Misuari’s temporary liberty extended until November 16

AVAO CITY (MindaNews) — Extended for six months.

The regional trial court that last year granted a sixmonth liberty to Nur Misuari, founding chair of the Moro National Liberation Front (MNLF), has granted him an extension of another six months or until November 16, 2017.

Misuari made his first public appearance after the court granted his motion for extension on Sunday, May 21, at the Royal Mandaya hotel here at the “Bangsamoro and Federalism” lecture and consultation on Federalism, “focused on its application in Mindanao, Sulu and Palawan.”

In a three-page resolution dated May 16, Judge Maria Rowena Modesto San-Pedro of the Regional Trial Court Branch 158 in Pasig City granted Misuari’s “Motion for Extension of Period of Suspension of

Proceedings and Implementation of Warrant of Arrest” filed on April 26, a day before the six-month temporary liberty Modesto granted on October 27 was scheduled to end.

The court directed the Philippine National Police, Armed Forces of the Philippines, the National Bureau of Investigation and other law enforcement agencies to “suspend as well, the enforcement of the Warrants of Arrest issued against the accused Misuari” within the extended six-month period.

Misuari was in hiding from September 2013 until Judge Modesto granted him temporary liberty in October last year “to allow him to attend peace talk sessions with the government.”

GIGAQUIT, Surigao del Norte-- Who would’ve thought that a fast-food chain employee then ended up owning one of today’s newest bakeries and cafes here?

Rose Arquina PapelerasTesiorna, a 29-year-old businesswoman from Barangay San Isidro, Gigaquit, Surigao del Norte, says, “It hasn’t sunk in yet that I’m already here. I still can’t believe it.”

She was a fourth-year Nursing student at Surigao Education Center in 2008 when she got pregnant and had to put a halt to her studies and said good-bye to her dream of becoming a professional in health care.

Battle of Bayang remembered B

AYANG, Lanao del Sur - The Local Government Unit (LGU) here recently celebrated the historic “Battle Of Bayang” on its 115th anniversary.

The epic battle which took place in May 1902 was remembered in time to the “55th Araw ng Bayang” celebration last April 26 to May 2.

According to Wikipedia, that on May 1902, during the Moro Rebellion (also known as the Moro–American War), Bayang was the site of a clash between Moro rebels and American troops that became known as the Battle of Bayang.

The American troops, three infantry battalions and a battery of artillery totaling some 1200 men, were led to Bayang by colonel Frank Baldwin to demand the extradition of the Moros responsible for the ambushing

and killing of two American soldiers at the construction of a road from Iligan to Lake Lanao, two months earlier.

When the sultan of Bayang refused, Baldwin’s troops attacked and captured the nearby cotta (fortress; “small, castle-like structures with thick, high walls”[) of Binidayan on 2 May. They subsequently attempted to capture the cotta of Pandapatan, which resisted the artillery fire and was only subdued the next day after hand-to-hand combat between Moros and Americans. The number of Moro casualties is estimated at 300 to 400, including the sultan of Bayang and his brother.

On the American side, ten

soldiers were killed and some forty wounded.

The cotta of Pandapatan has been preserved as a historical monument; the fallen of the Battle of Bayang are considered martyrs by Filipino Muslims.

Mayor Aslani P. Balt together with other local officials, Barangay officials, religious group, traditional leaders, visitors, media and the people of Bayang paid tribute to the grand celebration.

Former governor Saidamen Pangarungan said that the Battle of Bayang was bloody. He reminded his people in Bayang that they must be relaxed and not be stressed of any kind of problems encountered in life.

Pres. To any Filipino the situation is ripe for war except that we cannot afford. If we proceed with our desire to drill for oil, chances are the Chines will invade our country and the consequence is fatal for all of us. I use two biomorphic forms in this artwork to symbolize ou r c o l l e c t i ve d re ams because, like our dreams,

life forms represent how society is morphing: not qu ite pre d i c t abl e , but sustained by each person’s life and becoming a memorable emblem of the collective whole.

Should we allow this morphing to accelerate?

I use luminous orange color of the artwork to suggest a burning passion rendered with a contemporary touch. The sculpture draws energy from the current major influences from Brancusi to Henry Moore, although I s p e a k w i t h my ow n voice.

C an you imagine your frustration in tr ying to get where you want to go in Manila, when

all the time you’re following t he map of Jakarta? You’re following the wrong map.

You c ou l d wor k on your driving skills and actions. Tr y harder and d r i v e f a s t e r. B u t t h a t would only get you to the wrong place faster!

You might even work on your attitude and think more positively. But you would still be lost. Even being good and kind to other drivers and p e d e s t r i a n s a l on g t h e way would not get you there either.

You see, your biggest problem is not your actions and b ehavior, or your attitude, not e ven

the good things that you do—e ven thoug h thes e all are ver y imp or tant.

B ut y ou r nu m b e r on e problem is that you have the wrong map. You must have t he r ig ht map of life, or you simply can’t get where you need to go.

There is nothing more f r ustrating than b eing lost and not having the rig ht map to f ind your way.

First Negosyo Center in ARMM launched in Marawi City

MARAWI CITY, Lanao del Sur - The development of micro, small and medium enterprises (MSMEs) gets a boost after the provincial government of Lanao del Sur and the Department of Trade and Industry (DTI) launched the first negosyo center in the Autonomous Region in Muslim Mindanao (ARMM).

The center is located at the TLDC Building in Lanao Peoples' Park, Barangay Datu Saber, this city.

Vice Governor Adiong said the Negosyo Center will strengthen the local economy and pave the way for Meranao products to be included in the national market.

"We are very happy that Lanao del Sur is among the recipients of this program. The Negosyo Center provides us a venue to showcase Meranao products and promote our MSMES not just in the neighboring towns but also at the national market," he further said.

So, what could be done to address this problem?

It is certain that this problem means additional work to the teacher. So, in such case, a teacher must find an internet nearby in the place, do the research, save all of the important data and present it to the class. This must be a lot of sacrifice for educators but this is what is usual to the educators assigned in faraway areas to make learning possible.

Next thing is making use of the library. Books as well play big role in researches. What is good of books, rather than the data available in the internet is you can be sure that the information is well curated. Unlike internet that may present opinions and not fact at all. Remember that internet comprises all information in the world, yet you have to do an intense digging just to get the right information. While in books, the information is exact and you can be sure that authors are reliable, though doing researches might took several hours.

So, in making term papers and report for students, making use of the library is the next effective option.

Third is that, this problem must be sent to the higher office of Department of Education especially that

there are several places who cannot connect to the internet. One effective solution is providing softcopies for modules that must be learned by the students. This set of modules could be save to either CD or USB flash disk. In this way, there is no need for an internet because all needed information are already in the material. The good in this method is students can make use of the computer in their school. Department of Education could have done this in other educational programs they are implementing, so distribution of softcopies of modules to remoted areas should also be given priorities.

Learning might be hard especially for those places that are not easy to be reached, but in providing learning, when there's a will, there's a way.

"Although grilled banana (or ginanggang s ag ing) is common in most parts of the

“You are on the right track in having this kind of Festival. People get attracted to anything unique in a particular place. And I’m pretty sure the tourists will find their way here,”

As a Science Coordinator in my respected school, I believe that a key objective of Science is to encourage pupils to engage and involve in teaching-learning and adopting studies and careers in the disciplines of science, technology, and mathematics. It is about showing pupils what is possible through science and the exciting careers and opportunities that these disciplines can present to them and to the community in the near future. Through Science Week, together with the Science Clubs we aim to take science out of the lab and show how it is so much more than a ‘subject’.

Science Week also in our school seeks to demonstrate and substantiate to pupils of all ages, the importance and relevance of science to the future de-

velopment of our society and economy. I hope the great range of events and activities that we make in school will motivate teachers, pupils and parents to engage with science at home, in the classroom and in the community.

From what I learned in one of the seminars I attended the speaker mentioned that, “Science can help to answer the what, the why and the how, while also revealing new questions. It is a problem-solver, helping to crack ever yday challenges. What has the power of science enabled us to achieve and what else are we capable of ?”

S. Cotabato starts preparatory works for outpatient drug treatment facility GENERAL SANTOS CITY -- The provincial government of South Cotabato has started the preparatory works for the establishment of an outpatient treatment and after care facility for drug dependents.

Nelida Pereira, Provincial Social Welfare and Development Office head, said Monday they are currently working on various arrangements for the operationalization of the facility, which will be situated at the Upper Valley Community Hospital in Surallah town.

She said the initiative is spearheaded by the Provincial Anti-Drug Abuse

Council (PADAC) and the provincial technical working group on surfacing personalities involved on drugs or SPIDs. “We’re hope to start catering to some of the assessed drug dependents soon,” she said in an interview.

She was referring to the more than 12,000 SPIDs in different parts of the province who earlier underwent a series of assessments in line with the program’s rollout.

Sarangani seeks PHP50M hospital equipment grant from PCSO GENERAL SANTOS CITY -- The provincial government of Sarangani is seeking a PHP50 million grant from the Philippine Charity Sweepstakes Office (PCSO) to fund the acquisition of additional equipment for the province’s main hospital.

D. Ar vin Alejandro, provincial health officer, said Monday they have proposed for the availment of the grant through the PCSO’s Integrated Health for Overall Productivity and Empowerment (IHOPE) program.

He said it would specifically be utilized to upgrade the equipment of its forthcoming provincial hospital located at the capitol

compound in Barangay Maribulan, Alabel town.

The two-storey facility, which is now 85 percent complete, is targeted to open within the second half of the year, he said.

Alejandro said the IHOPE grant could be used for equipment upgrade, medical assistance, nutrition initiatives and hospital services.

“But since the provincial hospital will be operational soon, we agreed with the governor (Gov. Steve Chiongbian Solon) that the PHP50 million will solely be utilized for the purchase of equipment for the provincial hospital,” he said.

The move will help the

local government make the hospital functional by October, he said.

The Depar tment of Health (DOH) and the provincial government has already spent around PHP150 million for the construction of the hospit a l, w h i ch sit s i n a 3,500-square meter area within the capitol compound.

The hospital’s construction started in 2012 through an initial PHP50 million grant from the DOH’s Health Facilities Enhancement Program.

Another PHP75 million was later released as augmentation.

The agency allotted some PHP20 million for

the acquisition of hospital equipment and PHP5 million for the construction of a two-storey out-patient department and its operating room foundation.

When fully completed, the provincial hospital will have a capacity of 200 beds and operate as a tertiary facility.

Last week, the provincial government received four new ambulances from the PCSO. The ambulances will be used by the municipal health offices of Malungon, Maitum, Kiamba and Glan towns.

Among the institutions visited by the team are the Luntiang Paraiso Regional Rehabilitation Center (LPRRC) in New Corella, Davao Del Norte and the Davao City Treatment and Rehabilitation Center for Drug Dependents

in Purok-7, Barangay Bago Oshiro, Tugbok, Davao City.

LPRRC currently accommodates 44 clients while the Davao City facility hosts 77 clients coming from parts of Mindanao.

Pereira said LPRRC’s clients pay at least PHP8,000 a month for a minimum six-month treatment and rehabilitation while the Davao City government-run treatment center charges

PHP10,000 a month.

She said they are working on forging a memorandum of agreement with the two institutions for the referral of clients from the province.

Pereira added that the team will embark on further site visits in June in drug rehabilitation and treatment facilities in the cities of Cagayan de Oro, Butuan and Zamboanga.

Regencia, intends to transfer the operation of the night market/cafe from the existing location at the Iligan City Freedom Park/Public Plaza to Cabili Avenue, Barangay Poblacion starting January 6, 2017 (Friday) due the concerns raised by the establishments surrounding the City Public Plaza, especially from the Iligan City Fire Station as the Night Market could impair the firemen’s response during fire calls;

Section 2. - Date of the Temporary Transfer of the Weekend Night Market and Café - The Weekend Night Market and Café shall be transferred starting January 6, 2017.

Section 3. - Section 7 of City Ordinance No. 15-6341, is AMENDED, as the same is hereby AMENDED to read as follows: “Temporary Closure of Portion of Cabili Avenue - During the duration of the temporary transfer of the Weekend Night Market and Café portion of Cabili Avenue which will be affected by its operation is hereby temporarily closed from vehicular traffic from 1:00 P.M. to 12:00 Midnight to accommodate the display of goods, merchandise, foodstuffs, commodities, or articles of commerce that may be sold and dispensed to the general public.

Section 4. - Section 13 of City Ordinance No. 15-6341, is AMENDED, as the same is hereby AMENDED to read as follows: ‘Designated Opening Time -The Weekend Night Market and Café opening shall start at 1:00 o’clock in the afternoon.

Section 5. - Section 14 of City Ordinance No. 15-6341, is AMENDED, as the same is hereby AMENDED to read as follows: “Designated Closing Time - The designated closing time shall be at exactly 12:00 midnight” SECTION 6. - Use of Cabili Avenue - The use of Tomas Cabili Avenue by any group or person which run in conflict with the use of the area by the vendors and customers of the Weekend Night Market and Café is hereby suspended, in order to prioritize the use of the same area by the vendors and customers of the Weekend Night Market and Café SECTION 7. Repealing Clause. All previous ordinances, executive orders, rules and regulations or parts thereof which are inconsistent with this ordinance are hereby repealed and modified accordingly.

f) Ensure the right of the people to a balanced and healthful ecology through the promotion of activities geared towards environmental protection, conservation and restoration through the integration of solid waste management in the development and operation of tourism sites and activities; g) Develop responsible tourism as a strategy for environmentally sound and community participatory tourism programs, enlisting the participation of local communities, including indigenous peoples, in conserving bio-physical and cultural diversity, promoting environmental understanding and education, providing assistance in the determination of ecotourism sites and ensuring full enjoyment of the benefits of tourism by the concerned communities. h) Strengthen the role of tourism councils and encourage the participation of non-government organizations (NGOs), people’s organizations (POs), civil society organizations and the private sector in initiating programs for tourism development and environmental protection in the Province; i) Promote the progressive development of existing civil aviation, land and sea transportation policies as they relate to tourism, in consonance with existing bilateral agreements and inter-agency pronouncements; j) Achieve a balance in tourism development between urban and rural areas in order to spread the benefits of tourism and contribute to poverty alleviation, better access to infrastructure and increase in community-based livelihood opportunities; k) Enhance capability-building of local government units (LGUs), in partnership with the private sector, in the management of local tourism projects and initiatives, thereby ensuring accessible and affordable destinations throughout the Province, especially in the areas which have shown strong comparative advantage; l) Promote the standardization and accreditation of tourism facilities and services at all LGU levels; m) Enhance inter-local business relations for the support of tourism projects of the private sector, through partnerships, joint ventures and other cooperative undertakings involving local and foreign investors; n) Support the establishment of tourism enterprise zones (TEZs), which will provide the necessary vehicle to coordinate actions of the public and private sectors to address development barriers, attract and focus investment on specific geographic areas and upgrade product and service quality; o) Ensure a sustainable funding mechanism for the implementation of tourism policies, plans, programs, projects and activities; p) Encourage and promote tourism enterprises that protect and defend the safety of children, women, against human trafficking; and q) For effective and highly coordinated approach to tourism development and promotion, all tourism-related endeavors, programs, projects shall be aligned with the provisions of this Code as well as the thrusts and directions of the Provincial Tourism Master Plan, and that of the Department of Tourism.

ARTICLE II

ORDINANCE NO. 13-17

COVERAGE, SCOPE, DEFINITION OF TERMS

“AN ORDINANCE ENACTING THE TOURISM CODE OF MISAMIS OCCIDENTAL”

SECTION 5. COVERAGE. This Code shall govern all tourism-related laws, ordinances, plans and activities within the territorial jurisdiction of Misamis Occidental, including its units and all political subdivisions.

SECTION 1. TITLE. This Ordinance shall be otherwise known as “The Tourism Code of Misamis Occidental”.

SECTION 2. LEGAL BASIS. Republic Act No. 9593 otherwise known as the Tourism Act of 2009, “An Act Declaring a National Policy for Tourism as an Engine of Investment, Employment, Growth and National Development, and Strengthening the Department of Tourism and its Attached Agencies to Effectively and Efficiently Implement that Policy, and Appropriating Funds Therefor”.

Explicitly stated in Section 37 of R.A. 9593, is the mandate for all government units to initiate, enforce and implement local tourism development plans towards sustainable tourism development, and manage all resources that cater to the needs and satisfaction of visitors and tourists in cooperation with stakeholders. Also, it is important that in this undertaking, cultural integrity, essential ecological processes, biological diversity and life support systems are maintained. All succeeding issuances, order are supplemental by the goals and policies embraced in the Tourism Act of 2009, geared to develop tourism enterprises, with its attendant facilities, services, infrastructures, environmental protection awareness and taking into account a balanced economic, socio-cultural aspect of tourism development.

The enactment of Misamis Occidental Tourism Code is therefore imperative to vigorously pursue sustainable tourism development in the Province that will foster economic growth, employment, development and progress for its people. There upon, tourist spots, destinations, events, festivals will be developed, harnessed as a vehicle for prosperity and inclusive growth, as embodied in Section 17 (b) (3) (xii) of the Local Government Code of 1991, R.A. 7160 and in accordance to the Environment Laws, Indigenous Peoples’ Rights Act of 1997(R.A. 8371), Mt. Malindang Range Natural Park of 2004 (R.A. 9304), and the National Cultural Heritage Act (R.A. 10066).

SECTION 3. DECLARATION OF POLICY. It is hereby declared the policy of the Province to pursue the sustainable development of Misamis Occidental as tourism haven that aims to foster economic and inclusive growth and progress of its people, and for this purpose:

a) Protect and preserve the natural environment including its biodiversity; b) Safeguard and preserve the integrity of cultural heritage, historical sites and natural endowments; c) Protect, promote and respect the cultural rights and sensibilities of the Subanen Community and other host communities; d) Promote tourism sites, activities and events that are socially, culturally, environmentally, and economically beneficial to the people of the Province at the local and international level; e) Educate all stakeholders, communities and tourists on the principles of responsible and sustainable tourism; f) Alleviate poverty by ensuring the “trickle-down” effect for inclusive growth of tourism benefits to communities, especially the Subanen Tribe of the Province; g) Empower and facilitate the development of service providers to become globally competitive in the delivery of tourism services; h) Support sustainable tourism development plans of the local government units (LGUs), people’s organizations (POs), and civil society organizations (CSOs) of Misamis Occidental; i) Encourage active involvement and participation of communities in tourism development planning, implementation and monitoring; j) Identify, develop and promote existing and potential tourism areas and tourism enterprise zones; k) Encourage, promote and link community-based tourism support industries to the mainstream of local tourism industry; l) Strengthen and support the capability of local government units in mandated tourism functions via the Office of the Provincial Tourism, Arts and Cultural Affairs (OPTACA); m) Encourage Private-Public Partnerships (PPPs) by, but not limited to, providing incentives and recognition to private initiatives in the establishment and development of tourism-related programs, projects, activities/events, and investments; n) Strive to promote and foster a tourist-friendly Misamis Occidental among local populace; and o) Foster linkages and networking with other neighboring LGUs, tourism agencies and stakeholders.

SECTION 4. OBJECTIVES. This Code is enacted for the following objectives: a) Encourage activities and programs which promote tourism awareness, preserve the Province’s diverse culture and heritage, and instill a sense of history and a culture of tourism among the youth, the communities and the populace, in general; b) Provide full government assistance by way of competitive investment incentives, lobby for resource mobilization, facilitate Private-Public Partnership (PPP) and other financing schemes extended to tourism related investments at all LGU levels; c) Ensure cultural rights and sensibility that tourism development protects and promotes the general well-being of the Misamisnons, particularly in the area of investment, to include the monitoring and prevention of any act of profiteering or speculation to the detriment of local residents, as well as the exploitation of women and children in tourism; d) Encourage competition in the tourism industry and maximize consumer choice by enhancing the continued viability of the retail travel industry and independent tour operation industry; e) Enhance the collection, analysis and dissemination of data which accurately measure the economic and social impact of tourism in the Province to facilitate planning in the public and private sectors;

SECTION 6. SCOPE. The provisions of this Code shall apply to all local government units, agencies and instrumentalities, non-government organizations, businesses and establishments for tourism; persons, whether natural or juridical, directly or indirectly involved in the tourism industry within the Province of Misamis Occidental. Local conditions and peculiarities obtaining, the provisions of Executive Order No. 120 in relation to Republic Act No. 7160 and the Republic Act No. 9593, as well as other relevant and applicable laws, rules and regulations issued by the national government and the Department of Tourism shall guide this Code.

SECTION 7. DEFINITION OF TERMS. In addition to the terms and phrases duly defined by the Department of Tourism in its several issuances of rules and regulations governing the accreditation of specific tourism establishments and facilities, which definitions are hereby adopted, the following terms shall mean: a) Accreditation -a certification given that the service provider is recognized as having complied with the standards required by the Department of Tourism (DOT) in the operation of tourist establishments and facilities concerned following the minimum accreditation standards of DOT and other accrediting agencies. b) Ancestral Domain - refers to all areas generally belonging to the Subanen Tribe comprising lands, inland waters, coastal areas and natural resources therein, held under a claim of ownership, occupied or possessed by the Subanen, by themselves or through their ancestors, communally or individually since time immemorial, continuously to the present except when interrupted by war, force majeure or displacement by force, deceit, stealth or as a consequence of government projects or any other voluntary dealings entered into by government and private individuals/corporations, and which are necessary to ensure their economic, social and cultural welfare. It shall include ancestral lands, forests, pasture, residential, agricultural and other lands individually owned whether alienable and disposable or otherwise, hunting grounds, burial grounds, worship areas, bodies of water, mineral and other natural resources, and lands which may no longer be exclusively occupied by the Subanen, but from which they traditionally had access to for their subsistence and traditional activities. c) Biodiversity - the existence of many different kinds of plants and animals in an environment. d) Code – refers to the Tourism Code of the Province of Misamis Occidental; e) Ecotourism – refers to a form of sustainable tourism within a natural and cultural heritage area where community participation, protection and management of natural resources, culture and indigenous knowledge and practices, environmental education and ethics as well as economic benefits are fostered and pursued for the enrichment of host communities and satisfaction of visitors. f) Capital resources –refers to availability of capital/financing, transportation, roads, airports, railroads, harbors, trails and walkways, water, power, waste treatment and communications. g) Coastal areas – the line where the land meets the sea or some other large expanse of water. h) Cultural Resources – refers to any prehistoric or historic remains or indicators of past human activities, including artifacts, sites, structures, landscapes, and objects of importance to a culture or community for scientific, traditional, religious, or other reasons. i) DOT– means the Department of Tourism. j) Heritage– means evidence of the past, such as historical sites, buildings, and the unspoiled natural environment, considered collectively as the inheritance of present-day society. k) Human Resource Infrastructure–these include the warm bodies in the tourism industry –the people operating the various establishments and facilities, the local population whose lives are intertwined with the development of tourism sites in their area; the tourists whose quality of lives are enriched and enhanced by the beauty, the history and the culture of their destinations. l) Human Resources – refers to the people who make up the workforce of an organization, business sector, or economy. m) Law and Regulatory Infrastructure–this component refers to the rules of order necessary to manage and control the tourism industry. These are put in place to protect the industry and the people who are the very reason for the industry –the tourists, the service and amenities providers, and the local population. With laws and regulatory measures, the relationships of tourists and their hosts become more harmonious and fulfilling. n) Marine areas –areas of seas, oceans, or large lakes. o) Natural Resources – refers to climate-seasons, water resources (lakes, streams, waterfalls, bays, flora (forests, flowers, shrubs, and wild edibles), fauna (fish & wildlife), geological resources (topography, soils, beaches, caves, rocks and minerals, fossils) and scenery. p) Physical Infrastructures–shall include, but not limited to, roads, bridges, administration buildings, toilets and comfort room facilities, parking areas, rest areas, forest tracks, walkways, viewing platforms, cottages, wharves, boat landing facilities, solid waste facilities, security and service facilities, and communication centers. q) Potential Tourist Properties – refers to sites and attractions not yet developed including, but not limited to, lakes, waterfalls, volcanic hot springs, caves and rainforests. r) Solid Waste Management – refers to the supervised handling of waste material from generation at the source through the recovery processes to disposal. s) Sustainable Tourism Development –means tourism development that leads to management of all resources in such a way that economic, social, and aesthetic needs are met, while maintaining cultural integrity, essential ecological processes, and biological diversity and life support systems. t) Tourism – a major provincial activity in which private and public sectors, Public-Private Partnership (PPP) investments effort and initiative are encouraged, fostered and supported and through which socio-economic development may be accelerated and the appreciation and enjoyment of the Province’s natural beauty, history and culture. u) Tourism Enterprise Zone (TEZ) - refers to Tourism Enterprise Zones created pursuant to R.A 9593; v) Tourism Industry - refers to industries or business enterprises providing goods and services to tourists and all types of travelers while they stay, travel, visit and enjoy the facilities and destinations. w) Tourism Infrastructures –have three major components, namely: physical, human resource, and legal and regulatory. x) Tourism Resources - refers to natural, cultural, human, or capital resources that either are being used or can be utilized to attract or serve tourist.

SECTION 8. PHYSICAL INFRASTRUCTURE. The PGMO, private stake holders and other national and local agencies shall promote and encourage the construction of tourism-related establishments and facilities either through public or private funding, or both, in their areas of jurisdiction. Toward this end, local government units shall:

a) Where applicable, enhance land, air and sea travel connecting to tourist destinations through construction and expansion of adequate road networks and terminals, air and seaports, for passengers and cargo; b) Implement and ensure compliance to guidelines, rules, and regulations through appropriate local government agencies in accordance with DOT standards in the construction of appropriate and adequate accommodation facilities as well as shopping centers, restaurants, health care centers, emergency and safety facilities, and recreation and entertainment establishments conforming to the unified design and the Philippine Disaster Risk Reduction and Management Act of 2010 (R.A. 10121) and Climate Change Act of 2009 (R.A. 9729); c) Implement the Accessibility Law to existing and upcoming tourism-related establishments and facilities by ensuring these establishments and facilities are designed to enhance the mobility of persons with disabilities such as sidewalks, ramps, railings, and the like; d) Enhance the provision of basic utilities such as water, energy and power as well as communication facilities through expansion or upgrading, based on long-term studies and carrying capacity of a tourist destination; e) Implement an integrated solid waste and sewerage management system in tourist destinations and zones, that is adequate and functioning, and in compliance with existing laws and ordinances on environment; Pursue a unified effort and institutionalize the proper solid waste management practices; f) Sustain the implementation and enhancement of tourism-related infrastructures such as accommodation facilities including shopping centers, health care centers, emergency and safety facilities and recreation; g) Improve transportation services for tourist use through strict implementation and monitoring of DOT standards and environmental laws, rules and regulations; h) Engage in the development of the Malindang Watershed and other potential alternative resources for power generation; i) Sustain the potable water sources and systems via protection, rehabilitation and management of watershed areas province-wide; j) Create a web portal for the Province linking all the municipalities and service providers’ websites; k) Explore, assess, and develop potential tourism destinations and sites; l) Encourage active community-based tourism events, endeavors and undertakings including diversified wholesome recreational activities and entertainment; m) Encourage the establishment of one-stop-shops and one-town-one-product to be participated in by all municipalities, showcasing while complementing their respective products; n) Establish, in collaboration with component local government units, tourism information and assistance centers within the tourism circuit/loop, including ports of entry, which shall prioritize the promotion of provincial-owned, -operated or -sponsored tourist destinations and activities, among others; and o) Encourage the inclusion of Misamisnon’s culture and heritage in the promotion of tourism sites in accordance to the National Cultural Heritage Act of 2009 (R.A. 10066).

SECTION 9. HUMAN RESOURCE INFRASTRUCTURES. Acknowledging tourism as a major factor in income and employment generation of the Province of Misamis Occidental, all local government units are hereby encouraged to sustain and strengthen its Municipal/City Tourism Offices with qualified manpower component and sufficient budgetary allocation for its operations.

Tourism programs shall be geared towards the fulfillment of the needs of the key players and stakeholders of the tourism industry. Toward this end, both local government units and private investors in tourism shall join hands to:

a) Provide financial and technical support for the professionalization of services and skills of tourism industry workers;

b) Encourage the Local Chief Executives of each city or municipality to create their own City/Municipality Tourism Office;

c) Organize and train a team of provincial and local trainers to capacitate and improve delivery of services of tourism front liners such as tourism officers, transport operators, tour guides, drivers, boatmen, porters, and the like;

d) The Office of the Provincial Tourism, Arts and Cultural Affairs (OPTACA) in coordination with the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council (MOPTACAC) and the Department of Tourism shall implement a certification and accreditation mechanism to regulate the quality of service and skills provided by frontliners and other tourism industry workers;

e) Coordinate with concerned government agencies in establishing, monitoring and evaluation of certified and accredited tourism industry workers;

f) Ensure that women in the entertainment industry shall be recognized as wage earners and receive a minimum wage and benefits afforded to women workers and shall render services as set in the job contract and only in the place of work as specified in the business permit of the establishment concerned. g) Advocate the culture of tourism and values formation in all levels of education starting with the elementary or primary level in Misamis Occidental schools;

h) Partner with higher education institutions (HEIs) and Technical-Vocational Institutes (TVIs) offering tourism and hospitality courses or programs to pursue capacity development among the students and the tourism front liners;

i) Ensure that tourism front liners (private, public and community stakeholders) are well-trained and qualified, provided with incentives and rewards, organized and federated based on their work affiliations; and

j) Build new and upgrade existing facilities, manpower components and, capacity and capability building for health care services, emergency responses and safety of the tourists and local residents.

SECTION 10. LEGAL AND REGULATORY INFRASTRUCTURE. The tourism industry is governed by national and local laws, as well as rules and regulations issued by the administrative bodies pursuant thereto. Local government units shall issue rules, regulations and directives on tourism pursuant to the provisions of Republic Act No. 7160, otherwise known as the Local Government Code of 1991 and the Republic Act No. 9593, known as the Tourism Act of 2009.

ARTICLE IV MISAMIS OCCIDENTAL PROVINCIAL TOURISM, ARTS AND CULTURAL AFFAIRS COUNCIL (MOPTACAC)

SECTION 11. THE MISAMIS OCCIDENTAL PROVINCIAL TOURISM, ARTS AND CULTURAL AFFAIRS COUNCIL (MOPTACAC). The Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council is hereby created. a) COMPOSITION. -The Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council shall be composed of the following:

a.1 Honorary Chairperson –The Provincial Governor;

a.2 Chairperson – to be elected by the Council Members during its first meeting, preferably coming from the Private Sector;

a.3 Honorary Vice- Chairperson –The Provincial Vice- Governor;

a.4 Vice-Chairperson – to be elected by the Council Members during its first meeting, preferably coming from the Public Sector

a.5 Provincial Treasurer

a.6 Members:

a.6.a The OPTACA Officer;

a.6.b Tourism Officers of the three (3) Cities and fourteen (14) municipalities in Misamis Occidental;

a.6.c Chairperson, Sangguniang Panlalawigan Committee on Tourism, Archeology, Antiquities & Cultural Heritage;

a.6.d Director/Chairperson, Protected Area Management Board;

a.6.e President, League of Mayors of Misamis Occidental;

a.6.f Representative from Accommodation Sector (Hotels, Lodging Houses, Inns, Homestay hosts, or similar group who is recommended by representatives from the establishments of Misamis Occidental and duly appointed by the Governor through an Executive Order and whose term shall not exceed three (3) years from the date of appointment;

a.6.g Representative from the Small, Medium Enterprise Development Council (SMEDC) of Mis. Occ. duly appointed by the Governor through an Executive Order and whose term shall not exceed three (3) years from the date of appointment;

a.6.h Representative of Travel Agents/Operators in Misamis Occidental duly appointed by the Governor through an Executive Order and whose term shall not exceed three (3) years from the date of appointment;

a.6.i Representative of the Media Association in Misamis Occidental duly appointed by the Governor through an Executive Order and whose term shall not exceed three (3) years from the date of appointment;

a.6.j Representative from the Provincial Environment and Natural Resources Office (PENRO);

a.6.k Subanen Council Chairperson with resolution endorsing the representation from the Subanen Council;

a.6.l Civil Society Organization representative selected by the CSOs,

a.6.m People’s Organization representative

a.6.n Representative from the Transportation Sector a.6.q Resource Persons: Representatives from the PNP, Philippine Army, Coast Guard, LTO, BFAR, DTI, Department of Environment and Natural Resources (DENR), and from NGAs with Tourism Programs in the Province.

b) DUTIES AND FUNCTIONS OF THE COUNCIL. The MISAMIS OCCIDENTAL PROVINCIAL TOURISM, ARTS AND CULTURAL AFFAIRS COUNCIL (MOPTACAC) shall:

b.1 Help identify, develop and promote potential tourism attractions; b.2 Extend technical assistance to all tourism-oriented and related establishments; b.3 Advocate for a responsible culture of tourism among stakeholders and tourists alike; b.4 Formulate sustainable tourism programs and projects for the communities; b.5 Create and promote awareness on the benefits of tourism through mixed media; b.6 Assist in monitoring compliance of the requirements of standards and regulations set by DOT, LGUs and other government agencies for the general welfare of tourists, visitors and community; b.7 Coordinate with the LGUs in the adoption and implementation of this Code; b.8 Formulate and recommend plans and policies on tourism development, including but not limited, to guidelines in declaring capitals and taglines by both government and private sectors; b.9 Initiate and encourage Private-Public Partnerships in implementing tourism development plans, programs and activities; and b.10 Advocate Event Tourism as core tourism activity in the Province.

c) PROCESS OF SELECTION. The Office of the Provincial Tourism, Arts and Cultural Affairs (OPTACA) shall initiate selection of representatives of various sectors to the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council. Representatives shall be selected by and from among the members of the sector concerned.

Only regular members can vote and be voted as officers of the Council.

The Council shall be assisted by the Secretariat as provided for in Section 17 hereof.

d) TERM OF OFFICE. Officers of the Council shall serve for three (3) years in accordance to the term of the Province’s government officials. The election of Officers shall be held every after three years to be held on the first week of June. The term of office of the new set of officers shall commence on the 1st of July of the same calendar year. e) MEMBERSHIP. The Council shall be recommendatory policy making body of the tourism industry in the Province.

It is composed of forty percent (40%) from government and public sector and sixty percent (60%) from private sector drawn mainly from the business sector. All associations/entities which directly represent various sectors/ elements of the tourism industry in the Province shall be encouraged to become members of the MOPTACAC. It shall provide general guidelines, framework and policies and direction of the tourism industry of the Province.

It may create committees as needed. f) SOURCES OF FUNDS. The funds of the Council shall come from:

f.1 Membership fees and/or dues approved by the members and the officers of the Council;

f.2 Grants and donations;

f.3 Proceeds of activities undertaken by the Council; and

f.4 Financial assistance through local legislation, as well as any other income that may be legally earned by the Council.

SECTION 12. THE EXECUTIVE COMMITTEE. The Executive Committee shall be composed of seven (7) members elected from the general membership of the Council. The composition shall be: five (5) members coming from the private sector and two (2) members shall come from the government sector.

a) The Executive Committee shall have the following functions: a.1 governing body of the Council in the implementation of policies and setting out strategic tourism-related objectives; and a.2 ensures the availability of adequate financial resources to activate and implement tourism-related activities.

b) MEETINGS AND QUORUM. The Executive Committee of the MOPTACAC shall meet once semi-annually. A simple majority (50% plus 1) of the officers present in any meeting called upon by the Executive Committee with prior written notice shall constitute a quorum. A general membership meeting shall be held at least once a year.

Special meetings can be called by the Chairperson of the Executive Committee as the need arises.

ARTICLE V THE OFFICE OF THE PROVINCIAL TOURISM, ARTS AND CULTURAL AFFAIRS

SECTION 13. OFFICE OF THE PROVINCIAL TOURSIM, ARTS AND CULTURAL AFFAIRS (OPTACA).The Office of the Provincial Tourism, Arts and Cultural Affairs (OPTACA) shall be institutionalized with the status of a Department.

OPTACA shall primarily be the implementing arm for the programs, policies and projects relating to tourism, culture, and arts including the marketing and promotions of the tourism industry in the Province. It shall pursue the development of the Misamis Occidental tourism industry in adherence to the provisions of this Code.

The Office shall be allocated with an annual budget from the General Fund of the Provincial Government of Misamis Occidental for personal services and operations of the office.

SECTION 14. DUTIES AND FUNCTIONS. OPTACA shall be responsible in the efficient and effective implementation of the policies, plans, and programs as recommended by the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council. Toward this end, OPTACA shall:

a) Initiate the crafting of the long-term, medium-term and short-term Provincial Tourism Plan;

b) Initiate and organize tourism-related, historical, and cultural activities;

c) Formulate, monitors, and coordinates integrated plans for tourism and culture and the arts;

d) Assist, monitor and facilitate accreditation of tourism-oriented and related facilities and service providers

e) Facilitate capability building for tourism providers and front liners;

f) Establish maintains and manages tourism information management system; g) Establish linkages and networking with national government agencies (NGAs),non-government organizations (NGOs) and people’s organizations (POs) in planning and implementing tourism activities;

h) Conduct inventory of existing, emerging and potential tourism attractions;

i) Promote and market Misamis Occidental as a tourist destination, regionally and globally, through exhibits, selling missions and the production of marketing collaterals;

j) Operate and maintain Provincial government-owned tourism facilities;

k) Represent the Province in tourism-related activities;

l) Advocate responsible culture of tourism;

m) Produce promotional and marketing collaterals for tourism. Establish linkages and alliances worldwide;

n) Conceptualize Tourism Events applicable in Misamis Occidental;

o) Conduct research and benchmark on best tourism practices of other LGUs, and;

p) Perform other functions related to tourism development.

(a) Promotions Section i. Creates publication in magazines, newspapers, pamphlets, flyers, billboards and online; ii. Broadcasts in radio and television network; iii. Conducts IECs; iv. Liaises with local operators, media, designers and printers; and v. Develops e-tourism platforms, including websites, social media advertising and constructs business database.

(b) External Relations Section

i. Establishes linkage and works with private sectors, business establishments, people’s organizations, academes and other agencies to promote tourism; and

ii. Encourages and facilitates the creation of a tourism association or similar group.

16.4 Education and Capacity Development Division. This division aims to provide capacity development in various disciplines of tourism development, management and promotion. Focused on tourism awareness, social economic and environmental impacts of tourism, tourism marketing, image development, implementation of tourism strategies and human resource development; and studies and best practices of tourism. (a) Capacity Development Section

i. Creates linkage with the Academe to establish partnership and support tourism and hospitality programs or courses; and

ii. Partners with tourism-related establishments in providing trainings, seminars and workshops related to the latest trends, strategies and updates on tourism.

SECTION 16. POSITIONS AND FUNCTIONS. OPTACA shall be headed by a Provincial Tourism Officer with a Department Head level (Salary Grade 26). He/ She has the following functions, to wit:

a) Formulates operational policies, plans, programs and projects for the development of the tourism industry of Misamis Occidental and in harmony with the Province’s Vision, Mission and Goals; b) Ensures the proper enforcement of tourism standards, laws, rules and regulations; c) Submits regular reports on status of tourism plans and programs, tourist arrivals, employment, occupancy rates, investment and tourist products, among others, to the Department of Tourism; d) Supervises the organizational staff in the performance of their tasks and functions; e) Advises and guides the Governor and other policy-makers in decisions affecting the tourism industry; f) Coordinates with the LGUs, the Department of Tourism, national government agencies, and non-government organizations in the development and promotion of tourism in the Province; and g) Others as may be outlined by future executive and/or legislative issuances.

The Office of the Provincial Tourism, Arts and Cultural Affairs (OPTACA) – Department shall have five (5) divisions, namely: Administrative Division; Planning and Product Development Division; Marketing and Promotions Division; Education and Capacity Development Division; and Arts and Cultural Affairs Division. It shall be staffed by the following, to wit: 16.1 Administrative Division. This division shall accelerate the bureaucratic processes in the Provincial Tourism Office and be responsible for the provision of effective and efficient administrative services and support to other divisions and shall be composed of the following sections: (a) Administrative Support

i. Take charge in ensuring the effective and efficient flow of information and correspondence in the office and in receiving, filing, safekeeping and disposing of communications;

ii. Responsible for asset and supply management; and

iii. General upkeep of the office premises.

(b) Human Resource

Responsible for the preparation of personnel compensation and management of personnel records.

(c) Finance i. Take charge in the procurement of office logistics and supplies and processing of payments; and ii. Responsible for the Office Financial Management and Annual Office Budget Preparation.

(d) Internal Control i. Ensures the smooth and legal functioning of the operations of the Office through the provision of effective and efficient advice and services in the areas of personnel management, human resource development, general services administration, information technology services, budgetary, financial and management services and including investigatory and advisory services; and ii. Ensures compliance with government laws, LCE’s executive/ administrative orders or from any regulating body.

16.2 P lanning and Product Development Division. This division shall sketch out plans on various tourism programs, projects and activities or enterprises that would ultimately bring forth a positive impact to the economic, socio-cultural, environmental and political dimension of a particular destination. Also, it shall identify and implement strategies to arrive at the objectives or direction of an organization and shall be composed of the following sections:

(a) Tourism Planning and Development Section i. Formulates tourism objectives, policies, plans and strategies that would promote and generate the following: i.1 An avenue for possible partnerships between LGUs or between LGUs and private sectors; i.2 Community participation; i.3 Destination’s exposure; and i.4 Benefits to the economy, environment, culture and community in terms of increase in employment, improvement of standard of living and conservation of natural resources. ii. Identifies, selects and develops a destination or a suitable and unique resort site by way of, but not limited to, engaging in site planning, landscaping, standard engineering design, health and safety; iii. Prepares action plans for the improvement of market accessibility and connectivity at the local and national level; iv. Determines and ensures the availability, development and sustainability of the following factors for an effective tourism planning and development: iv.1 Quality of tourism relevant data; iv.2 Tourism planning expertise; iv.3 The type and variety of tourism resource; iv.4 The culture of the destination residents; iv.5 Geographic location and spatial distribution of the tourism development units; iv.6 Target market; iv.7 Stage in the tourism area life-cycle; iv.8 Tourism development paradigm held by the influential actors in tourism development; iv.9 National tourism policy and legislation; iv.10 Perceptions and attitudes of stakeholders; iv.11 Awareness of external forces impinging on tourism planning and development; and iv.12 Financial capital requirement.

(b) Tourism Product Development Section

i. Recommends and facilitates the creation of tourism products such as attractions, activities, facilities, amenities, transport, service personnel and other organized events;

ii. Initiates collaboration, consultation and coordination with other LGUs, agencies, private sectors and people’s organizations pertaining to the destination’s development and delivery of tourism products; and

iii. Ensures and innovates the presence and sustainability of the tourist attractions, facilities and services offered, and its physical accessibility.

(c) Monitoring and Evaluation Section i. Develops M & E system with its objectives and works with the plan’s interventions and anticipated impacts on the economic, socio-cultural and environmental facets; ii. Supervises regular data collection and ensures data quality through verification and validation; iii. Coordinates with partners in conducting baseline surveys; iv. Designs, coordinates and conducts project or product evaluation and post implementation surveys; and v. Prepares and submits field/destination visit reports.

16.3 Marketing and Promotions Division. This division shall develop strategic marketing plans to promote tourism to a locality and develop programs for branding and advertising for domestic, national, and international exposure based on extensive research on market segmentation, matching and market mix. Likewise, it shall identify and communicate with actual and potential tourists to ensure and influence their needs, motivations, wishes, likes and dislikes on a particular destination. It shall also be composed of the following sections:

(b) Tourism Research Section

i. Explores on recent and latest updates on tourism strategies that can be useful and be applied in the Province; and

ii. Partners with tourism-related establishments in identifying gaps and challenges pertaining to tourism operations.

16.5 Arts and Cultural Affairs Division. This division shall take charge of the activities of the Province of Misamis Occidental pertaining to Arts and Culture. It shall take the lead in the undertakings and activities that aim to develop and preserve the Subanen culture, arts, and traditions. Likewise, it shall oversee the management and operations of the Provincial Historical and Cultural Art Gallery (PHCAG) “Museum”.

OPTACA, together with the MOPTACAC & the respective LGUs, shall establish a planning, monitoring & evaluation system in order to evaluate the economic, social and environmental impact of the tourism activity. They should cover all elements that are crucial to sustainability of the tourism resource in compliance with the provisions of this Code.

Monitoring and evaluation shall cover the following parameters/indicators:

Service quality and participation of local communities; Monitors the enforcement of standards and the collection of statistical data for tourism purposes; Monitors the implementation of provincial-funded tourism projects through the Provincial Project Monitoring Committee (PPMC); Conducts researches and studies; Disseminates all relevant data on tourism; Monitors and analyzes the socio-economic impact of tourism upon affected local communities to maximize the benefits of tourism throughout the Province and the affected local communities; and Assesses and mitigates the possible negative impacts of the tourism industry development.

SECTION 17. SECRETARIAT. OPTACA shall serve as Secretariat to the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council in all its activities & functions, and shall be manned by professional staff headed by the Provincial Tourism Officer.

ARTICLE VI INTER-GOVERNMENT RELATIONSHIP

SECTION 18. INTER-GOVERNMENT COORDINATION AND COOPERATION. The Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council shall be an instrument for inter-government coordination, communication and cooperation on tourism and related issues. It shall promote harmonious relationship between LGUs and government instrumentalities and facilitates open communication between them. It shall seek the assistance of appropriate government agencies in the implementation of its policies, projects and activities to attain its objectives.

SECTION 19. CONFLICT OF LAWS. In case of conflict among local government instrumentalities, the purpose, objectives and intent of the Tourism Code of Misamis Occidental shall prevail.

SECTION 20. LGU BUDGETS. Local Government Units shall regularly appropriate funds for programs and projects of the Local Tourism Councils subject to the availability of such funds.

SECTION 21. COORDINATION WITH LAW ENFORCEMENT. The LGUs and the Province shall closely coordinate with other law enforcement organizations for the special training of personnel assigned to tourism destinations and zones.

ARTICLE VII TOURISM RESOURCES

SECTION 22. INVENTORY, CLASSIFICATION AND ASSESSMENT OF RESOURCES. Tourism resources are any natural, cultural, human or capital resources that are being used or can be utilized to attract or serve tourists. The OPTACA, in coordination with the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council, shall periodically make an inventory to identify and classify the resources available that provide opportunities for tourism development.

The OPTACA shall periodically conduct an objective and realistic assessment of the quality and quantity of resources that can be used for tourism purposes.

SECTION 23. MONITORING OF TOURISM RESOURCES. The OPTACA, in partnership with other related agencies, shall likewise monitor all identified and classified tourism resources used for tourism purposes.

SECTION 24. CLASSIFICATION OF TOURISM DESTINATIONS. The OPTACA, in coordination with the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council and the respective LGUs, shall on an annual basis, classify tourism sites as destinations in accordance with DOT standards as existing, emerging and potential destinations.

SECTION 25. PRIORITIZED TOURISM DESTINATIONS. Tourism destinations that are given higher classification category shall be included among the priority for integrated promotion and marketing. The classification will guide tour operators and tourists the type of services offered by providers.

SECTION 26. INVESTMENT AND DEVELOPMENT. The Provincial Government of Misamis Occidental shall prioritize Tourism in its Investment Promotions activities as stated in the Investment Priority Areas of the Investment & Incentive Code of the Province. The OPTACA, in coordination with the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council, shall encourage LGUs to invest in and develop their respective tourist destinations. Tourism investment and development programs, projects and activities shall conform to the investment policies of the Province of Misamis Occidental.

SECTION 27. PROTECTION AND PRESERVATION. The OPTACA and the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council, in coordination with LGUs, shall ensure the protection and preservation of all tourism resources for its sustainability.

ARTICLE VIII TOURISM BUSINESS INVESTMENTS

SECTION 28. INVESTMENTS INCENTIVES. The Local Government Units (LGUs) in Misamis Occidental are hereby encouraged to invite and promote external and internal investments in Local Tourism by way of formulating laws and issuances that provide incentives to investments.

made by the Misamis Occidental Provincial Tourism, Arts and Cultural Affairs Council for endorsement to the Provincial Development Council, which shall then recommend these establishments to Tourism Infrastructure and Enterprise Zone Authority (TIEZA), after reviewing the features and purpose of the tourism enterprise zone intended to be developed pursuant to R.A 9593. Tourism Enterprise Zones shall be classified as follows: a) Cultural Heritage Tourism Zone – areas that will allow the tourist to experience the places, artifacts and activities that authentically represent the stories of the people living in the area, past or present. The area may include, but will not be limited to, cultural landscapes; historic sites, areas and precincts; ruins, archaeological and maritime sites; sites associated with industrial, scientific and agricultural heritage; collections that house or collectively promote objects of heritage significance; historic places and areas, including villages, small towns, cities and parts of larger urban areas with significant cultural and heritage assets; museums, art galleries, cultural centers, arts & crafts shops, and antique shops, and cultural sites. b) Health and Wellness Tourism Zone – areas that will allow visitors to avail of quality, but affordable mainstream, traditional, or alternative healthcare services for treatment of illnesses and health problems in order to maintain one’s health and well-being. The area may include, but will not be limited to, enterprises that are, or offer: medical and allied services; spas; health farms; counseling and rehabilitation services; and traditional Filipino touch therapy. c) Ecotourism Zone - areas that will allow visitors to experience a form of sustainable tourism within a given natural and/or cultural area where community participation, conservation and management of biodiversity, respect for culture and indigenous knowledge systems and practices, environmental education and ethics as well as economic benefits are fostered and pursued for the enrichment of host communities and satisfaction of visitors. The area may include, but will not be limited to: sites of scenic natural or rural beauty; areas for observing wildlife; areas for low impact activities such as camping, trekking, climbing, spelunking, diving, surfing, and other similar activities; and sites for observing and interacting with traditional or indigenous practices in relation to the environment. d) General Leisure Tourism Zone – areas that may offer recreational facilities that will have high visitor density. The area may include, but will not be limited to: golf parks/resorts; theme parks and amusement centers; convention and meeting centers; sports Complexes/Resorts; event centers/resorts; department stores/restaurants/shops; and zoos. e) Mixed-Use Tourism Zone – areas that will allow a combination of some or all of the features of the aforementioned zones within one area. Priority shall be given to the tourism enterprise zone to be created that conforms to the Comprehensive Land Use Plan of the cities and municipalities in the Province.

SECTION 30. CLASSIFICATION OF TOURISM ENTERPRISES.

a) Primary Tourism Enterprises which refer to facilities and services that are directly related to tourism such as, but not limited, to the following: a.1 travel and tour services; a.2 inbound travel agencies and tour operators, local tour operators, ecotour operators, and tour guides; a.3 tourist transport services whether for land, sea, and air transport exclusively or majority of its seats are for tourist use, including airport taxis and tourist drivers; a.4 accommodation establishments such as, but not limited to, hotels, resorts, apartment hotels, tourist inns, motels, pension houses, private homes used for homestay, eco-lodges, condotels, serviced apartments, and bed and breakfast facilities; a.5 hotel and tourism estate management services; a.6 meetings, incentives, conventions and exhibition organizers and facilities; a.7 Agri-tourism farms and facilities; a.8 Tourism training centers or institutes, including tourism trainers; outbound travel agencies; and other enterprises as may be identified by the OPTACA, in coordination with the MOPTACAC after due consultation with concerned sectors; a.9 sports and recreational facilities such as, but not limited to, dive shops, amusement parks, and adventure and ecotourism facilities; and a.10 foreign exchange dealers and such enterprises as may be identified by the OPTACA, in coordination with the MOPTACAC, after due consultation with concerned sectors.

b) Secondary Tourism Enterprises which refer to facilities and services that may be related to tourism such as, but not limited to, the following: b.1 Restaurants; b.2 Specialty shops and department stores; b.3 Sports facilities and recreational centers such as museums and galleries, theme parks, zoos; b.4 Health and wellness facilities such as, but not limited to, spas, tertiary hospitals, ambulatory clinics, and medical concierge; and b.5 Rest areas in gas stations;

SECTION 31. COMMUNITY AND SUBANEN TRIBE PARTICIPATION: SOCIAL ACCEPTABILITY, SUSTAINABLE & ETHICAL IMPLEMENTATION. The MOPTACAC through the OPTACA shall adopt a sustainable tourism development strategy in a participatory and inclusive manner by taking into consideration all stakeholders, including but not limited to, the LGU and Subanen Communities, in the identification, planning, development, management, and monitoring of LGU- or community-based tourism-related establishments, destinations, activities and facilities.

SECTION 32. SELF-REPORTING OF TOURISM ENTERPRISE. Tourism enterprises and businesses operating in the Province shall submit a monthly report of tourist arrivals for the immediately preceding month through their respective LGUs which shall collate and submit the same to the OPTACA within the first five days of the month. The OPTACA shall then collate the reports from the 17 LGUs and, in turn, forward the collated reports to the Provincial Governor, the MOPTACAC and to DOT 10 within the first ten days of the month.

SECTION 33. REGISTRATION, LICENSING, AND ACCREDITATION OF TOURISM ENTERPRISES AND BUSINESSES. The regulation, accreditation and standardization of tourism sites, activities and products and supervision of the tourism enterprises and businesses in the Province will strictly follow the accreditation standards of DOT. However, the OPTACA, in coordination with its counterparts in the different LGUs, will conduct massive campaign for registration, licensing and accreditation of tourism enterprises and businesses.

Regulation and supervision of tourism enterprises and businesses shall be the primary responsibilities of the respective LGUs, to wit:

To include in the “one-stop-shop” processing of the business permits the issuance of tourism clearance from the Local Tourism Office for tourism-related establishments, businesses, and facilities; To facilitate inspection on the tourism enterprises and businesses’ compliance by the LGU’s composite team to be made regularly as prescribed by each LGU, except on special cases; and To submit an annual report on the data related to the licensing, registration, and accreditation to the OPTACA.

The OPTACA shall assist in the issuance of certification to service providers adopting the accreditation standards set by the Department of Tourism (DOT) in the operation of tourism-related establishments and facilities concerned.

All tourism establishments, tourism service providers/activities in the Province shall be classified, accredited and registered with and in accordance with the pertinent Rules and Regulations promulgated by the Department of Tourism upon the recommendation of the LGUs.

SECTION 34. CONFIDENTIALITY, PRIVACY, AND SECURITY OF BUSINESS INFORMATION. Tourism enterprises and businesses’ information and documents filed by or with the municipal/city tourism office and OPTACA in pursuance with the requirements of this Code shall be treated as confidential and shall not be divulged to any private party without the consent of the party concerned when the public interest so requires. Any official or employee of the municipal/city tourism office and OPTACA, including those that are temporarily assigned therewith, who shall violate the provision of this Section shall be punished under Section 49 hereof.

ARTICLE IX PLANNING, IMPLEMENTATION, MONITORING AND EVALUATION SECTION 35. PROVINCIAL TOURISM MASTER PLAN. Pursuant to Proclamation No. 188, s. 1993, each LGU is required to formulate their Tourism Master Plan and shall be adopted and integrated in the Provincial Tourism Master Plan.

SECTION 36. MONITORING AND EVALUATION SYSTEM. There shall be an established monitoring and evaluation

system in order to evaluate the economic, social and environmental impact of the tourism programs, projects and activities.

The data shall cover all elements that are crucial to sustainability of the tourism resource in compliance with the provisions of this Code. Monitoring and evaluation indicators should include, but not limited to the following: service quality, participation of local communities and proper environmental management.

The OPTACA shall process tourism data from local government units (LGUs), to obtain quantitative/ statistical and qualitative information from the following sources:

a) Primary information from survey research on consumer behavior, motivation, satisfaction, studies of geographic segments, examining the image and destination brand perception, research needs, desires, attitudes and preferences of the client;

b) Primary information from workers in the tourism industry who are in constant contact with the target groups; and

c) Forecasts trends and research in other areas (e.g. economic or socio-economic, peace and order, weather, etc.).

ARTICLE X CAPACITY DEVELOPMENT SECTION 37. TRAINING AND CAPACITY DEVELOPMENT. The OPTACA shall develop a training and capacitybuilding program for implementers of tourism programs, projects, and activities, including but not limited to, tour guides, adventure sports guides, tourists police and front-line tourism personnel. The local tourism office shall coordinate with the government, whether local, national and international, and the private sector for this purpose.

The OPTACA shall coordinate with both government and private tourism entities to institutionalize tourism training programs, formal and informal, with corresponding certification upon completion.

The OPTACA shall create an environment for tourism investment, management and development where opportunities for cooperation between and among tourism enterprises towards a seamless tourism industry. Linkages and networking among tourism enterprises and organizations shall be encouraged and supported. The Province shall likewise initiate linkages and networking with other adjacent provinces and other local government units for tourism purposes.

The OPTACA shall partner with the Provincial Gender and Development Office and other related agencies in capacitating employees of tourism entities on Gender and Development information and programs in relation with the tourism industry and oversee any GAD-related concerns.

ARTICLE XI SPECIAL TOURISM EVENTS, ACTIVITIES & ZONES

SECTION 38. PROVINCIAL ANNIVERSARY & PAS’UNGKO S’G MIS. OCC. FESTIVAL. The Provincial Anniversary of Misamis Occidental is commemorated every 2nd day of November, but it is a month-long celebration with various activities such as the Pas’ungko S’g Mis. Occ. street dance parade and festival dance showdown, Trade Fairs, environment and mountaineering activities, agri-aqua day, and the like.

Pas’ungko S’g Mis. Occ. Festival is the official festival of the Province and is celebrated every 3rd Week of November.

It is a Subanen-based Festival competition which includes a dance showdown and street dancing among the participants representing the local government units (LGUs) of the Province showcasing the music, traditional costume, colorful props, and the different traditional practices of the Subanen Tribe (people of the river). The said Festival is accredited by the Department of Tourism (DOT) and is already included in the DOT list of major festivals in the country.

SECTION 39. PRESERVATION OF THE PROVINCIAL CAPITOL BUILDING. The Provincial Capitol Building was constructed on February to December 1935 and became the seat of the legislative power of the Province. The Building was designed by Architect Juan Arellano who also did the capitol building of the Provinces of Quezon, Negros Occidental and Cebu. The Provincial Government of Misamis Occidental is in pursuit to preserve the Capitol Building with utmost protection and conservation.

The OPTACA shall initiate and take measures so that the Provincial Capitol Building will be declared as a National Cultural Heritage of the Philippines by the National Commission for Culture and the Arts.

SECTION 40. FESTIVAL OF THE DIFFERENT LGUs. Each city and municipality in the Province shall be given the discretion to develop and promote their own festivals which shall be acknowledged by the PGMO through the Office of the Provincial Tourism, Arts and Cultural Affairs (OPTACA).

SECTION 41. HOLDING OF BEAUTY CONTESTS. Holding of beauty contests shall be in accordance with the GAD Code of the PGMO.

SECTION 42. GENDER-SENSITIVE TOURISM INFRASTRUCTURES. All tourism infrastructures must foster a genderresponsive environment to uphold safety amongst all tourism operation personnel (TOPs) and to help prevent sexual abuse and other forms of maltreatment in the workplace. This includes, but not limited to, safety and well-lighted structures and environment.

ARTICLE XIII PROMOTION AND SUPPORT OF SPECIFIC AREAS

SECTION 43. MT. MALINDANG RANGE NATURAL PARK. Mt. Malindang Range Natural Park is the 29th ASEAN Heritage Park and the home of the one and only native pride – Subanen Tribe. The protected area has a total land area of 53, 028 hectares with grassland, dipterocarp forest, lower montane forest, upland wetland, and mossy and associated forest. Many plant species are endemic and locally threatened with extinction including a rattan species and 10 dipterocarp species. Many forest dependent species such as sili-sili and kalingag are known for their high medicinal values. High value ornamentals include Medinilla spp., Cayote cuminggii and orchids. The Park is currently in the country’s list of extremely high conservation priority areas for plants. Other threatened species in the park include the Philippine Eagle, Philippine deer, Philippine tarsier, rufous hornbill, flying lemur and Mindanao warty pig. The Park is being managed by the Protected Area Management Board. It envisions in becoming a world class tourist destination offering a clean environment, unique culture, nature education and ethics sustainability managed by a resilient community. It aims to develop portions of the multiple use zones of Mt. Malindang Range Natural Park as an ecotourism site that will promote the preservation and conservation of its diverse natural resources, provide education and enjoyment to visitors and uphold inclusive growth that involves women, children, youth, indigenous peoples and other vulnerable groups.

the jurisdiction of the Province must adopt proper solid waste management as embodied in the Solid Waste Management Plan of every component LGU and the 10-Year Integrated Solid Waste Management Plan of the Province consistent with the provisions of Republic Act No. 9003 or the “Ecological Solid Waste Management Act”, and other existing environment laws.

In the implementation of the plan at the LGU level, solid waste management (SWM) shall begin with waste reduction at the community level. Reduction means reducing the amount of waste thrown away, save landfill space, save raw materials and natural resources such as energy and water, and save money.

a) Storage and segregation are inseparable to waste reduction. Storage refers to the interim containment of solid waste after generation and prior to collection for ultimate recovery or disposal. Segregation on the other hand, refers to solid waste management practice of separating different materials found in solid waste in order to promote recycling and reuse of resources and to reduce the volume of waste for collection and disposal as defined in RA 9003. Solid wastes shall be segregated and labeled with the following categories: “compostable,” “non-recyclable”, “recyclable”, or “special waste.” Color codes can be assigned to aid waste segregation in all tourism sites and tourism related-service facilities.

b) The second segment involves waste diversion by employing the 3R approach (reduce, re-use, recycle). At this stage, SWM will now redound to economic activities and income generation for families in the community. Further, this also ensures that segregated solid wastes do not remain unutilized in MRFs. Reusing is another way of decreasing the amount of waste you throw away, which in turn decreases the volume of waste destined for landfill.

In reusing a product, try and identify a long term use for the product.

c) The third stage includes proper solid waste disposal at sanitary landfills. LGUs are mandated under RA 9003 for the efficient management of residuals and of final disposal sites and/or any other related technologies for the destruction/ reuse of residuals. c.1 Biodegradable wastes that can be composted. c.2 Recyclable Wastes are solid waste materials which can be re-used or recycled such as, but not limited to, newspaper, ferrous scrap metal, non-ferrous scrap metal, corrugated cardboard, aluminum, Glass, office paper, tin cans

d) Residual wastes are solid waste materials that are non- compostable and non-recyclable. It should be disposed ecologically through a long term disposal facility or sanitary landfill. e) Special Wastes refers to household wastes such as, but not limited to, paints, thinners, household batteries, leadacid batteries, spray canisters, bulky wastes.

SECTION 47. Every tourism site to be developed shall be required to present a Solid Waste and Sewerage Management Plan as a requisite for business permits to be issued. The Solid Waste and Sewerage Management Plan shall be pursuant to Republic Act No. 9003, the Environment Code of Misamis Occidental and other existing environment laws.

ARTICLE XV SUPPLEMENTARY PROVISIONS

SECTION 48. NATIONAL LAWS, RULES, REGULATIONS AND ISSUANCES APPLICABILITY. In the adoption of all the provisions of this Code, reference shall always be made to the existing national laws more particularly on the acts of Congress, Presidential Decrees, and all rules and regulations appertaining to tourism. In case of conflict between the herein Code and national laws, Presidential Decrees, issuances, and rules and regulations, the latter law shall prevail without necessarily voiding the remaining provisions of this Code.

SECTION 49. PENAL PROVISIONS. Penal provisions provided for in specific tourism laws, rules, regulations are hereby adopted to protect the best interest of tourists, stakeholders, visitors and the general public.

SECTION 50. APPLICABILITY OF THE ENVIRONMENT CODE. Relevant provisions of the Environment Code of the Province to the Tourism Industry are hereby adopted to highlight the overriding importance of environment preservation and protection.

SECTION 44. MISAMIS OCCIDENTAL AQUAMARINE PARK. The Misamis Occidental Aquamarine Park (MOAP) is a provincial-managed tourism destination located in Libertad Bajo, Sinacaban, Misamis Occidental. It is a designated Wildlife Rescue and Rehabilitation Center of the Department of Environment and Natural Resources (DENR) and shall be developed and promoted to: (a) increase population in marine- aquaculture, (b) serve as the center for coastal resource management and protection and, (c) promote eco-tourism and generate income.

ARTICLE XV FUNDING REQUIREMENTS

SECTION 51. REGULAR BUDGETS. To ensure the development of tourism facilities, access roads and amenities, the local government units shall include in their annual budgets such estimated funding requirements as well as program, projects and activities for local tourism.

ONE MILLION AND FIVE HUNDRED THOUSAND PESOS (P 1,500,000.00) is hereby appropriated for the OPTACA to cover for the maintenance and other operating expenses.

SECTION 52. FUNDING SUPPORT FROM THE NATIONAL GOVERNMENT. Specific tourism projects may be undertaken with funding support from the National Government through representations made by the local government units.

The facilities in the park such as (a) Wildlife Park, (b) Ocean Grill Restaurant, (c) Hatcheries, fishponds, and fish cages, (d) Hotel and dormitories, and (e) the Ramiro Function Hall, along with other ongoing and future projects, shall be maintained and preserved to further attract tourists and generate revenue for the Province.

SECTION 45. BALIANGAO PROTECTED LANDSCAPE AND SEASCAPE. Baliangao Protected Landscape & Seascape (BPLS) was proclaimed as a protected area under the National Integrated Protected Areas System (NIPAS) by virtue of Presidential Proclamation No. 418 dated November 22, 2000 due to its biodiversity significance of a natural complex of mangrove, sea grass and coral ecosystems that are independent and shared mutual benefits in providing a habitat for a myriad of marine and coastal organisms. It is the 104th identified key biodiversity area in the Philippines and particularly a marine key biodiversity area due to the presence of Pavona decussate, cactus coral considered as trigger specie that can only be found in Baliangao.

ARTICLE XVI FINAL PROVISIONS

SECTION 53. IMPLEMENTING RULES AND REGULATIONS. The Implementing Rules and Regulations of this Code shall be issued by the Office of the Provincial Governor within one (1) month after its approval.

SECTION 54. SEPARABILITY CLAUSE. If, for any reason or reasons, any part or provision of this Code shall be declared invalid or unconstitutional, other parts or provisions hereof which are not affected thereby shall continue to be in full force and effect.

The Protected Area (PA) covers an area of 309.23 hectares(National Mapping and Resource Information Authority validated) having a landscape area of 114.96 hectares and 194.27 hectares of marine ecosystem with a mega-pascal area of 92 hectares. The PA is within the jurisdiction of Barangays Misom, Landing, Tugas & Sinian, Baliangao, Misamis Occidental, Region 10, Mindanao.

The Eco-tourism base products of the area ranges from the vast green and robust mangroves which lined up the coastlines and at Sinian River that are home to several waterbirds, seagrass meadows that landscape the shallow waters of the Marine Protected Area, the long and winding crystal clear Sinian River and the stone garden of coral reefs.

The ecotourism activities varies from the river cruising along Sinian River while listening to the tunes of the chirping water birds atop the mangrove species identification while trekking the Arboretum where mangrove trees were tagged for educational and research purposes; skin diving/snorkeling along the coral reef areas for a selfie shot underwater with the colorful aquarium fishes; boating along the mangrove coastlines using the glass-bottom boat; have fun riding the kayaks with your energy; and lastly, take a selfie shot at the life size ILOVEBPLS floating at the white sandbar.

To provide ease of access in BPLS and to have more fun in the area, eco-tourism facilities and amenities that you will enjoy in the area are as follows:

Act on Crimes Against International Humanitarian Law, Genocide and other Crimes against Humanity following the September 2013 stand-off in Zamboanga City between his followers and government troops that left 137 persons dead, 251 injured and 118,889 of the city’s 807,000 population displaced, according to the National Disaster Risk Reduction and Management Council’s October 2, 2013 report.

The Department of Justice (DOJ), the City of Zamboanga and the Office of the Presidential Adviser on the Peace Process (OPAPP) made no objections to Misuari’s October 2016 motion to the court.

In Misuari’s April 2017 motion, the DOJ and OPAPP again posed no objection.

The City of Zamboanga “failed to file its Comment/ Opposition after moving for time to file the same on 3 May 2017.”

The court noted that the peace process between the government and the MNLF “has yet to be terminated.”

In fact, there is no formal meeting as yet between the peace implementing panels of the government under Undersecretary Nabil Tan, and the MNLF headed by Randolph Parcasio. But they have held four informal meetings.

The cour t s aid t he OPAPP had manifested in its sixth monthly report to the court that after the four informal meetings, Misuari “sought the presence of no less than President Rodrigo Roa Duterte to discuss the envisioned new Bangsamoro entity, which was scheduled on the 1st and 2nd week of May.” The May meeting with the President did not push through. Tan and Parcasio told MindaNews that they are still awaiting the schedule from the Office of the President. The President is leaving for Russia on May 22 and will return to the country on May 26.

Misuari signed the December 23, 1976 Tripoli Agreement under the Marcos administration and the September 2, 1996 Final Peace Agreement under the Ramos administration.

His faction did not participate in the 21-member Bangsamoro Transition Commission (BTC) which

is tasked by the government and the Moro Islamic Liberation Front (MILF) to draft a Bangsamoro Basic Law (BBL).

The BTC is set to submit its draft law to the Office of the President on the first week of June, BTC chair Ghazali Jaafar had earlier told MindaNews.

The BBL would pave the way for the creation of the Bangsamoro, a new autonomous political entity that would replace the Autonomous Region in Muslim Mindanao (ARMM), in accordance with the Comprehensive Agreement on the Bangsamoro (CAB) that both parties signed on March 27, 2014.

The BTC under the Aquino administration had 15 members. The Duterte administration expanded the membership from 15 to 21 supposedly to “make it more inclusive” and ensure the participation of all the MNLF factions.

There are three representatives of the MNLF in the BTC, nominated by the MNLF faction under Muslimin Sema and Yusoph Jikiri.

So she decided to leave Surigao and to go to Cebu to find her place in the sun. “When I arrived in the big city, I was really struggling together with my ex-husband and our first child, because I could not get a job right away. I guess it’s because I didn’t have a college degree. I felt rejected, to say the least.

But that didn’t hinder her from soldiering on.

Rose remained optimistic and steadfast searching for a job, until, finally, one day, she was accepted into one of the largest realty property development companies in Cebu sometime in October of 2014, as a real estate specialist.

She barely had any knowhow of the industry under her belt.

“It was extremely challenging for me, because I had to sell a total of 4 million pesos in four months, and so I couldn’t help but ask myself whether I could make it considering the amount which seemed impossible to come up with,” the then neophyte real estate specialist and now a successful businesswoman recounts.

Given her inner talent and passion for work, Rose was able to hit beyond the quota. In her first few months of trying, she was able to sell more than a whopping 17 million worth of properties.

She shares, “Nothing is impossible with determination, perseverance, creativity, and prayer.”

Rose utilized her intelligence to the best of her ability in order to not just meet but also exceed expectations. She was an academic achiever back in the day, graduating as valedictorian from elementary school, not to mention receiving multiple awards. She was, in fact, the only recipient of the Outstanding Achievement Award on Entrepreneurship in the town of Gigaquit, a presidential award given by former president Gloria Macapagal-Arroyo.

Today, Rose takes pride in having materialized her dream, a three-storey building in Barangay San Isidro.

She spent at least 8 million pesos to realize her dream of putting up her own bakery and cafe.

“I chose this business not only because I’m fond of making flavorful repast, but also in order to provide

job opportunities for my town folks in Gigaquit,” she admits.

Rose could’ve set up the building in Surigao City, the capital of Surigao del Norte, but, according to her, nothing beats seeing her dream come true in a small town that witnessed her dreaming big and starting small.

Due to its location in the middle of the rice field, she has both heard and received comments as well as criticisms, to which our humble and noble friend said, “Just because the majority of the people in our town are poor doesn’t mean we cannot build something like this in our neighborhood.

This is a living proof of my testimony that nothing is impossible if we strive to reach the summit of our dreams and pray for God’s guidance.”

Thus, the three-storey Brewbakers Cafe and Bakery opened its doors to coffee lovers and bread buffs on May 13, 2017. It is located along the National Highway in Barangay San Isidro, the town of Gigaquit.

Rose, its proprietor, remains and will continue to remain humble despite this and more which she will reap, such as the fruits of her labor, in the future.

“Bragging about this or becoming haughty is not in my vocabulary. It never take me to better opportunities, more luck, especially more of God’s blessings in the long run. Instead, that will only bring me down, for blessings will only happen to the humble and not to the arrogant. Moreover, we should not limit ourselves to countless possibilities, because we’re all endowed with God-given capabilities to make our dreams come true. Everything will happen at the right time. It’s just that mine has happened, but then, that doesn’t mean I will rest on my laurels now. I will continue to work harder, so I will be able to help more people,” Rose explains.

Roy Pepino, a former US Navy residing in Gigaquit town, says of Rose: “She was my scholar. I supported her studies. And I liked this young girl because she would make sure to listen to my advices. So now, I am very proud of her for eventually becoming triumphant in her dreams and aspirations.”

House panel dismisses impeachment vs. Duterte

he House of Representatives’ justice committee has unanimously approved its committee report on the dismissal of the impeachment complaint against President Rodrigo Duterte last Monday.

A total of 17 lawmakers present during the hearing voted to approve the 15-page rep or t, which found the complaint filed

by Magdalo Rep. Gar y Alejano sufficient in form but insufficient in substance.

House justice committee chair Reynaldo Umali said this “formality” will effectively start the one year ban for any ouster try against the President.

“By unanimous vote, the committee report on resolution dismissing the verif ied complaint for

impeachment and supplemental complaint affidavit filed by Rep. Gary Alejano against President Rodrigo Duterte, effectively putting a one year ban on any and all impeachment complaints that may be filed against the president, is hereby approved unanimously,” Umali said.

According to the committee report, the complaint was insufficient in substance because the recital of facts was “all mere hearsay” after Alejano admitted that he had

no personal knowledge of the allegations he made in his complaint.

The committee report will be forwarded to the House plenar y for approval.

Th e House justice committee last Monday voted to reject the impeachment complaint lodged against President Duterte for insufficiency in substance with a total of 42 votes.

Globe (Philippines) and Telin (Indonesia) are major owners of SEA-US, a new cable that will link Indonesia and the Philippines to the USA via Guam and Hawaii, in partnership with GTA (Guam), Hawaiian Telecom (USA) and RTI (USA).

At a project cost of around USD250 million, the 14,000-kilometer cable system will consist of two fiber pairs with an initial design capacity of 20 terabits per second and will use the latest in submarine fiber-optic technology with 100 gigabits per second transmission equipment per pair. Such additional capacity will cater to the exponential growth of bandwidth between Southeast Asia and the United States.

Construction of the spur from Ngeremlengui state in Palau to the SEAUS cable to the north is well advanced, with the

modular Cable Landing Station expected to arrive at Koror this week. From there it will be transported by barge to the landing site for installation.

President Remengesau said: “I am delighted to see this milestone marked today. The submarine fiber network will be critical to so many aspects of our life in Palau, from healthcare to education, from social networking to business.

With the BSCC network expected to be in service before the end of the year, Palau is on the move.”

The Interconnection Agreements provide for five 100 Gigabit per second wavelengths to Guam, more than 1000 times the current capacity available in Palau, and will provide a big boost to businesses, schools, hospitals and clinics, government services, entertainment and social networking. The BSCC project is currently on schedule, and is expected to be in service in December 2017.

“The material allegations, kung hearsay lang, sasayangin mo lang ang panahon namin dito (if these are hearsays, then you are just wasting our time)” said Fariñas.

The majority leader warned that Alejano might face an ethics complaint and a perjury case because of his hearsay allegations.

“You are pro ducing statements under oath which are not your own, bawal po yan(This is unlawful),” Fariñas said.

“You are now coming to us and in fact i am warning you, you may be subjected to ethics case here,” he added. PNA

Globe, BSCC sign SEA-US Cable interconnection agreement in Guam

lobe Telecom and Belau Submarine Cable C orporation (BSCC) signed an agreement that would allow a submarine fiber optic cable spur currently under construction from the Republic of Palau to interconnect with the Southeast Asia-United States (SEA-US) cable for onward transport to Guam.

Globe was represented by its President and CEO Ernest Cu while George Rechucher, Chairman of BSCC, signed on behalf of the company. “We are excited about the commissioning of the SEAUS Cable because of its immense benefits to the Philippines. Additionally, we are proud to be able to provide the Republic of Palau with 1st world Internet connectivity through this interconnection agreement,” Cu said.

At the same, Lukner Weilbacher, FSM Secretary of the Department of Transportation, Communication & Infrastructure signed a similar agreement with the Chief Technology Officer of Telin, Pak Nanang Hendarno.
