Standing just a few meters away from the shore, the “Malacañang of the South” was built during the time of erstwhile Public Works and Highways Secretary Hermogenes Ebdane, between 2005 and 2006, and completed around 2007 to serve as Arroyo’s official residence whenever she came to visit Davao.

The building, which was painted white with green roofing and orange perimeter fence, was worth P24 million.

A source, who refused to be named, said that Arroyo, the country’s 14th President, had spent a night there. Duterte said that any actions done by the Chinese government that “would obstruct or impede our movement within the 200-kilometer EEZ is a violation of our rights and the law of the seas.”

Bereft of cottage, it lacks any trappings for relaxation, except that it affords a view of the beautiful Island Garden City of Samal (IGACOS).

Based on the photo that was shown to MindaNews, the building’s interior appears inspired by Mindanao design, particularly, Moro and Lumad.

The source said there’s nothing grandiose except for a chandelier that graces the building’s living room.

Anyone interested to see it can get a glimpse from the outside through that open space between the office of the DPWH 11’s Regional Equipment Management Division and a huge warehouse.

It was also used by Arroyo’s and outgoing President Benigno S. Aquino III’s cabinet members.

Construction worker John Concon, 25, recalled that the shore outside the mansion used to be where he and his playmates jumped off the jetty and play.

Until today, this remains to be the place where kids go to dive and play, except that it is now clean with just a very few pieces of garbage

floating.

“Sa una, daghan kaayo og basura unya daghan pud og buak nga botilya (Before, there was too many garbage and broken glasses),” Concon said. He lamented how garbage from other towns would always end up on their shore during high tide.

He noticed though that workers of the DPWH 11 cleaned up the garbage just a few days after the May 9 elections.

“Karon lang makita nga na-hinloan. Makatingala nga nahinlo na dira (It was my first time to see it was being cleaned up. It’s surprising that it’s now clean),” he said.

Concon grew up in the shanty where his family has been living for about 30 years.

His family’s home stands at the edge of the community where houses are built on stilts. It has a good view of the so-called “Malacañang of the South” from their kitchen that lends itself as their dining area and balcony.

His older brother Jay, 30, a beautician, said they were threatened of demolition after the building was built but nothing happened when Arroyo stepped down in 2010.

Jay is the second of 13 children.

He recalled that the place where the mansion now stands used to be a grassland. People would now find it hard to go near the house as it’s already guarded, he added.

of the 1990's it was experiencing a critical depletion of marine resources. Stakeholders identified coastal zone management as their top priority and, after securing the cooperation of

the fishing community, activities started to prioritize efforts to preserve marine resources and rehabilitate and reforest the marine ecosystem in order to increase the fish stock.

Thus a fish sanctuary was established in a 8.6 hectare area, chosen because of its relatively undisturbed environment, considerable distance from households, and mild nature of its currents.

Today the sanctuary houses 43 units of concrete pyramid "corals", supported by nearby mangrove re-afforestation.

Field visit orientations for city-folks by BFAR and voluntary experts continue to build awareness and support for wider replication. They also mobilized civil society support for regular beach clean-ups. They exhorted the coastal dwellers to carry out preventive efforts to protect the endangered habitats of marine life in the areas they fish. Support for the project was obtained and sustained through regular Working Group meetings and planning sessions, information drives, and clean-up activities.

The barangay Gusa project became one of the most note-worthy projects facilitated by the Cagayan de Oro City government through the Local Environment Planning and Management Project (LEPM). Among the thirteen coastal barangays lining the east coast of Cagayan de Oro City, Gusa shares the coastal waters of the Macajalar Bay. Thus, it enjoys the myriad of marine and aquatic resources that once made the Macajalar Bay a primary port of call during the Spanish occupation. Come present time, Gusa remains as one of the main sources of fish catch in the city, along with barangays Bulua, Bayabas, Bonbon, Macabalan, Lapasan, Cugman, Tablon, Agusan, Puerto, and Bugo, supplying approximately 16, 843 MT/year. Other than the rich variety of aquatic species such as octopus, milkfish, goatfish, butterfly fish, and white shrimp, the city’s coastal and marine ecosystems provide resources such as mangroves, coral reefs, beach sand, and sea grass beds.

Although there is no denying the richness of the Gusa coasts, years of dynamite fishing are taking its toll on their corals, thus, the reduced volume of catch. In the years past, the safety of the coral reefs in Gusa was not protected by any strictly enforced l a w against illegal f i s h i ng .

The need to repair impendi ng d e struction of the corals and refurbish the benefits the coasts extended the fishermen, became top priorities. Linkages were made with national agencies. Technical assistance was provided by the city agriculture office who is the project’s primary partner.

The 8.6 hectare sanctuary maintains a floating guard secure the premises. Concrete pyramid corals are lodged within the perimeters which are also marked by stryopore balls. A mangrove reforestation project was later tested in the coastal waters. Though strong currents failed it initially, the working group found a more strategic location. Eventually, they decided to try planting the seedlings along the creek area.

Presently, the Gusa fish sanctuary remains to be the largest and most sustainable among others put up in the coastal barangays. Only a year after the project was implemented, concrete results already include an increased fish catch around the sanctuary area. Variants of the species already present in the area appeared superior and more numerous than they were before the project. This of course, was to the benefit of the local residents whose livelihood is fishing. More importantly, the project is barangay Gusa’s contribution to restoring the glory of the marine ecosystem that witnessed the growth of Cagayan de Oro as a city. Duterte changes mind, DENR will not go to progressive left

DAVAO City––Incoming President Rodrigo Duterte is eyeing for another person to head the Department of Environment and Natural Resources (DENR) and not from the progressive left as earlier planned citing serious and sensitive issues on mining operations.

But Duterte remains committed to give the Department of Agrarian Reform (DAR), Department

of Social Welfare and Development (DSWD), might even consider to put leftists in some agencies. He said the Department of Labor and Employment (DOLE) went to Silvestre Bello III, who is also the choice of the left.

Duterte said he reconsidered to give the DENR to the progressive left after going through all some papers. But Duterte said he has already explained to Fidel Agcaoili, the emissary of the Communist Party of

the Philippines – National Democratic Front (CPPNDF), why he would not concede the DENR post to them during their meeting on Tuesday night.

Agcaoili met with Duterte on Tuesday night to submit the list of nominees from the progressive left for government offices reserved for them.

“It is an impressive list… about less than ten,” Duterte told reporters. He said he already submitted the list of the nominees mostly

from the University of the Philippines, to the screening committee.

A crime reporter has been shot dead in Manila, police said on Saturday.

Police identified the victim as Alex Balcoba, 56, a reporter who writes for People’s Brigada tabloid. He was gunned down at around 7:30 p.m. Friday in front of the family-owned watch repair shop in Manila’s Quiapo suburb, police said.

Police said the two gunmen who fatally shot Balcoba in the head with a pistol fled on a motorcycle after the shooting. The victim was rushed to a nearby hospital where he died later, police said.

Police have yet to determine the motive of the killing.

The National Union of Journalists of the Philippines condemned the cold-blooded killing of Balcoba, saying the victim is the 174th journalist slain in the line of duty since 1986 and the 34th under the watch of President Benigno Aquino.

“But whether or not Balcoba’s murder is related to his work as a journalist, we demand that authorities act speedily to catch his killers and bring them to justice,” NUJP’s chair Ryan Rosauro said in a statement.

“Our country has suffered too long from the impunity with which murder continues to be committed,” he said.

Help school children be online-ready through Digital Thumbprint Program Anyone concerned over the online health and safety of school children now has a chance to do something concrete to prevent them from committing social media mistakes and from becoming victims of cyberbullying and cybercrimes.

By nominating a public or private high school to the Digital Thumbprint Program (DTP) of Globe Telecom, concerned citizens would be able to help the youth learn about responsible use of technology, be it through gadgets, website browsing, or social media platforms.

Co-designed by the Karrikins Group, DTP is composed of a series of workshops patterned after the Optus DTP in-school program where it has already reached 81,000 high school students across Australia. Globe also aims to do the same by educating as many Filipino youth

on digital citizenship in view of a recent Philippine National Police report that half of the internet users are adolescents aged 17 years old and below.

“With the increasing time the youth spends online to do schoolwork or partake in online gaming and social media platforms, these young digital natives are becoming more exposed to a myriad of issues such as identity-theft and cyberbullying. Thus, we decided to bring DTP to the Philippines to help guide them in making safe and responsible choices in their online activities. DTP can equip them with the knowledge and tools to protect themselves online,” said Fernando Esguerra, Globe Director for Citizenship.

DTP offers three exciting modules for students in private and public schools nationwide. Each

module was designed to increase students’ knowledge of digital citizenship and cyber safety by taking a critical look at their online behavior and helping them develop insights into the influences of the online world and the choices they are making.

Life-Proof – the new Suzuki Ertiga You would be forgiven for not being enthusiastic about the new Suzuki Ertiga at first glance. Even with the aesthetic upgrades, it still look rather plain. Yet, this seven-seater from the Suzuki stable offer so much more than what meets the eye. Dubbed as Life Utility Vehicle, the Ertiga seems to gives more emphasis on function rather than form.

The new Suzuki Ertiga retained its predecessor’s 1,373 cc four-cylinder VVT 16-valve K14B engine which produces 95 hp @ 6000 rpm and 130 Nm @ 4000 rpm. When driving solo, acceleration is relatively brisk

considering its 1,770-kilogram weight.

With all seats occupied, however, you’ll be reminded that you are driving an MPV with a subcompact’s engine. Yet, the Ertiga’s modest but capable mill offered enough grunt when traversing steep mountain roads. Having a four-speed automatic transmission, one just had to press a button to turn off the overdrive function or pull the gear lever to switch to low gear when the going got a little tougher than expected.

What it lacked in exterior flair, the Ertiga more than made up with the creature comforts it offered inside the cabin. The top-spec variant GLX that we

tested is equipped with an Android-ready, multimedia touchscreen entertainment unit which plays not only music but also movies.

It even has a satellite navigation system. It comes with steering wheel-mounted control and hands-free function to keep the driver’s eyes on the road and his hands on the wheel.

The side mirrors can be adjusted and folded electronically. Heck, you can unlock the doors and start the engine without having to pullout a key.

With all the bells and whistles, it is the switch knob of the rear airconditioning vent which got the most attention from my passengers. It did an excellent job of keeping the occupants comfortable amidst this

heat. Even my kids at the third row wasn’t complaining. Speaking of which, two average-sized adults will fit in the third row as well. Getting to the back is done with a pull of a lever and to allow more leg room, the second row seats can slid forward. There are bottle holders in all doors and two cup holders in the rear. There is another provision for a cup at the base of the gear lever, wherein you can also place your wallet or mobile phone as you change it via the USB port or the 12-volt socket below the center console. There is also another socket in the second row.

The ride is a tad firm but comfortable nonetheless. The upside is that the Ertiga is

able to take corners pretty well. Handling is light and can be easily maneuvered around urban traffic. There is tilt adjustment on the wheel and height adjustment on the driver’s seat so there are no issues with regards to ergonomics.

Though the weight on the steering wheel felt inconsistent at times, getting in and out of tight parking slot was a breeze especially with the aid of the rear parking sensor. Suzuki didn’t skimp on safety as well since this variant comes with ABS with EBD and dual airbags.

Being an MPV, the Ertiga is not just a people carrier but a cargo hauler as well.

With the second and third rows folded, it can accommodate up to 736 liters of cargo. The

cabin can store items of various shapes and size as the seats offer flexible configuration.

Moreover, the 185 mm minimum ground clearance gives you a fighting chance against our poor road conditions or monsoon floods. It seems that the Ertiga is ready for whatever life my bring.

Not bad for a soccermom car.

I particularly like the beige-colored interior as it gives you a more premium feel.

It is, however, prone to stains, especially if you have kids. Leather seats might have been a good addition as it is easier to clean but that’s asking too much for a P 918, 000 price tag. You can’t have it all, I suppose. C’est la vie.

TESDA-Caraga undergoes IQA BUTUAN City -- In preparation for the re-certification audit on August this year, Technical Education and Skills Development Authority (TESDA)-Caraga is currently undergoing the Internal Quality Audit (IQA).

According to Regional Director Florencio F. Sunico Jr., the conduct of the audit is for all the Operating Units personnel to be aware of how far the system

is being implemented in their respective areas of responsibility.

Sunico added this is to ensure that all personnel have followed the procedures that TESDA as an organization has set. “Being an ISO-certified organization, everybody must be one in performing the mandates of the agency,” Sunico said.

Prices of school supplies under tight watch, says DTI

ZAMBOANGA City -- With the school opening just right around the corner, the Department of Trade and Industry (DTI)9 has been closely monitoring the prices of school supplies in the city based on the recently released 2016 Price Guide.

Engr. Samuel Delos Reyes, acting chief of DTI9’s consumer protection division, said the prices are generally stable, although there is a slight drop in prices of some commodities insofar as its weekly monitoring is concerned.

“The market forces in

our city are having a great competition in pricing their goods, that’s why some stores are selling them at lower prices,” he explained.

In 2012, the said association received a total of Php170,000 as Capital Seed Fund from the Sustainable Livelihood Program (SLP) which they used to individually venture into various businesses like hog raising, farming, sari-sari store and Wholesale/Retail on RTW items.

Challenge Arrives

While on the verge of earning positive profit, the association has faced crisis when the treasurer and a member used the funds and exiled.

A fiver optic cable is also a primary cable. u) Secondary Cable –are group of copper telephone wires connected from distribution/outside plant cabinets, usually 200, 500 or 1,000 pairs which are distributed to terminal boxes or distribution points. v) Redundant Wires/Cables – are wires or cables installed from one or many telecom provider’s terminal or distribution poin to the same destination which cause messy and out of standard installation. w) Improper Installation – is an installation not following the right standards that is the major cause of the most common problems. x) Violation Notice – is a notice to be served by the CAO to an identified party violating some provisions of this ordinance. y) Multiple poles – refer to the existence of two or more poles situated within twenty (20) meters from each other. z) Communications tower/mast – is a structure with corresponding height and support, same as telecommunication tower design for holding any communication antenna either receiving or transmitting. This structure should follow standards set by governing bodies. n) o)

CHAPTER I GENERAL PROVISION

SECTION 1. TITLE. This Ordinance shall be known as “The Telecommunication Cables, Telecommunications Towers, Electronics Equipment, Building Structured Cabling and Cable TV Facilities Regulation Ordinance 2016”.

SECTION 2, DECLARATION OF POLICY. It is hereby declared the policy of the city to promote the development of an efficient and sufficient telecommunication sector consistent with prescribed standards to meet the needs of the growing community and to make the City of Butuan the center of excellence of telecommunications and technology in Caraga Region.

SECTION 3. PURPOSES. The following are the purposes of this Ordinance: a) Set or provide minimum design standards necessary for the safety and proper installation, operation and maintenance of telecommunication cables, communication towers, electronic equipment, structured cables and cable TV facilities/equipment; b) Solve the problem of continuous and unregulated messy telecommunication cable installation, sagging, spaghetti and unbundled cables and wires that cause accidents to general public; c) Provide basic minimum provision considered necessary for safety, aesthetics, comfort, good workmanship and proper operation and maintenance in telecommunication and cable facilities/ equipment; d) Assist in the realization of savings for the one who pays for the work in the installation, operation and maintenance of telecommunication cable and cable facilities/equipment; e) Enforce and implement the good Engineering Practice and in compliance with prescribed rules and standard as sighted in the implementing Rules and Regulation; f) Regulate the installation and maintenance of telecommunication cables, wires and other attachments installed on poles, towers, and/or service drops; and g) Enforce corrective measures on problems such as excessive sagging, dangling cables, service drops and other attachments to poles, towers along roads, bridges,markets, parks and other public places.

SECTION 4. SCOPE OF APPLICATION. This Ordinance and its Implementing Rules and Regulations shall apply to: a) All telecommunication cable, local area network (LAN) cables and cable facility/equipment installation in building (in-house cabling) such as residential, commercial, institutional and industrial establishments on which building house wirings utilizing but not limited to copper cables, coaxial cable, fiber optics and other media, including structured cabling for telephone, cable television, computer and data communications; b) The installation, operation and maintenance for outside cabling of telecommunication cable and cable facilities/equipment for service providers. c) The installation of communication towers and the like.

SECTION 5. DEFINITION OF TERMS. For purposes of this ordinance and its Implementing Rules and Regulations, the following words and phrases are defined and understood to have the meaning correspondingly indicated herein, to wit: a) Electronics – the science dealing with the development and application of devices and systems involving the flow of electrons or other carriers of electric charge, in a vacuum, in gaseous media, in plasma, in semiconductors, in solid-state and/or in similar devices, including, but not limited to, applications involving optical, electromagnetic and other energy forms when transduced or converted into electronic signals. b) Professional Electronics Engineer – shall refer to a person who is holding a valid certificate of registration as Professional Electronics Engineer under Republic Act No. 9292 and to affix to his/her name the letters “PECE” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Communication, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially endorsed by any Chapter of the Institute of Electronics and Communication Engineers of the Philippines, Inc. (IECEP). c) Electronics Engineer – shall refer to a person who is holding a valid certificate of registration as Electronics Engineer under Republic Act No. 9292 and to affix to his/her name the letters “ECE” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially by any Chapter of the Institute of Electronics and Communication Engineers of the Philippines, Inc. (IECEP). d) Electronics Technician - shall refer to a person who is holding a valid certificate of registration as Electronics Technician under Republic Act No. 9292 and is affix to his/her name the letters “ECT” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially endorsed by any Chapter of the Institute of Electronics and Communications Engineers of the Philippines, Inc. (IECEP). e) Electronics and Communications Engineer – shall refer to a person who is holding a valid certificate of registration as Electronics and Communications Engineer under Republic Act No. 5734 issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially endorsed by any Chapter of the Institute of Electronics and Communications Engineers of the Philippines, Inc. (IECEP). f) Electronics Equipment – equipment that involves conduction of electrons (especially in gas or vacuum or semiconductor) like amplifiers, audio system, sound system, equalizers, detectors, mixers, modems, radios, monitors, telephone set, telephone switch, oscilloscope, auxiliary equipment, scrambler, television, video equipment and etc. g) Communications - the process of sending and/or receiving information, data, signals and/ or messages between two (2) or more points by radio, cable, optical wave guides or other devices and wired or wireless medium; h) Telecommunications – any transmission, emission or reception of voice, data, electronic messages, text, written or printed matter, fixed or moving pictures or images, words, music or visible or audible signals or sounds, or any information, intelligence and/or control signals of any design/format and for any purpose, by wire, radio spectral, visual/optical/light, or other electronic, electromagnetic and technological means. i) Commercial Establishment – shall include but not limited to office buildings, hotels, motels, hospitals, condominiums, stores, apartments, supermarkets, schools, studios, stadia, parking areas, memorial chapels/parks, watercraft and aircraft used for business or profit, and any other building/s or area/s for business purposes, where electronic or electronically-controlled machinery or equipment are installed and/or are being used, sold, maintained, assembled, manufactured or operated. j) Electronics Permit – A written authorization granted by the City Architect’s Office to an applicant allowing him to proceed with the installation of telecommunication cables, communication towers, electronics equipment, building structured cables and cable facilities after plans, specifications and other pertinent documents have been found to be in conformity with this ordinance and its implementing rules, regulations and standards. It is also a document given to existing companies, commercial establishments, and other parties having electronics equipment in their positions which are taxable in nature after the inspection and seeking of permit from the city government. k) Plant – refers to the whole or portion of the physical property of a communications company and cable TV operators which contribute to the furnishing of communication or Cable TV service. l) Pole User – Any person, natural or juridical, including government agencies and entities that use the poles and towers for the installation of any cable, wires, service drops and other attachments. m) Pole Owner – Any person, natural or juridical, including government agencies and entities that own poles, towers and its accessories.

SECTION 10. MULTIPLE POLES. The installation of two or more poles should be avoided because it will be unsightly, poses more hazards, uneconomical, causes obstruction to pedestrians, and in some cases, an impediment to the construction of buildings and other structures.

For this purpose, only one pole should be erected and all other pole users should share in the use of this pole. a) Right of first refusal to electric distribution franchise to erect a pole. As the franchisee with obligation to serve the electric power needs of the public, which is of basic and prime importance, it is given the right of first refusal to erect or install poles, towers, support structures along public roads, bridges, and other public places. This is without prejudice to the right of transmission company which has a franchise to install poles and towers for its transmission lines. b) In the event the electric distribution franchisee fails to refuses to install the pole notice within 30-day period from the date a written notice was received from the CAO, the City thru the CAO may on its own install the pole out of the funds of the City Government, or authorize any interested pole user to install the pole, provided that in any case such installation shall be subject to the requirements herein provided. c) No person, natural or juridical may erect a pole without first obtaining an Excavation or Erection Permit from the CAO, and the authorization from the City as mentioned above is presented. d) Poles that will be erected shall be constructed in conformity with standards so they could be used by electric distribution franchisee, and all other pole users for telephone/telecommunication companies, cable TV’s and other pole user, and to comply with existing laws, ordinances, rules and regulations. e) The pole owner shall allow his poles to be used by others, subject to the compliance of reasonable technical requirements as provided herein, and in accordance with a reasonable joint pole agreement with the pole user, which should be as much as possible uniform with all other pole users. In addition that pole owner shall provide and maintain at its own cost, the approved Cable/Wire Mounting Bracket whose spaces or slots are pre-assigned to existing and incoming pole users. f) Existing Multiple poles. The City Architect’s Office in consultation with the electric distribution franchisee, telephone/telecommunication companies shall find ways and means to eliminate existing multiple poles within the city, including but not limited to the following: 1. Removal of all other poles and retaining only the pole of the electric distribution franchisee, if cluster poles are located. Owners of existing multiple poles are hereby granted, a grace period off six (6) months, from effectivity of this Ordinance, to remove their polces subject to some exception as stated in the Implementing Rules and Regulations.

2. Requiring the pole to be retained that it be replaced with one that will conform with minimum standards to be usable for all pole users.

3. Requiring the owner of the ple to be retained to allow the use of its pole by other pole users in accordance with Sec. 4.

aa) CFCC – City Electronics and Communications Council, is the policy making bodyd and the overseer of the implementation of the electronics ordinance of the City of Butuan. bb) FDAS – Fire Detection and Alarm System.

AN ORDINANCE REGULATING THE INSTALLATION, OPERATION AND MAINTENANCE OF TELECOMMUNICATION CABLES, TELECOMMUNICATION TOWERS, BUILDING STRUCTURED CABLINGS, MOBILE CELLSITES, CABLE TV FACILITIES FOR SERVICE PROVIDERS, AND ELECTRONICS EQUIPMENT, PROVIDING PENALTIES FOR VIOLATION THEREOF AND FOR OTHER PURPOSES.

Be it ordainced by the Honorable Sangguniang Panlungsod in session assembled and by authority of the same that:

CHAPTER 2 IN-HOUSE CABLING

SECTION 6. REGULATION. It shall be unlawful for any person, firm or corporation, including any agency or instrumentality of the government to install telecommunication and cable facilities/equipment in their respective residential, commercial, institutional and industrial establishment without first obtaining an Electronics Permit therefore from the City Architect’s Office.

SECTION 11. TECHNICAL REQUIREMENTS. All attachments must conform to the provisions of the Philippine Electrical Code and comply with the requirements provided hereof, to wit:

SECTION 7. REQUIREMENT. Electronics Permit shall be issued by the City Architect’s Office for the installation of the above-stated telecommunication cables, communication towers, electronics equipment and cable facilities (in-house cabling) without a plan, design and specification that maybe prepared by Registered Electronics Engineers, but must be signed by a Professional Electronics Engineer (PECE) under Republic Act No. 9292.

SECTION 8. PROHIBITION. No plans and specifications covered by Electronics Permit shall be changed, modified or altered without the approval of the CAO and the work shall be done in accordance thereto.

If a permit was issued and defect was later found during installation which is not clearly defined in the specifications/design submitted during application of permit, the CAO shall require the permitee to effect the necessary corrections thereto.

Vertical Clearances: Joint pole owners shall install their wires, cables and other attachments at such height from the ground level as will allow safe passage of vehicles and pedestrians, and provide for safe distance from the Electrical Distribution Utility wires and facilities, to avoid contacts.

CHAPTER 3 OUTSIDE PLANT CABLING

SECTION 9. SAFETY REGULATIONS, CLEARANCES AND CONSTRUCTION STANDARDS. a)

Pole user shall install its wires or attachments at the designated level of the pole and shall observe government safety regulations, clearances, and construction standard, to avoid any obstruction of the normal flow to the electric conductors of Electric Company. Any alteration, modification, revisions and/or reconstruction, as may be necessary, shall likewise conform to the aforesaid regulations, clearances and construction standards. Pole user found at fault shall be the solely liable if its wire/cable and other installation cause damage to any party’s life and property.

In no case shall pole user tamper, tap or connect with any other attachments on the jointly used poles, or on the wire/cables, service drop line, insulators and other line accessories of electric utility or other pole users. The provisions of Republic Act No. 7832 (Aanti-Electricity Company and Transmission Lines/Materials Pilferage Act of 1994) shall apply.

All attachments of pole user which require the consumption of electric power, shall not be connected by pole user to any electric lines or other existssing attachments. In the event that pole users tap or use any other lines without first securing the prior written approval or consent from electric company shall then be liable under the Wiretapping Law. In no instance a pole user taps, makes or cause to be made any connection that require the consumption of electric power to the electric lines of electric company, or other existing pole attachments, without the prior written consent or approval from Electric company then the provisions of Republic Act No. 7832 (Anti-Electricity and Transmission Lines/Materials Pilferage Act of 1994) shall apply.

Maintenance. Pole user shall provide the necessary supports, with pole-owner’s approval, on structures that need reinforcement before the lines, attachments or accessories shall be installed.

Each party shall maintain its own facilities at its own expense and when it becomes necessary to relocate, replace, or remove a jointly use pole, each polc-user shall transfer its own attachments at its own expense.

Installation of Cables, Attachments and Accessories on Poles. In order to ensure safety, orderliness and cleanliness, it shall be the duty of the service providers that the installation of its cables, attachments and accessories on any pole, shall conform with the Philippine Electrical Code, Philippine Electronics Code, and the corresponding IRR including the IRR of this Ordinance.

The IRR of this Ordinance that shall be formulated shall provide for the rules and guidelines on the proper installation and maintenance of cables, service lines, other attachments and accessoriesx on the poles that shall be observed to ensure safety, orderliness and cleanliness.

Relocation or Replacement – In the event it becomes necessary to transfer the location or to replace an existing jointly use pole, pole-owner shall advice pole user in writing of the schedule of such relocation or replacement in order to avoid delay in the execution of the work to be done by pole-owner. Pole user, upon receipt of the proper notice from pole-owner, shall promptly remove its lines, attachments and accessories at its own expense.

Sharing the use of the poles installed along the public roads to other pole-users is encourage.

Any utilities desiring to install new poles, shall consult first with the CAO as to the minimum standard of the poles, considering already the space requirements needed by the oher pole users (Telcos, CATV, and Electric Company) and the clearances required by the PEC and national Building code. The pole owner shall provide the appointed Cable/Wire Mounting Bracket, whose spaces are already pre-asssigned to the existing and upcoming pole-users.

There should be a uniform Standard Joint Pole Use Agreement to be followed by all pole owners to ensure flexibility and early monitoring, except, if the pole owner is the electric utility, wherein necessary additional provisions that may added for the protection and safety of the electrical lines and equipment. Pole owner shall be responsible for maintaining the good condition of the pole and the attached mounting bracket and at all times ensure its safety to the public. In case the electric utility need to install poles longer its size of what was installed by the telcos or other service providers, the CAO will allow the electric utility to install its own, and the CAO shall oblige and direct the pole owner to retire its pole after individual users transfer their attachments to the new electric pole.

Bonding/Lashing. If pole user has two or more service drop wire or line, pole user shall bind such wires together using standard binding materials at 1.5 meters space interval. If there are more than 10 wires it shall be replaced with multi-conductor. Joint pole users shall pay the corresponding penalty, in case they fail to bundle their wires. In no case service drop wire/line shall be used as messenger wire/line of pole user’s wires.

Tagging. For purposes of identification of the owner of the pole, cable/wire, and other installations, pole owner and pole users shall provide identification tags of their pole, primary and secondary cables, and other installations, which shall be visible from the ground. For cables/wires, the tagging shall be at the distance of 0.50 meter from the pole. The CAO shall designate the color coding of all pole users. Failure of the pole users to tag their installations shasll be considered as loose wires and the CAO shall order for the removal and shall impose appropriate penalty thereto.

Polce-users shall maintain cable/wires sag not exceeding 2% of the polce span. Once the sag is correctly established in a particular span, the same shall be consistently followed by the subsequent pole-users. Pole-user shall be faully bound to correct the sag as required after the CAO during its inspection. The CAO shall see to it that there will be uniform cable/wire sag through-out the s[pan. The maximum distance between poles shall not exceed 50 meters.

Prohibition of drop wires in pole-to-pkole distribution. – Telecommunication companies and Cable TV operators shall use cable wires in pole-to-pole distributions.Service drops shall only be used from pole to customer service entrance. These service drops shall be appropriately bundled based on the approved bundling scheme and the same shall be properly tensioned as specified in the PEC or any other Engineering Manuals. The connection point of telephone and CATV service lines shall only be at the pole to the subscriber’s service entrance and no telephone terminal(s) or drop wires will be terminasted at mid-span or in between poles and no service drop shall cross the road diagonally. The manner and requirement in the installation of terminal boxes shall be provided in the IRR. Building Service Entrance. It shall be the responsibility of the building owner to provide service entrance facility for the telecommunication lines such as but not limited to telephone, CATV and CCTV in every building, including those that are designed for multi-occupancy. The service entrance location shall be at the point where the electric service entrance is located. All overhead cable/wirings of service providers shall be on the same run with the electricity supply. This is to ensure orderly installations from a common tapping pole to the building.

Redundant Wire/Cables and Other Attachments and Improper Installations. Upon the determination of the CAO based on its inspection or upon the report of the pole owner, any pole user, or any concerned citizen, of redundant wires/cables and other attachments and other installations, the CAO shall order for its correction or removal of such wires/cables, other attachments and improper installations through a Violation Notice issued to the pole users and pole owner.

Sanctions shall be imposed if the pole user fails or refuses to correct or remove for the period

required by the CAO. The pole user and the pole owner may conduct a separate evaluation for possible sanction if there is violation to the JPA. For all new installation of outside cable as may be required by the City Government thru the City Architect’s Office (CAO) should be underground or burial on specific places.

SECTION 12. PROHIBITIONS. The following violations for outside plant cabling are hereby declared as unlawful and shall subject the offender to the penalties provided in this Ordinance, to wit: a) Failure to transfer the cable/wires to the new pole within the specified period required by the CAO. b) Failure to bundle their cable/wires. c) Failure to provide assigned cable/wires and other installations Identification Tag. d) Violation of pole-ground clearance requirement. e) Failure to cut and retrieve dangling, loose or cut wires/cables. f) Failure to follow the assigned space in the Cable/Wire Rack. g) Failure to remove the unused or redundant poles, wire/cables, line hardware, terminal boxes, booster/amplifier and others. h) Failure to correct other hazardous conditions of pole, any part of the structure, or wires/ cables and other attachment. i) Failure to replace drop wires between poles that exceed 10 pairs. j) Failure to provide Service Entrance Facilities. k) Failure to correct excessive sagging. l) Installation and alteration of cable/wire and other facilities without permit. m) Installation of multiple poles without authorization from the CAO. n) Failure to remove multiple poles despite written notice from the CARO for such removal. o) Failure to correct the installation of poles that is not in conformity with the standards. p) Failure to perform other corrective actions or other requirements whenever directed by the CAO.

If pole-user violates the agreement with pole-owner or any of those enumerated in Section 12, the latter shall inform the former, and the Notice of Violation will be provided by the CAO stating the specific violation/s and the corresponding sanctions and CAO shall conducut an investigation of such violation.

CHAPTER 4 MOBILE CELLSITE, TELECOMMUNICATION, BROADCAST AND RADIO COMMUNICATION TOWERS

SECTION 13. DESIGNATED AREA FOR INSTALLATION. Designated area for installation of telecommunication towers shall be in accordance with existing local land use and zoning ordinances. The following should be strictly observed as stated in this Ordinance, to wit: a) No tower/mobile cell sites shall be installed without securing Barangay Resolution interposing no objection to the proposed project, approval of the Permits and Licensing Division, CPDO and CAO. If to be installed in residential areas, a public consultation is required, before the actual installation can proceed. b) Installation of towers near hospitals, schools, public markets, churches and crowded public places should also secure the necessary clearance from other government agencies. c) No mobile cell sites or communication tower/mast shall be installed nearby the airports without conforming to the International Aviation Law Standards. A clearance from the Civil Aviation Authority of the Philippines (CAAP) is also required.

SECTION 14. COLOR DESIGNATION AND TOWER LIGHTING. All telecommunication transmitter and transceiver towers that are already existing and those that may be constructed and/or installed in this designated area in the future shall be painted alternate with orange and white. All transmitter and transceiver towers already existing shall comply with this requirement within one (1) year from the approval of this Ordinance.

Tower lighting should be installed in the top most part of the structure. Tower lamps shall be maintained in working condition at all times. For towers exceeding the height of 200 ft, an additional lamp shall be installed at middle of the mast/tower. The tower lamp should be colored “red”, as set by the International Standards.

SECTION 15. EARTHING AND LIGHTNING PROTECTION OF TOWER. All towers shall be grounded and the earth resistance measured at the earth terminal block shall be less than 5 ohms. Earthing and Lightning protection shall be provided in all completed tower sites to protect equipment from damage and personnel from harm which may results from excessive voltages during a lightning strike that might also affect people nearby especially if the tower is installed in residential areas or on top of buildings.

CHAPTER 5 ELECTRONICS PERMIT

SECTION 16. APPLICATION FOR ELECTRONICS PERMIT. Applicant for Electronics Permit shall: A. Fill up the prescribed application form and file the same with the CAO. The said application shall provide at least then the following information: 1) A description of work (project plan) to be covered by the permit; 2) For in-house cabling, description and ownership of the building where the telecommunication cable facility will be installed. The applicant must provide the Building/ Occupancy Permit or copy of the contract of lease of the building, or duly notarized authority to install executed by the owner, if applicant is not the registered owner; 3) For outside plant cabling, attachment original copy either of the following duly signed document: i. Joint Pole Agreement(s) (JPAs) between applicant and the entity that owns the distribution pole(s), AND Notice to Proceed by the distribution utility. ii. Memorandum of Agreement or lease contract between applicant and entity providing

conduit or ducting facility. iii. Lease contract between applicant and carrier/backbonr service provider.

4) The use for which the telecommunication cable is intended; 5) Specifications of Broadcast equipment, electronic signages, cinema equipment including venue, lights and sounds, Automated Teller Machines, CCTVm FDASm elector-medical equipment, data centers and other related electronics equipment; 6) Bill of materials and installation costs; and 7) Electronic plan and design duly signed and sealed by a Professional Electronics Engineer (PECE) undere Republic Act No. 9292.

Such application shall be accompanied by at least five-(5) sets of corresponding plans and specifications prepared, and sealed by a Professional Electronics Engineer (PECE).

B. Submit all ancillary documents required for the particular installation or work being applied for in accordance with the provisions of this Ordinance and its IRR.

SECTION 17. ISSUANCE OF PERMIT. After evaluation of the application and the plans and specifications and the same having satisfied and conformed with the approved standard requirements clearly defined in the Implementing Rules and Regulations, the CAO shall issue the Electronics Permit within fifteen (15) days from the date of filing. In case non-compliance the CAO shall notify the applicant within reasonable time prior to the expiration of the 15-day period.

All approve permit shall remain valid unless the permittee/applicant fails (a) to commence the installation or work authorized therein within a period of one (1) year from the date of effectivity of the permit; (b) suspends or abandons the installation/work at anytime after it has commenced for a period of 120 days. In such case the permit is deemed to have expired.

SECTION 18. NON-ISSUANCE, SUSPENSION OR REVOCATION OF PERMIT. The CAO may order or cause the non-issuance , suspension or revocation of Electronics Permit on any of the following reasons or grounds: a) Errors fofund in the plans and specifications; b) Incorrect or inaccurate data or information supplied; c) Non-compliance with provisions of the Philippine Electronics Code, National Building Code or any rule or regulation relative thereto, this Ordinance and its Implementing Rules and Regulations; d) Failure to comply with other requirements the CAO may impose based on pertinent rules and regulations.

The applicant may apply for reconsideration of the Order within 15 days from the date of receipt or advice thereof.

SECTION 19. ELECTRONIC PERMIT FEES AND CHARGES. There shall be imposed fees to be collected by the City Treasurer’s Office for the issuance of Electronics Permit in residential, commercial and industrial establishments at the following rates:

The meeting was called to order at exactly 10:55 in the morning. <<>> SP ORDINANCE NO. 4942-2016 AN ORDINANCE REGULATING THE INSTALLATION, OPERATION AND MAINTENANCE OF TELECOMMUNICATION CABLES, TELECOMMUNICATION TOWERS, BUILDING STRUCTURED CABLINGS, MOBILE CELLSITES, CABLE TV FACILITIES FOR SERVICE PROVIDERS, AND ELECTRONICS EQUIPMENT, PROVIDING PENALTIES FOR VIOLATION THEREOF AND FOR OTHER PURPOSES.

Be it ordainced by the Honorable Sangguniang Panlungsod in session assembled and by authority of the same that: CHAPTER I GENERAL PROVISION

SECTION 1. TITLE. This Ordinance shall be known as “The Telecommunication Cables, Telecommunications Towers, Electronics Equipment, Building Structured Cabling and Cable TV Facilities Regulation Ordinance 2016”.

SECTION 2, DECLARATION OF POLICY. It is hereby declared the policy of the city to promote the development of an efficient and sufficient telecommunication sector consistent with prescribed standards to meet the needs of the growing community and to make the City of Butuan the center of excellence of telecommunications and technology in Caraga Region.

SECTION 3. PURPOSES. The following are the purposes of this Ordinance: h) Set or provide minimum design standards necessary for the safety and proper installation, operation and maintenance of telecommunication cables, communication towers, electronic equipment, structured cables and cable TV facilities/equipment; i) Solve the problem of continuous and unregulated messy telecommunication cable installation, sagging, spaghetti and unbundled cables and wires that cause accidents to general public; j) Provide basic minimum provision considered necessary for safety, aesthetics, comfort, good workmanship and proper operation and maintenance in telecommunication and cable facilities/ equipment; k) Assist in the realization of savings for the one who pays for the work in the installation, operation and maintenance of telecommunication cable and cable facilities/equipment; l) Enforce and implement the good Engineering Practice and in compliance with prescribed rules and standard as sighted in the implementing Rules and Regulation; m) Regulate the installation and maintenance of telecommunication cables, wires and other attachments installed on poles, towers, and/or service drops; and n) Enforce corrective measures on problems such as excessive sagging, dangling cables, service drops and other attachments to poles, towers along roads, bridges,markets, parks and other public places.

SECTION 4. SCOPE OF APPLICATION. This Ordinance and its Implementing Rules and Regulations shall apply to:

SECTION 5. DEFINITION OF TERMS. For purposes of this ordinance and its Implementing Rules and Regulations, the following words and phrases are defined and understood to have the meaning correspondingly indicated herein, to wit: d) Electronics – the science dealing with the development and application of devices and systems involving the flow of electrons or other carriers of electric charge, in a vacuum, in gaseous media, in plasma, in semiconductors, in solid-state and/or in similar devices, including, but not limited to, applications involving optical, electromagnetic and other energy forms when transduced or converted into electronic signals. e) Professional Electronics Engineer – shall refer to a person who is holding a valid certificate of registration as Professional Electronics Engineer under Republic Act No. 9292 and to affix to his/ her name the letters “PECE” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Communication, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially endorsed by any Chapter of the Institute of Electronics and Communication Engineers of the Philippines, Inc. (IECEP). f) Electronics Engineer – shall refer to a person who is holding a valid certificate of registration as Electronics Engineer under Republic Act No. 9292 and to affix to his/her name the letters “ECE” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially by any Chapter of the Institute of Electronics and Communication Engineers of the Philippines, Inc. (IECEP). d) Electronics Technician - shall refer to a person who is holding a valid certificate of registration as Electronics Technician under Republic Act No. 9292 and is affix to his/her name the letters “ECT” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially endorsed by any Chapter of the Institute of Electronics and Communications Engineers of the Philippines, Inc. (IECEP). e) Electronics and Communications Engineer – shall refer to a person who is holding a valid certificate of registration as Electronics and Communications Engineer under Republic Act No. 5734 issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/ or officially endorsed by any Chapter of the Institute of Electronics and Communications Engineers of the Philippines, Inc. (IECEP). cc) Electronics Equipment – equipment that involves conduction of electrons (especially in gas or vacuum or semiconductor) like amplifiers, audio system, sound system, equalizers, detectors, mixers, modems, radios, monitors, telephone set, telephone switch, oscilloscope, auxiliary equipment, scrambler, television, video equipment and etc. dd) Communications - the process of sending and/or receiving information, data, signals and/or messages between two (2) or more points by radio, cable, optical wave guides or other devices and wired or wireless medium; ee) Telecommunications – any transmission, emission or reception of voice, data, electronic messages, text, written or printed matter, fixed or moving pictures or images, words, music or visible or audible signals or sounds, or any information, intelligence and/or control signals of any design/format and for any purpose, by wire, radio spectral, visual/optical/light, or other electronic, electromagnetic and technological means. ff) Commercial Establishment – shall include but not limited to office buildings, hotels, motels, hospitals, condominiums, stores, apartments, supermarkets, schools, studios, stadia, parking areas, memorial chapels/parks, watercraft and aircraft used for business or profit, and any other building/s or area/s for business purposes, where electronic or electronically-controlled machinery or equipment are installed and/or are being used, sold, maintained, assembled, manufactured or operated. gg) Electronics Permit – A written authorization granted by the City Architect’s Office to an applicant allowing him to proceed with the installation of telecommunication cables, communication towers, electronics equipment, building structured cables and cable facilities after plans, specifications and other pertinent documents have been found to be in conformity with this ordinance and its implementing rules, regulations and standards. It is also a document given to existing companies, commercial establishments, and other parties having electronics equipment in their positions which are taxable in nature after the inspection and seeking of permit from the city government. hh) Plant – refers to the whole or portion of the physical property of a communications company and cable TV operators which contribute to the furnishing of communication or Cable TV service. ii) Pole User – Any person, natural or juridical, including government agencies and entities that use the poles and towers for the installation of any cable, wires, service drops and other attachments. jj) Pole Owner – Any person, natural or juridical, including government agencies and entities that own poles, towers and its accessories. kk) CAO – City Architect’s Office. ll) Wire/Cable Mounting Bracket – steel fabricated mounting wire/cable racks that are commonly adopted by all pole users. Each rack is capable of six (6) pre-assigned pole users and installed directly on pole or through alley arm. mm) Telecommunication Tower – typically, tall structures designed to support antennas (also known as aerials) for telecommunications and broadcasting, including television. nn) Structural Cabling – is/are wiring network that carries all data, voice, multimedia, security, VoIP, PoE, wireless connections throughout the building or campus. It includes everything from the data center to the desktop, including cabling, connecting hardware, equipment, telecommunications rooms, cable pathways, work areas, and even the jacks on the wall plate (face plate) in the office. oo) Service Drop Wire/Line – is an overhead electrical line running from a utility pole, to a customer’s building or other premises. It is the point where electric utilities or telephone that provide power or signal to their customers. pp) Cable/Wire – An electrical cable comprises two or more wires running side by side and bonded, twisted, or braided together to form a single assembly, the ends of which can be connected to two devises, enabling the transfer of electrical signals from one device to the other. Cables are used for a wide range of purposes, and each must be tailored for that purpose. Cables are used extensively in electronic devises for power and circuits. qq) Primary Cable – are group of telephone wires connected from Central’s Office main distribution frame usually 2,000 – 5,000 pairs to the distribution/outside plant cabinets. A fiver optic cable is also a primary cable. rr) Secondary Cable –are group of copper telephone wires connected from distribution/outside plant cabinets, usually 200, 500 or 1,000 pairs which are distributed to terminal boxes or distribution points. ss) Redundant Wires/Cables – are wires or cables installed from one or many telecom provider’s terminal or distribution poin to the same destination which cause messy and out of standard installation. tt) Improper Installation – is an installation not following the right standards that is the major cause of the most common problems. uu) Violation Notice – is a notice to be served by the CAO to an identified party violating some provisions of this ordinance. vv) Multiple poles – refer to the existence of two or more poles situated within twenty (20) meters from each other. ww) Communications tower/mast – is a structure with corresponding height and support, same as telecommunication tower design for holding any communication antenna either receiving or transmitting. This structure should follow standards set by governing bodies. xx) CFCC – City Electronics and Communications Council, is the policy making bodyd and the overseer of the implementation of the electronics ordinance of the City of Butuan. yy) FDAS – Fire Detection and Alarm System.

SECTION 10. MULTIPLE POLES. The installation of two or more poles should be avoided because it will be unsightly, poses more hazards, uneconomical, causes obstruction to pedestrians, and in some cases, an impediment to the construction of buildings and other structures.

For this purpose, only one pole should be erected and all other pole users should share in the use of this pole. g) Right of first refusal to electric distribution franchise to erect a pole. As the franchisee with obligation to serve the electric power needs of the public, which is of basic and prime importance, it is given the right of first refusal to erect or install poles, towers, support structures along public roads, bridges, and other public places. This is without prejudice to the right of transmission company which has a franchise to install poles and towers for its transmission lines. h) In the event the electric distribution franchisee fails to refuses to install the pole notice within 30-day period from the date a written notice was received from the CAO, the City thru the CAO may on its own install the pole out of the funds of the City Government, or authorize any interested pole user to install the pole, provided that in any case such installation shall be subject to the requirements herein provided. i) No person, natural or juridical may erect a pole without first obtaining an Excavation or Erection Permit from the CAO, and the authorization from the City as mentioned above is presented. j) Poles that will be erected shall be constructed in conformity with standards so they could be used by electric distribution franchisee, and all other pole users for telephone/telecommunication companies, cable TV’s and other pole user, and to comply with existing laws, ordinances, rules and regulations. k) The pole owner shall allow his poles to be used by others, subject to the compliance of reasonable technical requirements as provided herein, and in accordance with a reasonable joint pole agreement with the pole user, which should be as much as possible uniform with all other pole users. In addition that pole owner shall provide and maintain at its own cost, the approved Cable/ Wire Mounting Bracket whose spaces or slots are pre-assigned to existing and incoming pole users. l) Existing Multiple poles. The City Architect’s Office in consultation with the electric distribution franchisee, telephone/telecommunication companies shall find ways and means to eliminate existing multiple poles within the city, including but not limited to the following: 4. Removal of all other poles and retaining only the pole of the electric distribution franchisee, if cluster poles are located. Owners of existing multiple poles are hereby granted, a grace period off six (6) months, from effectivity of this Ordinance, to remove their polces subject to some exception as stated in the Implementing Rules and Regulations.

5. Requiring the pole to be retained that it be replaced with one that will conform with minimum standards to be usable for all pole users.

6. Requiring the owner of the ple to be retained to allow the use of its pole by other pole users in accordance with Sec. 4.

CHAPTER 2 IN-HOUSE CABLING

SECTION 6. REGULATION. It shall be unlawful for any person, firm or corporation, including any agency or instrumentality of the government to install telecommunication and cable facilities/equipment in their respective residential, commercial, institutional and industrial establishment without first obtaining an Electronics Permit therefore from the City Architect’s Office.

SECTION 11. TECHNICAL REQUIREMENTS. All attachments must conform to the provisions of the Philippine Electrical Code and comply with the requirements provided hereof, to wit: Vertical Clearances: Joint pole owners shall install their wires, cables and other attachments at such height from the ground level as will allow safe passage of vehicles and pedestrians, and provide for safe distance from the Electrical Distribution Utility wires and facilities, to avoid contacts.

SECTION 7. REQUIREMENT. Electronics Permit shall be issued by the City Architect’s Office for the installation of the above-stated telecommunication cables, communication towers, electronics equipment and cable facilities (in-house cabling) without a plan, design and specification that maybe prepared by Registered Electronics Engineers, but must be signed by a Professional Electronics Engineer (PECE) under Republic Act No. 9292.

SECTION 8. PROHIBITION. No plans and specifications covered by Electronics Permit shall be changed, modified or altered without the approval of the CAO and the work shall be done in accordance thereto.

If a permit was issued and defect was later found during installation which is not clearly defined in the specifications/design submitted during application of permit, the CAO shall require the permitee to effect the necessary corrections thereto.

CHAPTER 3 OUTSIDE PLANT CABLING

SECTION 9. SAFETY REGULATIONS, CLEARANCES AND CONSTRUCTION STANDARDS. p) Pole user shall install its wires or attachments at the designated level of the pole and shall observe government safety regulations, clearances, and construction standard, to avoid any obstruction of the normal flow to the electric conductors of Electric Company. Any alteration, modification, revisions and/or reconstruction, as may be necessary, shall likewise conform to the aforesaid regulations, clearances and construction standards. Pole user found at fault shall be the solely liable if its wire/ cable and other installation cause damage to any party’s life and property. q) In no case shall pole user tamper, tap or connect with any other attachments on the jointly used poles, or on the wire/cables, service drop line, insulators and other line accessories of electric utility or other pole users. The provisions of Republic Act No. 7832 (Aanti-Electricity Company and Transmission Lines/Materials Pilferage Act of 1994) shall apply. r) All attachments of pole user which require the consumption of electric power, shall not be connected by pole user to any electric lines or other existssing attachments. In the event that pole users tap or use any other lines without first securing the prior written approval or consent from electric company shall then be liable under the Wiretapping Law. In no instance a pole user taps, makes or cause to be made any connection that require the consumption of electric power to the electric lines of electric

company, or other existing pole attachments, without the prior written consent or approval from Electric company then the provisions of Republic Act No. 7832 (Anti-Electricity and Transmission Lines/Materials Pilferage Act of 1994) shall apply.

Maintenance. Pole user shall provide the necessary supports, with pole-owner’s approval, on structures that need reinforcement before the lines, attachments or accessories shall be installed.

Each party shall maintain its own facilities at its own expense and when it becomes necessary to relocate, replace, or remove a jointly use pole, each polc-user shall transfer its own attachments at its own expense.

Installation of Cables, Attachments and Accessories on Poles. In order to ensure safety, orderliness and cleanliness, it shall be the duty of the service providers that the installation of its cables, attachments and accessories on any pole, shall conform with the Philippine Electrical Code, Philippine Electronics Code, and the corresponding IRR including the IRR of this Ordinance. The IRR of this Ordinance that shall be formulated shall provide for the rules and guidelines on the proper installation and maintenance of cables, service lines, other attachments and accessoriesx on the poles that shall be observed to ensure safety, orderliness and cleanliness.

Relocation or Replacement – In the event it becomes necessary to transfer the location or to replace an existing jointly use pole, pole-owner shall advice pole user in writing of the schedule of such relocation or replacement in order to avoid delay in the execution of the work to be done by pole-owner. Pole user, upon receipt of the proper notice from pole-owner, shall promptly remove its lines, attachments and accessories at its own expense.

Sharing the use of the poles installed along the public roads to other pole-users is encourage. Any utilities desiring to install new poles, shall consult first with the CAO as to the minimum standard of the poles, considering already the space requirements needed by the oher pole users (Telcos, CATV, and Electric Company) and the clearances required by the PEC and national Building code. The pole owner shall provide the appointed Cable/Wire Mounting Bracket, whose spaces are already pre-asssigned to the existing and upcoming pole-users.

There should be a uniform Standard Joint Pole Use Agreement to be followed by all pole owners to ensure flexibility and early monitoring, except, if the pole owner is the electric utility, wherein necessary additional provisions that may added for the protection and safety of the electrical lines and equipment. Pole owner shall be responsible for maintaining the good condition of the pole and the attached mounting bracket and at all times ensure its safety to the public. In case the electric utility need to install poles longer its size of what was installed by the telcos or other service providers, the CAO will allow the electric utility to install its own, and the CAO shall oblige and direct the pole owner to retire its pole after individual users transfer their attachments to the new electric pole.

Bonding/Lashing. If pole user has two or more service drop wire or line, pole user shall bind such wires together using standard binding materials at 1.5 meters space interval. If there are more than 10 wires it shall be replaced with multi-conductor. Joint pole users shall pay the corresponding penalty, in case they fail to bundle their wires. In no case service drop wire/line shall be used as messenger wire/line of pole user’s wires.

Tagging. For purposes of identification of the owner of the pole, cable/wire, and other installations, pole owner and pole users shall provide identification tags of their pole, primary and secondary cables, and other installations, which shall be visible from the ground. For cables/wires, the tagging shall be at the distance of 0.50 meter from the pole. The CAO shall designate the color coding of all pole users. Failure of the pole users to tag their installations shasll be considered as loose wires and the CAO shall order for the removal and shall impose appropriate penalty thereto.

Polce-users shall maintain cable/wires sag not exceeding 2% of the polce span. Once the sag is correctly established in a particular span, the same shall be consistently followed by the subsequent pole-users. Pole-user shall be faully bound to correct the sag as required after the CAO during its inspection. The CAO shall see to it that there will be uniform cable/wire sag through-out the s[pan. The maximum distance between poles shall not exceed 50 meters. aa) Prohibition of drop wires in pole-to-pkole distribution. – Telecommunication companies and Cable TV operators shall use cable wires in pole-to-pole distributions.Service drops shall only be used from pole to customer service entrance. These service drops shall be appropriately bundled based on the approved bundling scheme and the same shall be properly tensioned as specified in the PEC or any other Engineering Manuals. The connection point of telephone and CATV service lines shall only be at the pole to the subscriber’s service entrance and no telephone terminal(s) or drop wires will be terminasted at mid-span or in between poles and no service drop shall cross the road diagonally. The manner and requirement in the installation of terminal boxes shall be provided in the IRR. bb) Building Service Entrance. It shall be the responsibility of the building owner to provide service entrance facility for the telecommunication lines such as but not limited to telephone, CATV and CCTV in every building, including those that are designed for multi-occupancy.

The service entrance location shall be at the point where the electric service entrance is located. All overhead cable/wirings of service providers shall be on the same run with the electricity supply. This is to ensure orderly installations from a common tapping pole to the building. cc) Redundant Wire/Cables and Other Attachments and Improper Installations. Upon the determination of the CAO based on its inspection or upon the report of the pole owner, any pole user, or any concerned citizen, of redundant wires/cables and other attachments and other installations, the CAO shall order for its correction or removal of such wires/cables, other attachments and improper installations through a Violation Notice issued to the pole users and pole owner. Sanctions shall be imposed if the pole user fails or refuses to correct or remove for the period required by the CAO. The pole user and the pole owner may conduct a separate evaluation for possible sanction if there is violation to the JPA. dd) For all new installation of outside cable as may be required by the City Government thru the City Architect’s Office (CAO) should be underground or burial on specific places.

SECTION 12. PROHIBITIONS. The following violations for outside plant cabling are hereby declared as unlawful and shall subject the offender to the penalties provided in this Ordinance, to wit: q) Failure to transfer the cable/wires to the new pole within the specified period required by the CAO. r) Failure to bundle their cable/wires. s) Failure to provide assigned cable/wires and other installations Identification Tag.

Failure to correct other hazardous conditions of pole, any part of the structure, or wires/cables and other attachment.

Failure to replace drop wires between poles that exceed 10 pairs.

Failure to provide Service Entrance Facilities. aa) Failure to correct excessive sagging. bb) Installation and alteration of cable/wire and other facilities without permit. cc) Installation of multiple poles without authorization from the CAO. dd) Failure to remove multiple poles despite written notice from the CARO for such removal. ee) Failure to correct the installation of poles that is not in conformity with the standards. ff) Failure to perform other corrective actions or other requirements whenever directed by the CAO.

If pole-user violates the agreement with pole-owner or any of those enumerated in Section 12, the latter shall inform the former, and the Notice of Violation will be provided by the CAO stating the specific violation/s and the corresponding sanctions and CAO shall conducut an investigation of such violation.

SECTION 13. DESIGNATED AREA FOR INSTALLATION. Designated area for installation of telecommunication towers shall be in accordance with existing local land use and zoning ordinances. The following should be strictly observed as stated in this Ordinance, to wit:

SP ORDINANCE NO. 4942-2016 AN ORDINANCE REGULATING THE INSTALLATION, OPERATION AND MAINTENANCE OF TELECOMMUNICATION CABLES, TELECOMMUNICATION TOWERS, BUILDING STRUCTURED CABLINGS, MOBILE CELLSITES, CABLE TV FACILITIES FOR SERVICE PROVIDERS AND ELECTRONICS EQUIPMENT, PROVIDING PENALTIES FOR VIOLATION THEREOF AND FOR OTHER PURPOSES.

d) No tower/mobile cell sites shall be installed without securing Barangay Resolution interposing no objection to the proposed project, approval of the Permits and Licensing Division, CPDO and CAO. If to be installed in residential areas, a public consultation is required, before the actual installation can proceed. e) Installation of towers near hospitals, schools, public markets, churches and crowded public places should also secure the necessary clearance from other government agencies. f) No mobile cell sites or communication tower/mast shall be installed nearby the airports without conforming to the International Aviation Law Standards. A clearance from the Civil Aviation Authority of the Philippines (CAAP) is also required.

Be it ordainced by the Honorable Sangguniang Panlungsod in session assembled and by authority of the same that: CHAPTER I

SECTION 14. COLOR DESIGNATION AND TOWER LIGHTING. All telecommunication transmitter and transceiver towers that are already existing and those that may be constructed and/or installed in this designated area in the future shall be painted alternate with orange and white. All transmitter and transceiver towers already existing shall comply with this requirement within one (1) year from the approval of this Ordinance.

SECTION 1. TITLE. This Ordinance shall be known as “The Telecommunication Cables, Telecommunications Towers, Electronics Equipment, Building Structured Cabling and Cable TV Facilities Regulation Ordinance 2016”.

Tower lighting should be installed in the top most part of the structure. Tower lamps shall be maintained in working condition at all times. For towers exceeding the height of 200 ft, an additional lamp shall be installed at middle of the mast/tower. The tower lamp should be colored “red”, as set by the International Standards.

SECTION 2, DECLARATION OF POLICY. It is hereby declared the policy of the city to promote the development of an efficient and sufficient telecommunication sector consistent with prescribed standards to meet the needs of the growing community and to make the City of Butuan the center of excellence of telecommunications and technology in Caraga Region.

SECTION 15. EARTHING AND LIGHTNING PROTECTION OF TOWER. All towers shall be grounded and the earth resistance measured at the earth terminal block shall be less than 5 ohms. Earthing and Lightning protection shall be provided in all completed tower sites to protect equipment from damage and personnel from harm which may results from excessive voltages during a lightning strike that might also affect people nearby especially if the tower is installed in residential areas or on top of buildings.

CHAPTER 5 ELECTRONICS PERMIT

SECTION 16. APPLICATION FOR ELECTRONICS PERMIT. Applicant for Electronics Permit shall: C. Fill up the prescribed application form and file the same with the CAO. The said application shall provide at least then the following information: 8) A description of work (project plan) to be covered by the permit; 9) For in-house cabling, description and ownership of the building where the telecommunication cable facility will be installed. The applicant must provide the Building/Occupancy Permit or copy of the contract of lease of the building, or duly notarized authority to install executed by the owner, if applicant is not the registered owner; 10) For outside plant cabling, attachment original copy either of the following duly signed document: iv. Joint Pole Agreement(s) (JPAs) between applicant and the entity that owns the distribution pole(s), AND Notice to Proceed by the distribution utility. v. Memorandum of Agreement or lease contract between applicant and entity providing conduit or ducting facility. vi. Lease contract between applicant and carrier/backbonr service provider.

11) The use for which the telecommunication cable is intended; 12) Specifications of Broadcast equipment, electronic signages, cinema equipment including venue, lights and sounds, Automated Teller Machines, CCTVm FDASm elector-medical equipment, data centers and other related electronics equipment; 13) Bill of materials and installation costs; and 14) Electronic plan and design duly signed and sealed by a Professional Electronics Engineer (PECE) undere Republic Act No. 9292.

Such application shall be accompanied by at least five-(5) sets of corresponding plans and specifications prepared, and sealed by a Professional Electronics Engineer (PECE).

D. Submit all ancillary documents required for the particular installation or work being applied for in accordance with the provisions of this Ordinance and its IRR.

SECTION 17. ISSUANCE OF PERMIT. After evaluation of the application and the plans and specifications and the same having satisfied and conformed with the approved standard requirements clearly defined in the Implementing Rules and Regulations, the CAO shall issue the Electronics Permit within fifteen (15) days from the date of filing. In case non-compliance the CAO shall notify the applicant within reasonable time prior to the expiration of the 15-day period.

All approve permit shall remain valid unless the permittee/applicant fails (a) to commence the installation or work authorized therein within a period of one (1) year from the date of effectivity of the permit; (b) suspends or abandons the installation/work at anytime after it has commenced for a period of 120 days. In such case the permit is deemed to have expired.

SECTION 18. NON-ISSUANCE, SUSPENSION OR REVOCATION OF PERMIT. The CAO may order or cause the non-issuance , suspension or revocation of Electronics Permit on any of the following reasons or grounds: e) Errors fofund in the plans and specifications; f) Incorrect or inaccurate data or information supplied; g) Non-compliance with provisions of the Philippine Electronics Code, National Building Code or any rule or regulation relative thereto, this Ordinance and its Implementing Rules and Regulations; h) Failure to comply with other requirements the CAO may impose based on pertinent rules and regulations.

The applicant may apply for reconsideration of the Order within 15 days from the date of receipt or advice thereof.

SECTION 19. ELECTRONIC PERMIT FEES AND CHARGES. There shall be imposed fees to be collected by the City Treasurer’s Office for the issuance of Electronics Permit in residential, commercial and industrial establishments at the following rates:

It includes everything from the data center to the desktop, including cabling, connecting hardware, equipment, telecommunications rooms, cable pathways, work areas, and even the jacks on the wall plate (face plate) in the office. lll) Service Drop Wire/Line – is an overhead electrical line running from a utility pole, to a customer’s building or other premises. It is the point where electric utilities or telephone that provide power or signal to their customers. mmm) Cable/Wire – An electrical cable comprises two or more wires running side by side and bonded, twisted, or braided together to form a single assembly, the ends of which can be connected to two devises, enabling the transfer of electrical signals from one device to the other. Cables are used for a wide range of purposes, and each must be tailored for that purpose. Cables are used extensively in electronic devises for power and circuits. nnn) Primary Cable – are group of telephone wires connected from Central’s Office main distribution frame usually 2,000 – 5,000 pairs to the distribution/outside plant cabinets. A fiver optic cable is also a primary cable. ooo) Secondary Cable –are group of copper telephone wires connected from distribution/outside plant cabinets, usually 200, 500 or 1,000 pairs which are distributed to terminal boxes or distribution points. ppp) Redundant Wires/Cables – are wires or cables installed from one or many telecom provider’s terminal or distribution point to the same destination which cause messy and out of standard installation. qqq) Improper Installation – is an installation not following the right standards that is the major cause of the most common problems. rrr) Violation Notice – is a notice to be served by the CAO to an identified party violating some provisions of this ordinance. sss) Multiple poles – refer to the existence of two or more poles situated within twenty (20) meters from each other.

Communications tower/mast – is a structure with corresponding height and ttt) support, same as telecommunication tower design for holding any communication antenna either receiving or transmitting. This structure should follow standards set by governing bodies. uuu) CFCC – City Electronics and Communications Council, is the policy making body and the overseer of the implementation of the electronics ordinance of the City of Butuan.

GENERAL PROVISION

SECTION 3. PURPOSES. The following are the purposes of this Ordinance: o) Set or provide minimum design standards necessary for the safety and proper installation, operation and maintenance of telecommunication cables, communication towers, electronic equipment, structured cables and cable TV facilities/equipment; p) Solve the problem of continuous and unregulated messy telecommunication cable installation, sagging, spaghetti and unbundled cables and wires that cause accidents to general public; q) Provide basic minimum provision considered necessary for safety, aesthetics, comfort, good workmanship and proper operation and maintenance in telecommunication and cable facilities/equipment; r) Assist in the realization of savings for the one who pays for the work in the installation, operation and maintenance of telecommunication cable and cable facilities/equipment; s) Enforce and implement the good Engineering Practice and in compliance with prescribed rules and standard as sighted in the implementing Rules and Regulation; t) Regulate the installation and maintenance of telecommunication cables, wires and other attachments installed on poles, towers, and/or service drops; and u) Enforce corrective measures on problems such as excessive sagging, dangling cables, service drops and other attachments to poles, towers along roads, bridges,markets, parks and other public places.

SECTION 4. SCOPE OF APPLICATION. This Ordinance and its Implementing Rules and Regulations shall apply to: g) All telecommunication cable, local area network (LAN) cables and cable facility/equipment installation in building (in-house cabling) such as residential, commercial, institutional and industrial establishments on which building house wirings utilizing but not limited to copper cables, coaxial cable, fiber optics and other media, including structured cabling for telephone, cable television, computer and data communications; h) The installation, operation and maintenance for outside cabling of telecommunication cable and cable facilities/equipment for service providers. i) The installation of communication towers and the like.

SECTION 5. DEFINITION OF TERMS. For purposes of this ordinance and its Implementing Rules and Regulations, the following words and phrases are defined and understood to have the meaning correspondingly indicated herein, to wit: g) Electronics – the science dealing with the development and application of devices and systems involving the flow of electrons or other carriers of electric charge, in a vacuum, in gaseous media, in plasma, in semiconductors, in solid-state and/or in similar devices, including, but not limited to, applications involving optical, electromagnetic and other energy forms when transduced or converted into electronic signals. h) Professional Electronics Engineer – shall refer to a person who is holding a valid certificate of registration as Professional Electronics Engineer under Republic Act No. 9292 and to affix to his/ her name the letters “PECE” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially endorsed by any Chapter of the Institute of Electronics and Communication Engineers of the Philippines, Inc. (IECEP). i) Electronics Engineer – shall refer to a person who is holding a valid certificate of registration as Electronics Engineer under Republic Act No. 9292 and to affix to his/her name the letters “ECE” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially by any Chapter of the Institute of Electronics and Communication Engineers of the Philippines, Inc. (IECEP). d) Electronics Technician - shall refer to a person who is holding a valid certificate of registration as Electronics Technician under Republic Act No. 9292 and is affix to his/her name the letters “ECT” issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/or officially endorsed by any Chapter of the Institute of Electronics and Communications Engineers of the Philippines, Inc. (IECEP). e) Electronics and Communications Engineer – shall refer to a person who is holding a valid certificate of registration as Electronics and Communications Engineer under Republic Act No. 5734 issued by the Board of Examiners for Electronics and Communications Engineer or the Professional Regulations Commission, duly issued with Professional Tax Receipt from the City of Butuan, and accredited and/ or officially endorsed by any Chapter of the Institute of Electronics and Communications Engineers of the Philippines, Inc. (IECEP). zz) Electronics Equipment – equipment that involves conduction of electrons (especially in gas or vacuum or semiconductor) like amplifiers, audio system, sound system, equalizers, detectors, mixers, modems, radios, monitors, telephone set, telephone switch, oscilloscope, auxiliary equipment, scrambler, television, video equipment and etc. aaa) Communications - the process of sending and/or receiving information, data, signals and/or messages between two (2) or more points by radio, cable, optical wave guides or other devices and wired or wireless medium; bbb) Telecommunications – any transmission, emission or reception of voice, data, electronic messages, text, written or printed matter, fixed or moving pictures or images, words, music or visible or audible signals or sounds, or any information, intelligence and/ or control signals of any design/format and for any purpose, by wire, radio, spectral, visual/optical/light, or other electronic, electromagnetic and technological means. ccc) Commercial Establishment – shall include but not limited to office buildings, hotels, motels, hospitals, condominiums, stores, apartments, supermarkets, schools, studios, stadia, parking areas, memorial chapels/parks, watercraft and aircraft used for business or profit, and any other building/s or area/s for business purposes, where electronic or electronically-controlled machinery or equipment are installed and/or are being used, sold, maintained, assembled, manufactured or operated. ddd) Electronics Permit – A written authorization granted by the City Architect’s Office to an applicant allowing him to proceed with the installation of telecommunication cables, communication towers, electronics equipment, building structured cables and cable facilities after plans, specifications and other pertinent documents have been found to be in conformity with this ordinance and its implementing rules, regulations and standards. It is also a document given to existing companies, commercial establishments, and other parties having electronics equipment in their positions which are taxable in nature after the inspection and seeking of permit from the city government. eee) Plant – refers to the whole or portion of the physical property of a communications company and cable TV operators which contribute to the furnishing of communication or Cable TV service. fff) Pole User – Any person, natural or juridical, including government agencies and entities that use the poles and towers for the installation of any cable, wires, service drops and other attachments. ggg) Pole Owner – Any person, natural or juridical, including government agencies and entities that own poles, towers and its accessories. hhh) CAO – City Architect’s Office. iii) Wire/Cable Mounting Bracket – steel fabricated mounting wire/cable racks that are commonly adopted by all pole users. Each rack is capable of six (6) pre-assigned pole users and installed directly on pole or through alley arm. jjj) Telecommunication Tower – typically, tall structures designed to support antennas (also known as aerials) for telecommunications and broadcasting, including television. kkk) Structural Cabling – is/are wiring network that carries all data, voice, multimedia,

CHAPTER 2 IN-HOUSE CABLING

SECTION 6. REGULATION. It shall be unlawful for any person, firm or corporation, including any agency or instrumentality of the government to install telecommunication and cable facilities/equipment in their respective residential, commercial, institutional and industrial establishment without first obtaining an Electronics Permit therefore from the City Architect’s Office.

SECTION 7. REQUIREMENT. Electronics Permit shall be issued by the City Architect’s Office for the installation of the above-stated telecommunication cables, communication towers, electronics equipment and cable facilities (in-house cabling) without a plan, design and specification that maybe prepared by Registered Electronics Engineers, but must be signed by a Professional Electronics Engineer (PECE) under Republic Act No. 9292.

SECTION 8. PROHIBITION. No plans and specifications covered by Electronics Permit shall be changed, modified or altered without the approval of the CAO and the work shall be done in accordance thereto.

If a permit was issued and defect was later found during installation which is not clearly defined in the specifications/design submitted during application of permit, the CAO shall require the permitee to effect the necessary corrections thereto.

CHAPTER 3 OUTSIDE PLANT CABLING

SECTION 9. SAFETY REGULATIONS, CLEARANCES AND CONSTRUCTION STANDARDS. ee) Pole user shall install its wires or attachments at the designated level of the pole and shall observe government safety regulations, clearances, and construction standard, to avoid any obstruction of the normal flow to the electric conductors of Electric Company. Any alteration, modification, revisions and/or reconstruction, as may be necessary, shall likewise conform to the aforesaid regulations, clearances and construction standards. Pole user found at fault shall be the solely liable if its wire/cable and other installation cause damage to any party’s life and property. ff) In no case shall pole user tamper, tap or connect with any other attachments on the jointly used poles, or on the wire/cables, service drop line, insulators and other line accessories of electric utility or other pole users. The provisions of Republic Act No. 7832 (Aanti-Electricity Company and Transmission Lines/Materials Pilferage Act of 1994) shall apply. gg) All attachments of pole user which require the consumption of electric power, shall not be connected by pole user to any electric lines or other existssing attachments. In the event that pole users tap or use any other lines without first securing the prior written approval or consent from electric company shall then be liable under the Wiretapping Law. In no instance a pole user taps, makes or cause to be made any connection that require the consumption of electric power to the electric lines of electric company, or other existing pole attachments, without the prior written consent or approval from Electric company then the provisions of Republic Act No. 7832 (Anti-Electricity and Transmission Lines/Materials Pilferage Act of 1994) shall apply. hh) Maintenance. Pole user shall provide the necessary supports, with pole-owner’s approval, on structures that need reinforcement before the lines, attachments or accessories shall be installed.

Each party shall maintain its own facilities at its own expense and when it becomes necessary to relocate, replace, or remove a jointly use pole, each polc-user shall transfer its own attachments at its own expense. ii) Installation of Cables, Attachments and Accessories on Poles. In order to ensure safety, orderliness and cleanliness, it shall be the duty of the service providers that the installation of its cables, attachments and accessories on any pole, shall conform with the Philippine Electrical Code, Philippine Electronics Code, and the corresponding IRR including the IRR of this Ordinance. The IRR of this Ordinance that shall be formulated shall provide for the rules and guidelines on the proper installation and maintenance of cables, service lines, other attachments and accessoriesx on the poles that shall be observed to ensure safety, orderliness and cleanliness. jj) Relocation or Replacement – In the event it becomes necessary to transfer the location or to replace an existing jointly use pole, pole-owner shall advice pole user in writing of the schedule of such relocation or replacement in order to avoid delay in the execution of the work to be done by pole-owner. Pole user, upon receipt of the proper notice from pole-owner, shall promptly remove its lines, attachments and accessories at its own expense. kk) Sharing the use of the poles installed along the public roads to other pole-users is encourage. Any utilities desiring to install new poles, shall consult first with the CAO as to the minimum standard of the poles, considering already the space requirements needed by the other pole users (Telcos, CATV, and Electric Company) and the clearances required by the PEC and national Building code. The pole owner shall provide the appointed Cable/Wire Mounting Bracket, whose spaces are already pre-asssigned to the existing and upcoming pole-users. ll) There should be a uniform Standard Joint Pole Use Agreement to be followed by all pole owners to ensure flexibility and early monitoring, except, if the pole owner is the electric utility, wherein necessary additional provisions that may added for the protection and safety of the electrical lines and equipment. Pole owner shall be responsible for maintaining the good condition of the pole and the attached mounting bracket and at all times ensure its safety to the public. In case the electric utility need to install poles longer its size of what was installed by the telcos or other service providers, the CAO will allow the electric utility to install its own, and the CAO shall oblige and direct the pole owner to retire its pole after individual users transfer their attachments to the new electric pole. mm) Bonding/Lashing. If pole user has two or more service drop wire or line, pole user shall bind such wires together using standard binding materials at 1.5 meters space interval. If there are more than 10 wires it shall be replaced with multi-conductor. Joint pole users shall pay the corresponding penalty, in case they fail to bundle their wires. In no case service drop wire/line shall be used as messenger wire/line of pole user’s wires. nn) Tagging. For purposes of identification of the owner of the pole, cable/wire, and other installations, pole owner and pole users shall provide identification tags of their pole, primary and secondary cables, and other installations, which shall be visible from the ground. For cables/wires, the tagging shall be at the distance of 0.50 meter from the pole. The CAO shall designate the color coding of all pole users. Failure of the pole users to tag their installations shasll be considered as loose wires and the CAO shall order for the removal and shall impose appropriate penalty thereto. oo) Polce-users shall maintain cable/wires sag not exceeding 2% of the polce span. Once the sag is correctly established in a particular span, the same shall be consistently followed by the subsequent pole-users. Pole-user shall be faully bound to correct the sag as required after the CAO during its inspection. The CAO shall see to it that there will be uniform cable/wire sag through-out the s[pan. The maximum distance between poles shall not exceed 50 meters. pp) Prohibition of drop wires in pole-to-pkole distribution. – Telecommunication companies and Cable TV operators shall use cable wires in pole-to-pole distributions.Service drops shall only be used from pole to customer service entrance. These service drops shall be appropriately bundled based on the approved bundling scheme and the same shall be properly tensioned as specified in the PEC or any other Engineering Manuals. The connection point of telephone and CATV service lines shall only be at the pole to the subscriber’s service entrance and no telephone terminal(s) or drop wires will be terminasted at mid-span or in between poles and no service drop shall cross the road diagonally. The manner and requirement in the installation of terminal boxes shall be provided in the IRR. qq) Building Service Entrance. It shall be the responsibility of the building owner to provide service entrance facility for the telecommunication lines such as but not limited to telephone, CATV and CCTV in every building, including those that are designed for multi-occupancy. The service entrance location shall be at the point where the electric service entrance is located. All overhead cable/wirings of service providers shall be on the same run with the electricity supply. This is to ensure orderly installations from a common tapping pole to the building. rr) Redundant Wire/Cables and Other Attachments and Improper Installations. Upon the determination of the CAO based on its inspection or upon the report of the pole owner, any pole user, or any concerned citizen, of redundant wires/cables and other attachments and other installations, the CAO shall order for its correction or removal of such wires/cables, other attachments and improper installations through a Violation Notice issued to the pole users and pole owner.

Sanctions shall be imposed if the pole user fails or refuses to correct or remove for the period required by the CAO. The pole user and the pole owner may conduct a separate evaluation for possible sanction if there is violation to the JPA. ss) For all new installation of outside cable as may be required by the City Government thru the City Architect’s Office (CAO) should be underground or burial on specific places.

SECTION 10. MULTIPLE POLES. The installation of two or more poles should be avoided because it will be unsightly, poses more hazards, uneconomical, causes obstruction to pedestrians, and in some cases, an impediment to the construction of buildings and other structures.

For this purpose, only one pole should be erected and all other pole users should share in the use of this pole. m) Right of first refusal to electric distribution franchise to erect a pole. As the franchisee with obligation to serve the electric power needs of the public, which is of basic and prime importance, it is given the right of first refusal to erect or install poles, towers, support structures along public roads, bridges, and other public places. This is without prejudice to the right of transmission company which has a franchise to install poles and towers for its transmission lines. n) In the event the electric distribution franchisee fails to refuses to install the pole notice within 30-day period from the date a written notice was received from the CAO, the City thru the CAO may on its own install the pole out of the funds of the City Government, or authorize any interested pole user to install the pole, provided that in any case such installation shall be subject to the requirements herein provided. o) No person, natural or juridical may erect a pole without first obtaining an Excavation or Erection Permit from the CAO, and the authorization from the City as mentioned above is presented. p) Poles that will be erected shall be constructed in conformity with standards so they could be used by electric distribution franchisee, and all other pole users for telephone/telecommunication companies, cable TV’s and other pole user, and to comply with existing laws, ordinances, rules and regulations. q) The pole owner shall allow his poles to be used by others, subject to the compliance of reasonable technical requirements as provided herein, and in accordance with a reasonable joint pole agreement with the pole user, which should be as much as possible uniform with all other pole users. In addition that pole owner shall provide and maintain at its own cost, the approved Cable/Wire Mounting Bracket whose spaces or slots are pre-assigned to existing and incoming pole users. r) Existing Multiple poles. The City Architect’s Office in consultation with the electric distribution franchisee, telephone/telecommunication companies shall find ways and means to eliminate existing multiple poles within the city, including but not limited to the following: 7. Removal of all other poles and retaining only the pole of the electric distribution franchisee, if cluster poles are located. Owners of existing multiple poles are hereby granted, a grace period off six (6) months, from effectivity of this Ordinance, to remove their polces subject to some exception as stated in the Implementing Rules and Regulations.

8. Requiring the pole to be retained that it be replaced with one that will conform with minimum standards to be usable for all pole users.

9. Requiring the owner of the ple to be retained to allow the use of its pole by other pole users in accordance with Sec. 4.

SECTION 11. TECHNICAL REQUIREMENTS. All attachments must conform to the provisions of the Philippine Electrical Code and comply with the requirements provided hereof, to wit: Vertical Clearances: Joint pole owners shall install their wires, cables and other attachments at such height from the ground level as will allow safe passage of vehicles and pedestrians, and provide for safe distance from the Electrical Distribution Utility wires and facilities, to avoid contacts.

Such application shall be accompanied by at least five-(5) sets of corresponding plans and specifications prepared, and sealed by a Professional Electronics Engineer (PECE).

F. Submit all ancillary documents required for the particular installation or work being applied for in accordance with the provisions of this Ordinance and its IRR.

SECTION 17. ISSUANCE OF PERMIT. After evaluation of the application and the plans and specifications and the same having satisfied and conformed with the approved standard requirements clearly defined in the Implementing Rules and Regulations, the CAO shall issue the Electronics Permit within fifteen (15) days from the date of filing. In case non-compliance the CAO shall notify the applicant within reasonable time prior to the expiration of the 15-day period.

All approve permit shall remain valid unless the permittee/applicant fails (a) to commence the installation or work authorized therein within a period of one (1) year from the date of effectivity of the permit; (b) suspends or abandons the installation/work at anytime after it has commenced for a period of 120 days. In such case the permit is deemed to have expired.

SECTION 18. NON-ISSUANCE, SUSPENSION OR REVOCATION OF PERMIT. The CAO may order or cause the non-issuance , suspension or revocation of Electronics Permit on any of the following reasons or grounds: i) Errors fofund in the plans and specifications; j) Incorrect or inaccurate data or information supplied; k) Non-compliance with provisions of the Philippine Electronics Code, National Building Code or any rule or regulation relative thereto, this Ordinance and its Implementing Rules and Regulations; l) Failure to comply with other requirements the CAO may impose based on pertinent rules and regulations.

SECTION 21. DUTIES AND RESPONSIBILITIES OF THE COUNCIL. It shall be the duty of the CECC to oversee and to be the policy-making body in relation to the implementation of this Ordinance. The CECC shall also be the technical inspection and validation of Electronics Permit requirement of the City of Butuan. Likewise, it shall be responsible of the following:

1. Adminisstrative and Management Coordination.

2. Delegation and Networking. a. Ensures the execution of tasks through proper delegation of responsibility. b. Seeks and acquires the cooperation and assistance of all stakeholders.

3. Lead in evaluating the implementation of this ordinance. a. Carefully collects and analyzes information and prepares and submits the status reports to include feedback and recommendations.

4. Budget Management. a. Reviews and indorses proposals for use of resources and labor to accomplish goals and tasks. b. Ensures that funds are spent in accordance to that approved programs and budget.

5. Performance Management. a. Ensures that goals aare consistently being met in an effective and efficient manner.

6. Others that maybe required by higher authorities.

SECTION 22. FUNDING SUPPORT TO CECC. Thirty percent (30%) of the total collection for the Electronics Inspection Fee every year shall incur to the CECC as its annual funding support. CHAPTER 4 MOBILE CELLSITE, TELECOMMUNICATION, BROADCAST AND RADIO COMMUNICATION TOWERS

SECTION 13. DESIGNATED AREA FOR INSTALLATION. Designated area for installation of telecommunication towers shall be in accordance with existing local land use and zoning ordinances. The following should be strictly observed as stated in this Ordinance, to wit: g) No tower/mobile cell sites shall be installed without securing Barangay Resolution interposing no objection to the proposed project, approval of the Permits and Licensing Division, CPDO and CAO. If to be installed in residential areas, a public consultation is required, before the actual installation can proceed. h) Installation of towers near hospitals, schools, public markets, churches and crowded public places should also secure the necessary clearance from other government agencies. i) No mobile cell sites or communication tower/mast shall be installed nearby the airports without conforming to the International Aviation Law Standards. A clearance from the Civil Aviation Authority of the Philippines (CAAP) is also required.

SECTION 14. COLOR DESIGNATION AND TOWER LIGHTING. All telecommunication transmitter and transceiver towers that are already existing and those that may be constructed and/or installed in this designated area in the future shall be painted alternate with orange and white. All transmitter and transceiver towers already existing shall comply with this requirement within one (1) year from the approval of this Ordinance.

Tower lighting should be installed in the top most part of the structure. Tower lamps shall be maintained in working condition at all times. For towers exceeding the height of 200 ft, an additional lamp shall be installed at middle of the mast/tower. The tower lamp should be colored “red”, as set by the International Standards.

SECTION 15. EARTHING AND LIGHTNING PROTECTION OF TOWER. All towers shall be grounded and the earth resistance measured at the earth terminal block shall be less than 5 ohms. Earthing and Lightning protection shall be provided in all completed tower sites to protect equipment from damage and personnel from harm which may results from excessive voltages during a lightning strike that might also affect people nearby especially if the tower is installed in residential areas or on top of buildings.

CHAPTER 5 ELECTRONICS PERMIT SECTION 16. APPLICATION FOR ELECTRONICS PERMIT. Applicant for Electronics Permit shall: E. Fill up the prescribed application form and file the same with the CAO. The said application shall provide at least then the following information:

CHAPTER 7 PENALTY CLAUSE

SECTION 23. PENALTY CLAUSE. Any person or institution violating any provision of this Ordinance shall be penalized with a fine of not less than P5,000.00 or imprisonment of not exceeding six (6) months, or both such fine and imprisonment at the discretion of the court.

If the violation is committed by a partnership, firm, corporation, association or any other legal entity, including a government-owned or controlled corporation, the penalty shall be imposed on the president, manager and each of the officers thereof who shall have knowingly permitted, failed to prevent or was otherwise responsible for the commission of the violation.

If pole-user violates the agreement with pole-owner or any of those enumerated in Section 12, the latter shall inform the former, and the Notice of Violation will be provided by the CAO stating the specific violation/s and the corresponding sanctions and CAO shall conducut an investigation of such violation.

15) A description of work (project plan) to be covered by the permit; 16) For in-house cabling, description and ownership of the building where the telecommunication cable facility will be installed. The applicant must provide the Building/Occupancy Permit or copy of the contract of lease of the building, or duly notarized authority to install executed by the owner, if applicant is not the registered owner; 17) For outside plant cabling, attachment original copy either of the following duly signed document: vii. Joint Pole Agreement(s) (JPAs) between applicant and the entity that owns the distribution pole(s), AND Notice to Proceed by the distribution utility. viii. Memorandum of Agreement or lease contract between applicant and entity providing conduit or ducting facility.

SECTION 19. ELECTRONIC PERMIT FEES AND CHARGES. There shall be imposed fees to be collected by the City Treasurer’s Office for the issuance of Electronics Permit in residential, commercial and industrial establishments at the following rates:

The following violations for outside plant cabling are hereby declared as unlawful and shall subject the offender to the penalties provided in this Ordinance, to wit: gg) Failure to transfer the cable/wires to the new pole within the specified period required by the CAO. hh) Failure to bundle their cable/wires. ii) Failure to provide assigned cable/wires and other installations Identification Tag. jj) Violation of pole-ground clearance requirement. kk) Failure to cut and retrieve dangling, loose or cut wires/cables. ll) Failure to follow the assigned space in the Cable/Wire Rack. mm) Failure to remove the unused or redundant poles, wire/cables, line hardware, terminal boxes, booster/amplifier and others. nn) Failure to correct other hazardous conditions of pole, any part of the structure, or wires/cables and other attachment. oo) Failure to replace drop wires between poles that exceed 10 pairs. pp) Failure to provide Service Entrance Facilities. qq) Failure to correct excessive sagging. rr) Installation and alteration of cable/wire and other facilities without permit. ss) Installation of multiple poles without authorization from the CAO. tt) Failure to remove multiple poles despite written notice from the CARO for such removal. uu) Failure to correct the installation of poles that is not in conformity with the standards. vv) Failure to perform other corrective actions or other requirements whenever directed by the CAO.

The applicant may apply for reconsideration of the Order within 15 days from the date of receipt or advice thereof.

Failure of the offender to pay the said fine within seventy two (72) hours period after being served the third and Final Notice of Violation, the City Legal Office shall forward or file the appropriate complaint or information at the Office of the City Prosecutor of Butuan.

CHAPTER 6 CITY ELECTRONICS AND COMMUNICATION COUNCIL

SECTION 20. COMPOSITION OF THE COUNCIL. The CECC shall be composed of the following:

SECTION 25. CREATION OF THE CITY ELECTRONICS INSPECTION UNIT. A City Electronics Inspection Unit with at least one City Electronics Inspector who is a licensed Professional Electronics Engineer with a Salary Grade of 19 or equivalent to Engineer III position in the government, shall be created in accordance to No. 5 of DILG MC-2013-001, Series of 2013. This is to ensure the full implementation of R.A. 929 otherwise known as “Electronics Engineering Law of 2004”. This Section shall be under the Office of the CAO.

SECTION 26. DUTIES OF CITY ELECTRONICS INSPECTOR. It shall be the duty of the City Electronics Inspector to review and validate all applications for Electronics Permits if it’s in accordance withs the prescribed standards and pertinent rules. It shall also be the duty of the City Electronics Inspector to conduct a regular inspection on the installation to which a permit was earlier granted and to submit a correspondidng report thereof to the CAO.

SECTION 27. REPEALING CLAUSE. This Ordinance hereby repeals en toto Section 2, Item No. 7 (Electronics Fees) of SP Ordinance No. 3707-2011, entitled “AN ORDINANCE ADOPTING THE NEW SCHEDULE OF BUILDING PERMIT FEES AND CHARGES, AS PROVIDED UNDER SECTION 203 (4) OF P.D. 1096, AND FOR OTHER PURPOSES.”

Any other Ordinances or provisions thereof that are contrary or inconsistent with this ordinance or any of its provisions is hereby repealed, modified amended accordingly.

SECTION 28. SEPARABILITY CLAUSE. If, for any reason or reasons, any part or provision of this Ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which are not affected shall continue to be in full force and effect.

SECTION 29. TRANSITORY PROVISION. All existisng telecommunication cableand cable facilities shall be respected and given 1 year grace period to adopt and comply with the provisions of this ordinance and its rules, regulations and standards. The expense for which shall be borne by the entity itself or the consortium of concerned entities that may be formed for the purpose.

SECTION 30. IMPLEMENTING RULES, REGULATIONS AND STANDARDS. In order to ensure the proper implementatikon of this Ordinance, the Sangguniang Panlungsod (SP) shall promulgate the Implementing Rules and Guidelines subject to prior consultastion with the Industry Standards (IECEP-Caraga, PCTA), Polc Users, Pole Owners and other affected parties. Such guidelines may include but not limited to the following:

1. Permit Application Procedure 2. Procedures for inspection of wires/cables and other attachment 3. Procedures in the handling of complaints, investigation, corrective actions relative to violation

SECTION 31. EFFECTIVITY. This Ordinance shall take effect thirty (30) days following its publication in local newspaper of general circulation and posting in the bulletin board in two other places in Butuan City.

Salmos had been in a coma until last month.

The appeal, publicized by Hannan, and highlighted the plight of the victim, who lives alone with no family support in Jeddah or any

job to sustain him during his crisis.

Thanks to Hannan’s initiative, Salmos’ plight caught the attention of Human Rights associations when his photo appeared on major social networks, including various channels in the Philippines.

Abdul Hannan has also been in the forefront of other initiatives requiring media intervention. In one such case, he highlighted the plight of 19 OFWs in the AlJouf Province (northern part of Saudi Arabia). Through him, Dondon Lanuza’s case, the OFW on death row based in Dammam Saudi Arabia came to light again after publishing it in Arab News on August 31 that followed his personal letter in Arabic to HRH Prince Alwaleed bin Talal for possible assistance. Lanuza was freed in September this year and now already in his hometown as a freeman.

That move was followed with strong appeal by SPMUDA to the Custodian of the Two Holy Mosques, King Abdullah bin Abdulaziz for his Majesty’s possible intervention.

He just cannot avert his eyes on truth about the real needs of his fellow ‘Pinoy expats’. That, he can serve quite well his fellow overseas Filipinos via diplomatic service. That, he can take the bull by its horn and be a ‘true diplomatic servant’ and companion to his fellow OFWs. Because he knows how to be an OFW since he is one. An OFW! At exactly 7:17 p.m. Friday, presumptive President Rodrigo Duterte wins by a big margin of more than six million votes against his closest rival, former Secretary Mar Roxas.

The most awaited portion on who won the vice presidential seat between Senator Bongbong Marcos and Camarines Sur Rep. Leni Robredo was closely followed by both camps and media.

Robredo won by a slim margin of 263,473 votes after posting a total votes of 14,418,817 against Marcos who only got 14,155,344 The nation will be waiting for the final resolution of the two chamber of Congress declaring the winners of 2016 presidential elections and proclamation immediately follows early next week.

Meanwhile, Robredo said that she is excited to work with President-elect Rodrigo Duterte after Joint Congress sitting as National Board of Canvassers (NBOC) declared them winners in the 2016 elections.

The neophyte solon, in an interview with local journalists in Naga City, could not hide her excitement after NBOC finished its job tabulating their votes where she edged out her closest rival, Senator Bongbong Marcos, by more than 200,000 votes.

“Obligasyon ko po hindi lang bilang susunod na pangalawang pangulo, pero obligasyon ko po bilang Filipino na ibigay ‘yung 100 percent support ko sa kaniya [Duterte]. Kasi ‘yung kaniya naman pong success, hindi naman para sa kaniya. Ang success niya para sa buong bansa,” Robredo said.

“Naging mahirap po ‘yung eleksyon, naging very divisive. Kinakailangan pong mag-rebuild tayo bilang isang bansa at kailangan po ni President Duterte ‘yung ating tulong lahat,” she added.

Shortly after winning the race for vice president she said she was willing to accept cabinet position if offered by the next president [Duterte].

Robredo said she has not spoken with Duterte specifically about the Cabinet position that will be delegated to her. She opts to wait for her proclamation before paying him a visit.

“Palagay ko po napakapremature pa na makipagkita dahil hindi pa ako napoproklama. Hihintayin ko po muna ‘yung aking proklamasyon bago pumunta sa kaniya para magbigay ng aking kortesiya. Ayaw ko naman pong pangunahan,” she explained.

Green Action PH has strongly criticized the Department of Agriculture (DA) and Aquino administration for paving the way for GMOs and biotech corporation interests in the country.

While there are no conclusive scientific evidence on the safety of GMOs allowed for feeds and food processing, the government continues to evade studying the potential impact or harm this will cause on health, livelihoods, and the environment, said the group.

Early this year the DA, together with the Department of Environment and Natural Resources (DENR), the Department of Health

(DOH), and the Department of Science and Technology (DOST) rushed the approval of the questionable Joint Departmental Circular (JDC) No.1 in compliance with a Supreme Court requirement in lifting a temporary ban on GMOs. Not only did the government railroad public and stakeholder consultations on the JDC, it also left out some of the most critical provisions such as risk assessment, food safety test, liability and redress.

The DA is currently facilitating new applications of biotechnology firms such as Monsanto Philippines, Inc. and Bayer Philippines, Inc. to breed and import GM seeds and crops under the JDC. “Green Action PH calls on the new administration to veer away from the previous administration’s proGMO stance by practicing the precautionary principle on GMOs. We reiterate our demand for a ban of GMOs and the conduct of the long overdue post release impact evaluation of GMOs in Philippine farms on health, biodiversity and on small farmers’ incomes”, says Mr. Sansen Maglinte, spokesperson for Green Action PH. The post release impact evaluation is a requirement for any novel organism such as GMOs released to the environment under the national bio-safety framework under Executive Order No. 514, series of 2006.

“Instead of promoting GMOs in Philippine agriculture, we recommend that the incoming DA Secretary and new government under President-elect Duterte support the optimization of the country’s agricultural potentials.

Suspect in 2008 Digos bus bombing nabbed DATU PAGLAS, Maguindanao--After a long and tedious surveillance operation, joint police, Army and military intelligence agents arrested in this municipality dawn on Thursday a suspect believed to have participated in the 2008 Digos City bus terminal bombing.

CAGAYAN de Oro City––Agriculture department underscored the importance of the Good Agricultural Practices to health and environment during a forum on May 18.

Department of Agriculture conducted a quarterly media interaction to inform and update the public on GAP. The conference catered the relevance of GAP to the farmers, to the consumers’ health, and the environment and also on animal rights and welfare.
