Davao del Norte Rep. Antonio “Tonyboy” Floirendo Jr. was removed as a member of the powerful Commission on Appointments (CA) last Monday. Deputy Majority Leader Juan Pablo Bondoc made the announcement during Monday’s plenary session. Floirendo , representative of the PDP-Laban political party to the CA, was replaced by Isabela Rep. The disciples of Jesus hide in a locked room because of fears that they will be killed also like their master. Some of us are living in our individual dark room of life like: fears, anxieties, sufferings, trials, worries, depressions and frustrations. The worst of all this is, we are prisoners of our sins. The disciples became the prisoners of their fears. Imagine, how pitiful and painful to be a prisoner? Then why you allowed yourself to be free

outside but not in inside? Some of us are free physically but not internally. I am sure that some of you are prisoners in different problems in life. Some also are prisoners of your past. When Jesus appeared to them, they were encouraged to get out from their hiding place and not to be afraid from any one. Do not allow yourself to be coward because of the bad people around us. j) OPERATOR means a person or entity that manages a transport business but not necessarily a vehicle owner; k) STREET OR HIGHWAY refers to any national, city or Barangay road; l) GOVERNING BOARD refers to a multi-sectoral body created under Section 9 of the Act to effectively carry out and implement the air quality action plan of an airshed. SECTION 4. ENFORCEMENT The emission standards for enforcement of anti-smoke belching regulations shall be based on the current approved guideline values as provided for under the 1999 Clean Air Act.

ORDINANCE NO. 26, S. 2017

SECTION 5. APPREHENSION OF VEHICLE EXCEEDING EMISSION LIMITS

“AN ORDINANCE REGULATING ALL SMOKE BELCHING MOTOR VEHICLES PLYING AND TRAVERSING THE TERRITORIAL JURISDICTION OF TAGOLOAN, MISAMIS ORIENTAL AND PROVIDING PENALTY THEREOF.”

Section 4, Rule 35 of the 1999 Clean Air Act Implementing Rules and Regulations provides that in pursuance to Section 46 of the Act, the procedure for apprehension of motor vehicles which emit pollutants beyond the allowable limits is hereby adopted with minor revisions supplied as used in this Ordinance:

WHEREAS, the metropolitan areas and other densely populated cities in our country have already regulated smoke-belching vehicles from passing through the streets or highways thereof;

A vehicle suspected of violation of emission standards through visual observation is flagged down by the apprehending officer.

The apprehending officer conducts an emission test of the vehicle using portable emission testing equipment and using test procedures given in Annex B and Annex C of the Implementing Rules and Regulation of Republic Act 8749 (Clean Air Act of 1999), to determine whether the vehicle complies with the emission standards. Should the results show an exceedance of the emission limits, the computerized print-out or other test result generated by the portable emission testing equipment shall serve as prima facie evidence of violation of the standards.

Should the test result now that there is an exceedance of the standards, an Ordinance Violation Receipt (OVR) will be issued to the driver and a warrant of constructive or actual distraint to any owner of the motor vehicle as provided for under Republic Act 4136 (Transportation Code) shall commence unless the vehicle has been previously found violating the standards three (3) or more times within the last 365-days period. In the latter case, the motor vehicle registration shall be suspended for a period of one (1) year

d) One the vehicle meets the standards, the Tagoloan deputized LGU Testing Center shall issue a Certificate of Emission Compliance (CEC) to the driver or operator of the vehicle upon payment of clearance fee and the appropriate fines imposed.

f) Previously apprehended vehicles flagged down for the second time within the seven (7) days grace period and found to have not conducted vehicle repairs and emission retest shall be considered Second Offense.

g) In the event that the apprehended vehicle/s failed to report for retesting to LTO-deputized Testing Center within fifteen (15) days, the plate number, name of operator and other relevant information of the vehicle shall be reported to LTO for system alarm.

i) If a motor vehicle was previously issued CEC by Private Emission Center and found turning the actual apprehension apprehending team that the emission failed Emission Test the apprehending team shall confiscate/ revoke the CEC issued and he shall further training and Emission testing until the vehicle passes test, then the CEC will re-issuance.

WHEREAS, the number of unregulated smoke belching vehicles plying the Municipality of Tagoloan has remarkably increased; WHEREAS, the operation of these smoke-belching vehicles poses a grave threat to the health and safety of the general public; WHEREAS, in order to protect the health and safety of the people, there is a need to enact an Ordinance in accordance with the provision of the 1999 Clean Air Act; NOW THEREFORE, after proper deliberation on the matter and on motion of Councilor Felipe C. Valdehuesa Jr., duly seconded by Councilor Roger S. Achas, it was resolved as the body does hereby, RESOLVED, to enact as the body does hereby enact the following Ordinance: ORDINANCE NO. 26, S. 2017 “AN ORDINANCE REGULATING ALL SMOKE BELCHING MOTOR VEHICLES PLYING AND TRAVERSING THE TERRITORIAL JURISDICTION OF TAGOLOAN, MISAMIS ORIENTAL AND PROVIDING PENALTY THEREOF.” BE IT ORDAINED by the Sangguniang Bayan of Tagoloan, Misamis Oriental, that: SECTION 1. This Ordinance shall be known as the ANTI-SMOKE BELCHING ORDINANCE OF 2017 SECTION 2. ADMINISTRATION The municipal environmental unit shall administer the implementation enforcement of this Ordinance. It shall conduct mobile emission testing anywhere within the territorial jurisdiction of the Municipality of Tagoloan and apprehend vehicle found out not in compliance with the emission standards set in the 1999 Clean Air Act as espoused in this Ordinance and may subject them to emission control test. SECTION 3. DEFINITON OF TERMS. As used in this Ordinance with reference to the 1999 Clean Air Act. a) SMOKE–BELCHING refers to the excessive emission of black or dark and thick smoke from any motor vehicle arising from wherever cause or reason; b) EMISSION means any measurable air contaminant, pollutant, gas stream or unwanted sound from a known source which is passed into the atmosphere; c) EMF means Environmental Management Fund; d) LTO means the Land Transportation Office e) CERTIFICATE OF EMISSION COMPLAINCE refers to a certificate issued by the LTO or its deputized LGU Emission Testing Center for a vehicle apprehended during roadside inspection, certifying that the particular vehicle meets the emission requirements of the Clean Air Act Implementing Rules

Apprehended vehicle/s that failed to meet the emission standard and issued with OVR is given not more than seven (7) working days for conduct of repairs or overhauling and emission retest to LTO – deputized Testing Center or Private Emission Testing Center

Temporary Operator Permit (TOP) sanctioned by the LTO, shall be issued to apprehended motor vehicle driver/operator or violation(s) other than smoke belching.

SECTION 5.1 – RESPONSIBILITIES

5.1.1 The main responsibility of the Apprehending Team is to ensure that vehicles comply with the emission standards set forth under this Ordinance. The Team shall compose the following:

To ensure continuity of activities and financial concerns under this Ordinance, an Environmental Management Fund (EMF) is hereby established subject to standard accounting and auditing procedures. The fund shall be sourced from the proceeds of fines, penalties, testing fees, grants and donation from donors the accrued amount of which shall be solely disbursed for the following:

5.1.2 The TEAM LEADER shall ensure that the team members properly execute the apprehension procedure.

5.1.3 The designated APPREHENDING OFFICER issues the Ticket to drivers of apprehended vehicles.

5.1.4 SPOTTER(s) identifies, through visual means, smoke-belching vehicles and relays information to the flaggers and apprehending officers of the team. 5.1.5 FLAGGERS(s) motion the drivers of smoke-belching vehicle to pull over the roadside. SECTION 5.2 – EXECUTION STRATEGY 5.2.1 The SPOTTER shall position himself about 50 to 100 meters away from the apprehension team and spot and identify the smoke belching vehicle. He informs the TEAM LEADER the description of the spotted smoke-belching vehicle through pre-arranged signals or through the use of radio communication device or its equivalent.

5.2.2 The TEAM LEADER orders the FLAGGERS to flag down the reported smoke-belching vehicle.

5.2.3 The FLAGGER motions the driver of the smoke-belching vehicle to pull over at the outer most lane of the road near the sidewalk. 5.2.4 The APPREHENDING OFFICER identifies himself to the driver and informs him that his vehicle is being stopped because it is visually emitting smoke and, therefore, must be tested for smoke emission. Then, he will request to driver to show a copy of the Vehicle OR and CR and his driver’s license for authenticity verification purposes.

5.2.5 While the APPREHENDING OFFICER verifies the documents, the MACHINE OPERATOR boards the vehicle (for public utility vehicles) and informs the passengers that the Team is conducting smoke-belching test in accordance with the provision of the Clean Air Act.

5.2.6 The TESTING TEAM (Machine Operator and Prober) immediately conducts smoke emission test in accordance with the work instruction for Smoke Emission Test in motorized vehicle.

5.2.7 The MACHINE OPERATOR submits the test result to the APPREHENDING OFFICER and informs the latter whether or not the vehicle passed the test. If the result shows that the vehicle passed the test, the APPREHENDING OFFICER returns all documents requested earlier and releases the vehicle. 5.2.8 If test result shows that the vehicle failed to pass the allowable limit then the APPREHENDING OFFICER issues a Ticket to the driver. He records all test results whether the offense is the first, the second, etc. of the vehicle. He explains to the driver to take possession of the vehicle for purposes of undertaking the needed repairs.

SECTION 5.3 – CUSTODY OF RECORDS At the end of the roadside operation, the MANCHINE OPERATOR shall turn over the smoke emission testing equipment and all vehicle information including the test result to the Office of (City or Municipal Environmental Unit) for safekeeping. SECTION 6. FINES AND PENALTIES FOR VIOLATION OF STANDARDS FOR MOTOR VEHICLES As provided for in Rule LV under the Clean Air Act, the driver and operator of the apprehended vehicle found to have exceeded the emission standards shall suffer the following penalties;

(a) First offense

A fine in the amount of Two Hundred Pesos (Php 200.00);

(b) Second offense

A fine in the amount of Five Hundred Pesos (Php 500.00);

A fine in the amount of One Thousand Pesos (Php 1,000.00) and the offender must undergo a seminar on pollution control and management conducted by the LTO.

In case the third offense was committed within a year from the commission of the first offense, an additional penalty of suspension of the Motor Vehicle Registration (MVR) for a period of six months to one (1) year shall be imposed. SECTION 7. No apprehended motor vehicle shall be accepted for registration by the Land Transportation Office without first presenting the Certificate of Emission Compliance duly issued by the Municipality of Tagoloan Anti-Smoking Belching Team as a deputized government entity by LTO pursuant to Section 3 Rule 35 of the 1999 Clean Air Act implementing Rules and Regulations. SECTION 8. ENVIRONMNETAL MANAGEMENT FUND (EMF)

a) Eighty percent (80%) shall be allocated for the operational expenses of the Anti-Smoke Belching Team, purchase of necessary smoke-testing equipment, personal protective equipment (PPE) handheld radios or its equivalent and ambient air monitoring equipment;

b) Ten percent (10%) shall be allocated for the incentives or designated members of Anti-Smoke Belching Team;

c) Ten percent (10%) shall be allocated for the operational expenses of the Airshed Governing Board.

SECTION 9. GRANTS AND DONATIONS. Any amount coming from grants and donations supporting this Ordinance shall form part of the EMF. SECTION 10. EFFECTIVITY. This Ordinance shall take effect upon its approval. SECTION 11. REPEALING CLAUSE. Any Ordinance, Resolution or Administrative Order or parts thereof inconsistent with the provisions of this Ordinance are hereby modifies or repealed.
