Staff responsible for release of containers asked to explain C

AGAYAN de Oro City--Bureau of Customs, Region 10 (BOC-10) collector Atty. Ruby Claudia Alameda has asked the signatories responsible for the release of the seven containers full of sodium cyanide to explain within 48 hours from yesterday why they released the shipment despite loopholes in the documents of the shipment.

Initially, Alameda pointed out negligence on the part of some personnel of the Mindanao Container Terminal (MCT) who manifested release of the shipment as the main culprit.

CAGAYAN de Oro City, the premier capital of Northern Mindanao, remained as one of the safest places for tourists in the country, Vice Mayor Ceasar Ian Acenas said on Wednesday.

Acenas issued the statement to dispel insinuations by some candidates of “Mr. and Miss PanContinental International Global Beauty Pageant” that Cagayan De Oro City is not a safe place for foreigners.

Six Davao del Sur barangays declare NPAs persona non grata S

IX barangays in Malita, Davao Del Sur have declared all members of the New People’s Army (NPA) persona non grata in their respective localities.

These barangays are identified as Little Baguio, Kinangan, Manuel Peralta, Demoloc, Pinalpalan and Datu Danwata.

Philippine Army (PA) spokesperson Col. Benjamin Hao said the resolution was passed by the barangays councils of the six communities.

“The barangay councils of the above mentioned barangays inked a resolution prohibiting the NPAs to enter their respective barangays. All of the councilmen

that include the indigenous people mandatory representative unanimously affixed their signatures to show their support in calling for the NPAs to enter their ancestral lands/barangays,” he added.

All six barangays are predominantly populated by Tagakaolo Tribes and are located in the boundary of Davao Del Sur and

Sarangani Province.

These barangays were once infiltrated by NPA’s Guerrilla Front 75 that were already dissolved.

“Further, the residents of these barangays were forcibly subjected to extortion that worsens their lives,” Hao added.

tim to the communist group’s atrocities that includes Ramon Danwata, killed on 2010, a former barangay captain of Barangay Datu Danwata, Henry Dasal of Barangay Pinalpalan, Lindo Dioya of Barangay Pangaleon and Linda Tiwado, pregnant when she was brutally killed, of Barangay Little Baguio, among others. CDO’s Mayoral race: ‘Back to one-on-one’ WHETHER one likes it or not, the race for mayor in Cagayan De Oro City has been reduced to a twocornered fight. We have written about this in the past that the mayoral fracas would ultimately become between Rufus Rodriguez and Dongkoy Emano. Now, it is worth to reiterate the prognosis.

With a string of anti-graft and corruption cases in the queue, City Mayor Oscar Moreno’s reelection bid is doomed. Moreno, himself, admitted that there are still 15 pending graft cases above his head.

With the one case involving the Ajinomoto scandal already decided: The Ombudsman has already ordered the dismissal and perpetual disqualification of Moreno from public service, the fate of Moreno now hangs in the balance.

Technically, Moreno’s continued stay in office as City Mayor is nothing but part of the law’s remedial measure. Notwithstanding, aside from being an object of prohibition in the

Supreme Court, the 60-day restraining order penned by the local Court of Appeals (CA) is going to end in mid-January. What if the High Court sustained the restraining order and the writ of preliminary injunction filed by the petitioner against the CA’s ruling that granted Moreno a 60-day retrieved?

What if the Ombudsman would not reply or, simply set aside Moreno’s motion for reconsideration?

It would simply mean that the Ombudsman is sustaining the dismissal order that the anti-graft court has meted against Moreno.

Under this condition, one could sense that Moreno could do nothing anymore against the Ombudsman.

Of course, Moreno would seek the final relief in the High Court.

Perhaps, t his t ime, Moreno could not ask for another restraining order.

Moreno would go to the Supreme Court to question the Ombudsman ruling.

While Moreno is preoccupied with defending and

trying to wiggle his way out of the situation, there is a greater tendency that he would be forcibly ousted from office this time.

Of course, Vice Mayor Ian Acenas and the political opposition would no longer allow Moreno to stay in the City Hall’s Executive Building anymore. “Once is enough,” said an opposition leader with reference to Moreno’s holding out at the Executive Building when the dismissal order was served last Nov. 12, 2015.

Now the campaign period has begun. Obviously, Rufus and Dongkoy would be the only two political protagonists whose figure would be visible on the campaign trail.

Moreno’s supporters and drum beaters might try to catch along the way, but the more they would, the more the campaign trail would be perilous for them because the electors would no longer want to be associated with them.

Ozamis extends livelihood aid to displaced fishermen O

ZAMIS City--The city government has extended assistance to displaced fishermen as the local government mounted a campaign against illegal fishing along the Panguil Bay area here, City Mayor Reynaldo Parojinog said.

Parojinog said the local government has seized

hundreds of “filter nets,” locally known as “Sanggab,” which catches small fish, crabs, and prawns around the Panguil Bay area.

“Sanggab” is an illegal fishing prohibited under Republic Act No. 8550 as amended by RA 10654 or An act to Prevent, Deter and Eliminate “Illegal, Unreported and Unregulated

Fishing (IUUF).

Parojinog said that the city government of Ozamis has extended PHP 4,600.00 to each fisherman caught using the illegal “Sanggab”

fishing as a livelihood assistance.

“Scholarship is also granted to the children of the fisherman provided the fisherman would no longer

engage in the illegal “sanggab” fishing,” Parojinog said.

Parojinog also disclosed that the city government has also included in its 2016 budget an appropriation

for “livestock” livelihood to all identified fishermen in the city’s coastal areas as registered by the Bureau of Fisheries and Aquatic Resources (BFAR). CD/EM

4ID conducts 3rd Quarter Conference for Bayanihan Assessment in Butuan City BUTUAN City--The Philippine Army’s 4th Infantry Division held its 3rd Quarter Conference entitled “Bayanihan Assessment with Key Stakeholders,” on Wednesday held at 2nd floor Samping Avenue conference hall, J.C. Aquino Ave., this city.

A press forum was conducted as part of the said activity which was attended by 4th Infantry Division Commander Major General Oscar T. Lactao, 4th ID Deputy Commander BGen. Paul T. Atal, 401st Brigade Commander Col. Alexander L. Macario, 402nd Brigade Commander Col. Isidro L. Purisima, 403rd Brigade Commander Jesse A. Alvarez, Task Force Diamond Commander Col. Henry G. Dar, PSupt. Rudy L. Elandag Deputy of the Police Regional Office 13 Operations Division and PSupt. Ramir Perlito P. Perlas, Officerin-Charge of the Regional Investigation Detection and

Management Division.

MGen. Lactao, during the forum, presented the accomplishments of the 4ID from the 3rd Quarter up to December 2, this year.

He reiterated the mission of his division which is to conduct support operations in collaboration with the civil authorities in his area of responsibility. He cited that it is to normalize these areas in Regions 13 and Region 10 not later than the year-end of 2016 “in order to establish resilient security and investment conditions, thereby facilitating the attainment of lasting peace and stability, social progress and economic development in Caraga and Northern Mindanao,” he said.

Lactao cited that the Army found value on continually imparting human rights and international humanitarian law training to the Army troops in partnership with the Commission on Human Rights.

He also said that the Army had engaged in facilitating development even in the far-flung communities.

Among the accomplishments cited by Lactao were the 2nd Peace Caravan under the theme: “Nagkahiusang Nasud Alang Sa Kalinaw (One Nation For Peace,” which according to him was a part of the whole nation initiative conducted in Lianga and Marihatag, Surigao del Sur last August 24-25.

Among the highlights of the said activities were the ceremonial hand over of support to 43 former rebels, the inauguration of the newly constructed farm-to-market road and water system at Sitio Neptune, Barangay Diatagon in Lianga, Surigao del Sur. According to Lactao, in Misamis Oriental, the energization project had reached Sitio Lantad, Barangay Kibanban, Balingasag which was once considered

as the bastion of insurgency of North Central Mindanao.

A ceremonial switchon was held at the area on September 29, this year which signaled the entry of electricity in the said area. This, he said, will enhance the productivity, information and education infrastructure of the residents of this once isolated community.

Lactao also said that to show the Army’s support to promote peace among the citizens, they undertook various activities in observance of the national peace consciousness month.

The activity was pinnacled by the peace gathering last September 21 in observance of the international day of peace. During that time, different sectors converged at Kiosko Kagawasan, Divisoria, Cagayan de Oro City and expressed their commitment to peace by joining in the lighting of peace candles. (PNA)

The K to 12 Basic Education

The implementation of K to 12 Basic Education Program has been met by different form of challenges even at the beginning. Adding two years in the Philippine’s basic education system was viewed as disadvantage for the students. Some people see it as an extended financial burden especially for the parents who are already struggling to support their children. Aside from this, students may lose their interest in studying.

However it is good to look at the bright side. K-12 program will improve the quality of education in the Philippines and will equip students with trainings that would qualify them for job. Its purpose is to provide the essential skills and abilities to prepare individuals for employment or higher education.

Furthermore, this curriculum addresses the gaps on general education programs, which currently cover material that could be learned at the pre-university level. This can result to more focused degree

programs among Higher Education Institutions. It is better rather than consuming so much of the first two years resolving the insufficient proficiencies of the old 10-year program.

Department of Education has long started preparing for the full implementation of K to 12. It has trained K to 12 teachers to address their anxieties of having new and additional responsibilities. Further, DepEd announced that it will be hiring more 39,000 teachers in 2016 to meet the number of learners.

Filipinos should look beyond and see the real potential of K to 12 in expanding opportunities of everybody. True, K-12 is clearly a work in development that will go through many changes as it is applied. However, people should consider these changes as an advantage because it will lead to an enhanced learning. It is very much important especially nowadays that even having a diploma is not an assurance of landing to a high paying job; it is when one is absorbed to right extent of experience.

2,000 mangrove seedlings planted in Pagadian P

AGADIAN City-Committed to treating our environment with love and utmost care, a group of 2 0 0 p e op l e f rom national government agencies, local government units, civil society organizations, and other well-meaning citizens participated on Friday in the mangrove tree planting activity here.

Some 2,000 mangrove seedlings were planted along the wetlands mangrove area in barangay White Beach.

The mangrove tree

planting is part of the lined up of activities for the celebration of Mindanao Week of Peace which runs from Nov. 26 to December 10.

Mons i g n or Fo e l an Echavez, Catholic convenor of Interfaith Forum for Solidarity and Peace (IFSP) also said the mangrove tree planting activity was “part of our massive wake-up call for everyone to protect and conserve our natural resources as an effective defense against the ill effects of climate change.” “ T he a c t iv it y i s a symbolic gesture of a

deeper commitment of our people to environmental protection,” he pointed out, adding “we take the keen interest not only in the cause of environmental protection, but also implement this ideal in action by encouraging the barangay officials and residents living in the area to take care of the planted mangrove seedlings.”

Meanwhile, City Councilor Cesar Dacal Jr. , w h o re pre s e nt e d Mayor Romeo Pulmones in his message said he was grateful to the IFSP for sp e arhe ading t he initiative saying “it does not only foster unity of all sectors of society, but it

also demonstrates a global concern for the protection of our environment.”

“We are stewards of the God’s creation. We care for the earth and act in ways that will restore and help protect the environment by planting mangrove trees,” Dacal urged.

As a gesture of support to the climate change mitigation and adaptation of the national government, Dacal disclosed that the Pulmones administration

had strictly implemented Republic Act 9003 ot h e r w i s e k n ow n a s “Solid Waste Management Ac t o f 2 0 0 1 ” w h e r e institutional mechanisms for proper treatment of waste and waste disposal were introduced to the 54 barangays such as segregation, transport, collections, disposal and recycling procedures.

constituents learned to appreciate its benefits,” he observed.

Troops seize Abu Sayyaf camp in Sulu Z A M B OA NG A C it y -Government forces have seized a camp of a top Abu Sayyaf leader early Thursday in the hinterlands of Sulu province, a top mi lit ar y of f icia l announced.

Brig. Gen. Alan Arrojado, Joint Task Group Sulu commander, said the camp was seized around 8:30 a.m. Thursday in Barangay Darayan, Patikul hours after they shelled

the encampment.

Arrojado said the camp seized by the troops from the Army’s 32nd Infantry Battalion belongs to the group of one-armed Abu Say yaf leader R adulan Sahiron.

Farmers intensify upland rice farming L I G AO C i t y, A l b a y - Arou n d 4 0 0 up l an d farmers from the Bicol region completed a training program in upland rice production during PhilRice Bicol’s Field Day and Regional Recognition Day, 19 November.

The farmers participated in the Upland Palayamanan Farmers Field School where they established a diversified farming system integrating upland rice, vegetables, and other crops.

Graduates came from the provinces of Albay, 70; Camarines Norte, 40; Camarines Sur, 198; Masbate, 30; and Sorsogon, 72.

The said training program aimed to strengthen cultivation of upland rice in the region. It adheres to the Upland Rice Development Program (URDP) in promoting sustainable farming systems and practices in upland communities.

Rub en B. Miranda, URDP program leader, encouraged the graduates to establish and strengthen cooperatives for upland farmers. This will allow them to avail government projects such as the farm mechanization program.

Miranda also challenged the farmers to produce quality organic upland rice that could cater to local or even international market.

Meanwhile, a review and planning workshop was

conducted on 20 November to assess impacts and map out sustainability plans of URDP in the Bicol region.

Coping with climate change The El Niño phenomenon persists in many parts of the country, including the provinces of Bicol. But many farmers remain resilient.

When typhoon Glenda struck in 2013, Bula river overflew and affected many rice fields.

“When we were losing our livelihood in lowland, we intensified upland farming for food self-sufficiency,” said Reynato A. Esteve, agricultural technician of Bula, Camarines Sur. While waiting for major crops to prosper, farmers of Barangay Lubgan in Bula cultivate root crops. Camote or sweet potato yielded the highest at 3 t/ha, enough to supply the local market.

Leonora N. Dotillos, one of the URDP graduates and also from Bula, practices diversified farming in her 2-ha farm. Succesive heavy rains and dry condition in the last few months affected her upland rice field.

Yet, the livelihood of the 67-year-old farmer easily recovered with vegetables and legumes that withstood adverse weather conditions.

Alameda assured that sanctions against erring personnel for gross misconduct will be issued, even as she said that there is no room for negligence in the BOC. Alameda though said that the first consignee, Acestar International Service Corp., could be a mere Forwarder International Consolidator and that Greenstone Resources Corporation is the real consignee, causing the shipment to pass through the MCT gate.

The BOC is tracking down seven containers full of sodium cyanide slipped out of the MCT by suspected syndicate group in cahoots with some BOC and port operator personnel.

Bure au of Customs Deputy Commissioner for Intelligence Jessie Dellosa has ordered the formation of a team of investigators who will be arriving to investigate the case.

Last October 26, Intelligence Officer II Alvin Enciso, acting chief of the CIIS, Port of Cagayan de Oro and MCT, requested for the issuance of an alert order for the seven containers of sodium cyanide after receiving derogatory information that the shipment, which arrived MCT on October 23, 2015, was devalued and with no pertinent documents from the Department of Environment and Natural Resources (DENR).

Immediately on the same day, Atty. Alameda issued the alert order against the shipment under the name of Acestar International Service Corporation as consignee with Bill of Lading (BL) No. APLU014021866, which arrived from Japan via Sima Sapphite V024.

However, on Tuesday, Enciso found out that despite the Alert Order on the shipment, the seven containers had been shipped out of the MCT. When checked, Enciso found out that the consignee has been changed to Greenstone Resources Corporation and the BL number has also been changed.

Enciso said there are only two circumstances when the consignee can be changed.

These are if the shipper went to the shipping lines and requested for the change, and if the shipper requested the change before the BOC and asked for amendment/s.

Enciso said both processes were not done in the case of the shipped-out seven containers.

Enciso also said the shipment managed to slip out of the MCT despite the fact that the container numbers,

which were alerted upon, remained the same.

Enciso said agents from the BOC, in coordination with the military, have been dispatched Wednesday night to track down the shipment.

If located, the BOC will immediately issue warrants for its seizure and detention based on two factors: Devaluation and lack of permission from the Environment Management Bureau of the DENR. Enciso said the shipment has been placed at P1.2 million, three times lower than its reference value and that the importation permit for the chemicals was issued

by DENR-Caraga, instead of Northern Mindanao’s, and had been dated April 21, 2015, and is good for 12 calendar months.

Enciso suspects the permit used in the clearance of the shipment has been recycled.

The National Bureau of Investigation has also been requested to investigate the case.

If found guilty, all the staff and personnel involved in the release of the shipment will be held accountable and graft and corruption charges will be filed against them with the Ombudsman. The consignee will also be charged with smuggling.

The new law also states that the application for probation based on the modified decision shall be filed in the trial court where the judgment of conviction imposing a non-probationable penalty was rendered, or in the trial court where such case has since been re-raffled.

“In a case involving several defendants where some have taken further appeal, the other defendants may apply for probation by submitting a written application and attaching thereto a certified true copy of the judgment of conviction,” it adds.

The trial court shall, upon receipt of the application filed, suspend the execution of the sentence imposed in the judgment.

“This notwithstanding, the accused shall lose the benefit of probation should he seek a review of the modified decision which already imposes a probationable penalty,” the new law states.

“Probation may be granted whether the sentence imposes a term of imprisonment or a fine only. The filing of application shall be deemed a waiver of the right to appeal,” it adds.

The new law amends the benefit of probation by disqualifying only those who have previously been convicted by final judgment of an offense punished by imprisonment of more than six months and one day.

It also states that the final discharge of the probationer “shall operate to restore to him all civil rights lost or suspended as a result of his conviction and to totally extinguish his criminal liability as to the offense for which probation was granted”.

The new law also considers Regional, Provincial, and City Probation Officers as persons in authority to administer oaths and acknowledgements and to take depositions in connection with their duties and functions under this Decree.

Further, it allows the appointment of Volunteer Probation Assistants (VPAs) to assist the Chief Probation and Parole Officers; and provides that the VPAs will hold office for a two-year term, which may be renewed or recalled anytime for a just cause.

The new law is a consolidation of Senate Bill No. 2280 and House Bill No. 4147 that was passed by the senators and lawmakers last September 15 and September 14, respectively.

Dujali and Carmen came in second and third to New Corella in the municipal category.

The national scorecards on health is rated based on achievement of the public health providers on 2016 NOH and 2006 national targets. Local government units who passed the 2016 NOH have high grades and those who fail the 2006 national targets got the lowest grade.

The president also said the Philippines has an “almost ideal environment” for solar panels due to the “excellent irradiation.”

Lenz added the Germanfirm will stay in the country and will defend its 55-percent market share -- even without a third round of the FiT subsidy, which are granted to renewable-energy projects that are completed within a certain deadline applicable for 20 years.

For Conergy’s portfolio of projects around the world, the Philippines ranks second -- only behind the United Kingdom in terms of capacity.

The firm is currently constructing an additional 219 MWs of solar projects for other companies, which are all targeted to make the cut for the Php 8.69 FiT by March 15, 2016.

If Conergy completes the projects in time, it will be the contractor that built 55-percent of the FiT granted solar farms at 274 MWs from the initial 500-MW targeted capacity. (PNA)
