Civilians tap as undercover agents in Oro fiesta revelries

CAGAYAN de Oro City--The Cagayan de Oro City Police Office (Cocpo) has tapped the services of some civilians to ensure the safety of Kagayanons as they celebrate their month-long annual fiesta in honor of their patron, St. Augustine.

Cocpo Spokesperson Chief Insp. Mardy Hortillosa II said that based on their initial assessment there is no terror threat in the city during the entirety of the festivities despite the fact that the month-long siege in nearby Marawi City is still going on.

Thus, there is no need for any reinforcement from the Police Regional Office 10 (PRO 10) which is also quartered in this city, Hortillosa said.

C. de Oro to launch local ‘Rescue 911’ CAGAYAN de Oro City-This city will soon have its own localized 911 system in an effort to speed up dispatch of emergency services.

A "localized" 911 dispatch system is seen to be faster, where calls will not have to be routed to a central emergency dispatch center outside the city, said City Disaster Risk Reduction and Management Office (CDRRMO) head Allan Porcadilla.

Porcadilla explained that emergency calls under the nationwide Rescue 911 launched last year are routed in a central command in Manila before they are transferred to their respective origins.

Cagayan de Oro, a city of 675,950 people, needs

a speedy rescue system to better respond to the emergency needs of its burgeoning population, Porcadilla said.

Under the locally-operated 911 rescue unit, Porcadilla said the city government will be able to directly receive calls and appropriate respond the nature of emergencies—medical, police, fire, bomb defusers, hazardous materials containment, and other emergency situations.

The city's CDRRMO has been consistently awarded for the past five years as the best local disaster management in Region 10.

However, it recently received criticisms for allegedly taking too long in the rescue of multiple victims at a vehicular accident last

month.

Porcadilla said the new 911 system will be available to all PLDT, Globe and Smart subscribers.

Mayor Oscar Moreno will activate the local 911 system by taking the first ceremonial call on August 28.

“Just dial 911, stay on the line and our call center will handle the rest,” he said. The CDRRMO 911 emergency dispatch center will be located at the City Hall campus and will be manned 24/7 by operators who were trained by Davao Central 911.

The previous head of Davao Central 911, retired Col. Mario Verneer Monsanto, is the Cagayan de Oro CDRRMO consultant.

New radar system to boost Navy’s ability to detect intrusions THE Philippine Navy's (PN) capability to detect unauthorized entries in the country's vast maritime domains will be greatly boosted by the Americandonated tethered aerostat radar system (TARS) that will be turned over on August 22.

Nav y sp oke sp e rs on Capt. Lued Lincuna said TARS is the PN's first selfsustained unmanned lighter-than-air system and will enhance their capability in maritime intelligence surveillance reconnaissance.

TARS will allow the PN to detect maritime and air traffic within the country’s coastal waters using sensors, he added.

Aside from protecting the country's waters from intruders, TARS can also be utilized in the conduct of humanitarian assistance and disaster response operations.

Lincuna said TARS is also equipped with a weath-

er station that provides telemetry data to the ground station for the monitoring of ambient temperature, pressure, wind speed and other pertinent parameters in the operation of the system.

The equipment will be formally turned over by the US government to the PN during short ceremonies at the Naval Education and Training Command, San Antonio, Zambales on Tuesday.

The activity will be spearheaded by US Deputy Embassy Chief of Mission to the Philippines, Michael Klescheski and PN flagofficer-in-command Vice Admiral Joseph Ronald S. Mercado.

Earlier, Department of National Defense (DND) Secretary Delfin Lorenzana announced that he is keen to get more modern radar systems to improve the country's maritime domain situational awareness

capability.

Such capability is sorely needed on the Sulu and Celebes Sea, which is being threatened by piracy and kidnapping attacks Abu Sayyaf and other lawless elements and the eastern seaboard of the Philippines where incidents of poaching and intrusions are rampant.

Lorenzana said he is planning to include the acquisition of modern radars in the Armed Forces of the Philippines (AFP) Modernization Program's Second Horizon.

Maritime domain situational awareness refers to the capability to detect, monitor and if necessary, drive away intruding water craft from one's territorial waters.

The AFP Modernization Program is divided into three horizons, with the first lasting from 2013 to 2017, the second from 2018 to 2022 and third 2023 to 2028. (PNA)

Philippine National Police (PNP) Chief Dir. Gen. Ronald "Bato" Dela Rosa, made the statement in re-

sponse to the call made by religious leaders for their followers to pray for the suspension of the ongoing anti-illegal drugs campaign, a Radyo Pilipinas report said Monday.

This is in wake of the large numbers of suspected drug pushers and users killed during police operations in Bulacan, Manila and Caloocan City last

week.

Dela Rosa added that if there was no illegal drugs trade, there will be no violence which results in the death of illegal drugs suspects and law enforcers alike.

Halting anti-drug operations now will only result in the negation of the campaign's success, the PNP chief said. (PNA)

Draft BBL in Congress; awaits authors for filing

THE draft Bangsamoro Basic Law (BBL) finally reached Congress last week, a month after it was submitted to President Rodrigo Duterte, but it has yet to be filed as a bill in the House of Representatives and the Senate.

MindaNews asked Senate President Aquilino Pimentel and House Speaker Pantaleon Alvarez, Jr. if they would be the principal authors. Alvarez did not send a reply but Pimentel told MindaNews he was “willing to be author” but “have to sked discussion with my legislative staff.”

Asked if the bill would be filed next week after the holiday on Monday, Pimentel replied: “not even sure if next week. Discuss pa namin (we will still discuss).”

There are only 22 session days (Mondays to Wednesdays, excluding holidays) or 38 days (including Thursdays and Fridays) between August 22 and October 13, as Congress takes a break from October 14 to November 12.

The draft BBL was submitted to President Rodrigo Duterte by the Bangsamoro Transition Commission (BTC) on July 17 in rites held in Malacanangn and witnessed by Pimentel and Alvarez.

The transmittal letter from the Office of the President to Congress took a month but no certificate of urgency accompanied the transmittal.

Instead, Undersecretary Ryan Estevez of the Presidential Legislative Liaison Office (PLLO) under the Office of the President said in his August 14 letter to Pimentel that they “trust in the collective wisdom of Congress should they deem proper to refine the draft further in the course of the regular legislative mill in order to reflect the genuine aspirations of the Filipino people.”

letter stamped received by Pimentel’s office at 7 p.m. on August 14.

“Per Deputy Executive Secretary Menard Guevarra, when all pending bills are consolidated into one bill, then certificate of urgency will be issued,” Dureza told MindaNews.

Bai Sandra Sema, Deputy Speaker for Mindanao said the President’s certification can be issued “anytime even after the bill has been filed.”

Sema told MindaNews late Thursday afternoon (August 17) that the draft BBL had just been received by the Secretary General of the House and “was immediately transmitted to the Speaker’s Office.”

“Congress is the policymaking body of the Republic of the Philippines. Its duty is not only to honor the commitment of the Government to the Bangsamoro but also to express the will of the Filipino people in the form of the law. As a leader of the Bangsamoro, I will see to it that our voice is heard, our sentiments are expressed, and our aspirations realized. Inshaallah,” Sema added.

Last Friday, Sema said the draft BBL was still in Alvarez’ office and that “we will know next week” who will be its authors.

BTC chair Ghazali Jaafar declined to comment on the non-filing as yet of the draft BBl into House and Senate bills. “No comment muna ako,” he told MindaNews Thursday afternoon.

process that will secure their identity and posterity and allow for meaningful selfgovernance.”

“Bangsamoro country” “Within the context of the Republic of the Philippines, there shall be a B angs amoro count r y,” Duterte declared on July 17, after receiving a copy of the draft BBL. Duterte committed to “support and husband” the proposed BBL in Congress to ensure its passage.

But nowhere in his speech did Duterte mention the CAB. He reiterated “there will be no objections (to) the provisions of all that is consistent with the Constitution and the aspiration of the Moro people.”

“I am for this. Within the context of the Republic of the Philippines, there shall be a Bangsamoro country,” Duterte said.

Congress under the Aquino administration adjourned in 2016 without passing a Bangsamoro law.

after their respective committee hearings, both titled Basic Law for the Bangsamoro Autonomous Region (BLBAR), which the MILF and even the government peace panel then agreed did not comply with the CAB and instead envisioned a Bangsamoro less autono-

mous than the ARMM it sought to replace.

The draft BBL was crafted by a 21-member Commission, 11 nominated by the MILF and 10 by the government. Lumads (Indigenous Peoples) in the proposed Bangsamoro core territory are represented in

the Commission along with three representatives from the Moro National Liberation Front under Yusoph Jikiri and Muslimin Sema.

Professionalizing the gov’t Civil Security Unit

About 100 security professionals are expected to attend the general membership meeting in Cagayan De Oro City come August 25, 2017. These people are mostly retired senior military and police officers who band together as members of the Philippine Society of Industrial Security, Inc. (PSISI).

Some civilian members are security officers, managers, and consultants of private security agencies in the city. One of the qualifications is to first become a certified security professional (CSP). Becoming a CSP is passing a paper and pencil examination supervised by PSIS and CSP board

from Manila. The CSP exam could be taken only after one undergoes a five-day seminar/workshop.

Even the retired and active military officials are still required to undergo the workshop and passed the CSP exam before being admitted to the close-door PSISI whose members are professional security men.

By the way, the PSISI/ CSP monthly general meeting talks about current security concerns.

In Cagayan De Oro City, the conflict in Marawi remains the top subject because as security professionals and managers of private security firms, the security of the lives and properties

are of primary concern.

Although Marawi City is about 130 kilometers from Cagayan De Oro City, the conflict there directly and indirectly affects the general security condition of its neighboring cities and provinces. Thus, the security professionals are keeping an updated information about the security of the Marawi while conducting an up-to-date assessment of the security situation.

The latest to happen was a man who jumped from a high rise building and was declared dead upon reaching the pavement. Not so long ago, a man also took his own life after he was reportedly driven off by his girlfriend. Some of the reasons are hardship in life, love affairs, cheating in marriage, etc. I am calling our religious groups to please spy on people who are facing the blank wall on their problems. Talk to them and give them help until he is back to his senses and save his life. Another thing that is taking place in our city is the recent stabbing incidents caused by drunkenness. People end their friendship after

they become drunk, they quarrel and resort to killing each other with knives.

The second principle is that the school must produce students with a high curiosity and can find a way of learning. Teachers or lecturers should be able to guess about it or students about the nature of their learning so that they can learn effectively and efficiently.

The third principle is that teachers or lecturers understand it more on selfevaluation or self-evaluation. So, the lecturer is not an absolute super-appraiser.

The advantages of each individual student or student should not be ruled out. This is an important principle in class and learning.

The principle is the feeling and also knowledge, important in the learning process. Teachers or lecturers should have a lot of knowledge or variety. By understanding the variation of learning strategies, teachers or lecturers are able to cultivate their feelings to apply each strategy on a contingency basis.

Monotonous in teaching means killing the traits of the students’ motivation.

This principle is mandatory, but it is often forgotten.

The last principle is the learning process that is best in a non-threatening environment. Teachers or lecturers should be able to grow a class or learning atmosphere that is not frightening. Teachers or lecturers should be able to provide a comfortable and warm learning atmosphere.

In essence, there is no gripping moments that make the students fear. Good teachers or lecturers are those who can provide a comfortable condition.

PNP should publicize “orders of battle” on drugs LIFE’S INSPIRATIONS: “… I keep my eyes always on the LORD. With him at my right hand, I will not be shaken…” (Proverbs 16:8, the Holy Bible).

-oooPNP SHOULD PUBLICIZE “ORDERS OF BATLE” VS. DRUG SUSPECTS: To avoid incredulity about claims by the Philippine National Police that the persons being killed in the course of its deadly anti-illegal drugs campaign are involved in drugs, it should take the initiative of immediately publicizing its dossiers or its so-called “orders of battle” specifically naming their supposed “high value targets”.

This way, those truly involved in drugs could either leave, or stop their nefarious trade altogether, to avoid being killed in the on-going “tokhang” operations. Or, the innocent ones whose names appear in the list can perhaps seek the aid of the courts to clear their names right away. The objective here is transparency and, of course, putting an end to drugs.

President Duterte already did this anyway,

even if only partially. If the President did disclose some names at the start of his fierce campaign on drugs, why can’t the police do the same thing? Doing this should compel them to be more careful in their operations, and therefore stop inflicting “collateral damage” against ordinary and law-abiding citizens.

-oooPUBLICIZING “ORDERS OF BATTLE” SHOW PNP SINCERITY IN DRUG CAMPAIGN: Police publicizing their dossiers or “orders of battle” will also put an end, or somehow lessen, criticisms that their “tokhang” operations constitute “extra-judicial killings” of drug suspects in order to silence them, to prevent them from spilling the beans on their cohorts.

I know this is skewered reasoning but if and when the people in the dossiers or “orders of battle” are killed, the usual police excuse for the death of the suspects---that they are into drugs---would somehow become more acceptable, and would not cause an uproar similar to the uproar generated by the death of

the Caloocan City student Kian Delos Santos.

The police should do this now---publicize its dossiers and “orders of battle”, that is---to show its sincerity in its campaign against illegal drugs. The situation would become vastly different if anyone, whether a single individual or a group of people, would later summon the courage to file a petition with the Supreme Court to compel the police to make that disclosure.

-oooDUTERTE’S LIST SHOULD BE MADE PUBLIC, TOO: And, while we are tackling the issue of disclosures of dossiers and “orders of battle”, I think the same thing should be done with respect to the list of President Duterte. I believe that it would also be to the best interest of the country and its people if the contents of that list would also be publicized in full.

Of course, the list may not be 100% accurate and may hurt reputations, but it would be better to let the people whose names are in that list to know they are in the list! That way, they

could be moved to either confess and then cut clean, so to speak, or avail of legal remedies to correct their inclusion in that list.

A disclosure of that list should then prompt some kind of a lifestyle audit of the personalities that are being connected with the trading of illegal drugs.

This audit should focus on an examination of the sources of income of the persons in the list side by side with an inquiry into his assets and properties.

This should tell us whether those in the list are living within their means or are being supported by illicit income!

In the coming years, all heads and senior staff of the government’s Civil Security Unit (CSU) would be required to have CSP and PSISI accreditation. Aside from having CSP security heads, the government security guards would be strictly required to obtain licenses.

This is one project that the CSP and PSISI in Northern Mindanao should push in order to get an accreditation with the Civil Service Commission (CSC). By then, the CSC would require government offices in the national, regional, and local government units (LGUs) to hire only CSPs to head the government’s CSU. The idea of pushing the legislation is to professionalize the government CSU.

By doing so, the government CSU would be rid of employees who are hired only because of political consideration. In other words, the CSU would no longer become a security office of workers who worked like “goons.” While some of the existing CSU heads

of government institutions are retired military personnel, these CSU heads are not qualified because they have no idea what “security administration” is all about.

ECOP to submit ‘employer’s version’ of contractualization bill to Congress

The Employers Confederation of the Philippines (ECOP) has expressed anew concerns over certain provisions in 25 pending House of Representatives bills tackling the issues of contractualization and workers’ security of tenure.

The ECOP Technical Working Committee met August 17 to further firm up the association’s position over “questionable or objectionable prescriptions” in some of these House bills pending deliberation before the House Committee on Labor and Employment.

ECOP said it is currently drafting an “employer’s version” of the bill on contractualization and security of tenure to be submitted to the committee upon the request earlier of committee chair Rep. Randolph Ting.

The organization has listed at least 10 provisions contained in these bills that it claimed contradict “fundamental legal principles governing these two issues.”

Among these bills is House Bill No. 55 prohibiting the principal from engaging subcontracted employees in excess of 20% of the principal’s total workforce.

The group objected to the bill as constituting “undue interference in management prerogative and best business judgment to contract or outsource jobs based on its constitutional right and freedom to contract.”

House Bill No. 55 also prohibits subcontracted employees from performing work directly related to the main business of the employer.

ECOP countered that work contracted out is always directly related to employer’s main business.

“It is a fundamental principle in case law that all forms of contracting and subcontracting of work by the employer under Article 106 of the Labor Code are invariably directly related

Philippine President Rodrigo Duterte is asking Congress to appropriate P4.2 billion so the Bureau of Customs (BOC) can hire more than 3,000 personnel-or double its current workforce-next ye year, Senate President Pro Tempore Ralph Recto disclosed.

The chief executive’s request is included in the “President’s Budget Message” for fiscal year 2018, which explains and distills the highlights of the proposed national budget, Recto said in a statement.

In his message to Congress, Duterte said he is seeking P3.6 billion as BOC’s budget for 2018.

The money, he explained, will be used “to implement an aggressive campaign against smuggling which deprives us, on average, of more than P165.5 billion in potential revenues yearly.”

Duterte enumerated the anti-smuggling activities to be funded by the proposed appropriations, including “the enhancement of cyber security for all ports, and the acquisition of speedboats, firearms and other tacti-

cal equipment for better revenue collection.”

On top of the P3.6 billion for BOC operations is a separate P4.2 billion to be lodged in a “special purpose fund” of the budget for recruiting more personnel, Recto said.

“In addition to the BOC’s budget, we have tucked in an additional P4.2 billion under the (Fiscal Year) 2018 Misc e l l an e ou s Pe r s on n e l Benefits Fund (MPBF).

This will finance the BOC restructuring, to fill up its more than 3,000 vacant positions, capacitate personnel, improve systems and modernize facilities,” Duterte said.

Recto said his research showed that of the 6,264 authorized permanent positions in the BOC, only 3,031 are filled, leaving a vacancy of 3,233.

“These are the items the Palace wants funded and filled,” he said.

Recto said he is supporting Duterte’s request “if it is linked to reforms and measurable productivity goals.”

books distributed, families given health insurance will be financed by BOC collections,” Recto said.

“The government will not be able to deliver on its promises to the people if its second biggest supplier of funds is broken, malfunctioning and damaged,” Recto remarked, adding that with the resignation of some high BOC officials, a new team may have to be appointed.

“These must be competent and ethical people, knowledgeable of the intricacies and culture of Customs operations, because the country cannot afford OJTs (on the job trainees) on training wheels being appointed to such a crucial job,” he said.

Customs Commissioner Nicanor Faeldon earlier said BOC will start filling around 3,000 vacant positions in the customs bureau. To ensure competent and “incorruptible” people will be hired by the agency, a Customs Academy has been set up to train applicants starting October this year before they are hired as customs personnel. -- www.portcalls.com

“In the industry and services sectors, we have outlined strategies for greater backward linkage with domestic firms and forward linkages with global firms,” said Socioeconomic Planning Secretary Ernesto Pernia.

Pernia also hoped the private sector, especially the medium and large enterprises, would take the initiative to link up with the micro and small enterprises.

He said priority strategies for agriculture, industry and services sectors are outlined in the Philippine Development Plan (PDP) 2017-2022.

“These strategies will be backed by a comprehensive public investment program, but then again, we need the support of the business sector and civil society to make these work,” he said.

In the agriculture sector, Pernia, also the National Economic and Development Authority (NEDA) DirectorGeneral, said the priority

strategies are diversification into high-value crops and greater value-adding activities.

“The goal is to increase the income of farmers and fisherfolk,” he said.

The Department of Agriculture (DA) has already launched a website showing a color-coded agricultural map that lists the crops that are appropriate for a certain location given soil quality and weather patterns.

The NEDA chief said next step is to teach farmers how to make the map work for them.

“We are hoping that the private sector can reach out to other farmers’ groups and associations, and introduce new technologies on further improving their productivity and adding value to their raw produce,” he added.

The Philippine economy expanded by 6.5 percent in the second quarter of 2017 from 6.4 percent the previous quarter, supported by higher government’s spending and a rebound in the farm sector.

Stakeholders hold Caraga congress for sustainable organic agriculture

BUTUAN CITY – Farmers, agricultural extension workers, local government representatives, researchers, exhibitors and members of the academe recently convened here for the 3rd Regional Organic Congress (ROAC) carrying the theme “Go Organic: Sa Organikong Pamamaraan, Ligtas ang Mamamayan!”

The congress aims to mainstream organic agriculture regionwide and encourage practitioners to obtain the Third-Party Certification in order to gain better access to domestic and foreign markets.

According to National Organic Agriculture Board (NOAB) member Jimmy Geronimo, the Department of Agriculture (DA) together with organic agriculture stakeholders should envision not just the five percent conversion to organic farming but also that every household should practice and be an advocate of organic agriculture.

PGS are locally focused quality assurance systems which certify producers based on active participation of stakeholders and are built on trust, social network and knowledge exchange.

Davao’s 1st shrimp processing plant opens DAVAO CITY -- Davao Region’s first processing plant for shrimp products set to create employment for over a hundred Dabawenyos opened Friday at the Davao Fish Port Complex in Toril, this city.

Anderlude Seafoods Corp. Chief executive officer Ludevito Batilong said the plant process packs of tempura (nobashi ebi), headless shrimps, whole shrimp which the company will supply to domestic market all over the country.Batilong has a foreign investor, Anders Haagen who is from Denmark.

The company grows shrimps in 45-hectare area in Dumoy, Toril. It has a 14-hectare area farm in Coronon, Sta. Cruz, Davao del Sur and 68 hectares in Hagonoy, Davao del Sur. The total production in these aeas is at 142 to 180 tons every month. It has leased some 600 sq. meters area in the fish port. Of the total area, 300 sq. meters is dedicated to the processing facility which process 3 tons of the products daily in a single shift.

According to Batilong, there is a big demand of the products in the country.

The requirement in Davao City alone from Monday to Thursday is five tons daily and goes up to 10 tons on Friday to Sunday.

He also said that the company already had a purchase order of 2.5 million pieces of processed shrimps for delivery next month to a Manila buyer.

There is great potential in this industry, he said, especially now that seafood preference among consumers is increasing. Batilong said he will first concentrate on the distribution of their products within the country, targeting small restaurants and eateries to patronize their products like the tempura.

“We wanted to teach this small eateries how to prepare the food and for them to offer good food like the tempura to ordinary people as we deliver the ready to cook shrimp in the morning and collect payment the next day,” he said.

He said he would also be helping this small businesses earn additional income by offering the product at affordable price of PHP5 per piece for a shrimp of five inches in size. The company is also eyeing malls, restaurants and other institution.

As of latest report, there are 9,611 identified wasted and severely wasted elementary school pupils in the province.

In addition, the central kitchens that will be put up will also play a significant part on the disaster preparedness program where it could provide freshly cooked meals for victims during catastrophe.

Grab mulls expanding operations in Davao DAVAO CIT Y -- Grab Philippines is mulling on expanding its GrabCar operations in Davao City which is now under study if it’s feasible amid a good taxi system here.

Leo Gonzalez, head of the Public Affairs, said Grab is testing the environment in Davao City if Davaoenos are ready to pay higher fares for a more convenient ride.

Gonzalez stressed the company is looking more on the demand side under such operation. He said the company has already expressed interest with the Land Transportation and Franchising Board (LTFRB) to operate in the city.

GrabCar is a car-booking application that dispatches

private vehicles. The app has high demand in Metro Manila.

Grab has been operating in Davao City since 2014 when it partnered with taxi operators and drivers in Davao for GrabTaxi.

Jose Thor Villarreiz, Grab Davao Manager, said there are now 1,300 Grab-a-Taxi drivers still using the Grab platform averaging about 500 drivers active per day.

When Grab started in Davao City there were about 2,600 because of the incentives they offered to establish the brand.

Meanwhile, on Friday, Grab Philippines revealed it has already accepted 100 drivers from Uber as of Friday, August 18, after

the Land Transportation Franchising and Regulatory Board (LTFRB) allowed transport network vehicle services (TNVS) units to transfer to two other accredited Transport Network Companies (TNCs).

Grab Philippines Country head Brian Cu, however, is not sure how many will be joining Grab. “It is yet to be seen,” Cu said when asked how many the company would take in.

Cu, who was here for the 32nd Kadayawan sa Dabaw, said Grab will just submit a list to LTFRB daily until his company will be told it is enough. The submission of a list is required by LTFRB. On Thursday, LTFRB released Board Resolution

School (DCNHS) Special Program in the Arts and the Sagayen National High School Performing Arts of Asuncion town, Davao del Norte bagged the major prize in the Davao City school-based category and the open category, respectively.

It was a big comeback for DCHNS, which bagged PHP500,000 in cash prize plus trophy. It also bagged PHP15,000 for best music. Sagayen National high

School won the P700,000 cash prize.

Sagayen’s performance showed the richness of the town where many banana plantations are located.

It is also opposed to HB No. 76 and HB No. 4444 that seek to prohibit or restrict fixed term employment and contractualization.

Aside from transgressing the right of employers to exercise prerogative and best business judgment to contract, disallowing fixed period employment “violates the freedom of contract of both parties who knowingly, willingly and without any moral pressure gave their consent to the execution of the contract guaranteed by the Constitution,” said ECOP. HB No. 563, on the other hand, authorizes the Secretary of Labor and Employment to ban all private companies from engaging in contractualization.

“To reiterate, it is the proprietary right of employers to exercise an inherent prerogative and its best business judgment to determine whether it should contract out performance of some of its work to independent contractors,” stressed the group.

Also on ECOP’s list is HB No. 895 outlawing contracting out of jobs if this causes the termination of services or reduction in the number of regular employees and the splitting up of the bargaining unit.

ECOP insisted that job contracting may replace the services of regular workers, as ruled in the case of Asian Alcohol Corporation vs. NLRC et al., G.R. No. 131108, March 25, 1999.

The decision on the case reads in part, “We have previously ruled that reduction of the number of workers in a company made necessary by the introduction of the services of an independent contractor is justified when the latter is undertaken in order to effectuate more economic and efficient methods of production.”

As for HB No. 1208 which stipulates a fine of P1 million to P10 million for violating its provisions, ECOP said: “Excessive fines especially if imposed on employers of micro establishments (are) violative of Sec. 19 of the Bill of Rights of the Constitution which prohibits the imposition of excessive fines.”

The certification, like the Arrest Orders, was issued to the Chief of Staff of the Armed Forces of the Philippines, Chief of the Philippine National Police, Commandant of the Philippine Coast Guard, Direct of the National Bureau of Investigation and Commissioner of the Bureau of Immigration.

He also said that when Solitario was in hiding, ‘he continued to provide inputs on how to address the problem. And he committed to help now. So let’s see if he delivers otherwise we can put him back on the list.”

On Sunday afternoon, the OPAPP emailed a seven-paragraph statement, where he repeated what he said in his text message to Lorenzana.

He added Solitario, after he was named in the arrest orders, informed him that he left Marawi City “and stayed in a safe sanctuary outside the city but he kept in touch making suggestions on how to deal with the developing incidents.”

Dureza said Solitario was “distressed” with the inclusion of his name in the arrest orders.

“At one time, when the President was in Cagayan de Oro monitoring Marawi, I arranged his phone call with the President. The President told him over the phone that he instead should talk to me. So I continued handling him,” Dureza added.

He said he was later informed that there was an arrangement for Solitario to meet with Lorenzana “to discuss how he could help government” and because his name was still in the arrest order and in order to enable him to attend the meeting with Lorenzana in Iligan or Marawi, “I recommended that a clearance from the SND (Secretary of National Defense) be issued to allow him to safely travel to meet the SND for the purpose considering there were AFP checkpoints and his name was on the arrest list.”

Dureza said he spoke with Lorenzana and was told that a clearance for Solitario “was being issued, including his two sons.” Dureza said he made no recommendation for Solitario’s sons “as I did not know them and their activities.”

He said that during a Cabinet Security Cluster meeting in Camp Aguinaldo, he was furnished copies of the clearances signed by Lorenzana and that he “e-mailed the copies to former iligan Mayor Franklin Quijano to pass them on to Omar Solitario.”

He said he “also later called Solitario that he

should directly arrange the planned meeting with SND as OPAPP does not get involved in AFP operational matters..”

The Marawi Crisis entered Day 90 on Sunday.

On Solitario’s alleged involvement in illegal drugs, “if there is evidence, then he has to face the charges,” Dureza said on Saturday night.

Before his name was listed under Arrest Orders 1 and 2, Solitario was also on Duterte’s list of persons allegedly involved in illegal drugs which the President read during a wake at a military camp in Davao City on August 7 last year.

Solitario denied allegations he was engaged in the illegal drugs trade.

During the first martial law under then President Ferdinand Marcos, Solitario was a commander of the Moro National Liberation.

ZAMBOANGA CITY -A suspected drug pusher was killed while five others were arrested in separate anti-illegal drug operations in this city, police officials announced Saturday.

Slain was Mercedito Luna, 31, a resident of Barangay Putik, this city.

Supt. Mark Azur, Police Station 5 chief, said Luna was killed in a buy-bust operation at around 9 p.m.

Friday in Barangay Putik.

Azur said that Luna pulled and aimed his handgun upon sensing the persons he was transacting with illegal drugs are policemen.

But Azur said Luna was killed as one of the two policemen was quick to draw and opened fire before Luna managed to pull the trigger of his handgun.

He said the Scene of the Crime Operatives (Soco) recovered from the scene a caliber .357 revolver with six rounds of ammunition, P200 marked money and a sachet of suspected shabu.

He said the suspects were detained pending the filing of appropriate charges against them.

ZAMBOANGA CITY -First district Rep. Celso Lobregat on Saturday, Aug. 19, led the inauguration and turnover of the P11.3 million school building project in this city.

The project, which consisted of two buildings with four classrooms each, was constructed at the Don Pablo Lorenzo Memorial Senior High School in Barangay Sta. Maria, this city.

The school buildings were constructed by a private contractor under the supervision of the Department of Public Works and Highways (DPWH) district engineering office.

The construction of the two school buildings was initiated by Lobregat and funded through the Department of Education (DepEd)

School Building Program.

Lobregat advised the school officials and students to put to good used the new school buildings given them.

The completion of the project has increased the number of classrooms to 48 in Don Pablo Lorenzo Memorial Senior High School.

It also reduced the classroom-student ratio to 24 from 29 per classroom. The school has 1,180 students.

City Schools Division Superintendent Felix Romy Triambulo has thanked Lobregat for initiating the project.
