Martial law in Mindanao to be enforced in accordance with laws, human rights

T

he implementation of martial law in Mindanao will be done in accordance with existing laws and respect for human rights.

This was bared by Armed Forces of the Philippines (AFP) public affairs office chief Col. Edgard Arevalo during a briefing Wednesday when sought for a comment on Pre s i d e nt R o d r i go Duterte's declaration of martial law in wake of the ongoing fighting between government troops and Maute Group members.

"Declaration of martial law does not mean abuse of authority. We will do it in accordance with the existing law and respect for human rights," he said in Filipino.

My Vision and Mission for Bohol Island State University Not all well-designed boxes deliver the best cheese. I may not fit that box made by the Commission on Higher Education—referring to CHED Memo 16, Series of 2009--but BISU stakeholders must consider selecting better visions and missions for the academia as it chooses its next president. We see to it that public resources are not wasted for suboptimal endeavors and recycled ideas uninformed by the recent trends.

I do not want the contenders of BISU presidency to steal my ideas here (that is intellectual dishonesty) for the coming panel presentation and I did not apply for the position at the helm of the university; nevertheless, there should be a hue and cry for the less imaginative and complacent vision and mission I read before.

Therefore, I come up with my vision and mission of the university. At least, there are elements that can hit the big time: Vision: Science and technology leader serving as seedbed of new commercial ventures in the region; and a center of excellence status in various professional fields both for enabling the circulation of ideas, people and resources in a knowledge-based economy.

Mission: We nurture and establish leading faculty and student researchers/ scholars and underscore novel and effective strategies in classroom learning.

We initiate continuous and disruptive innovations in creating new products and services resulting to spinoff companies that pioneer them.

This trend informs my vision: universities play a vital role in the knowledgebased economy and it should initiate the triumvirate of the academia, government and industrial sector in creating new products that can lead to new companies.

The academia has already ceased the ivory-tower focus on instruction, research and our mode of “extension” programs. It has already become a birthplace for spin-off companies—the results of its research and development. The FAVLAB, by the way, cannot serve the purpose if BISU does not make spin-off companies from products made by its own efforts and if it merely allows anyone from the community to use it haphazardly.

In my vision, I mention a “center of excellence status” in lieu of clichés that fail to measure “quality” or its derivatives. If be-

ing a center of excellence is not its vision, BISU is short-sighted, if not naïve.

“Quality” or “excellence” in a vision statement is just an excuse to fail because a perfunctory program and activities may be forced to fit in—especially if someone’s subjective opinion determines it. Stakeholders, we cannot allow this to happen.

The focus to perform the academia’s traditional functions and a passion to become a seedbed of new companies is better than merely raising up competent employees or OFWs because society needs to develop successful entrepreneurs.

We should transform from the employment mentality which has perpetuated poverty into a mindset that owns ideas for commercial exploits. BISU offers an entrepreneurship course, but this does not translate into an entrepreneurial emphasis--a strategy towards an upward trek.

The circulation of ideas, people and resources is the means to attain development in a knowledge-based context. It means developing a system that encourages networking and exchange of ideas among the players of development towards the creation of commercially-

rewarding endeavors. It means finding the paths for new ideas to be used for society rather than the usual mode of extension activities, though they cannot be ignored.

In my mission statement for BISU, I underscore nurturing professors and students to develop a scholarly mindset. If teachers only want to teach, they cannot align anymore because internationally speaking, they are expected to publish scientific papers in refereed journals. At least per statement of a CHED officer from the Region 7Office, schools will be required soon to implement a no-publication-no-tenure policy for the faculty. I am not kidding. I also highlight creative classroom strategies like blended learning using online platforms and culture-based learning: create a niche and do not feel comfortable with doing what everyone else does.

-ooo DUTERTE CRITICS UNAWARE OF TERROR THREAT: The usual critics of President Duterte have gone to town once again deriding his declaration of martial law in Mindanao 10 p.m.

Tuesday, May 23, 2017, in the aftermath of the violence and mayhem perpetrated by terrorist groups in Marawi City.

They say it was merely a part of his overall plan to really place Southern Philippines and ultimately the whole country under his one-man rule.

Well, they can say whatever they want to say, for that is the essence of democracy which, undeniably and indeed regrettably, is working in the Philippines. The unsinkable truth however is that, the terror that comes from terrorists groups---such as the one that is taking place in Marawi City even while this column is being written---is deadly real, not only in the Philippines but in almost every country in the world today.

The human race is facing

an explosion of violence and terroristic acts in a magnitude that has never been seen before. The bombing of a concert in the United Kingdom just two or three days ago where 22 have been confirmed killed, and the shooting war and arson that erupted in Marawi City on Tuesday, are eloquent proof that terrorism is here to stay, and must be dealt with firmly and fast if we are to triumph over it!

-ooo MARTIAL LAW IN JUST ONE OPTION VS. TERROR: Declaring martial law, actually, is just one of the options open to the President under the emasculated 1987 Constitution. As the commander-in-chief of all armed forces in the country, he has the right to call such armed forces, whenever it becomes necessary, to prevent or suppress lawless violence, invasion or rebellion.

Then, in case of invasion or rebellion, when the public safety requires it, he may declare martial law in the entire country or in any part thereof, for a period not exceeding sixty days.

He may also suspend the privilege of the writ of habeas corpus---which writ gives the citizens the right not

to be arrested unless there is a warrant against them issued by the courts. These options, however, are greatly emasculated, considering the duty of the President to report to Congress on what he had done.

Unknown to many, the President also has a more radical option, which is not in any manner subject to the Constitutional limitations that are found under the Cory Aquino Constitution.

This more radical option is declaring a “revolutionary government”---which means scuttling the Constitution and all other laws, to give way to a more firm and absolute rule by the President.

-ooo DUTERTE CAN SCUTTLE 1987 CHARTER, DECLARE “REVOLUTIONARY GOVERNMENT”: Throwing away the Constitution and setting up of a revolutionary government where only the President rules is not new in the Philippines. Under more peaceful and therefore less compelling circumstances, these two things have already been done in the country, by a leader who styled herself as a democracy icon, President Cory Aquino.

ant to the EDSA power grab in 1986 and after Cory had already consolidated the presidency in her hands with the aid of the United States and its lackeys in the Philippines, she set aside the then existing 1973 Constitution and put up her “Freedom Constitution”, at the same time setting up a revolutionary government.

This Cory precedent was never contested. It has therefore become part of the law of the land, which remains valid and binding up to now.

I believe that the conditions prevailing today---with bold terror groups and lawless elements particularly the drug syndicates and other criminal gangs lording it over---Duterte can---and should---throw away the 1987 Constitution and install a truly “Duterte government”.

YAHSHUA Intelex graciously ended its Summer Music Program at XU Little Theater, last May 13, 2017 with the theme ‘’Thank YOUth’’.

It was a celebration of the young aspiring musicians – unveiling their talents and skills in voice, keyboard, acoustic guitar, and violin as well as looking forward to their future’s endless possibilities.

The event was graced by the management of YAHSHUA Intelex; Ptr. Ron Bayron, CEO; Dr. Ruth Bayron, VP; Mr. John Paul Cabelin, Lead Musical Instructor and Ms. Mel Cabelin, Lead Vocal Coach.

The Summer Music Program has successfully unleashed the musical potentials of children as young as 4-years-old. Most, if not

all, of the children overcame their stage fright and triumphantly performed on stage. Parents took photos with a glint of pride in their eyes.

YAHSHUA Intelex has designed programs to make tough disciplines; Math, Music, Arts, and Reading a little easier than traditional training. They were most especially thankful for their parents’ love, support, and for enrolling them to the YAHSHUA Intelex Summer Music training. Based on the school feeding report made by the feeding coordinator Ms. Jessie L. Arranguez, there is an increasing number of severely wasted and wasted pupils of Old Kibawe Elementary School. In order to decrease the increasing number, the principal, feeding coordinator and the faculty and staff have intensified the school feeding program through everyday feeding sessions

for the school year 2015 up to present.

The school principal Mr. Jess G. Bernas mentioned that, the only way to decrease the problem in malnutrition is through intensified and enhanced school feeding program.

With these, the teaching force coordinated with the parents in every grade levels with a wasted and severely wasted sons and daughters and they are

being group and given each schedule as to when they are going to have their cooking sessions for the rest of the year.

They also encouraged that they should prepare viands which are nutritious.

The program now has been the best practices of Old Kibawe Elementary School for a couple of years now. With massive school feeding, it has been proven to be a great help for the

school and for the pupils.

Moreover, the accomplishment was very impossible to achieve if not through the generosity and constant support of our school principal, school coordinator, and as well as the parents who has been always there. This program will continue until there are no more record of severely wasted and wasted pupils in our school.

The ICTSI Philippine Masters fires off Wednesday at the Villamor golf course in Pasay City.

Clyde Mondilla, who defeated Miguel Tabuena and Tony Lascuña by one to win the ICTSI Manila Southwoods Championship, is eyeing to match or better his stunning 22-under 266 victory last week.

Endless Summer at Apple Tree Story by MARK FRANCISCO

IT was surely a blast of two days and nights of partying at Apple Tree Resort and Hotel this third weekend of May. Aptly dubbed as Endless Summer, it was seemingly an endless array of festivities as the morning of May 20 kicked off with the annual beach volley competition.

There were a total of five volleyball teams in play during the two-day tourney – Solido 1, CU, Titans, Opol and Solido 2 – with two players of mixed gender in each team. In the end, the

real-life athletic love duo of Marvin Villanueva and Brithanney Antiquina of Titans won as champions of the year.

Then there was the much awaited third edition of Shore Breaks – the annual skimboarding competition every summer at Apple Tree.

For this year, there were a total of 31 participants broken in three categories – kids, Mastgers and Advanced. The champion for the Masters got home a P10,000 prize. The farthest competitors came from as

far as Tandag City.

Of course, those two events would never be complete without the presence of a dozen highly experienced sports photographers molded even better by sports photography expert Jijo de Guzman. In a day-long training, de Guzman inputted his insights to his provincial colleagues in Cagayan de Oro his craft expertise.

In the end, a total of 30 great pictures about the beach volleyball and skimboarding tourneys were produced.

Yet only one emerged as the winning photo – that of Abel Matthew Silawan’s.

Another side event during the first day of Endless Summer was a two-hour Zumba marathon. Those who managed to still graciously dance after two hours were adjudged as champion, first runnerup and second runner-up, respectively.

The highlight of the second night of events was the foam party at Apple Tree’s infinity pool. The mostly youthful crowd enjoyed the foamy waters with music emanating from The Rain Man, DJ Kyle, RB Banaag and Kitty G. Skewered hotdogs, beer

and punch cocktails were served all throughout the event.

Pres. Duterte asks Putin for arms

P reside n t R o d r i g o Duterte has requested Russian President Vladimir Putin for a soft loan for weapons which will be used by the Philippine government in its fight against terrorism.

President Duterte made this request during his bilateral meeting with the Russian leader at the Grand Kremlin Palace here Tuesday evening (early Wednesday morning in Manila).

It w a s m a d e a f t e r President Duterte declared martial law in Mindanao, as Islamic State-backed Maute terrorist group besieged Marawi City and clashed with government troops.

The bilateral meeting of the two leaders was initially scheduled on Thursday but President Duterte decided to fly back to the Philippines early Wednesday morning here. The meeting was moved to around 10 p.m.

of Tuesday here -- past 3 a.m. Wednesday in Manila.

President Putin was not in Moscow on Tuesday but decided to return to Kremlin to meet President Duterte before his trip back to Manila.

“As you probably know, I spent this day away from Moscow in one of our regions. And that I have seized the chance to see you in person,” President Putin said.

“My colleagues and myself definitely understand quite well that you do have to come back to return to your motherland,” he added.

The Russian leader also expressed his sympathy to those affected by the terrorist attack in Marawi City.

“And let me express hope that the conflict that you have just mentioned will be resolved as soon as possible and with minimal losses

and casualties,” Putin said.

He also assured that the full package of bilateral documents will be signed -- a defense cooperation is included in the package of bilateral documents.

In an interview with Department of National Defense (DND) Secretary Delfin Lorenzana here, he said Russia can help the Philippines in fighting against terrorists, particularly preventing the ISIS to spread in the country.

“They are aggressive in fighting against ISIS,” Lorenzana told the Philippine News Agency.

“If you look at the current events in the Middle East, they are into heavily fighting against ISIS in Syria,” he added.

He mentioned that he and his Russian counterpart had discussions in Moscow last month prior to the visit of the Philippines’ official delegation this week.

Troops regain ‘full control’ of Marawi City -- Westmincom

ZAMBOANGA CITY -- The Armed Forces of the Philippines’ Western Mindanao Command (Westmincom) announced Wednesday that the government is now in “full control” of the situation in Marawi City, which was attacked by the Maute terror group yesterday.

“As to the Marawi incident, the government is in control of the situation.

(We are) fully aware that the Maute and similar groups have the capability, though limited, to disturb the peace.

(They) have shown no hesitation in causing havoc, taking innocent lives and destroying property as man-

ifested yesterday in Marawi City,” said Lt. Gen. Carlito Galvez Jr., Westmincom chief.

Galvez said they launched an operation against the members of local terrorist group Maute because of information that Abu Sayyaf Group (ASG) leader Isnilon Hapilon was with them.

This output is appropriate for the type of institution and based on the world-wide trend for universities which already do away with the idea of having only the traditional function to focus. Universities cannot just exist for knowledge creation’s sake in this current context.

To support the vision and mission, here are my development goals for the university: A. To establish a simple Research and Development (R&D) center for new products which also takes charge of developing blueprints continuously for services that meet the needs and wants of the region’s market; B. To come up with an office that oversees the protection of copyrights and patents for ideas and studies made by the constituents of the university; C. To create spin-off companies that market and produce new products or services that the university initiates, if feasibility studies support them; D. To design attractive research and journal publication systems, incentives and activities for faculty/ staff and students; E. To develop an attractive scholarship program for faculty members who pursue their doctorate degrees in reputable universities; and F. To design systems, incentives and activities that promote creative classroom learning strategies that best fit each discipline.

As a backgrounder, God’s grace allowed me to receive an honorary doctorate degree—PhD in Social Sciences and Fine Arts--conferred by two external academic institutions from Mindanao and Luzon. By God’s grace, I do not discount having earned a reputation in international peer-reviewed journal publications; in fact, I always receive a barrage of emails from different parts of the world inviting me to

publish a scientific paper with them. My extension programs were pioneering and innovative while they creatively served needs that were never met before. I deliberately designed classroom strategies that are relatively novel. I am already qualified for a Full Professor rank, though I do not anymore teach full-time. If I did not have a deanship experience, I had proven more.

For the 9th year "Ginanggang Festival" (grilled banana) was again held here in Barangay Poblacion recently.

Hundreds of people came to witness the simultaneous grilling of more than 20,000 sticks of bananas along the streets of Barangay Poblacion where everyone was free to partake of the grilled bananas.

The Ginanggang Festival was officially accredited by the Department of Tourism (DOT) in 2011, thus including it in the festivals of Lanao del Norte.

Adding color to this year's festival were competitions in folk dance, sports, cooking, best decorated Ganggangan, best tasty Ginanggang, most organized purok and most cooperative purok and others.

But just as soon as the first Mindanawon to become President gave his assurance, he announced, in a video footage posted by Communications Assistant Secretary Mocha Uson, that he has declared martial law “for Mindanao” and for those who have experienced martial law before, “it would not be any different from what President Marcos did.”

Presidential spokesperson Ernesto Abella told a press conference in Moscow Tuesday (11 p.m. in the Philippines) that the President declared martial law in all of Mindanao as of 10 p.m. Manila time.

The declaration came hours after clashes in downtown Marawi City between government forces and the terrorist Maute Group left three government forces dead and 12 others injured.

The Maute group also occupied several buildings and burned some structures.

Abella said the declaration that placed Mindanao under martial law was “good for 60 days” but Duterte said this depends on the developments and that “if it would take a year to do it, then we’ll do it.”

Article VII, Section 18 of the 1987 Constitution provides that in case of invasion or rebellion, “when the public safety requires it,” the President may, “for a period not exceeding sixty days, suspend the privilege of the writ of habeas corpus or place the Philippines or any part thereof under martial law.”

The Constitution allows an extension of the period of martial law.

“Let me just tell everybody that I have declared martial law for Mindanao.

In other words, the President must immediately return to the Philippines and comply with this constitutional requirement. ”The Congress, voting jointly, by a vote of at least a majority of all its Members in regular or special session, may revoke such proclamation or suspension, which revocation shall not be set aside by the President. In other words, the Congress can override the President. ”The Congress must now convene within 24-hour.

“The Congress, if not in session, shall, within twentyfour hours following such proclamation or suspension, convene in accordance with its rules without any need of a call,” he said.

Ditucalan added that “if Congress doesn’t override the President, any citizen may invoke the judicial review power of the Supreme Court to check the factual basis of the proclamation.

If Martial Law is not warranted, the Supreme Court may nullify the proclamation.” ”Most importantly, the proclamation of Martial Law doesn’t not suspend the operation of the constitution. In other words, our rights guaranteed by the constitution remain inviolable,” he emphasized.

AVAO CITY -- Davao City Mayor Sara Duterte-Carpio ordered the police and the military to lockdown the city hours after President Rodrigo Duterte declared a 60-day martial law in Mindanao late Tuesday evening.

The mayor also asked non-residents to postpone visits to Davao City if these are not important as security checks at several checkpoints would be more aggressive.

For D avao enos and tourists, she advised them to exercise prudence in planning their activities in the city, warning that security measures will be more intensive considering that Davao is the hometown of the President.

She assured the city is beefing up police visibility on the ground and in coastal areas, where terrorists could possibly enter.

In an urgent press conference at past 1:00 a.m and after meeting with police and army officials, the mayor announced that locking down the city was a decision they agreed as a security measure in light of the incident in Marawi City. This will also hold while martial law is in effect for 60 days.

Shortly before the official declaration of martial law, the mayor admitted her father, President

Duterte, called her of his decision. She said she also saw the official announcement from Russia live on television.

Duterte-Carpio said police and army authorities did not discount the possibility of terrorists and bandits to enter the city given previous incidents.

She also cited the members of the Maute group who are currently detained at the city jail.

While the city remains under full alert since last year, the mayor ordered police and army officials to plan their operations well and set up additional checkpoints.

In the absence of an executive order on martial law declaration, DuterteCarpio reminded that under a martial law regime, “warrantless arrest is in effect, activities of people are monitored and there is suspension of the writ of habeas corpus in cases of terrorism and others like rebellion. Pangilinan said this is to ensure that the constitutionally guaranteed rights of Filipinos are protected and that the exercise of the martial law powers of the President are checked.

Citing Article VII Section 18, Pangilinan said that martial law may be declared and the writ of habeas corpus suspended only "in case of invasion or rebellion, when the public safety requires it" and not longer than 60 days.
