LTFRB elated as RTMI donates 45-seater aircon bus to AFP

CAGAYAN de Oro City-The Land Transportation Franchising and Regulatory Board Regional Office 10 (LTFRB-10) was elated over the donation by a bus company of one airconditioned bus to the Armed Forces of the Philippines’ Forward Service Support Unit based in Cagayan de Oro City.

Rural Transit Mindanao Inc. (RTMI) has donated one 45-seater airconditioned bus to the 10th Forward Service Support Unit (10FSSU) based at the 4th Infantry Division (4ID), Camp Evangelista, Patag, Cagayan de Oro City.

First KMME summit in the region highlights MSME competitiveness

CAGAYAN DE ORO CITY -- The Department of Trade and Industry (DTI) Misamis Occidental in partnership with the Philippine Center for Entrepreneurship gathered mentee graduates from the 5 batches of Kapatid Mentor ME (KMME) program to gear them up for Micro, Small And Medium Enterprises (MSME) competitiveness during the KMME Summit held last December 5, 2019 at Royal Garden Hotel, Ozamiz City.

The summit was intended for the mentees to earn new learnings and insights to further improve their businesses and to build a great network and strong linkages.

CAGAYAN DE ORO CITY -- Department of Trade and Industry (DTI) Northern Mindanao awarded Local Government Units (LGUs) in Region 10 that made it to the top 20 in the 2018 Cities and Municipalities Competitiveness Index (CMCI) Survey.

DTI-10 Regional Director Linda Boniao gave the plaques and certificates during the 120th Regional Development Council (RDC)-X Full Council Meeting held last December 4, 2019, in Tangub City.

The CMCI is an annual ranking of Philippine cities and municipalities

developed by the National Competitiveness Council through the Regional Competitiveness Committees (RCCs) with the assistance of the United States Agency for International Development.

Cities or municipalities are ranked on their competitiveness in the four pillars: economic dynamism, government efficiency, infrastructure, and resiliency.

Scores are determined by the completeness of data and the values of the actual data submitted.

DAR chief lauds Pagadian support for housing program

PAGADIAN CITY, Zamboanga del Sur -- Department of Agrarian Reform (DAR) Sec. John Castriciones has lauded the city government for its support to the agency’s housing program for the farmers.

Castriciones, who visited this city Tuesday, said the support of the city government will significantly help DAR to uplift the livelihood of the farmers, especially those in the rural areas.

City Mayor Samuel Co announced that the city

government will allocate PHP40 million for the procurement of land in different barangays here to be given to farmers and other individuals, who are beneficiaries of programs similar to that of DAR. “So long as they qualify, they could apply for it and have it (the land),” Co said citing the lot will be given for free, but the house will be paid by the beneficiaryfarmer through affordable monthly amortization.

DAVAO CITY -- The Davao City’s Rescue 911 Urban Search and Rescue (USAR) and Bureau of Fire Protection-Search and Rescue Unit (BFP-SRU) has terminated its search and retrieval operation inside the collapsed Southern Trade commercial building in Padada, Davao del Sur, late Tuesday evening.

Engr. Luke Cadoyas, Padada Municipal Disaster Risk Reduction Management Office (MDRRMO) action officer, said their detection equipment indicated that there were no longer any signs of life inside the crumbled building.

“Also, there is no more claimant of any missing person,” he added.

On Monday (December 16) evening, rescuers retrieved the third body from the building that was later identified as Emily Gallegos Beloy, 31, and a resident of Mckinley, Sulop, Davao del Sur. Beloy was named in local media reports, who managed to send a text message to her relatives and friends at about 4 a.m. on Monday,

telling them she was with four other trapped shoppers inside the building.

On Monday morning, two bodies were retrieved from the rubbles of the three-story building, identified as Elsa Abanador Ababon, 57, of Tomas Claudio, NCO District, Padada and Evangeline Tarongoy Artiaga, 70, resident of Barangay Tanwalang, Sulop, Davao del Sur.

From the consolidated report of Davao del Sur Provincial Police Office (DSPPO), eight persons were confirmed dead due to the magnitude 6.9 earthquake on December 15.

In Matanao, the victims were identified as Cherbel Chime Makidato Gador, 6, Grade 1 pupil from Barangay Asinan, who was caught by the quake inside their house, and Juliana Donaire Cagas,

who was already bedridden and reportedly had a heart attack when the earthquake struck.

Fernando B. Balitayo, 63, a resident of Purok 3, Udaka, Barangay Dalawinon in Magsaysay, was reported dead also due to heart attack during the tremor.

Nuts & Bolts Tourism is leading other global sectors in advancing gender equality, offering women more opportunities for leadership roles JUST read a new study that revealed that tourism offers women more opportunities for leadership roles, has a larger female workforce and a smaller gender wage-gap.

The World Tourism Organization (UNWTO), in collaboration with UN Women, The German Society for International Cooperation (GIZ), World Bank Group and Amadeus, recently launched the second edition of the Global Report on Women in Tourism . The publication highlights the progress the global tourism sector has made in advancing gender equality, with key case studies and statistics gathered from around the world.

The report highlights that the majority of the tour-

ism workforce worldwide is female with 54% of people employed in tourism are women compared to 39% in the broader economy.

It also offers women more opportunities for leadership roles: 23% of tourism Ministers are female compared to 20.7% of Ministers overall.

The wage-gap is also smaller in the tourism sector with women in tourism earning 14.7% less than men compared to 16.8% in the broader economy.

The report also highlights how more and more women are challenging gender stereotypes in the sector.

In Morocco, for example, women have been issued tour guide licenses for the first time. An airline in the UK has doubled the number

of female pilots they employ and Uganda’s Hotel Owner’s Association is now lead by its first female CEO. The report acknowledges that technology has been a catalyst for empowerment, providing women with access to more training opportunities and stimulating female entrepreneurship through easier access to the tourism market. In the public sphere, policymakers are also waking up to the importance of gender equality in tourism and putting measures in place to ensure women fairly share the benefits that tourism can bring.

Speaking on the report’s findings UNWTO secretary general, Zurab Pololikashvili, said: “Tourism is lead-

ing the charge for female empowerment all over the world. Across the private and public sectors women are harnessing the potential of tourism to become financially independent, challenge stereotypes and start their own businesses.

“UNWTO is firmly committed to working towards UN Sustainable Development Goal 5 – the empowerment of women and girls – and ensuring that tourism continues to be at the forefront of gender-equality efforts,” he added.

WHILE all of us already experience what climate change is all about, delegates from developing countries have reacted angrily to what they see as attempts to block progress at the COP25 meeting in Madrid. Yes, I get already big problems remaining patient while watching live stream news from Madrid.

One negotiator told the BBC that the talks had failed to find agreement on a range of issues because of the blocking actions of some large emitters. Carlos Fuller from Belize said that Brazil, Saudi Arabia, India and China were “part of the problem”.

Other observers said there was a serious risk of failure at the talks.

Ministers from all over the world have arrived in Madrid for the high-end negotiations that will determine the final outcome of this conference. Despite a huge climate demonstration on the streets of the Spanish capital last Friday, hopes of an ambitious declaration

at COP25 have smacked straight into the realities of politics and entrenched positions.

I am afraid, also “Madrid” won’t help anymore. There’s an effort right now to block the words ‘climate urgency’ in text from Brazil and Saudi Arabia, saying we haven’t used these words before in the UN, so we can’t use them now,” said Jennifer Morgan, executive director of Greenpeace International.

“This gap between what’s happening on the outside and what’s happening in the science, and this ‘UN speak’ that won’t react and drive something is very frustrating.”

Homecoming

IT’S ALWAYS a happy occasion or, at least, one that is full of emotions. And even if we have mixed feelings about it, we would still look forward to a homecoming, since it reminds us of the past, of a sense of togetherness and shared experiences, of our origins. Homecomings are actually a necessity for us. Its immediate effect is undoubtedly one of joy and thanksgiving as we reconnect with familiar faces.

It brings back memories, insights, precious lessons learned, and many other things, happy and sad, that occurred between the past and the present. The road to the present, marked with lights and shadows, has given us a good, meaningful journey. Life may have led us to different and separate ways, but we are still together as one family, one

clan, one class.

And regardless of how our accounting of things turns out, whether it is in the black or in the red, a win or a loss in human terms, we would still be happy and thankful because what matters is that, once upon a time and in varying periods of time, we have lived with others who are close to us and with whom we have some intimate relations — our parents, brothers and sisters, relatives, classmates, teachers, friends, etc.

We can never fully account the value they have added to our life. We know by some mysterious ways that they have helped in shaping us the way we are today. We know that God is always in control of things and would know how to derive good even from evil.

And so, even if we have

experienced some negative things by the hands of others, we still know that with God everything will work out for the good.

We just have to make sure that our homecomings are not simply an exercise of nostalgia and mere sentimentalism. They, the homecomings, have a significance that is truly important to all of us. That’s because in the end, they remind us that we all come from God, our Father and Creator. He is the origin of our togetherness, the pattern, the power and also the end or purpose of our unity.

The homecomings are a good reminder that we are and should be together in our continuing journey toward our ultimate end who is God himself, who made us to be his image and likeness, and wants us

to share his very life. Yes, the homecomings remind us that we need each other, and that we are, with God, responsible for one another.

The homecomings are a good reminder that we need to help one another in this universally common journey of ours. They remind us that there is a continuum among the past, the present and the future, and eventually, eternity with God. PH scores big in 2nd Asean Mineral Awards

MANILA -- Three members of the Chamber of Mines of the Philippines (COMP) were adjudged winners at the recently concluded 2nd Asean Mineral Awards (AMA) held in Bangkok, a biennial event that recognizes mineral resource companies for achieving best practices in environmentally and socially sustainable operations.

Coral Bay Nickel Corporation, which operates a nickel processing plant in Rio Tuba, Bataraza, Palawan, emerged with the Best Practices award for the Philippines in the Metallic Mineral Processing category.

Rio Tuba Nickel Mining Corp, also in Bataraza, was named runner-up in the Metallic Mineral Mining category, while Agata Mining Ventures was also named runner-up in the Metallic Mineral Distribution category.

In the non-metallic category, LaFarge Holcim bagged runner-up awards in both the mining and processing categories.

The AMA is an initiative of the Asean mining ministers to recognize best practices in sustainable mineral mining, processing, and distribution among its various member countries.

The Awards, launched in 2017 in Myanmar, saw the Philippines garnering two of the three awards handed out, with Rio Tuba Nickel recognized for best mining practices and Oceana Gold Philippines, Inc. for the best plant. BSP releases new 20-Piso and enhanced 5-Piso coins

THE Bangko Sentral ng Pilipnas (BSP) released today the new 20-Piso and the enhanced 5-Piso coins which are the latest to be circulated under the BSP’s New Generation Currency (NGC) Coin Series.

The use of the 20-Piso coin—which is now the highest denomination in the NGC Coin Series launched in 2018—is more cost-efficient to produce as it will have a longer circulation life than a 20-piso banknote.

According to a study by the University of the Philippines, the 20-Piso banknote is the most-used denomination for payments across the country. As a result, it is easily rendered unfit for circulation and returned to the BSP for replacement.

The new 20-Piso NGC coin shall co-exist as legal tender with the currently-

circulating 20-Piso NGC banknote, which will be removed from circulation through natural attrition.

The new coin retains major elements of the 20-

piso banknote. The coin’s front side features Manuel L. Quezon, the first president of the Philippine Commonwealth who advocated the adoption of the national

language, created the National Economic Council, and worked ardently for Philippine independence.

Gacal said the new building is important for the Army, adding it was a way of thanking field commanders for “doing a good job.”

Davao City LGU gives incentives to plantilla workers

DAVAO CITY -- The City Government of Davao will be giving the financial benefits entitled to its plantilla employees starting Dec. 16.

Atty Zuleika Lopez, City Administrator said the benefits cover the Collective Negotiation Agreement which is P25,000, Productivity Performance Bonus amounting to P5,000 and the P10,000 Salary Incentive, mandated by the Office of the President.

She said the city government has already provided a budget for these benefits.

Pursue health program services by enlisting the support of concerned international, national and other local government agencies, civil society organizations, religious and other sectors; and Exercise the powers expressly granted and those necessarily implied therefrom which are appropriate or incidental for its efficient and effective policy formation and implementation of health programs and services.

SECTION 5. OPERATIVE PRINCIPLES. In the pursuance of this Code and the policies herein declared, the Provincial Government shall be guided by the following operative principles: Accountable, efficient, effective and dynamic organizational structure that will be primarily responsible in the formulation, implementation, monitoring and evaluation of all health programs and services in the province.

Adequate resource shall be provided in support of all provincial health programs, projects and activities to ensure quality health service delivery resulting to better health outcomes and opportunities.

Appropriate and relevant continuing capability building programs shall be provided to enhance the knowledge, attitude, skills and practices of health service providers.

Institutional and implementing mechanism and other applicable laws, rules and issuances shall be established to ensure efficient, effective and sustainable health programs implementation.

SECTION 6. OBJECTIVES. The objectives of the Code are the following:

To establish policies and mechanisms that will improve the preventive, curative and rehabilitative health care delivery systems in the province of Agusan del Sur;

SECTION 7. DEFINITION OF TERMS. As used in this Code, the following terms, phrases and acronyms shall be construed to mean as follows:

THE PROVINCIAL HEALTH CODE OF 2019

WHEREAS, Section 15, Article II, of the Philippine Constitution, provides: “the State shall protect and promote the right to health of the people and instill health consciousness among them”.

Basic Emergency Obstetric and Newborn Care (BEmONC) – are facilities capable of performing six signal obstetric functions, which include: (i) parenteral administration of oxytocin in the third stage of labor; (ii) parenteral administration of loading dose of anti-convulsants; (iii) parenteral administration of initial dose of antibiotics; (iv) performance of assisted deliveries; (v) removal of retained products of conception, and (vi) manual removal of retained placenta. BEmONC facilities are also capable of providing neonatal emergency interventions which include at the minimum (i) newborn resuscitation, (ii) treatment of neonatal sepsis/infection; and (iii) oxygen support. It shall also be capable of providing blood transfusion services on top of its standard functions.

WHEREAS, Section 16 of Republic Act 7160 provides: “the local government units shall ensure, among other things, the health and safety and preserve the comfort and convenience of their inhabitants”;

WHEREAS, Section 17 of Republic Act 7160, further provides: “Local government units shall endeavor to be self-reliant and shall continue exercising their powers and discharging the duties and functions currently vested upon them, and as such, they shall exercise the powers and discharge other functions and responsibilities as necessary, appropriate or incidental to efficient and effective provisions of the basic services and facilities such as social welfare and health services”;

WHEREAS, one of the eight-point programs of the Provincial Government of Agusan del Sur is Health and Sanitation which gives emphasis on programs geared towards attaining a common vision of accessible, affordable, equitable, sustainable and quality health care services for all Agusanons;

WHEREAS, the Province of Agusan del Sur subscribes and promotes the notion of “Malusog na Mamamayan, Matatag na Bayan” as a vital element in nation-building;

NOW THEREFORE, be it ordained by the Sangguniang Panlalawigan of Agusan del Sur in session assembled, that: CHAPTER I GENERAL PROVISIONS Article 1 Title and Scope

SECTION 1. TITLE. This Ordinance shall be known as the Provincial Health Code of Agusan del Sur of 2019, and shall hereinafter be referred and cited to as the “Code”.

SECTION 2. NATURE AND SCOPE. The Code provides policy direction in accordance with pertinent laws, rules and issuances relative to the implementation of health programs and services applicable to all barangays, municipalities and city.

SECTION 3. RULES OF INTERPRETATION. A. General Rules. All words and phrases shall be construed and understood according to the common and approved usage of the language; but technical words and phrases such others that may have acquired a peculiar and appropriate meaning in the law shall be construed and understood according to the peculiar and appropriate meaning.

B. Person. The word “person” shall extend and be applied to natural and juridical persons such as firms, corporations and voluntary associations, susceptible of rights and obligations or of being the subject of legal relations.

C. Shall and May. “Shall” is mandatory and “May” is permissive.

D. Gender and Number. Every word in the Code using masculine gender shall extend to both male and female. Every word using the singular number shall extend and apply to one person or thing, and the plural number shall extend and apply to several persons or things as well.

Article 2 Policy, Principles, Objectives and Definition of Terms

SECTION 4. GENERAL POLICY. It is hereby declared the policy of the Provincial Government to

Comprehensive Emergency Obstetric and Newborn Care(CEmONC) – are facilities which can perform the six signal obstetric functions of a BEmONC and in addition, perform caesarean section and provide blood banking and transfusion services along with other highly specialized obstetric services. It is also capable of providing the following neonatal emergency interventions, which include at the minimum: (i) newborn resuscitation, (ii) treatment of neonatal sepsis/infection, (iii) oxygen support for neonates, and (iv) management of low birth weight or premature newborn, along with other specialized neonatal services.

Civil Society Organizations (CSOs) – shall refer to groups of people who, among other things, are involved or undertaking health services and activities to include NGOs and POs.

Methods of Contraception - any device, substance or method that will space or limit childbearing when the desired family size is attain. Services provided consider medical safety, legal, and cultural acceptability. It also helps childless couple to have children.

Degenerative Diseases – refers to diseases brought about by the aging process which oftentimes include asthma, arthritis, osteoporosis, cardiovascular diseases, cancer, diabetes, chronic acute pulmonary diseases, Alzheimer’s disease, dementia, renal disease and cataract.

Non-Communicable Diseases - refer to diseases that are not contagious or transmissible.

Lifestyle Diseases – refers to diseases brought about by lifestyle (the way people live) such as hypertension, diabetes, cancer and the likes.

Dentist – refers to a person who is a holder of a valid certificate of registration and professional identification card in Dentistry who renders dental service within the meaning and intent of this law.

Dental Hygienist – refers to a person who is a holder of a valid certificate of registration and professional identification card and has undergone a two year course in dental hygiene from a government recognized school under a college of dentistry and passing the prescribed board examination for dental hygienist, renders oral health promotion and preventive measures, performs scaling and polishing, oral examination, taking brief clinical history, taking radiograph, and giving oral health education to patients under the supervision of a licensed dentist.

Dental Technologist – refers to a person who is a holder of a valid certificate of registration and professional identification card and who renders technical services such as mechanical construction of artificial denture and other oral devices under the supervision of a licensed dentist, and has finished a two year certificate course in dental technology from any government recognized school.

Departmentalized Services – hospital health care services generally divided into different specialties such as Pediatrics, Medicine, Obstetrics – Gynecology, Surgery, Dental Department, Ancillary Department(Pharmacy, Dietary, Radiology (Laboratory, X-ray, Ultrasound Diagnostic Test).

Depressed Area – an area where majority of its population do not meet the minimum basic needs and/or the income of the majority households in the area is below the poverty line as defined

by NEDA.

Difficult Area – A place where an increased amount of risk to life is encountered while travelling to such places, i.e. rough and rugged terrains and bodies of water, dangerous and steep trails.

Distressed Area – an area declared under state of calamity and/or emergency.

Environmental Clean-up – maintaining the cleanliness of the surroundings.

Hazard – the risk to the health and safety of public health workers.

Health–Related Establishment – health service facility or unit which performs health service delivery within an agency as an adjunct function. This applies to among others, clinics or medical departments of government corporate, medical corps and hospital of the Armed Forces of the Philippines (AFP), and specific health service section, division or bureau or any type of organizational subdivision of a government agency.

Health Services – shall refer to services provided to clients based on their health needs, which include the preventive, promotive, curative and rehabilitative services.

Health Services Providers – shall refer to (a) Institutional Health Service Providers which includes hospitals, clinics and other health facilities both public/private (b) Professional Health Service Providers which include the various medical and dental professionals and paramedical-professional and c) Community-based medically-trained volunteers.

Holiday – regular holidays and non-working days as mandated by law. (Book 1, Chapter 7, Administrative Code of 1987).

Hospital Networking – an organized system of government and private hospitals helping one another in rendering/providing services not available at their respective hospitals. This includes sharing of equipment, manpower, and other resources which follow certain referral procedure.

Hotspots – an area where two or more dengue cases arising in the same locality for 2 consecutive weeks.

Implementing Mechanism – a set of systematic approaches intended for a specific programs of action that will carry out the provisions of this code.

Job Rotation – a temporary assignment to a similar position in another geographic area or unit as a means to enrich professional experience as well as to avoid service interruption.

Linkages – collaboration, coordination and cooperation of health institutions and different government and non-government agencies on quality health care services. This include among others, financing, infrastructure and capability building.

Medico-Legal – relating to the law concerning medical questions.

City/Municipal Health Officer (CHO/MHO) – a mandatory position under the Local Government Code of 1991 who serves as the department head, in-charge of the preventive, promotive, and curative services of a certain city/municipality.

Vermin- small insects and animals (such as fleas or mice) that are sometimes harmful to plants other animals and that are difficult to get rid of or control.

Morning Shift – a duly authorized work rendered between 8:00 A.M. to 4:00 P.M. Afternoon Shift - a duly authorized work rendered between 4:00 P.M. to 12:00 M.N

Night Shift – a duly authorized work rendered between 12:00 MN. to 8:00 A.M.

On Call – the period during which the public health worker satisfies the agency’s requirement for him to remain on stand-by within the premises of specified place to be readily available to perform work on demand or to be deployed in work areas.

Overloading – a situation where a public health worker is given more than the accepted standard workload he can efficiently handle.

Overtime – a duly authorized work rendered beyond the regular scheduled normal hours work, such as work during the day beyond the 8 hours of work required from daily paid workers or work during the week beyond 40 hours of work required from paid workers.

Physiatrist – licensed medical practitioner who had undergone 3 years residency training in an accredited hospital in the field of Rehabilitation Medicine.

Post-Graduate Degree - the degree for graduate diploma, research degrees or doctorates or master graduates.

Potable Water/Safe Drinking Water - is a water that is free of microorganisms or diseases producing bacteria (pathogens). In addition, the water should not possess undesirable taste, odor, color, levels of radio activity, turbidity or chemicals and it should pass the standards of the Philippine National Standards for drinking water.

Preliminary Investigation – a fact-finding proceeding seeking to determine the existence of sufficient grounds to file normal administrative charges.

PGAS – shall refer to the Provincial Government of Agusan del Sur.

Public Health Workers (PHWs) – Persons engaged in public health and health related works.

These include employees/personnel in any of the following:

Any government entity mandated to deliver health services, dental clinics, operation of hospital, sanitaria, health infirmaries, health centers, barangay health centers, clinic or other institutional forms which perform health delivery functions, like clinical laboratories, treatment and rehabilitation center, x-ray facilities and other similar activities; and medical, dental and allied health professionals, as well as administrative and support personnel, regardless of their employment status in government.

Qualification Standard – a statement of minimum qualification for a position which includes education, experience, training, civil service eligibility and physical characteristics and personality traits required by the job.

Quality Immediate Care – standard health care given without delay to all patients.

Quality Obstetric Care – standard health care services rendered to women during pregnancy, labor, delivery, and post-partum period.

Radiology Services – X-ray examinations performed in aid of diagnosis and treatment of diseases.

Regulated Drugs – any regulated substance/narcotics other than intended for use in the prevention, diagnosis and treatment of diseases.

Rest Day – any day of the week when the employee is scheduled not to report to work provided the employee shall have rendered forty (40) hours work within a week.

Satisfactory Service – the performance of an employee achieving the desired target and meeting the standard set.

Sentinel area – site or place considered watch over for occurrence of any untoward health events and where surveillance/investigation is conducted.

Service Delivery Network – a network of health facilities, health providers and service organizations both public and private coming into an agreement to readily provide information, goods and services

Social Security – the protection against economic and social distress that is caused by the stoppage or substantial reduction of earnings resulting from sickness, maternity, employment, injury, disability and retirement.

Specially-Controlled Environment – a unit or section in the hospital where optimum set of conditions are always maintained to ensure appropriate quality care, e.g. operating room, pathologic nursery, Intensive Care Unit (ICU), etc.

State of Emergency – a sudden occurrence demanding immediate action which may be due to epidemic, natural or technological catastrophies, strife, or other man-made and/or natural causes.

Traditional and Alternative Health Care – the sum total of knowledge, skills and practices on health care, other than those embodied in biomedicine, used in the prevention, diagnosis and elimination of physical and mental disorder.

Understaffing – a situation where the staffing or personnel complement of a health or health related establishment is inadequate, failing to meet the acceptable standard ratio of manpower to patient/population, to wit :

Ward – an area where patients are placed or admitted.

Women of Reproductive Age – are women in the population between the ages 15-49 based on the World Health Organization (WHO) recommendation.

Work During Rest Day – a duly authorized work rendered during periods designated as regular rest day of the worker.

CHAPTER II PUBLIC HEALTH Article 1 Policy and Coverage

SECTION 8. POLICY. The Provincial Government, together with its component city and municipalities, shall adopt an integrated and comprehensive approach to public health development, thus, ensuring health and related social services available to all.

SECTION 9. COVERAGE. Public health services as contemplated in this Code shall constitute the following:

Food Sanitation. All activities and services related to providing food to the general public shall be in consonance with the provisions of Chapter III “Food Establishment” of the Code of Sanitation of the Philippines (P.D. 856) and its Implementing Rules and Regulations.

C.

Insect and Vermin Control. All activities related to insect and vermin control for food establishments, public and private buildings and other institutions including households shall comply with the provisions of Chapter XVI – “Vermin Control” of the Code on Sanitation of the Philippines (P.D. 856) and its Implementing Rules and Regulations; and

D.

Excreta and Sewage Disposal. All Households, institutions and buildings of abode shall have a sanitary toilet and sewage disposal facilities.

E.

Disposal of Cadavers. The Provincial Government of Agusan del Sur shall ensure that disposal of cadavers, operation of business and practice of trade related to the disposal of dead persons shall be in accordance with the provision of Chapter XXI of PD 856 – “Disposal of Dead Persons”.

SECTION 20. OCCUPATIONAL/INDUSTRIAL HEALTH SERVICES. All institutions, establishments and facilities shall ensure the health and welfare of their workers through a healthy, conducive, safe workplace in consonance with the provisions of “Industrial Hygiene” and “Occupational Health” of the Code on Sanitation of the Philippines (P.D. 856) and its Implementing Rules and Regulations.

Article 4 Disease Prevention and Control

SECTION 10. REPRODUCTIVE HEALTH. The Provincial Government shall adhere to the 12 Sexual and Reproductive Rights of clients adopted during the International Conference on Population and Development (ICPD) in Cairo, Egypt in 1994, such as the right to life; liberty and security of the person; equality and be free from all forms of discrimination; privacy; freedom of thought; information and education; choose whether or not marry and to find and plan a family; Decide whether or when to have children; health care and health protection; benefits of scientific progress; freedom of assembly and political participation; and be free from torture and ill-treatment.

SECTION 19. SOLID WASTE MANAGEMENT. All institutions, establishments and facilities shall strictly observe the provisions of Ecological Solid Waste Management, and those provided under the Environmental Code of the Province of Agusan del Sur.

The Reproductive Health Program shall consist of the following elements: A. Responsible Parenthood and Birth Spacing B. Maternal, Neonatal Child Health and Nutrition; C. Prevention and Control of Reproductive Tract Infections (RTIs), Sexually Transmitted Diseases (STDs) and Human Immunodeficiency Virus/Acquired Immune Deficiency Syndrome (HIV/AIDS); D. Prevention of Reproductive Tract Infection and Other Gynecological Problems; E. Prevention of Abortion and Management of its Complications; F. Education and counseling on Sexuality and Sexual Health; G. Adolescent Reproductive Health; H. Prevention and Management of Violence Against Women and Children; I. Men’s Reproductive Health and Involvement; and J. Prevention and Treatment of Infertility and Sexual Disorders.

SECTION 11. RESPONSIBLE PARENTHOOD AND BIRTH SPACING. The Provincial Government shall promote and maintain quality reproductive health services and to strive for self-sufficiency of service delivery.

SECTION 12. MATERNAL, NEONATAL, CHILD HEALTH AND NUTRITION. The Provincial Government shall provide accessible, available, affordable and appropriate Maternal, Neonatal, Child Health Care and Nutrition Programs and Services at all levels which may include the following: A. Implementation of an Integrated Maternal Neonatal and Child Health and Nutrition Strategy. The province-wide or city/municipal-wide health system shall be the basic unit for planning, organizing and implementing the Maternal, Neonatal, Child Health and Nutrition-Adolescents/other health program activities. The Provincial Health Office(PHO)shall advocate and promote the standards of a stable and mature service delivery network to local stakeholders. It shall also ensure that the standards are flexible enough to adapt to local conditions, and are appropriate to the local area and population.

B. Compulsory Basic Immunization Services For All Children. There shall be a compulsory basic immunization for children against certain diseases such as: (a) Bacille Calmette Guerin (BCG) Vaccination against tuberculosis; (b) Inoculation against diphtheria, tetanus, and pertussis (c) oral poliomyelitis immunization; (d) Protection against measles; (e) immunization against rubella; and (f) such other basic immunization services as provided in Republic Act 10152 and as mandated by the Department of Health.

C. Sexually Transmitted Diseases (STD) Human Immuno Deficiency Virus (HIV) Acquire Immuno Deficiency Syndrome (AIDS) Council shall be created at all levels to set the direction of STD/HIV/ AIDS-related programs/activities.

D. Safe Motherhood and Women’s Health. The Safe Motherhood and Women’s Health shall be facility based. All deliveries shall be attended by skilled birth attendants such as doctors, nurses and midwives only and they are responsible for the child’s birth registration. Traditional Birth Attendants shall be limited to supportive care services during ante-natal delivery and postpartum.

E. Prevention and Management of Abortion and its Complications (PMAC) through strict enforcement of pertinent laws prohibiting abortion and initiating public awareness on the untoward and risk effects of abortion.

F. Nutrition Program through the enforcement and implementation of Food Fortification, Salt Iodization, Micronutrients and Food Supplementation, Operation Timbang, Early Childhood Care and Development, Mother-Baby Friendly Initiative and the establishment of Health and Nutrition Post especially in remote areas.

G. Lactation stations in workplace shall also be established and encouraged lactating mothers to practice exclusive breastfeeding contributing to the reduction of infant/under five years old deaths as well as malnutrition.

H. Monitoring of the implementation of RA 8172 otherwise known as “An Act for Salt Iodization Nationwide (ASIN).” The province, through its health officers and nutritionists/dieticians, or in their absence through their sanitary inspectors, to check and monitor the quality of food-grade salt being sold in the market in order to ascertain that such salt is properly iodized.

SECTION 21. INFECTIOUS/COMMUNICABLE DISEASE CONTROL. The Provincial Government through the Provincial Health Office shall provide technical supervision over city/municipal health offices and government hospitals by establishing and providing guidelines and procedures on its prevention and control.

SECTION 22. NON-COMMUNICABLE DISEASEPREVENTION AND CONTROL. The Provincial Government shall support and implement the prevention and control programs and services on noncommunicable diseases.

Article 5 Other Programs and Special Services

SECTION 23. MEDICAL, DENTAL, AND SURGICAL OUTREACH PROGRAMS. The Provincial Government in partnership with the component LGUs shall ensure that funds are regularly appropriated in their respective annual budgets for the conduct of annual medical, dental and surgical outreach programs in the province especially for the people in Geographically Isolated Depressed Areas(GIDA) and those affected by natural and man-made calamities.

SECTION 24. QUARANTINE PROCEDURES FOR EMERGING/RE-EMERGING DISEASES. An individual identified or determined by the Department of Health (DOH) or by the Local Health Officials who is suffering from symptoms of Emerging/Re-emerging Diseases shall be required to undergo testing and be quarantined in a place designated by the DOH Regional Office.

SECTION 25. VOLUNTARY BLOOD SERVICES PROGRAM. The Provincial Government shall plan, implement and sustain voluntary blood donation program and services and to operate a Lead Blood Service Facility that collects, processes and conducts blood screening for transfusion including transmissible diseases pursuant to Republic Act No. 7719 otherwise known as the National Blood Services Act.

SECTION 26. PARTNERSHIP FOR COMMUNITY HEALTH DEVELOPMENT (PCHD)/PUBLIC AND PRIVATE. The provincial government shall ensure active partnership with the community for nation building and empowerment of the people toward self-reliance.

SECTION 27. CHILD-FRIENDLY MOVEMENT. A Child-Friendly Movement shall be initiated and established at all levels of government units to pursue the principles of the Convention on the Rights of the Child and the Convention on the Elimination of all Forms of Discrimination against Women and Children.

SECTION 28. MEDICO-LEGAL SERVICESAND EXAMINATIONS. All requests for Medico-Legal examinations of victims due to deliberate act or abusive behavior shall be provided with effective treatment, rehabilitation and after care in any health facilities. All Medico-Legal cases shall be attended to by the concerned City/Municipal Health Officer and other designated authorized health officer.

SECTION 29. PHARMACEUTICAL PROCESSING. A pharmaceutical processing/repacking may be established to ensure the availability of affordable and quality drugs and medicines.

SECTION 30. REGULATION IN THE USE, SALE, DISTRIBUTION AND ADVERTISEMENT OF CIGARETTES IN THE PROVINCE. It is the responsibility of the Provincial Government to regulate the use, sale, distribution and advertisement of cigarettes in accordance with Provincial Ordinance No. 69, Series of 2011, and other pertinent laws.

Article 6 Health Promotion

SECTION 31. HEALTH EDUCATION AND COUNSELING. The Provincial Government in coordination with the Department of Education and public and private institutions shall integrate health education and promotion activities.

SECTION 32. INFORMATION, EDUCATION AND COMMUNICATION (IEC) CAMPAIGN. Userfriendly and culture-sensitive IEC materials shall be made available to enhance the promotion of health programs and activities to stakeholders.

Article 7 Epidemiology and Surveillance

SECTION 33. EPIDEMIOLOGY AND SURVEILLANCE. The Provincial Government with multisectoral participation shall set priorities, plan programs and take actions to promote and protect the health of the people on the basis of epidemiology analysis and results of health surveillance in accordance with existing laws.

SECTION 34. MECHANISMS. The established mechanisms for epidemiology and surveillance purposes shall be based on DOH policies, guidelines and protocol which shall be sustained and regularly updated.

SECTION 13. ADOLESCENT/YOUTH REPRODUCTIVE HEALTH. The Provincial Government shall provide adolescent reproductive health services that are youth-friendly and accessible in Teen Centers established in Health Facilities and School Institutions (public/private).

SECTION 14. VIOLENCE AGAINST WOMEN AND THEIR CHILDREN (VAWC). As far as applicable, VAWC survivors shall be provided with Medico-Legal Examination; Pre-natal, natal and post-natal services; Emergency Care/Treatment; and Psychosocial Intervention in coordination with the Provincial Social Welfare and Development Office (PSWDO).

SECTION 15. MALE REPRODUCTIVE HEALTH. male reproductive health programs and services.

SECTION 16. DENTAL HEALTH CARE PROGRAMS. The Provincial Government shall provide dental health care programs and services and shall also enforce the provision prescribed under Republic Act No. 9484 otherwise known as Illegal Dental Practice Act. In collaboration with the Philippine National Police, National Bureau of Investigation and other law enforcement agencies and the Philippine Dental Association, AgusanDel Sur Chapter, LGUs are to conduct routine checks on illegal practice of the dentistry profession in their respective areas of jurisdiction.

Article 3 Environmental, Industrial and Occupational Health

SECTION 17. ENVIRONMENTAL SANITATION. The local Government Units shall enforce the pertinent provisions of the Sanitation Code of the Philippines (P.D. No. 856) and its Implementing Rules and Regulations.

SECTION 18. PROGRAMS AND SERVICES. The Environmental Sanitation Programs and Services shall be focused, among others, on:

A. Water Supply Sanitation. The Provincial government shall promote safe and potable drinking water.

CHAPTER III HOSPITAL CARE SERVICES (Curative) Article 1 Policy and Scope

SECTION 35. POLICY. Pursuant to its mandate, the Provincial Government shall ensure delivery of quality preventive, curative and rehabilitative health services for its constituents.

SECTION 36. SCOPE. The curative health services shall consist of the different scientific treatment modalities to include Medicine, Pediatrics, Obstetrics, Gynecology, and Surgery among others.

Article 2 Hospital Services

SECTION 37. HOSPITALS. Hospitals shall be the principal implementers of curative services appropriate to the level of care. They shall have a system that will develop an effective network of facilities which are available, accessible, acceptable and affordable.

SECTION 38. CLASSIFICATION OF HOSPITAL. Hospitals shall be classified according to:

A. Nature of Ownership 1.

S. Spiritual Guidance and Counseling Services shall facilitate services for the spiritual and emotional needs of patients.

T. Morgue/Cadaver Holding Services shall have an organized system that will facilitate storage and safekeeping of cadaver in accordance with existing laws;

U. Transport Services shall have an organized system that will facilitate transport of patients for referrals and further treatment and management;

V. Billing and Cashiering Services shall have an organized system in billing and collection of all hospital charges.

SECTION 41. HOSPITAL COMMITEES AND FUNCTIONS. Hospitals shall ensure quality patient care and transparency of services, through the following committees;

a. Non-departmentalized hospital which provides clinical care and management on the prevalent disease in the locality.

A. Quality Assurance Program Committee shall be responsible in giving quality medical and nursing care standards including research and development activities;

b. Clinical services which include general medicine, pediatric, obstetric, and gynecology, surgery and anesthesia;

B. Hospital Waste Management Committee shall be responsible in the planning and implementing proper storage, collection, transport and disposal of hospital wastes;

c. Provision for appropriate administrative and ancillary services (clinical laboratory, radiology, pharmacy); and

C. Nursing Audit Committee shall be responsible in the analysis and evaluation of nursing performance, nursing records and physical facilities for the improvement of patient care;

d. Provision for nursing care for patient who require intermediate, moderate and partial category of supervised care for 24 hours or longer.

D. Therapeutic Committee shall be responsible in ensuring the rational use of drugs medicines, its monitoring and evaluation and recommend the same for procurement;

E. Infection Control Committee shall be responsible in assuring that all patients and staff are protected from infections acquired in the hospital;

2. Second Level Referral Hospital:

a. Departmentalized hospital which provides clinical care and management on the prevalent disease in the locality, as particular forms of treatment, surgical procedure and intensive care.

b. Clinical services as provided in the first level of referral hospital, as well as specialty clinical care;

F. Blood Transfusion Committee shall be responsible primarily for the establishment of hospital policies and guidelines for Blood Transfusion Therapy, monitoring and rational use of blood and blood products within the facility in accordance with the prescribed standards;

c. Provision for appropriate and administrative and ancillary services (clinical laboratory, radiology, pharmacy); and

G. Medical Audit Committee shall be responsible in the analysis and evaluation of medical performance, medical records, morbidity and mortality for the improvement of patient care;

d. Nursing care as provided in the first level referral hospital as well as total and intensive skilled care.

H. Grievance Committee shall be responsible in resolving problem and/or conflict at all levels within the organization that may hamper public service;

3. Third Level Referral Hospital: a. Teaching and training hospital which provide clinical care and management on the prevalent disease in the locality, as well as specialized and sub-specialized forms of treatment, surgical procedure and intensive care;

I. Operating and Delivery Room Committee shall be responsible establishing the standards and procedures in the use of OR/DR; and

J. Medical Records Committee shall be responsible in prescribing procedures in safekeeping, safeguarding and storing of patients health records and Dental Records.

b. Clinical services as provided in the second level referral hospital as well as sub-specialty clinical care;

K. Credentialing and Privileging Committee shall be responsible in evaluating the application and credentials of specialist and etc., applying to practice in the hospital.

c. Provision for appropriate administrative and ancillary services (clinical laboratory, radiology, pharmacy); and nursing care as provided in the second level referral hospital, as well as continuous and highly specialized clinical care;

L. Service Delivery Network (SDN) Committee shall be responsible in collaborating with other networks of health facilities and providers within or outside of the province offering care packages of health care services in an integrated and coordinated manner.

SECTION 39. HOSPITAL OPERATIONAL SERVICES. The hospital operational services: A. Administrative Services. The hospital administrative services shall execute policies and directions promulgated by the hospital governing body and discharge support services in the area of finance, personnel, materials and property, housekeeping, laundry, security, transport, engineering, and maintenance.

M. Ethics Committee shall be established and assigned in the Provincial Health Office (PHO) in the Province of Agusan del Sur to consider, debate, study, take action, or report on ethical issue that arise in patient care.

B. Medical/Ancillary Services. The Medical/Ancillary Services shall render effective and efficient medical services to In and Outpatient through a competent and organized medical and ancillary staff;

C. Nursing Services. The Nursing Services shall provide quality nursing care and management to meet the needs of the patients in close coordination with the Medical/Ancillary and Administrative Services.

SECTION 40. HOSPITAL GENERAL SERVICES. All government hospitals in the province of Agusan del Sur shall provide the following services. Other services based on new arrangement, requirements shall also be included.

A. Emergency Care Services shall be managed by competent personnel equipped with adequate facilities to attend to patients with life-threatening condition. 24 hours a day to provide immediate care and treatment.

B. Admission Care Services shall be responsible for admitting and providing initial care and appropriate treatment to all patients when necessary.

C. Ward Services shall provide quality care for all admitted patients in the hospital to include Ward Work , Nursing Rounds , Doctors Rounds, Endorsement, Medication, Treatment, General Grand Rounds, Recording/ Reporting, Nursing Care, Mortality/Morbidity, Conferences and Discharges; Health Education.

D. Out-patient Department Services shall provide ambulatory care and other hospital-based preventive health care services;

E. Operating Room Services shall continuously provide a specially-controlled environment necessary for the performance of surgery in the treatment of illness and injury to include Pre-operative care, Intra-operative care, major and minor emergency and elective surgeries;

SECTION 42. SPECIAL PROGRAMS. The Hospitals may also implement the following special programs and similar imports: Mother-Baby Friendly Initiative, Immunization, Family Planning, Cardiovascular Disease (CVD), Anti-Rabies, Lifestyle Modification and Primary Health Care, Voluntary Blood Donation/Services 24 hours a day, Customer Satisfaction, Impact Studies/Research, Human Resource Development(HRD), Geriatric Services, Psychiatric Services and other programs required and deemed necessary.

SECTION 43. HOSPITAL MANAGEMENT INFORMATION SYSTEM. The Hospital shall have an established and regularly maintained system in collecting, analyzing and recording data relevant to hospital management and services. It shall include Hospital Statistical Report, Surveillance Report, International Classification of Disease-10 (ICD-10) Computerized Record, in and out patients’ record, circulars, special orders, memorandum and Mortality/ Morbidity Review and others Article 3 NON-HOSPITAL CURATIVE FACILITIES

SECTION 44. FACILITIES. The Non-hospital curative facilities shall include Health Centers, Clinics, Barangay Health Stations and other similar facilities such as:

A. Infirmaries shall provide emergency treatment and limited care (confinement of not less than 24 hours but not more than 72hours) for sick and injured person , as well as clinical care and management of normal delivery babies;

B. Birthing Homes shall provide maternity services during prenatal delivery and post natal care including newborn care .

D. Psychiatric Care Facilities shall provide consultative medical, nursing, pharmacological and psychosocial treatment for mentally-ill patient;

E. Custodial Psychiatric Care Facilities shall provide long-term care including basic human services such as food and shelter to chronic mentally-ill patients.

SECTION 45. SERVICES. The non-hospital curative services shall include the following:

F. Labor and Delivery Room Services shall provide quality obstetric care to all pregnant women, early breastfeeding practice/latch on;

A. General Medicine Services – consultation, treatment of minor illness and normal spontaneous delivery;

G. Neonatal Care Services – shall provide quality neonatal care to all newborn including conduct of newborn screening, hearing test, exclusive breastfeeding and others.

B. Surgical Services – minor surgeries and dressing of wounds;

H. A separate breastfeeding room can be established for promotion/demonstration and counseling in every hospital/clinic and working institutions;

C. Laboratory Services – malarial smear, pap smear collection, ECG, Urinalysis, stool examination, sputum examination, blood typing complete blood count seminal fluid examination, blood chemistry, HIV test, rapid dengue test, among others

I. Laboratory Services shall conduct examination and analysis of all sample of human tissues, fluid, secretion, excretions, and other material to determine the presence of pathologic and pathogenic organism that will aid in confirming clinical impression, establish diagnosis and subsequent treatment of disease;

D. Dental Services – tooth extraction and treatment of simple dental related diseases;

E. Pharmacy/Dispensing Services – dispensing of essential drugs; and

F. Quick Response Team (QRT) - provide immediate health care services to those affected by calamities, violence, disaster and other emergencies in coordination with the Provincial Disaster Risk Reduction and Management Council.

J. Radiology/Imaging Services shall perform X-ray and imaging examination that will aid in the diagnosis and treatment of disease;

K. Dietary Services shall provide food and dietary requirements for the patients including dietary counseling and instructions;

Article 4 Patient’s Rights, Duties and Obligations

L. Medical Social Services shall assess and categorize all patients seeking consultation and admission as to their economic status for billing purposes and counseling;

SECTION 46. HOSPITAL PATIENTS’ RIGHTS. The patients shall have the following rights regardless of his ability to pay or type of health plan coverage:

M. Dental Services shall render professional dental care and management and Dental Education;

N. Medical Record Services shall classify, analyze, codify, file and safeguard charts and records of patients, with privacy and confidentiality;

O. Linen and Laundry Services shall determine the utilization, processing, costing and attrition of linen according to standards. It shall further provide adequate and continuous supply of linen required for patient care and office needs in hospital units;

P. Housekeeping Services shall provide for upkeep, maintenance and cleanliness of hospital premises and facilities. This also includes disinfection of identified hospital area and ensure proper waste management

Q. Pharmacy Services shall ensure continuous supply of affordable drugs , medicines and IV

bance to other patients and interfere with established medical procedures;

L. Right to communication support;

M. Right to access protection services; and

N. Right to billing explanation.

SECTION 47. PATIENTS’ DUTIES AND OBLIGATIONS. The patients shall have following duties and obligations:

A. Abide by the rules and obligations/regulations of the hospital; B. Respect and cooperate with health workers; C. Help maintain cleanliness and orderliness D. Participate in any primary health care activities in the hospital; E. Pay hospital bills; F. Handle with care all the hospital equipment; G. Comply with PhilHealth requirements upon admission; and H. Comply with prescribed home treatments and follow up upon discharge.

CHAPTER IV MAGNA CARTA FOR PUBLIC HEALTH WORKERS, ITS COVERAGE AND IMPLEMENTATION Article 1 Magna Carta For Public Health Workers

SECTION 48. OBJECTIVES. The Provincial Government in consonance with Republic Act No. 7305, otherwise known as the Magna Carta for Public Health Workers shall:

A. Promote and improve the social and economic well-being of health workers, their living and health conditions and terms of employment thereby encouraging especially those with proper qualifications and excellent abilities to join and remain in government service.

B. Develop their skills and capabilities in order to be more responsive and equipped to deliver health projects and programs; and

SECTION 49. COVERAGE. The provisions of this chapter shall apply to all public health workers in the province of Agusan del Sur as enumerated in the RA 7305.

SECTION 50. IMPLEMENTATION OF MAGNA CARTA. There shall be an appropriation for the full implementation of the Magna Carta of Public Health Workers (Republic Act 7305) in the province and in the respective budgets of the component LGUs of Agusan del Sur Article 2 Staffing Requirements

SECTION 51. PERSONNEL COMPLEMENT. The Provincial Human Resource and Management Office (PHRMO) in coordination with the heads of hospitals shall conduct a periodic review of the personnel complement of its health institutions to determine the adequacy of staffing and workload of each public health worker taking into consideration the nature and scope of services, targets and position description functions. The PHRMO shall submit its review findings and recommendations to the Provincial Governor.

SECTION 62. SALARIES. The salaries for the public health workers shall be in accordance with the existing salary standardization schedule and other relevant provisions of the law, and guidelines.

SECTION 63. HIGHEST BASIC SALARY UPONCOMPULSORY RETIREMENT. Three (3) months prior to the compulsory retirement, the public health worker shall automatically be granted one (1) salary range or grade higher than his present salary and computed on the basis of his highest salary: Provided, that he has reached the mandatory retirement age and fulfilled service requirements under existing laws.

SECTION 64. ADDITIONAL COMPENSATION. Public Health Workers in the province shall receive hazard, subsistence, laundry, remote assignment, longevity, and other allowances. Further, a Public Health Worker shall be entitled to a Salary Step Increment for Completion of a Post Graduate Degree as provided for in R.A. No. 7305.

SECTION 65. MEDICO-LEGAL HONORARIUM. Municipal/City Health Officers, Rural Health Physicians, Medical Officers and Medical Specialists who are required to render medico-legal services shall be entitled to honorarium in accordance with existing laws, rules and regulations.

SECTION 66. ANNUAL MEDICAL AND DENTAL EXAMINATION. Public health workers shall avail of compulsory annual medical and dental examination to be subsidized by the Local Government Units concerned.

SECTION 67. LEAVE BENEFITS FOR PUBLIC HEALTH WORKERS. Public health workers are entitled to all applicable leave benefits as provided under existing laws and prevailing practices.

SECTION 68. COMPENSATION FOR INJURIES. Public health workers shall be protected against the consequences of employment injuries in accordance with existing laws.

SECTION 69. HEALTH INSURANCE BENEFITS FOR VOLUNTEER COMMUNITY HEALTH WORKERS. The Local Government Units shall provide health insurance benefits in coordination with other national agencies supporting the National Health Insurance Program. Honorarium can be provided based on LGU approved policies/guidelines.

SECTION 70. INCENTIVE TO TRADITIONAL BIRTH ATTENDANTS (TBAs). Traditional Birth Attendants (TBAs) who assist pregnant women during delivery at birthing clinic or hospital, shall be given an incentive based on LGU approved policies/guidelines.

SECTION 71. GRANTING FINANCIAL ASSISTANCE. The Provincial Government shall grant financial assistance -to all qualified Barangay Health Workers (BHWs) who have reached the age of 65 years old at the time of retirement and/or has rendered at least thirty (30) years of voluntary service in pursuant to Provincial Ordinance No.13-2004.

SECTION72. LIVING QUARTER. All public health workers who are on duty and those who, because of unavoidable circumstances are forced to stay in the hospital, sanitaria or health infirmary premises, shall be entitled to free living quarters within the hospital, sanitarium or health infirmary.

SECTION 73. BENEFITCLAIMS. Wherever other laws provide for the same benefits covered by this Code, the public health worker shall have the option to choose which benefits shall be paid to him.

Article 7 Transfer or Geographical Reassignment of Public Health Workers

SECTION 52. STANDARD RATIO. The standard ratio of health staff to patient/client population load shall be observed so as to prevent overloading or understaffing and enable the health staff to render quality health care subject to availability of funds.

SECTION 74. TRANSFERS. A transfer is a movement from one position to another which is an equivalent rank, level of salary, without break in service which requires the issuance of an appointment.

SECTION 53. AFFILIATION. Affiliation of health students and apprentices shall be allowed only for purposes of training and education in accordance with the Local Revenue Code of Agusan del Sur.

SECTION 75. GEOGRAPHICAL REASSIGNMENT. A geographical reassignment is a movement from one geographical location to another in the same agency. All reassignment shall be made in the interest of public service. However, employees who believe otherwise may appeal the case to the Civil Service Commission. Provided, that such reassignment shall not involve a reduction in rank, status, or salary and that no reassignment whatsoever shall be made three (3) months before any local or national elections. All expenses incidental to the transfer and/or reassignment of the public health worker and his immediate family shall be paid by the agency concerned.

Article 3 Recruitment and Qualification

SECTION 54. RECRUITMENT AND SELECTION. Recruitment and selection of public health workers shall be in accordance with the policies and standards set forth by the Recruitment, Selection and Placement Committee of the Provincial Government of Agusan del Sur and the Civil Service Commission and the provisions of Republic Act 7160, otherwise known as the Local Government Code of 1991.

Article 4 Public Health Worker’s Rights, Duties and Obligations

SECTION 55. RIGHTS. A Public Health Worker has the right to:

A. Avail of competency-based learning and development intervention;

B. Equal opportunities in the practice of profession or employment regardless of sex, civil status, religion, political affiliation, dialect and ethnic group; E. Due process of law, to defend and to be defended by a representative of choice and/or by organization with adequate time to be given for the preparation of defense;

F. Appeal to designated authorities;

G. Self-organization;

H. Freedom from interference and coercion in the performance of duties and responsibilities;

I. Receive all remunerations as stipulated by law;

J. Safe and comfortable workplace; and

K. Recognition/Award for exemplary performance/contribution to the health system.

SECTION 56. DUTIES AND RESPONSIBILITIES. The public health worker shall have the following duties and responsibilities:

A. Discharge his duty humanely with conscience and dignity; B. Perform his duty with utmost respect for life; and C. Exercise his functions without consideration to race, gender, religion, nationality, party politics, social standing, or capacity to pay.

SECTION 57. PRIVATE PRACTICE OF PROFESSION. A Public Health Worker shall be allowed to practice his profession during off-duty provided that he is authorized by proper authorities and ON CALL status to respond to urgent or immediate needs for health/medical/dental assistance or relief work during emergencies such that he cannot devote the time for his own interest.

SECTION 58. ADMINISTRATIVE/DISCIPLINARY ACTIONS. Administrative/Disciplinary charges against any public health worker shall be heard by the Ethics Committee created for the purpose. The preliminary and formal investigation of administrative charges shall be in accordance with the Civil Service Law, Rules and Regulations.

Article 5 Hours of Work

SECTON 59. NORMAL HOURS OF WORK. A public health worker in the Province shall render the required number of hours of work. A normal number of hours of work shall not be less than eight (8) hours a day nor more than forty (40) hours a week.

SECTION 60. SHIFTING HOURS

A. Morning Shift-shall be rendered between 8:00 A. M to 4:00 P.M B. Afternoon Shift- shall be rendered between 4:00 P.M to 12:00 M.N C. Night Shift-shall be rendered between 12:00 M.N to 8:00 A.M

SECTION 61. OVERTIME WORK FOR HOSPITAL/PUBLIC HEALTH SERVICES. In the exigencies of the service, any public health worker may render service beyond the normal eight (8) hours but not more than twenty four (24) hours a day. In such cases, the worker shall be paid an additional compensation in accordance with existing laws and prevailing practices.

SECTION 76. MARRIED PUBLIC HEALTH WORKERS. Whenever possible, the proper authorities shall take steps to allow married couples, both of whom are public health workers, to be employed or assigned as much as possible in the same locality but not in the same office.

Article 8 Human Resource Development and Management for Health

Section 77. HEALTH HUMAN RESOURCE DEVELOPMENT/MANAGEMENT STUDY. The province, city and municipalities shall conduct annual health human resource development management study and review from the effectivity of this Code.

Section 78. Recruitment, Selection, Placement and promotion – Recruitment and selection of public health workers shall be in accordance with the policies and standards set forth by the Civil Service Commission.

Section 79. Learning and Development. Within six (6) months from the effectivity of this code, the Provincial Government shall develop a career and personnel development plan for public health workers of the Province which include provisions for merit promotion, performance evaluation, inservice training grants, job rotation. Suggestions and incentive award system taking into consideration the professional advancement of each employee.

A. CONTINUING EDUCATION. All Local Government Units shall encourage qualified public health workers to pursue continuing education directly related to their respective functions by providing full compensation and benefits while on their duration of studies;

B. POST-GRADUATE STUDIES. Qualified public health workers shall be provided with the opportunities towards professional growth and development through the availment of postgraduate studies as provided for in section 34 (B) of Republic Act No. 7305; and

C. BENEFICIARIES OF STUDY GRANTS. In case of a beneficiary of government study grant, the public health worker shall be required to render the corresponding service before considering voluntary separation in pursuance to existing national and local guidelines.

SECTION 80. Performance Management and Evaluation. There shall be an established performance evaluation system appropriate for public health workers that shall consider among all others the improvement of the employee’s efficiency and organizational effectiveness.

CHAPTER V SPECIAL EVENTS AND DAYS OF ACTION Article 1 Purpose

SECTION 81. SPECIAL EVENTS AND DAYS OF ACTION. The Provincial Government shall observe/commemorate special events and days of action in coordination with all local health offices, concerned government agencies and Civil Society Organization’s, to raise the level of health awareness among Agusanons, increase service usage, promote and maintain a healthy and happy lifestyle and develop civic-consciousness among various sectors.

SECTION 82OTHER CELEBRATIONS. Other days/events not provided herein shall be observed subject to existing laws, rules and regulations.

Article 2 January Event and Days of Action

SECTION 83. CANCER CONSCIOUSNESS WEEK. SECTION 110 NATIONAL VOLUNTARY BLOOD SERVICES MONTH. Pursuant to RA 7719, series of 1994, The National Voluntary Blood Services Month shall be observed every month of July to promote voluntary blood donation among the citizenry and instill public consciousness on the principle that blood donation is a humanitarian act.

SECTION 87. DENTAL HEALTH WEEK. Pursuant to Proclamation Number 559 series of 2004, the Provincial Government through the Provincial Health Office in coordination with the Philippine Dental Association, Agusan Del Sur Chapter, celebrates the Dental Health Month every month of February to intensify the dental health program as well as serve as an opportune time for dentists to stress that oral health is an essential contributor to the attainment of a quality of life. Yearly medical missions, Dental Education and adopt school activities that will enhance and solve dental issues and concerns.

SECTION 111. PNEUMONIA AWARENESS WEEK. The Pneumonia Awareness Month shall be observed every third week of July pursuant to Department Circular No. 178, series of 1994 to focus on creating awareness among mothers and health workers on the early signs of Pneumonia and acting on its by referring to the nearest health facility.

SECTION 88. LUPUS ADVOCACY WEEK. Pursuant to Proclamation No. 1435, Series of 2007, the Lupus Advocacy Week shall be observed every First Week of February of every year.

SECTION 112. NATIONAL DISABILITY PREVENTION AND REHABILITATION. Disabled Persons, PD 1879 and Department Circular No. 247, series of 1997, to show society’s concern for people with disabilities and identify and prevent environment factors that cause or complicate disability.

SECTION 89. LEPROSY CONTROL WEEK. Pursuant to Proclamation No. 467, Series of 1965, the Leprosy Control Week shall be observed every last week of February of every year as Leprosy Control Week.

SECTION 113. NATIONAL DIABETES AWARENESS/REHABILITATION WEEK. Pursuant to RA No.8191-1996, The National Diabetes Awareness Week shall be observed every fourth week of July to promote awareness on diabetes preventions and its deadly complications such as heart attack, stroke, kidney failure, impotence and blindness and the awareness of diabetes is compounded today by an emerging consumer society and a sedentary lifestyle.

SECTION 90. RABIES AWARENESS MONTH. Pursuant to Executive Order No. 84, Series of 1999, the Rabies Awareness Month shall be observed every March which aims to reduce if not totally eliminate the incidence of rabies. A massive information drive on rabies prevention shall be conducted year round complemented by mass castration, ovariohysterectomy and immunization of dogs to be spearheaded by the Provincial Veterinary Office in collaboration with the Provincial Agriculture Office.

SECTION 114. FAMILY PLANNING DAY. The Family Planning Day shall be observed every first day of August pursuant to Executive Order No. 307 and Presidential Proclamation No. 429, series of 1994. To create awareness on the benefits of Family Planning and Responsible Parenthood as means to improve the quality of life and the standard of living of every Filipino Family.

SECTION 91. BURN PREVENTION AND FIRE SAFETY MONTH. Pursuant to Department of Health (DOH) Memorandum No. 29, series of 2000, the Burn Prevention and Fire Safety Month shall be observed every March to embark on the different activities for the prevention of loss of life and property due to fire.

SECTION 92. NATIONAL WOMEN’S DAY. Pursuant to Republic Act 6949, Series of 1990, March 8 of every year is declared as National Women’s Day. CHAPTER V Article 5 April Special Events and Days of Action

SECTION 93. MIDWIFERY WEEK. The Midwifery Week shall be observed in the first week of April pursuant to Proclamation No. 1275-1974 to sustain the interest of midwives and in delivering quality care and meeting the needs of less privileged women and children of the province.

SECTION 94. HEALTH RESEARCH CONSCIOUSNESS WEEK. Pursuant to Administrative Order No. 104-A dated April 8, 1991 and Department Circular No. 9, series of 1996, the Health Research Consciousness Week shall be observed every first week of April to conduct research related activities such as seminars, symposia, essay writing or slogan contests by enlisting the participation of NGOs, GOs, and academic and research institutions and all LGUs of the province.

SECTION 95. GARANTISADONG PAMBATA WEEK (ROUND 1). Pursuant to DOH Circular No, 209, s. 1997, the Garantisadong Pambata Week (Round 1) shall be observed every third week of April to provide a package of health services to all 0-5 years old children in the province aimed and reducing child morbidity and mortality.

SECTION 96. WORLD HEALTH DAY. The World Health Day shall be observed every seventh day of April per WHO declaration as a reminder of the significant challenges that exist in promoting global health.

SECTION 97. WORLD MALARIA DAY. The World Malaria Day shall be observed every 25th day of April.

Article 6 May Special Events and Days of Action

SECTION 98. SAFE MOTHERHOOD WEEK. The Safe Motherhood Week shall be observed during the second week of May pursuant to Administrative Order No. 79 series of 2000 to increase the awareness of women of reproductive age group (15-49 years old) on the risk factors of pregnancy and birth delivery.

SECTION 99. CERVICAL CANCER CONSCIOUSNESS MONTH. Pursuant to Proclamation No. 368, Series of 2003, the Cervical Cancer Consciousness Month shall be observed every month of May under the auspices of the Philippine Obstetrical and Gynecological Society (Foundation), Inc., with the support of the Department of Health.

SECTION 100. NATIONAL HYPERTENSION AWARENESS MONTH. Month of May of every year is hereby declared as the National Hypertension Awareness Month per Proclamation No. 1761, Series of 2009. All government and non-government agencies, such as the Department of Health and the Department of Social Welfare and Development are enjoined to collaborate and cooperate with the Philippine Society of Hypertension in advocating and implementing activities to prevent and control hypertension and its cardiovascular complication.

SECTION 101. NATURAL FAMILY PLANNING MONTH. The Natural Family Planning Month shall be observed during the month of May pursuant to Department Circular No. 63- A, series of 1996 to initiate activities as support to ongoing family planning program.

SECTION 102. INTERNATIONAL AIDS CANDLELIGHT MEMORIAL DAY. The International AIDS Candlelight Memorial Day shall be observed every 20th day of May to honor the memory of those who died with the cause of HIV/AIDS, show support to those living with HIV/AIDS, raise awareness and mobilize community involvement in the fight against HIV/AIDS.

SECTION 103. HEALTH WORKER’S DAY. May 7 of every year is hereby declared as a special working holiday to be known as “Health Worker’s Day” to give due recognition to the important role and contributions of the health workers who provide vital health services to our people and to promote their rights and welfare and enhance their sense of worth and dignity pursuant to Republic Act No. 10069, Series of 2010.

SECTION 104. INTERNATIONAL DAY OF ACTION FOR WOMEN’S HEALTH. International Day of Action for Women’s Health which falls on the 28th May every year strives for women’s rights, especially in the area of their sexual and reproductive health. Sexual and reproductive health and rights of women are an inalienable part of our human rights, that sadly continue to be violated globally.

Article 7 June Special Events and Days of Action

SECTION 105. PROVINCIAL HEALTH WEEK. The Provincial Health Week shall be conducted every first week of June to assess and update all existing health program, manpower, infrastructure and technical support applications necessary for planning, program implementation and sustainability.

SECTION 106. NO SMOKING CAMPAIGN MONTH. The No Smoking Campaign Month shall be observed every June pursuant to Consumers Act No of 1992 and Philippine Clean Air Act of 1999 to emphasize the province’s commitment to a smoke-free environment, prevention and control of smoking and to sustain its anti-smoking policy.

SECTION 107. DIARRHEA DISEASES CONTROL MONTH. The Diarrhea Diseases Control Month shall be observed every June pursuant to Memorandum Circular No. 4, series of 1992 to create awareness on the prevention of diarrhea, promote environmental sanitation, use of safe water, and water

SECTION 115. MOSQUITO-BORNE DISEASES PREVENTION MONTH. The Mosquito-Borne Diseases Prevention Month shall be observed every August to promote awareness and create concerted community actions to prevent the occurrence and rise of mosquito-borne diseases.

SECTION 116. MOTHER AND BABY FRIENDLY HOSPITAL WEEK. Pursuant to Republic Act No. 7600-1992. The Baby-Friendly Hospital shall be observed during the first week of August to strengthen and emphasize the policy that all hospitals in the province are Mother and Baby Friendly Hospitals. The celebration shall aim to promote breast-feeding and rooming-in practices and the same time emphasize the psycho-social and economic benefits of breast milk and breast-feeding.

SECTION 117. HOSPITAL WEEK. The Hospital week shall be celebrated every second week of August pursuant to Proclamation No. 181, dated May 2, 1983 to create awareness on the role and importance of hospitals in the delivery of quality health services.

SECTION 118. HOSPITALS AS CENTERS OF WELLNESS MONTH. The Hospital as Center of Wellness Month shall be observed every month of August pursuant to Department Circular No. 181, series of 1996 to increase awareness on social role of hospitals as center of wellness and strengthening of partnership between the hospitals (government and private and other health sectors of the society).

SECTION 119. NATIONAL TUBERCULOSIS MONTH. The National Tuberculosis Month shall be observed every August pursuant to Proclamation No. 840, series of 1996. and Department Circular No. 64-B, series of 1997 to increase the various stakeholders’ awareness on the symptoms, diagnosis and treatment of TB and the importance of effective TB control.

SECTION 120. ASTHMA WEEK. Pursuant to Proclamation No. 442, Series of 1994, Asthma Week shall be observed every second week of August of every year.

SECTION 121. NATIONAL BREASTFEEDING AWARENESS MONTH. This bill designates the month of August of every year as “National Breastfeeding Awareness Month” in order to protect, promote and support breastfeeding in the Philippines as the normal, natural and preferred method of feeding infants and young children. The core message of the bill is especially urgent today as a reported 16, 000 Filipino babies die every year-more than all those who died from insurgency and terrorism combined- directly due to the harmful effects of bottle-feeding.

Article 10 September Special Events and Days of Action

SECTION 122. BARANGAY HEALTH WORKERS DAY. The Barangay Health Workers day shall be celebrated every first day of September pursuant to Republic Act No. 7883-1995 to recognize the effort and worthy contributions of Barangay Health Workers as front liners in the delivery of basic health services in the community.

SECTION 123. MEDICINE WEEK. The Medicine Week shall be celebrated every last week of September pursuant to Department Circular No. 275-A, series of 1999 to update health and allied health professionals to the current issues and concerns of the medical profession and to develop camaraderie and improve working relationship among government and private practitioners and employees.

SECTION 124. GENERICS AWARENESS MONTH. Pursuant to RA No. 6675 of 1998, The Generics Awareness Month shall be observed every month of September to create public awareness on the availability of common and affordable but quality and effective medicines.

SECTION 125. BREAST CANCER PREVENTION MONTH. The Breast Cancer Prevention Month shall be observed every September pursuant to Department Circular 219-D, series of 2000 to create awareness on the known risk factors of breast cancer, the practice of self-breast examination, its signs and symptoms, and the importance of early referral, diagnosis and treatment.

SECTION 126.CEREBRAL PALSY AWARENESS AND PROTECTION WEEK. Declaring from September 16 to 22 of every year as the Cerebral Palsy Awareness and Protection Week pursuant to Proclamation No. 588, Series of 2004.

SECTION 127. OBESITY PREVENTION AWARENESS WEEK. Pursuant to Proclamation No. 162, Series of 1999, the Cerebral Palsy Awareness and Protection Week shall be observed every September of the year, under the auspices of the Philippine Association for the Study of Overweight and Obesity.

SECTION 128. NATIONAL EPILEPSY AWARENESS WEEK. Every first week of September of every year, the National Epilepsy Awareness Week shall be observed pursuant to Proclamation No. 230, Series of 2002.

SECTION 129. NATIONAL PHYSICAL THERAPY DAY. The National Physical Therapy Day shall be observed every eight day of September of every year as provided for in Proclamation No. 15, Series of 1998.

Article 11 October Special Events and Days of Action

SECTION 130. MENTAL HEALTH WEEK. The Mental Health Week shall be celebrated every second week of October pursuant to Department Circular No. 266-B, series of 1999 and Presidential Proclamation No. 452 (August 25, 1994) to increase awareness on the importance of mental health, develop and discover effective coping mechanisms to manage and combat stress and reduce its effect.

SECTION 131. HEALTH EDUCATION WEEK. The Health Education Week shall be celebrated every third week of October pursuant to Presidential Proclamation No. 255-1967 to achieve discussions on national health promotion, directions, policies and guidelines and identify stakeholders as partners in health promotion of DOH programs.

SECTION 132. ELDERLY FILIPINO WEEK. The Elderly Filipino week shall be celebrated every October 1to 7 pursuant to pre proclamation # 470-1975.

SECTION 134. OSTEOPOROSIS AWARENESS WEEK. The Osteoporosis Awareness Week shall be celebrated every fourth week of October pursuant to Department Circular No. 239-A, series of 2001 to increase public awareness on the prevention of Osteoporosis and promote healthy lifestyle practices.

SECTION 135. NURSES WEEK. The Nurses Week shall be celebrated every fourth week of October pursuant to Department Circular No. 150-A, series of 2002 to create public awareness on the vital role nurses play in nation-building and as forefront of the health care industry, and to discuss and deliberate issues and concerns affecting nurses and the nursing profession.

Article 12 November Special Events and Days of Action

SECTION 136. NATIONAL DEWORMING MONTH. The whole month of November shall be dedicated for deworming activities in the province. The Provincial Government through the Provincial Health Office, in coordination and partnership with the component LGU’s in city, municipal and barangay levels, and the Department of Education, shall distribute for free safe and effective deworming drugs to all who may need it, especially children in elementary and high schools pursuant to DepEd Memorandum # 80-2015.

SECTION 137. DRUG ABUSE PREVENTION MONTH. The Drug Abuse and Prevention Month shall be celebrated every November pursuant to Presidential Proclamation No. 335, series of 1998 to bring into focus the vital role of the youth towards a drug-free and progressive society. Activities should be designed to promote heightened awareness of the dangers posed by drug abuse and further enhance the people’s resolved to do their share in the overall efforts against this pernicious evil.

SECTION. 138. NATIONAL SKIN DISEASE DETECTION AND PREVENTION. Declaring every second week of November of every year, the National Skin Disease Detection and Prevention is hereby declared pursuant to Proclamation No. 110, Series of 2001.

Article 13 December Special Events and Days of Action

SECTION 139. WORLD AIDS DAY. The month of December shall be AIDS Awareness and Prevention Month pursuant to Republic Act No. 8504, otherwise known as the Philippines AIDS Prevention and Control Act of 1998 to provide timely, accurate, appropriate and relevant HIV/AIDS Education and Information which shall empower persons and communities to think and act in ways that protect themselves from HIV infection, minimize the risk of transmission and decrease the socio-economic impact of HIV/AIDS.

SECTION 140. HEALTH EMERGENCY PREPAREDNESS MONTH. Pursuant to Presidential Proclamation No. 705, the Health Emergency Preparedness Month shall be observed every December to create awareness on the nationwide campaign to prevent accidents, trauma and injuries and instill in the general citizenry respect for laws and ordinances that promote public safety.

SECTION 141. OPLAN IWAS PAPUTOK. The Oplan Iwas Paputok shall be implemented every December pursuant to Department Memorandum No. 13, series of 1998 to reduce the incidence of firecracker related injuries during the holiday season. The Provincial Government through its Stop Death Program shall embark on the said project which promotes alternative forms of revelry and discourages the use of firecrackers and fireworks.

CHAPTER VI COMPLEMENTARY HEALTH SERVICES Article 1 Traditional Medicine and Complementary Alternative Medicine Services

SECTION 142. TRADITIONAL MEDICINE AND COMPLEMENTARY ALTERNATIVE MEDICINE SERVICES (TM-CAM). The Provincial Government shall integrate and adopt traditional medicine and other complementary alternative medicines (TM-CAM) which are available and affordable into the preventive and curative services following the DOH standards of accreditation.

SECTION 143. HERBAL PROCESSING PLANT. There shall be established a Herbal Processing Plant to ensure safe, affordable and available source of herbal drugs.

Article 2 Rehabilitative Health Services

SECTION 144. REHABILITATIVE HEALTH SERVICES. The Provincial Government shall formulate, plan, institutionalize, promote and sustain rehabilitative health services intended for the reduction of physical disability.

SECTION 145. PROGRAMS AND SERVICES. The Rehabilitative Services shall consist of physical therapy and rehabilitation to: (a) neurovascular-Accident (stroke); (b) Musculoskeletal disorders; (c) Orthopedic Disorders and Post-op Orthopedic Complications; (d) Pain Management; and Prosthetics and Orthotics Rehabilitation.

SECTION 146. HOSPITAL-BASED REHABILITATION SERVICE. A hospital-based rehabilitation service with complete physical therapy modalities shall be established in all higher-level referral hospitals, both private and government.

SECTION 147. COMMUNITY-BASED REHABILITATION PROGRAM. The Provincial Government shall formulate and implement Community-Based Rehabilitation Program to ensure continuity of care of the patient.

SECTION 148. SUBSTANCE USE RECOVERY AND ENLIGHTENMENT (SURE) PROGRAM. The provincial government shall institutionalize a Substance Use Recovery and Enlightenment (SURE) Program for Substance Use Disorder (SUD) for persons who are bona fide residents of Agusan Del Sur. The SURE program shall delve on three (3) major components: (a) Information and Education Campaign; (b) out-patient drop-in center; and (c) rehabilitation and treatment center. This program shall operate under the auspices and as one of the additional created divisions in the office of the Provincial Governor. (to include personnel benefits).

CHAPTER VII SUPPLY AND PROPERTY MANAGEMENT AND THE DIRECT RESPONSIBILITY Article 1 Miscellaneous Provisions

SECTION 149. SUPPLY AND PROPERTY MANAGEMENT. The Provincial Government and all its LGUs shall observe the pertinent provisions of laws, rules and regulations on supply and property management.

SECTION 150. DIRECT RESPONSIBILITY FOR SUPPLIES OR PROPERTY. The person in actual possession of supplies or property or entrusted with its custody and control shall be responsible for its proper use and care and shall exercise utmost diligence in the utilization and safekeeping thereof including those donated by foreign and local entities.

SECTION 151. DOH-ACCREDITED SUPPLIER. All government agencies within the province shall make purchases of drugs and medicines, medical, dental, laboratory supplies and equipment from supplier duly accredited by the Department of Health/Bureau of Food and Drugs.

SECTION 152. RATIONAL DRUG USE. Drugs and medicines shall be purchased in accordance with the guidelines prescribed by the Philippine National Drug Formulary (PNDF).

SECTION 153. DRUGS CONSIGNMENT SYSTEM. The Provincial Government of Agusan del Sur shall implement the Drug Consignment System in the Provincial Government-Owned Hospitals to ensure availability of drugs and medicine, etc. and faster processing of all documents of the health sector.

SECTION 154. FUNCTIONAL SERVICE DELIVERY NETWORK. The Provincial Government shall ensure that established networks in the province shall sustain its functionality through provi-

SECTION 155. REVENUE ENHANCEMENT CAPABILITY. The Provincial Government shall strengthen the revenue capability of all government hospitals under its jurisdiction for a sustainable health programs and services. There shall be a special committee tasked to initiate proposals for revenue generation ventures.

SECTION 156. USER’S FEES. User’s fees in accordance with pertinent provisions of the Provincial Revenue Code and other applicable ordinances of Agusan del Sur shall be imposed for the use of government health facilities and services under the supervision of the Provincial Health Office (PHO).

SECTION 157. HEALTH CARE FINANCING SYSTEM. Aside from the Provincial Appropriated funds for hospital operation of the five (5) provincial owned hospitals (D.O. Plaza Memorial Hospital (DOPMH), Bunawan District Hospital (BDH), Loreto District Hospital (LDH), Talacogon District Hospital (TDH), Esperanza Medicare Community Hospital (EMCH) of the province of Agusan del Sur, the Provincial Government shall endeavor to continue to find alternative ways of financing hospital operation and to strengthen existing health care financing schemes implemented by the provincial government namely: Revolving Trust Funds, Income/Revenue generated from its operation and Consignment Scheme.

SECTION 158. CATEGORIZATION OF PATIENTS. For the purpose of revenue enhancement, there shall be policies and guidelines to be followed in the assessment of patients seeking consultation/admission in all provincial government hospitals

SECTION 159. UNDUE INTERFERENCE. Communication/Letters from persons intending to influence or adversely affect the revenue enhancement procedures of provincial government hospital shall not be entertained.

Article 3 Standards from Quality Health Services

SECTION 160. DEPARTMENT OF HEALTH (DOH) PROFESSIONAL REGULATORY COMMISSION (PRC) LICENSING. All government hospitals, drugs, and pharmaceutical enterprises and products, radiation-emitting instruments, medical devices, laboratory, dental services and diagnostic clinics shall undergo the mandatory licensing requirements prescribed by the DOH, as well as for health professionals by the PRC. The Provincial Government shall assist, monitor and disseminate information for the compliance of these requirements.

SECTION 161. SENTRONG SIGLA/AND OTHER QUALITY INITIATIVE CERTIFICATION. The Provincial Government of Agusan del Sur shall endeavor to assist government health facilities under its jurisdiction to meet the standard of quality service for certification as set forth by the Department of Health.

SECTION 162. PROVINCIAL HEALTH INSURANCE CORPORATION (PHIC) ACCREDITATION. The Provincial Government shall allocate funds for the upgrading of facilities and equipment as well as the personnel complement of its hospital to meet the standard as set forth by PHIC for accreditation. It shall likewise encourage private and other government health facilities to meet the same standard.

Article 4 Ambulance

SECTION 163. PROPER USAGE – The Provincial Government shall enjoin all local chief executives to strictly observe the proper use of government ambulance for their constituents.

SECTION 164. AVAILABILITY OF AMBULANCE – All hospitals and RHUs must have available ambulance at all times and shall be properly equipped with emergency care facilities, equipment, fuel and oil. It shall be made available and in good condition at all times at the vicinity of the hospital/ Rural Health Unit/Birthing Clinic and be solely use for referral of patients and/or other health related activities. The availment of ambulance services for indigent patients shall at all times be free of charge. The actual cost of fuel to and forth, may, however, be charged against the user.

SECTION 165. DRIVERS – DOH accredited Drivers for ambulance shall be available twenty-four [24] hours, seven (7) days a week.

SECTION 166. REFERRAL, SERVICE FEES, AND PROHIBITION. Certain guidelines shall be provided on the usage of the ambulance and that aside from the transport of patients, the ambulance can also be used during Health outreach program and other health related activities. SECTION 167. ADMINISTRATIVE SANCTION. Violation to the above provision shall be subject to the Revised Rules on Administrative Cases in the Civil Service.

Article 5 Health Security Program of the Government

SECTION 168. HEALTH INSURANCE PACKAGE/COVERAGE. All Local Government Units shall provide funds and implement applicable benefit packages of social health security through adoption and support to the implementation of the National Health Insurance Program (NHIP) to all its indigent families and other constituents in order to obtain access to quality health services and adopt the UNIVERSAL HEALTH CARE ACT (RA 11223) which measure intends to provide Health Care for all Filipinos and automatically enroll every Filipino in the National Health Insurance Program.

Membership in the program can either be direct, meaning by paying Health Premium, or indirect such as those who are sponsored like Senior Citizens and indigents.

SECTION 169. RESPONSIBILITIES. The Local Health Security Office be created for the province/city/municipality/barangay and the Member/Beneficiaries shall perform with due diligence and efficiency all mandated duties and responsibilities.

SECTION 170. SOCIAL HEALTH INSURANCE COVERAGE AND BENEFITS FOR WOMEN ABOUT TO GIVE BIRTH. The un-enrolled women about to give birth shall be covered by Philippine Health Security Corporation. This is to enable all mothers and their newborns to have financial access to essential health services that will ensure their survival and well-being as provided for in PHILHEALTH Circular No. 025-2015 and RA 11223.

Article 6 Health Budget

SECTION 171. HEALTH BUDGET ALLOCATION. It shall be the responsibility of every Local Government Unit to allocate necessary funds for its health program and services, likewise, to prioritize health program recommended by its respective Local Health Board.

SECTION 172. BUDGETARY ESTIMATES. All Department Head shall submit to the Local Chief Executive (LCE) its proposed office budget for the ensuing year.

SECTION 173. ADDITIONAL FUNDING SOURCE. Revenue generated from the operation of the hospital/RHU shall accrue to the General Fund of concerned LGUs and shall be utilized in accordance with the approved appropriation ordinance.

SECTION 174. INCOME FROM HERBAL PROCESSING PLANT. Income derived in the operation of the plant shall accrue to the General Fund of concerned LGUs and shall be utilized in accordance with the approved appropriation ordinance.

SECTION 175. INCOME FROM PHARMACEUTICAL PROCESSING. Income derived from processing and sale of pharmaceutical products shall accrue to the General Fund of concerned LGUs and shall be utilized in accordance with the approved appropriation ordinance.

CHAPTER VIII IMPLEMENTING MECHANISM Article I The Provincial Health Board

SECTION 176. PROVINCIAL HEALTH BOARD. E.O No.12 series of 2013 mandates the Provincial Health Board to cater and address the needs of the public health (preventive and promotive) program of the province.

SECTION 177. COMPOSITION. Pursuant to Section 102(a) of Republic Act No. 7160, the Provincial Health Board shall be composed of the following: Provincial Governor as Chairman; Provincial Health Officer as Vice Chairman; SP Chairman on Committee on Health and Sanitation, representative of the Department of Health (DOH) NGO/Civil Society Organization. Membership to the PHB can be expanded as maybe necessary as determined by the Local Chief Executive and National Policies and Guidelines.

SECTION 178. SECRETARIAT. The Provincial Health Office (PHO) shall be the Secretariat of the Provincial Health Board to provide administrative and technical support, and such other assistance as may be required in the discharge of its function.

SECTION 179. MEETING AND QUORUM OF PROVINCIAL HEALTH BOARD. The Provincial Health Board is mandated to meet at least once every quarter and may hold special meeting as the need arises upon the request of the chairman or by majority members of the board.

SECTION 180. COMPENSATION AND REMUNERATION. The Chairman, Vice Chairman and members of the Provincial Health Board shall perform their duties as such without additional compensation or remuneration. Members thereof who are not government officials or employees shall be entitled to necessary travelling expenses and allowances, chargeable against any available funds, subject to existing accounting and auditing rules and regulations.

Article 2 The Provincial Blood Coordinating Council

SECTION 181. CREATION OF THE PROVINCIAL BLOOD COORDINATING COUNCIL. The Provincial Blood Coordinating Council shall plan and implement a provincial blood program to promote voluntary blood donations and shall be the policy making body in terms of blood program in the province.

Article 3 Provincial Water Analysis Laboratory Facility

SECTION 182. CREATION. There shall be created the Provincial Water Analysis Laboratory Facility.

SECTION 183. RULES AND REGULATIONS. The services of the Provincial Water Analysis Laboratory shall include among others the screening of the quality as well as the potability of the water sourced out from within the area of jurisdiction of the province of Agusan del Sur.

SECTION 184. ADMINISTRATIVE PROVISIONS. The Provincial Water Analysis Laboratory shall impose appropriate laboratory service fees, as provided in the Revenue Code of the province. The management and supervision of the Provincial Water Analysis Laboratory facility shall be vested upon the Provincial Health Office as a separate unit.

Article 4 Inter-Local Health Zones

SECTION 185. COOPERATIVE UNDERTAKING. Pursuant to Section 33 of Republic Act No. 7160, which provides that local government group themselves into an Inter-Local Health Zones (ILHZ) to consolidate and coordinate their efforts, services and resources for the purpose beneficial to them.

SECTION 186. COMPOSITION. The Inter-Local Health Zones (ILHZ) shall be composed of at least one referral hospital and health center strategically clustered within the catchment areas to deliver integrated health care and ensure smooth coordination between municipalities, barangays and the core referral hospitals.

SECTION 187. REFERRAL SYSTEM. There shall be installed functional referral system among health facilities/providers to ensure continuous and complementary delivery of health services.

SECTION 188. NETWORKING. Health center and referral hospital clustered into Inter-Local Health Zones shall share responsibility and resources in addressing health problems within their zone and may network with other health zone or private health facilities. The regional hospital and medical centers may form part of a functional service delivery network of the province.

Article 5 Planning and Research

SECTION 189. LOCAL HEALTH PLAN. A Comprehensive local health plan shall be prepared by every LGU based on the local health situation and consistent with DOH guidelines and standard.

The Provincial Health Office (PHO) shall review, assess and integrate all local health investment plans to determine the areas where the Provincial Government may provide technical, administrative, financial, or logistical assistance.

SECTION 190. PROVINCIAL HEALTH PLAN. The Provincial Health Officer shall cause the preparation of an integrated and comprehensive Provincial Health Investment Plan based on the actual and prevailing local health situation in the province and integrating/collating the submitted local health investment plan of all component LGUs, and submit the same to the provincial health board for evaluation and finally to the Sangguniang Panlalawigan for further review, adoption and budget authorization.

SECTION 200. POWERS AND FUNCTIONS OF THE PHO. The powers and functions of the Provincial Health Office shall be carried on by two (2) divisions namely: (a) The Public/Preventive Health Services Division and (b) Hospital Care/Curative Services Division.

Article 2 The Provincial Health Officer II

SECTION 201. APPOINTMENT. The Provincial Health Officer II shall be appointed by the Provincial Governor and concurred by the Sangguniang Panlalawigan, with the rank and position equivalent to a Department Head of the Provincial Government.

SECTION 202. QUALIFICATIONS. The Provincial Health Officer II shall possess the necessary qualifications provided for under Section 478 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991.

Article 3 The Public Health Services Division

SECTION 203. DUTIES AND FUNCTIONS. The Public Health Services Division, through the Primary Health Care Strategy, shall provide the preventive and promotive services linking with the Hospital Health Care Services.

Article 4 Hospital Care/Curative Services Division

SECTION 204. HOSPITAL CARE SERVICES DIVISION. The Hospital Care Services Division shall execute and manage the delivery of curative health services.

CHAPTER X PENAL PROVISION

SECTION 205. Any act or omission committed by any person, natural or juridical, in violation of this code shall be penalized as follows:

1st Offense ………..P 2,500.00 2nd Offense ……….. 3,500.00 3rd Offense ……….. 5,000.00 or an imprisonment of not more than Thirty (30) days, or both, at the discretion of the Court

CHAPTER XI TRANSITORY PROVISIONS

SECTION 206. VESTED RIGHT. Rights and obligations existing on the date of effectivity of the Code and arising out of contracts shall be governed by the original terms and conditions of said contract or the law in force at the time such rights were vested.

SECTION 207. IMPLEMENTING RULES AND REGULATIONS (IRR). The Provincial Governor, through the Provincial Administrator and the Technical Staff of the Provincial Health Office and other oversight agencies, shall formulate the Implementing Rules and Regulations necessary to carry out the provisions of this Code within Ninety (90) days after approval.

SECTION 208. APPROPRIATION. The Provincial Health Office shall include in their program the implementation of this Code, the funding of which shall be included in the Annual Budget: Provided, That the Provincial Governor, City/Municipal Mayors and the Punong Barangays through their respective Sanggunians, shall allocate funds in the implementation of health programs, projects and services.

CHAPTER XII MISCELLANEOUS PROVISIONS

SECTION 209. REPEALING CLAUSE. All previous ordinances, resolutions, rules and regulations or parts thereof, Circulars, Memoranda or Executive Orders, which are inconsistent with any provisions of this Code are hereby repealed or modified accordingly with Universal Health Care Act (RA 11223).

SECTION 210. SEPARABILITY CLAUSE. If any provision or part hereof is held invalid or unconstitutional, the remainder of the law or the provision not otherwise affected shall remain valid and subsisting.

SECTION 211. CONFLICTING PROVISIONS OF CHAPTERS. If the provision of the different Chapters are in conflict with each other, the provision of each chapter shall prevail as to the specified matters and questions involved therein.

SECTION 212. CONFLICTING PROVISIONS OF SECTIONS. If the provisions of the different sections in the chapter or Article are in conflict with each other, the provisions of the section which is the last in point of sequence shall prevail.

SECTION 191. HEALTH SERVICE INFORMATION MANAGEMENT SYSTEM (HSIMS). The Provincial Government shall keep and maintain Health Database for information, planning, monitoring and evaluation using the standard of Health Service Information Management System (HSIMS) as prescribed by the DOH. May also use other health data system as approved and credited by other oversight agency.

SECTION 213. CONFLICTING PROVISIONS WITH OTHER ORDINANCES OF THE LOWER LGUs. Any conflicting provision found in Ordinances on lower LGUs shall be liberally interpreted in its favor, and in case of doubt, any question thereon shall be resolved in favor of devolution of powers and of the lower local government unit. Any fair and reasonable doubt as to the existence of the power shall be interpreted in favor of the local government unit concerned.

SECTION 192. HEALTH RESEARCH STUDIES. In partnership with the concerned stakeholders, studies, researches, surveys on health maybe conducted as necessary to support health developments and interventions.

SECTION 214. POSTING AND PUBLICATION. This Ordinance shall be posted at the prominent places in the provincial government center, the City/Municipal/Barangay Halls, and in any other conspicuous public places for seven (7) days and shall be published in at least one (1) newspaper of regional circulation in the province.

Article 6 Resource Development

SECTION 193. CAPABILITY-BUILDING. Updated and situation-specific training program shall be made available to public health workers and other partners in health to continuously develop their competencies in the management and delivery of health services.

SECTION 215. EFFECTIVITY CLAUSE. This Code shall take effect after its complete publication in at least one (1) newspaper of regional circulation and copies thereof shall be distributed in all component Local Government Units of the province.

SECTION 194. DOCUMENTATION. There shall be proper documentation of all activities for records and reference purposes.

SECTION 195. MONITORING AND EVALUATION. There shall be monitoring and evaluation of activities implemented as basis for program planning and redirection of strategies, policies and proper resource allocation.

Article 7 Linkages

SECTION 196. CIVIL SOCIETY ORGANIZATIONS. The Provincial Government shall involve the participation of accredited Civil Society Organizations who may support health service delivery, promote self-help activities in primary health care, and complement the resource of the Provincial Government.

SECTION 197. PROVINCIAL HEALTH SUPPORT ORGANIZATIONS. The Provincial Government shall organize councils, committees, task force and other related health groups to ensure effective and efficient delivery of health services.

The bus will be used in times of calamity, to rescue stranded passengers, during insurgency, and other incidents free of charge.

In the last decade, Ang engineered the massive diversification and transformation of the over 100 years old San Miguel from a beer, food, spirits and packaging company with market leading positions, to a diversified conglomerate with interests in industries crucial to Phil-

ippine economic growth: food and beverage, oil and fuels, power, infrastructure, and banking.

SMC is one of the Philippines’ largest companies by revenues and profits. In 2018, its revenues breached PHP1 trillion, equivalent to about 5.9 percent of the Philippines’ Gross Domestic Product.

Reinvesting in the Philippines Much of San Miguel’s earnings are ploughed back and reinvested in the Philippines in the form of growthgenerating manufacturing facilities and infrastructure projects aimed at improving people’s lives, decongesting cities, and sustaining economic growth.

Currently, SMC’s food and beverage business is in the midst of the largest capacity expansion program in its 129-year history.

It is building additional breweries, new feed mills, flour mills, food processing plants, poultry facilities, and a ready-to-eat plant, in various locations nationwide.

These new facilities bring direct and indirect jobs, livelihood opportunities, and boost local economies.

SMC, under Ang, is also managing, operating, and constructing some of the country’s biggest infrastructure projects.

Its operating expressways include the South Luzon Expressway (SLEX), Skyway 1 and 2, Southern Tagalog Arterial Road (STAR), the NAIA Expressway (NAIAX), and the Tarlac-Pangasinan-La Union Expressway (TPLEX).

It is building Skyway Stage 3, which will connect SLEX and Skyway 1 and 2 to the Northern Luzon Expressway from Buendia, Makati; Skyway Stage 4, from Skyway FTI, Paranaque City to the Batasan Complex in Quezon City and to San Jose del Monte, Bulacan, and the Skyway Extension from Alabang to SLEX Susana Heights.

SMC is also set to build the SLEX TR4 project, which will extend SLEX from Sto. Tomas, Batangas to Lucena City in Quezon province.

San Miguel is also building the MRT-7 project, which will stretch from North Edsa through Quezon City, to San Jose del Monte, Bulacan. The project includes an intermodal transport terminal and a road component that will connect to the North Luzon Expressway.

Most ambitious project SMC’s biggest and most ambitious upcoming project to date is the new Manila International Airport project in Bulacan province, just north of Metro Manila, and accessible via an expansive infrastructure network.

At USD15 billion, it is the company’s single largest investment to date, and the largest in the country.

The new airport will be the Philippines’ largest and most modern.

have four runways, upgradable to six, and world-class facilities seen to boost the country’s competitiveness as an investment and tourism destination.

Philantropy, Sustainability Ang is also a known philanthropist. Through the San Miguel Foundation, he has channeled billions of pesos towards building housing communities for thousands of families affected by natural calamities and armed conflict.

The foundation has also built community hospitals, schools, and libraries, among others. It’s thrust today is to address hunger and education. It recently completed its first learning and feeding center and food bank in the poorest district of Tondo, Manila, where Ang grew up.

Under Ang, SMC has also pushed for greater sustainability, initiating a landmark water sustainability project which calls for an ambitious 50 percent reduction in the utility and domestic use of water across all its businesses by year 2025.

In 2017, as part of efforts to reduce the company’s solid waste footprint, he announced the discontinuation of San Miguel’s plastic bottled water business.

In 2019, he announced several major sustainability initiatives: a PHP1 billion donation to clean up the Tullahan River; building the country’s first recycled plastics road, and adopting the Philippines’ first fully-certified biodegradable plastics for various packaging requirements.

From an early age, Ang has had an entrepreneurial spirit. He started in business importing and reconditioning heavy equipment for the local construction industry. He is a mechanical engineering graduate and an avid car aficionado and collector.

PHOENIX Petroleum, the fastest-growing and leading independent oil company in the Philippines, reinforces its thrust for cleaner energy and diversified energy sources through a new deal with a manufacturer, distributor, and operator of generator sets that can run on raw wellhead gas, LNG, CNG, and propane rich LPG. The partnership was made official with a memorandum of agreement between Phoenix Pilipinas Gas and Power, Inc., a wholly-owned subsidiary of Phoenix Petroleum Philippines, Inc., and Mesa Natural Gas Solutions LLC, an American company based in Casper, Wyoming. The agreement will make the genset units available in the Philippines with the corresponding commissioning, training, and technical support from the USA. Both companies are expecting the deal to promote the use of gas, and broaden the Philippines’ energy mix.

The project also aims to contribute to the Department of Environment and Natural Resources’ initiatives on Clean Development Mechanism (CDM).
