COWD: Water supply in Oro remains precarious DOT, DENR to inspect resorts in coastal areas

HE Cagayan de Oro City Water District (COWD) has cautioned that the city’s water supply remains precarious despite measures being taken to address the problem.

“Our present supply from all sources is just enough to meet demand,” said Engr. Bienvenido V. Batar Jr., COWD Acting General Manager. “If any of our wells go down for repairs, it would immediately result to disruptions in water service.”

Not only both Gaid and Ebsolo are classmates, but they were in the police service for 20 years.

In his speech, Gaid thanked Mayor Jennie Uy for her strong support to the Municipal Police Station of Villanueva--and to his

fellow police officers.

On the other hand, Ebsolo said he was elated after he was given the chance to serve the people of Villanueva. He vowed to continue whatever programs that his classmate has left.

4Ps pay-out this April

Cagayan de Oro City -- The Department of Social Welfare and Development (DSWD) is set to pay the cash grants of Pantawid Pamilyang Pilipino Program (4Ps) beneficiaries through the Land Bank of the Philippines (LBP) this April.

Pay-out will start on April 17 until the 27th day of this month.

The synchronization of payouts of 4Ps grantees with the beneficiaries of the 2018

Unconditional Cash Transfer has caused the delay of the payment of cash grants of 4Ps grantees, who are set to receive the grants for their compliance of the conditionalities in December 2017 and January 2018 under Period 6.

The UCT is a component of the national government’s Tax Reform for Acceleration and Inclusion (TRAIN) program that aims to assist indigent Filipinos that will be

affected by the rising prices because of the implementation of the new tax reform program.

As stipulated in the TRAIN act, DSWD will implement the UCT scheme for three years. It will release P2,400 (P200 per month) in 2018 and a total of P3,600 (P300 per month) in 2019 and in 2020. P24 billion has been earmarked for the 2018 UCT implementation in the FY 2018 GAA.

As it is, ten million households/individuals will receive the UCT. Of this figure, 4.4 million are Pantawid Pamilya beneficiaries.

DSWD has already paid the 1.8 million 4Ps beneficiaries with cash cards last 31 January 2018. The remaining 2.6 million Pantawid Pamilya beneficiaries without cash cards will receive the grants through partner conduits this April.

The three million indi-

gent senior citizens who are beneficiaries of DSWD Social Pension Program are among the beneficiaries.

The remaining 2.6 million households will be selected from the Listahanan or National Household Targeting System (NHTS-PR) which will go through validation.

Payouts for 4Ps beneficiaries is set every two months.

Northern Mindanao has more than 270,000 households 4Ps beneficiaries.

Establishment of loading, unloading areas at coastal road sought

CAGAYAN DE ORO CITY, April 6 -- The City Council committee on roads and traffic management started discussions on Resolution No. 038-2017 of the Barangay Council of Barangay Lapasan, Cagayan de Oro City urging City Vice Mayor Raineir Joaquin V. Uy to establish loading and unloading area at the coastal road near Sitio Lambago, Lapasan.

According to barangay officials, there is a need to establish the loading and unloading area for the protection and convenience of both motorists and commuters.

Committee Chairperson Councilor Roemo V. Calizo, however, said the requesting party should specify the reason for the proposal, such as the complaints of residents or tourists, among others.

These will be the basis of the committee to tackle the said request,he clarified.

DTI activates Operation Timbangan during Panaad 2018 CAGAYAN DE ORO CITY, April 6 -- The Department of Trade and Industry (DTI) in Camiguin island intensified its Operation Timbangan or the checking of calibration of weighing scales to safeguard consumers’ interest during their observance of Panaad 2018.

This activity was undertaken in cooperation with other agencies that formed t he comp osite team, such as Philippine National Police, the Treasurer and the Municipal Agriculture of the Local Government Unit, and a Consumer Organization in the province.

ILIGAN CITY, April 6 (PIA ICCC) – The Vietnamese government turned over 8000 bags of rice at 25 kilos per bag as aid to internally displaced persons (IDPs) of Marawi siege in a ceremonial turnover held at a warehouse of the Department of Social Welfare and Development (DSWD) in Iligan City, April 5.

A pledge was made by Vietnamese President Tran Dai Quang during his bilateral talks with

Tension feared over illegal selling of ‘Sendong’ houses

Worrying wouldn’t help…

LIFE is better than ever, so why does everybody seem to be unhappy? As a regular reader of this column, you surely remember this topic which I already raised several times.

Whenever I hear people saying that things turned so bad nowadays, I think of my late LOLA, born in 1899 (!) into a really awful world in Germany and its surroundings. Also the socalled “Golden Twenties” between two World Wars have been everything but golden for her and my former relatives. Lola never complained, even during the sorrowful times in the former East German, the “German Democratic Republic”. Lola reached the ripe old age of almost 86.

We hardly count our blessings. We enjoy counting our crosses. Instead of gains, we count our losses.

We don’t have to do all that counting - computers do it for us. Information is easily acquired.

Facebook to and fro, back and forth, there and back - how many posts and comments have been posted already with sadness, loneliness, boredom strikes, problems, worries....

Just remember this:

Opportunity doesn’t just knock - it jiggles the doorknob. And “your social media online-friend” - the worrier, is with you day and night, at every corner, following your every step.

Complaining and grumbling are good excuses, right?

Is social media bad for us? Three billion people, around 40% of the world’s population, use online social media – and we’re spending an average of two hours every day sharing, liking, tweeting and updating on these platforms, according to some reports. That breaks down to around half a million tweets and snapshot photos shared every minute.

Stress, mood, anxiety, depression, sleep (or better non-sleep), self-esteem - Overall, social media’s effects on well-being are ambiguous, according to a paper written last year by researchers from the Netherlands. However, they suggested there is clear evidence for the impact on one group of people: social media have a more negative effect on the well-being of those who are more socially isolated.

and opportunities to do almost anything. So why haven’t we done it? We have the freedom of bondage or restraint, every one of us in his or her very special, unique way - but, we’re still our old inferior selves.

The job is boring. I don’t get a good job. The house is an unpleasant mixture of tidy and dirty things. It’s a mess. I’m not in the mood to arrange my garden. I can’t afford a gardener. That’s life. How sad. No, it’s not my fault; or course not.

The whole world is an awful place filled with dreadful and horrible negativism. Yes, I confess, I’m also surrounded by many worries who put their fears into me. Politicians, i.e., many times love to search for some grave alarm that will cause individuals to abandon their separate concerns and act in concert, so that politicians can wield the baton. Calls to fatal struggles and fights are forever being sounded.

The over-bearing person, who tyrannizes the weak, who wants to domineer and to bluster, is simply nothing else than a worrier, who claims to be a friend. But he isn’t. Really

Well, when will we start counting our courage and not our fears, or enjoy instead of our woe? Worrying itself is pointless.

Of course, no society has achieved perfectly rules of law, never-ending education or unique responsible governments. Let’s seek out the worries, but avoid the worriers, because they try to avoid liberty.

On establishing a federal system in the Philippines QUEZON City––The Consultative Committee organized by President Rodrigo Duterte is presently designing a federal structure for the country which he plans to announce in his State of the Nation address in July.

In this context, an exchange in the 1986 Constitutional Commission between Comm. Blas Ople and Comm. Ricardo Romulo on the nature and depth of local autonomy is worth recalling: “MR. OPLE. I think what we want to establish is a kind of maximum decentralization, short of federalization, at this moment in history.

ROMULO. That sounds like someone being half pregnant.

OPLE. No, that is what local autonomy ought to mean.

ROMULO. That is what I am trying to say. Is the Gentleman talking of local autonomy or is he talking of federalism?

OPLE. Local autonomy, Madam President.” (Record of the Constitutional Commission, Volume 3, August 11, 1986, pp178-179) The phrase, “a kind of maximum decentralization, short of federalization”, is how local autonomy under

the 1987 Constitution must be understood. This means the current local autonomy framework established in Article X already has federal features. I am referring to the revenue-raising power sections (5, 6 and 7) and the “consolidation of efforts” sections (13 and 14).

But the non-federalist aspect of these provisions is represented by the fact that these prescriptions are not immediately enforceable. To be implemented, they either need an enabling law or the initiative of the President.

Indeed, Section 3 provides that, “Congress shall enact a local government code which shall provide for a more responsive and accountable local government structure instituted through a system of decentralization”.

Pertinently, according to the Supreme Court, “Autonomy, in the constitutional sense, is subject to the guiding star, though not control, of the legislature, albeit the legislative responsibility under the Constitution and as the ‘supervision clause’ itself suggest-is to wean local government units from over-dependence on the central government.”

The sad fact is Congress has failed to meet this man-

date. Local governments are still utterly dependent on Malacañang despite the enactment of the Local Government Code of 1991. And this provision, which requires a local government code to establish a system of decentralization, is the very reason why our local autonomy framework is not federal.

Fundamentals of the federal system According to Ronald Watts, considered as the preeminent authority on federalism, “The key is not the degree of decentralization, but the degree of constitutionally guaranteed autonomy that the constituent units may exercise.”

Therefore, in designing the federal set-up for the Philippines, the autonomy of the regional government must be self-evident in the new federal charter. We do not want a repeat of the, “a kind of maximum decentralization, short of federalization”, structure in the 1987 Constitution.

Simply put, there should be no need for an enabling law to operationalize the federal system.

Moreover, for the federal system to work the regional government structure itself

must be configured to facilitate a community-oriented governance mindset. Pertinently, a regional government framework meeting this requirement is found in the proposed Bangsamoro Basic Law. Accordingly, the regional governance structure in the new federal constitution must be parliamentary with members elected through single-member legislative districts and through political party representation.

The chief executive of the regional government shall then be elected by the regional parliament from its ranks.

Members of the regional executive cabinet shall also be members of the regional parliament. However, nonmembers may be designated to a cabinet post subject to confirmation by the regional parliament.

One necessary change that must be made here is to remove the supervisory power of the president over the regional executive and over local government units. This institutional link undermines the autonomy of the subnational level of government. Indeed, it is a peculiar facet of See FEDERAL, page 15

revealed over the weekend that for several weeks now, a joint team from her office and the Department of Environment and Natural Resources (DENR) have conducted inspections on beach resorts in the region.

The first wave of their inspections were in the beach resorts from Opol to Laguindingan in Misamis Oriental. The second wave, which will happen by the end of this month, will be in tourist-rich Camiguin, according to Unchuan.

Unchuan said that during their initial inspections, they have discovered that there are some beaches in the province which could have violated nobuild-zones. But Unchuan refused to identify those resorts, saying she needs to deliberate first with her DENR counterpart, regional executive director Arleigh Adorable, to determine the exact scope of their violations.

When pressed on the matter in an inter view with this writer, Unchuan replied, “Naa g’yud, naa g’yuy naka-violate.”

She added that prior to the inspections, the resort owners were already aware that a portion of their properties sit on no-build-zones. “Existing man kana nga balaod ug guidelines, wala man

mi bag-o nga gidugang,” she said.

Unchuan said they are merely implementing a 2013 presidential directive mandating a no-buildzone policy 20 meters from the shoreline in high tide.

Then President Aquino had issued the directive in the wake of supertyphoon Yolanda that struck the country that year, killing thousands.

“The 20-meter easement will be for the safety of the tourists against storm surges and similar incidents,” she pointed out.

Prior to 2013, the coastal easement was only set at three meters, per Philippine Water Code guidelines.

Less than a month before the joint DOT-DENR team visits Camiguin, resort owners in the island province are not taking chances.

PPP projects gets boost with Normin PPP Corner Launch

THE government’s Build Build Build infrastructure initiative in Northern Mindanao received a big boost with the launching Thursday, 05 April 2018 of the Public-Private Partnership (PPP) Center Knowledge Corner2 at the Region X office of the National Economic and Development Authority(NEDA).

NEDA had previously said it expects Cagayan de Oro to become the Philippines’ fourth metropolitan center after Metro Manila, Cebu and Davao by 2025.

“We acknowledge the priorty programs and projects listed in our Regional Development Investment Program (RDIP) from 20172022 cannot be sourced from government coffers alone,” said NEDA-X Regional Director Leon M. Dacanay, Jr. during the program launch.

“Partnering with the private sector is another option which the region is eager to pursue in support of the implementation of capital investment targets worth P749.08-billion,” he added.

Dacanay said the PPP corner to widen the dissemination of information about

the PPP scheme especially among local government units (LGUs), particularly its advisory and technical services now these are within easy reach of its clients and stakeholders.

“We look forward to the preparation and implementation of more PPP proposals and projects, especially those focused on Mindanao such as water supply, septage/sewerage, schools and hospitals, among others,” he noted.

In his presentation following the corner’s launch, PPP Executive Director Ferdinand A. Pecson said there are now seven (7) PPP projects at the local levl in the pipeline ranging from water, solid waste management, energy, and public markets.

The PPP Center is currently providing its technical assistance for these PPP LGUs projects.

“This is a new pipeline that we are building. PPPs at the local level remain a considerable part of the PPP program where we hope to gain more traction and have PPPs address the vast infrastructure needs of the regions,” Pecson said.

Pecson identified these projects as the P128 million Cagayan De Oro Septage

Management Project; Los Baños Public Market Project (P110 million); Baggao Water Supply Project (P84.22 million), Quezon City Waste-to-Energy-Project (P16.56 billion); Pampanga Bulk Water Supply Project (P16.7 billion) and the Cebu City Solid Waste Management Project and General Santos Public Market Project whose project costs are yet to be determined.

The Cagayan de Oro Septage Management Project being implemented by the Cagayan de Oro City Water District (COWD) has already been approved for procurement under a solicited contractual joint venture scheme.

This PPP project involves the finance, design, construction, and operation of a septage management facility for Cagayan De Oro City. The project pre-feasi-

bility study was prepared

by United States Agency for International Development (USAID) under the Be Secure Project. The project concession period will be for 25 years.

Three (3) of these seven (7) PPP projects are under development meaning their completed projects studies are undergoing review by IAs or are undergoing studies. These include the Cebu City Solid Waste Management Project, the Los Baños Public Market Project, and the General Santos Public Market Project.

Developing PPPs at the local level is an ongoing strategy of the PPP Center to deliver the various infrastructure needs of the regions and help local governments deliver better services and improve the lives of Filipinos in the countryside.

M’danao’s growth to drive PH progress: WB exec DAVAO C IT Y - - T he growth and development of Mindanao could drive the country’s full progress if the government and other stakeholders succeed in unlocking the region’s potentials.

This prospect was expressed by World Bank (WB) Country Director for Brunei, Malaysia, the Philippines and Thailand, Mara Warwick, during the presentation of the Philippines Mindanao Jobs Report at the Marco Polo Hotel Davao on Friday.

Warwick underscored the need for the national and local governments, the private sector, and other players to be more focused, interconnected and coordinated in planning and implementing programs and reforms to unlock Mindanao’s potentials.

She said that in the long run, progress in the entire country deends on the growth and development of Mindanao.

“Mindanao holds about one-fourth of the country’s population and one-third of the total number of poor Filipinos. Therefore, significantly reducing national poverty hinges on reducing poverty in Mindanao.

Ensuring Mindanao’s prosperity benefits the entire country,” Warwick said during the launch of the report, which was made in collaboration with the Mindanao Development Authority (MinDA) and the Philippine Business for Social Progress (PBSP).

The 92-page report, a strategy on Mindanao’s development, outlines three

recommendations to speed up growth that creates more and better jobs and reduces poverty in the region.

Warwick said the report has gone through an extensive consultation process.

Following the study, she said, WB came up with three recommendations around three development areas.

She cited as an example, the country’s gross domestic product (GDP) per capita at USD2,953. However, in Mindanao, the GDP per capita is only USD1,800 while the Autonomous Region in Muslim Mindanao (ARMM) is only USD576.

“Such regional disparities are further reinforced by the human development indicators in Mindanao with the greatest challenge in ARMM,” Warwick said.

She said that more than half of ARMM’s population are poor and more than half of its employed population are in agriculture with 80 percent of them working as subsistence farmers, living precariously from crop to crop.

Grab vows no outright siphoning of Uber riders’ personal data

MANILA -- No personal information of passengers of ride-sharing firm Uber will be migrated to the platform of Grab once the former’s Philippine operations cease on April 8.

This, as Grab vows to ensure that the personal data of Uber’s passengers as well as its drivers will be protected.

“There is no acquisition of data. Even after April 8, no data will be shared.

There is no path for us to take Uber’s data. The data we received from Uber is upon consent only on the driver’s side,” Grab Philippines Country Head Brian Cu said in a press conference Friday, as the National Privacy Commission (NPC) conducts its investigation on the impact of Grab’s acquisition of its rival’s operations in Southeast Asia on data privacy.

“Drivers have to manually give consent and say ‘I’m okay to share this data’,” he added.

The NPC urged Grab to be transparent on what will happen with the personal data of around 1.2 million Uber account holders and to ensure that these are protected.

“Our intention is neither to hinder any legitimate business exchange, nor prevent the public from using the services of Grab, so long as personal data privacy is respected and protected. The NPC is closely looking into this deal given consumer fears that the company’s dominant market position might lead to possible abuses in how it processes personal data,” Privacy Commissioner Raymund Liboro said.

Eastmincom backs possible resumption of GRP-NDFP talks DAVAO CITY -- The Eastern Mindanao Command (Eastmincom) has assured support to the possible resumption of the stalled peace negotiations between the government and the National Democratic Front of the Philippines (NDFP).

This came amid the recent attacks in Davao City and Davao del Norte where the New People’s Army (NPA) rebels burned the heavy equipment used in the construction of access roads in the remote areas.

On Tuesday, President

Rodrigo Duterte said he was open to talk again the Communist Party of the Philippines-NPA-NDFP but with certain conditions.

Eastmincom spokesperson Maj. Ezra Balagtey said it is the discretion of the President since he is the commander-in-chief.

“But of course, our commanders will be giving a situationer for the President to decide if he will pursue the peace talks or not,” he said.

Balagtey said whatever the decision of President

Duterte after he will receive the situationer, the Eastmincom will abide by it.

“There are many factors that are being considered and we will be supporting the President on the peace initiatives that he is pursuing,” he said.

Earlier, Duterte said in his speech in Bongabong, Oriental Mindoro the communist rebels should stop their hostilities if they want to resume peace talks with government.

MIAS 2018: All-new Suzuki Swift Dzire now looks more -uh- desirable

Suzuki Philippines has you covered as the company has just launched the all-new Swift Dzire at the 2018 Manila International Auto Show. Featuring a bolder exterior as well as a sleeker cabin, the newgeneration Swift Dzire aims to deliver the same fun factor of the Swift Hatchback albeit in a more practical and spacious packaging.

Unlike the previous generation which practically resembled its five-door brethren, Suzuki made the nextgen Dzire have a more unique look while retaining key design features. Starting with the front fascia, the Dzire gets a black front grill with a thick chrome trim. There is also the new front bumper which comes with bigger foglights and additional chrome accents.

Topping it all off are the sleeker headlights which have been slightly redesigned for the four-door Dzire. Like the hatchback, Suzuki was able to imbue the Dzire with soft curves as well as sharp angles which makes it stand out from the rest.

Compared to the hatchback’s sloped roofline, the Dzire has a more rounded design which makes it have a more conventional appearance. Finally, the four-door Dzire comes with longer rear quarter panels, upswept taillights and the distinct short trunk. In terms of size, the Swift Dzire measures 3995mm long, 1735mm wide, 1515mm tall and has a 2450mm wheelbase.

Base models only get a 2-DIN audio system with AM/FM radio, CD and USB. Under the hood is the 1.2-liter K12M four-cylinder engine

carried over from the previous generation.

It puts out 82 PS at 6000 rpm along with 113 Nm of torque at 42000 rpm. The engine can then be saddled with either a five-speed manual gearbox or a fivespeed automatedmanual transmission (AMT) called Auto Gear Shift (AGS).

From its namesake, it functions like an automatic transmission but benefits from a computer-controlled clutch that seamlessly changes gears.

Standard safety features available in the Swift Dzire include anti-lock brakes (ABS) with electronic brakeforce

distribution (EBD) and brake assist (BA), side impact beams, keyless entry and start (for AMT model only) and dual SRS airbags.

Electronic Nicotine Delivery Systems (ENDS) – any device such as electronic cigarettes (e-cigarettes), electronic shisha (e-shisha), and other similar devices, whether or not it is used to deliver nicotine and other components to the user through the act of vaping, that resemble the act of smoking or the outward appearance of smoking products.

f. Enclosed – being covered by a roof or enclosed by one or more walls or sides, regardless of the type of material used for the roof, wall or sides, and regardless of whether the structure is permanent or temporary.

g. Informant – any person who can give valid information on the violators of this ordinance.

h. Minor – any person below eighteen (18) years old.

j. Advertisement - any sign, model, placard, board, billboard, banner, bunting, poster, streamer, paint-on, light display, device, structure or representation, employed indoors, outdoors or visible from outside, wholly or partially to advertise or promote a tobacco product or ENDS to the public.

p. Sponsorship – any form of contribution to any event, activity or individual with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly.

Tobacco Products –products entirely or partly made of the leaf tobacco as raw material which are manufactured to be used for smoking, sucking, chewing or snuffing, such as cigarette, cigar, pipe, shisha/hookah and chew tobacco.

Tobacco Industry – comprises those persons and companies engaged in the growth, preparation for sale, shipment, advertisement, distribution and sale of tobacco and tobacco-related products.

Tobacco Industry Interference – a broad array of tactics and strategies used by the tobacco industry to interfere with the setting and implementation of tobacco control measures.

t. Vaping – the act of inhaling and exhaling vapor produced by any Electronic Nicotine Delivery System (ENDS) or other electronic device whether or not it is used to deliver nicotine to the user, and mimics the act of smoking.

ORDINANCE NO. 18-1211 AN ORDINANCE BANNING SMOKING AND VAPING IN PUBLIC PLACES AND CONVEYANCES AND REGULATING THE SALE, PROCUREMENT AND DISTRIBUTION OF TOBACCO AND VAPE PRODUCTS IN THE CITY OF KIDAPAWAN AND IMPOSING PENALTY FOR VIOLATION THEREOF. BE IT ENACTED by the Honorable Members of the Sangguniang Panlungsod in session, that Section 1. Title. — This Ordinance shall be known as the SMOKE-FREE ORDINANCE OF KIDAPAWAN CITY. Section 2. Declaration of Policy. – The 1987 Constitution of the Republic of the Philippines declares that the State shall protect and promote the right to health of the people and instill health consciousness among them.

Further, the republic, under the Framework Convention on Tobacco Control (FCTC), to which Philippines is a party, is determined to give priority to the right to protect public health and to promote measures of tobacco control based on current and relevant scientific, technical and economic considerations, and agreed to implement the measures provided in the treaty.

Section 3. Legal Bases: 3.1. Philippine Clean Air Act of 1999 (Republic Act No. 8749) declares the right of every citizen to breathe clean air, prohibits smoking inside enclosed public places including public vehicles and other means of transport, and directs local government units to implement the Act. 3.2. Tobacco Regulation Act of 2003 (Republic Act No. 9211) prohibits smoking in certain public places whether enclosed or outdoors in certain places; prohibits the purchase and sale of cigarettes and other tobacco products by and to minors and in certain places frequented by minors; imposes bans and restrictions on advertising, promotion and sponsorship activities of tobacco companies; and directs local government units to implement these provisions; 3.3. Civil Service Commission (CSC) Memorandum Circular No. 17, Series of 2009 prohibits smoking in premises, buildings and grounds of government agencies providing health, education or social welfare and development services such as hospitals, health centers, schools and universities and colleges; provides for specific requirements for designated smoking areas; 3.4. Land Transportation Franchising and Regulatory Board (LTFRB) Memorandum Circular No. 2009-036 provides that drivers and operators of public utility vehicles are responsible for preventing smoking in public conveyances and posting specified “No Smoking” signs in their vehicles; 3.5. Civil Service Commission – Department of Health Joint Memorandum Circular No. 2010-01 prohibits government officials and personnel from interacting with the tobacco industry and those representing their interests unless strictly necessary to effectively regulate, supervise or control the tobacco industry.

Section 4. Purpose. — It is the purpose of this Ordinance to safeguard public health and ensure the well-being of all its constituents by protecting them from the harmful effects of smoking and tobacco consumption, reduce potential exposure to tobacco, restrict its accessibility, and provide support and a conducive environment for tobacco users to quit; Section 5. Coverage. — This Ordinance shall apply to all persons, whether natural or juridical, whether resident or not, and in all public places, within the territorial jurisdiction of the City of Kidapawan; Section 6. Definition of Terms. — As used in this Ordinance, the terms below shall have the meanings ascribed to them in this section. Any words or terms not defined shall be given their plain and customary meanings, unless the context requires otherwise, and shall be interpreted in a manner consistent with the purpose and spirit of this Ordinance

Advertisement and promotion – any form of commercial communication, recommendation or action with the aim, effect or likely effect of promoting a tobacco product or tobacco use either directly or indirectly. For purposes of this ordinance, it shall likewise apply to Electronic Nicotine Delivery Systems (ENDS).

b.

Buffer Zone – is a ventilated area between the door of the DSA not located in an open space and the smoke-free area.

Law Enforcer – any person oriented, trained and educated regarding the provisions of this ordinance and duly deputized by the City Government of Kidapawan to implement the same.

Public conveyances- modes of transportation servicing the general population, such as, but not limited to, elevators, jeepneys, buses, multicabs, vans, tricycles and other similar vehicles.

Section 7. Prohibited Acts — The following acts are declared unlawful and prohibited by this Ordinance:

a. Smoking or vaping in public places and conveyances except in DSAs fully compliant with the provisions of Section 8 of this ordinance. b. Participation of officials and employees of the City Government of Kidapawan in events, activities, programs and projects sponsored or promoted by any tobacco company Section 8. Designated Smoking Area. DSAs shall strictly comply and adhere to the following standards: 1. There shall be no opening that will allow air and smoke to escape from the DSA to the smoke-free area of the building or conveyance; 2. The DSA shall not be located in or within ten (10) meters from entrances, exits or any place where people pass or congregate, or in front of intake ducts; 3. The combined area of the DSA and the buffer zone shall not be more than 20% of the total floor area of the building or conveyance.

4. There shall be no opening that will allow air to escape from the buffer zone to the smoke-free area except for a single door equipped with an automatic door closer. Such door shall be distinct from the door of the DSA, which is at least two (2) meters from the other.

5. No building or conveyance shall have more than one DSA; 6. Minors shall not be allowed inside the DSA and the Buffer Zone; 7. The DSA shall have the following visible and prominently displayed signages: 7.1.”SMOKING AREA” 7.2. Graphic health warnings on the ill-effects of tobacco use; and 7.3. Prohibition on the entry of minors.

8. Other standards and specifications as may be prescribed by Republic Act No. 9211 and Executive Order No. 26 dated May 16, 2017 of the Office of the President.

The City Building Official is mandated to conduct a regular inspection on the DSAs as to its compliance with the above-listed standards and thereafter issue the necessary Certificate of Compliance thereof.

Section 9. Areas/Places where smoking is prohibited.

1. Centers of youth activity such as playschools, preparatory schools, elementary schools, high schools, colleges, and universities, youth hostels and recreational facilities for minors; 2. Government Offices; 3. Plazas and parks and other places frequented by minors; 4. Elevators and stairwells; 5. Location in which fire hazards are present, including gas stations and storage areas for flammable liquids, gas, explosives or combustible materials; 6. Within 100 meter radius from the buildings and premises of public and private hospitals, medical, dental, and optical clinics, health centers, nursing homes, dispensaries and laboratories; and 7. Food preparation areas.

Section 10. Duties and Obligations of Persons-in-Charge. Persons-in-charge shall:

a. Conspicuously post and display the “No Smoking” and “No Vaping” signages at in their respective areas where smoking and vaping are prohibited, with the following text:

Section 13. Task Force Kontra Usok. —A Task Force shall be created to aid in the implementation, enforcement and monitoring of this Ordinance, and to protect the same from tobacco industry interference at all times, as well as to conduct educational awareness campaigns, information dissemination programs, and capacity building programs, that will inform the constituents and train enforcement officers.

The Task Force Kontra Usok shall be composed of the following:

City Mayor - Chairperson City Health Officer - Vice-Chairperson MEMBERS: Chairman – SP Committee on Health City Legal Officer City Administrator City Treasurer Tobacco Control Coordinator (if there be any) BPLO Head City Building Official City Information Officer Representative of Accredited CSO City Chief of Police ABC President Section 14. Duties and Responsibilities of the Task Force. Aside from their individual and specific duties and responsibilities, the task force shall have the following duties and responsibilities, to wit: a. Ensure the implementation of this ordinance and other related national laws; b. Disseminate information to the public regarding the implementation of this ordinance c. Receive, review and process reports on violations of and complaints relative to the ordinance d. Recommend additional policies on smoking e. Attend regular task force meetings f. Formulate the implementing rules and regulations of this ordinance indicating the individual duties and responsibilities of the members of the Task Force and the enforcement procedures g. Monitor the implementation of this ordinance and keep a record of the same for submission to the Office of the City Mayor h. Initiate a campaign against smoking i. Establish guidelines on the determination of 100-meter radius from establishments covered by the 100-meter radius ban.

Section 15. Citizens’ Participation. Citizens may participate in the implementation of this ordinance by informing or giving valid information with documentation of a violation to any law enforcer.

Section 16. Barangay Government Participation. Barangay Governments may organize their respective tasked group specifically for the effective implementation of this ordinance.

Section 17. Sharing of Proceeds from the Penalties 40/60 Sharing. Forty Percent (40%) of the Penalties shall be given as incentive to the apprehending unit, or the barangay government responsible in the apprehension of the violators. Ten Percent(10%) of which shall be given to the informant, if there be any. Sixty Percent (60%) of the penalties shall accrue to the coffers of the City Government.

Section 18. Funding. — An initial funding of Two Hundred Thousand Pesos (PhP200,000.00) is hereby allocated to defray the expenses necessary for or incidental to the implementation of this Ordinance. Every year thereafter, at least Five Hundred Thousand Pesos (PhP500,000.00) shall be appropriated in the Annual Budget of the City for the implementation and enforcement of this Ordinance, based on the city’s plans and programs.

Section 19. Repealing Clause. — Ordinance No. 02-258 of the City of Kidapawan is hereby repealed and all other ordinances contrary to or inconsistent with this Ordinance are hereby repealed or modified accordingly.

Section 20. Separability Clause. — If any part or provision of this Ordinance is declared unconstitutional or invalid, the same shall not affect the validity and effectivity of the other parts or provisions hereof.

Section 21. Effectivity Clause. — This Ordinance shall take effect after compliance of the publication in a newspaper of local or general circulation or posting in at least two (2) conspicuous places within the city.

Section 11. Persons Liable. —The following persons shall be liable under this Ordinance:

Persons-in-charge who knowingly allowed, abetted, authorized or tolerated the prohibited acts enumerated in Section 7 and who failed to fulfill his duties and obligations provided for in Section 10 hereof; and, c. Parents or guardians of minors after incident has been reported to the persons-in-charge who have jurisdiction of the minor-offender for disciplinary measures, appropriate actions or intervention, pursuant to Republic Act No. 9344, otherwise known as the Juvenile Justice and Welfare Act of 2006.

Section 12. Penalties. Violators of this ordinance shall be penalized in the amount of Five Thousand Pesos (PhP5,000.00) or imprisonment for a period

Although COBI was already supposed to be delivering 60,000 MLD to COWD since January, Batar said it was still delivering only 40 MLD due to ongoing repairs at the RVWCI water treatment plant caused by floodwaters spawned by

Tropical Storm Vinta last December. At present, COBI is buying its bulk water from RVWCI. The bulk water supply purchased by COWD from COBI at present accounts for 56% of the total West Area daily production, and 21.47% of the total COWD daily production in the East and West service areas.

Batar admits the COWD’s Supply situation was complicated by problems with Rio Verde contract.

“As planned, bulk water deliveries as of this date should already have been 120MLD but only 40MLD is still being delivered. The 80 MLD difference should have been COWD’s buffer to improve our resiliency in meeting issues encountered in the supply/demand situation,” he explained.

Another problem complicating COWD’s supply situation is its High Percentage of Non-Revenue Water (NRW).

“NRW is water produced

by COWD for which we have no income, such as the water we use for testing, flushing of valves, and supplying fire hydrants,” said Eduardo Montalvan, COWD Chairman of the Board. “The Local Water Utilities Administration (LWUA) allows a maximum of 30% NRW per water district. When I was appointed a member of the COWD Board, our NRW as 59%, one of the highest in the country. While COWD’s present NRW is down to 50.36%, Montalvan said COWD has committed to LWUA to reduce it further to 20%.

Most of the NRW is believed caused by old and leaking pipes in the poblacion that even predates the COWD’s creation in 1973.

“So we have to identify all the leaking pipes to replace them and ultimately,

we have to replace all of the old pipes. We loaned P425 million from DBP just for that. Loan took a long time to be approved due to the complicated process, so far only 50% has been released and the balance has not yet been released.”

Montalvan admits even that amount still lacks if COWD is to replace all its old and leaking pipes.

“This is one of our most important projects we have to really focus on because even if we reduce NRW by 30%, that means 30% more income for us and we don’t even have to implement any further rate increases,” he added.

COWD has created an NRW Dept. headed by Engr. Edgardo Tuvilla that is charged with focusing on and resolving our NRW issues.

If the ordinance goes into fruition, it could potentially affect the businesses of the families of a congressman and a councilor, who are into outdoor signages and advertising. The congressman’s son is also a City Council member.

Maharlika Bridge in particular is being littered with dozens of billboards. According to Daba in his proposal, the regulated areas must be designated “to preserve the natural beauty, cityscape and skyline of Cagayan de Oro.” Daba also proposed that all outdoor signages be made of incombustible materials and must be strictly checked in accordance with the National Structural Code for Buildings, the Fire Code of the Philippines and the National Electrical Code.

Under the proposal, adjacent billboards must be erected in such a way as to maintain 200 meters unobstructed line of sight.
