to a government social worker afterwards.

There must be at least one female police officer in every WCPD.

There shall be a child-friendly room within the Women and Children’s Protection Desk of the Davao City Police Office as venue for the interview of victims of heinous crimes under 18 years of age.

Child-friendly police procedures shall be implemented as contained in the existing police manuals and handbooks. Each WCPD personnel shall be provided with a copy of the police manuals and handbooks.

SECTION 10.

SPECIAL COURSE FOR PNP MEMBERS, AND AUXILIARY MEMBERS OF BARANGAY. A special training for members of the Philippine National Police (PNP) shall be designed by the SOCC to effectively handle children in need of special protection.

The police officers must undergo trainings on the management of Cases of Children in Need of Special Protection and Gender Sensitivity Trainings before assuming the functions of a WCPD.

All police officers shall take up the training, especially those who are to be assigned in the WCPD. The Barangay Police, BCPC, auxiliary units, and volunteer organizations shall also be required to attend the special training inasmuch as they are front liners.

The course shall be provided by the Special Office for Children’s Concerns in close coordination with the Women and Children’s Concern Section, other agencies, and NGOs focused on child and youth programs.

SECTION 11.

BRUTALITY AND/OR MALTREATMENT. Any brutality and/or maltreatment against children committed by persons in authority and their agents including but not limited to barangay police, security guards, CVOs, Police Volunteers and their assets shall be subjected to penalty under this Ordinance as determined by the local Internal Affairs Service of PNP, NAPOLCOM, the Bureau of Jail Management and Penology, the Department of the Interior and Local Government (DILG), and other appropriate agencies without prejudice to the provisions of the Revised Penal Code. The SOCC shall monitor in filing complaints of brutality and maltreatment at the appropriate courts.

SECTION 12.

PROHIBITION ON THE EMPLOYMENT OF CHILDREN. Children shall not be employed as provided in the Labor Code of the Philippines and Republic Act No. 7658, Republic Act No. 10361, and Republic Act No. 9231.

Any form of Child Labor is prohibited unless employed as a Kasambahay and/or subject to the exceptions provided by Republic Act No. 9231.

The employment of children as Kasambahay, aged 15-17 years old, and the termination of their employment, shall be registered at the Office of the Punong Barangay. The Punong Barangay or his/ her designated Kasambahay Desk Officer is authorized to monitor the condition of children domestic helpers from time to time.

The SOCC, CSSDO and the Department of Labor and Employment shall develop alternative livelihood programs for the families of street and urban working children.

The City Government shall allocate higher budget for educational assistance to street children and employed children.

SECTION 13.

PROHIBITION ON THE EMPLOYMENT OF CHILDREN IN CERTAIN ADVERTISEMENTS. No person and establishment shall employ or allow to employ any child to model in all forms of commercial or advertisements promoting alcoholic beverages, intoxicating drinks, tobacco and its by-products, prostitution and violence, with or without compensation. It is also prohibited to upload such activities on social media websites and even for entertainment purposes.

SECTION 14.

CREATION OF A MORO AND OF AN INDIGENOUS PEOPLE’S COUNCIL. A council for Moro and for Indigenous Peoples communities in Davao City shall be created separately to facilitate planning, decision-making, implementation, and evaluation of all government programs affecting children of indigenous and Moro peoples.

SECTION 15.

RESPECT FOR THE INTERNATIONAL COVENANTS RELEVANT TO ARMED-CONFLICT. The Local Government of Davao City shall undertake to respect and to ensure respect for rules of international humanitarian law applicable to Philippine political armed-conflict which are relevant to the child. Specifically the following policies shall be observed:

Children shall not be the object of any attack and shall be entitled to special respect. They shall be protected from any form of threat, assault, torture or other cruel, inhumane or degrading treatment. Places that generally have significant presence of children including, but not limited to, schools, hospitals and places of worship shall also be protected from attacks or threats of attacks; Children shall not be allowed to take part in hostilities.

SECTION 16.

EVACUATION OF CHILDREN DURING ARMED CONFLICT. Children shall be given priority during evacuations as a result of armed conflict. The CSSDO together with the SOCC, other agencies and non-government organizations shall look after the welfare of children during evacuation. Measures shall be taken to ensure that children evacuated are accompanied by persons responsible for their safety and well-being.

Persons responsible shall refer to the following order of preference, to wit: 1) Parents; 2) Judicially appointed Guardian; 3) The surviving grandparent; 4) The oldest brother or sister, over twenty-one years of age, unless unfit or disqualified; 5) The child’s actual custodian, over twenty-one (21) years of age, unless unfit or disqualified; and 6) Government.

SECTION 17.

FAMILY LIFE AND TEMPORARY SHELTER DURING ARMED CONFLICT. Whenever possible, members of the same family shall be housed in the same premises given separate accommodation from other evacuees and provided with facilities to lead a normal family life. In places of temporary shelter, expectant and nursing mothers and children shall be given additional food in proportion to their physiological needs. Whenever feasible, children shall be given opportunities for physical exercise, sports and outdoor games.

SECTION 18.

RIGHTS OF CHILDREN IN SITUATIONS OF ARMED CONFLICT. Any child who has been rescued for reasons related to armed conflict, a combatant, courier, guide or spy is entitled to the following rights: a. Separate detention from adults except where families are accommodated as family rights; b. Immediate free legal assistance through the City Social Services and Development Office (CCSDO) in coordination with the Special Office for Children’s Concern (SOCC); c. Immediate notice of such rescue to the parents or guardian of the child; and d. Release within twenty-four (24) hours upon the receipt of the child by the arresting party to the protective custody of the Department of Social Welfare and Development or its accredited organization or the City Mayor as mandated in the Memorandum of Agreement in the Handling and Treatment of Children Involved in the Armed Conflict; and e. Psychosocial therapy.

The SOCC shall initiate rescue of children recovered or taken into custody by any armed element related to armed conflict. Together with CSSDO, it shall monitor and ensure the implementation of the Memorandum of Agreement in the Handling and Treatment of Children Involved in the Armed Conflict by and among the Department of National Defense, Armed Forces of the Philippines, Department of the Interior and Local Government, Philippine National Police, the Department of Social Welfare and Development (DSWD), Commission on Human Rights, Office of the Presidential Adviser on the Peace Process and the National Program for Unification and Development Council signed on March 21, 2000. The SOCC shall call the attention of the agency or agencies found not to be implementing the MOA.

SECTION 18a.

The child held in custody or rescued due to armed-conflict shall not be used as a state witness nor shall he/she be subjected to media exposure at any time upon his/her arrest and stay at the DSWD.

SECTION 19.

Monitoring And Reporting Of Children In Situations Of Armed Conflict. The chairperson of the Barangay Council for the Protection of Children or any designated official of the Barangay affected by the armed conflict shall submit the names of children residing in said Barangay to the CSSDO within twenty-four (24) hours from the occurrence of the armed conflict.

SECTION 20.

PROHIBITION OF COMMODIFICATION OF CHILDREN. All fund-raising activities that directly or indirectly commodify children or expose children as commodities or objects for sale shall be prohibited. These activities include, but are not limited to, beauty contests featuring child contestants who are reduced to a commodity for manipulation and utilization for one’s interest and/or entertainment whether or not in exchange of money or goods; in community benefit dance or disco where the proceeds from young patrons are utilized to fund common activities or projects; or in freak shows where children are used to attract customers for a fee.

Talent-based competitions and culturally relevant competitions shall not be covered by this prohibition.

It is the duty of the Barangay Council for the Protection of Children to push for the education of this specific provision in the Barangay.

SECTION 21.

RESCUE OF CHILDREN UNDER SPECIAL CIRCUMSTANCES.

For the protection of children below 18 years of age, they shall be rescued by the BCPC and CSSDO when found loitering around or sleeping in public places unless they are in company with their parents or guardians. The social worker in the Barangay, or any available personnel from the CSSDO as well as from the Philippine National Police shall initiate and accompany the rescue of these children and turn them over to their respective residences provided that the parents or guardians must sign an undertaking for them to attend the scheduled parenting seminar to be conducted by the CSSDO. The same shall also be turned over to the CSSDO or other accredited NGO. The same undertaking shall be conducted on children found inside bars, videoke establishments, internet cafes and other similar establishments unless accompanied by an adult or guardian.

Armed Forces of the Philippines or its civilian units or other armed groups, nor be allowed to take part in the fighting, or used as guides, or couriers, or spies, cooks or medic;

• Delivery of basic social services such as education, primary health and emergency relief services shall be kept unhampered;

• The safety and protection of those who provide services including those involved in fact-finding missions from both government and non-government institutions shall be ensured. They shall not be subjected to undue harassment in the performance of their work;

• Public infrastructure such as schools, hospitals and rural health units shall not be utilized for military purposes such as command posts, barracks, detachments, and supply depots; and

• All appropriate steps shall be taken to facilitate the reunion of families temporarily separated due to armed conflict.

SECTION 22.

CHILDREN AFFECTED IN NATURAL DISASTERS AND/OR CALAMITIES. Children shall be given priority in times of natural disasters and/or calamities like flashfloods, fire, earthquakes, pest infestation, volcanic eruption, and drought as provided by Republic Act No. 10821. The CSSDO, in coordination with the Davao City Disaster Risk Reduction and Management Council (DRRMC) and the City Health Office shall devise a program to assist children victims of disasters inclusive of the following components:

Psychosocial therapy and counseling; Naturally processed foods for newborn babies and special food for lactating mothers; Free medical services and children’s clinic; and Child-friendly and child-sensitive evacuation centers.

In cases of natural disasters and/calamities, the Local Government of Davao City with the proper written documentation to the DepEd and DILG shall provide evacuation centers pursuant to Section 5 of Republic Act No. 10821.

SECTION 23.

MEDIA HANDLING OF NEWS AND ISSUES INVOLVING CHILDREN. Children in need of special protection shall not be exposed to undue media coverage unless consented to by the child and parent/guardian. Media practitioners shall have the duty to maintain the highest critical and professional standards in reporting and covering cases of children in conflict with the law.

Thus, in accordance with Republic Act No. 9344, all records and proceedings involving children in conflict with the law from initial contact until final disposition of the case shall be considered privileged and confidential. The public shall be excluded during the proceedings and the records shall not be disclosed directly or indirectly to anyone by any of the parties or the participants in the proceedings for any purpose whatsoever, except to determine if the child in conflict with the law may have his/her sentence suspended or if he/she may be granted probation under the Probation Law, or to enforce the civil liability imposed in the criminal action.

The component authorities shall undertake all measures to protect the confidentiality of proceedings, including non-disclosure of records to the media, maintaining a separate police blotter for cases involving children in conflict with the law and shall not be used in subsequent proceedings for cases involving the same offender as an adult, except when beneficial for the offender and upon his/her written consent.

In all publicity, the best interest of the child should be the primordial and paramount concern. Any member of the mass media who shall display, air, broadcast or print violence and exploitation of children shall be held liable in this Code. Children must also be protected against child pornography and bullying.

Article IV Development Rights of Children

SECTION 1.

EARLY CHILDHOOD CARE AND DEVELOPMENT SYSTEM -This refers to the full range of health , nutrition, early education and social services programs that provide the basic holistic needs of young children from birth to age eight (8) and to promote for their optimum growth and development as provided by Republic Act No. 10410. The program includes:

The Kindergarten Education Act or Republic Act No. 10157 which provides equal opportunities for all children to avail of accessible mandatory and compulsory kindergarten education that effectively promotes physical, social, intellectual, emotional and skills simulation and values formation to sufficiently prepare them for formal elementary schooling. Kindergarten education is made mandatory and compulsory entrance to Grade 1.

Center-based programs, such as the day care service established under Republic Act No. 6972, public and private pre-schools, kindergarten or school-based programs, community or church-based early childhood education programs initiated by non-government organizations or people’s organizations, workplace-related child care and education programs, child-minding centers, health centers and stations; A Barangay-based child minding center shall be established to care for children of working parents during the day in a daily 8 hour programme and, where feasible, care and supervision for children up to eight (8) years of age when parents are working at night; Provided, that the day care center need not take care of the children in a particular place but shall develop network of homes where adults may take care of the children up to (8) eight years of age of working parents during work hours, with adequate supervision from the Supervising Social Welfare Officer of the CSSDO: Provided, further, that where young children are left to the care of a paid domestic, an elderly relative or older children without adequate and competent adult supervision, the Supervising Social Welfare Officer shall provide such training and adult supervision until the children’s care meets adequate standards whereby the children under their care will develop normally as healthy, happy and loving children, even in the absence of their parents during working hours; and See ORDINANCE, page 14

Home-based programs, such as neighborhood-based play groups, family day care programs, parent education and home visiting programs.

Materials and network of surrogate parents-teachers who will provide intellectual and mental stimulation to the children, as well as supervised wholesome recreation, with a balanced program of supervised play, mental stimulation activities, and group activities with peers.

Unstructured combined with structured learning exercises for children under the early childhood education shall be instituted in the children center or day care centers respecting the participation right of the child.

The Local Government of Davao City in cooperation with the Department of Education and ECCD Committee shall also ensure to the maximum extent possible the survival of the child from 0-8 years old. The program on survival shall also include the following: •

Monitoring of registration of births and the completion of the immunization series for prevention of tuberculosis, diptheria, pertusis, tetanus, measles, poliomyelitis and such other diseases for which vaccines have been developed for administration to children up to eight (8) years of age;

• Growth and nutritional monitoring with nutritional feeding and supervision of nutritional intake at home;

• A sanctuary for abused, neglected or exploited children which will take in children in urgent need of protection due to a situation which endangers the child or which has exposed the child to cruelty and abuse; Provided, that the center, with the help and support of the Barangay officials and their Barangay-level support systems, may call upon law enforcement agencies when the child needs to be rescued from an unbearable home situation;

• A reproductive health care center for pregnant mothers for prenatal and neonatal care, and in the proper case, for delivery of the infant under conditions which will remove or minimize risk to mother and child: Provided, that highrisk mothers shall be referred to the proper tertiary or secondary care service personnel and children who are at risk from any condition or illness will be brought for care: provided, further that “hilots” and Barangay health workers are provided the needed basic training for normal delivery and are trained to recognize high-risk pregnancies which should be referred to competent obstetrical and pediatric medical care for mother and child who are at risk; • To monitor and register pregnancies and to ensure full access to pre-natal and post-natal care in accordance with Republic Act No. 11148; and

SECTION 6.

Parenting Orientation Courses.

Prior to the issuance of marriage license, applicants shall be required to participate in a Parenting Orientation Course I which gives emphasis on counseling and strengthening family relations.

This course becomes an integral part of existing Family Planning Seminar on Reproductive Health course.

Parents-applicants for birth certificate of their child shall also be encouraged to participate to a Parenting Orientation Course II, as a follow up to the first course before the issuance of Certificate of Live Birth by the Civil Registrar without prejudice to the early registration of birth requirement under existing law. Parenting Orientation course II shall be done in coordination with the community-based secondary and tertiary hospitals.

The Davao City Special Office for Children’s Concerns in coordination with the City Health Office, CSSDO and the City Civil Registrar’s Office shall update the family planning seminar and design the module of Parenting Orientation Course I and II.

Parenting orientation for Senior High school shall also be promoted in cooperation with DepEd, DSWD, and CSSDO.

SECTION 7.

Registration of Live Birth and of Live Birth Certificate shall be issued free of charge to indigent below 18 years of age.

SECTION 8.

Promotion of Moral and Spiritual Values. There shall be a promotion of a comprehensive moral and spiritual values of all children in all schools and communities. These values must be scripture-based principles that foster love of God, love for others, love for country, and respect for creation. It must inculcate the basic attitude of respect for laws and authorities. The promotion must be in all Children Development Centers, all schools especially, elementary and in communities through the BCPC and other NGOs in the area.

SECTION 9.

Recreational and Educational Facilities. All Barangays shall establish a play ground or recreational facilities and library or reading centers.

Article V Survival Rights

SECTION 1.

A pool of trained day care center or child development workers with an upgraded salary scheme commensurate to the tasks assigned shall be installed.

ECCD Curriculum refers to the age and developmentally appropriate educational objectives, programs of activities, organized learning experiences and recommended learning materials for children that are implemented by service providers through center and homebased programs. It shall consist of national program goals and guidelines, instructional objectives, and content outlines integrating local leaning experiences and indigenous learning materials.

Parent Education refers to the various formal and alternative means of providing parents with information, skills, and support systems to assist them in their roles as their children’s primary caregivers and educators. These include public and private parent education programs linked to center, home and media-based child care and education programs.

Population-based Child Development Center. Child Development Center shall be set up in every Barangay. In case the Child Development Center could not be set up or not feasible in the Barangay, other ECCD modalities can be set up on every Barangay. The number of such centers shall depend on the number of children and the prevailing economic conditions in the Barangay as determined by the CSSDO. Parents Program shall form part of this early childhood education. Child Development Workers shall preferably be a resident of the barangay, shall possess good moral character and shall undergo intensive trainings on ECCD. Monthly evaluation and monitoring shall be conducted.

Survey and Active Program for Children with Disabilities.

The CSSDO in coordination with the SOCC shall make a periodic comprehensive survey, facilities, and infrastructure on the children with disabilities in the City.

Barangay-level Recreational and Cultural Facilities and Program. A Barangay-level program for the revival of indigenous games reflective of the cultural diversity in Davao City shall be installed. The Local Government of Davao City shall allocate space for recreation and provide recreational facilities appropriate for children’s gender and age. A regular cultural program appropriate for each children’s age-group and gender shall be designed with due respect to cultural diversity.

SECTION 5.

Local Children’s Literature. In support to the socio-cultural development of children in Davao City, the Local Government of Davao City, in cooperation with appropriate government agencies, shall invest in the production of local literature for children or other relevant materials.

Promotion of Primary Health Care Program.The Barangay Health Centers shall implement the Primary Health Care Program. Each Barangay Health Center shall have a Barangay Child Health Officer tasked to monitor child health in the barangay level with a salary commensurate to the task assigned. The Local Government of Davao City, in particular, shall take appropriate measures which shall include, but not limited to, the following: • To combat disease and malnutrition within the framework of primary health care, through inter alia the application of readily available technology and through the provision of adequate nutritious foods and clean drinking water, taking into consideration the dangers and risk of environmental pollution; • To establish a comprehensive Parents Orientation Development Program which includes courses on reproductive health, child, health and child rearing practices in the context of the Filipino psychology; • To monitor the full implementation of the Milk Code of the Philippines and advocate for the prosecution of milk firms which violate the Code; • To monitor the implementation of the Act for Salt Iodization Nationwide of 1995 (R.A.8172) which mandates the iodization of all food-grade salt for human and animal consumption; and • To conduct massive information and education on breast feeding. Utilizing existing reference materials for effective breast feeding education program. And that students in all levels are required to take up breast feeding course which shall be an integral part of all curricula.

SECTION 2.

Comprehensive Training Course on Child and Maternal Health.

All health practitioners dealing with child health in the government, NGO or private institutions shall be required to complete a Comprehensive Training Course on Child and Maternal Health.

No one shall practice her or his health profession without the updated Certificate of Completion of this training course which shall be designed by the Task Force on Health or as prescribed in the implementing rules and regulations of this Ordinance. Violation of this provision will constitute a penalty of cancellation of license to practice profession.

SECTION 3.

Child-friendly Hospital in Davao City. All hospitals in Davao City shall set-up child-friendly units to include lying in and birthing home facilities, rooming-in facilities and pediatric-appropriate mechanisms and gadgets. This section must be understood to be in coordination with CHO and DOH.

SECTION 4.

CREATION OF CHILDREN’S HOSPITAL AND COMPREHENSIVE CHILDREN’S FACILITIES. The Local Government of Davao City shall establish a special hospital for children accessible to, and affordable for the poor families.

It shall ensure pediatric assistance and facilities for the treatment of illness and physical rehabilitation. Such protective and developmental placement shall be evaluated regularly by a competent team composed of multi-disciplinal professionals.

This multi-disciplinal special hospital shall not however, assume the function of the primary health care available at the Barangay level. The Davao City Pediatric Society shall be involved in the final promulgation of program of the Children’s Hospital under the Task Force on Child Health which shall be formed by the City Health Office and the Davao City Special Office for Children’s Concerns within one year of the effectivity of this Ordinance. B. Right to Free Expression:

Learners shall have the right to establish/form publications that will be published regularly and independently. These shall serve as venues to exercise their right to free expression and to ensure access to information.

School records of public concern shall be made available to the pupil/student publication whenever requested.

Learners shall have the right to convey information and to manifest their ideas/views freely, either orally, in writing or in the form of art (e.g. distribute/circulate and/or mount leaflets, newsletters, posters, wallnews, and other similar materials reflective of their interests, aspirations, and well-being). The school shall provide adequate facilities for dissemination of information, such as bulletin boards, etc.

Learners shall have the right to peaceably assemble and to petition for redress of grievance. Peaceful student assemblies shall not be forcibly dispersed and/or harassed. No school regulations and/or guidelines pertaining to pupil/student assemblies shall be restrictive of their basic right to peaceably assemble.

A freedom wall shall be established so that the children can have and use it as an avenue to voice out their grievance, admiration, and critics inside the school campus.

Request for permits shall not be required from pupils/students for the conduct of assemblies inside campuses. However, they shall notify the Office of Student Affairs within a reasonable period of time prior to the conduct of the assembly.

There will be a children’s forum to be conducted during the Children’s Month and to include the Supreme Student Government (SSG) in the Children Protection Committee to acknowledge their power to vote and to become part in the children’s policy assessment;

C. Right to Participate in the Review and Formulation of Policies Affecting their Welfare:

School-based children shall have the right to participate in the review and determination of school policies relevant to their welfare by having representatives in policy-making bodies in the school, particularly the leading officers of the pupil/student council/government. They shall have voting powers in these policy-making bodies.

Similarly, school-based children shall have the right to participate in the review and formulation of government programs and policies affecting them by having representatives to the Children’s Congress.

A school-based Children’s Congress will be initiated which should be managed by the school children and not by the school teachers.

However, such teachers or school advisers may guide the school children on managing such school-based Children’s Congress.

Accordingly, the monitoring and implementation of this activity will be headed by the Department of Education in cooperation with the SOCC;

D. Right to Avail the Use of School Services and Facilities:

For more efficient participation, learners shall have the right to adequate welfare services and facilities in school. Learners and pupil/student organizations shall have the right to make use of school facilities, and are held responsible for its proper use and maintenance; and

E. Role of Moderators/Advisers:

Moderators/advisers of pupil/student councils, publications and clubs shall function to give guidance and assistance to aid in the formation of active and dynamic children sector in schools; but shall prohibit from exercising any form of control and censorship (as to publications).

Any child, on account of his/her exercise of participation rights shall be protected from arbitrary disciplinary measures and penalties.

He/she shall have the right to due process, to procedural fairness in disciplinary proceeding, and to presumption of innocence.

These rights of school-based children shall be included in all pupil/student handbooks for more effective dissemination and implementation.

Learner governments/councils shall represent their constituents and in consultation with them, shall participate in decision and policy-making processes regarding school matters directly affecting them.

The Sangguniang Kabataan Federation shall adopt mechanisms to ensure and to monitor the implementation of these provisions.

School administrators shall assist in the collection of reasonable learner government/council fee. The same shall be used for the implementation of the latter’s activities and programs.

SECTION 1.

Based on their skills, talents, and interests, pupils/students have the right to form and join clubs, alliances, and other associations.

These may include, but not limited to, academic, religious, sociocivic, cultural, and political clubs. These clubs shall be given recognition and shall conduct activities in line with the school’s mission statement and policies; and with the supervision of the Office of Student Affairs.

The recognition of learner clubs shall be determined by the learner government/council in coordination with the Office of Student Affairs, and shall be governed only by necessary and reasonable requirements. School policies pertinent to clubs shall be made with genuine students’ participation and are applied for as long as these do not hinder them from realizing their goals and activities.

Functions of the Special Office for Children’s Concerns. The Davao City Special Office for Children’s Concerns, a line agency under the City Mayors Office, separate and distinct from the City Social Services and Development Office, shall be created to beef up the capacity of the latter in realizing the provisions of this Ordinance. It shall assume functions relative to conceptualization, coordination of programs and services for and with children, regulatory, executory, monitoring and evaluation in support to the Local Government of Davao City’s high priority on children.

It shall cause to file complaints on cases of unlawful acts committed against children in the most expeditious process with the appointment of Ombudsperson for Children with full legal staff as deemed necessary.

A staffing pattern that has a strong leaning to child-centered work must be established.

SECTION 2.

Local Council for the Protection of Children. There is hereby reorganized and reconstituted a body known and called as the Local Council for the Protection of Children (LCPC) in the City of Davao.

The LCPC shall have the following functions:

The Local Government of Davao City shall likewise establish a Comprehensive Children’s Facilities.

All children regardless of their gender identity and expression, sexual orientation, ethnicity, religion, economic status, academic status, educational attainment, and body structure shall not be discriminated and their Rights and Welfare Shall be Promoted and Respected.

Article VI Participation Rights of Children

SECTION 1.

Participation of Children in Decision Making Processes. All children in the family, school, community or other organization or institution shall be heard. They shall have the right to organize among themselves. Each child regardless of sexual orientation, age and tribe has the right to express his or her opinion freely and to have that opinion taken into account in any matter or procedure affecting the child. It shall be the responsibility of the adults to provide opportunities for children to express his or her views, obtain information, make ideas or information known, regardless of tribe, religion, age and sexual orientation.

Every children in the different barangays shall elect a representative in the BCPC to sit down on meetings, planning, and decision making as well as to attend the City-Wide or Regional Children’s Congress.

The criteria for the selection of child representative are as follows: • Must be between 10-15 years old; • Must be an active participant of the community; • Must be an active member of an accredited/recognized organization in the Barangay, school, or faith group; • Must be able to articulate children’s issues and concerns; • Must have at least a residency of one (1) year in the barangay; • Must have good leadership skills; and • Must have balanced views on gender, religion and ethnicity, and disabilities.

SECTION 2.

Installation of Mechanism for Participation in the Policy and Program Formulation of the Local Government. Children, who are from the different groups such as those from the grassroots, out-of-school youth, peasant, fisher folks, Indigenous People, badjao, and moro shall be convened in a Children’s congress to be held in October every year.

The Children’s Congress shall provide venue for children to express their views relevant to the policies of the Local Government of Davao City. Detailed implementing rules and guidelines in the conduct of the Children’s Congress shall be formulated by the Davao City Special Office for Children’s Concerns.

The BCPC shall create and establish a Barangay Children’s Association represented by different groups of children such as, but not limited to, the OSY, CICL, IP, badjao, moro, fisherfolk, urban poor, children at risk, children with disabilities, children with special needs and marginalized children.

SECTION 3.

School-based Children’s Rights. This shall include:

A. Right to organize among themselves:

School-based children shall have the right to form autonomous, democratic and representative learner government/council as the highest expression of learner organization in the school.

It shall have its own Constitution and By-laws and shall serve as primary venues for school-based children to uphold their general welfare and aspirations. It shall be established through a democratic process such as elections. It shall plan and determine programs and activities geared towards their holistic development provided that such are made in accordance to the mission statement and policies of the school.

Learners shall not be compelled to join or not to join any particular club. Any form of intimidation or harassment shall not be allowed.

Learners shall not be made to sign documents or any paper (e.g. waiver) certifying that they are not members of or do not intend to join a particular club, as a condition for enrolment and/or admission in school;

Considering the wide territorial jurisdiction of the Local Government of Davao City, a District-IMTF shall be organized composed of district officers/personnel from the core members of the City-IMTF per congressional district.

Other functions of the LCPC – IMTF shall be in accordance with the DILG MC 2008 – 126 and DILG – DSWD – DepEd – DOH JMC no. 2019 – 01.

1) Formulate plans, programs and policies for children that are gender-fair, culturally relevant and responsive to the needs of diverse groups of children from 0 to below 18 years of age; 2) Prepare Annual Work and Financial Plan (AWFP) for children and recommend appropriations to the Sanggunian; 3) Provide coordinative linkages with other agencies and institutions in the planning, monitoring, and evaluation of plans for children; 4) Provide technical assistance and recommend financial support to the Barangay Council for the Protection of Children; 5) Establish and maintain database on children in the city; 6) Foster education of every child; 7) Advocate for the establishment and maintenance of playgrounds, day care centers and other facilities necessary for child and youth development; 8) Recommend local legislation promoting child survival, protection, participation and development, especially on the quality television shows, media prints and coverage, which are detrimental to children, and with appropriate funding support; 9) Assist children in need of special protection and refer cases filed against child abusers to proper agencies/institutions; 10) Conduct capability building programs to enhance knowledge and skills in handling children’s program; 11) Document barangay best practices on children; 12) Monitor and evaluate the implementation of the program and submit quarterly status reports to the Regional Committee for Welfare of Children (RCWC); and 1 3) Perform such other functions as provided for in the ECCD and other child related laws.

SECTION 5.

The BCPC shall have periodic assessment and report regarding situation of children in their respective barangays and to submit the same to the LCPC through the SOCC being the secretariat.

This provision shall be in accordance with the provisions of DILG Memorandum Circular No 2002-121 and those prescribed in this Ordinance.

SECTION 6.

Children As Social Indicators Of Local Conditions. Children are hereby declared as Social Indicators of Local condition. The City Planning & Development Office in coordination with the SOCC shall come up with a yearly situational analysis of children in Davao City for monitoring and evaluation.

The Council, in coordination with the Local School Board, the Division of City Schools, National Commission of Indigenous Peoples, Office of Muslim Affairs and the Davao City Council for the Protection of Children, shall create a Team of Educators to formulate a specialized curriculum which is culture-specific and relevant to the needs and existing situation of the indigenous and Moro children in Davao City. (From Article III, Section 15)

The Council may add members from time to time as deemed necessary.

SECTION 3.

Organizational Structure of LCPC. The organizational structure of the LCPC shall be as follows: • Executive Committee: Chairperson, Co-chairperson, ViceChairperson, five (5) chairpersons of the sub-committees on survival, development, protection, child participation, ECCD, Child representatives, CBO, CAO, CPDO, Liga President and DILG City Director.

Composition. There shall be an Inter-Agency Monitoring Task Force (IMTF) at all levels, specifically, City –IMTF.

ARTICLE VIII PENAL PROVISIONS SECTION 1.

PENALTY. Unless otherwise provided, persons found violating any provisions of this Ordinance shall be penalized as follows:

ARTICLE IX FINAL PROVISIONS SECTION 1.

RULES AND REGULATIONS. An Ad Hoc Committee shall be created by the City Mayor composed by the members of the Technical Working Group in the amendment process of the Children Welfare Code together with the City Prosecutor’s Office, which shall promulgate rules and regulations for the effective implementation of this Ordinance.

SECTION 2.

APPROPRIATIONS. The amount necessary to carry out the provisions of this Ordinance is hereby authorized to be appropriated subject to usual available funds of Government and accounting Rules, particularly 5% of the General Fund.

SECTION 3.

SEPARABILITY CLAUSE. –If, for any reasons, any part or provision of this Ordinance shall be declared unconstitutional or invalid, other parts or provisions not affected thereby shall continue to be in full force and effect.

SECTION 4.

REPEALING CLAUSE. –All Ordinances contrary to or inconsistent with this Ordinance are hereby repealed or modified accordingly.

SECTION 5.

EFFECTIVITY. This Ordinance shall take effect after publication in a newspaper of general circulation in Davao City.

Aside from the Constitution and the Bangsamoro law, the BARMM also cited jursiprudence, reiterating that its creation “contemplates the grant of political autonomy and not just adminisitrative autonomy.”

It also cited the case of Disomangcop vs Datumanong where the Supreme Court ruled that regional autonomy is the “granting of basic internal government powers to the people of a particular area or region with least control and supervision from the central government.”

The BARMM said that based on RA 11054, “ratification in a plebiscite is the operative fact that determines the establishment of the territorial jurisdiction and no further act is necessary for the inclusion of provinces, cities and geographical areas in the Bangsamoro Autonomous Region.”

Status Quo Sayadi’s position paper claimed as legal basis for the President to consider their appeal is that implementation of the law is “inherently executive in nature” and the President has the “full power” to hold in abeyance the turnover of the city to the BARMM. She also cited the general supervision powers of the President in the Constitution, the Local Government Code, and the Bangsamoro Law’s Article VI which pro-

vides that the President shall exercise general supervision over the Bangsamoro Government “to ensure that the laws are faithfully executed.”

Sayadi claimed her city would be placed in a “critical and difficult sitaution” and that the momentum of the city for progress and development “will be unduly derailed” if they would be under BARMM. She cited several issues to push for status quo until 2022, among them, that the turnover of the city to BARMM is “not urgent.. not exigent.. not necessary as of this time,” claiming the BARMM has yet to pass its Administrative Code; that the system of governance in the BARMM is parliamentary and the BARMM is still “learning its craft.”

The mayor also claimed that after a year, “BARMM has no significant achievement,” that it has “no transition plan” and cited other issues pointing to the alleged incompetence of the BARMM and that the turnover of Cotabato City to BARMM now “will imperil the development and growth and bring confusion in Intergovernmental Relations of the City.”

She also claimed peace and order “would be seriously sacrificed,” adding the incidence of crimes has “significantly increased” since the BARMM was set up and that investors are “withdrawing their investments because of this perceived threat to peace and political stability.”

She cited four cases pending in the Supreme Corut – three on the issue

of constitutionality of the Bangsamoro law filed by Sulu Governor Abdusakur Tan vs Executive Secretary Salvador Medialdea, Philippine Constitution Association vs Senate, and Congressman Dimaporo vs Commission on Elections, and a petition for nullification of the plebiscite results in Cotabato City (Amil P. Sula vs Comelec).

Sinarimbo said the Administrative Code is “not a requirement for the inclusion of Cotabato City in the BARMM or the transfer of national agencies located in Cotabato whose functions have been transferred to the Bangsamoro.”

He said the Bangsamoro law provides that “subsisting regional laws, including the Administrative Code, continue to operate unless revoked by the Parliament.”

Sayadi’s reference to a “status quo” is apparently for Cotabato City to remain with Region 12 where it was a part of before last year’s plebiscite on the Bangsamoro law.

An effective learning environment consists of students and teachers learning harmoniously. The give and take relationship, which works on both ways, produces a never- ending opportunity for learning. Finding suitable teaching styles and strategies to cater all students, providing suitable and appropriate feedback and knowing how to give positive responses benefit both parties.

Struggling with classroom participation is not a new problem for many educators. The already existing factors added with the distraction caused by gadgets and personal digital assistants (PDAs), the pressure is set to a whole new level. That being said, teachers can only match students’ enthusiasm,

or lack of thereof in some cases, as to boost participation in class.

However, with the influence of today’s Social Networking Sites (SNS), social media seems to be doing more harm than good. Since most students have their own phones, drawing students to participate has indeed been challenging. With mobile data and data plans, students have infinite access to the internet. Without proper monitoring, the unrestraint and excessive web surfing ultimately affects academic and extra-curricular performance.

Fortunately, this doesn’t necessarily mean to be a bad thing. The rise of social media can be a turning point in a greater pursuit of academic excellence. Trending topics and memes in

PowerPoint presentations or playing popular KPOP songs as icebreakers can give students the sense of understanding from their teachers. Mentioning celebrity names in situational problems is another way to spark interest. Focusing on learner-centered approach by matching students’ interests doesn’t solely rely on traditions but also on compromises each party has to make along the way.

So instead of fearing the vast world of internet, understanding it bit by bit is certainly the way to go. In order to meet this young generation’s needs half-way, proper observation and implementation is the key to opening another door to an upgraded version of an effective learning environment.

PROJECT JAR (Joy in Artistic Reading) By: Eden C. Acaylar, PhD Bulua Central School

Reading is an essential skill, but it does not come easy to everyone. Children who struggle are often frustrated and learn to dislike reading. With this, Bulua Central School has responded to the reading challenges of the learners enrolled for School Year 2019-2020. Department of Education has implemented Project CNR or Project Care for NorMin Readers and Project 3B’s or Bawat Bata Bumabasa initiatives to help learners with reading deficiencies.

Bulua Central School has intensified its implementation as they instigated the schools’ reading program “Project JAR”.

Project JAR (Joy in Artistic Reading) is an approved Basic Education Research Fund (BERF) of Eden C. Acaylar, PhD., lead proponent. It is an innovation to improve the reading skills of elementary pupils. The project was formally launched on July 8, 2019. It was supported by Barangay Council Members, LGU’s, school heads, parents and pupils.

With the constant support of Barangay Council Members headed by Hon. Al. P. Legaspi Jr., Brgy

Chairman and Kagawad Pacifico Luman, Chairman of Committee on Education and Health, the program has extended and became a joint advocacy of the school and the barangay. Presently, Project JAR is supported by the barangay through free feeding program and came up with the program named FREEDVOCACY or Feeding and Reading Advocacy.

Several stakeholders supported the program.

Barangay Council Members provides reading resources and food for feeding. The Christian Adventist Riders Association (CARS) has pledged foods for feeding recipients. The KCLM laboratory has sponsored free laboratory checkup of children, parents and Mobile JAR teachers. Barangay Council Members have always shown gratitude for the constant sustenance and provision of materials needed for the reading sessions.

As noticed, learners have improved their reading performance, self-esteem as they continuously engage on differentiated instructions and performance output presentations. They have developed critical thinking, creativity, vocabulary, fluency and comprehension as they engross on oral communications during games, dramatization or role playing activities.

The milestone alliance was formalized through a recent courtesy visit of Globe leaders at the City Hall of Iloilo. The ceremony was led
