SAN Francisco, Agusan del Sur--All five family members who were trapped inside their bedroom were charred to death in the tragic fire at the town center here shortly before Monday midnight.

Neighbors said the father, Kim Abelita, 42, managed to get out of the house but went back again to rescue his wife and three young girls, but the fire spread so quickly that it was already too late to save their lives.

Army pushes for closure of Lumad school

GENERAL Santos City-Government troops are pushing for the closure of another school for indigenous peoples or Lumad in an upland village in Malapatan town in Sarangani which they suspected of being run by New People’s Army (NPA) rebels and sympathizers.

‘Govt regulations must uphold human rights’ mark francisco, Section Editor

Experts at the recently concluded conference on regulation and governance in the Philippines organized by state think tank Philippine Institute for Development Studies and Canberra-based Australian National University (ANU), highlighted the importance of having responsive regulations that respect human rights.

In her presentation, titled “What regulatory rights do states owe their citizens in the 21st century?”, Prof. Veronica Taylor of ANU, emphasized that having responsive regulation that respects human rights is everybody’s business, stressing that civil society organizations, the business sector, and other nongovernment stakeholders should work together to ensure that nobody’s right is violated.

“Civil society and nongovernment actors are important in nudging or sharply reminding governments about the limits of their capacity and what it is that citizens are owed,”

regulations. They are less costly, less coercive, and more respectful. It is also more legitimate given that citizens are able to argue about injustice. Since coercion comes after dialogue, we can say that it is also procedurally fair and will more likely lead to compliance,” Taylor explained.

According to Taylor, government can be responsive to how effectively citizens or corporations regulate themselves before deciding whether to escalate intervention. She added that the state and civil society must share the responsibility of enforcing regulations. As an example, Taylor cited the case of Grab that has already been co-formulating regulations in some Southeast Asia countries by sharing its technologies with regulators in managing and tracking drivers’ violations, among other things.

On the other hand, she referred to the Philippine government’s war on drugs as the direct opposite of a responsive regulation.

According to Taylor, the government spends so much time, effort, and resources on this campaign. She added that it is also illegitimate given that it comes with no prior effort at persuasion or dialogue.

“This is an example of a

regulatory failure which has a continuing reputational costs to the current administration,” Taylor explained.

In the same session, Dean Jose Diokno of the De La Salle University College of Law lamented that the present government’s war on drugs has “supplanted justice from the courts with justice from the barrels of guns.” “(The) war on drugs has created a mutant police force that compiles names of alleged drug personalities instead of gathering evidence for prosecution and conviction. And when the legal system suffocates and dies, as it did during the Marcos dictatorship, the only form of government capable of maintaining order is an authoritarian government,” he cautioned.

According to Diokno, the rule of law and human rights are vital in building accountable leadership. He emphasized that genuine accountability can only be achieved if there is respect for the rule of law and human rights.

“Like it or not, the country appears to be moving in the direction of lesser accountability and greater authoritarianism. There is still time, however, to stop the train and put it back on the right track,” he concluded.

3.A signed copy of the certification of the Register of Deeds concerned that the original of the certificate of title on file in the Registry was either lost or destroyed, indicating the name of the registered owner, if known from the other records on file in the said office

In accordance with A M No 12-8-8-SC (Judicial Affidavit Rule), Section 2(a), petitioner is DIRECTED to submit to the Court and serve on the adverse party the judicial affidavits of her witnesses, which shall take the place of such witnesses’ direct testimonies and the parties’ documentary or object evidence, if any, which shall be attached to the judicial affidavits marked as Exhibits A, B, C and so on, not later than five (5) days before the scheduled hearing on November 10, 2017.

CDO City Council split seen in Metropac dispute It appears that the issue about the Metro Pacific Investment Corporation (Metropac) and the Cagayan de Oro Water District (COWD) is getting out of hand. As my little bird said: “It all boils down to money.”

Indeed, money is a “hot” item. Whether an exchanged for money between the Metropac and COWD bulk water supply contract has taken place, the CYNOSURE is not interested at all.

What does the P 2.8 billion Metropac-COWD contract controversial and suspicious? Perhaps, it is the manner of the contract’s

execution that becomes outrageous. Based on reports, the Metropac and the COWD has already tackled and approved (in principle) the contact in the latter part of 2016. The formal signing of the contract, however, took place on August 15, 2017 in Shang-rila Makati.

The signatories of the contract were the COWD’s top management while City Mayor Oscar Moreno and his entourage allegedly led

by City Councilor Ian Mark Nacaya were present as witnesses.

Moreno and some city officials as witnesses when the signatory of the COWD was supposed to be only the COWD Gen. Manager and the Chairman of the COWD’s Board of Directors.

Anyway, Moreno could be excused because he appoints the water district’s Board of Directors. It appears too that the city government has a total control of the COWD when the water district should be under the supervision and control of the Local Water Utilities Administration (LWUA) as a quasi-government institution.

However, why would Moreno bring about a dozen city officials, including Nacaya and the head of the City Disaster Risk Reduction Management Department?

Another also asked whether the city government pays for the hotel and travel allowances of the government officials.

If the city government did not pay for the hotel and accommodation of the city officials, except Moreno, who foots the bill for them?

-ooo MARENG WINNIE’S CRITIQUE OF ASEAN 2017 IS WAY OUT OF ORDER: In the Philippines, it is a fact of life that when you are in the political opposition, there is no longer anything good that the administration is capable of doing. This was my thought while I was listening to a radio interview on Tuesday, November 07, 2017, of my “Economics 11” professor in UP Diliman almost four decades ago, Professor Solita “Winnie” Monsod. In that interview, she lambasted to the hilt

the ASEAN Summit 2017.

According to Prof. Monsod (who is now widely known as Mareng Winnie), no good is going to come to the Philippines in its hosting of the 5oth annual meeting of the ASEAN (or the Association of Southeast Asian Nations). The reason, according to her, is that, ASEAN is merely a social club of its membercountries, and it has not really done anything for the benefit of any of its members since it was put up 50 years ago.

Well, I can understand where Mareng Winnie was coming from in her criticisms of ASEAN 2017 in the Philippines. She is after all a member of the opposition

which is against President Duterte at all cost. The truth, however, is that, that critique of hers against the ASEAN is way out of order since, in the latter part of her radio interview, she admitted that the meeting of ASEAN leaders in the country somehow brings a truly big benefit not only to the Philippines but to the world as well.

PIDS, Australian university lead forum to reinforce political, economic regulations in PH

This was stressed by Professor Sharon Friel of the Australian National University (ANU) at the recently held Manila Conference 2017, a two-day event coorganized by the Philippine Institute for Development Studies (PIDS) and ANU. The conference, which carried the theme “Regulation and Governance in the Philippines: Development policy challenges for the new administration”, aimed to tackle the present state of regulation in the Philippines and identify current regulatory barriers to growth of major industries in the country.

Concluding the forum, Friel emphasized the importance of regulations in improving the lot of every person, saying that these are “conditions that [can] help everyone to flourish.”

Although issues on regulations can be “chaotic, overwhelming, and challenging at times”, Friel said these should be considered as vital inputs in enhancing government’s regulatory frameworks and systems.

She expressed confidence in the ability of governments to regulate and put things in order through the implementation of effective

policies and standards.

“I would certainly say that it is possible to regulate in government. As human beings, one thing we can do is adapt, albeit, in a very complex way. History tells us that we can reinforce positive adaptation even when it seems remarkably difficult,” she said.

She also pointed out the significance of empirical evidence and in-depth analyses in the formulation of policies, guidelines, and procedures in government, adding that the success and effectiveness of regulations depend on mutual cooperation among key players.

“We have a whole diversity of actors. It’s not just government officials, not just politicians, not just civil societies, it’s a whole suite of actors involved in different ways,” said Friel.

The ANU professor also urged everyone in the forum to “reimagine the purpose of regulation” and be “model mongerers and chaotic innovators” to attain sustainable

and inclusive development.

The conference featured panel discussions on the Philippines’ enabling competition policy, its prospects and challenges, and a comparative perspective of other countries’ regulatory practices and systems. Global standards and regulations in key sectors were also discussed, along with the role of civil society and the private sector in regulation.

Among the panelists and speakers were prominent academics, researchers, and high-ranking officials from the Bangko Sentral ng Pilipinas, National Economic and Development Authority, Philippine Competition Commission, and private sectors and institutions like the World Bank, and other top universities in the country.

The two-day conference was attended by nearly 150 participants from various government agencies, private organizations, civil society groups, and the academe.

ASEAN leaders urged to fast track ease of doing business

MANILA -- The ASEAN Business Advisory Council (BAC), the voice of businesses in the 10 ASEAN member states, have urged ASEAN leaders to fasttrack enforcement of initiatives to further ease doing business in the region.

ASEAN BAC Chairman Jose Maria Concepcion said the ease of doing business is considered as one of the most important deliverables for the Council.

“The non-tariff barriers are really the biggest challenges. Yes, you are lowering tariffs but the non-tariff barriers are still there,” said Concepcion. He noted that the Council will push to fast-track the de liverables on ease of doing business in its report to the Leaders to be submitted prior to the 31st ASEAN Summit happening in Manila next week.

“The ease of doing business, they’ve been there for a long time, and they are still there until now. It

really never changed. They have to really accelerate the speed,” he stressed.

During ASEAN BAC’s Prosperity for All Summit last April, Malaysia Prime Minister Najib Razak noted that non-tariff barriers (NTBs) and non-tariff measures (NTMs) ballooned from 1,634 to 5,975 products between 2000 and 2015.

The ASEAN leader added that the region should cut 50 percent of NTBs and NTMs to reach the USD 9.2-trillion economy by 2030, which is forecasted to be the fourth largest economy in the world by 2030.

In the 49th ASEAN Economic Ministers’ (AEM) Meeting last September, Philippine Trade Secretary and AEM Chairman Ramon Lopez urged other ASEAN members to link their National Single Window (NSW) to the ASEAN Single Window (ASW).

MANILA -- The Philippine economic prospects have been fairing significantly based on different economic and trade reports with the United Nations calling the Philippines “a rising star in foreign direct investments”, Presidential Spokesperson Harry Roque said on Monday, November 6.

“The Philippines is expected to have significantly better trade prospects for 2017 according to United Nations Economic and Social Commission for Asia Pacific (UNESCAP) in the Asia-Pacific Trade and Investment Report 2017: Channeling Trade and Investment into Sustainable Development,” Roque said in a press briefing in Malacañan Palace.

“The positive outlook is a result of the improved services export performance, 58.6 percent year-on-year increase in the telecommunication services and 11.3 percent growth in the number of international tourist arrivals,” he added.

He said UNESCAP considered the Philippines

as a rising star because of the 60 percent growth in the county’s foreign direct investment (FDI) inflows and simplified procedures for foreign investments contributed to the positive forecast.

He also said the report approved of the streamlining of services such as the releasing of business permits and licensing system of the country.

Roque also welcomed another report which said that the Philippine manufacturing sector being ahead of other member countries of the Association of Southeast Asian Nations (ASEAN).

“The Nikkei Philippine Manufacturing Purchasing Managers’ Index (PMI) reported that the country’s manufacturing sector got a score of 53.7 for the month of October, which is higher than last month’s score of 50.8. This makes the Philippines on top of ASEAN countries in overall growth ranking in manufacturing sector,” he said.

growth in manufacturing sector is attributed to the strengthened domestic demand and maintained export sales, increased volumes of firm production and availability of more capital equipment.

On the international front, Roque also welcomed UNHCR’s recognition on the Philippines’ efforts on refugee welfare with the UN body commending the country for its continuous support to protect refugees.

“The Department of Justice, which leads 15 other agencies of the government, signed an interagency agreement that would give legal ground for asylum seekers, refugees, stateless persons and other persons of concerns to avail of government services they need in the country,” he said.

“This proves that Filipinos are hospitable people who would warmly welcome travellers and tourists extend the same warmth and support to refugees and asylum seekers,” he added. (PND)

Lending conduit receive checks for PLEA program Department of Agriculture-Regional Field Office 10 (DA-RFO 10) in collaboration with the Agricultural Credit Policy Council (ACPC) has turned over Php 54.43M worth of checks to the lending conduits in the pilot province of Bukidnon on October this year..

The turn-over ceremony was done at the Northern Mindanao Agriculture Crops and Livestock Research Complex (NMACLRC), Dalwangan, Malaybalay City.

Led by OIC Regional Director Carlene C. Collado and ACPC Director Cristina G. Lopez, Team Leader for Bukidnon, the checks were given to three lending conduits: Sta. Monica of Pangantucan Multi-Purpose Cooperative of Pangantucan, Bukidnon (Php9.95M), Mindanao Consolidated Cooperative Bank (MCCB) with Cagayan de Oro and Misamis Oriental as their service areas (Php40M), and Lumintao Farmers Multi-Purpose Cooperative (LUFAMCO) of Quezon, Bukidnon (Php4.48M).

The amount of money

entrusted to conduits were intended for the Production Loan Easy Access (PLEA) program of DA which aims to empower farmers and fisherfolks by providing them easy access to credit that intends to finance production of crops, livestock, poultry and fishing activities with minimum requirement.

The said PLEA program has a very minimal interest rate compared to other lending institutions. Its loan limit is up to Php50,000 at 6% per annum or 0.5% per month based on the project requirement and repayment capacity of the borrower, as evaluated by the lending conduit. The loan is payable in a span of 2 to 10 years depending on the commodity or project of which the 6% interest payment will go directly to their cooperative.

With the implementation of the program, the government anticipated the abundance and economical food for Filipino people.

SSS management, meanwhile, said it adheres to the ethical standards of the institution. “Everyone has a right to a due process, this blue ribbon is a gesture of support to the

SSS ethical standards. We are all committed to entail the highest level of integrity of SSS which has been compromised by this trial of publicity of an administrative complaint.”

Based on the SSS Code of Ethics’ Prohibited Acts and Transactions under Section 8.A.I, any SSS official or employee is prohibited in using or divulging confidential or classified information officially known to him by reason of his office and not made available to the public, either to further his private interests, or give undue advantage to anyone; or to prejudice the public interest.

Section 8.A.II, likewise, stated that disclosing confidential information given by parties, counsel, witness, or any other person during investigation in a pending administrative case except when expressly authorized by the disciplining authority.

Duterte to create new army camp in Marawi DAVAO CITY – With the five-month long Marawi crisis over, President Rodrigo Duterte wants a new army camp to be established in Marawi.

“I will create a new camp, maybe one regiment or one division within the vicinity of the greater Marawi area,” Duterte said during a press conference at the Davao International Airport on October 31, shortly after arriving from his official visit in Japan.

Duterte further emphasized that the military won’t claim huge tracts of land to be used as military reservation.

“Well, it is a huge tract of land. Ang military naman is ready; just give them a little bit of space where they can conduct everything they should know about soldiering,” he said.

He added that he would concede the Marawi proper to the Moros (Meranaws).

A 1953 Presidential proclamation has set aside 6,000 hectares in Marawi as a military reservation. The reservation would include bulk of Marawi City whose total area is 8,700 hectares.

The military earlier had said it wouldn’t claim the lands under the 1953 reservation.

Davao City prepares for Candy Land theme of ‘Pasko Fiesta’ DAVAO CIT Y -- The Davao City government is now finalizing the activities for the coming Christmas celebration dubbed “Pasko Fiesta”, a yearly event to give Dabawenyos a joyful holiday even without using firecrackers.

Museo de Dabaw head Orly Escarilla, who is also the spokesperson of Pasko Fiesta sa Davao, bared that the executive committee has already identified 21 activities for the celebration during their first meeting last week.

“We are still finalizing the activities and hopefully, within a week or two, we can release the final list,” he said.

Escarilla said the city is also sprucing up the city streets soon, including the Francisco Bangoy International Airport, so that tourists and returning residents could feel the spirit of Christmas while in the city.

He said that the theme for the decorations in this year’s celebration is ‘Candy Land’.

“For the decorations, specifically here at the City Hall, the theme is Candy Land. There will be lollipops that are made of round fabricated steel and covered with light.

The posts in the city hall will be also covered with decorations that will appear as candy,” he said.

Escarilla said the

highlight of this year’s Pasko Fiesta sa Davao would be the opening program where Presidential daughter and Davao City Mayor Sara Z. Duterte-Carpio would light the Christmas Tree and other decorations.

“Our target date for the opening is December 1 and after which there will be succeeding activities until the end of December,” he said.

Interactive Websites: A Boon for Quality Education

Technology as one of its definition says is the application of science in Industr y, engineering, education and etc. to invent useful things or to solve problems. But how is technology applied in the field of education?

By the way, I am school teacher in one of the farflung places of Tangub City in the province of Misamis Occidental. Teaching in a primary school with approximately 7 kilometers from the city proper is not quite easy. It would take me to pass three spillways with muddy and rocky roads. Going to the place is not as safe as it may seem. When rain pours and spillways are deep, sometimes calling all the angels and saints to help cross the river is a habit.

Difficult. The road and the way is difficult and inconvenient but I have to.

I have to get there. I have young minds to mold, I have little lives to save. I have to teach my pupils the knowledge and wisdom that they need to have a fulfilling and successful future.

In doing this, I need to make use of technology. I have to rediscover interactive websites to simplify and make learning more enjoyable and fun for these little minds. But the question is, “Do interactive websites really bring more advantages than disadvantages or is it the other way

around”?

Being a teacher, I have few things to share which makes interactive websites more of a boon than a bane: First, with the use of these websites, learning becomes more updated.

My pupils, being a 21st century learners need updated and new knowledge which they should know to compete with the world outside their school and outside their community.

They would know not just learn the basic and traditional knowledge but the kind of knowledge that they need to live outside their communities. The knowledge that pupils in private schools know.

Second, these websites make learning more enjoyable and fun. Opening the websites and looking at those colorful and attractive pictures and videos activates their minds, thus, opening their sense of creativity. It makes pupils more participative and cooperative, developing the pupils to become social beings.

Third, these interactive websites don’t just make pupils social beings but a more intelligent ones.

Pupils become more positive in learning because of the motivation and energy that these sites bring.

Thus, in learning and in becoming knowledgeable in this 21st century, nothing beats the aid of technology and of these interactive websites.

During the ceremony, about 40 BOC-10 employees were also given the loyalty award for the length of service they have rendered.

He said these importers and exporters have been complying with the Customs regulations and have been properly declaring their goods making it easier for the government to collect tariff from them.

Marohomsalic said they are optimistic that they can achieve their collection target of P13 billion.

He said their original target was P12 billion, but Customs Commissioner Isidro Lapeña has added a billion more to BOC-10’s target.

The Collector said the BOC-10 has collected P10 billion from January to October.

“I think we can maintain our status as long as our stakeholders (importers and exporters) declare their shipment properly and pay the right taxes,” Marohomsalic said.

The earnings of the BOC-10 will form part of the overall income of the bureau, which has reached more than P42 billion in October, according to the Customs.

In an article posted on its website, Lapeña was quoted as saying the Customs achieved “the highest monthly collection in the agency’s history.”

“Although the month of October was marked with lesser number of working days and volume of imports, growth was still achieved because of increase in the value of imports brought by the higher exchange rate, oil price, and improved valuation and classification,” the Commissioner said in the article.

Now, there is this report about the split in the City Council when some City Councilors reportedly smelled something fishy about the Metropac-COWD “sweetheart deal.” They called it “sweetheart deal” because the public was not informed of the deal until it was exposed to the public.

Perhaps, there was nothing wrong with the contract. However, the water consumers were enraged of the agreed water rates of P16.00 per cubic meter that the Metropac imposed on the COWD. The consumers were not happy because there was no “public consultation” about the contract and the water rates, too. Perhaps, this one of the reasons that some well-meaning City Councilors in the local legislative body are rallying to nullify the Metropac-COWD contract.

The Cagayanons are glad that City Councilors Bong Lao and Eric Salcedo along with some other city councilor like Boboy Daba are standing on the ground to repel an otherwise “outrageous” contract. It is expected that as the public support to the city councilors mounts, the majority of the city councilors, including the opposition would come together to support Lao. Nacaya would be left alone and his days as Majority Floor Leader would certainly end soon.

Anyway, as my little bird has opined, the issue boils down to “money.” Amid the hype, the Metropac has lately announced that it is now preparing to implement the contract with the COWD. Thus, while Lao, Salcedo, and Daba were not invited to the sumptuous dinner in Shang-rila-Makati, there is still a tendency that they would succumb to Moreno.

When that happens, all that the Cagayanons are fighting for would come to naught. Many, however, have expressed the confidence that the elected city councilors would carry the mandate of protecting the interest of the people at all costs.
